Chairman’s Pen

My dear fellow exporters,

The Council has submitted its Pre-Budget Memorandum to the Department of Commerce,

Ministry of Commerce & Industry, Government of India and the DGFT for the next fiscal (2009-

10). The suggestions are made on the basis of the representations received from our members

from all over the country. With respect to Direct Tax suggestions, we have requested for abolition

of Fringe Benefit Tax (FBT) on all export promotion related expenses to be exempted under Section

115WB(2)(c), 115WB(2)(d)(ii) for exporters. We have also requested for removal of FBT for

exempting the cost of participation by exporters in any overseas fairs, exhibitions, business

delegation, foreign delegation etc. The other significant suggestion with respect to Direct Tax is

to extend the due date for payment of TDS from the 7th to the 15th of the next month. With respect

to Central Excise, we have suggested that there should be a change in procedure for availing

CENVAT Credit by a direct Exemption System for manufacturing concern. For this, the Council

has suggested that procurement of raw material by manufacturer exporters, who are registered

with Central Excise and are members of EEPC should be allowed to procure raw materials under

bond/undertaking. This will reduce the transaction cost for both the exporters and the Government,

but also act as an incentive for SSI unit to register with Central Excise Authorities.

This apart, we have asked for an Exemption System for all Service Taxes at the post production

stage of export of goods. Enhancing the SSI exemption limit from Rs. 1.50 crore to Rs. 2.50 crore

has also been suggested by the Council.

We have also suggested that more powers to be given to Settlement Commission by including

Drawback and Service Tax cases to be brought under the Settlement Commission.

Preamble

In order to have its first-ever foothold into the one of the most upcoming industrial nations in the world, EEPC is pleasedto announce its forthcoming INDEE at Shanghai, China scheduled to take place at Shanghai New International ExpoCentre (SNIEC), Shanghai, China during 4-8 November, 2008. This INDEE is being coincided with Metalworking & CNCMachine Tool Show which is the concurrent Show covered under China International Industry Fair 2008 that is consideredto be one of the major events in China visited by business community not restricting within South East Asia and Asia-Pacific but all over the world.

CIIF 2008 is being organized by Shanghai World Expo (Group) Co., Ltd., in association with Hannover-Messe InternationalGmbH & Hannover Fair Shanghai Ltd., and co-organized by China Machinery Industry Federation. The event issupported by various departments of Government of China such as �

The People's Republic of China has the second largest economy in the world after the US with a GDP of over US$ 7 trillion (2007)when measured on a purchasing power parity (PPP) basis. In November 2007, it became the third largest in the world afterthe US and Japan with a nominal GDP of US$ 3.42 trillion (2007) when measured in exchange-rate terms. China has been

the fastest-growing major nation for the past quarter of a century with an average annual GDP growth rate above 10%. China'sper capita income has grown at an average annual rate of more than 8% over the last three decades drastically reducingpoverty. The country's per capita income is at about US$ 2,000 at nominal exchange rates and US$ 7,800 in PPP terms in2006, according to the IMF.

The country is one of the world's largest producers of a number of industrial and mineral products, including cotton cloth,tungsten, and antimony, and is an important producer of cotton yarn, coal, crude oil, and a number of other products. Itsmineral resources are probably among the richest in the world but are only partially developed. China has acquired somehighly sophisticated production facilities through trade and also has built a number of advanced engineering plants capableof manufacturing an increasing range of sophisticated equipment, including satellites.

Industry and construction account for about 48% of China's GDP. Around 8% of the total manufacturing output in the worldcomes from China itself. China ranks third worldwide in industrial output. Major industries include mining and ore processing;iron and steel; aluminum; coal; machinery; armaments; textiles and apparel; petroleum; cement; chemical; fertilizers; foodprocessing; automobiles and other transportation equipment including rail cars and locomotives, ships, and aircraft; consumerproducts including footwear, toys, and electronics; telecommu-nications and information technology. China has become apreferred destination for the relocation of global manufacturing facilities. Its strength as an export platform has contributedto incomes and employment in China. The state-owned sector still accounts for about 40% of GDP. In recent years,authorities have been giving greater attention to the management of state assets - both in the financial market as well asamong state-owned-enterprises - and progress has been noteworthy.

India-China Bilateral Trade and the emerging opportunities

Trade relations between the two countries have been on the increase. At present the balance of trade is in favour of China.India�s exports to China were to the tune of US$ 8,287.48 million in the year 2006-07 and imports from China to India wasUS$ 17,447.01 million. Thus the total trade was US$ 25,734.49 million.

Engineering goods scope in China

China ranks first as an importer of engineering goods and machinery in the world with imports in this category reachingUS$ 335.30 billion in 2007. China mainly imports machinery and engineer-ng goods from Europe, Japan, South Korea andTaiwan. In 2007, to meet the demand of machine tools, China imported products worth US$ 9.72 billion. Indian engineeringindustry is yet to tap this market largely on account of lack of understanding about Indian engineering industry in China.

China today is also a major importer of machinery items. There are niche areas where we can promote our exports to meetChinese demand. Many Chinese companies are interested to source vendors and parts from India either for projects inChina or for projects in third countries. Products that are looked to be sourced from India are :

Pressure Vessels, Pressure Vessels Internals, Air Coolers, Heat Exchangers, Storage Tanks, Furnaces, Boilers, CoolingTowers, Pumps, Compressors and Boilers, Agitators and Mixers, Fans, Turbines, Gears, Electric Motors, Valves, Pipes,Fittings, Flanges and Ring Joints, Transmitters and Converters, Control Room Instruments, Control Valves, Safety Valves,Instrument Cables and Tubes, Electric Cables, Transformers, Medium Voltage Panels, Low Voltage Panels.

Share of Small and Medium Industries in total exports is also growing at a steady rate. Out of the above mentioned items thereare various items manufactured by Indian small and medium industries that have good export potential for the Chinese market.

The in-built booth of minimum 9 sq. mtr. shall contain -

1 Round Table, 3 Chairs, 1 Waste Bin, 3 Spot Lights, Fascia, one 10 Amp. Electrical Socket, Wall-to-Wall Carpet. Foradditional furniture and other requirements, prior intimation has to be made to the Council against payment.

Larger booths in multiple of 3 sq. mtr. are also available.

Participation Charges

One side open booth : Euro 200 per sq. mtr. or Indian Rs. 14,000/- per sq. mtr.+ Rs. 1,730/- per sq. mtr. as deposit towards Service Tax.

Two sides open booth : Euro 240 per sq. mtr. or Indian Rs. 16,800/- per sq. mtr.+ Rs. 2,076/- per sq. mtr. as deposit towards Service Tax.

Early Bird Rates

One side open booth : Euro 180 per sq. mtr. or Indian Rs. 12,600/- per sq. mtr.+ Rs. 1,557/- per sq. mtr. as deposit towards Service Tax.

Two sides open booth : Euro 216 per sq. mtr. or Indian Rs. 15,120/- per sq. mtr.+ Rs. 1869/- per sq. mtr. as deposit towards Service Tax.

(a) Early bird rates are applicable to those who will confirm their bookings on or before 15th September, 2008.

(b) Participants of INDEE - Kuala Lumpur will get 5% discount over and above the subsidized rates stated above.

Note : In case Service Tax is not chargeable, the deposit would be returned to participants.

If participants make payments in Euros, Service Tax is not applicable.

Due to limited availability of corner booths, allocation will be done on first-come-first-served basis subject to receiving fullpayment.

Payment & Cancellation

Full payment should be made along with Application Form, duly filled in latest by 30th September, 2008. The payment

should be made by way of Demand Draft drawn in favour of �Engineering Export Promotion Council�.

Booking of space will be considered only after receiving 100% payment. 50% cancellation charges applicable if reservation

is cancelled before 30th September, 2008. Any cancellation after this date would result in 100% forfeiture. Acceptance ofapplication and allocation of space will be at the sole discretion of the Council.

Shipment of Exhibits

In order to facilitate shipment of exhibits, Council will appoint a Shipping Agent.

Selection Criteria

Final selection of the participants will be done by a Committee based on the criteria such as Accreditation to the InternationalStandards (like ISO, QS, etc.), foreign collaboration, annual exports etc.

Travel and Hotel Accommodation

Council will assist participants in locating suitable airlines and hotels at Shanghai at negotiated rates through accreditedTravel Agents. However, participants are free to make their own travel/hotel arrangements.

Visa

Council will issue recommendation letters in favour of the representatives of the participating Indian companies in INDEEfor issuance of Visa for the Show. However, EEPC will not give any guarantee to this effect, as this is the sole discretionof the Embassy of China in India.

MDA Grant

This project is under Market Access Initiative (MAI) Scheme of the Government of India. Therefore, the cost of participationis highly subsidized. In fact, the cost of direct participation is Euro 280 per sq. mtr. However, no separate subsidy underMDA is available for this event.

The Council is pleased to inform that a Multi-Product Trade Delegation will be visiting Australia, New Zealand & Indonesiaduring 23rd November - 3rd December, 2008.

Australia�s Economy

Australia is currently the world�s 14th largest economy by nominal GDP, with a size of $ 889 billion in 2007. The total exportsto Australia from India was US$ 924.05 mn out of India�s total export of US$ 126262 mn. The export of engineering items fromIndia in the financial year of 2006-07 was US$ 226.17 mn, while in 2007-08 was US$ 365.61 mn The items constituted ofMachinery & instruments, Transport equipment, Primary & semi-finished iron & steel, Iron & steel bar/rods etc.

The main export partners are Japan, China, South Korea, US and India, and the main import partners are US, China,Japan, Singapore, and Germany. While traditionally tied to Europe and US, Australia is now dependent on Asia for itseconomic well-being, which will give India the scope to survey the untapped opportunities to export engineering items.

New Zealand�s Economy

New Zealand has a modern, prosperous, developed economy with an estimated nominal gross domestic product (GDP) ofUS$ 128.1 billion (as of 2008). The manufactured products such as mechanical and electrical machinery, vehicles and textilesmake up for almost three-quarters of all imports to New Zealand. In 2007-08 total imports from India in the engineering sectorwhich included mostly of machinery & instruments, manufactures of metals, primary & semi-finished iron & steel etc. wasUS$ 40.23 mn which was around US$ 16.51 mn more than 2006-07 out of the total export from India of US$ 502.97 mn in2006-07.

Indonesia�s Economy

Indonesia, one of Southeast Asia's biggest economy, has a market-based economy in which the government plays asignificant role. Indonesia�s full-year growth for 2007 clocked in at 6.32 per cent, the fastest rate in the last 11 years. Indiatotal exports to Indonesia accounted for about US$ 2026.5 mn, where export of engineering items from India registered agrowth of US$ 192.03 mn over the last fiscal and stood at around US$ 606.45 mn in 2007-08.

Registration and Participation Charges

Rs. 55000/- (plus Rs. 6798/- as Service Tax) per participant will be charged to partially cover the expenses on providing followingfacilities to the participants :

Other individual expenses like hotel charges, food expenses (other than the one lunch provided by the Council at eachcentre on the day of BSM), transport charges for factory visits (if delegate arranges) will have to be borne by the delegates.

Please note that Service Tax of Rs. 6798/- (12.36%on Rs. 55000/-) will be charged on the participation fees. In caseService Tax is not chargeable, the deposit would be returned to participants.

MDA Entitlement

Participants will be eligible to & fro air passage in economy excursion class up to Rs. 70000/- only as per revised MDAguidelines. Only one person per company will be entitled.

Selection Criteria

In view of limitations on number of participants (15 only) selection of participants will be done on first-come-first-serve basisand finally it will be decided by a Committee based on the criteria such as accredition to the international standards, ISO,QS etc, foreign collaboration, annual export etc.

Construction of Kazakh section of a gas pipeline to China with the capacity of 30bn cubic meter a year started in Almatyregion. The construction work is being carried out by KazStroyService company and China Petroleum Pipeline EngineeringCorporation. SARIO Facilitated Foreign Investment Flows of �240.3 million in 1H08

The Slovak Trade and Investment Development Agency (SARIO) was involved in 22 investment projects that were

completed in the first six months of 2008, facilitating a flow of foreign direct investments worth �240.3 million (Sk7.24billion) and the creation of 3,191 new jobs (which could rise to 3,331).

Most projects were in chemicals, rubber and plastics production, and in the car, engineering and electrotechnical industries.

SARIO is working on 131 registered investment projects at various stages of development at the moment. The highest

number is from Germany (24), followed by the U.S.A. (13), Great Britain (10), and Belgium (7).

EC Recommended Extra Safety Measures for Mochovce Nuclear Plant

The European Commission recommended that additional safety measures should be introduced for the construction ofreactor blocks three and four at the Mochovce nuclear power plant (Nitra region). E.C. said that extensive discussionswith the plant�s operator led to the conclusion that if the recommendations were put into practice, the completion of theplant would be in accordance with European legislation. It was proposed that the plant�s reactors should have a full-fledgedprotective jacket, as is normal for European nuclear power plants.

In exercise of powers conferred under paragraph 2.4 of the Foreign Trade Policy 2004-09, the Director General of Foreign

Trade hereby notifies the following amendment in the Handbook of Procedures (Vol. I) :

2. The following new paragraph shall be added in Handbook of Procedures Vol. I :

Para 2.37A : Import authorizations for a restricted item if so directed by the competent authority, shall be issued for

import through one of the sea ports or air ports or ICDs or LCS, as per the option indicated, in writing, by the applicant.

Authorization holder shall register the same at the port specified in the authorization and thereafter all imports against

said authorization shall be made only through that port, unless the authorization holder obtains permission from customs

authority concerned to import through any other specified port.

G.S.R.(E).-Whereas, the designated authority vide Notification No. 15/2/2008-DGAD, dated the 31st March, 2008, published

in Part I, Section 1 of the Gazette of India, Extraordinary, dated the 1st April, 2008, had initiated review, in terms of Sub-

Section (5) of Section 9A of the Customs Tariff Act, 1975 (51 of 1975) read with rule 23 of the Customs Tariff (Identification,

Assessment and Collection of Anti-dumping Duty on Dumped Articles and for Determination of Injury) Rules, 1995, in the

matter of continuation of anti-dumping duty imposed on steel and fibre glass tapes and their parts and components (hereinafter

referred to as the subject goods) originating in or exported from the People�s Republic of China vide Notification of the

Government of India in the Ministry of Finance (Department of Revenue), No. 147/2003-Customs, dated the 7th October,

2003, published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-Section (i) vide number GSR 793(E), dated the

7th October, 2003;

And whereas the Central Government had extended anti-dumping duty on the subject goods by six months vide Notification

of the Government of India in the Ministry of Finance (Department of Revenue), No.50/2008-Customs, dated the 21st April,

2008 published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-Section (i) vide number GSR 296(E), dated the

21st April, 2008;

And whereas the designated authority has requested for further extension of anti-dumping duty by six months, pending

completion of the review investigations;

Now, therefore, in exercise of the powers conferred by Sub-Sections (1) and (5) of Section 9A of the said Tariff Act read with

rule 23 of the Customs Tariff (Identification, Assessment and Collection of Anti-dumping Duty on Dumped Articles and for

Determination of Injury) Rules, 1995, the Central Government hereby makes the following further amendment in the Notification

of the Government of India, in the Ministry of Finance (Department of Revenue), No. 147/2003-Customs, dated the 7th

October, 2003, namely : -

In the said Notification, for the paragraph 3, the following paragraph shall be substituted, namely :-

�3. The anti-dumping duty imposed under this Notification shall be effective up to and inclusive of the 3rd day of April, 2009.�

Overseas Investment � Rationalisation

Attention of the Authorised Dealer Category - I (AD Category - I) banks is invited to Notification No.FEMA120/RB-2004dated 7th July, 2004 [Foreign Exchange Management (Transfer or Issue of any Foreign Security) Regulations, 2004] (theNotification), as amended from time to time.

2. In terms of Regulation 15 of the Notification ibid, an Indian party which has acquired foreign security in terms ofRegulations in Part I of the Notification shall receive share certificates or any other document as an evidence of investmentin the foreign entity to the satisfaction of the Reserve Bank within six months, or such further period as Reserve Bank maypermit, from the date of effecting remittance or the date on which the amount to be capitalised became due to the IndianParty or the date on which the amount due was allowed to be capitalised. The documentary evidence of investment isrequired to be submitted to the Regional Office concerned of Reserve Bank.

3. With a view to further simplifying the procedure, it has been decided that, henceforth, such share certificates or anyother document as an evidence of investment in the foreign entity should not to be submitted to the Reserve Bank. Theshare certificates or any other document as evidence of investment where share certificates are not issued shall, henceforth,be submitted to and retained by the designated AD Category � I bank, who would be required to monitor the receipt of suchdocuments and satisfy themselves about the bonafides of the documents so received. A certificate to this effect should besubmitted by the designated AD Category � I bank to the Reserve Bank along with the APR (Part III of Form ODI) asannexed to AP (Dir Series) Circular No 68 dated June 1, 2007.

4. AD Category - I banks may bring the contents of this Circular to the notice of their constituents and customers concerned.

5. The directions contained in this Circular have been issued under Sections 10(4) and 11(1) of the Foreign ExchangeManagement Act, 1999 (42 of 1999) and is without prejudice to permissions/approvals, if any, required under any other law.

Foreign Exchange Management Act, 1999 � Advance Remittances for Import of Services

Attention of all Authorized Dealer Category � I (AD Category � I) banks is invited to paragraph 3 of A. P.(DIR Series)Circular No.65 dated January 6, 2003, in terms of which AD Category � I banks are required to obtain a guarantee from abank of international repute situated outside India or a guarantee from an AD Category � I bank in India, if such a guaranteeis issued against the counter guarantee of a bank of international repute situated outside India for advance remittancesexceeding USD 100,000 or its equivalent for import of services into India.

2. With a view to liberalizing the procedure further, it has been decided to raise the limit of USD 100,000 for advanceremittance for all admissible current account transactions for import of services without bank guarantee to USD 500,000 orits equivalent. AD Category � I banks may frame their own guidelines to deal with such cases as per the policy approvedby the bank�s Board of Directors.

3. Where the amount of advance exceeds USD 500,000 or its equivalent, a guarantee from a bank of international reputesituated outside India, or a guarantee from an AD Category � I bank in India, if such a guarantee is issued against thecounter-guarantee of a bank of international repute situated outside India, should be obtained from the overseas beneficiary.

4. AD Category � I banks should also follow-up to ensure that the beneficiary of the advance remittance fulfils his obligationunder the contract or agreement with the remitter in India, failing which, the amount should be repatriated to India.

5. AD Category � I banks may bring the contents of the Circular to the notice of their constituents and customers concerned.

6. The directions contained in this Circular have been issued under Section 10(4) and Section 11(1) of the Foreign ExchangeManagement Act, 1999 (42 of 1999) and is without prejudice to permissions/approvals, if any, required under any other law.

Exim Bank Extends US$ 25 MN LOC to Ghana

Export-Import Bank of India (Exim Bank) has, at the behest of Government of India, extended a Line of Credit (LOC) of US$ 25

million to the Government of Ghana. The LOC has been earmarked for the purpose of financing (i) ICT and Good Governance,

(ii) Procurement of track materials, tools and equipments, wagons and spares, trucks and buses, foundry materials and (iii)

Agro Processing Plant in Ghana. Exim Bank will reimburse 100% of contract value to the Indian exporters, upfront upon the

shipment of goods.

Exim Bank already has in place three Lines of Credit aggregating to US$ 102 million that have been extended to the

Government of Ghana. The LOCs were utilized for projects including Rural electrification, Construction of seat of Government,

Agriculture, Transportation and Communication equipment. Main products exported from India to Ghana include transport

equipment, petroleum crude, pharmaceutical products, primary & semi-finished iron & steel, machinery & instruments,

manufactures of metals and plastic & linoleum products.

Exim Bank has in place 102 Lines of Credit, covering over 90 countries in Africa, Asia, Latin America, Europe and the CIS,

with credit commitments of over US$ 3.35 bn, available for financing exports from India. Exim Bank's LOCs afford a risk-

free, non-recourse export financing option to Indian exporters.
