Zoning: “RR2” Rural Residential R.M. of East St Paul Zoning By-Law 2009-04
Purpose:
In the Zoning By-law, Ready to Move (RTM) homes are defined as Transported Dwellings,
which require a conditional use approval in the “RR2” Rural Residential Zone. As well, any
associated accessory structures to a conditional use also require conditional use approval. The
applicant is proposing a 1,359 sq. ft. transported dwelling (RTM), and a 1,008 detached
accessory garage on the subject property. The applicant has provided a preliminary site plan,
letter of intent, and photos of the proposed RTM.
Background:
The subject property is 8.8 ac. in size, and is 132 ft. in width. The proposed RTM is 1,359 sq.
ft., and the proposed detached garage is ~1,008 sq. ft. The proposed locations for each of the
structures conforms to the requirements in the Zoning By-law.
The surrounding area is as follows:
North: A property zoned “RR2” Rural Residential that is developed with a single-family
dwelling, accessory structures, and also appears to be used for agricultural purposes.
East: A property zoned “RR2” Rural Residential that is developed with a single-family
dwelling.
South: A property zoned “RR2” Rural Residential that is developed with a single-family
dwelling.
West: Ross Farm Rd., and then Lagimodiere Blvd. (PTH 59).
Municipal Comments:

Analysis:
The proposed RTM is defined as a transported dwelling in the Zoning By-law, and requires a
conditional use approval in the “RR2” Rural Residential Zone. In conversation with the
applicant, they have indicated that the same model of RTM could be constructed entirely on site,
but, the model they have purchased has already been constructed, and needs to be moved on site.
The proposed RTM is effectively a single-family dwelling, which is similar to other uses in the
surrounding area.
Accessory structures to a conditional use also require a conditional use approval. The
applicants’ have included a 1,008 sq. ft. detached accessory structure (garage) on their site plan
as part of the proposed conditional use application. If the applicants’ had constructed the
proposed RTM on the site, rather than moving it onto the site from another location, then they
could potentially construct up to two (2) accessory structures 1,200 sq. ft. in size as per the
Zoning By-law without additional approvals. As the proposed RTM is effectively a single-
family dwelling, the RRPD recommends that Council considers including approval for the
applicant to construct accessory structures on the subject property as would normally be allowed
for a permitted single-family dwelling use. This is included as a condition of approval below.
Based on the submitted site plan, the proposed transported dwelling (RTM) and detached
accessory structure (garage) will meet the requirements of the Zoning By-law. It should be
noted that the submitted site plan details proposed locations for the proposed transported
dwelling (RTM) and detached accessory structure (garage), but, could potentially change at the
final permitting stage. In other words, the applicant could relocate the dwelling and / or
proposed garage, so long as it remains within the requirements of the Zoning By-law. If Council
wishes to ensure a specific location for the proposed transported dwelling (RTM) and / or
detached accessory structure (garage), a condition of approval can be included to address this.
Permits will be required from Manitoba Infrastructure, as well as the Municipality in order to
transport the dwelling from its current location to the subject property. A condition of approval
has been included requiring that all required permits be obtained, which includes these permits.
The requirement of these permits is also included as a condition of any approved building
permits.
The RRPD recommends that the proposed conditional use for a transported dwelling and
detached accessory structure(s) could be approved, subject to conditions.
Options:
Under section 106(1) of The Planning Act, on completion of the public hearing, Council may:
(a) reject the application; or
(b) approve the application if the conditional use proposed in the application
(i) will be compatible with the general nature of the surrounding area,
(ii) will not be detrimental to the health or general welfare of people living or working in
the surrounding area, or negatively affect other properties or potential development
in the surrounding area, and
(iii) is generally consistent with the applicable provisions of the development plan bylaw,

the zoning by-law and any secondary plan by-law.
Recommendation:
The RRPD recommends that the proposed conditional use could be approved, subject to
conditions. If Council wishes to approve the proposed conditional use, the following conditions
are recommended:
1. This Conditional Use approval is limited to allow one (1) transported dwelling (RTM) as
proposed, and associated accessory structures as allowed in the Zoning By-law. Any
changes in use will require a new conditional use approval.
2. Applicant / owner obtains all required permits from the Red River Planning District,
Municipality, and Manitoba Infrastructure, including any permits necessary for
transporting the proposed transported dwelling.
