it’s not a question in the mind of the consumer should I take a drug or not it’s what drug should I take.” This is how the majority of our country thinks and this way of thinking needs to be shifted. Since health, eating organically, and exercise are more popular currently, this is the perfect time for a shift in how we think about health and wellness. Jeff Hays is one of the producers of this film and was short-listed for an Academy Award on his last documentary. His film, On Native Soil, is a follow up on the surviving families of the 9/11 tragedy. He is passionate about alternative health care and has seen results personally. We hope that this film will earn an Academy Award for him. All of the trailers can be viewed on the CCA blog at coloradochiropracticassociation.org. If you would like to donate to the film’s production click here. Jeff Hayes has been invited to appear at our convention, so stay tuned for more information on Medical, Inc. We will definitely have a private screening of the film at some point and you will have the opportunity to get a free DVD of the film and hear Jeff Hays speak.

Chiropractors come out of college with a lot of knowledge about philosophy and technique, as well as clinical acumen. Rarely do graduates also have an innate ability to drive business, market themselves and manage staff. Usually, when a practice is new, there is more time than money, but focusing the time can be difficult. The CCA invites you to join us for lunch on the last Wednesday of every month to do just that, focus. A place to relate with other D.C.’s, talk about practice building ideas, figure out what works and learn from experts in the field, for free. (No CE available for lunch series)

The CCA is designed to support. We’re here to help you figure out your own practice with guidelines, regulations and suggestions that have helped those who came before you.

A chiropractor recently asked me, ‘should our practice have a page on Facebook?’ Here’s what I told her. No small- or medium-sized practice can afford all types of advertising—so I’d start with the broader question, ‘what’s the right marketing mix for my practice?’ Or, ‘where should I advertise?’

The answer starts with who your patients are. If you know how they prefer to be communicated to—email, text, social media, favorite web sites, good old postal mail, etc.—then you’ll know how to reach them and others like them. Whatever is in your marketing mix, measure your successes as well as you can to determine what’s working and what isn’t.

Now, some thoughts on Facebook. The most important part is content—topics and discussions. The majority of Facebook users are staying in touch with friends and family, so they’re not in the mood for a hard sell.1 Facebook also provides an amazing opportunity to connect with your patients beyond office visits that makes your relationship more personal and rewarding for both of you.Putting loads of content and hoping it’ll stick to someone will waste your time and theirs. Use data—patient surveys, web site analytics, and Facebook analytics—to know patient’s interests and focus on topics that resonate with them.Assuming you’ve decided your patients, or at least a decent-sized subset, use Facebook, consider the time commitment. Creating content, posting pictures and videos, and responding to your patient’s questions or wall posts is time-consuming. There’s also other social media to partake in, such as Twitter, LinkedIn, and Google+. Other parts of your marketing mix may have to go away because of the time you’re spending or the money you pay someone else to do it.It comes down to this: whatever you put into your marketing mix, know first your patients’ communication preferences. Then, plan out the con-tent, measure successes, and continually tweak your plan based on what you’ve learned.

Dr. Kristen Kells of Colorado Springs, Colo., a chiropractor who works closely with USA Wrestling athletes and programs, has been named Woman of the Year by USA Wrestling, the national governing body for wrestling in the United States. This award recognizes an outstanding woman for her contributions to the sport of wrestling.

The award was announced and presented at the annual USA Wrestling Awards Banquet, held in Iowa City, Iowa alongside the U.S. Olympic Team Trials on April 20.

Kells is a chiropractor with Freedom Chiropractic in Colorado Springs, which is affiliated with Maximized Living, the Wellness Advisory Council for USA Wrestling. She has been a chiropractor for more than 12 years.

Dr. Kells has taken a special interest in helping Women’s Team USA. She has worked as team chiropractor at the last three Senior World Cham-pionships in Denmark (’09), Russia (’10) and Turkey (’11). She has a close working rela-tionship with the athletes and coaches on the team, and has been a key contributor to the success of the program since she has been involved.

She has also helped organized chiropractic care for U.S. teams from other professionals when she is not there. She donates care in her office to all national team athletes. She has worked extensively with the staff of USA Wrestling and their families.

Dr. Kells volunteers at local wrestling tournaments and works with clubs and coaches to enhance the performance of the athletes through nutrition, rehabilitation, and keeping the mind of a cham-pion.

She has won numerous awards, including 2010 Sports Chiropractor of the Year in Colorado.

“I was very surprised about the award. I am honored and humbled,” said Kells. “My passion is helping athletes, especially wrestlers, per-form at their highest level. When they are able to perform at their best, that is what I love. I want to know that I can help people.”

“The National and World Teams have become my family. I love wrestling athletes at all levels. I am seeing them perform better. But I also want their lives to thrive when they are done wrestling. I want them to avoid injuries and to the right things with their bodies now and in their future,” she said.

Districts 2, 5, and 6 are up this year. First, nomination forms will be MAILED to all CCA members in these districts. Nominations will be due in the CCA office by July 13, 2012. Based on nominations received, ballots will then be MAILED out to CCA members in these districts. Ballots will be returned to our CPA’s office for tabulation by August 3, 2012. The results will be announced at the CCA Annual Business Meeting on Friday, September 7 at 7 p.m. at the Hyatt Regency Denver Tech Center. Directors at Large/AlternatesLive election at CCA Annual Business MeetingThe CCA now has THREE Directors at Large and THREE alternates, according to the new bylaws approved in 2011. This year will be a “correction” year for these positions. There will be ONE AL-TERNATE Director at Large election this year. In 2013, there will be one position open for Director at Large and one for an alternate. This pattern will continue for the Director at Large positions. Nominees will be elected by plurality of votes, meaning the person with the most votes will be Director at Large and the person with the second most votes will be Alternate. To serve as a Direc-tor at Large, you must be an ACTIVE CCA member for at least TWO years immediately prior to the term of office. The term is THREE years.

The term is ONE year for each position, with no more that THREE consecutive terms. Secretary/TreasurerLive Election at CCA Annual Business MeetingSecretary/Treasurer is elected every two years at the CCA Annual Business Meeting. This year is an election year – current Secretary/Treasurer Steve Schuster, DC is eligible to run for a second term if he chooses. The term is TWO years with no more than TWO consecutive terms. PresidentLive election by the CCA Board of Directors at the Annual BOARD MeetingThe new CCA bylaws state that the CCA President will be elected by majority vote of the CCA Board of Directors at the Annual BOARD meeting that will take place within 15 days after the CCA Annual Business Meeting. There are three categories of damages an injured person can recover in Colorado. 1) Economic damages, 2) non-economic damages, and 3) physi-cal impairment. An injured person’s spouse can also recover for loss of con-sortium damages—the negative effect the injuries have had on the marital relationship. The first category of damages is economic damages. Economic dam-ages are out-of-pocket losses such as wage loss for missed time from work, medical bills, the costs of future medical care, and future lost earnings or re-training costs. Economic damages are not capped in a personal injury case. The second category of damages is non-economic damages. Non-economic damages are losses such as pain and suffering, emotional stress, and the negative impact a person’s injuries have had on his/her quality of life. In 1986, Colorado enacted a series of “tort reform” laws. One of those laws limited the amount of non-economic damages a catastrophically injury plain-tiff could recover. It was not until 2007 that these non-economic damages caps of $250,000 were increased for inflation, despite the fact that the pur-chasing power of the dollar had decreased by 32% since the cap. In allowing for an adjusted cap for inflation, the General Assembly remarked that injured people whose damages were found to justify an award in excess of the cap were the most severely injured and damaged people. In other words, these were catastrophically injured people. The current non-economic damages cap for personal injury plaintiffs hurt after January 1, 2008 is $468,010 which may be increased by the court upon clear and convincing evidence to a maximum amount of $936,030. The last category of damages is physical impairment. Under Colorado law, in a personal injury case, physical impairment and disfigurement damages have always been considered an element of damages separate from the cate-gories of economic and non economic damages. As such, physical impairment damages are not capped. What is physical impairment? There is no clear definition in the context of personal injury law. The Colorado Code of Regula-tions provides some guidance as to what a physical impairment describing, “Physical impairment means any physiological disorder or condition, cosmetic disfigurement, or anatomical loss affecting one or more of the following body systems including, but not limited to: neurological; musculoskeletal; special sense organs; respiratory, including speech organs; cardiovascular; reproduc-tive; digestive; genital urinary; hemic and lymphatic; skin; and endocrine.” Should you or your patients have any questions about what damages they can recover in a personal injury action, please feel free to contact me.

Effective for Colorado DCs November 19, 2012Includes MANDATORY Change on How Your Receive Medicare Reimburse-ment Medicare claims processing services in Colorado (and in the states of Arkansas, Louisiana, Mississippi, New Mexico, Oklahoma and Texas) will be changing from Trailblazer to Novitas (formerly Highmark Medicare Ser-vices). As the incoming MAC (Medicare Administrative Contractor), Novi-tas will start processing the Medicare claims workloads for Colorado DCs on November 19, 2012. For more detailed information use the following address for Novitas Solutions, Inc.: https://www.novitas-solutions.com/transition/jh. In addition, Medicare will now require ERT (electronic FUNDS transfers) for reimbursement of providers when revalidation or other changes occur. Since the claims processing company will change in November, you will be required to accept ERT at that time. You may still BILL via paper, but must accept electronic transfers for reimbursement of claims. Here is more information from Medicare on this subject and a link to more information: “Existing regulations at 42 CFR 424.510(e)(1)(2) require that at the time of enrollment, enrollment change request, or revalidation, providers and sup-pliers that expect to receive payment from Medicare for services provided must also agree to receive Me dicare payments through electronic funds transfer (EFT). Section 1104 of the Affordable Care Act further expands Section 1862(a) of the Social Security Act by mandating federal payments to providers and suppliers only by electronic means. As part of CMS’s re-validation efforts, all suppliers and providers who are not currently receiv-ing EFT payments are required to submit the CMS-588 EFT form with the Provider Enrollment Revalidation application, or at the time any change is being made to the provider enrollment record by the provider or supplier, or delegated official.”For more information visit http://www.cms.gov/Outreach-and-Education/Medicare-Learning-Network-MLN/MLNMattersArticles/downloads/SE1126.pdf

WE SEE AN INDUCEMENT VIOLATION FINE THAT

COULD’VE BEEN PREVENTED.Do you have $10,000 to throw away? That’s exactly what you might be doing if your discounts trigger an inducement violation. With fines like this, many practices are one inducement violation away from serious financial hardship, maybe even bankruptcy... Medicare, the OIG and insurance companies ARE pursuing violators of State and Federal regulations.

Offering discounts to your cash and underinsured patients can be legal if done properly! The solution is easy, free to set up, and recommended by many Chiropractic State Associations across the country. If over1,000 doctors are doing it the RIGHT way, you can too!

And that’s not all... Over 50,000 patients appreciate their doctors for keeping health care affordable for their families; join ChiroHealthUSA and yours will too! It’s time to start practicing with peace of mind.

The Colorado Chiropractic Association, CCA, keeps updated on these issues and together with our lobbyists push for a pro-chiropractic agenda. There is always a need for a well-funded PAC. Please contribute today. Thank you! (Staff, spouse, family, friends and patients can contribute too.)

The Campaign Finance Reform Act establishes rules on contributions to PACs (Political Action Committees) in Colorado. The maximum contribution an individual can make to a PAC is $525 per election cycle (every two years). For example, an election cycle is from December 2010 to December 2012. Corporate/business checks are allowed as well as checks from individual accounts. A husband and wife may make a single $800 contribution if the contribution is done from a joint checking account. Each family member may contribute with their own personal account, but only one contribution can be made from a joint account. In addition, contributions can be made directly to candidate campaigns by individuals up to $400 each two-year election cycle ($200 for the primary election and $200 for the general election). Please include your current address, profession/employer with your contributions to make it easier for the candidates to properly report. If you have any questions about contributions call our lobbyist Kristin Thompson 720-373-9259.

The diverse educational knowledge and experienced clinical back-ground of the course instructors will equip you to provide outstanding care in an ever changing and dynamic healthcare setting. It will set you apart as a true specialist, not only from other chiropractors, but also from the medical profession. You will learn to treat and manage chronic illnesses that have formerly been the exclusive domain of the allopathic community.

We’ve assembled a well-rounded, eclectic, and experienced team of diplomates who will be teaching from their true areas of expertise. Chiropractic Internists all have similar educations but tend to gravitate to a specific area of interest and area offocus. Our outstanding group of physicians will offer a different perspective on Chiropractic Internal Disorders and inspire you to become the doctor you’ve always wanted to become!
