GENEVA - Swiss record labels are refus-ing to service Swiss radio stations withnew releases.
The unprecedented step is the initia-tive of the Swiss branch of the Interna-tional Federation of the PhonographicIndustry (IFPI), which represents themajority of the country's record compa-nies. The row centres around Switzer-land's law on neighbouring rights, whichwas implemented in July 1993.
In 1984, radio stations signed a dealwith IFPI Switzerland under which theyagreed to pay 0.3 percent of their annualturnover for the use of music. But sincethe 1993 neighbouring rights law, sta-tions have also had to pay collecting soci-ety Swissperform an additional 1.25 per-cent of turnover.
"We've been paying twice for thesame thing," claims Pierre Steulet, presi-dent of the RRR trade body which repre-sents regional radio stations in French-speaking Switzerland. Steulet took thecase to a Swiss federal court-whichruled in favour of the radio stations-atthe end of December 1997.
Since then, RRR and VSP, which rep-resents stations in the German-speakingregion of Switzerland, have asked theirmembers to stop making payments tothe IFPI, a move which has now alsobeen followed by Swiss public broadcast-er SSR.
However, Peter Vosseler, director ofIFPI Switzerland, argues that themoney stations pay IFPI and Swissper-form doesn't cover the same rights. "TheIFPI agreement between the labels and

Even in a global marketplace, it has become essential thatrecord companies develop strong rosters of local artists. Thiswas made clearer than ever last week, when PolyGram andWarner Music unveiled their 1997 financial results.
The buoyant mood of PolyGram chief executive AlainLevy, offering an 11 percent increase in operational income,contrasted sharply with the sombre admission from TimeWarner chairman Gerald Levin that Warner Music's earn-ings took a 26 percent tumble.
PolyGram, which has started reaping the rewards of atough global restructuring policy, was blessed by strong per-formances from several acts who were from neither the U.S.or U.K, the traditional homes of global stars. AndreaBocelli-an Italian artist on an Italian indie label, licensedto PolyGram's Dutch affiliate for the world-was the com-pany's second -biggest act in 1997, exemplifying Levy's aim oftaking local talent to worldwide stardom. Bocelli has evencracked the U.S., where his album Romanza has been certi-fied gold as it rides The Billboard 200.
Warner, on the other hand, hit some bad luck-the "slip-page" of several key releases to 1998-and tough market
conditions, especially in its traditional centre of gravity, theU.S. Fortunately, the outlook for '98 seems brighter.
But there is another key factor underpinning the situa-tion Warner experienced in 1997: the degree to which it stilldepends on established Anglo-American superstars to pro-duce worldbeating revenues. Which acts did Levin cite asbest hopes for '98? Eric Clapton, Madonna, Rod Stewart,Seal and Van Halen. Contrast this with Levy's commentthat U.S. and U.K established acts "do not represent asmuch [business] as they used to," at least for PolyGram.
Last year, Warner certainly fulfilled the all-important,local -repertoire mission in Italy and Spain, developing huge-ly successful stars: Pino Daniele, Ligabue, Nek, Litfiba andLaura Pausini in Italy, and Alejandro Sanz, Celtas Cortosand Presuntos Implicados in Spain. And yet, according toshare -of -chart data compiled byMusic & Media, Warner Musiclost ground in most otherEuropean territories in '97.
Which brings us back to Levy'scomments last week: to balancethe increasing unpredictability ofinternational acts, there's onlyone way forward-developinglocal and regional acts and, whenpossible, translating their localsuccess into global success.
Bonton marries Sony in Czech republicby Michele Legge
PRAGUE - Sony Music Czech Republic(SMCR) has finally tied the knot withlocal label Bonton Music, ending morethan six months of negotiations.
Signing the deal to create Sony Bonton are (backrow, 1-r): Aaron Kirtz (acting general manager,SMCR); David Main (vice-president, businessdevelopment, Sony Music EntertainmentEurope); Zbynek Knobloch (managing director,Bonton Music). The newly -merged company, SonyMusic Bonton, will begin operationson March 1 and will be the secondlargest record company in the CzechRepublic. Sony Music has taken a 51percent stake, while Bonton Music's
parent company theBonton Group-aconglomorate whichalso has significantinterests in mediaand retail-has theremaining 49 per-cerikt of shares.
Neither sidewould comment ontheir financial con-tributions to the newventure, which hasseen a total of 10staffers from SMCRand Bonton losetheir jobs.
Zbynek Knobloch,formerly managingdirector of BontonMusic, has beenappointed MD of SonyMusic Bonton, whileAaron Kirtz, actinggeneral manager ofSMCR since July, hasbeen named as
deputy MD and marketing manager.Mick Hawk, co -president of the
Bonton Group, comments: "SonyMusic was the first deal that Bontonconcluded and in that time we havebuilt up a great deal of respect for eachother. Our local presence in the enter-tainment field, coupled with Sony'sinternational strength, make for a per-fect fit. If you like, we have been goingout together for the last seven -and -a -half years and liked the experience-now it makes sense and feels perfectlynatural to get officially married!"
Tony Woollcott, senior vice presi-dent, Sony Music Europe, notes thatthe merger is "a continuation of [Sony's]global efforts to forge partnerships thatyield the best quality repertoire."
Bonton Music's strength lies firm-ly in the field of domestic repertoire.In 1997, it took a 20 percent share ofthe Czech Republic's domestic musicmarket (second only to Monitor -EMI),according to figures published byIFPI. SMCR, meanwhile, had just a1.0 percent share of the domesticmusic market in '97.
Both SMCR and Bonton, however,had an 8.0 percent share of the over-all Czech Republic music market lastyear, with SMCR scoring with itsinternational acts.
Gong censured for 'secret' investmentsby Ed Meza
BERLIN - Studio Gong has received aformal reprimand from Bavarianradio regulator the BLM after itadmitted hiding long-standing finan-cial involvements in local stations inthe state.
At its February 5 meeting, theBLM's media council severely criti-cised the commercial radio group'ssecret holdings of major shares in sta-tions in the towns of Neumarkt
and Schweinfurt.Since 1991, Studio Gong has dis-
creetly built up a majority sharehold-ing in Hot AC station GongFM/Neumarkt (it had previously onlyheld a minority stake, which the BLMwas aware of). In 1992 Gong alsoacquired a major part of schlager/goldstation Radio Prima Ton/ Schweinfurt,again without informing the BLM.
Despite its reprimand, however,the regulator has decided to allowStudio Gong to maintain its present
level of involvement in the two broad-casters. Studio Gong had claimedthat its investments stopped both sta-tions from going out of business.
Meanwhile, another Bavarian sta-tion, RT.1, has had its licencerenewed until 2004 by the BLM.Targeting 25 to 54 -year -old listeners,the station serves up a mixture ofoldies and AC to listeners in theNordschwaben area, which includesthe towns of Donauworth, Dillingen,Nordlingen and Huhnerberg.

Q: What have been the mainchanges in the two months sinceRevert's departure?A: They've been mainly structural sofar. It was decided not to appoint anew Cadena 100 director-in effectthat position has been taken by PedroDiez, COPE director general. Thereare three new divisions: I am the pro-gramme co-ordinator, JordiCasoliva-who previously ran ouroperations in Catalonia-is now inMadrid co-ordinating external affairs,and all commercial activities are beingrun by Antonio Gonzalez. But in termsof what the public listens to, Fm theone in charge.
Q: What programming changeshave you implemented so far?A: There have been no major changesas yet. But we are now spicing themusic content with more news bites-a maximum of one minute of informa-tion about traffic, sport or what's onsafter every two or three records. Theidea is to create closer links with thepublic. We continue to be the networkwhich gives most support to the jointcampaigns with [authors' and publish-ers' society] SGAE and [artists' associ-ation] AIE to promote new talent,such as Imaginarock and En Ruta.
Q: With the government in theprocess of awarding 350 new FMlicences across the country, thereis much apprehension in the radiosector about a fourth big groupemerging. What is your view?A: People have been talking for yearsabout redrawing the Spanish radiomap, so Fm not too worried. I hope tosee Cadena 100 get at least 30 morestations-at present we have 79.What I really want to see is an end tothe tremendous imbalance in favourof Cadena SER, which has some threetimes more stations than COPE.
Q: Unlike most other countries inEurope, most of Spain's 20 millionradio listeners tune into news/talkformats rather than music sta-tions. Why is this?A: I think this matter has been exag-gerated. With virtually no music onterrestrial TV, music radio is veryimportant to the industry. The pointis that in Spain there have alwaysbeen at any one given time three orfour big radio stars-real personali-ties-and they have always beennews/talk presenters.

C1)1\I T I B l A IMECADO 'OFFICIALLY BANKRUPT'AMSTERDAM - The much -rumoured bankruptcy of Dutchindie label MECADO has been confirmed. A court in TheHague declared the company insolvent February 4, a deci-sion that was made public on February 13. MECADO-Music Entertainment Company and Artist DevelopmentOrganisation-was launched by Robert -Jan Hertog, formervice-president of Dutch -based indie Arcade Music Group, inthe summer of 1996. The company's main products weredance compilations along with some home-grown artists onsubsidiary labels Woosh and Tricky Stuff. Robin van derBasch, general manager of MECADO's distributor, Weesp-based Music Net, says: "We will stick to all agreementsregarding the returning of MECADO product by our clients."
CAPITAL GOES FOR KIDS' FORMATLONDON - The Capital Radio Group is applying for a newnorth east England regional licence with a "children's radio"format. Capital says the application, Fun Radio, has been"specifically designed to cater for the needs of children, anaudience currently ignored by the 200 -odd stations of boththe BBC and independent local radio networks in the U.K"Fun Radio will target 4-14 year -olds, says Capital, withmusic -driven programming "playing a mix of teen bands andnovelty hits, often interspersed with useful and educationalitems of interest to local children and parents." Capitalpromises the station will also be "highly interactive."
FLEMISH ESSENCE ON CABLE?ANTWERP - Following the recent launch of Luxembourg-
based cable station Radio Flandria (M&M, December 27,1997), a second station has applied to broadcast on Flanders'cable radio system. Essentio ("Essence"), programmed bypublic radio veteran Gust De Coster, is proposing a predomi-nantly instrumental easy -listening format. However, the sta-tion will wait until the new Flemish Media Decree becomeslaw (expected to be before the summer) until it takes to theair. Meanwhile, Flemish commercial TV broadcaster VTMhas announced it will apply to the Flemish Media Commis-sion to set up a new Flanders -wide terrestrial FM station.
GILTRAP RETURNS ON K -TELLONDON - U.K. folk gui-tarist Gordon Giltrap,recently featured in CliffRichard's Heathcliff stageshow and best known forhis 1978 hit Heartsong,has signed a three -albumdeal with U.K-based K -Tel. Giltrap is pictured(centre) with label manag-

TEL Aviv - In a move seen aspotentially damaging by thecountry's record industry,Israel's biggest radio station,the state-owned Rechet Gimel,has switched from a CHR/dance format to a diet of 100percent Israeli music.
The public broadcaster'smove towards a mainly-MORsound comes in response togrowing competition for theyounger 15-30 demographicfollowing the granting of 20local commercial radio licencesin Israel two years ago.
"In moving out of the youthmarket, the station hasplumped for the more tradition-ally minded 30-50 year olds,"
explains Shira Geyra, head ofprogramming at Tel Aviv com-mercial station 100 FR"Although more young listenersare tuning into 100 FM, Voiceof the Red Sea and army sta-tion Gallait Tzhal [the latter isthe only other station in Israelwith national coverage], RechetGimel is gaining listeners of avery different sort."
Record companies are con-cerned at the developmentbecause it means that chancesfor foreign acts to gain exposurein Israel will be more limitedthan ever. "There had alreadybeen a dip in [record] sales dur-ing the last half of 1997 due to acombination of factors, mainlyeconomic," reports Jez Ansell,label manager of indie Agnosia.
He adds: "Rechet Gimel's deci-sion certainly won't help!"
Another major concern is thatmore contemporary forms ofhome -produced music-particu-larly dance-will also receiveless national exposure as a resultof Rechet Gimel's sudden formatchange. Israel is already interna-tionally recognised as a leadingexporter of "trance," but manyleading DJs have now quitRechet Gimel in favour of localcommercial outlets.
"As a label, we were think-ing about starting a secondimprint for trance," revealsAnsell, "but now that the DJshave gone to stations with lim-ited reach we expect a furtherdownturn in the market-sothe plan is on hold."

LONDON - MTV Europe ispreparing for its entry into thedigital TV age-in which itexpects to be able to roll -out anumber of new niche chan-nels-by transferring its cen-tral video archives to an on -demand digital storage system.
The digital archive will beoperated by MTV's newly -formedEuropean Operations Centre(EOC), headed up by its ownmanaging director, Mark Allen.Allen was formerly MTV Europesenior vice-president, networkoperations. The EOC will have152 staff, based at MTV's Cam-den offices in London.
"Digital storage will signifi-cantly reduce unit costs andallow more efficient roll -outs ofnew channels," says Allen."Video clips can be turned into adata file and handled like an e-mail, thus cutting out tapecosts, dubbing and storagespace." The digital storage sys-tem will replace MTV's existingtransmission suites at Camden.
Just how much MTV willinvest in the new technologyremains unclear. "We are still innegotiations with digital equip-ment suppliers," says Allen. "I
cannot name any figures yet."MTV Europe's video
archives hold an estimated165,000 individual video clips.Whether all of these will betransferred onto the new sys-tem has not yet been decided,according to Allen. But it isunlikely that the transfer fromtape to digital will lead to a"spring-cleaning" of the broad-caster's archives.
"We still have to determinethe actual route we want totake on this," says Allen. "Gen-erally speaking, we would liketo put as many clips as possible
into digital storage." MTV has appointed Chris-tiane zu Salm-Salm as manag-ing director of its CentralEurope service, effective April1. She will be responsible forMTV Europe strands servingthe G/S/A territories, as well asVH-1 in Germany. Her lastpost was with her own musiccompany Medien Music Ser-vice in Germany; she has alsoworked in TV production atUFA in Berlin, Munich andHamburg. Salm-Salm replacesMichael Oplesch, who left MTVCentral Europe last November.

OsLo - Norway's digital radio land-scape is beginning to take shape.
Slots on the country's national dig-ital radio multiplex havealready been awarded tonational commercial ACstation P4, and to four ser-vices from public broad-caster NRK NRK will dig-itally broadcast its AC sta-tion P1, "culture" stationP2, CHR station P3, andeither 24 -hour news sta-tion Alltid Nyheter or clas-sical music service Alltid Klassisk.
Commercial AC network Radio 1Norway has emerged as a contenderfor the sixth and final slot on the mul-tiplex. It is likely to face competitionfor the frequency, however, from reli-gious broadcaster Kristen Riksradio.
Radio 1 Norway chief engineerGeir Malmnes, who sits on the localradio association (NLRF)'s technicalcommittee and who is also a memberof the Norwegian Digital Radio steer-ing committee, says: "Everything hasits price, but for us [getting on thenational digital multiplex] is a 'win ordie' situation."
No firm timetable has yet beendrawn up for the implementation ofdigital radio in Norway, but testtransmissions are currently beingconducted by the stations concerned,
and significant progressis expected by the end ofthe year.
NRK P3 managingdirector Nils Heldal saysof his station's digitalplans: "It's not an optionto establish any morefragmented music for-mats. Listening just tomusic you think you want
to hear [on radio] becomes like listen-ing to your own CDs. P3 wants to playmusic listeners didn't know they want-ed to listen to. But we are looking toexploit digital radio technology for spe-cial events like the Quart Festival orthe Roskilde Festival."
Asked about digital radio's impli-cations for the music industry, Radiol's Malmnes comments: "I think thatthe record companies would be a lotmore frightened if they updatedthemselves on the developments.There won't be any reason for con-sumers to buy CDs if they like whatthe digital radio services play."
'Official' licences for Sky, Classicby Robbert Tilli
HILVERSUM - Sky Radio 100.7 FMand sister station Classic FM havefinally received full Dutch broadcastlicences-even though they have beenbroadcasting on terrestrial frequenciesin the Netherlands for some years.
European Union legislationrequires any radio station broadcast-ing on a terrestrial frequency to havea full broadcast licence in that coun-try. However, both soft AC market -leader Sky and Classic FM had U.K.broadcast licences, dating back to thedays when they were satellite -onlyoperations broadcast from England.
"It makes sense to have a broad-casting licence in the country whereyour main activities take place, andwhere all decisions are taken," admitsSky Radio's director of public affairsMartin Banga. 'We don't deny thatwe're Dutch acid that we're makingprogrammes for the people of Holland."
As a result of the move, Sky andClassic will have to make someadjustments to their programming-mainly in the areas of sponsorshipand advertising. Under Dutch broad-cast law, each radio station is obligedto restrict advertising spots to a max-imum of 15 percent of output per day,and 20 percent of output per hour.
Bjork recently visited Copenhagen to pick up the best internationalfemale vocalist award at the 1998 Dansk Grammy ceremony. Justbefore the event, the singer-who described herself as a "gratefulgrapefruit" on receiving a similar award at the U.K.'s Brit Awards-was presented with a gold disc by PolyGram Denmark managingdirector Stefan Fryland in recognition of over 30,000 Danish sales ofher current album Homogenic (Mother/One Little Indian).

Copyright protection on the opIn the third part of Music & Media's series on the impact of thedigital age, editor -in -chief Emmanuel Legrand examines thelegal issues facing the music community with the advent of adigital environment. How are record companies, publishers,copyright owners planning to protect their rights and revenues ina global music market which now has the potential to bypasstraditional methods of distribution and control?

Music Alliance."And yet," Hutchinson adds, "we
aren't seeing the revolution in theway entertainment is presented. Ithink the horizon 2010 is a muchmore realistic one," he estimates, forthe music industry's full entry intothe digital age.
Hutchinson's comment puts intoperspective the time frame-morethan a decade-to which the musicindustry in Europe appears to beworking. Yet all the technological ele-ments of the new digital future areeither in place already or developingrapidly, and the legal framework ofprotection and regulation being draft-ed now will have to serve the indus-try-and the public-through a peri-od of profound change.
Danger ahead?Because of its impact on the way peoplewill listen to, select, buy and store theirmusic, the digital revolution containsseeds of danger for the music industry.As a result, although record companiesview its coming with great interest,they have been very conservative intheir approach to the new environment.
Just two weeks ago, PolyGramoffered a good example of the way themusic industry is addressing theseissues, when PolyGram chief execu-tive Alain Levy announced he wascreating a task force "at the highestmanagement level" within the compa-ny. Its purpose is to review the impli-cations the digital age will have forthe business of music, and to formu-late a "global and coherent policy" forthe company.
"It is a worldwide issue," said Levy,"so we are going to take some time tosee what the situation is, and come upwith a world-wide position for the corn-
pany within the next three months."Levy made no secret of the fact
that he is taking a cautious approachto the digital world, above all becauseof the absence of a proper legal frame-work for the development of new busi-ness practices. "We need a securelegal environment and at this stage,"he said. "I'm not feeling totally secureabout it," Levy continued. "There's alot of legal work to be done before weare fully satisfied."
Levy's remarks sum up the domi-nant feeling within the music indus-try. While all admit that the digitalage offers countless opportunities todevelop the distribution of music, thefear of loopholes in country -by -countryand international legislation, in whatwill be a global market without physi-cal frontiers, has so far restrainedenthusiasm. In Music & Media'sMidem issue, PolyGram presidentcontinental Europe Rick Dobbis, wentso far as to express concern that thenew digital era had the potential "toput us out of business."
The legal protection problemPolicy makers are also starting towake up to the new digital world. InJanuary 1997, during his visit to theMidem trade show in Cannes, U.K.minister for culture, media and sportsChris Smith said that "one of thebiggest of the new challenges ahead isthe emerging 'digital market.'
"It is vitally important that weensure copyright laws provide theprotection needed in the age of digitaldistribution," added Smith. Forrecord companies, this aspect is cru-cial. If sources supplying music arepoised to multiply, how can the musicindustry best protect itself, ensure itsrights are preserved, and guaranteethat the use of music generates prop-er financial remuneration?
Nic Garnett, director general of theInternational Federation of thePhonographic Industry (IFPI),explains that, from a record companyperspective, there are differentapproaches to this complex question."One key element in our analysis ofthe situation is to look at things in thecontext of the overall environment, inwhich music is only one part of a huge

matrix of content providers and sys-tem providers," says Garnett.
"What we are seeing is the conver-gence between technologies andmedia," he adds. "But our approach isto start breaking it down and lookingat it in different ways: the technologi-cal perspective (what are the tech-nologies coming our way?); the piracyaspect (what anti -piracy measurescan be applied in that environment?);the future of music distribution (howis music going to be exploited by com-panies both individually and throughcollective processes?); and last, from alegislative perspective (what legalenvironment [should be created] forthe digital world?)"
Technology as servantAt the heart of the IFPI analysis is
the belief that digital technologieswill directly transform the traditionalways music has been distributed, andwill redefine the shape of the indus-try. While the bulk of the music indus-try's revenues currently come fromthe sale of soundcarriers (such as
CDs), this source may be reduceddrastically as other ways of distribut-ing music are increasingly used.
Music will be delivered to con-sumers in many different ways: soundcarriers, which shouldn't be ruled outtoo soon with the advent of the DVDformat and the need for a digitalrecordable carrier; on-line distribution,either via direct retailing of pre-record-ed products or downloading of musiconto computer; or over -the -air or cable -delivered music in a digital form.
"There are lots of technologicalissues to be looked at," admitsGarnett. "Technology is neutral, it all
depends how you use it. Atape recorder doesn't causeany offence until it is used tocopy our music. That's whywe need laws which enableus to operate with all thetechnologies. It's on coursebut not yet in place."
One of the most commonly dis-cussed issues within the music indus-try is the development of on-line ser-vices through the Internet, and how tomaintain control of the flow of data.PolyGram's Levy doubts that by theyear 2000 the on-line business will beimportant, but he is convinced thisnew market will be "growing fast."
"The Internet is not yet a marketfor legitimate producers," reckonsGarnett, "but it'll represent a signifi-cant volume in the next few years.Majors are right to look at it carefully.It is not secure yet."
Cyberspace piratesSeveral experiments with on-line ser-vices are currently underway, withrecord companies closely observingthe legitimacy of the process. Garnettsays one of his tasks is to look at ser-vices providing music from an anti -piracy point of view. "Piracy on theInternet can be traced and fought,"Garnett says. "We are able to pick upvirtually every new site that comesout week on week. We can trace oper-ators and we have already shut downsome sites."
But the pirates are also, inevitably,becoming more sophisticated.Recently, the Russian IFPI officepicked up 2 CD-ROMs which con-tained the RollingStones have recorded-the equivalentof 27 records. They were available ona site somewhere on the Internet,downloaded and put onto the marketby some pirates, according to Garnett.
"We are able to pickup virtually every newsite that comes outweek on week. Wecan trace operatorsand we have alreadyshut down some sites."

These threats force labels to look aton-line distribution cautiously.
While working as general managerof BMG Interactive in France a fewyears ago, Marc Guez, currently man-aging director of record label collect-ing society SCPP, worked on anElectronic Village project in partner-ship with France Telecom, whichoffered music on-line. "My wholepoint was to tell labels that it was intheir interest to be involved in theseprojects," says Guez. "And I haven'tchanged now."
Guez is convinced that record com-panies have much to gain with theInternet, and that there are ways toprotect their rights. "Each time there isa problem, there is a solution," he says.
"All the legal cases brought so farhave recognised the validity of localcourts, even if the site is not based inthe country where the case isbrought," notes Guez. "And this

en rangemakes sense. It would be impossibleto take any action against serviceslocated in countries where legal sys-tems are full of loopholes."
Built-in protectionThe music industry is pushing forencryption codes to be incorporatedon digital as well as analoguerecorded music.
The IFPI is working with the RIAAin the U.S.A., and with the EU-backed Muse programme in Europe,on several initiatives. The currentISRC code, for example, is in a sepa-rate part of the recording from themusic and therefore can be strippedout. The goal is to come up with astandard, secure form of encryption.
Garnett calls the whole processthe building of "a generalencryption environment."
"We try to make it as diffi-cult as possible to steal themusic," says Garnett. "Andthen you make it as difficult aspossible to distribute the stolenmusic without being detected.That's the essence of an anti -piracy operation in a physicalworld, and it will be in the on-line world as well.
"Instead of a physical carrier,"adds Garnett, "we are going to haveelectronic media carrying the music.But the music cannot go in pure musi-cal form. It's got to be encoded and it'sgot to be encrypted so that you canonly access the music if the producerhas given the authorisation to decryptit. That may happen directly throughthe producer, or it may happen, morelikely, through a string of intermedi-

aries. But your protection has to beguaranteed throughout the process."
Concludes Garnett: "We knowwhere we are now and we can have apretty good idea where we'll be 5 to 10years down the road. The difficulty isto go from A to B. You don't know howlong it's going to take, how you'regoing to get there or what will happenduring that journey. People are goingto get through, although some willdrop out. But there's no doubt that
music is meant to be an importantpart of the information society, even ifit's going to be used in a different waythan what we know."

Collecting societiesin the digital ageMCPS/PRS Music Alliance chief exec-utive John Hutchinson forecasts thatwith the environment changing, col-lecting societies will be under strongpressure to streamline their opera-tions and offer a more efficient service.
In a provocative speech at Midem,Hutchinson pointed out that thesenew technologies will allow collectingsocieties to collect and redistributethe proceeds of the different rightsmore quickly, but collecting societieshave to react swiftly to ensure theyare keeping pace with the evolution ofthe market.
"What I was highlighting inCannes is that the very way copyrightsocieties are run is a danger in thecurrent environment of copyrightchanges," says Hutchinson, reflectingon his Midem speech. "If users canshow that the system gets in theirway, and they can demonstrate thatphysically, then governments may notfeel so well disposed towards strength-ening our hand."
According to Hutchinson, mechan-ical and performing rights societieswill see a shift in their sources ofincome. "In 10 years' time, there will

be significant changes in the sourcesof revenues," he says. "That is, if wegrasp the opportunity, because thewhole business of supplying music tothe people over the Internet, or net-works, or telephone lines, or whatev-er medium, will by 2010 be seriouslysuperseding the physical medium ofconventional soundcarriers.
"That said, by 2001-2003, it's prob-ably not going to exceed 15 percent ofthe business, maximum. There arestill opportunities for soundcarriersto evolve, if the record industry andthe manufacturers get their market-ing act together."
Some streams of performing rightsthrough the Net could nevertheless beabsent, says Hutchinson, if the legisla-tion doesn't protect rights owners thor-oughly. "There are some slices [ofincome] that can be taken off by poorlegislation. That would eventuallyerode copyright revenues. I think thatin the ideal scenario, by 2010 you'llhave lots and lots more music playedand paid for. In any scenario, you'llhave a lot more music played-thequestion is whether we can capture it.
"I don't have any misgivings aboutthe potential vibrancy of the marketplace. The thing I am going on about isthe need to get our act together if wewant to protect our streams of income."

The song has astrong chorus, so we could be looking at an unusual hit,although the virtually vocal -free dub version is the strongesttrack here.
WINDOW OF OPPORTUNITYIn trimming Watching Windows (Talkin' Loud)-one of themost commercial numbers on his album New Forms-downto a radio -friendly four minutes, Roth Size/Reprazent could beon the way to fully-fledged pop stardom. The track has every-thing a 'Dv 10 hit needs: hooks, sweeping dynamics and atouch of the underground. Europe's ongoing love affair with Celtic andLatin music is taking place against a New Yorkbackdrop.
New York's Putumayo label has gained afoothold in Europe with a number of carefullythemed world music compilations. The label'slatest release, the aptlytitled Romantica: GreatLove Songs From AroundThe World shipped just intime for Valentine's Day.
Putumayo CEO DanStorper found a niche in themarket back in 1991, whencustomers at his NY importclothing store (also called)Putumayo kept asking forcopies of his self -compiledtapes. Storper's choice ofworld music and contempo-rary folk seemed to strike a

Goldie back in orbitwith 'difficult' albumby Sally Stratton
Sales of Saturnz Return (ffrr), the second albumfrom drum'n'bass pioneer Goldie, are keepingthe spotlight trained on the genre which reachedcrossover audiences with Roni Size/Reprazent'sNew Forms (Talkin' Loud).
Goldie's two -CD set entered M&M'sEuropean Top 100 Albums at 32 last week. Thealbum's strongest markets outside the U.K.,are Norway, Germany, Ireland and France.
Described as inaccessible by some critics,Saturnz Return faces a tough task followingthe artist's ground -breaking 1995 debutTimeless (ffrr), which has, to date, sold over200,000 units worldwide excluding the U.S.Over half of those sales were achieved in theU.K., where the album was a Top 10 hit.
Artistic progression"People didn't get Timeless immediately, and ifyou listen to that album now it almost soundslike normal music," comments Goldie on hisartistic progression over the past two years."You shouldn't understand it [the music onSaturnz Return], you're not supposed to," hecontinues. "[The album] is a very personalthing for me. Timeless was an exterior [view]of my environment, this is [the interior aspect]of my environment. This has definitely openedup a lot of wider avenues for me and I'm veryproud of having an album that is that nakedand that truthful."
The first disc of the two -CD set is dominat-ed by stream -of -consciousness compositionMother which clocks in at just over one hour,followed by Truth, which features the voice ofDavid Bowie. But this is no commercially -motivated collaboration; Bowie's vocals sounddisembodied, stretched over a ponderous beat.
Goldie is a risk -taker: "Traditional ways ofdoing things seem to work the least in today'ssociety," he says. His record company is, how-

Best crossover potential"Most of our international territories are ship-ping Saturnz Return in numbers roughlyequivalent to Timeless," notes London Recordshead of international Nina Frykberg. "We'vehad particularly strong interest from Japan.One of the most interesting news that hascome back to us from our territories is thatthe drum'n'bass scene is very active in Europeand they all see Goldie as the best crossoverpotential artist of the scene. I know ourFrench company in particular thinks that.
"To a degree, we have to cater to the spe-cialists but, for example, in Germany they'refinding that they're getting positive reviewsfor him in crossover magazines, so Goldie has[pop -appeal] to a degree already."
Goldie has stayed close to the roots ofdrum'n'bass culture throughout the gapbetween albums, hosting weekly"Metalheadz" nights in London, where manyof the tracks on Saturnz Return receivedtheir first airings early last year.
However, acceptance for Goldie onEuropean radio is still in its early stages: air-play for first single Temper Temper has beenlimited mostly to specialist shows despite thebonus of a guest appearance from Oasis gui-tarist Noel Gallagher.
Goldie's profile has, nevertheless, beenboosted within the music industry and beyond.He's collaborating on a movie project calledBlessed with Val Kilmer and Josh Evans, aswell as starring alongside Bowie in a Britishstreet culture film titled Everybody LovesSunshinte. "Media and technology have allowedme to catch up with my peers and heroes,which is very important," notes Goldie.
"He is such a personality and he's not pre-dictable in any shape or form," says Frykberg,"that means he can go into other areas as long aspeople have their open minds and don't pigeon-hole him."
AmbassadorWith personal tastes ranging fromRadiohead and Pat Metheny-with whomhe also plans to collaborate shortly-toR&B singer Mase, Goldie remains anambassador for the music that madehim famous. "I think the drum'n'bassscene is thriving more than everbefore," he says.
Goldie is now set to export thatenthusiasm with a European tourwhich starts at the end of April.

Buckfunk 3000.You've heard about the ghost in the machine-well, First Class Ticket is George Clinton lockedinto a MIDI system trying to get back to the moth-ership... Confused? You will be. First Class Ticketis funky as hell and displays the sheer lunacy ofParliament's The Clones Of Dr. Funkenstein andthe cool techno of Joey Beltram's Energy Flashrolled into one. A must.

Libido originally hailfrom Bergen and re -located to London in 1996 toboost their career. Singer/guitarist Even Johansenworks as a studio engineer and the band used down-time at his workplace to record the demos for thealbum. Already on their fourth single-Overthrown,released on January 19-Libido have steadily builtup a good reputation in the U.K. press.

This week, Music & Media's Major Market Air-play section demonstrates how Europe is dividedregionally on the most aired record. Janet Jack-son's Together Again (Virgin) drops to number 3in the European Radio Top 50, but remains themost played in the Netherlands and the G/S/A.Madonna's Frozen (Maverick), at number 2 over-all, holds the top slot in Scandinavia. Althoughher record is honoured this week with the titles of"Greatest Chart Point Gainer" and "Most Added,"it fails by a couple of adds to overtake Natalie Im-bruglia's Torn (RCA), which rises for a remark-able third time to the top position. Imbruglia'sfeat is owed to the strength of the track in Franceand Italy.Last week, this column predicted that eitherMadonna or Celine Dion's My Heart Will Go On(Epic/Columbia) would overtake Imbruglia toreach No. 1. But Dion's record appears not to begrowing as quickly on CHR formatted radio as itis on AC.In the U.K., the regional picture is differentagain, with the Backstreet Boys' All I Have To

Radio ad revenues rise in U.K., FranceCommercial broadcasters breaking ad records in UK.; French advertisers turning to music networksby Mike McGeever
LONDON - Records for U.K commer-cial radio advertising revenue haveagain been shattered -and labels arepumping more money into radio thanever before.
For the first time, the industrypulled in £100 million ($162 million) ina single quarter (the last quarter of1997), according to new figures fromthe Radio Advertising Bureau (RAB)and the Advertising Association. Thatquarterly total represents a 15.3 per-cent increase on the same three-monthperiod the previous year.
The figures are based on sales datasupplied by broadcasters to MediaMonitoring Services, a data -compila-tion company contracted by the RAB.
U.K commercial radio's total rev-enue for 1997 reached £354 million($573.48m), a year -on -year increase of14.7 percent. The rise was fuelled by acontinuous growth in national radioadvertising, which increased 17.5 per-cent across the year.
The Advertising Association alsoreports that commercial radio broke the5 percent barrier of the total displayadvertising market in the third quarterof 1997.
The U.K. record industry invested
over £1.71m ($2.77m) more to promoteits product in the fourth quarter of1997 than it did during the same peri-od of 1996. The music industry's totaladvertising spend (£6.04m) with com-mercial radio was largely made up ofcampaigns for compilation albums byVirgin Records (£1.13m), Telstar(£1.01m), EMI (£761,485) and Poly -Gram (035,042).
The record industry's total invest-ment in U.K radio advertising for 1997was about £16.27m, a significant hikeon the 1996 total of £12.5m.
According to the RAB's breakdownof figures, the top five radio advertisingcampaigns for albums by individualartists during the last quarter of 1997were: Spice GirlsISpiceworld (Virgin)£44,660; Eternal/Greatest Hits (1stAvenue/EMI) £42,209; LightningSeeds/Like You Do...The Best Or (Epic)£37,913; Barbra Streisand/High.erGround (Columbia) £36,968; andRadiohead/OK Computer (Parlophone).
Meanwhile, the outlook for U.Kcommercial radio advertising in 1998 isencouraging, according to a leadingmedia analyst company. Zenith Mediaforecasts that revenue will top the £400million mark this year because of the"increasing confidence" being placed inthe medium by advertisers.

PARIS - France's national musicnetworks saw sharp increases inadvertising revenues during 1997,mainly at the expense of full -service broadcasters.
The revenues of music networksincreased by 10.2 percent in 1997 ina total radio advertising marketworth Ffr6.9 billion ($1.13bn),according to advertising data compil-er Secodip. Overall French radioadvertising expen-diture grew by 2.1percent. Secodip'sfigures show thatFrench recordlabels spent a totalof Ffr511.7 millionon radio advertis-ing in 1997, upfrom Ffr497.7m in 1996.
Secodip monitors radio ad spotsand then matches them with officialstation rate cards, without takinginto account discounts, free spots,group deals, etc. Therefore the actualnet advertising revenue figure couldbe 30 to 40 percent lower than theSecodip figure, according to advertis-ing experts.
Yet the figures still give some
indication of the trends in the Frenchmarket. The 11 percent drop in rev-enues for national full -service net-works coincides with the drop inaudience at Europe 1 and the reallo-cation of several advertisers' budgetsfrom full -service to music networks.Altogether, the revenue share of full -service radio dropped from 50.9 per-cent in 1996 to 44.3 percent in 1997.
Secodip figures also give an indica-tion of the current state of the rivalradio sales houses. NRJ Regies,
which sells for theNRJ group, sawits revenues growby 12.3 percent toFfr998.5m, whileEurope Regie (rep-resenting Europe1, Europe 2, RFM,Skyrock and local
radio grouping Les Independants)posted a modest 2.9 percent growth atFfr1.5 billion.
IP (RTL, RTL2, Fun Radio) lostsome ground with a 3.6 percent dropin revenues, but it remains the mar-ket leader with a 34.9 percent share.
GEM also saw its share of revenuego down, by 6 percent Its two mainclient stations-Nostalgie and RMC -both lost revenue share during 1997.

Arista Ushers in radio smashWanna very early, before its release,"reports Glen White, head of music atU.K regional dance station VibeFM/Bury St.Edmunds. "Several of thepresenters' gut feel was that it wasgoing to be big. And it was."
Arista head of R&B Mervyn Lyncomments: "When his debut albumUsher came out in 1994 there was littlesupport for black R&B on U.K radio.Back then, we released two singleswhich both went Top 40. Now radio ismuch more open to this style of music.People like [BBC Radio 1 head ofmusic] Jeff Smith have helped to openradio to R&B."
In the Netherlands, Come Klijn,presenter, producer and programmerof the Kort en Klijn show on publicCHR station Radio 3 FM, recalls: "Thefirst time I heard this stuff was lastautumn when I listened to a Lafacesampler which featured Make MeWanna and Nice And Slow. Both thesesongs just stood out, and I was con-vinced that Make Me Wanna should bethe first single."
A few weeks later, Klijn visited
New York, where several stations hadthe track on particularly intensiverotation. "I sort of adopted this methodback home and it worked very well. Alot of credit should go to the producersL.A. and Babyface, who have found aperfect formula for coming up withR&B crossover hits of such as TonyRich's Nobody Knows [LaFace/Arista]and Eric Clapton's Change The World[Reprise]. These records also cleverlyincorporate acoustic guitar partswhich renders them very useful formultiple formats."
With his second album, Usher iswell on the way to breaking into thepop sphere. "I was already noticinginterest from specialist [R&B] circlesin the run-up to the release," recallsArista's Lyn. "Our aim was to add tothat and to extend his appeal by estab-lishing him as a bit of a heart-throb."

The follow-up Nice & Slow is dueout on in Europe on March 16, exceptin the U.K., which will follow on April6. Arista plans to work the track in itsoriginal slow ballad form and in a B -Rock remix "which brings the tempoup just enough to bring it onto thedancefloor," according to Lyn. For the first time thisyear, the Swedish govern-ment participated in theawards directly by creating aspecial prize for "exceptionalefforts for Swedish music lbexports". The ratisic industry has longcomplained that the political establish-ment has ignored the large sums gener-ated by Swedish music sales abroad,

Parallel imports stream into U.K. marketdate been a nebulous, unquantifiedtrade. The BPI now says trans -ship-ments were directly responsible for a1.7 percent decline in the value of ship-ments made by U.K labels last year.
BPI director of research Peter Soap-ing says he believes British retailersbought around 4 percent more musiclast year but, because the strong Britishpound made imports cheaper thandomestic product, store chains mademany of their purchases elsewhere inthe EU-thereby undermining sales for

Retailers tend to remain tight-lipped because, although they wantthe cheapest product they can obtain,they do not want to destroy the good-will and cooperation they enjoy withtheir local labels.
Overall, the value of shipments byU.K record companies fell 1.7 percentto £1.059 billion ($1.7bn) in 1997.Within that figure, the volume ofalbum shipments was down 5.1 per-cent to 197.9 million units. The valueof the albums market fell 4 percent to£919.3m. One bright spot for Britishlabels was the singles sector, wherevolume was up 11.2 percent to 87 mil-lion units and value rose 16.8 percentto £140.1m.

"Moreover," Vosseler adds, "theIFPI agreement is what allows stationsto receive free of charge all the newreleases from record companies. That'swhy we have asked our members tostop all promotionalservice to stations thathave unilaterally bro-ken the agreement."
Jacky Sanders,director of music pro-gramming at Geneva -based CHR station Radio Lac, con-firms: "We are not receiving any newreleases, and all our requests for artistinterviews have been turned downsince mid -January."
The record labels will not commenton the situation, but an un-namedhead of a promotion department at amajor company recently told Swissdaily La Tribune de Geneve: "We don'tunderstand what's going on-we aresimply obeying instructions, and untilfurther notice, we are not servicingstations or setting up interviews withour artists."
Warns IFPI's Vosseler: "Nothingcan force us to supply stations with freerecords. If we were going to court, I'mconvinced judges wouldn't decide thatwe should supply free product to radiostations who don't respect our rights,"
According to Vosseler, IFPI Switzer-land is ready to let Swissperform col-lect the reproduction rights paymentscurrently collected by IFPI, providingthe stations pay the appropriateincrease in fees.
`This conflict demonstrates thatwhat is at stake is a matter of princi-ple, as the sums of money in questionare not important," reflects YvonneBurckhardt, director of Swissperform."But it is fundamental that the repro-duction rights are recognised and thatthe different uses of music are differen-tiated in order to protect all the inter-ests of rights owners."
Currently, negotiations betweenIFPI Switzerland and representativesfrom VSP and RRR are non-existent.IFPI's strategy is to break the coalitionof broadcasters by dealing with eachradio station individually.
"We have started to negotiate sta-tion -by -station and, in the German-speaking region, the situation is start-ing to get back to normal," reportsVosseler. "The sums involved are verysmall, smaller than what stationswould pay if they had to buy therecords themselves."
RRR's Pierre Steulet contends that:"Mr. Vosseler has a very personal viewof the situation and is putting pressureon record companies, but we are nowgoing to see all the labels, one by one,and we think the situation will returnto normal pretty soon."
Meanwhile, La Tribune de Genevereports, "the coalition of record labelsaffiliated to the IFPI is starting tocrack under the pressure of some mar-keting guerrillas who are discreetlysupplying promotional material toradio stations."

German royalties collection society GEMA isapparently demanding DM1.5 million ($0.9m) inperformance royalties for a concert in a court casewhich could make history. The concert was givenby the Three Tenors-Jose Carreras, PlacidoDomingo and Luciano Pavarotti-on August24, 1996. It attracted 60,000 visitors and, saysGEMA, grossed DM45m ($26.5m). Mannheim con-cert promoter Hoffmann Konzerte offered GEMADM40,000 ($24,000) based on the German royaltyrate for classical performances, set at 0.089 percentof the takings. GEMA insists the Three Tenors con-cert was a "large scale entertainment show"-not aclassical concert-and is suing Hoffmann Konzertefor the full "pop" royalties rate of 3.424 percent.
Speculation about a significant programmingreshuffle at U.K. public MOR station BBCRadio 2 in the spring has increased with thenews that afternoon presenter Debbie Throweris leaving the network at the end of May-herreplacement has yet to be named.
OTR hears that U.K film distributor and pro-ducer Metrodome Group plc has stepped into themusic world by acquiring 75 percent of independentlabel Dressed To Kill (DTK). The label, set up in1995 by George Kimpton-Howe (formerly withdistributors Pinnacle and his own Rio) and busi-ness partner Robin Greatrex, specialises in com-pilation box sets.
