THE JUDGE AMD THE PKISONEB

In the Circuit Couit yesterday thepresiding judge created a sensationby Imposing a nominal sentence onlyon a Hawaiian whom the jury hadfound guilty of larceny in the seconddegree an offenso punlahabla withimprisonment at hard labor Tho sen-

tence imposed was that the man besent to prison for one hour

This peculiar action of tho judgeis explained by him in his newspaperthis morning In the following reportof the proceedings which reads

When Naiheo was brought in guiltyof larceny by the jury yesterday evening as stated in the court proceedingselsewhere both the prisoner and hisattorney Mr Bigelow stated that theformer had been In prison five monthsawaiting trial Not only that butfor four months of the period Naiheohad been required to perform hardlabor

Tho court asked the prisoner if hehad voluntarily performed such laboror if he was required to do it by theprison authorities Nalhee repliedthat ho did it solely because he wascompelled to do it His labor con-

sisted in breaking coral rockWas he required to peiform this

labor in company with prisoners inconvict garb serving sentences forcrime the court inquired

Yes the prisoner answeredThereupon the court said it had be-

fore denounced the practice of requlrIng prisoners who are awaiting trialbut not convicted to perform hardlabor or any labor at all except to po

lice their quarters and that it Intended whenever the law was violated by

the authorities in this respect to impose the lightest possible sentenceupon tho person whose rights hadbeen invaded

Mr Dunn representing the Terri-tory remarked that ho would takepleasure in bringing the matter to theattention of the authorities

To this the court replied that it didnot think such infoimation would doany good as he had on more than oneoccasion denounced tho practice

Thereupon the court sentenced thedefendant to bo imprisoned at hardlabor for tliei period of one hour andthe officer was instructed to ieleasehim at 7 oclock all costs being re-

mitted¬

Wo believe that the Circuit Judgehas simply been misinformed becausewo have not yet noticed that he hasexhibited any special animus againstthe Oahu Prison for which he in hisgrand jury charge rather seemed tohave a perhaps natural sympathy

We have no reason to entertain anyfriendly feeling for that institutionbut we do not hesitate for a momentto say that the man tho Judge treat-

so leniently lied In tho prison themen awaiting trial arc at all timeskept apart from the convicts a rulewhich any Warden will uphold strict-ly

Most prisoners awaiting tilalsmay be released at any moment onball and if allowed to mix with con-

victs all kinds of arrangements couldbe made for escapes and a nice stateof affairs occur As to a prisonerawaiting trial being forced to workin tho convict gang is all bosh Hewill be asked to clean his cell toempty that beastly bucket and per ¬

haps even to help in sweeping theyard or do some light chores withinthe walls of the prison In ninetynine instances out of a hundred hewill be only too glad to put his handto something so as to pass tho wearytime but in no case have we everseen or heard of a prisoner awaitingtrial being ordered or forced towork

We have had the pleasure of payinga prolonged though not quite volun-tary visit to Oahu Jail and we havecarefully watched tho manner Inwhich convicts as well as prisonersawaiting tiial are treated Thecharge against the jail by the CircuitJudge is absolutely without founda-tion but we presume that by lettingNalhee off easy he thought he strucka body blow at the High Sheriffwhich ho couldnt get in over theshoulders of tho urana Jury

In the Circuit Couit yesterday thepresiding judge created a sensationby Imposing a nominal sentence onlyon a Hawaiian whom the jury hadfound guilty of larceny in the seconddegree an offenso punlahabla withimprisonment at hard labor Tho sen-

tence imposed was that the man besent to prison for one hour

This peculiar action of tho judgeis explained by him in his newspaperthis morning In the following reportof the proceedings which reads

When Naiheo was brought in guiltyof larceny by the jury yesterday evening as stated in the court proceedingselsewhere both the prisoner and hisattorney Mr Bigelow stated that theformer had been In prison five monthsawaiting trial Not only that butfor four months of the period Naiheohad been required to perform hardlabor

Tho court asked the prisoner if hehad voluntarily performed such laboror if he was required to do it by theprison authorities Nalhee repliedthat ho did it solely because he wascompelled to do it His labor con-

sisted in breaking coral rockWas he required to peiform this

labor in company with prisoners inconvict garb serving sentences forcrime the court inquired

Yes the prisoner answeredThereupon the court said it had be-

fore denounced the practice of requlrIng prisoners who are awaiting trialbut not convicted to perform hardlabor or any labor at all except to po

lice their quarters and that it Intended whenever the law was violated by

the authorities in this respect to impose the lightest possible sentenceupon tho person whose rights hadbeen invaded

Mr Dunn representing the Terri-tory remarked that ho would takepleasure in bringing the matter to theattention of the authorities

To this the court replied that it didnot think such infoimation would doany good as he had on more than oneoccasion denounced tho practice

Thereupon the court sentenced thedefendant to bo imprisoned at hardlabor for tliei period of one hour andthe officer was instructed to ieleasehim at 7 oclock all costs being re-

mitted¬

Wo believe that the Circuit Judgehas simply been misinformed becausewo have not yet noticed that he hasexhibited any special animus againstthe Oahu Prison for which he in hisgrand jury charge rather seemed tohave a perhaps natural sympathy

We have no reason to entertain anyfriendly feeling for that institutionbut we do not hesitate for a momentto say that the man tho Judge treat-

so leniently lied In tho prison themen awaiting trial arc at all timeskept apart from the convicts a rulewhich any Warden will uphold strict-ly

Most prisoners awaiting tilalsmay be released at any moment onball and if allowed to mix with con-

victs all kinds of arrangements couldbe made for escapes and a nice stateof affairs occur As to a prisonerawaiting trial being forced to workin tho convict gang is all bosh Hewill be asked to clean his cell toempty that beastly bucket and per ¬

haps even to help in sweeping theyard or do some light chores withinthe walls of the prison In ninetynine instances out of a hundred hewill be only too glad to put his handto something so as to pass tho wearytime but in no case have we everseen or heard of a prisoner awaitingtrial being ordered or forced towork

fense with which he is charged to belocked up for months because he isunable to procure bail but the faultIs not with tho authorities but withtho law and we shall heartily endorseany action or suggestion on the partof the judge editor which ho maymake to remedy the existing laws

We have had the pleasure of payinga prolonged though not quite volun-tary visit to Oahu Jail and we havecarefully watched tho manner Inwhich convicts as well as prisonersawaiting tiial are treated Thecharge against the jail by the CircuitJudge is absolutely without founda-tion but we presume that by lettingNalhee off easy he thought he strucka body blow at the High Sheriffwhich ho couldnt get in over theshoulders of tho urana Jury
