1. Terms of Reference (ToR)

1.1 Background Tourism is a key focus area for Government of India and the State Government of Andhra Pradesh. In order to promote investments in tourism sector through Private investments, PPP projects and Government projects. The Government of Andhra Pradesh has introduced Tourism Policy 2015 - 20 (available at www.aptourism.gov.in) and a Land Lease Policy to boost investments into the tourism sector, to transform scenic locations of the State into world-class tourism destinations and provide complementary tourism infrastructure as catalyst for growth of tourism in the State.

1.2 About the project

Government of Andhra Pradesh intends to develop Buddha Memorial Project towards creation of a destination that caters to requirements of followers/philosophers of Buddha and other tourism attractions that cater to the overall tourism requirements of the area.

The site proposed for the project is juxtaposing the Kanaka Durga temple in Vijayawada and will be on the other side of the banks of river Krishna. This site (mentioned above) is in proximity of the tourism destinations/ attractions such as Bhavani Islands, Kanaka durga temple, Krishna Pushkar Ghats and other Buddhist monuments etc.

Given the undulating nature of land and hilly portions in this area, it is felt that the highest point of this area will be considered suitable for installation of a tall Buddha statue. The surrounding development would accordingly be expected to reflect Buddha’s ideology and also provide other facilities such as dhyan-mandirs, museum’s to showcase the history of Buddhism. The other add-ons would include facilities and amenities to cater to tourists of all age groups. 1.3 Andhra Pradesh- India’s sunrise state

1.3.1 General Overview The erstwhile state of Andhra Pradesh was bifurcated into two states, Telangana and residuary Andhra Pradesh on 2nd June 2014. After bifurcation, Andhra Pradesh is the 8th largest state in terms of area. The state has well-developed social, physical and industrial infrastructure and virtual connectivity. It also has good power, airport, IT and port infrastructure.

Andhra Pradesh is the tenth largest state in the Country, in terms of population. The percentage of urban population to the total

population in the State is 29.47 percent in 2011 as compared to 24.13 percent in 2001.

Andhra Pradesh’s geographical position and rich history gives it unique strengths which not many States in India have. These include – a long coastline of 974 kilometers, over 30 thousand temples, prime Buddhist sites spread across the State, and fertile lands drained by two mighty rivers of the country i.e. Godavari and Krishna, hills of Deccan plateau, upcoming metropolis like Vishakhapatnam and Vijayawada and an opportunity to create a world class capital right from scratch!

Given this vast potential of the State, the Government of AP wishes to facilitate investments in the State by identifying areas of opportunity for both Private and Government projects which can promote and/or support tourism in the State.

1.3.2 Economic profile of the State The Government of Andhra Pradesh’s vision is to be amongst the top 3 States in tourism in India by 2022, the top State in India by 2029, and be the most preferred global destination by 2050, in Tourism. The state is a progressive State and the government is taking steps to provide an environment conducive to economic and social growth. These include formulation of investment friendly policies; creating world-class infrastructure; improving governance and taking necessary steps to attract investments into the state. Promotion of tourism infrastructure and services at potential destinations is one amongst the many initiatives being taken up by the Government on a priority basis.

Implementation of appropriate policies and programmes by the state have enabled the State to register an impressive growth rate of 10.99% in the GSDP for the year 2015-16, compared to India’s growth rate of 7.6%.

Andhra Pradesh contributes around 4.04 per cent share to the cumulative FDI inflows of India in FY 2015-16. Rich in natural and human resources, the State is keen to leverage its strengths through district specific growth strategies and achieve double digit growth targets. While focus will be on Coast-led growth, manufacturing, agro-processing, pharma, development of physical infrastructure like ports, airports and

river ways are some of the key areas identified for pushing the growth significantly. Sector specific strategies have been developed to achieve desired inclusive growth.

1.3.3 Development plan of the State Andhra Pradesh, the Sunrise state, is all set to attain new heights in the coming years. Necessary policies and implementing mechanisms have been put in place to drive and sustain the growth momentum to achieve the vision of making the Andhra Pradesh as one of the top three high-performing States in India by 2022 and the best state in the country by 2029.

The State is undertaking massive infrastructure investment and industrial development in the State. Some of the key projects include:

a) 3 Industrial Hubs at Amaravati, Visakhapatnam and Tri-city (Tirupati-Nellore-Chittoor) b) 3 Industrial Corridors (Visakhapatnam-Chennai Industrial Corridor, Chennai-Bengaluru Industrial

Corridor and Bengaluru-Kurnool Proposed Corridor) c) 32 SEZs, 258 Industrial parks

Visakhapatnam- Chennai Industrial Corridor Chennai- Bangalore Industrial Corridor

The VCIC is a key part of the planned East Economic Corridor and India’s first coastal corridor and the extent of it is considered from Pydibheemavaram in Srikakulam district to Chennai in Tamil Nadu. It has influence area about 1,10,000 sq. km, (3.5% of India’s area). The corridor contributes to 5% of national GDP.

Focus Industries: Food processing, Chemical & Petroleum, Textiles, Electronics, Metallurgy, Pharmaceuticals, Automobiles & auto ancillary etc.

CBIC is one of the mega Infrastructure projects of Government of India which passes through the State. With the main objective to increase the share of manufacturing sector in the GDP of the country and to create smart sustainable cities which will have world-class infrastructure, convenient public transport etc.

Focus Industries: General manufacturing; Automobiles & auto ancillary; agro and food processing; metals and metallurgical products; Biotech and Services sector.

1.4 Tourism in Andhra Pradesh

Government of Andhra Pradesh (GoAP) vision is to be amongst the top 3 States in India by 2022, the top State in India by 2029, and be the most preferred global destination by 2050. The government is taking steps to provide an environment conducive to economic and social growth. These steps include formulation of investment friendly policies, creating world-class infrastructure, improving governance and taking necessary steps to attract investments into the State. Promotion of tourism infrastructure and services at potential destinations is one amongst the many initiatives taken up by the GoAP.

In line with the objective to make Andhra Pradesh the premier destination for tourists in the country, Government of Andhra Pradesh has identified nine key theme areas to be developed. The theme areas are listed below:

There has been steady increase in both domestic and international tourist arrivals from 2011-12 to 2015-16.

2. Scope

2.1 Scope of Work and Deliverables To develop the site master plan of area along with the landscaping of total area including design and structural detail of Buddha statue and surrounding area conforming to Indian standards wherever applicable / PWD guideline and where such standard or guideline not available international standards are applicable. The consultant shall bind to design the project as per the conditions laid by ministry of Environment and forest (MoEF) for project. — Preparation of Detailed Project Report (DPR), considering all the requirements and concept

that Govt. of Andhra Pradesh intends to develop the site. — Preparation of detail estimate of the project with detailed drawing and design, getting technical

sanction from the competent authority and preparation of Draft Tender Paper comprising bid conditions, bid documentation, bid specification, specification for memorial such that the statue expected to last for at least 5 centuries and other facilities and buildings structure with least maintenance for 100 years along with Bill of Quantities (BOQ), all detailed drawings & Structural design of the project. Also local architecture and motifs shall be appropriately incorporated in the design to portray the Indian heritage features in place of tourist importance.

— To examine emergency evacuation during natural calamity with required infrastructure for safe landing under manmade or natural emergency.

The PMC shall perform the following Services for the Project under this Agreement as described below: — From structural design, detailed drawing, with proof check from agencies approved by PWD

and preparation of detailed Estimate (SR & Non SR Items should be supported by proper documentation as per requirement of Engineer-In-charge), to actual construction, supervision, equipment planning, training and commissioning. Master planning of area and preparation of DPR.

— The PMC shall give the Mission and Vision Document to guide all current and future works. “No separate fee shall be paid to the PMC for hiring consultancy services if any, for any of the services required for execution of the project.”

COMPREHENSIVE SERVICES:

I. The PMC should develop the conceptual plan taking into account the conceptual proposal. II. PMC should prepare master plan of the total area. The master plan includes but not limited

to: — Technical Studies including demand market assessment, need analysis, benchmarking

of similar projects globally including the concepts, feasibility and scope of various project structures.

— Preparation of Project master plan including and infrastructure plan for the area and guideline specifications.

— Financial studies evaluating the revenue generation and financing mechanisms for various project components.

— Taxation structure analysis and means of getting tax exemptions. — Cultural studies to enhance the project educational value to the public. — Tourism plan to attract domestic and international visitors and improve the project

attractiveness and revenue generation. — Developing interpretation for the museum and exhibition centre from a functional

planning perspective — Development of environmentally sustainable solutions to the project components.

Conceptual design stage: The PMC shall

i. be responsible for developing the Design Brief Details, Area Statement, and detailed memorial area layout with all services such as following facilities.

a. It is proposed to have efficient clean water supply & sanitary fitting and fixtures and appropriate services

b. Energy efficient electrical fittings and fixtures c. Possible use of solar energy. d. Strom water utilisation. e. Renewable energy conservation. f. Waste water treatment arrangement. g. Water recycle and reused (Including rain water)

h. Optimized design to reduced conventional energy, water, etc.

ii. develop a phased roadmap for integration of the entire campus. iii. Develop Concept Plan acceptable to Employer. iv. Interact with Employer, modify the concept design, if required, incorporating necessary

changes and submit revised/modified conceptual design with reference to the requirements given, providing details of useful area, circulation area, plinth area, ground coverage, and broad specifications etc.

v. Obtain appoval of final Concept Plan from Competent Authority vi. Propose methodology

vii. Steps (i) to (vi) shall be repeated as per requirement and as directed by Employer. viii. All concerned experts in all fields such as the following shall remain present at every stage

during finalization of conceptual design: a) Architectural b) Electrical, HVAC, & Plumbing c) Consultancy for Design of waste management system. d) Security consultancy e) Structural Consultancy. f) All types of survey Works. g) Geo tech consultancy. h) MOEF consultancy. i) Master planning and infrastructure planning consultancy. j) Green building certification consultancy. k) Traffic consultancy. - Traffic impact assessment studies. l) Vertical Transport consultancy.

Preliminary Drawings / Design Stage: The PMC shall

i. Arrange environmental clearance certificates from the concerned authorities as per requirement. The Statutory fee for such clearances will be borne by the Employer.

ii. Prepare report on site evaluation. iii. Geotechnical/sub soil investigations necessary for facilitating design of various structures. iv. Conduct detailed topographic survey of the project site. v. Carry out surveys of all existing services in site area & necessary surveys for features

services should be carry out by PMC. vi. Undertake preliminary planning on the basis of approved concept design and observations

of Employer. vii. Prepare and submit preliminary drawings, designs, specifications etc.

viii. Suitably modify the preliminary drawings, designs, etc. as discussed with Employer ix. Prepare detail estimates as per PWD norms and get them sanctioned from Competent

Authority. x. Submitted Drawing to local bodies, Aviation authority etc. for clearance and arranged

approval the statutory fees for such clearances will be borne by the Employer.

xi. Proof checking/ Vetting of Architectural drawings shall be got done through PMC Selection Committee

xii. Obtain the necessary Building permission from Competent authority / Local authority including fire & fire fighting, arrange water supply connection, Drainage connection, Electrical Connection and shifting of High Tension towers, utility shifting and other necessary approvals, NOC’s and permissions required for the Project at any stage of the project. The fee for such clearances shall be borne by the Employer.

xiii. Steps (i) to (xiii) shall be repeated as per requirement and as directed by Engineer in- charge.

Detailed Design Stage: The PMC shall

i. Prepare detailed Architectural, Structural, Services drawings including drawings showing details of all utilities and internal & external services, specifications after incorporating all revision with integration of all services.

ii. Prepare complete Architectural, Structural and services design & drawings, working details, schedules, specifications including Architectural design, Structural details, Electrical details, HVAC system , Acoustic designs, sanitary and plumbing details, communication and networking plan, call system, fire detection, Fire protection and fighting systems, water supply and sewerage details, Environment sustainability, Rain water harvesting, EIA and clearance, Solid waste water management(SWM), including Bio-medical waste management, Detailed Furniture layout for all units and its specification, Electrical layout and details, integration of all systems and services, Specialist services like audio- video, IT and Intelligent Management system, Operating Workflows and systems, EPABX, Glazing, HR Planning, Organization and Manpower plan, Traffic and Parking system, Security system, Landscape Architecture (Site Planning Land form and grading, surface drainage, Irrigation, Hard and soft copy, garden Furniture, Illumination), schedule of finishes, Structural design, detailed drawing, with Proof PMC approved by PWD and preparation of detailed Estimate (SR & Non SR Items should be supported by proper documentation as per requirement of Engineer-In-charge), and get them approval from Competent Authorities and from all the local bodies, etc. The PMC shall provide 10 sets of drawings to the employer and soft copy.

iii. Proof checking / vetting of structural designs of all structures shall be got done through Proof PMC to be appointed by the Engineer- in- Charge. For the selection of Proof PMC, the PMC shall suggest three Proof PMCs out of which the Engineer in-charge has to select one. And the Fee for such PMC shall be borne by the PMC itself.

BID PROCESS MANAGEMENT — Preparation of tender documents including specifications, drawings etc. and get approvals to

them from Competent Authorities. — Invite the tenders in standard “C-Format” through wide publicity in national level newspapers

ensuring competitiveness in addition to placing Tender on the website — Hold pre-tender meeting in a pre-determined manner and offer clarifications, if any, sought by

the tenderers. The clarifications relating to the RFP shall be drawn up by the Engineer-in-charge with the help of PMC and, the same shall be issued to the intending tenderers with due

approval from Competent Authority. The clarifications issued shall form a part of the main Contract document for the work.

— Help employer to evaluate the bids and issue Letter of Acceptance to the selected Contractor(s) and take further necessary actions in accordance with the tender conditions.

CONSTRUCTION STAGE ACTIVITIES Construction & Commissioning — PMC through selected contractor shall be responsible for executing and commissioning the

work on a turnkey basis and shall be responsible for getting the project facility constructed as per approved designs. Towards this the Engineer-in-charge shall engage various contractors and suppliers and enter into Project Contracts with such contractors and suppliers. The PMC shall be responsible to assist Engineer-in-charge for the soft commissioning, shakedown, final commissioning and hand over of the facility in functional order/condition to the Employer.

Construction Supervision — Carry out checking and verification of the setting-out data for the work including lines, levels

and layout to ensure conformity with the working drawings, — Lay down a proper quality assurance system and ensure conformity to the same by the

Contractor, including deputing an exclusive quality control / quality assurance engineer at site of work for all engineering and construction activities

— Review Contractor’s work programme, suggest modifications, if any, and approve the work programme after a careful study keeping in view the overall interest of the project.

— Review and approve the construction methods proposed by the Contractor for carrying out the works to ensure that these are satisfactory with particular reference to the technical requirements, project implementation schedule and environmental aspects as well as safety of works, personnel and the general public.

— To have utility diversion plans prepared by the Contractor and follow up with the utility owners concerned.

— Review and suggest modifications to the traffic diversion plans prepared by the Contractor during construction period in consultation with the departments concerned.

— Regular monitoring of the Contractor’s equipment, plant, machinery, installations, personnel etc. and ensure the adequacy in accordance with the terms and conditions of the Contract.

— Direct the Contractor to carry out all such works or to take necessary actions as may be necessary to avoid or to reduce the risk in case of any emergency affecting the safety of life or of the works or of the adjoining property and advise the Engineer-in-charge thereof as soon thereafter as is reasonably practicable, including deployment of a safety engineer.

— Interpretation of the technical specifications and Contract documents, wherever required. — Inspect the works on substantial completion before taking over and indicate to employer any

outstanding work to be carried out by the Contractor. — To carry out all functions of as stipulated in the Contract(s) executed with the Contractor(s)

engaged for the execution of the Project. — Represent the interest of the Employer, in all matters related to the construction Contract and

the proper execution thereof. — The PMC shall develop a project schedule, project budget and cash flow statement as soon as

major project requirements have been identified, and update periodically.

Progress of Works — Systematically check the progress of the works and order the initiation of the work which is

part of the Contract. — PMC shall take corrective measures with respect to items executed in non- conformity to the

standards as laid down in this document. — Maintain an up-to-date status of all construction activities against the original schedule for

completion of works. — Investigate and assist Employer to and initiate early actions with regard to the delays in the

execution of works. PMC shall explain in the monthly progress and special reports the reasons for delays and explain the actions to be taken / already taken to correct the situation. All reports prepared by the PMC shall be objective and shall substantiate any event / recommendation with factual data and information. The Progress Reports shall contain the pertinent data indicating the comparison between the projected and the actual work done.

Measurement of works and Payment — PMC shall record and verify all the field measurement of completed works and of quantities

of materials incorporated in the work being carried out by the Contractor(s), and get them cross- checked from Employer’s representatives

— Checking and certification of all monthly bills, interim bills, escalation bills, final bill of the Contractor and forward with recommendation to employer.

— Scrutinize and recommend suitable action on the claims raised by the Contractor, if any, — Assist with matters relating to the audit queries and para. — Prepare and submit a detailed statement of closure report of the Project on its completion.

COMPLETION CERTIFICATE — PMC shall prepare and recommend the Completion Certificate to the Engineer-in-charge on

completion of the Project in accordance with the Contract, after due approvals from Competent Authorities.

— PMC shall submit and procure completion plans to local bodies like Municipal Corporation/Fire/Traffic/Police/Naval /Aviation etc. for obtaining completion certificate. Similarly, fitness certificates for operating Lifts / Escalator shall be obtained by PMC.

MAINTENANCE SCHEDULE: — PMC shall assist to ensure AMC/CMC for all equipment and machinery deployed. — Final measurement sheets shall be prepared for all building works for carrying up maintenance

work. — PMC shall assist in rectification of defects, if any, during the defects liability period, in

accordance with the Contract.

MAINTENANCE MANUAL: — The PMC shall prepare and submit a maintenance manual giving procedure for maintenance,

including inspection, tools and equipment to be used, means of accessibility for all parts of the structure. The PMC shall also include in the manual, the specification for maintenance work

that would be appropriate for its design and technique of construction. This manual shall be submitted within the contract period.

PROCUREMENT OF EQUIPMENT For preparation of Procurement Plan: — Review of technical specifications; Pre-qualification (as applicable) — Assist in Pre-bid meetings; Solicitation; Opening of Bids; Evaluation of Proposals — Assist for award of work; issue of contracts/purchase orders — QC standards verification/inspection where necessary — Assist in Placing purchase order; pre-dispatch inspection and shipment — Delivery to consignees; liquidated damages on account of delayed deliveries — Post-delivery/installation inspection; inspection by independent/accredited agencies — Installation, user training, commissioning in sync with building construction — Contract management, enforcement of warranty and AMC services — Hand-holding in initial procurement & management of basic/essential services TRAINING AND CAPACITY BUILDING — Training and capacity development of key staff in national and international best practices in

project management, procurement services and Equipment training. — Transfer of relevant knowledge/soft skills, SOPs, templates in relevant aspects of project

such other aspect and in the format required by Employer. — The PMC including its concerned staff shall be present for the Monthly/ Weekly meeting (or

any other meeting with regards to the Project), held on the Site/ Head Office/ any Venue as decided by the Employer. The PMC shall submit a report of the said meeting, clearly mentioning the actions taken on the instructions given by the Employer or any representative.

2.2 Project Milestones & Timelines

2 Governement may at its discretion terminate the services of the Consultant after completion of any stage and the Consultant will then be paid only for the stages completed.

3 All the payment under this contract will be made only in Indian Rupees. 4 The fees/price may be quoted in Indian Rupees only. 5 The consultants shall be paid for the services rendered as per the TOR as per payment schedule

given above. The Service Tax prevalent will be paid extra to the consultant.

2.2 Review & Reporting: 1. The Agency shall work under guidance and overall supervision of MD-APTDC, GoAP 2. Weekly reports on activities and output shall be provided by the Agency team to APTDC,

who will oversee their day to day functioning. 3. Monthly governance review with Tourism Apex body/Tourism Board/Tourism Secretariat

of GoAP and other senior government stakeholders will be conducted on status, dashboards, progress and any issues

4. All resources will be stationed onsite during the project duration and will require approval from MD-APTDC for any change in team structure and composition, once the project starts.
