EXEMPTION/S GRANTED

The following application for exemption from the provisions of the Anti-Discrimination Act 1998 (Tas) (the Act) has been granted:1. Womens Shelter Inc trading as Hobart Womens Shelter –

16/08/052 – Application for an exemption granted under section 57 of the Act for a period of three years.This exemption has been granted to permit Hobart Womens Shelter to recruit and employ women only in all paid positions with Hobart Womens Shelter; and recruit and engage women only in all positions on the volunteer governance board of the Hobart Womens Shelter on the basis it is consistent with:

a) section 25 of the Act, which provides an exception for discrimination ‘for the purpose of carrying out a scheme for the benefit of a group which is disadvantaged or has a special need because of a prescribed attribute’; and

b) section 27(1)(d) of the Act, which provides an exception for gender discrimination ‘in employment, if it is based on a genuine occupational qualification or requirement in relation to a particular position’.

Granted on the 12th day of October 2016.

The exemption is for the period of three (3) years subject to the fulfilment of the conditions that Hobart Womens Shelter:

a) continue its efforts to engage men in supporting its work through its fundraising committee and in primary prevention activities and partnership projects; and

b) report on or before 30 April 2017 to the Anti-Discrimination Commissioner on any actions taken in reliance on this exemption; and

c) on at least one occasion in the 12 months immediately the date of this exemption order, organise and promote community education for the staff, members, officers and volunteers of Hobart Womens Shelter through Equal Opportunity Tasmania’s community education program to increase awareness of rights and obligations under the Anti-Discrimination Act 1998 (Tas); and

d) ensure that Equal Opportunity Tasmania brochures about protections from discrimination under the Act, particularly in relation to discrimination, offensive

conduct, gender discrimination and sexual harassment, are made available to clients of the service and Equal Opportunity Tasmania posters about protections under the Act are displayed in areas where clients of the service are likely to be present.

A person may apply to the Anti-Discrimination Tribunal for a review of the Commissioner’s decision within 28 days from the date of this notice being published.

IN ACCORDANCE with the provisions of the Rules Publication Act 1953, notice is given of the making of the following statutory rules:—

GENERAL PURPORT OR EFFECT OF THE ABOVEMENTIONED STATUTORY RULES

(1) Firearms Regulations 2016These regulations –

(a) prescribe various matters for the purposes of the Firearms Act 1996 including –

(i) the manner in which heirloom firearms and firearms in a firearms collection are to be rendered permanently incapable of being fired; and

(ii) the periods for which firearms licences remain in force; and

(iii) safety requirements for conveying firearms; and

(iv) the particulars required to be kept of dealings with firearms between licensees; and

(v) fees for licences, permits, registrations and other matters under that Act; and

(b) are made consequentially on the repeal of the Firearms Regulations 2006 under section 11 of the Subordinate Legislation Act 1992.

(1) Relationships Amendment Regulations 2016These regulations amend the Relationships Regulations 2013 to prescribe –

(a) the following classes of relationships for the purpose of section 65A(1) of the Relationships Act 2003:

(i) marriage of two people, regardless of their sex, sexual orientation, or gender identity, under the Marriage Act 1955 of New Zealand;

(ii) marriage of same sex couples under the Marriage (Same Sex Couples) Act 2013 of the United Kingdom;

(iii) marriage of two persons, without distinction as to their sex, under the Marriage Act 2015 of the Republic of Ireland; and

(b) the following laws as corresponding laws for the purpose of section 65A(2) of the Relationships Act 2003:

(i) Marriage Act 1955 of New Zealand;

(ii) Marriage (Same Sex Couples) Act 2013 of the United Kingdom;

(iii) Marriage Act 2015 of the Republic of Ireland.
