Article 1.—DISEASES

28-1-20. Immunizations; schools, child care facili-ties, family day care homes, and preschool or child careprograms operated by a school. (a) Definition. For thepurposes of this regulation, ‘‘susceptible child’’ shallmean either of the following if, for that individual, thereis no history of the disease that has been documented bya licensed physician, no laboratory documentation of im-munity, or no documentation acceptable to the secretarythat demonstrates current vaccination against the disease:

(1) Any individual who attends school as defined inK.S.A. 72-5208, and amendments thereto; or

(2) any individual who is enrolled, is placed, or residesin a child care facility as defined in K.S.A. 65-503, andamendments thereto, a family day care home, or a pre-school or child care program operated by a school.

(b) Required vaccinations. Except as provided in K.S.A.72-5209(b) and amendments thereto, each susceptiblechild shall be required to receive the following vaccina-tions before enrolling in any Kansas school:

(1) Diphtheria;(2) hepatitis B;(3) measles (rubeola);(4) mumps;(5) pertussis (whooping cough);(6) poliomyelitis;(7) rubella (German measles);

(8) tetanus; and(9) varicella (chickenpox).(c) Immunization record for school entry. The immu-

nization record of each pupil shall document that the pu-pil has received the vaccinations specified in subsection(b) from a licensed physician or local health departmentor is not a susceptible child, on forms provided by thedepartment.

(d) Immunizations required for a child in a child carefacility, family day care home, or preschool or child careprogram operated by a school. Each susceptible child, in-cluding a child under 16 years of age of a child care pro-vider who is enrolled, is placed, or resides in a child carefacility, a family day care home, or a preschool or childcare program operated by a school, shall be required toreceive the following immunizations as medically appro-priate:

(1) Diphtheria;(2) Haemophilus influenzae type B;(3) hepatitis A;(4) hepatitis B;(5) measles (rubeola);(6) mumps;(7) pertussis (whooping cough);(8) pneumococcal disease;(9) poliomyelitis;(10) rubella;(11) tetanus; and(12) varicella (chickenpox).(e) Immunization records for a child care facility or a

family day care home. Each child’s immunization recordshall be maintained on the forms provided by the de-partment. Article 4.—MATERNAL AND CHILD HEALTH

28-4-117. Health care requirements for childrenunder 16 years of age. (a) (1) A completed medical recordon the form provided by the department shall be on filefor each child under 11 years of age enrolled for care andfor each child under 16 years of age living in the childcare facility.

(2) Each medical record shall include the results of ahealth assessment conducted by a nurse trained to per-form health assessments or a licensed physician, withinsix months before the child’s initial enrollment in a childcare facility.

(3) Each medical record shall include a medical historyobtained from the parent.

(b) A child under 16 years of age shall not be requiredto have routine tuberculin tests.

(c) Immunizations for each child, including each childof the provider under 16 years of age, shall be current asmedically appropriate and shall be maintained currentfor protection from the diseases specified in K.A.R. 28-1-20(d). A record of each child’s immunizations shall bemaintained on the child’s medical record.

(d) Exceptions to the requirements for immunizationsshall be permitted as specified in K.S.A. 65-508, andamendments thereto. Documentation of each exceptionshall be maintained on file at the child care facility.

(e) If an infant who has not been immunized againstmeasles, mumps, rubella, and varicella because of the ageof that child is enrolled and there are children in care whohave not had measles, mumps, rubella, and varicella im-munizations due to exemption, including the children ofthe provider, the parents of the infant at risk shall sign astatement that the parents have been informed of the riskto their child. This statement shall be in the infant’s fileat the day care or group day care home.

(f) If a child is moved to a different child care provider,a new health assessment shall not be required if the pre-vious medical record is available.

(g) Each licensee shall provide information to parentsof children in the licensee’s program about the benefitsof annual well-child health assessments for children un-der the age of six years and biennial health assessmentsfor children six years of age and older. Each licensee shallalso provide information about the importance of seekingmedical advice when children exhibit health problems.This information may be given on a form provided by thedepartment to the parent when the child is enrolled or beposted in a conspicuous place, with copies of the formavailable to parents on request. 28-4-120. Family day care home certificate of reg-istration. (a) Except as specified in subsection (b), eachindividual wanting to maintain a family day care homeshall obtain the forms to register the family day care homefrom either the secretary of the Kansas department ofhealth and environment or from the county health de-partment in the county in which the individual resides.

(b) Each individual maintaining a family day carehome may choose to be licensed pursuant to K.S.A. 65-501 through 65-516, and amendments thereto, rather thanregistering the family day care home. If the individualchooses to be registered, the individual shall not be li-censed to provide child care services at the same locationduring the effective period of the certificate of registra-tion.

(c) Each applicant shall be 18 years of age or older atthe time of application.

(d) When obtaining registration application forms, eachapplicant shall receive a family day care home safety eval-uation form, which shall be completed and forwarded,together with the application, to the Kansas departmentof health and environment.

(e) Each registrant shall maintain the family day carehome in the registrant’s residence.

(f) A copy of the regulations governing the registrationof family day care homes for children shall be kept on thepremises at all times.

(g) Each registrant shall notify the county health de-partment or the Kansas department of health and envi-ronment if child care services are discontinued. Resump-tion of child care services shall require a new applicationfor a certificate of registration.

(h) Each applicant receiving a notice of denial and eachregistrant receiving a notice of revocation of the certificateof registration shall be notified of the right to an admin-istrative hearing by the Kansas department of health andenvironment and subsequently to the right of appeal tothe district court. 28-4-121. Required immunizations for childrenunder 16 years of age. (a) Immunizations for each child,including each child of the registrant under 16 years ofage, shall be current as medically appropriate and shallbe maintained current for protection from the diseasesspecified in K.A.R. 28-1-20(d).

(b) Each registrant shall maintain, at the family day carehome, a record of each child’s immunizations on thechild’s medical record.

(c) Exceptions to the requirement for immunizationsshall be permitted as specified in K.S.A. 65-519, andamendments thereto. Documentation of each exceptionshall be maintained on file at the family day care home.(Authorized by K.S.A. 65-522; implementing K.S.A. 65-519; effective July 11, 2008.)

28-4-430. Health practices; illness and abuse; gen-eral health requirements for staff. (a) Children’s healthassessments.

(1) A preentrance health assessment conducted withinsix months before enrollment shall be required for eachchild. The assessment shall be conducted by a licensedphysician or by a nurse approved to perform health as-sessments.

(2) The results of the health assessment shall be kepton file at the child care facility.

(3) Children transferring from one child care facility toanother shall not be required to obtain a new health as-sessment if the previous assessment record is available.

(4) Tuberculin testing shall be required only if the childcomes in contact with a new active or reactivated case oftuberculosis. The results of the examination shall becomea part of the child’s health record.

(5) Immunizations for each child in care shall be currentas medically appropriate and shall be maintained currentfor protection from the diseases specified in K.A.R. 28-1-20(d). A record of each child’s immunizations shall bemaintained on the child’s medical record form.

(6) Exceptions to the requirement for immunizationsshall be permitted as specified in K.S.A. 65-508, andamendments thereto. Documentation of each exceptionshall be maintained on file at the child care facility.

(7) Each licensee shall provide information to the par-ents of children in care about the benefits of annual, well-child health assessments for children under six years ofage, and biennial health assessments for children sixyears of age and older. Each licensee shall also provideinformation about the importance of seeking medical ad-vice when a child exhibits health problems. This infor-mation may be either given on a form provided by theKansas department of health and environment to the par-ent at the time the child is enrolled or posted in a con-

spicuous place, with copies of the form available to par-ents on request.

(b) Health practices.(1) Each child’s hands shall be washed with soap and

water before and after eating and after toileting.(2) Children shall be allowed to go to the bathroom

individually as needed.(c) Illness and abuse.(1) If a child is absent due to a communicable disease,

staff shall inform all parents of the nature of the illness.(2) Each communicable disease shall be reported to the

county health department.(3) Each staff member shall be trained to observe symp-

toms of illness, neglect, and child abuse and shall observeeach child’s physical condition daily.

(4) Symptoms of illness shall be reported upon discov-ery to parents.

(5) All evidence of neglect or unusual injuries, includ-ing bruises, contusions, lacerations, and burns, shall benoted on the child’s record and shall be reported upondiscovery to the program director or, in the absence ofthe program director, the person designated in charge ofthe child care facility.

(6) The program director or, in the absence of the pro-gram director, the person designated in charge of thechild care facility shall report within 24 hours to the Kan-sas department of social and rehabilitation services anyevidence of suspected child abuse or neglect. When thelocal offices of the department of social and rehabilitationservices are not open, reports shall be made to local lawenforcement agencies.

(7) If care of sick children is to be provided, writtenplans regarding the needs of a sick child and the care ofa sick child shall be prepared in consultation with thepublic health nurse and shall be presented to the parentsat the time of enrollment. The requirements for the infec-tious and contagious diseases specified in K.A.R. 28-1-2and for the isolation and quarantine of individuals withthe infectious and contagious diseases specified in K.A.R.28-1-6 shall be met.

(8) A quiet area shall be provided for any sick child.Each sick child shall be supervised by an adult.

(9) Non-prescription medications shall not be admin-istered to any child except on written order of the parentor guardian. Each order shall be renewed yearly. Eachnon-prescription medication shall be administered by adesignated staff member.

(10) Each prescription medication shall be adminis-tered by a designated staff member, from a pharmacycontainer labeled with the child’s name, the name of themedication, the dosage and dosage intervals, the name ofthe physician, and the date the prescription was filled.The label shall be considered the order from the physi-cian.

(11) A record of the name of the designated staff mem-ber who administered the medication and the date andtime the medication was given to the child shall be keptin the child’s file.

Article 2.—LOTTERY RETAILERS

111-2-211. Bird Oil, Felts Oil winner awareness‘‘Starburst’’ promotion. (a) In addition to compensationspecified in K.A.R. 111-2-4 and 111-2-6, the Kansas lotteryshall also conduct a ‘‘Starburst’’ promotion to enhancewinner awareness at all Bird Oil and Felts Oil corporatelocations.

(b) The winner awareness sales promotion will com-mence at 5:00 a.m. on Saturday, March 1, 2008, and endat the end of the business day as defined at K.A.R. 111-6-1 on Monday, March 31, 2008.

(c) Beginning March 1, 2008, and concluding March 31,2008, the lottery will conduct a ‘‘Starburst’’ promotion atall the Bird Oil and Felts Oil corporate stores located inKansas. The stores must place a starburst decal on a vis-ible wall or counter for every winning instant or on-lineticket that is redeemed at that retailer which wins $10 ormore. Each starburst placed should contain, where pos-sible, the amount won, the ticket itself, and the name ofthe winner if written permission is obtained from thewinner.

(d) For every 10 winning starbursts placed in a visiblelocation at the retail establishment, the retailer will re-ceive the lottery’s choice of a promotional item, with amaximum of 10 items per store. For every 25 winningstarbursts placed in a visible location at the retail estab-lishment, that retailer will be entered into a drawing fora prize from the lottery. The grand prize is a $300 crediton the retailer’s lottery account. Second prize is a $50credit on the retailer’s lottery account, and third prize isa $25 credit on the retailer’s lottery account. Each retaillocation is eligible to win only one of the three creditprizes.

(e) During the week preceding the start of the promo-tion, an information sheet will be provided for all partic-ipating retailers so that they may all start on the sameday. Starbursts will be provided by the lottery. The draw-ings for the grand prize, second prize, and third prize will

111-4-2657. ‘‘Bonus Crossword’’ instant ticketlottery game number 751. (a) The Kansas lottery shallconduct an instant winner lottery game entitled ‘‘BonusCrossword’’ commencing on or after February 1, 2008.The rules for this game are contained in K.A.R. 111-3-1 etseq. and 111-4-2657.

(b) The ‘‘play symbols’’ for this game are as follows: A- B - C - D - E - F - G - H - I - J - K - L - M - N - O - P - Q- R - S - T - U - V - W - X - Y - Z. There are no ‘‘playsymbol captions’’ in this game.

(c) For this game, a play symbol shall appear in eachof 18 play spots within the ‘‘YOUR LETTERS’’ play area,in each of two play spots within the ‘‘BONUS’’ play area,and a variable number of times within the crosswordpuzzle grid.

(d) The ticket numbers in each book of tickets in thisgame shall start with 000 and end with 149.

(e) The three letters comprising the retailer validationcodes used in this game shall appear in three of eightvarying locations among the play symbols. The retailervalidation codes for this game and their meanings are asfollows:

(f) The price of instant tickets sold by a retailer for thisgame shall be $2.00 each.

(g) ‘‘Bonus Crossword’’ consists of three play areas. Inthe upper part of the ticket there is a crossword puzzlegrid that contains 11 spaces (height) by 11 spaces (width)covered by transparent latex. In the ‘‘YOUR LETTERS’’play area, located in the lower part of the ticket, there are18 letters located under opaque latex. To the right of the‘‘YOUR LETTERS’’ play area is the ‘‘BONUS’’ play areain which there are two letters covered by opaque latex.Imaged around each of the 18 ‘‘YOUR LETTERS’’ andtwo ‘‘BONUS’’ letters there will be a four-sided box com-posed of solid lines. A player will remove the latex fromthe ‘‘YOUR LETTERS’’ and ‘‘BONUS’’ play areas one let-ter at a time, and then for each matching letter in thecrossword puzzle grid scratch off the transparent latex.Each letter revealed in the ‘‘YOUR LETTERS’’ and ‘‘BO-NUS’’ play areas may be used an unlimited number oftimes in the crossword puzzle grid. If a player reveals atleast three complete words in the crossword puzzle grid,the player wins the corresponding prize in the prize leg-end. The prize legend on the front of the ticket indicatesprizes won for number of words revealed, as is also setforth in subsection (k) hereinafter.

(h) To qualify as a complete word to win a prize in thisgame, the words revealed must meet the followingrequirements:
