Notice of Hearing

A public hearing will be conducted at 9 a.m. Thursday,November 17, in the offices of the Kansas DevelopmentFinance Authority, 555 S. Kansas Ave., Suite 202, Topeka,on the proposal for the KDFA to issue its AgriculturalDevelopment Revenue Bond for the project numbered be-low in the respective maximum principal amount. Thebond will be issued to assist the respective borrowernamed below (who will be the owner and operator of theproject) to finance the cost in the amount of the bond ofacquiring the project or for the purpose of refunding abond previously issued to finance the project. The projectshall be located as shown:

Project No. 000645—Maximum Principal Amount:$52,000. Owner/Operator: Craig Schurle. Description: Ac-quisition of 80 acres of agricultural land and related im-provements and equipment to be used by the owner/op-erator for farming purposes. The project is located at theEast Half of the Southeast Quarter of Section 21, Town-ship 7, Range 4, Clay County, Kansas, approximately .5mile south of Green on 859 and 1 mile east on 21st Road.

The bond, when issued, will be a limited obligation ofthe KDFA and will not constitute a general obligation orindebtedness of the state of Kansas or any political sub-division thereof, including the KDFA, nor will it be anindebtedness for which the faith and credit and taxingpowers of the state of Kansas are pledged. The bond willbe payable solely from amounts received from the re-spective borrower, the obligation of which will be suffi-cient to pay the principal of, interest and redemption pre-mium, if any, on the bond when it becomes due.

All individuals who appear at the hearing will be givenan opportunity to express their views, and all writtencomments previously filed with the KDFA at its offices

at 555 S. Kansas Ave., Suite 202, Topeka, 66603, will beconsidered. Additional information regarding the projectmay be obtained by contacting the KDFA.

Any individual affected by the above-described projectmay, at or prior to the hearing, file a written request withthe KDFA that a local hearing be held on the proposal toissue a bond to finance said project. A local hearing, ifrequested, would be conducted in the county where theproject in question is located.

The Attorney General’s Office hereby provides noticeof the availability of funds under the Young Kansans —Safe Kids grant program and seeks grant proposals frominterested groups and organizations. The Young Kansans— Safe Kids grant program was created during the 2005Kansas Special Legislative Session to encourage and aidin the funding of programs designed to provide Internetsafety education and training for school-age childrenthroughout the state of Kansas. The Attorney General’sOffice has accepted the responsibility for managing$250,000 of state funds allocated for the Young Kansans— Safe Kids program. The funding available through theYoung Kansans — Safe Kids program is intended to pro-vide start-up/expansion grants to aid in providing onlinesafety training to more children across the state by cre-ating and expanding programs that will give Kansas kidsthe knowledge and skills they need to have fun, learn,and be safe when they are online.

Pursuant to the language of 2005 Special Session SenateBill 4, the funding available through the Young Kansans— Safe Kids grant program only may be awarded on thebasis of a 1/1 match of non-state to state moneys. All grantapplicants wishing to be considered to receive monetaryawards from the Young Kansans — Safe Kids programwill be required to provide documentation confirmingthe existence of non-state funds to be utilized by the ap-plicant sufficient to match on a 1/1 basis the amount ofthe award made by the Attorney General to the applicantfrom the Young Kansans — Safe Kids grant programprior to the transfer of any funds from the program to theapplicant.Applying for Young Kansans — Safe Kids Grant Funds:

Applications for grant funding under the Young Kan-

sans — Safe Kids program must be received by the At-torney General’s Office not later than November 11.

Applicants must complete the ‘‘Young Kansans — SafeKids Grant Application Form’’ providing all contact in-formation regarding the organization seeking to obtaingrant funds, financial information for the organizationand a summary of the methodology to be employed bythe organization to provide on-line safety training to Kan-sas school-age children. Applicants also must providesamples of the curriculum/materials proposed to be util-ized by the organization to educate Kansas children andprovide assurances that sufficient quantities of any suchmaterials will be available to distribute to the number ofchildren proposed to be served under the grant applica-tion.

Following receipt of grant applications, staff membersfrom the Attorney General‘s Office may contact appli-cants for further information regarding the applicants’ or-ganization, ability to comply with requirements for par-ticipation in the grant program, proposed non-statefunding sources, curriculum materials or other informa-tion necessary to the grant application/review process.Decisions on grant awards will be made by December 1,and applicants chosen to receive awards from the avail-able funds will be contacted by the Attorney General’sOffice to complete the grant award process.

The Kansas Department of Health and Environment issoliciting comments regarding a proposed air quality op-erating permit. National Cooperative Refinery Associa-tion has applied for a Class I operating permit in accord-ance with the provisions of K.A.R. 28-19-510 et seq. Thepurpose of a Class I permit is to identify the sources andtypes of regulated air pollutants emitted from the facility;the emission limitations, standards and requirements ap-plicable to each source; and the monitoring, record keep-ing and reporting requirements applicable to each sourceas of the effective date of permit issuance.

National Cooperative Refinery Association, McPher-son, owns and operates Petroleum Refinery and FertilizerPlant located at 1391 Iron Horse Road, McPherson.

The 60-day public petition pe-riod will directly follow the EPA’s 45-day review period.Interested parties may contact KDHE to determine if theEPA’s 45-day review period has been waived.

Any such petition shall be based only on objections tothe permit that were raised with reasonable specificityduring the public comment period provided for in thisnotice, unless the petitioner demonstrates that it was im-practicable to raise such objections within such period, or

The Kansas Department of Health and Environment issoliciting comments regarding a proposed air quality op-erating permit. Camoplast Rockland, Ltd. has applied fora Class I operating permit in accordance with the provi-sions of K.A.R. 28-19-510 et seq. The purpose of a Class Ipermit is to identify the sources and types of regulatedair pollutants emitted from the facility; the emission lim-itations, standards and requirements applicable to eachsource; and the monitoring, record keeping and reportingrequirements applicable to each source as of the effectivedate of permit issuance.

Camoplast Rockland, Ltd., Emporia, owns and oper-ates a rubber-covered wheel and belt manufacturing fa-cility located at 1601 E. South Ave. Emporia.

A copy of the proposed permit, permit application, allsupporting documentation and all information reliedupon during the permit application review process isavailable for a 30-day public review during normal busi-ness hours at the KDHE, Bureau of Air and Radiation,1000 S.W. Jackson, Suite 310, Topeka; and a copy of theproposed permit can be reviewed at the KDHE SoutheastDistrict Office, 1500 W. 7th, Chanute. To obtain or reviewthe proposed permit and supporting documentation, con-tact Ralph E. Direct written comments or questions regarding theproposed permit to Ralph E. Walden, KDHE, Bureau ofAir and Radiation, 1000 S.W. Jackson, Suite 310, Topeka,66612-1366. In order to be considered in formulating afinal permit decision, written comments must be receivedbefore the close of business December 5.

A person may request a public hearing be held on theproposed permit. The request for a public hearing shallbe in writing and set forth the basis for the request. Thewritten request must be submitted to Christy Thurman,Bureau of Air and Radiation, not later than the close ofbusiness December 5 in order for the Secretary of Healthand Environment to consider the request.

The U.S. Environmental Protection Agency has a 45-day review period, which will start concurrently with the30-day public comment period, within which to object tothe proposed permit. If the EPA has not objected in writ-ing to the issuance of the permit within the 45-day reviewperiod, any person may petition the administrator of theEPA to review the permit. The 60-day public petition pe-riod will directly follow the EPA’s 45-day review period.Interested parties may contact KDHE to determine if theEPA’s 45-day review period has been waived.

Any such petition shall be based only on objections tothe permit that were raised with reasonable specificityduring the public comment period provided for in thisnotice, unless the petitioner demonstrates that it was im-practicable to raise such objections within such period, or

Article 4.—MOTOR CARRIERS OF PERSONSAND PROPERTY

82-4-3a. Hours of service. (a) With the following ex-ceptions, 49 C.F.R. Part 395, as in effect on October 1, 2005,is hereby adopted by reference:

(1) 49 C.F.R. 395.0 shall be deleted.(2) The following revisions shall be made to 49 C.F.R.

395.1:(A) 49 C.F.R. 395.1(a)(2), 49 C.F.R. 395.1(h), and 49

C.F.R. 395.1(i) shall be deleted.(B) 49 C.F.R. 395.1(k) shall be deleted and replaced by

the following:‘‘(k)(1) The provisions of this regulation shall not apply

to drivers transporting agricultural commodities or farmsupplies for agricultural purposes in the state if the trans-portation meets the following conditions:

‘‘(A) Is limited to an area within a 100-air-mile radiusfrom the source of the commodities or the distributionpoint for the farm supplies; and

‘‘(B) is conducted within the planting and harvestingseasons.

‘‘(2) ‘Planting and harvesting seasons’ means the timeperiods for planting and harvesting that occur betweenJanuary 1 and December 31.

‘‘(3) ‘Agricultural commodities’ means the unproces-sed products of agriculture, horticulture, and cultivationof the soil, including wheat, corn, hay, milo, sorghum,sunflowers, and soybeans. Agricultural commoditiesshall not include livestock and livestock products, milk,honey, poultry products, timber products, and nurserystock, nor shall the term include the transportation of haz-ardous materials of the type or quantity that requires thevehicle to be placarded.

‘‘(4) ‘Farm supplies’ means supplies or equipment foruse in the planting or harvesting of agricultural commod-ities, but shall not include the transportation of hazardousmaterials of the type or quantity that requires the vehicleto be placarded.

‘‘(5) ‘Hazardous materials of the type or quantity thatrequires the vehicle to be placarded,’ as used in 49 C.F.R.395.1(k)(3) and (4), means materials that require placard-ing pursuant to 49 C.F.R. Part 172, as adopted in K.A.R.82-4-20, but shall not include fertilizer, animal waste usedas fertilizer, anhydrous ammonia, and pesticides.’’

(3) The following revisions shall be made to 49 C.F.R.395.2:

(A) The definition of ‘‘sleeper berth’’ shall be deletedand replaced by the following: ‘‘‘Sleeper berth’ means aberth conforming to the requirements of 49 C.F.R. 393.76,as adopted in K.A.R. 82-4-3(a)(4).’’

(B) The phrase ‘‘found by the Secretary to be hazardousunder 49 U.S.C. 5103 in a quantity requiring placardingunder regulations issued to carry out such section,’’which appears in the definition of ‘‘transportation of con-

struction materials and equipment,’’ shall be deleted andreplaced by ‘‘requiring placarding pursuant to 49 C.F.R.Part 172, as adopted in K.A.R. 82-4-20.’’

(4) The following revisions shall be made to 49 C.F.R.395.8:

(A) The last sentence in 49 C.F.R. 395.8(a)(1) shall bedeleted.

(B) The ‘‘Note’’ that appears between 49 C.F.R. 395.8(c)and (d) shall be deleted.

(C) 49 C.F.R. 395.8(e) shall be deleted.(D) The ‘‘Note’’ that appears between 49 C.F.R.

395.8(h)(5) and (i) shall be deleted.(E) The ‘‘Note,’’ including the graphic, that appears af-

ter 49 C.F.R. 395.8(k)(2) shall be deleted.(5) The following revisions shall be made to 49 C.F.R.

395.13:(A) 49 C.F.R. 395.13(c)(2) shall be deleted and replaced

by the following:‘‘Within fifteen days following the date any driver is

placed out of service, the motor carrier that employed thedriver shall personally deliver or place in the U.S. mail tothe division administrator or the state director of the fed-eral motor carrier safety administration a signed certifi-cation in a form acceptable to the commission. Anysigned certification acceptable to the commission shall in-clude the following information:

‘‘(i) All violations have been corrected;‘‘(ii) action has been taken to assure compliance with

49 C.F.R. 395.1, 49 C.F.R. 395.2, 49 C.F.R. 395.3, 49 C.F.R.395.5, 49 C.F.R. 395.8, 49 C.F.R. 395.13, and 49 C.F.R.395.15; and

‘‘(iii) the motor carrier understands that false certifi-cation can result in appropriate enforcement action.’’

(B) The phrase ‘‘as adopted in K.A.R. 82-4-3k’’ shall beadded before the phrase ‘‘pertaining to attendance andsurveillance of commercial motor vehicles,’’ which ap-pears in 49 C.F.R. 395.13(d)(4).

(6) The last sentence in 49 C.F.R. 395.15(b)(3) shall bedeleted.

(7)(A) The phrase ‘‘special agent of the Federal MotorCarrier Safety Administration (as defined in appendix Bto this subchapter),’’ which appears in 49 C.F.R. 395.1, 49C.F.R. 395.2, 49 C.F.R. 395.3, 49 C.F.R. 395.5, 49 C.F.R.395.8, 49 C.F.R. 395.13, and 49 C.F.R. 395.15, shall be de-leted and replaced by ‘‘any authorized representative ofthe commission, and any member of the Kansas highwaypatrol or any other law enforcement officer in the statewho has been certified in the inspection of motor carriersbased on the motor carrier safety assistance programstandards.’’

(B) The phrases ‘‘Federal Motor Carrier Safety Admin-istration’’ and ‘‘FMCSA,’’ which appear in 49 C.F.R. 395.1,49 C.F.R. 395.2, 49 C.F.R. 395.3, 49 C.F.R. 395.5, 49 C.F.R.395.8, 49 C.F.R. 395.13, and 49 C.F.R. 395.15, shall be de-leted and replaced by ‘‘commission.’’

(b) Whenever the federal regulations adopted in thisregulation refer to portions of the federal regulations orother operating standards that are not already adoptedby reference in article 4 of the commission’s regulations,the references shall not be applicable to this regulationunless otherwise specifically adopted.

(c) No wrecker or tow truck, as defined by K.S.A. 66-1329 and amendments thereto, with a gross vehicleweight rating or gross combination vehicle weight ratingof 26,000 pounds or less shall be subject to this regulation.

This regulation shall be effective on and after Novem-ber 1, 2005. 115-18-14. Nontoxic shot; statewide. (a) Each in-dividual hunting with a shotgun for waterfowl, coot, rail,snipe, or sandhill crane shall possess and use only non-toxic shot.

(b) The following nontoxic shot materials shall be ap-proved for the hunting of waterfowl, coot, rail, snipe, andsandhill crane:

86-3-29. Participation of salesperson or associatebroker in affiliated business arrangement with titleagency. (a) Any salesperson or associate broker may havea financial interest, as defined in K.S.A. 40-2404(14)(e)(ii)and amendments thereto, in an affiliated business ar-rangement with a title insurer or title insurance agencycreated or regulated pursuant to K.S.A. 40-2404(14)(e)-(j)and amendments thereto, 12 U.S.C. §2607(c) of the realestate settlement procedures act (RESPA), and 24 C.F.R.3500.15 if, upon commencement of the affiliated businessarrangement, the salesperson or associate broker notifiesthe supervising broker or branch broker, by certified mail,of the proposed affiliated business arrangement in orderto allow supervision pursuant to K.S.A. 58-3035(d) and(n) and K.S.A. 58-3062(c)(3), and amendments thereto.

(b) Each salesperson or associate broker who has afinancial interest in an affiliated business arrangement asspecified in subsection (a) shall notify the supervisingbroker or branch broker in writing within five businessdays after the effective date of each contract in any realestate transaction from which the salesperson or associatebroker will receive compensation due to an affiliatedbusiness arrangement. Article 10.—CHILD RAPE PROTECTION

16-10-1. Definitions. As used in this article, the fol-lowing terms shall have the meanings specified in thisregulation:

(a) ‘‘Abortion’’ has the meaning specified in K.S.A. 65-6701, and amendments thereto.

(b) ‘‘K.B.I.’’ means the Kansas bureau of investigation.(c) ‘‘Fetal tissue’’ means any tissue, organs, or body

parts obtained from a dead human embryo or fetus afteran abortion.

(d) ‘‘Medical care facility’’ has the meaning specified inK.S.A. 65-425, and amendments thereto. (Authorized byand implementing L. 2005, Ch. 149, § 3; effective, T-16-7-11-05, July 11, 2005; effective Nov. 18, 2005.)

16-10-2. Preservation and submission of fetal tis-sue. (a) Each physician who performs an abortion on aminor who is younger than 14 years of age shall perform,or shall ensure that the physician’s staff performs, the fol-lowing steps:

(1) Keep at least one fetal tissue collection kit providedby the K.B.I. on hand at all times and obtain replacementkits from the K.B.I. as needed; and

(2) collect, preserve, and ship fetal tissue using one ofthese fetal tissue collection kits.

(b) The document titled ‘‘Kansas bureau of investiga-tion fetal tissue collection kit instructions,’’ dated October26, 2005, is hereby adopted by reference. In accordancewith the kit instructions and within two hours after com-pleting the abortion, each physician shall perform, orshall ensure that the physician’s staff performs, the fol-lowing:

(1) Complete the evidence custody receipt form pro-vided by the K.B.I. and contained in the kit;

(2) collect the amount and type of tissue prescribed bythe kit instructions;

(3) preserve, secure, and label the tissue specimen asinstructed;

(4) ship the tissue specimen and the original of the ev-idence custody receipt form to the K.B.I. within the timelimit and in the manner specified by the kit instructions;and

(5) mail a copy of the evidence custody receipt form byfirst-class mail to the appropriate law enforcement de-partment as follows:

(A) The city police department, if the abortion is per-formed within the city limits; or

(B) the county sheriff’s department, if the abortion isperformed outside the city limits.

(c) The evidence custody receipt form shall contain thefollowing information in plain, legible printing or type-face:

(1) The name, address, and telephone number of themedical care facility or other location where the abortionis performed;

(2) the name, address, and telephone number of thephysician performing the abortion;

(3) the name, date of birth, residential address, and tel-ephone number of the minor upon whom the abortion isperformed;

(4) the name, residential address, and telephone num-ber of the parent or legal guardian of the minor uponwhom the abortion is performed;

(5) the date and time when the tissue specimen is col-lected;

(6) the date on which the tissue specimen is shipped;(7) the signature of the person collecting the tissue spec-

imen; and(8) the signature of the person shipping the tissue spec-

16-10-3. Disposal of fetal tissue. The physician whoperformed the abortion shall ensure that all returned fetaltissue is properly handled and disposed of in accordancewith K.A.R. 28-29-27.
