Political Leadership EnhancementPCL Teams up with Albay Chapter
The Philippine Councilors League through the Legislative Academy in close coordination with PCL Albay Provincial Federation Chapter headed by Honorable Alan Rañola of Legazpi City scheduled the Political Leadership Enhancement Program on May 31 to June 2, 2018 at the Grand Ballroom, The Oriental Hotel in Legazpi City, Province of Albay.
Dr. Cedric D. Daep, Department Head of Albay Public Safety Emergency Management Office (APSEMO) gave a lecture on the climate in Albay, calamities which hit the province and the creation
of APSEMO. He emphasized how they effectively respond to natural disasters like typhoons, floods, earthquake, eruption of Mt. Mayon, landslides, storm surge among others to evacuation and providing healthcare to their constituents.
Mayor Noel E. Rosal of Legazpi City shared their best practices including the Galing Pook Award they received in year 2014. He presented various innovative projects they accomplished and many Public-Private Partnership Programs they implemented such as the sanitary landfill and central terminal.
Two facilitators from Manila namely Genesis Villaflores and Jeferlito Menguin lead the teambuilding. The afternoon session of the delegates was filled with activities, fun and laughter. Afterwards, the councilors went to see the Cagsawa Ruins. At 6 in the evening, they proceeded to the Mayor’s Night (Welcome Dinner) sponsored by Hon. Rosal and were entertained by the City Legazpi Choir, GRD Dance Troupe, TRIO and the Voice of Memories. Mayor Rosal once again extended his generosity by offering ocular visit at the Sanitary Landfill.
City Councilor Gregorio Fernand Imperial III lead the PCL Creed while PFP Alan Rañola gave his welcome remarks. On behalf of the PCL leadership and NP Chavit Singson, National Chair Danny Dayanghirang and NEVP Benny Brizuela gave their words of appreciation.
Representing DILG Assistant Secretary Jonathan Malaya, former Masbate Vice Governor Atty. Vince Revil gave a lecture on Federalism and laid down the immediate plans of the National Government on the possible shift to this system of government. He was assisted by DILG Region V through Atty. Zalmar Uddin, focal person and legal officer. During the Open Forum, PCLLA Executive Director Dr. Larry Caminero, Regional Chairperson Owen Garcia, Provincial Federation President Shiela Baclaan of South Cotabato, City Chapter President Atty. Mila Arroyo and other Councilors from General Santos and Nueva Vizcaya participated during the Open Forum.
Representative Joey Salceda as the luncheon speaker on the second day, talked about the advantages and economic impact of the Tax Reform for Acceleration and Inclusion (TRAIN). He encouraged everyone to fully understand the different sections of the law and
explained why it is essential for the ordinary Filipinos.
In line with the thrust for continuing education of its members, selected PCL Officers learned about campaign management specifically on utilizing the 4+1 M namely Man, Machinery, Message, Money plus Methodology. Infanta, Quezon Councilor Hon. LA Ruanto as a strategist, shared his knowledge on ensuring ability to win during local elections. He also stressed the importance of utilizing the social media.
Apart from the said activities, the attendees had the opportunity to visit the Legazpi City Sanitary Landfill, ride ATV at the foot of the Mt. Mayon and enjoy the pili nut delicacies as well as spicy bicolano dishes. During the Closing Dinner, Governor Al Francis Bichara, thanked PCL for choosing his province. He called on all members to utilize the Union of Local Authorities of the Philippines or ULAP as the voice of the local officials to lobby on certain matters in Congress. He discussed salient points in Constitutional Reform and Federalism.
Provincial Federation and City Chapter Presidents extended their appreciation to PFP Alan Rañola for the warm hospitality and congratulated him for a fruitful event.

PCLLA Governance and Research Conference
The Philippine Councilors League Legislative Academy in partnership with Philippine Christian University and Belarmine Global Education scheduled the first Governance and Research Conference on May 24-26, 2018 at Bayview Park Hotel, City of Manila.
Around 500 students of Baccalaureate, Masteral and Doctoral Programs participated in the said activity. The Opening Program was graced by PCL LA Executive Director Larry Caminero and Dean Robert Galindez, PCU Extension and Transnational Education.
They gave the overview of the conference. VP for Academic Affairs Kathleen Rose Guimbatan provided a message while Metro Manila Development Authority (MMDA) Chair General Danny Lim served as the Keynote Speaker. He talked about the upcoming projects that will alleviate the traffic condition in the Metro as well as current issues and community concerns. On behalf of the PCL National President Luis “Chavit” Singson, Regional Chairperson Atty. Oliver Owen Garcia reported several accomplishments of the League.
Former CHED Commissioner Dr. Alex Brillantes, President of Philippine Society for Public Administration and Executive Director Dr. Lisan Calina discussed about Developing Research-Based Policies and Data Mining. IT Director of SRIA Ms. Jocel Calcena presented the EDMODO/LMS or the online storage of e-books and other learning materials while Executive Director Rico Pableo of the National Commission for Culture and Arts talked about the priority programs of their agency.
On the second and third
days, Dr. Ramon Ricardo Roque, Senior Deputy Secretary General of the House of Representatives gave updates on human resources management and CESO programs; Atty. Odilon Pasaraba, DILG-BLGS Director presented about high-impact programs which DILG and the LGUs can organize. General Esperion Javier of the Philippine Sugar Corporation discussed about the basics of Federalism.
The highlight of the activity was the students’ consultation and presentation of research topics. The students were also given the
opportunity for a campus tour to see the facilities of the Philippine Christian University in Taft, Manila. For his personal assistance, National President Singson sent a Partas bus to be utilized during the campus tour.
PCLLA Executive Director Larry Caminero encouraged the government officials to finish their education as this will also assist them in finding a better future after government service. He added that on the past administrations, several three termer councilors were appointed to career positions due to their PCLLA degrees.

2018 Local Legislative Award ImplementationThe First National Award Committee
Meeting for the 2018 Implementation of the Local Legislative Award was held last May 24, 2018 at the 27th Flr., DILG NAPOLCOM Center, Edsa corner Quezon Avenue, Quezon City. The meeting was presided by Atty. Mila Arroyo representing the PCL National President, Luis C. Singson.
Members of the NAC include OIC Assistant Director Vivian P. Suansing from DILG; Ms. Adamar Estrada, representing the Department of Agriculture; Ms. Catherine Espedido representing the Department of Social Welfare and Development; Mr. Aurelio C. Gloria representing the Department of Budget and Management; Mr. Arniel Rey G. Alcaraz, representing the Department of Environment of Natural Resources; and Mr. Edwin R. Glindro, representing the Philippine Chamber of Commerce and Industry.
The meeting focused on the review of
the Award criteria and guidelines. For 2018, it was suggested that the award categories are as follows:
• Outstanding Sanggunian in Highly Urbanized Cities Category;
• Outstanding Sanggunian Independent Component Cities Category;
• Outstanding Sanggunian in Component Cities Category;
• Outstanding Sanggunian in 1st to 3rd Class Municipalities Category; and
• Outstanding Sanggunian in 4th to 6th Class Municipalities Category
Likewise, field documentation, as necessary, of National Finalists may be conducted. Cash Award from PCL is up for the approval for the National Board.

PCL opens a FEDERALISM Advocacy Partnership with DILG
In line with DILG Memorandum Circular 2017-117 dated September 13, 2017 which calls on all local government units, organizations and individuals to implement Federalism-related information campaign activities within their jurisdiction, Philippine Councilors League National President Luis “Chavit” Singson met with the Secretary of Department of The Interior and Local Government (DILG) General Eduardo Año and Assistant Secretary Jonathan Malaya.
The ceremonial signing of Memorandum of Understanding (MOU) between PCL and DILG has been scheduled on May 4, 2018 at the DILG Office in Quezon City. However due to urgent activities, the signing was reset. The draft MOU is presently

President Benny Brizuela with Regional Chairperson Maria Shiela Gange of Guimaras and Executive Director Esther Cuadra conducted ocular inspections at various hotels in Iloilo City for the second time on April 24-25, 2018.
As preparation for the upcoming 3rd Quarterly NEO NB CLLEP in Iloilo City on 20-22 June 2018, NEVP Brizuela, as head of the five-man Working Committee for the said event, has been negotiating with the local hoteliers to acquire the least possible rates. Prior to the Subic event, NP Singson clearly announced the need to support the different projects and programs of PCL Local Chapters through a considerable share from the surplus which they could potentially acquire. Hence, NEVP Brizuela said they must reduce or eliminate unnecessary expenses per quarterly event.
Initially on 4-5 April 2018, NEVP Brizuela met PCL Iloilo Chapters headed by PFP Licurgo Tirador, CCP Jose Treñas and the managers of
Richmonde, Eon, Mansion, Injap, Gold Berry, Mansion and Marriott to finalize the pencil booking reservations spearheaded by RCC Shiela Gange. After successful renegotiations, he immediately endorsed the contracts to PCL National President Chavit Singson for approval. As of this time, around 1000 rooms were tentatively reserved.
PCL National PRO Bembot Bermejo, Accommodation Committee Chair and PCL Legislative Academy Dr. Larry Caminero also joined the said activity. They both assisted in finalizing the requirements as well as the schedule of activities with the local host members.
National Chairman Danny Dayanghirang also visited Iloilo City on April 19-21 to double check the rates and met with the Iloilo local officials. He sought their full support for the success of the 3rd quarterly event. Together with Visayas Vice-Chairman Mitch Patricio, RCC Shiela Gange and RCC Myra Abubakar, he conducted site inspections in Guimaras.

NC DAYANGHIRANG GRACES LOCAL AND REGIONAL ASSEMBLIES
Philippine Councilors League (PCL) National Chairman Danilo C Dayanghirang graced the 1st Asian Conference on Dangerous Drug Abuse Prevention and Recovery Program in Tagum City on 17 April 2018. The said conference highlighted Mind Education as the New Approach to Drug War participated by around 200 leaders from the education sector, health sector, drug enforcement agencies and local government units in the Philippines and Asia.
Philippine Councilors League National Chairman Danilo Dayanghirang graced the launching of B4BG (Bayan for Bong Go) Movement last April 9, 2018 at the Grand Regal Hotel, Davao City. The said event was attended by leaders from Regions 1, 2, 3 and 4, and ARMM, showing their support to SAP Bong Go to run on the 2019 Senate election.

After the PCL NB Meeting, a dinner, attended by both the NEO-NB Officers,
was held at the same venue. The new Director of DILG Bureau of Local
Government Supervision Atty. Odilon L. Pasaraba, was welcomed by the
League through National Chairman Danny Dayanghirang. Mr. Thony Dizon
with Mr. Manny Calonzo of Ecowaste Coalition presented the harmful
effects of lead while the team from Department of Science and Technology
composed of Dr. Marie Bugas, Clarita Magsadia and Nelly Rose Pablo
presented various facts from the Food and Nutrition Research Council.
DAY 1
14 March 2018 (Wednesday)
The delegates were given a festive welcome by the Olongapo Marching
Band and Batang Gapo Drum Beaters as they enter the Subic Bay Exhibition
and Convention Center. At 9 in the morning, the first batch of ITAPS (Integrity,
Transparency and Accountability in Public Service) Seminar was held. The
whole day activity was in partnership with the Office of the Ombudsman
spearheaded by the Anti-Corruption Committee of PCL. There were
75 delegates who joined. At the main plenary, the Olongapo City Local
Government shared their best practices through the offices of Disaster Risk
and Reduction Management Office, James L. Gordon Memorial Hospital,
Gordon College and City Events. The department heads presented the
historical background and current programs of their respective offices for
other LGUs to appreciate.
The Opening Program commenced with audio and video presentations
for the prayer, anthem, Olongapo and PCL Hymn. From Olongapo City,
Councilor Noel Atienza lead the PCL Creed while CCP Sarah Lugerna
Garcia gave the welcome message. National President Luis “Chavit”
Singson delivered his opening message stating the League’s Reform
Agenda. Representing Department of The Interior and Local Government
(DILG) was Regional Director Julie Daquiaog from DILG Region III. Atty.

Wilma Eisma, SBMA Chairperson and Chief Executive Officer welcomed
the delegates to Subic likewise narrated various milestones the SBMA has.
The delegates were provided with two Technical Sessions: (1) Local
Budgeting by Atty. Enrique Dela Cruz, former PCL Luzon Vice President,
Board Member from Bulacan Province and currently teaching at the
Law Department, University of Sto. Tomas and (2) Utilizing Technology in
Enhancing Public Service Delivery by Atty. Rico Paolo Quicho of Quicho &
Angeles Law Firm and a professor from University of Makati.
Executive Director of Public-Private Partnership Center of the Philippines
Undersecretary Ferdinand Pecson gave a lecture on several types of PPP
projects in the country and why the local government units should engage
in these kinds of projects. Usec. Pecson discussed about Republic Act
7718 and other DILG Memorandum Circulars. He stressed the mandate of
PPP and cited examples of these projects from the National Government
and LGUs. On the other hand, Philippine Economic Zone Authority Director
General Bgen. Charito Plaza shared that there are 379 operating economic
zones nationwide, wherein from 1995 to 2017, these ecozones generated
Php 3.6 trillion contributing to the country’s growth. She said that in setting
up economic zones, there is no graft and corruption and has benefits to
LGUs in terms of taxes and shares.
From 2 until 4 in the afternoon, the Integrated Bar of the Philippines (IBP)
Zambales Chapter joined PCL lawyers headed by PCL General Legal
Counsel Atty. Rey Oliver Alejandrino for the Legal Help Desk. IBP Zambales
representatives were Atty. Winnie Bundang-Ortiz, Atty. Manny Rosapapan
Jr., Atty. Josefina Ela Bueno and Atty. Lito Orozco.
Welcome Dinner

SBMA Board Walk
The delegates gathered at the SBMA Helipad area. A local priest delivered
the Muslim Prayer, while the National Anthem, Christian Prayer and
PCL Hymn were on audio-video presentations, Ms. Almira Lat sung the
Olongapo Hymn, Councilor Bas Palo lead the PCL Creed and Olongapo
CCP Lugie Garcia welcomed the delegates. Mayor Ed Pamintuan delivered
his message, highlighting the best things in Olongapo as a disciplined city
at the same time, discussed about Angeles City, his hometown. Coun. Atty
Winnie Ortiz introduced Olongapo Mayor Rolen Paulino as the evening’s
distinguished guest. Mayor Paulino welcomed the delegates to his city.
He shared various insights to the delegates being once a city councilor
himself. At the end of the speech, fireworks lit up the night sky followed by
a firedance production by the Exodus Tribe Dancers. The delegates were
entertained by Olongapo City Stretos Band, Sound Machine, Exodus Tribe
and Gummy Baes from Manila with Comedians T-Rex, Trish and Missy as
the hosts.

The Philippine Councilors League Legislative Academy, headed by
Executive Director Helario Caminero, in partnership by the DILG Bureau
of Local Government Supervision organized seven (7) breakout classes on
the following topics:
Bridging Leadership by Dr. Antonio Delos Reyes
Micro-Finance/ Go Negosyo by Dr. Alfredo Derecho
Managing Security Challenges by. Gen. Enrique Galang
Urban Planning by Professor Roque Magno of University of the Philippines
ITAPS by the Office of the Ombudsman (8AM to 5PM)
Road Classification, Speed Limit Setting and Enforcement and Road Crash
Data Collection by Atty. Sophia Monica San Luis
Strategic Planning and Management by Dr. Robert Galindez
All functions rooms of the Subic Bay Exhibition and Convention Center
(SBECC) were utilized. After the morning classes, the delegates proceeded
to Plenary 2 for their lunch break. On a working lunch, National Chairman
Danilo Dayanghirang talked to the delegates concerning League
operations, problems and issues. National President Luis “Chavit” Singson
likewise discussed status of current projects and other urgent concerns.
Afterwards, the delegates went back to their respective classes for the
Federalism Consultative Forum. Discussion on the proposed form of
government was provided afterwards, survey forms were answered by the
councilors. Through the PCL LA, data will be gathered and summarized.
The PCL National will endorse the results to the Senate and Congress as
feedback from the league of councilors with regard to the proposed shift
to the Federalism form of government.
Several councilor-delegates went to see the tourism areas in the Freeport
Zone particularly Ocean Adventure, Zoobic Safari, JEST Camp and Treetop
Adventure. Approximately 1,900 delegates joined the tours.
Closing Dinner

The Closing Dinner started early around 6 in the evening with Basic Mode,
Pasi Voci and Ms. Almira Lat as the performers.
PCL Luzon Vice President Atty Darwin Icay from Taguig City introduced
his Congresswoman, the Honorable Atty. Pia Cayetano, Deputy Speaker
of the House as the Guest of Honor. On her speech, the former Senator
was delighted to see the councilors and gave her inspirational message.
The Philippine Commission on Women representative Ms. Maria Kristine
Josefina G. Balmes talked about the role of PCW as a catalyst for
gender mainstreaming, authority for women concerns and advocate for
empowerment, equity and equality. She also laid down their legislative
agenda to the 17th Congress as well as their objectives for the Women’s
Month. Representing Secretary Arthur Tugade, Undesecretary Reinier
Usec Reinier Paul Yebra of the Department of Transportation gave a talk
about the projects of DOTr on roads, railways, airports, LRT and MRT, ports
and the PUV Modernization.
After the program, the delegates were once again entertained by local
band Basic Mode and Ms. Ethel Booba, as the guest performer from Manila.

DILG Adopts Local Legislative AwardAtty. Odilon L. Pasaraba, CESO V of
the DILG Bureau of Local Government Supervision called a meeting on 17 May 2018 at the 27th Floor, DILG-NAPOLCOM Center in Quezon City to discuss the proposed BLGSLG Leagues Workshop and creation of Local Legislative Award.
As the highlight of the said gathering, Director Pasaraba endorsed the LLA Program, which was an established regular event of DILG and PCL since 2006, to the Malacañang. President Rodrigo Duterte was expected to sign an Executive Order establishing the Local Legislative Award. This aspires to give recognition to Sanggunian that has exemplary performance in building the foundation of meaningful local administration and development. Provinces, highly urbanized cities, component cities and municipalities may join. They may submit ordinances or resolutions which could highlight innovation or excellence thereby attain a desirable socio-economic and environmental outcome to the community.
The proposed EO will establish
an Award Committee composed of the Secretary of DILG as the Chairperson with the heads of Leagues (League of Vice Governors of the Philippines, Provincial Board Members League of the Philippines, Vice Mayors League of the Philippines and Philippine Councilors League) as Vice-Chair. The members are various Secretaries of the National Government: Department of Agriculture, Department of Social Welfare and Development, Department of Budget and Management, Department of Environment and Natural Resources as well as the President of Philippine Chamber of Commerce and Industry, with a Representative from a Non-Government Organization involved in policy studies or capacity building related to local legislation.
Once the draft EO is signed and implemented, the submission of entry documents shall be October to be reviewed by the National Board of Judges until November this year. The selection of National Winners will be by January next year and the Awarding Ceremony is on March 2019.

PCL ADVOCACY CENTERBriefer on the Proposed Budget Reform Bill
Introduction The Proposed Bill strengthens government’s accountability to the people for its use of public funds. Ultimately,
it improves the ability of government to deliver direct, immediate, and substantial services to the people, especially the poor.
1. It is a landmark law that seeks to modernize the Budgeting system by establishing holistic, and internationally-established principles encompassing the whole PFM process, the whole public sector, and all PFM institutions. It also seeks to resolve the currently fragmented legal framework on PFM as well as inconsistencies with the 1987 Constitution (vis-a-vis recent SC decisions).
2. The bill strengthens Congress’ power of the purse that all expenditures must be approved by Congress as enshrined in the Constitution; and to enable Congress to review and approve proposed appropriations against clearly defined performance information and actual reported performance. Includes:
a) Tightened rules on the declaration of, and setting limits on the use of, savings; b) The rationalization of Special Purpose Funds (SPFs), lump sum funds, Special Funds, and Special
Accounts in the General Fund (SAGFs); c) Mandatory fiscal, financial, and performance reports by the national government and individual agencies
for the examination of Congress. d) Clearer rules on the re-enactment of prior years’ appropriations as well as the preparation and approval
of supplemental appropriations.
3. The bill will usher the shift to an annual cash-based appropriations and the introduction of the Extended Payment Period.
4. The bill seeks to secure the institutionalization of many key PFM reforms such as the Treasury Single Account, the Accounting and Auditing Reforms, as well as the development of an Integrated Financial Management Information System through binding legal mandates for the same; as well as strengthened roles and responsibilities for PFM institutions.
Structure and Key Features
1. Roles and Responsibilities: specifies additional legal powers and obligations of all PFM institutions, particularly Congress, the President and the Executive (DBM, DOF, NEDA, line agencies, etc.), and COA. In particular:
a) Congress’ review of government financial and non-financial accountability reports and COA audit reports through existing or new committees;
b) The President’s approval of the Statement of Fiscal Policy, the Medium-term Fiscal Strategy, and the Budget Priorities Framework; and
c) The DBM evaluation of financial and non-financial performance of the NGA’s, GOCCs, and LGUs; monitoring the annual cash appropriation of NGA’s’; integration of the government’s financial information system in collaboration with DOF, BTr, and COA; and formulation and overseeing human resource and capacity development requirement on PFM.
2. Fiscal Responsibility: establishes fiscal responsibility mechanisms that oblige each new government to articulate and adhere to a comprehensive and legally-binding medium-term fiscal strategy and regular fiscal reports. The proposed bill also includes a provision requiring a Financial and Budgetary Information Sheet for all proposed expenditure-adding or revenue-eroding measures containing an estimate of the financial and budgetary implications of said proposal for the initial year of implementation and the next five (5) years.
3. Budget Preparation, Execution and Adjustment: promotes disciplined and policy-oriented budgetary decision-making and approval, and the faithful execution of the enacted Budget. This section includes: a) Linking planning, budgeting, and reporting through, among others, the DBCC Medium Term Fiscal Strategy,
Mid – year and Year-end Fiscal Reports, the Annual Agency Plans, and Quarterly Appropriations Reports; b) Shifting from Multi-year Obligation-based Appropriations to Annual Cash-based Appropriations; c) Limiting the number of SPFs and lump sum funds, tightened rules on unprogrammed appropriations, clearer
rules on the declaration and use of savings, and parameters on re-enacted budgets and supplemental appropriations; and
d) Institutionalizing of key PFM reforms, such as the program budgeting, the immediate release of funds upon enactment of the General Appropriations Act, Early Procurement, and Multi-year Contracting Authority (MYCA).
4. Financial Management: specifies arrangements for the planning and control of cash in the Treasury and the management of revenues and liabilities. This section includes: a) The institutionalization of the Treasury Single Account; and b) The regular review of Special Funds and SAGFs and the stipulation of sunset provisions.
5. Accountability and Reporting: establishes financial management and internal control rules for agencies, agency-level planning and reporting requirements, and whole-of-government reporting and audit. This includes: a) The responsibility of NGA heads to ensure financial management and internal control, as well as compliance
with annual plans, budgets & reports; and b) The responsibility of Department Secretaries to approve and include attached agencies’ and GOCCs’
plans, budgets, and reports in the Departments’ reports.
6. Transparency and Participation: strengthens mechanisms for participatory budget process and people’s access to public financial information through, among others, standards on public disclosures and reporting and publication of the People’s Budget.
7. Enforcement: specifies sanctions for non-compliance with law and procedures, including: penalties for financial misconduct and criminal offenses, institutional sanctions for failure to comply with reporting and other requirements, etc.
8. Final Provisions: identifies implementing rules and regulations; transitional arrangements; amendments to existing legislation. This includes the requirement to produce a Transition Plan to spell out the timetable for the roll-out of provisions that may not be immediately implementable.

For the PCL Provincial Federation Presidents (PCL-PFPs) to receive fully the representation allowance and transportation allowance (RATA) given to the regular members of the Sangguniang Panlalawigan (SP) as Ex-Officio Member.
BackgroundSec 508 (b), Chapter II Leagues and Federations of Local Elective Officials, Title Six, Leagues of Local
Government Units and Elective Officials, Book III The Local Government Units of the Local Government Code of 1991 provides that “Sanggunian members of component cities and municipalities shall form a provincial federation and elect a board of directors and a set of officers headed by the Presidents. The duly elected president of the provincial federation of sanggunian members of component cities and municipalities shall be an ex-officio member of the Sangguniang Panlalawigan concerned and shall serve as such only during his term of office as President which in no case shall be beyond the term of office of the SP concerned”.
The IssueThe PCL Provincial Federation Presidents have common sentiment that as far as the RATA is concerned, it
should be given in full and not just the difference between the RATA of the municipality/city councils and the provincial councils considering that their coverage is the entire province compared to the regular SP members who are only serving in their respective districts. This is on top of the Sanggunian standing Committees they chaired, co-chaired or as member.
The RATANature: RATA is a collective term for two distinct but complementary allowances: Representation Allowance
(RA) and Transportation Allowance (TA). Both allowances are provided to select government officials to cover related expenses incidental to and in connection with the actual performance of their respective functions.
RATA may either be commutable or reimbursableCoverage: 4.3 Sanggunian Members, including Ex-Officio MembersEquivalent Ranks to National Government Officials: Sangguniang Panlalawigan Member, SG.27 is equivalent to Director III, SG-27 (Assistant Bureau Director)
Department of Management (DBM) PositionItem (4)(g)(i) of the Senate and House of Representatives joint Resolution (J.R.) No. 41, s. 2009, lists the
Representative and Transportation Allowances (RATA) among the Specific-Purpose Allowances and Benefits under the Total Compensation Framework of the Compensation and Position Classification System established under Republic Act (R.A.) No. 67582, as amended. These are granted to government officials down to division chiefs at monthly standard rates in order to defray representation and transportation expenses while in the actual performance of the duties and responsibilities of their positions.
Item (7)(b) of JR No. 4 further provides that the rates of RATA shall be determined on the basis of the income class of each local government unit (LGU).
Section 45 of the General Provisions of R.A. No. 10352, the FY 2013 General Appropriations Act (GAA), provides new rates of RATA, as well as the policies governing the grant thereof. It further provides that the RATA for local government officials equated to national government officials entitled to RATA “shall be at the same percentages as the salary rates under R.A. No. 6758, as amended.”
In the Annual General Appropriations Act, there is always a provision on RATA stipulated in a certain section. In the 2016 GAA it is found in Sec. 59 Vol III.No.1
“Representation and Transportation Allowance. Government officials with the following ranks and their equivalent, as determined by the DBM, while in the actual performance of their respective functions, are hereby authorized monthly commutable representation and transportation allowance at the rates indicated…”
Since the opening of the 16th Congress, the House Committee on Government Enterprises and Privatization chaired by Cong. Jesus Sacdalan of which the GSIS Advocacy has been lodged, has conducted only one Technical Working Group (TWG) Meeting chaired by Congessman Antonio Tinio on September 2, 2015 attended by Councilor Raul Corro, Advocacy Committee Chair and Ms. Esther Cuadra, Executive Director for Advocacy and Programs.
During the said TWG meeting, Councilor Atty. Corro strongly manifested and justified the PCL GSIS Advocacy.
The GSIS representative raised the following issues:
1. Who will pay the employers share? Is this included in the voluntary payment of the premium?2. Is age being considered in this advocacy because the person who volunteers to avail of the option should
not be more that 54 years old so that the six (6) years he/she will continue paying he/she will be in the optional retirement age of 60 already.
On the question of Councilor Corro what benefits a three termer local elected official will enjoy if he/she is separated from Service considering that he/she is not entitled to a retirement benefits.
The GSIS responded:
The concerned elective official is entitled to the following GSIS Benefits thru an application:1. SeparationBenefits For those members who are separated from service and who have at least 8 years of service but less than 15
years, shall be entitled to cash payment equivalent to 100% of the member’s Average Monthly Compensation (AMC) for each year of creditable service, but not less than P12,000.00, payable upon reaching the age of 60 or upon his/her separation if he/she is already 60 years of age at the time of separation.
2. Cash Surrender Value (CSV) The application for CSV is required in case of resignation, retirement or separation from the government service
and for those with elective position (councillors, mayors, governors, vice-mayors and provincial board members) but excluding barangay officials who are receiving honoraria.
CSV- refers to cash surrender value, which is the amount to be paid to the policy holder of Life Endowment Policy (LEP) or optional life insurance policies when he/she is separated from the service before maturity date of the policy.
The above benefits can also be availed by defeated incumbents in an election.

and two (2) Committee Meetings on Government Enterprises and Privatization on: September 7, 2016 March 15, 2017• HBN 471 “AN ACT FURTHER STRENGTHENING THE GSIS” authored by Cong. Antonio Tinio and Cong.
Francisca Castro, a substitute bill consolidating 23 bills, is actually the same Third Reading version from the 15th Congress supported by GSIS. This is still pending with the Committee on Government Enterprises and Privatization chaired by Cong. Jesus Nonato Sacdalan, 1st District, North Cotabato, since July 26. 2016.
Sec. 6 of the above bill on Effect of Separation from the Service-“ A Member separated from the service shall be deemed an inactive member of the system. An inactive member shall be entitled to whatever benefit she/she has qualified for in the event of any contingency compensable under this Act.”
Here too the the “Option” provision was deleted.
Portability Law• DOJ opined that a remedy maybe availed of by PCL using RA 7699 or the Portability Law wherein a former
elected official may voluntarily contribute this time in the SSS System , either as an employee or a self-employed individual and the SSS will now add his total contribution so that he/she can enjoy social security benefits under the SSS Law.
• HB 1864, proposing amendments to RA 7699 or the Portability Law (Cong. Christopher De Venecia)
GSIS does not support the proposed amendments. GSIS explained that the Portability Law is a mechanism to enable an employee, who cannot avail of retirement benefits from either GSIS or SSS due to lack of minimum number of years of required premium contribution, to “totalize” his/ her creditable services or contributions for purposes of old age, disability, survivorship and other benefits. GSIS said that giving the employee the option to choose from which system to apply for retirement pension would be unfair to GSIS members who contributed a minimum of 15 years to the fund. SSS did not submit a written comment but said that it agrees with the points raised by the GSIS.
GSIS and SSS will assist the TWG in formulating acceptable amendatory provision to the bill.• The Secretary of the Committee on Government Enterprise Marlon Valencia suggested to visit the Office of
Cong. Maximo Rodriquez,Jr. brother of former Cong. Rufus Rodriquez to file a Bill with the “option” provision as an amendment to the GSIS law or a Special Bill providing Retirement Benefits to Elected Officials.

Our warm greetings of peace, love and happiness to all local legislators! It is another quarter and we cannot thank everybody enough for the strong cooperation and support being extended to the League as your beloved organization. Rest assured we are doing our best to fulfill our duties as your leaders.
CONTINUING EDUCATION. Article 17 of the Philippine Councilors League Constitution and By-Laws creates the PCL Legislative Academy. This PCL Program is responsible for the capability building of the PCL Members other local legislators and public servants.
As we all recognize the significance of education, we all should take note that this is not just for the youth. Education is equally important to the Councilors as there is a need to continuously equip ourselves with the latest trends, technology and additional knowledge.
We need formal education. This will help us to be hired, promoted or in the least, be recognized in the society. Let us support the PCL Legislative Academy in their objectives of helping you finish Baccalaureate, Masteral or Doctoral courses. These curricula are specially designed for the requirements as public servants in the course of your responsibilities and commitment in the government.
On 31 May to June 2, we have organized a learning activity in Legazpi City, Albay Province. To Governor Al Francis Bichara, Mayor Noel Rosal and all participants, thank you for making this event successful. In the near future, we hope more delegates will be joining this kind of activity hence acquire more skills and build camaraderie with each other.
FEDERALISM. Together with the Office of Assistant Secretary Jonathan Malaya, we shall sign a partnership agreement through Memorandum of Understanding as DILG’s Advocacy Partner. Secretary General Eduardo Año has warmly acknowledged this proposal and ordered the Legal Department to enhance our draft MOU.
ANTI-CORRUPTION. Together with Office of the OMBUDSMAN, we are now regularly conducting ITAPS Seminar (Integrity, Transparency, Accountability in Public Service). Apart from the PCL National, several LGUs through the PCL Local Chapters are now organizing these ITAPS Seminars in their respective jurisdictions.
LOCAL LEGISLATIVE AWARD. DILG will launch LLA as a nationwide program to all Sanggunians. As our project since 2006, we are deeply honored on this move. Let us all support this project and continue to be prime movers in the excellence for local legislation.
SHARING OF BEST PRACTICES. We are strengthening this program because we perceive the need to assist each other to perform well. In all activities of PCL, the local host presents various accomplishments which we can emulate. This will enhance local government capability. On top of this, we have invited the Provincial Federation and City Chapter Presidents to share their outstanding legislative measures to the PCL Members during the Plenary Session. We dream of making a positive change in the whole nation through the simple ordinances we can implement within our respective jurisdictions.
REFORM AGENDA. Noting that LGU funds be invested to the right priorities, efficiently and effectively utilized, we recognize the regulations being set by the Commission on Audit, Department of Budget and Management and Department of the Interior and Local Government. We are continuously disallowing excessive expenses and managing well the PCL Funds. As we go through this strict process, we hope to receive full support from our dear PCL Officers.
Our NEO NB CLLEP is not perfect, however we strive to discover various ways to serve you better. We need everybody’s cooperation to make this possible. Once again, thank you for the patience and commitment to PUBLIC SERVICE ABOVE SELF.
