HORSHAM RURAL CITY COUNCILRoad Discontinuance

At its meeting on 28 September 2020, and acting under Clause 3 of Schedule 10 of the Local Government Act 1989, the Horsham Rural City Council resolved to discontinue the road enclosed between James Street and Burgess Street and the road west of 1 James Street, Horsham, being the land contained in Certificate of Title Volume 12050 Folio 651, and shown on the hatched plan below, as it is not reasonably required as a road for public use.

NOTICE OF PROPOSED AMENDMENT OF ROAD MANAGEMENT PLANIn accordance with section 54 (6) of the Road Management Act 2004, and regulations 10 of

the Road Management (General) Regulations 2016, East Gippsland Shire Council gives notice that it proposes to amend its Road Management Plan (RMP). This includes changes to: document structure defect classification standards for inspection frequencies, intervention levels and response times.

The proposed amendments apply to all roads and classes of roads for which Council is the responsible road authority under the Act.

A copy of the proposed plan is available at Council’s Service Centres or on Council’s website: www.eastgippsland.vic.gov.au

Anyone can make a written submission on the proposed amendments within 28 days of the date of this notice.

MOORABOOL SHIRE COUNCILORDER MADE PURSUANT TO

SECTION 25 OF THE DOMESTIC ANIMALS ACT 1994

Notice is given that the Moorabool Shire Council, at its meeting on 2 December 2020, resolved to exercise its power and make the following Order pursuant to section 25 of the Domestic Animals Act 1994 imposing conditions on the presence of cats found at large outside the premises of the owner, or not securely confined to the owner’s premises:

Cat CurfewThe owner of a cat must keep the cat securely

confined to the owner’s property and must not allow the cat to wander at large outside of the owner’s property between the hours of sunset and sunrise.

‘Sunset and sunrise’ means 8.30 pm (sunset) to 7 am (sunrise) during Victorian daylight-saving time (DST) and 6 pm (sunset) to 7 am (sunrise) during non-daylight saving time.

‘Owner’ in respect of a cat has the same meaning as the Domestic Animals Act 1994 and includes a person who keeps or harbours the animal or has the animal in his or her care for the time being whether the animal is at large or in confinement.

Notice of the Preparation of an Amendment Amendment C131

The Nillumbik Shire Council has prepared Amendment C131 to the Nillumbik Planning Scheme.

The Amendment applies to land within the Green Wedge Zone and Rural Conservation Zone (Schedules 1 – 5).

The Amendment proposes to amend the schedule to the Green Wedge Zone and schedules 1 to 5 of the Rural Conservation Zone to require a permit trigger for earthworks which involve the receipt, importation, stockpiling or placement of more than 100 cubic metres of fill on land within those specified zones.

Specifically, the request: Amends the Schedule to Clause 35.04

(Green Wedge Zone), and schedules 1-5 of Clause 35.06 (Rural Conservation Zone).You may inspect the Amendment, any

documents that support the Amendment and the explanatory report about the Amendment, free of charge, at the Nillumbik Shire Council website at https://participate.nillumbik.vic.gov.au/; and/or during office hours, at the office of the planning authority, Nillumbik Shire Council, Civic Drive, Greensborough Victoria 3088; and at the Department of Environment, Land, Water and Planning website www.delwp.vic.gov.au/public-inspection

Any person who may be affected by the Amendment may make a submission to the planning authority about the Amendment. Submissions must be made in writing giving the submitter’s name and contact address, clearly stating the grounds on which the Amendment is supported or opposed and indicating what changes (if any) the submitter wishes to make.

Name and contact details of submitters are required for Council to consider submissions and to notify such persons of the opportunity to attend Council Meetings and any public hearing held to consider submissions.

The closing date for submissions is 3 June 2021. A submission must be sent to Rosa Zouzoulas, Executive Manager Planning and Community Safety, Nillumbik Shire Council, Civic Drive (PO Box 476), Greensborough, Victoria 3088.

MITCHELL RIVER AND TRIBUTARIESSouthern Rural Water is auctioning Take and Use Surface Water Licences (Winterfill) from the

Mitchell River and tributaries. The total volume available will be 1,990 ML. The auction will be held on 12–14 May 2021.

The announcement of this auction is in accordance with section 57 of the Water Act 1989, where Gippsland and Southern Rural Water Corporation (trading as Southern Rural Water) is acting as the delegate for the Minister for Environment, Climate Change and Water.

The auction is open to those who completed the application form and met the eligibility requirements advertised in the Bairnsdale Advertiser during November and December 2020.

Development Victoria Act 2003 PROJECT ORDER

Order in CouncilThe Governor in Council under section 34 of the Development Victoria (Vic) Act 2003 (‘the

Act’) by Order: (a) declares the redevelopment of the State Basketball Centre (‘the Declared Project’) to be a

project to which the Act applies; (b) specifies that the following provisions of Divisions 2, 4 and 6 of Part 3 of the Act are to apply

to the Declared Project: Sections 41, 44, 45, 46, 53 and 54; and (c) specifies that the area of land as shown hatched in the plan attached is to be the project area

for the purposes of the Declared Project. This Order comes into effect on the date it is published in the Government Gazette.
