NOTICE TO BIDDERS

NOTICE IS HEREBY GIVEN that sealed bids will be received by the Village of West

Haverstraw at the office of the Village Clerk, Village Hall, 130 Samsondale Avenue, West

Haverstraw, New York 10993, until 12 noon on Wednesday, September 5, 2018, and then be

publicly opened and read aloud.

Copies of the Specifications, Bid Blanks and all necessary information may be obtained

at the Office of the Village Clerk, between the hours of 8:30 o’clock a.m. and 4:30 o’clock p.m.,

Monday through Friday or online at www.empirestatebidsystem.com. Bids must be submitted

on official forms and in sealed envelopes at the above address and shall bear on the face thereof

the name and address of the bidder, and addressed to the “Bid for Drainage Improvements –

Samsondale Housing Development”

All bids must be accompanied by a Statement of Non-Collusion in conformity with the

requirement of Section 103-d of the General Municipal Law, as amended, and bid security in a

sum equal to the 10% of the amount bid.

Bids are requested from any and all parties including but not limited to minority

businesses and enterprises operated and conducted by women.

The Village reserves the right to reject any and/or all bids. Bids shall be awarded in

accordance with General Municipal Law §103.

INFORMATION FOR BIDDERSREQUIREMENTS OF BID AND DELIVERY

ALL BIDS MUST BE SUBMITTED ON THE FORMS ANNEXED HERETO AND IN ACCORDANCE WITH PROVISIONS CONTAINED HEREIN.

1. Receipt and Opening of Bid.

The Village of West Haverstraw invites bids for the "Bid Item" specified in the "Notice to Bidders" as detailed in the specifications attached hereto. Bids will be received at the office of the Village Clerk until the time stated in the Notice to Bidders, and then at said place will be publicly opened and read aloud. Bids received after the specified time will not be considered. A bid may be withdrawn prior to the specified time for public opening. No bid may be withdrawn after the time set for public opening.

2. Preparation of Bid.

2.1. Sealed envelope. Each bid shall be submitted in a sealed envelope. The envelope shall have the following information on the outside:

2.2. Bid Proposal . All blank spaces on the bid proposal form must be filled in. Prices must be specified in both words and figures. Bid proposals must be signed by the bidder and properly acknowledged as specified on the form. Proposals which are incomplete, conditional or obscure, or which contain additions not called for, erasures, alterations, ambiguities or irregularities of any kind may be rejected as non-compliant.

2.3. Non-Collusion Certification . Each bid must be accompanied by a non-collusion

certification as required by General Municipal Law Section 103-d. The certification shall be signed by the bidder. A copy of non-collusion certification is annexed hereto.

3. Addenda and Interpretation.

No interpretation of the meaning of the specifications or other pre-bid documents will be made to any bidder orally. Every request for such interpretation or clarification should be in writing addressed to the Clerk of the Village of West Haverstraw, 130 Samsondale Avenue, West Haverstraw, NY 10993. To be given consideration such requests must be received at least five days prior to the date fixed for the opening bids. All such interpretations and any supplemental instructions will be in the form of a written addendum to the specifications which, if issued, will be mailed by certified mail with return receipt requested to all prospective bidders (at respective addresses furnished for such purposes), not later than three days prior to the date fixed for the opening of bids. Failure of any bidder to receive any such addendum or interpretation shall not relieve such bidder from any obligation under his bid submitted. Any addenda so issued shall become part of the contract documents.

4. Deviations from Specifications.

Minor deviations from specifications need not be specified. Major differences or variances from specifications shall be listed separately from the proposal and enclosed with the proposal and made a part hereof.

5. Duration of Bid:

Prices and bid shall remain firm and effective for at least 45 days from date of opening of bids.

6. Performance / Payment / Maintenance Bonds.

The successful bidder shall submit, at the time of execution of the contract, a Performance Bond and a Payment Bond, or Certified Check, or equivalent, in the full amount due under the lump sum and unit prices stipulated in the bid for the faithful performance of the contract. A maintenance bond for one year in an amount equal to 5% of the total cost of the project shall be required upon completion. (At the contractor’s option, the maintenance bond requirement may be satisfied by leaving retainage in the stated amount withheld by the Village from the final contract payment pending the completion of punch list and other contract obligations for the period of the maintenance requirement.)

7. Bid Price.

The prices quoted are to include the complete cost of the work or items bid including all charges, taxes, and all other incidental charges. It is expressly called to the bidder’s attention that bids are to be complete in all respects as regards materials, equipment or work to be furnished under this contract, and that no extras of any kind be allowed.

8. Taxes.

The bid price shall not include any Federal Excise Tax, Transportation Tax or New York State Sales Tax from which the Village is exempt.

9. Qualifications of Bidders.

The Village may make such investigations as it deems necessary to determine the ability of the bidder to perform the work or supply the items, and the bidder shall furnish the Village all such information and data for this purpose as the Village may request. The Village reserves the right to reject any bid if the evidence submitted by or investigation of, such bidders fails to satisfy the Village that such bidder is properly qualified to carry out the obligations of the contract or supply the items, and to complete the work contemplated therein. Conditional bids will not be accepted.

10. Prevailing Wages.

The wages and supplements to be paid to laborer, workman or mechanic performing work under this Contract shall be not less than the prevailing rate of wages and supplements as defined and determined by the New York State Labor Law or the Davis-Bacon Act (40 USC276a to a-7) as supplemented by Department of Labor regulations (29 CFR Part 5), as applicable, a copy of which is attached hereto or to the Bid Documents (Attachment No. 2).

11. Village's Reservation Rights.

The contract will be awarded to the lowest responsible bidder furnishing the required security. The Village reserves the right to select the bid proposal, or any separate part thereof if separable, the acceptance of which will best serve the interest of the Village or to reject all bids and to re-advertise for bids. The Village specifically reserves the right to waive any informalities in the bids tendered.

12. Bid Award Basis.

The Village will award the bid to the lowest responsible bidder. The Village reserves the right to accept or reject all bids or any parts thereof. The Village reserves the right to waive any irregularities or informalities in the bidding.

13. Additional Terms.

13.1. Bidders must comply with the provisions of Section 296 of the Executive Law of the State of New York which prohibits discrimination because of age, race, creed, color, sex or national origin in the hiring, firing or promotion of an employee.

13.2. Bidders shall comply with all other applicable Federal, State and local laws relating to the operation of its business and in the performance of this project and shall, at its own cost and expense, obtain any and all permits required by law for said operation and performance.

13.3. After opening of bids and prior to the award of a contract, the Board of Trustees may require the apparent low bidder to submit references or other such evidence of bidder’s financial or other ability to perform the work in the bid specifications or such other information as deemed relevant by the Board of Trustees.

13.4. The successful bidder shall not assign, transfer or subcontract any portion of the work to be performed, without the express written consent of the Village.

13.5. Bidders must comply with the regulations of the “Anti-Kickback Act” of June 13, 1934 and amendments thereto.

13.6. Any bid accepted for materials or equipment only is accepted on an “as when needed” basis. The Village reserves the right to purchase in lesser or greater quantities (up to 25%) than those set forth on the specification and proposal sheet, without an increase in the unit price.

13.7. All prices quoted for materials or equipment only must be held for six months.

13.8. All prices are F.O.B., West Haverstraw, New York.

13.9. All materials and equipment purchased must be of the latest manufacturer’s design and specifications of the current year.

13.10. The successful bidder shall submit, at the time of execution of the contract, a Certificate of Insurance, showing liability insurance coverage in the amount of $2,000,000 per person for bodily injury, $2,000,000 for each accident and $100,000 property damage of each accident, in addition to the statutory limits for Worker’s Compensation, and otherwise as set forth at in the General Conditions of the Proposed Contract annexed hereto and made a part hereof.

13.11. Bidders submitting bids in excess of $10,000 must comply with Executive Order 11246 entitled “Equal Employment Opportunity” as amended by Executive Order 11375 and as supplemented in Department of Labor Regulations. Contractors and subcontractors shall be required to report once each month during the construction of the project as to the composition of their workforce. Reporting forms will be provided at the preconstruction conference.

13.12. Bidders submitting bids on construction projects in excess of $2,000 must comply with Sections 103 and 107 of the Contract Work Hours and Safety Act, as supplemented by Department of Labor regulations.

13.13. Direct any questions related to these specifications directly to P.J. Corless, PE, Village Engineer, [email protected] at least 48 hours prior to the scheduled bid opening.

13.14. The contractor is to provide on-site “portable johns” for his employees, within walking distance of the construction site. These devices are to be regularly serviced and positioned in such a location as to not be an attractive nuisance to the homeowners in the area. Approval of the location of these facilities is required and will be given by the Superintendent of Public Works. Alternates to the portable johns may be approved by the said Superintendent.

13.15. During the evening hours of the construction period, the contractor shall provide continuous access to each driveway and front door access, such as smooth level gravel surfaces. In the event of questionable access, the final determination shall be made by the Village DPW.

TECHNICAL SPECIFICATIONSFOR

DRAINAGE IMPROVEMENTS – SAMSONDALE HOUSING DEVELOPMENT

Standards of Construction: All construction is to be in accordance with the applicable sections of NYSDOT Standard Specifications, construction and materials, 01/02/1990, as last revised.

NOTE: The details of the proposed drainage piping, elevations, catch basins, flared end sections, etc., are shown in the attached drawing – see Attachment No. 1. The contractor, as part of the unit price, shall:

1. Notify all appropriate utilities and schedule a pre-work mark-out. Work cannot commence on the project until the said “mark-outs’ are on the ground and have been approved as being on the entire site, by the Superintendent of Public Works of the Village;

2. Schedule a pre-construction meeting 48 hour prior to construction start with the Village Engineer and Village Superintendent of Public Works on site prior to the commencement of the project;

3. Parking of individual homeowner vehicles are at a premium in this project area. The contractor must coordinate with the DPW and the Town of Haverstraw Police for temporary “no parking” signs for the limited area to be done each day.

4. The proposed road excavations are to be saw-cut, with a mechanical device. The road cuts shall be at least 60” wide – i.e. 24” on each side of the existing 15” CMP.

5. The existing pipe and catch basins are to be carefully removed from the ground so as to protect the integrity of the remaining roadway. The abandoned material, pipe and catch basins, are to be removed and discarded in accordance with the standards promulgated by the NYSDEC and the RC Health Department.

6. The new 15” diameter HDPE pipe and precast concrete catch basins, as shown on the project drawing, are to be installed in the same locations and the same elevations as the existing pipe and basins. The existing elevations and top of the finished castings on the catch basins is to remain “as is” for continued street “sheet flow” drainage. Most (approximately 90%) (estimated quantity -2,600 lf +/-) of the pipe on this project is to be installed in trenches at less than 4’ in depth.

7. The cost of excavation, removal and disposal of the pipe, supply of the necessary stone, material, labor, etc., shall be included in the unit price of the new pipe installed.

8. There are three locations - Kennedy Drive and Roosevelt Drive; Kennedy Drive and Farley Drive, and; Kennedy Drive and Brownsell Avenue – where there is existing 15” HDPE pipe, which totals 141 lf. These three sections/locations of pipe shall remain in place but connected into the new catch basins. The contractor will be paid, under a unit item bid by the contractor, for connecting the existing pipe at six locations into the new precast concrete basins. This will require six separate connections, into the basins and its related mortar joints. The contractor will not be paid for these sections of pipe (141 lf).

9. There is one section of piping (30 lf of pipe) which is to be installed at a depth greater than 6’, but less than 9’. There is a separate bid item for this section of piping.

10. Approximately 150 lf of 15” HDPE piping is to be installed outside of the pavement area. There is a separate bid item for this section of piping.

11. Since the pipe depth is shallow, the contractor must install the new pipe in a 4” thick bed of clean ¾” stone and supply similar ¾” stone halfway up the side of the pipe (approximately 8”) for the width of the trench. This will provide continuous lateral support to the installed pipe.

12. The remaining excavation shall be filled with suitable excavated material, (free of compressible material and rocks larger than 6”) to within 6” of the existing finished surface. This 6” space is to be filled with NYSDEC dense binder asphaltic concrete paving, level with the existing roadway and shaped to drain. The cost of the pipe, stone and asphaltic concrete shall be included in the per foot price for the pipe.

13. The new precast concrete catch basins shall be furnished and installed at the same location of the existing catch basins. The existing basins are to be removed from the site. The existing castings shall be re-used. These castings are to be bolted to the new basins. Include the cost of installation and restoration of the existing castings as part of the lump sum price for each catch basin. Approximate quantity of new catch basins is 32.

14. The contractor shall take all necessary precautions to insure soil erosion control, per NYSDEC guidance, and protection of the adjacent property from soil/earth runoff, weather or vandalism during this period of construction. No trench can be open overnight. Suitable steel plates or temporary trench closing with stone is permitted. All open trenching made each day is to be patch paved at the end of the workday, to the maximum extent possible. If any trench is not paved, the excavation shall be made level to the road elevation with a minimum 6” layer of NYSDOT item 4 stone. Pedestrian access to each house must be maintained during the day always and vehicular access to the individual driveways in the evenings.

15. Broom sweep the road and all disturbed areas of all debris and excess material each night. Replant and reseed all disturbed grassy areas to the similar condition that exists prior to construction and shape the area to drain freely towards the catch basins. Any damage to the surface of the roads or driveways must be repaired or replaced to the existing conditions, as determined and approved by the Village Superintendent of Public Works.

16. Crack-seal the joints, with hot AC-20 asphaltic tar, between the existing pavement and new pavement section.

NON-COLLUSIVE BIDDING CERTIFICATION

By submission of this bid, each bidder and each person signing on behalf of any bidder certifies, and in the case of a joint bid each party thereto certifies as to its own organization, under penalty of perjury, that to the best of knowledge and belief:
