WHEREAS, the City Council of the City of Centennial, Colorado has received and examined the filings and the Petitions for Annexation requesting the annexation of certain real estate more fully described in said petitions and in Exhibit 1 (“Dry Creek Corporate Center Annexation No. 1”), Exhibit 2 (“Dry Creek Corporate Center Annexation No. 2”), and Exhibit 3 (“Dry Creek Corporate Center Annexation No. 3”), which exhibits are attached to this Resolution and are incorporated herein by reference (collectively, the “Property”); and

(b) A map showing the boundary of the Property proposed to be annexed.

(c) Within the map, the boundaries and the plat numbers of plots or of lots and blocks.

(d) Next to the boundary of the Property proposed to be annexed is drawn the contiguous boundary of the City of Centennial.

3. That no signature on the Petitions is dated more than one hundred eighty (180) days prior to the date of filing of the Peti-tions for Annexation with the City Clerk of the City of Centennial, State of Colorado.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Centenni-al, Colorado as follows:

Section 1. That the foregoing recitals and findings are incorporated herein as findings and conclusions of the City Council.

Section 2. That the Petitions for Annexation to the City of Centennial of the Property commonly referred to as the “Dry Creek Corporate Center Annexation No. 1”, “Dry Creek Corporate Center Annex-ation No. 2” and the “Dry Creek Corporate Center Annexation No. 3”, which Petitions were officially filed of record with the City Clerk of the City of Centennial on or prior to Friday, May 23, 2014, substantially comply with the requirements of C.R.S. § 31-12-107(1).

Section 3. No election is required under C.R.S. § 31-12-107(2).

Section 4. No additional terms and conditions are to be imposed except as provided in the Petitions for Annexation and in any Annexation and Development Agreement which may be entered into by and between the City of Centennial and the petitioner(s) or their successors and/or assigns, which are not to be considered additional terms and conditions within the meaning of C.R.S. § 31-12-112.

Section 5. That a public hearing shall be held on Monday, the 4th day of August, 2014, at 7:00 p.m. at the City Council Chambers, 13133 East Arapahoe Road, Centennial, Colorado for the purpose of determining and finding whether the pro-posed annexation complies with section 30 of article II of the Colorado Constitution and the applicable provisions of C.R.S. §§ 31-12-104 and 31-12-105.

Section 6. Any person may appear at such hearing and present evidence pertaining to the eligibility of the proposed annexation of the Property.

Section 7. Effective Date. This Resolu-tion shall be effective immediately upon its adoption by City Council.

SERIES OF 2014INTRODUCED BY: Mayor pro tem kramerAN ORDINANCE AMENDING THE GREENWOOD VILLAGE LAND DEVEL-OPMENT CODE REGARDING LENGTH OF STAY IN HOTELS AND MOTELSWHEREAS, the Greenwood Village Land Development Code defines a dwelling unit as a housekeeping unit containing cooking, living, sleeping and sanitary facilities; and

WHEREAS, only extended stay hotels and motels in Greenwood Village have full kitchens, including a sink, dishwasher, built in cooking facilities and full-sized refrigerators essential to longer term dwelling by an individual or a family; and

WHEREAS, persons staying in hotels for long periods tend to have more electrical appliances than a transient guest and more personal belongings stored in the room; and

WHEREAS, Colorado law provides that occupants of hotels, motels, inns, rooming houses, and similar accommodations gain status as tenants and residents after 30 days; and

WHEREAS, some proprietors of hotels and motels allow long term stays but avoid conferring tenancy status and rights to guests by having them check out before 30 days and check back in; and

WHEREAS, a 30-day occupancy limit for hotels and motels intended for transient stays serves the important public purpose of preventing hotels and motels from becoming substandard apartments without rights of tenancy and in violation of zoning laws; and

WHEREAS, for reasons of health, safety and welfare, venues allowing longer term occupancy of hotel and motel rooms must comply with applicable zoning, housing, building, and occupancy codes; and

WHEREAS, residential use of commercial property is currently prohibited by the Greenwood Village Land Development Code; and

WHEREAS, the Greenwood Village City Council desires to regulate the duration of hotel and motel stays to allow some resi-dential use where it is safe to do so, and prohibit stays longer than 30 days where necessary to ensure safety of the guests and maintain the commercial nature of the property in accordance with its zoning designation.

NOW, THEREFORE, THE CITY COUN-CIL OF THE CITY OF GREENWOOD VILLAGE, COLORADO, ORDAINS:

Section 1. Section 16-1-100 of the Greenwood Village Municipal Code is hereby amended to read as follows:

Sec. 16-1-100. Definitions

Hotel or motel means a building contain-ing guest rooms, which may have eating and drinking facilities, an interior rental car counter and meeting rooms as accessory uses, with a garage or parking area con-veniently proximate, and which is intended only for transient occupancy of less than 30 consecutive days.

Extended stay hotel or motel means a hotel or motel in which all rooms contain accommodations for sleeping and a kitch-en equipped with a full-sized refrigerator, built-in cooking facilities, microwave, sink, dishwasher, cooking utensils, dishes, and cutlery.

Section 2. Section 16-17-20 of the Greenwood Village Municipal Code is hereby amended to read as follows:

Sec. 16-17-20. Uses by right.

Uses by right are as follows:

(1) All uses by right in the B-3 District except that General Retail Stores shall be limited to no more than ten thousand (10,000) square feet and not including drive-in businesses and service uses shall be limited to laundry and dry cleaning facilities; (2) Hotels and motels; (3) Auto service stations and repair garag-es for minor repairs;(4) Retail stores for the sale of new auto-mobile parts and accessories;(5) Theaters;(6) Mailing centers;(7) Art studios and galleries;(8) Recreation facilities; (9) Public buildings and facilities; and(10) Extended stay hotels and motels in existence as of January 1, 2014.

Section 3. Section 16-17-30 of the Greenwood Village Municipal Code is hereby amended to read as follows:

Sec. 16-17-30. Special uses.

Uses permitted in accordance with an SUP are as follows:

(1) New automobile dealerships, provided:a. Vehicles as sold by a licensed fran-chised dealer of only one make of auto-mobile where all models of said make are marketed as “luxury vehicles” and defined as such by Kelly Blue Book, Ward’s Auto-motive Group U.S. Market Segmentation, or other nationally recognized resource for prices, values and review on new cars;b. There shall be no off-site storage of vehicles;c. Showrooms for the display or sale of motor vehicles may have as an accessory use thereof, outdoor display area for new and previously owned vehicles and a fully-enclosed service or repair shop;(2) Public buildings and facilities; (3) Public utilities; (4) Businesses with drive-in or drive-up facilities; and(5) Extended stay hotels and motels.

Section 4. A new section, 16-17-90, is hereby added to the Greenwood Village Municipal Code to read as follows:

Sec. 16-17-90. Limitations on duration of occupancy in hotels, motels and extended stay hotels and motels.

(a) It shall be unlawful for any person to put up or stay at the same hotel or motel for longer than twenty-nine (29) days in a sixty (60) consecutive day period. It shall also be unlawful for the owner, operator, manager, or person in charge of a hotel or motel to permit or allow a person to stay at the hotel or motel in excess of twenty-nine (29) days in a sixty (60) consecutive day period. This section shall not apply to extended stay hotels and motels, as defined in 16-1-100.

(b) Notwithstanding subsection (a) of this section, a stay in excess of twenty-nine (29) days in a sixty (60) consecutive day period may occur in the following situations:

WHEREAS, the owner of property located north of East Orchard Road and west of South University Blvd. dedicated a drainage easement to the Village by plat in 1980; and

WHEREAS, a request has been submitted by the property owner that the City vacate the drainage easement so that the owner

can construct a swimming pool in that location; and

WHEREAS, the owner has agreed to dedicate a new drainage easement to the Village to replace the vacated easement; and

WHEREAS, City staff has recommended that the City Council approve the request to vacate the easement and move the drain-age easement and the detention pond.

NOW, THEREFORE, THE CITY COUN-CIL OF THE CITY OF GREENWOOD VILLAGE, COLORADO, ORDAINS:

Section 1. Vacation of Easement. Based on the recommendation of City staff, the City Council hereby vacates the drainage easement located as more particularly described in Exhibit A.

Section 2. Recordation. Upon the

Approximately 250 children live in this area and frequently use these streets. This project will utilize Sheridan’s $25,000 in set-aside funds, with the balance being provided by the County’s Competitive Funds.Location: W. Floyd Ave between S. Bryant St. and S. AN ORDINANCE ORGANIZING THE GREENWOOD VILLAGE HOSPITALITY BUSINESS IMPROVEMENT DISTRICT AND APPROVING AN INITIAL BOARD OF DIRECTORS THEREFORE

WHEREAS, the City Council of the City of Greenwood Village (the “City Council”) received a Petition for the Organization of the Greenwood Village Hospitality Busi-ness Improvement District (the “Petition”) within the City of Greenwood Village (the “District”) on June 16, 2014;and

WHEREAS, in accordance with Section 31-25-1206, C.R.S., on June 16, 2014 the City Council fixed by order the place and time of a hearing on the Petition, which is not less than twenty (20) days nor more than forty (40) days after the date the Petition was received; and

WHEREAS, the City Council, following notice as required by Section 31-25-1206, C.R.S. held and concluded such public hearing at 7:00 p.m. on Monday, July 7, 2014 at the Greenwood Village City Hall, at which proponents and opponents of the District had the opportunity to be heard; and

WHEREAS, the City Council has found from the tax rolls of Arapahoe County, in which the proposed District is located, that the total valuation for assessment of the taxable real and personal property in the proposed service area of the District is $1,589,289, all of which is classified for

assessment as commercial, and none of which is classified as residential; and

WHEREAS, based upon the Petition and other evidence presented to the City Council in the aforementioned public hear-ing, the City Council has found and does hereby find that the Petition has been duly signed and presented in conformity with Part 12 of Article 25 of Title 31, C.R.S., that the signatures on the petition are genuine, and that the execution of the petition has been delegated by the per-sons who own real or personal property in the service area of the proposed District having a valuation for assessment of not less than fifty percent of the valuation for assessment of real and personal property in the service area of the proposed District and who own at least fifty percent of the acreage in the proposed District to the persons signing the Petition; and

WHEREAS, the City Council does not find it to be in the best interests of the District to exclude any property from the District, nor is the City Council required to do so in accordance with Section 31-25-1208, C.R.S.; and

WHEREAS, the Petition sets forth:

(a) The name of the proposed District, which shall include a descriptive name and the words “business improvement district”, to wit: “Greenwood Village Hos-pitality Business Improvement District”;

(b) A general description of the bound-aries and service area of the proposed District;

(c) A general description of the types of services or improvements or both to be provided by the proposed District;

(d) The names of three persons to repre-sent the petitioners, who have the power to enter into agreements relating to the organization of the District; and

(e) A request for organization of the District; and

WHEREAS, the allegations of the Petition appear to be true.

NOW, THEREFORE, THE CITY COUN-CIL OF THE CITY OF GREENWOOD VILLAGE, COLORADO, ORDAINS:

Section 1. Pursuant to its authority to organize business improvement districts under Part 12 of Article 25 of Title 31, C.R.S., and specifically Section 31-25-1207, C.R.S. the City Council, as governing body of the City of Greenwood Village, hereby adjudicates all questions of jurisdiction to find that jurisdiction is vested in the City Council to organize the business improvement district described in the Petition. Section 2. The City Council hereby ascertains, based on evidence presented from the tax rolls of Arapahoe County that the total valuation for assessment of the taxable real and personal property in the

In accordance with Section 31-25-1207(5), C.R.S., the District shall be a quasi-municipal corporation and political subdivision of the State of Colorado with all powers and responsibilities thereof, and specifically the powers set forth in Part 12 of Article 25 of Title 31, C.R.S.Section 8. Pursuant to Section 31-25-1209(1)(a), C.R.S., the City Council provides by this ordinance for the creation of a board of directors comprised of not fewer than five eligible electors to be ap-pointed by the City Council in accordance with Section 31-25-1209(1)(b), C.R.S. The actions of the City Clerk and petitioners in setting and providing public notice of the public hearing on the Petition as set forth in Section 31-25-1206, C.R.S. are hereby ratified and confirmed. NOTICE IS HERBY GIVEN that the Arapahoe County Cultural Council of Arapahoe Coun-ty, Colorado will hold a Public Hearing on July 22, 2014 at 9:30 AM or as soon thereafter as the calendar permits, in the East Hearing Room of the County Administration Building located at 5334 South Prince Street, Littleton, Colorado 80120 in order to obtain the opinions of citizens, public agencies and other interested parties regarding the Arapahoe County Cultural Council (ACCC) disbursement of 2014-2015 Scientific and Cultural Facilities District (SCFD) Tier III funds benefiting local art, cultural and scientific and his-torical organizations in the amount of $1,356,711.51. The $48 million in total allocations, proposed by the Scientific Cultural Facilities District Board, represents 1/10th of 1 percent of sales tax collected from Adams, Arapahoe, Broomfield, Boulder, Denver, Douglas and Jefferson Counties. The SCFD Grant Funds Check Award Ceremony will take place on October 16, 2014 at 6:30 pm in the East Hearing Room in the Arapahoe County Adminis-tration Building located at 5334 South Prince Street, Littleton, Colorado 80120.
