ANORDINANCEREGULATINGTHEUSEOFTHEPARKSANDPROPERTYOWNEDORCONTROLLEDBYTHEVERNONHILLSPARKDISTRICT

(“CONDUCTORDINANCE”)

CHAPTER1-DEFINITIONS,CONSTRUCTION,ANDSCOPE

Section 1.01. Short Title.ThisOrdinanceregulatingtheuseoftheparksandpropertyowned,operated,maintainedorcontrolledbytheVernonHillsParkDistrictshallbeknownandmaybecitedasthe"ConductOrdinanceoftheVernonHillsParkDistrict."

Section 1.02. Definitions.Unlessotherwiseexpresslystatedelse-whereinthisOrdinance,forpurposesofthisOrdinance,thefollowingwords,terms,andphrasesshallhavethemeaningsgivenherein:

1. "Aircraft"meansanydevicethatisusedorintendedtobeusedforhu-manflightintheairoriscapableofflightintheair,includingwithoutlimi-tationpowerlessflight.Modelaircraftalsomeansanyunmannedaircraftthatiscapableofsustainedflightintheatmosphereincludingdronesofanykind.

2. "AlcoholicLiquor"isdefinedasprovidedintheIllinoisLiquorControlActof1934(235ILCS5/1-3.05)asamendedhereafter.

3. "AquaticLife"meansallfish,reptiles,amphibians,crayfish,mussels,mollusks,andcrustaceans.

4. "Board"meanstheBoardofParkCommissionersoftheVernonHillsParkDistrict.

5. "Camping"shallincludetheerectingofatentorshelterofnaturalorsyntheticmaterial,preparingasleepingbag,hammock,orotherbeddingmaterialforuse,settingupanytemporaryorpermanentcampingequip-mentincludingwithoutlimitationfoodpreparationequipment,andparkingofamotorvehicle,motorhomeortrailer,ormooringofavessel,fortheapparentpurposeofovernightoccupancy,orremainingovernightonDistrictProperty.

6. "Cannabis"isdefinedasprovidedintheIllinoisCannabisControlAct(720ILCS550/3(a))asamendedhereafter.

7. "Carry"meanstowear,bear,orhaveonorabouttheperson.

8. "ControlledSubstance"isdefinedasprovidedintheIllinoisControlledSubstancesAct(720ILCS570/102(f),204,206,208,210and212)as

amendedhereafter.

9. "Director"istheExecutiveDirectoroftheVernonHillsParkDistrict.

10."District"istheVernonHillsParkDistrict,LakeCounty,Illinois.

11."DistrictPoliceForce"istheVillageofVernonHillsPoliceDepartment.

12.“DistrictProperty”isalloftheproperty,realandpersonal,ofeverykindanddescriptionlocatedwithinthejurisdictionof,orowned,adminis-tered,leasedorlicensedby,orotherwiseinthepossessionorunderthecontroloftheDistrictincludingwithoutlimitationeverybuilding,shelter,street,sidewalk,trail,path,beach,park,playground,wildernessoropenspace,orotherpublicorproprietaryplaceorfacilityandallDistrictWaterslocatedonoradjacenttoorflowingoverpropertylocatedwithinthejurisdictionof,orowned,administered,leasedorlicensedby,orotherwiseinthepossessionorunderthecontroloftheDistrict.

13.“DistrictWaters”shallincludeallwaterlocatedonoradjacenttoorflowingoverlandowned,leased,orgenerallyadministeredoroperatedbytheDistrict,includingwithoutlimitationallnaturalorman-madelakes,rivers,creeks,streams,ponds,lagoons,bays,anddrainageways.

14.“DivisionHead”isthepersonimmediatelyinchargeofagivenDistrictDivisionanditsactivitiesandtowhomallemployeesofsuchdepartmentaredirectlyresponsible(e.g.,SuperintendentofRecreationandSuperin-tendentofParks).

15.“Fish”or“Fishing”meanstakingorattemptingtotakeaquaticlifeinorfromanyDistrictWatersbyanymethod,andallotheractssuchasplacing,setting,drawingorusinganydevicecommonlyusedforthetakingofaquaticlifewhetherresultinginsuchtakingornot.

16.“ILCS”istheIllinoisCompiledStatutes.

17.“Obscene”isdefinedassetforthin70ILCS5/11-20.

18.“Operator”meansapersonwhooperates,drives,controls,otherwisehaschargeof,orisinactualphysicalcontrolofamechanicalmodeoftransportationoranyothermechanicalequipment.

19.“Ordinance”meansthisConductOrdinance.

20.“Permit”isthewrittenauthorizationissuedbyorundertheauthority

oftheDistrict,byaDistrictofficeroremployeeempoweredtograntsaidauthorization,toaPersontodoorengageinaparticularactoractsonDistrictProperty.Saidauthorizationissubjecttothetermsandcondi-tionsspecifiedinthePermitaswellasallapplicablefederal,state,local,andDistrictlaws,ordinances,rules,andregulations.

21.“Person”iseverynaturalpersonandeveryorganization,firm,partner-ship,association,corporation,unitofgovernmentorentityofanykindoranyemployee,agentorofficerthereof.ThisdefinitionshallnotincludetheDistrictandanyauthorizedofficer,employee(fullorpart-time,regularorshort-term),oragentoftheDistrictwhenactingwithinthescopeofhisauthority.

22.“Possess”or“Possession”meansexercisingdirectphysicalcontrolordominion,withorwithoutownership,overanykindofproperty,orarcheological,culturalornaturalresource.

23.“Refuse”includeswithoutlimitationtrash,garbage,rubbish,waste,papers,bottlesorcans,debris,litter,oil,solvents,liquidwaste,orotherdiscardedmaterialwhethersolidorliquid.

24.“Services”shallincludebutnotbelimitedtolabor,professionalservices,transportation,leasingorrentinganyarticle,object,privilege,orservice,givingofinstructionsorlessons,admissiontoexhibits,useoftelephoneorotherutilities,oranyactforwhichpaymentiscustomarilyreceived.

25.“UseofTobacco”meansthelightingofcigarettes,cigarsorpipes,thecarryingoflightedcigarettes,cigarsorpipes,ortheintentionalanddirectinhalationofsmokefromtheseobjects.“Tobacco”isdefinedtoincludeanylightedorunlightedcigarette,includingbutnotlimitedtoclove,bidis,orkreteks,electronicore-cigarette,cigars,cigarellos,pipes,hookahproducts,andanyothersmokingproducts;anysmokeless,spit,orspit-less,dissolveableorinhaledtobaccoproducts,includingbutnotlimitedtodip,chew,snuff,snus,inanyform;andallnicotinedeliverydevicesthatarenotFDAapprovedascessationproducts.

26.“Take”or“Taking”meanstopursue,hunt,harass,lure,harm,shoot,traporensnare,gigorspear,net,capture,collect,kill,destroy,wound,orattempttodoanyoftheabove.

27.“Vehicle”meanseverydevicein,upon,orbywhichapersonorpropertyistransportedordrawnonland,whethermotorpoweredorself-propelled,exceptbabycarriagesorstrollers,bicycleswhenproperlyusedonwalksortrails,andvehiclesintheserviceoftheDistrict.

28.“Vessel”meanseverytypeordescriptionofcraft,otherthanasea-planeonwater,usedorcapableofbeingusedasameansoftransporta-tiononwater,includingwithoutlimitationboats,rafts,canoes,kayaks,jetskis,inflateddevices,oranybuoyantdevicepermittingorcapableoffreeflotation.

29.“Wildlife”shallincludeanywaterfowl,mammal,animal,amphibian,reptile,orbirdortheyoungoreggsthereof.WildlifedoesnotincludeanyanimalwhichisspecificallypermittedtobeonDistrictPropertybyasectionofthisOrdinance,butsuchpresenceshallbeinstrictaccordancewithanyconditionsorrestrictionsprovidedinsuchsection.

Section 1.03. Construction and Scope.(a)IntheinterpretationofthisOrdinance,itsprovisionsshallbeconstruedasfollows:

Wherethecontextpermits,wordsinthemasculinegendershallincludethefeminineandneutergendersandwordsinthesingularnumbershallincludethepluralnumber;(2)Theword“shall”isalwaysmanda-toryandnotmerelydirectory;(3)Theword“may”isalwayspermissiveanduponthediscretionoftheDistrict;(4)ThisOrdinanceisinadditiontoandsupplementaltoallapplicablestate,federal,local,andDistrictlaws,ordinances,rules,andregulationsincludingwithoutlimitationtheParkDistrictCode(70ILCS1205/1-1etseq.);(5)Themeaningofanyterm,phrase,orwordnototherwisedefinedinthisOrdinanceshallbeconstruedandinterpretedtomeanthesameassaidterm,phrase,orwordisotherwisedefined,construedorinterpretedinsuchapplicablefederal,state,local,orDistrictlaws,ordinances,rules,orregulations;(6)Themeaningofanyterm,phrase,orwordnototherwisedefinedinthisOrdinanceorinsuchapplicablefederal,state,local,orDistrictlaws,ordinances,rules,orregulationsshallretainitsordinaryandproperlyunderstoodmeaning;(7)Thedescriptiveheadingsofthevarioussec-tionsorpartsofthisOrdinanceareforconvenienceonlyandshallnotaffectthemeaningorconstruction,norbeusedintheinterpretationofanyprovisionofthisOrdinance;and,(8)AnattempttocommitanactorengageinanactivityprohibitedunderthisOrdinanceshalllikewisebedeemedprohibitedinthesamemannerasthecommissionofsuchactortheengaginginsuchactivityandsubjecttothesamepenalties.

(b)ThisOrdinanceshallapplytoandbeenforceablewithinanduponallDistrictProperty,andshallregulatetheusethereofbyallPersons.However,noprovisionhereofshallmakeunlawfulanyactnecessar-ilyperformedbyanyofficer,employeeoragentoftheDistrictorbyanycontractoractingpursuanttoexpressauthoritygrantedtohimunderhiscontractwiththeDistrict,orbyanymemberoftheDistrictPoliceForcewhenactingwithinthescopeofhisauthorityorinhislineofduty,orany

otherPersonsummonedbysuchpersontoassisthim.

CHAPTERII-SPECIFICRESTRICTIONSONCONDUCT&BEHAVIOR

Section 2.01. Alcoholic Liquor.(a)NoPersonundertheinfluenceofAlcoholicLiquorshallenterinto,be,orremainonDistrictProperty.ForpurposesofthisSection2.01,“undertheinfluence”shallmeansanyimpairmentresultingfromtheconsump-tionofAlcoholicLiquorthatmakesapersonlessable,eitherphysicallyormentally,orboth,toexerciseclearjudgmentortopossessthatcontrolofhimselfandhisactionsthathewouldotherwisehave.

(b)NoPerson,otherthantheDistrictoritsagent,shallsellordeliveranyAlcoholicLiquoronDistrictProperty,unlesssaidPersonhasfirstobtainedaPermitthereforfromtheDistrict.

(c)NoPersonshallbring,possess,drink,consume,take,use,ortransferanyAlcoholicLiquoronDistrictPropertywithouthavingfirstobtainedaPermitthereforfromtheDistrictunlessheisinoronDistrictPropertywherethepossession,consumption,use,ortransferofAlcoholicLiquorispermitted.

(d)EveryPersonpossessing,using,consuming,ortransferringAlcoholicLiquorpursuanttothissectionshallbesubjecttoandshallcomplywithallapplicablefederal,state,local,andDistrictlaws,ordinances,rules,andregulationsregardingthepossession,use,consumption,ortransferofAlcoholicLiquor.

Section 2.02. Animals and Pets.(a)NoPersonshallbringorreleaseontoDistrictPropertyanyWildlifeincludingwithoutlimitationanyanimalthecaptureorkillingofwhichisauthorizedbythefishandgamelawsoftheStateofIllinois,oranyotheranimal,exceptfordomesticateddogs,catsorotherdomesticatedanimalssubjecttotherestrictionscontainedinthissection.Provided,however,thattheDistrictmaybringorrelease,orpermitanotherPersontobringorreleasesuchproscribedanimalsontoDistrictPropertyincon-junctionwithanactivityoreventconductedorsponsoredbytheDistrictorinconjunctionwithazoo,museum,naturecenter,orsimilarfacilitycontrolled,maintained,permittedorlicensedbytheDistrict.(b)Noowneroragentoftheownerhavingcontrolofanydomesticateddog,cat,oranyotherdomesticatedanimalshallcauseorpermitsuchanimaltobeonDistrictPropertyunlessthepetisonaleashwhichshallnotexceedsix(6)feetinlengthandsuchPersonhasinhisimmediatepossessionadeviceforremoval,andadepositoryforthetransportation

of,animalexcrementfromsuchProperty.

(c)Allownersoragentsoftheownerhavingcontrolofanydomesticateddog,cat,orotherdomesticatedanimal,shallremoveanyexcrementfromDistrictPropertyleftbysuchanimal.

(d)NoPersonshallbringadomesticateddog,cat,oranyotheranimalontoorpermitanyanimaltoremainonanyportionofDistrictPropertywherethepresenceofanimalsisprohibited.

(e)AnyanimalfoundonDistrictPropertyinviolationofsubsections(a)or(d)maybeapprehended,removedtoananimalshelter,publicpound,orotherplaceprovidedforthatpurpose,anddisposedofpursuanttothelawsorordinancesofLakeCounty.TheownerorPersonresponsibleforsuchanimalshallberesponsibleforallcostsandexpensesincurredorencumberedintheremovalandhousingofsuchanimalandsuchchargeshallbeinadditiontoandnotinlieuofanyotherpenaltiesprovidedforinthisOrdinanceandanyotherapplicablefederal,state,localorDistrictlaws,ordinances,rulesorregulations.

(f) Dogsforthevisuallyimpairedandotherdomesticatedanimalsspe-ciallytrainedtoassistPersonswithdisabilitiesareexcludedfromtheprohibitionsofthissectionwhentheyareaccompanyingPersonswithdisabilitiesforpurposesofprovidingsuchassistance.

Section 2.03. Assault or Bodily Injury.(a)NoPersonshall,withoutlawfulauthority,engageinconductonDistrictPropertythatplacesanotherPersoninreasonableapprehensionofreceivingbodilyharmorphysicalcontactofaninsultingorprovokingnature.

(b)NoPersonshallintentionallyorknowinglybyanymeanscausebodilyharmormakephysicalcontactofaninsultingorprovokingnaturewithanotherPersononDistrictProperty.

Section 2.04. Begging and Panhandling.(a)NopersonshallbegorpanhandleinDistrictbuildingsorfacilitiesortheentrancesorstairwaysofsuchbuildingsorfacilities.

(b)NoPersonbeggingorpanhandlingonDistrictPropertyshallinten-tionallyobstructorimpedepedestriansorVehicles;harassparkvisitorswithphysicalcontactorpersistentdemands;misrepresenthisaffiliations;misrepresentwhatthesolicitedfundswillbeusedfor;orinterferewith,interrupt,orengageinconductincompatiblewiththepurposeof,anyprogram,activity,function,and/orspecialeventconducted,sponsored,

licensedorotherwisepermittedbytheDistrict;orcoerceorintimidateanotherpersonintogivingmoney,goodsorservices.

Section 2.05. Charitable, Religious, Political, or Non-Profit Activities.(a)Forpurposesofthissection,charitable,religious,political,ornon-profitactivitiesshallinclude,withoutlimitationsolicitationofcontributions,thesaleordistributionofmerchandise,solicitationofvotesorcirculationofpetitionsfororagainstanycandidateforelectiontopublicofficeorwithrespecttoanyreferendumorotherpublicquestion.

(b)Solicitingcontributionsforcharitable,religious,political,ornon-profitorganizationsispermittedonDistrictPropertyprovidedthataPermitthereforhasfirstbeenobtainedfromtheDistrictinaccordancewithChapterVofthisOrdinance. (c)Thesaleordistributionofmerchandisebycharitable,religious,politi-cal,ornon-profitorganizationsispermittedonDistrictPropertyprovidedthataPermitthereforhasfirstbeenobtainedfromtheDistrictinaccor-dancewithChapterVofthisOrdinance.

(d)SolicitingvotesandcirculatingpetitionsfororagainstanycandidateforelectiontopublicofficeorwithrespecttoanyreferendumorotherpublicquestionispermittedonDistrictPropertyinareasopentothegeneralpublicwithoutapermit,subjecttothelimitationssetforthinthisSection2.05.

(e)NoPersonshallengageinanyactivitydescribedinsubsections(a)through(d)ofthisSectioninanyroomofaDistrictbuildingorfacilityinwhichanyprogram,activity,class,functionorspecialeventconducted,sponsored,licensedorotherwisepermittedbytheDistrictisinprogress.

(f) NoPersonengagedintheactivitiesdescribedinsubsections(a)through(d)ofthissectionshallobstructorimpedepedestriansorVehicles,harassparkvisitorswithphysicalcontactorpersistentdemands,misrepresenttheaffiliationsofthoseengagedinsuchac-tivities,misrepresentwhatsolicitedfundswillbeusedfororwhethermerchandiseofferedforsaleordistributionisavailablewithoutcostordonation,orinterfere,interrupt,orengageinconductincompatiblewiththepurposeof,anyprogram,activity,function,and/orspecialeventconducted,sponsored,licensedorotherwisepermittedbytheDistrict.

Section 2.06. Commercial Sale, Rental, Exhibition, or Distribution of Goods or Services.(a)Nopeddler,vendororanyotherPersoninvolvedinanendeavorfor

profitshallengageinthecommercialsale,rental,exhibition,ordistribu-tionofgoodsorservices,includingwithoutlimitationthegivingofinstruc-tionorlessonsforafee,uponDistrictPropertyunlesshehasreceivedaPermit,licenseorcontractthereforfromtheDistrict. (b)NoPersonengagedinthesaleordistributionofgoodsorservicesunderthissectionshallobstructorimpedepedestriansorVehicles,harassparkvisitorswithphysicalcontactorpersistentdemands,misrep-resenttheaffiliationsofthoseengagedinsuchactivities,misrepresentwhetherthegoodsorservicesareavailablewithoutcostordonation,orinterfere,interrupt,orengageinconductincompatiblewiththepurposeof,anyprogram,activity,function,and/orspecialeventconducted,spon-sored,licensedorotherwisepermittedbytheDistrict.

Section 2.07. Controlled Substances and Cannabis.(a)NoPersonundertheinfluenceofanyControlledSubstanceorCannabisshallenterinto,be,orremainonDistrictProperty.

(b)NoPersonshallbringinto,possess,take,use,sell,ortransferanyControlledSubstanceorCannabisonDistrictProperty.

Section 2.08. Cooperation with Authorities.(a)NoPersonshallphysicallyhinder,threaten,resist,intimidate,disobey,orotherwiseintentionallyinterferewithanymemberoftheDistrictPoliceForceoranyDistrictemployeeoragentintheperformanceofhisduties.

(b)NoPersonshallfalselyrepresentthatheis,orotherwisepretendtobe,aDistrictofficeroremployee,amemberoftheDistrictPoliceForce,oranagentorotherrepresentativeoftheDistrict.

(c)NoPersonshallknowinglygiveafalsereportorfalseinformation(in-cluding,withoutlimitation,informationrequestedinaPermitapplication)forthepurposeofmisleadingtheBoard,aDistrictemployeeoragent,oramemberoftheDistrictPoliceForceintheconductofhisofficialduties.

Section 2.09. Disorderly Conduct.APersoncommitstheoffenseofdisorderlyconductwhenheknowingly:(a)Doesanyactinsuchunreasonablemannerastoalarmordisturbanotherandtoprovokeabreachofthepeace;or

(b)Makesorcausestobemadeanyexcessivelyloudorunreasonablenoisewhichdisturbsthepeace.Forpurposesofthissubsection,exces-sivelyloudorunreasonablenoiseisdefinedasnoiseinconsistentwithornotreasonablyattendanttoappropriateandcustomaryparkandrecre-ationalactivities,consideringthenatureandpurposeoftheactor’scon-

duct,location,timeofdayornight,andotherfactorsthatwouldgoverntheconductofareasonablyprudentpersonunderthecircumstances.Thissectionshallinclude,withoutlimitation,theloudoramplifiedplay-ingofanytypeofaudioequipment,noisemaker,musicalinstrument,orsoundequipment.Thissectionshallnotapplytotheplayingofanymu-sicalinstrument,publicspeaking,ortheamplificationthereof,inconjunc-tionwithactivitiesconducted,sponsored,licensedorotherwisepermittedbytheDistrict;or

(c)UsesObsceneorabusivelanguageorgestures,orthreatensvio-lenceorinjurytothepersonorpropertyofothers,inamannerintendedandlikelytoinciteorproduceanimmediatebreachofthepeaceorviolentordisorderlyresponse;or,

(d)CongregateswithotherPersonsonDistrictPropertywiththeintenttorestrictvehicularorpedestriantrafficorwiththeintenttorestrictfreeingresstoandegressfromDistrictPropertyandfailstocomplywithalawfulorderoftheDistrictPoliceForcetodisperse.

Section 2.10. Display of Permit or Pass. EveryPersonshallproduceordisplayaPermitorpasswhenrequestedtodosobyanyauthorizedPersonforthepurposeofenforcingcompli-ancewithanyfederal,state,local,orDistrictlaw,ordinance,rule,orregulation,whensuchPermitorpassisrequiredtoengageinanactivityonDistrictProperty.

Section 2.11. Dumping, Pollution, Sanitation, and Litter.(a)NoPersonshalllitter,cast,throw,drop,scatter,place,pile,orotherwisedump,release,leave,ordepositinanymanneranykindofdirt,rubbish,placard,handbill,pamphlet,circular,book,notice,paperofanykind,ashes,garbage,wastematerial,snow,ice,orothersubstance,whetherliquidorsolid,oranyotherRefuseinoruponDistrictPropertyexceptasspecificallypermittedbytheDistrict.Provided,however,thatpaper,glass,cans,garbageandotherRefuseresultingfrompicnicsorotherlawfuluseofDistrictPropertymayandshallbedepositedinrecep-taclesprovidedbytheDistrictforthatpurpose.Wherereceptaclesarenotprovided,aremissing,orarefulltocapacity,allsuchgarbage,Refuse,orothermaterialshallbecarriedawayfromtheareaofusebythePersonresponsibleforitscreationandpresence,andproperlydisposedofelsewhere.(b)NoPersonshallurinateordefecateonDistrictPropertyotherthanintoiletsinrestroomfacilitiesexpresslyprovidedforsuchpurposes.

(c)NoPersonshalldrainoil,grease,anti-freeze,gasolineorothersub-stancefromatrailerorotherVehicleonDistrictProperty.

(d)NoPersonshallbatheorwashhimselforfood,clothing,dishes,orotherpropertyatwateroutlets,fixturesorpoolsonDistrictProperty,exceptatthoseareasdesignatedbytheDistrictforsuchuse.

(e)NoPersonshallpolluteorcontaminateDistrictPropertyorDistrictWaters.

(f) NoPersonshalldisposeoffishremainsonDistrictProperty,orinDistrictWatersexceptaspermittedbytheDistrict.

(g)NoPersonshalldisposeofhumanoranimalwasteonDistrictProper-tyexceptatdesignatedlocationsorinfixturesprovidedforthatpurpose.

(h)AnyPersonviolatingthissectionmaybeassessedthecostofremovinganysuchimproperlydepositedsubstanceormaterialandsuchchargeshallbeinadditiontoandnotinlieuofanyotherpenaltiesprovid-edforinthisOrdinanceorapplicablefederal,state,local,and/orDistrictlaws,ordinances,rules,andregulations.

Section 2.12. Encroachment. Nobuildingorotherstructure,garden/landscaping,oranypartorappurtenancethereofshallextendinto,uponoroveranypartofDistrictProperty,unlessexpresslypermittedbytheDistrict,inwriting.

Section 2.13. Erection of Structures/Wires and Other Appurtenances and Devices. NoPersonshallconstruct,build,erect,orotherwiseplaceanybuilding,tent,stand,scaffold,platformorotherstructureofwhateverkind,whetherstationaryormoveableandwhetherpermanentortemporaryincharac-ter,orconstruct,run,string,hang,orotherwiseplaceanyelectricalwire,conduitorpipe,oranypublicserviceorprivateutility,into,upon,above,acrossorbeneathDistrictProperty,unlessaPermit,license,orcontractthereforhasfirstbeenobtainedfromtheDistrict.

Section 2.14. Fairs and Special Events: Sale and Distribution of Merchandise; Soliciting Contributions. NoPersonshallselland/ordistributemerchandiseorprintedorwrit-tenmaterialsorsolicitcontributions,votesorsignaturesduringfairsorspecialeventsconductedorsponsoredbytheDistrictexceptatafixedlocationdesignatedbytheDistrictandunlessaPermitthereforhasfirstbeenobtainedfromtheDistrictinaccordancewithChapterVofthisOrdi-nance.TheDistrictshallallocatespaceatthefixedlocationtoapplicantsonafirst-come,first-servedbasisuntilnomorespaceremainsavailable.

Section 2.15. Fires.(a)NoPersonshalllight,maintain,ormakeuseofanyfireonDistrictProperty,exceptatsuchplacesandatsuchtimesastheDistrictmaydesignateforsuchpurposeandundersuchrulesasmaybeprescribedbytheDistrict.

(b)Nofireshalleverbeleftunattended.Everyfireshallbeunderthecontinuouscareanddirectionofacompetentadultfromthetimeitiskindleduntilthetimeitiscompletelyextinguished.Allfiresmustbeprop-erlyandcompletelyextinguishedpriortoanyPersonleavingthesiteofthefire.

(c)NoPersonshallthroworotherwisediscardlightedorsmolderingma-terialinanymannerthatthreatens,causesdamageto,orresultsintheburningofDistrictPropertyorparkresources,orcreatesasafetyhazard.

Section 2.16. Gambling and Games of Chance. NoPersonshallplayorengageinsellingfortunesorfutures,gamesofchance,orinanyotherdeviceorgameofchance,hazardorskill,eitherasbookmaker,dealer,playerorotherwise,forthepurposeofgamingorgamblingformoneyorothervaluablethingsonDistrictProperty,exceptatafair,carnival,orotherorganizedeventconducted,sponsoredorauthorizedbytheDistrict.

Section 2.17. Interference with Other Users.(a)NoPersonshallwalk,act,orconducthimselfuponanyportionofDis-trictPropertydesignatedforaparticulargame,sport,event,amusementorotheruseinsuchawayastointerferewiththeuseofsuchportionbyotherPersonswhoareproperlyusingthesamefortheparticulargame,sport,event,amusementorotheruseforwhichithasbeendesignated.

(b)NoPersonshallunreasonablydisturborinterferewithanyotherPersonoccupyinganareaorparticipatinginanyactivityonDistrictProp-ertyundertheauthorityofaPermit.

(c)NoPersonshallengageinanyactivityonDistrictPropertyinamannercalculatedorwhichisreasonablylikelytoendanger,injure,ordamagePersonsorpropertyinanyway.

Section 2.18. Loitering in District Buildings. NoPersonshallloiterorremaininanyDistrictbuildingorfacilityinsuchamannerthat:(1)unreasonablyobstructstheusualuseofen-trances,hallways,corridors,stairways,orroomsdesignatedforspecificpurposes;(2)impedesordisruptstheperformanceofofficialdutiesbyDistrictemployees;or,(3)preventsthegeneralpublicfromobtainingthe

administrative,recreationalorotherservicesprovidedinthebuildingorfacilityinatimelymanner,afterbeingrequestedtoleavebyanymemberoftheDistrictPoliceForce,orwheretheDistricthaspostedasignorsignsthatprohibitloitering.

Section 2.19. Misappropriation of Property. No person on Park District Property shall knowingly: (a)Obtainorexerciseunauthorizedcontroloverthepropertyofanother.

(b)Obtainbydeceptioncontroloverpropertyofanother.

(c)Obtainbythreatcontroloverpropertyofanother.

(d)Obtaincontroloverstolenpropertyknowingthepropertytohavebeenstolenorundersuchcircumstancesaswouldreasonablyinducehimtobelievethatthepropertywasstolen,wherehe: (1) Intendstodeprivetheownerpermanentlyoftheuseorbenefitof theproperty;or, (2) Knowinglyuses,conceals,orabandonsthepropertyinsucha mannerastodeprivetheownerpermanentlyofsuchuseorbenefit; or, (3) Uses,conceals,orabandonsthepropertyknowingsuchuse, concealment,orabandonmentprobablywilldeprivetheowner permanentlyofsuchuseorbenefit.

Section 2.20. Mob Action.(a)NoPersonshallcollectwithotherPersons,inbodiesorincrowdsoftwo(2)ormorePersonswithoutauthorityoflaw,forunlawfulpurposesoranypurposeofdisturbanceorobstructionofthelawfulactivitiesofotherPersonsorotherwisedisturb,obstruct,orinterfereunreasonablywiththelawfulactivitiesofotherPersonsusingDistrictPropertyinaman-nerwhichcreatesimmediateviolenceorbreachofthepeaceorthreatthereoforendangersthepersonorpropertyofothers.

(b)NoPersonshallknowinglycommitanactorengageinconductthaturgesorincitesotherPersonstoriot,engageinimmediateviolenceorlawlessness,orcommitanyunlawfulact.

(c)NoPersonshallorganize,promote,encourage,orotherwisepartici-pateinariotorotherbreachofthepeaceinvolvingcrowdsoftwo(2)ormorePersonsgathered,withoutauthorityoflaw,forunlawfulpurposesoranypurposeofdisturbanceorobstructionofthelawfulactivitiesofother

Persons.

Section 2.21. Parades, Public Assemblies or Meetings.(a)Publicparades,processions,theatricalordramaticpresentations,meetings,assemblies,gatheringsanddemonstrationsarepermittedonDistrictProperty,providedthatwherethenumberofparticipantsisrea-sonablyexpectedtoexceedtwelve(12)ormorepersonsand/orvehicles,aPermitthereformustfirstbeobtainedfromtheDistrictinaccordancewithChapterVofthisOrdinance.

(b)Thissectionshallnotapplytostudentsgoingtoandfromschoolclassesorparticipatingineducationalactivitiesundertheimmediatedirectionandsupervisionofschoolauthoritiesortheiragents,agov-ernmentalagencyactingwithinthescopeofitsfunctions,ornormalorscheduledDistrictprogramsoractivities.

Section 2.22. Posting Printed or Written Material In Designated Area.

(a)TheDistrictshalldesignateanareaforthepostingofprintedorwrittenpublicinformationmaterial(“CommunityBulletinBoard”).

(b)NoPersonshallpost,place,display,orcausetobeposted,placed,ordisplayedanyprintedorwrittenmaterialontheCommunityBulletinBoardwithoutpresentingthematerialtotheDistrict.TheDistrictshallstampanddatethematerialasreceived,andpostthematerial,spacepermitting,ontheCommunityBulletinBoardunlessthesaidmaterialisObscene.Thematerialmayremainpostedforaperiodnottoexceedone(1)weekafterwhichaPersonmayresubmithispublicinformationnoticeforposting,spacepermitting.

(c)SpaceontheCommunityBulletinBoardshallbeallocatedonafirst-come,first-servedbasis,exceptthattheDistrict’sownprintedorwrittenpublicinformationmaybegivenpriority.Theprintedorwrittenmaterialshallbenolargerthan81/2inchesx11inchesandonlyonecopyofeachpublicinformationnoticeshallbeposted.

(d)TheDistrictmayremoveprintedorwrittenmaterialthathasnotbeenpostedinaccordancewiththisSection.ThePersonresponsibleforsaidpostingshallbeliableforthecostincurredintheremovalthereof.TheprovisionsoftheIllinoisParentalResponsibilityLaw(740ILCS115/1etseq.)arespecificallyincorporatedinthisOrdinancebyreferenceforpurposesofthissection.

Section 2.23. Posting Printed or Written Material On Public Places and Objects.(a)ExceptasprovidedinSection2.22ofthisOrdinance,noPersonshallpaint,writeon,orinanywaymarkordeface,orpostorotherwiseaffix,anyprintedorwrittenwords,symbols,materials,orothermarkstooruponDistrictPropertyoranythingorobjectlocatedonDistrictProperty.

(b)TheDistrictmayremoveanyprintedorwrittenword,symbol,materi-al,sign,orothermarkfoundpostedorotherwiseaffixeduponanyDistrictPropertyoranythingorobjectlocatedonDistrictPropertyinviolationoftheprovisionsofthisSection.ThePersonresponsibleforanysuchdefacing,writing,orpostingshallbeliableforthecostincurredintheremovalthereof.TheprovisionsoftheIllinoisParentalResponsibilityLaw(740ILCS115/1etseq.)arespecificallyincorporatedinthisOrdinancebyreferenceforpurposesofthissection.

Section 2.24. Protection of Animals.(a)NoPersonshallhunt,pursue,hurt,touch,injure,kill,trap,catch,poison,abuse,chase,shoot,throworpropelobjectsat,endangerinanyway,orremoveorcausetoberemoved,haveinhispossession,orreleaseorcausetobereleased,anyWildlifeonoruponDistrictProperty,exceptwithwrittenpermissionoftheDistrict.

(b)NoPersonshallgiveoroffertoanyWildlifeanyharmful,poisonous,ornoxioussubstanceonoruponDistrictProperty.

(c)NoPersonshalltouch,tease,frighten,disturb,orotherwiseintention-allyinterferewithanyWildlifewhilefeeding,nesting,breeding,sleeping,resting,flyingorengaginginanyotheractivityon,upon,overorunderDistrictProperty.

(d)NoPersonshalldisturb,touch,throworpropelanobjectat,destroy,digup,crush,shake,orinanywaytamperwithordamagethenest,lair,den,burrow,orhomeofanyWildlifefoundon,upon,overorunderDis-trictProperty.

(e)NopersonshallfeedwildlifeonDistrictProperty.

Section 2.25. Protection of Property.(a)NoPersonshallmark,carve,bend,cut,paint,deface,affixanystick-erorsignto,breakdown,destroy,damage,alter,change,sever,uproot,dig,excavateorotherwiseremove,orattachorsuspendanyrope,wire,orothermaterialorcontrivanceto,on,orfrom,DistrictPropertyoranythingorobjectonoruponDistrictProperty,orotherwisetake,damageordestroysuchProperty,thingorobjectunlessaPermit,licenseorcontract

thereforhasfirstbeenobtainedfromtheDistrict.

(b)NoPersonshallclimbupon,walkon,hangfromorstandorsiton,anyplant,fence,structure,orotherDistrictPropertyofanykindexceptsuchbenchesorotherpropertydesignatedorcustomarilyusedforsuchpurposes,orrecreationalequipmentinstalledforsuchpurposes.

(c)NoPersonshallbringinto,throw,cast,drop,deposit,orotherwiseleaveorlaydownanysmokebomb,stinkbomb,orotheroffensivesmell-ingcompoundonDistrictProperty.

(d)NoPersonshallbringanyplantorportionofaplantorplantproductontoDistrictProperty. (e)TheDistrictmaygiverewardstothePerson(s)(otherthanDistrictemployeesoragents,ormembersoftheDistrictPoliceForce)whofur-nishinformationtotheDistrict,directlyresultinginthearrestandconvic-tionofanyPersonwhounlawfullytakes,damages,ordestroysDistrictProperty.AllclaimsforsaidrewardmustbemadetotheDistrictwithinthirty(30)daysafterconvictionandtheDistrictshallbethesolejudgeofanydisputearisingoverareward,ifany,andthePerson(s)entitledtosharetherein.TheDistrict’sdecisiononanymatterconnectedwiththerewardshallbefinal,conclusive,andbindingandshallnotbesubjecttojudicialreview.

Section 2.26. Public Indecency.(a)NoPersonseventeen(17)yearsofageoroldershallperformorcom-mitanyofthefollowingactsonDistrictProperty:

(1) Anactofsexualpenetrationorsexualconductasdefinedin720 ILCS5/12-12;or,

(2) Alewdexposureofthebodydonewithintenttoarouseorto satisfythesexualdesireofthePerson.

(b)NoPersonshallexhibit,sell,giveaway,offertosellorgiveaway,displayorholdorplaceinsuchamannerastobeopentopublicviewanyObscenebook,pamphlet,drawing,picture,photograph,model,cast,instrument,oranyotherObscenearticlewhileonoruponDistrictProperty.

Section 2.27. Reporting Accidents. APersoninvolvedinanincidentonDistrictPropertyresultinginpersonalinjuryorpropertydamage,shallreporttheincidenttotheDistrictPoliceForcewithintwenty-four(24)hoursaftertheincident.

Section 2.28. Restricted Areas.(a)NoPersonshallenterorremaininanybuildingorportionofDistrictPropertywherePersonsareprohibitedbytheDistrictfromentering,or,exceptasprovidedinSection2.30(c)ofthisOrdinance,whereuseisrestrictedtoPersonsoftheoppositesexasindicatedbyasignornoticepostedbytheDistrict.

(b)NoPersonshallenterorremaininanyDistrictPropertywhenitisclosedtothepublic.

(c)NoPersonshallenteranyDistrictPropertythatisreservedorsched-uledforaspecificgrouporactivity,unlesssuchPersonisinvitedbytheindividual,group,oragencyresponsibleforsuchactivityandunlesssuchPersonhaspaidanyapplicableadmissionand/orregistrationfees.

Section 2.29. Restrictions Applicable to Specific Recreational Activities.

(a) Aircraft/Model Aircraft. (1) NoPersonshallfly,causetobeflownorpermitorauthorize theflyingofAircraftofanykindatanytimeoverDistrictPropertyatanelevationlowerthantheminimumsafetyrequirementsestablishedbytheFederalAviationAdministrationorothergovernmentalauthority,atanelevationwhichislowerthanisreasonablysafeunderthecircumstanc-es,orinamannerthatendangersthesafetyofanyPersononDistrictProperty.

(2) NoPersonshallland,causetobelanded,orpermitorauthorizethelandingofanyAircraftonDistrictProperty,exceptwhennecessitatedbyunavoidableemergency.

(3) NoPersonshallflyorcausetobeflownorpermitorauthorizetheflyingofmodelAircraftonoroverDistrictPropertyunlessaPermitthereforhasfirstbeenobtainedfromtheDistrictinaccordancewithChapterVofthisOrdinance.

(4) NoPersonshallparachuteorotherwisedescendfromanAir-craftintoorontoDistrictPropertyorcause,permitorauthorizeanotherPersontoparachuteorotherwisedescendfromanAircraftintoorontoDistrictProperty,exceptwhennecessitatedbyunavoidableemergency.

(b) Baseball and Softball Playing. NoPersonshallengageinsoftballorbaseballgamesexceptinthoseparksonwhichdiamondsandbackstopshavebeenconstructedforthatpurpose,orsuchotherareasasmaybespecificallydesignatedbythe

District;

(c) Boating/Model Boating. (1) NoPersonshalllaunchanyVesselinDistrictWaters,exceptfromsuchplacesasmaybedesignatedbytheDistricttherefore,andthenonlyincompliancewithapplicablefederal,state,local,andDistrictlaws,ordinances,rules,andregulations.

(2) NoPersonshalluse,employ,orbeinoruponanyDistrictlaunchingramporfacilityforthelaunchingorremovalofVesselsexceptondatesandduringhoursestablishedbytheDistrict.

(3) ModelBoating.PermittedonlyinthelagoonareaofLittleBearLakeinCenturyPark.Thelengthoftheboatmaybenolongerthan60”andtheenginesizemaybenolargerthan30cc.

(d) Camping.NoPersonshallplace,erect,oruseanyhammock,tent,shelter,oranyothertypeoftemporaryorpermanenthousingorcampingequipmentonDistrictProperty,remainovernightonDistrictPropertyorotherwiseengageinCampingonDistrictPropertyunlessaPermitthereforhasfirstbeenobtainedfromtheDistrict.

(e) Fishing. (1) NoPersonshallFishorotherwisetakeaquaticlifefromDistrictWatersatanylocationwheretheDistricthaspostedprohibitorysignage.

(2) EveryPersonFishinginDistrictWatersshallcomplywithallapplicablefederal,state,local,andDistrictlaws,ordinances,rules,andregulationsincluding,withoutlimitation,conservationlawsandlicensingrequirements. 3) FishinginDistrictWatersshallbeconductedbymeansofahookandline,withtherodorlinebeingcloselyattended.NoPersonshallusedrugs,poisons,explosives,electricity,ormissilesofanykindtoDistrictWaters.

(4) NoPersonshalldig,scratch,orotherwisedisturbDistrictPropertyinordertolocateortakebait.

(5) EveryPersonshallcarefullyandimmediatelyreturntothewaterfromwhichitwastakenanyfishthatdoesnotconformtosizeorspeciesrestrictionsimposedbyanyapplicablefederal,state,localorDistrictlaw,ordinance,ruleorregulation,orthatthePersonchoosesnottokeep.

(6) TheprovisionsofthissectionapplytoiceFishing.

(f) Golf. NoPersonshallplayorpracticegolfonDistrictProperty,exceptwheninvolvedinanestablishedgolfclassunderthesupervisionanddirectionoftheDistrict,orinanareadesignatedbytheDistrictfortheplayingorpracticingofgolf,andthePersonhassatisfiedallrequisitesbeforeplay-ingorpracticing,includingwithoutlimitationthepayingofanyapplicablefees.

(g) Horseback Riding. NopersonshallbringorcausetobebroughtontoDistrictpropertyanyhorses,unlessaPermitallowingsuchactivityhasfirstbeenobtainedfromtheDistrict.

(h) Hunting or Trapping. NoPersonshallhuntortrapinoron,orbringanydeviceforhuntingortrappingintooronto,DistrictPropertyorDistrictWaters.

(i) Picnics. NogroupofPersonsexceedingtwenty(20)innumbershallpicniconDistrictPropertyunlessaPermitthereforhasfirstbeenobtainedfromtheDistrictinaccordancewithChapterVofthisOrdinance.TheDistrictmaydesignateareasforpreparing,consuming,anddispensingfood,bever-agesandotherproducts.PersonsholdingaPermitanddispensinganysuchproductsmaydosoonlyintheareadesignatedinthePermit.Intheeventthatdispensingofthepermittedproductsisbysale,thePersonalsomustcomplywithSection2.14ofthisOrdinance.NoPersonmaydispense,prepare,consume,sellorotherwiseuseproducts,itemsorthingsotherwiseprohibitedinthisOrdinanceoranyotherfederalstate,local,orDistrictlaw,ordinance,rule,orregulation.

(j) Rollerskating and Skateboarding. NoPersonusingrollerskates,in-lineskates,skate¬boards,coastingvehicles,orsimilardevicesonDistrictPropertyshallinterferewithpedes-trianuseofsidewalksoruseofthestreetsbyVehicles,orotherwiseactnegligently,recklesslyorwithoutduecaution,orinanymannersoastoendangeranyPersonorproperty.NopersonshallusesuchdevicesonanyDistrictPropertywheresuchusehasbeenpostedasprohibited.

(k) Sledding, Ice Skating, and Snowmobiling. (1)NoPersonshallskate,sled,toboggan,innertube,ski,slide,orengageinsimilaractivitiesonDistrictPropertyexceptatsuchplacesandatsuchtimesastheDistrictmaydesignateforsuchpurposes.

(2)NoPersonshallengageinanysuchactivityinarecklessmannerthatendangershimselforothersorataspeedgreaterthanissafeandproperunderthecircumstances.

(3) NoPersonshalltow,push,pull,orotherwisepropelanotherPersononskis,sled,orotherslidingdevicebyuseofanyVehicleonDistrictProperty.

(4) NoPersonshalldrive,ride,orotherwiseoperateasnowmobileonDistrictProperty.Forpurposesofthissubsection,asnowmobileshallbedefinedasanyself-propelledvehicleintendedfortravelprimarilyonsnow,drivenbyatrackortracksincontactwiththesnow,andsteeredbyskiorskisincontactwiththesnow.

(l) Swimming. NoPersonshallbathe,swim,wade,float,splash,orotherwiseenterDistrictWatersexceptatsuchtimesandplacesandincompliancewithallpolicies,rulesandregulationsastheDistrictmaydesignateforsuchactivities.

(m) Tournaments, Leagues, or Other Organized Recreational Activities. NoPersonshallutilizeanyDistrictProperty,includingwithoutlimitationplayingfieldsandotherDistrictfacilities,fortournaments,leagues,orotherorganizedrecreationalactivitiesandoutingsunlessaPermitallow-ingsuchuseoractivityhasfirstbeenobtainedfromtheDistrict.

(n) Conflicts. Thissectiondoesnotapplytoprogramsoractivitiesconducted,spon-sored,licensedorpermittedbytheDistrict.WhereaconflictbetweenDistrictprogramsoractivitiesconducted,sponsored,licensedorpermit-tedbytheDistrictandarequestedactivityoccurs,Districtprogramsandactivitiesshalltakeprecedence.

Section 2.30. Restrooms, Shower Rooms, and Locker Rooms.(a)EveryPersonshallcooperateinmaintainingrestrooms,showerrooms,andlockerroomsonDistrictPropertyinaneatandsanitarycondition.

Section 2.31. Selling or Distributing Printed or Written Material.(a)ThedistributionofprintedorwrittenmaterialavailablewithoutcostordonationispermittedonDistrictProperty.

(b)ThesaleordistributionfordonationofprintedorwrittenmaterialispermittedonDistrictPropertyprovidedthataPermitthereforhasfirstbeenobtainedfromtheDistrictinaccordancewithChapterVofthisOrdinance.

(c)AnyPersonengagedinthesaleordistributionofprintedorwrittenmaterialsunderthisSectionshallnotobstructorimpedepedestriansorVehicles,harassparkvisitorswithphysicalcontactorpersistentdemands,misrepresenttheaffiliationsofthoseengagedinsuchactivi-ties,misrepresentwhetherthematerialsareavailablewithoutcostordonation,orinterfere,interrupt,orengageinconductincompatiblewiththeconductorpurposeofanyclass,program,activity,function,and/orspecialeventconducted,sponsored,licensedorotherwisepermittedbytheDistrict.

Section 2.32. Sleeping on District Property. NoPersonshallsleeponbenches,sidewalks,parkinglots,ortables,playgroundsorplaygroundequipment,stairwaysorindoorwaysofDistrictbuildingsorotherDistrictPropertyinamannerwhichunreason-ablyobstructs,hinders,orimpedesthemovementofotherPersonsortheiraccesstooruseofanysuchlocation,equipment,orfacility.

Section 2.33. Soccer Goal Usage. (a)Exceptasprovidedinsubsection2.33(c),below,noPersonmayinstall,placeoruseanysoccergoalonDistrictPropertythatisnotanchoredtothegroundinamannerreasonablycalculatedtomakeitdifficultforanyPersontomovethegoal.

(b)Exceptasprovidedinsubsection2.33(c),below,noPerson,otherthanauthorizedDistrictpersonnel,maymoveanysoccergoalthattheDistricthasinstalledorotherwiseplacedonDistrictProperty.(c)Theprohibitionscontainedinsubsections2.33(a)and2.33(b),above,shallnotapplytolightweightfold-uporpop-up,collapsiblepor-tablesoccertraininggoalswhicharetypicallymarketed,soldandusedforyouthsoccerpracticeandtrainingsessionsandnotforofficialgames.

Section 2.34. Use of Tobacco. (a)NoPersonundertheageof18maypossessoruseTobaccoprod-uctswhileonDistrictProperty. (b)TheuseofTobaccoproductsisprohibited:(i)onorwithin15feetofallDistrictProperty,whichisdefinedasalloftheproperty,realandpersonal,ofeverykindanddescriptionlocatedwithinthejurisdictionof,orowned,administered,leasedorlicensedby,orotherwiseinthepossessionorunderthecontroloftheDistrictincludingwithoutlimitationeverybuilding,shelter,street,sidewalk,trail,path,beach,park,play-ground,wildernessoropenspace,orotherpublicorproprietaryplaceorfacilityandallDistrictWaterslocatedonoradjacenttoorflowingoverpropertylocatedwithinthejurisdictionof,orowned,administered,leasedorlicensedby,orotherwiseinthepossessionorunderthecontroloftheDistrict;and(ii)inanyvehicle,machinery,orequipmentowned,leased,operatedby,orotherwiseunderthecontroloftheDistrict.

InadditiontotheprovisionsofthisChapter,andtotheextentnotin-consistenttherewith,noPersonshallperformanyactinanymanneronDistrictPropertyinviolationofanyprovisionoftheCriminalCodeof1961(720ILCS5/1-1etseq.),theFishandAquaticLifeCode,515ILCS5/1-1etseq.),theWildlifeCode(520ILCS5/1-1etseq.),ortheVillageCodeoftheVillageofVernonHills,whichprovisionsarespecificallyincorpo-ratedinthisOrdinancebyreference.

CHAPTERIII–MOTORIZEDVEHICLES,PARKING,ANDTRAFFIC CONTROL

Section 3.01. All -Terrain Vehicles. NoPersonshalldrive,ride,orotherwiseoperateanall-terrainVehicleonDistrictProperty.Forpurposesofthissection,anall-terrainVehicleshallbedefinedasanymotorizedoff-highwaydevice50inchesorlessinwidth,havingamanufacturer’sdryweightof600poundsorless,trav-ellingonthree(3)ormorelow-pressuretires,designedwithaseatorsaddleforoperatoruse,andhandlebarsorsteeringwheelforsteeringcontrol.

Section 3.02. Minibikes, Trailbikes and Scooters. NoPersonshalldrive,ride,orotherwiseoperateanyminibike,trailbike,ATV,motorizedscooterormotorbikeonDistrictProperty.Forpurposesofthissection,everymotorvehiclewhichisself-propelledbypowerobtainedbythecombustionofgasolineisprohibited.Maximumspeedlimitsonallvehiclesshallnotexceed15milesperhouseonallDistrictparkproperties.

Section 3.03. Commercial Vehicles.(a)Theterm“commercialvehicles”asusedinthissectionshallinclude,

butnotbelimitedto,trucks,stationwagons,vans,pickups,passengercars,orotherVehicleswhenusedintransportingPersonsormovablepropertyforafeeorprofit,eitherasadirectchargetoanotherPerson,orotherwise,orusedasincidenttoprovidingservicestoanotherPerson,orusedinconnectionwithanybusiness.Thisincludesfooddeliveryvehiclesandfoodvendingvehicles.

(b)AllroadwaysonDistrictPropertyshallbeusedforpleasuredrivingonly.NoPersonotherthanDistrictemployeesshalldriveanytruck,trac-tororothercommercialvehicleofanykindonDistrictPropertywithoutfirstobtainingaPermit,licenseorcontractthereforfromtheDistrict.

(c)ThissectionshallnotapplytocommercialvehiclesmakingauthorizeddeliveriestoorperformingauthorizedservicesfortheDistrict.

Section 3.04. Driving Areas. NomotorVehicleshallbedrivenorotherwiseoperateduponDistrictPropertyexceptoveranduponsuchroadways,parkinglots,orotherareasdesignatedormarkedbytheDistrictforusebymotorVehicles.AbicyclepathshallnotbedeemedaroadwayfortheuseofmotorVehiclesunderthissection.

Section 3.05. Enforcement of Traffic Regulations. NoPersonshallfailtoobeyamemberoftheDistrictPoliceForceorotherDistrictemployeewhoisdirectingtrafficorenforcingsectionsofthisChapteronDistrictProperty.

Section 3.06. Fleeing or Attempting to Elude the District Police Force.NoPersondrivingorotherwiseoperatingamotorVehicleonDis-trictPropertyshallwillfullyfailorrefusetoobeyavisualoraudiblesignalbyamemberoftheDistrictPoliceForcetobringhisVehicletoastop.ThesignalgivenbyamemberoftheDistrictPoliceForcemaybebyhand,voice,siren,orredorbluelight.ThememberoftheDistrictPoliceForcegivingsuchsignalshallbeinuniformordrivingaVehicleappropri-atelymarkedshowingittobeanofficialDistrictVehicle.

Section 3.07. Gas and Smoke. NoPersonshalldriveorotherwiseoperateaVehicleonDistrictPropertywhichemitsexcessivelynoxiousfumesordensesmoke.

Section 3.08. Hitchhiking. NoPersonshallsolicitaridenorstandinorneararoadwayonDistrictPropertyforthepurposeofsolicitingaridefromtheoperatorofanyVehicle.

Section 3.09. Incorporation of State Statutes. InadditiontotheprovisionsofthisChapter,andtotheextentnotincon-sistenttherewith,noPersonshalldriveorotherwiseoperateaVehicleorperformanyactinanymanneronDistrictPropertyinviolationofChap-ters11and12oftheIllinoisVehicleCode(625ILCS5/11-100etseq.and625ILCS5/12-100etseq.)whichprovisionsarespecificallyincorpo-ratedinthisOrdinancebyreference.

Section 3.10. Parking.(a)NoPersonshallparkamotorVehicleonDistrictPropertyotherthaninestablishedordesignatedparkingareas,andinaccordancewithposteddirectionsandmarkingsorwiththedirectionsofanyattendantwhomaybepresent.

(b)NoPersonshallparkanymotorVehicleorallowanymotorVehicletoremainparkedinanyareaofDistrictPropertybeyondthenormalclosinghouroftheparksystem,exceptwhenadifferentclosinghourhasbeendesignatedbytheDistrictforthatareaorunlesspermissionthereforhasfirstbeenobtainedfromtheDistrict.InnoeventshallanymotorVehicleexceptDistrictVehiclesbeparkedonDistrictPropertylaterthan11:30p.m.,exceptwiththeapprovaloftheDistrictwhichap¬provalshallautomaticallybedeemedgiveninconnectionwithactivitiesconducted,sponsored,licensedorotherwisepermittedbytheDistrict.AnyvehicleparkedinviolationofthisSection3.10(b)mayberemovedand/orim-poundedbytheDistrictPoliceForceasprovidedforinSections4.06(b)and7.03ofthisOrdinance.

(c)NoPersonshallstop,park,orplaceanyVehicleonDistrictPropertysoastoobstructorinterferewithtrafficortravelorendangerthepublicsafety,andnoPersonshallstop,park,orplaceanyVehicleinanyofthefollowingplacesexceptwhenexpresslypermittedbytheDistrictorwhennecessarytoavoidconflictwithothertrafficorwhenincompliancewiththeinstructionsofamemberoftheDistrictPoliceForce:(1)ontheleftsideofanyroadway;(2)onparkways,lawnareas,andgrounds;(3)infrontofapublicorprivatedriveway;(4)withinanyintersection;(5)withinanycrosswalk;(6)within20feetofanyintersectionorcrosswalk;(7)within30feetofanystopsignortrafficcontrolsignal;(8)ontheroad-waysideofanyVehiclestoppedorparkedattheedgeorcurboftheroadway;(9)inapositiontoblockanotherVehiclelawfullyparked;(10)onanysidewalk;(11)atanyplacewhereofficialsignsorothermarkingsprohibitparking,orwherecurbshavebeenpaintedyellow;(12)within15feetofafirehydrant;(13)inafirelaneorwithin8feetoftheentrancetoafirelane;(14)within20feetofthedrivewayentrancetoanyfirestationandonthesideofastreetoppositetheentrancetoanyfirestationwithin

75feetofsuchentrance(whenproperlysign-posted);(15)betweenasafetyzoneandtheadjacentcurborwithin30feetofpointsonthecurbimmediatelyoppositetheendsofasafetyzone,unlessadifferentlengthisindicatedbysignsormarkings;(16)alongsideoroppositeanystreetexcavationorobstructionwhenstopping,standing,orparkingwouldobstructtraffic;(17)uponanybridgeorotherelevatedstructureuponaroadway,orwithinaroadwaytunnel;(18)onanyrailroadtracksorwithin50feetofthenearestrailofarailroadcrossing;(19)onacontrolled-ac-cessroadway;(20)intheareabetweenroadwaysofadividedhighway,includingwithoutlimitationcrossovers;and,(21)atanyplaceortimewhereapermitorstickerisrequiredbytheDistrictforparkingunlesstherequiredpermitorstickerhasbeenobtainedandisdisplayedontheVehicle.

(d)NoPersonshallparkaVehicleupononDistrictPropertyforanyofthefollowingpurposes:todisplaysuchVehicleforsale;toperformmain-tenanceorrepairofsuchVehicle,exceptforrepairsnecessitatedbyanemergency;or,tosellgoodsorservicesfromsuchVehicle.

(e)EveryPersoninwhosenameaVehicleisregisteredpursuanttolawandwholeasessuchVehicletoothers,afterreceivingwrittennoticeofaviolationofthisOrdinanceinvolvingsuchVehicleandtheidentifyingnumberupontheregistrationplatesandregistrationstickerorstickersofsuchVehicle,shalluponrequestprovidetheDistrictwithawrittenstate-mentofthenameandaddressofthelesseeatthetimeofsuchoffense

(f) NoPersonwhoisthelessorofaVehiclepursuanttoawrittenleaseagreementshallbeliablefortheviolationofanyparkingorstandingregulationofthisOrdinanceinvolvingsuchVehicleduringtheperiodoftheleaseprovidedthatupontheDistrict’srequestreceivedwithin120daysaftertheviolationoccurred,thelessorprovideswithin60daysaftersuchreceiptthenameandaddressofthelessee.Thedriver’slicensenumbermayalsoberequestedbytheDistrictifneededforenforcementofthisOrdinance.

(g)Exceptasotherwiseprovided,everyVehiclestoppedorparkeduponatwo-wayroadwayonDistrictPropertyshallbestoppedorparkedwiththeright-handwheelsparalleltoandwithintwelve(12)inchesoftheright-handcurborascloseaspracticabletotherightedgeoftheright-handshoulder.

(h)PenaltyProvisionsforParkingViolations.

(1) WheneveranyVehicleshallhavebeenparkedinviolationofanysectionofthisOrdinanceprohibitingorrestrictingvehicularstand-

ingorparking,thePersoninwhosenametheVehicleisregisteredwiththeSecretaryofStateofIllinoisshallbeprimafacieresponsiblefortheviolationandsubjecttothepenaltytherefor,exceptasprovidedinthisOrdinance. (2) WheneveranyVehicleisparkedinviolationofanyparkingprovisionofthisOrdinance,anylawenforcementofficerobservingsuchviolationmayissueaparkingviolationnotice,andservethenoticeontheowneroftheVehiclebyhandingittotheoperatoroftheVehicle,ifheispresent,orbyaffixingittotheVehicleinaconspicuousplace.Theis-suerofthenoticeshallspecifyonthenoticehisidentificationnumber,theparticularparkingregulationallegedlyviolated,themakeandstateregis-trationnumberofthecitedVehicle,andtheplace,date,time,andnatureoftheallegedviolationandshallcertifythecorrectnessofthespecifiedinformationbysigninghisnametothenotice.

(3) Aparkingviolationnoticeissued,signed,andservedinaccor-dancewiththissection,oracopyofsuchnotice,shallbedeemedprimafaciecorrectandshallbeprimafacieevidenceofthecorrectnessofthefactsshowntherein.Thenoticeorcopythereofshallbeadmissibleinanysubsequentadministrativeorlegalproceeding.

(4) AnyviolationoftheparkingprovisionsofthisOrdinanceoranyprovisionoftheIllinoisMotorVehicleCodeprohibitingorrestrictingvehicularstandingorparkingshallbeaciviloffensepunishablebyfine,andnocriminalpenaltyorcivilsanctionotherthanthatprescribedinthisOrdinanceshallbeimposed.

(5) AnyPersonwhoviolatesorfailstocomplywithanyprovisionofthissectionshallbefined$25.00foreachoffense.

(6) AnyPersononwhomaparkingviolationnoticehasbeenservedshallwithinfourteen(14)daysfromthedateofthenoticeeitherpaytheindicatedfineor,inthemannerindicatedonthenotice,requestacourthearingtocontestthecharge,violation,orviolations.

(7) Ifnoresponseismadeinaccordancewiththissection,theClerkoftheCircuitCourtshallserveasecondnoticeofviolation,byfirst-classmail,postageprepaid,totheaddressoftheregisteredownerofthecitedVehicleasrecordedwiththeSecretaryofStateofIllinois.Thenoticeshallspecifythedateofaviolation,andmakeandstateregistrationofthecitedVehicle,theOrdinanceorCodeprovisionviolated,theappli-cablefineandpenaltyinanamountequaltotherelevantfinetobepaidbythefinalnoticedateorrequestforhearing.Thefinalnoticedateforpaymentshallbe21daysfromtheinitialduedate.

(8) Iftherespondentrequestsacourthearinginpersontocontestthecitedviolationorviolations,theClerkoftheCircuitCourtshallnotifytheDistrictandtherespondentinwritingofthetimeandplaceofthehearing. (9) Anoticesentpursuanttosubsections(k)(6),(7),and/or(8)shallstatethatfailuretopaytheindicatedfineorfailuretorequestacourthearingwillcausetheamountofthefinetobecomeadebtdueandowingtheDistrict,which,assuch,maybecollectedinaccordancewithapplicablelaw.Paymentinfullofanyfineand/orpenaltyresultingfromastandingorparkingviolationshallconstituteafinaldispositionofthatviolation.

(10)TheClerkoftheCircuitCourtshallnotifytheCountyState’sAttorneyofeachrespondentwhofailstomakepaymentorwhofailstorequestacourthearingpursuanttosubsections(k)(6),(7),(8),and/or(9).UponbeingnotifiedbytheClerkoftheCircuitCourt,theCountyState’sAttorneyshallinstituteacivilactionagainsttherespondentinanamountofthefineplusapenaltydoubletherelevantfineandcosts.Anyactioninstitutedand

(11)proceedingthereinshallbeconductedinaccordancewiththeRulesoftheCircuitCourtofLakeCounty,theCodeofCivilProcedureandthelaws,rulesandregulationsoftheStateofIllinois.

Section 3.11. Speeding. ExceptasprovidedinthisOrdinance,noPersonshalldriveorotherwiseoperateaVehicleonDistrictPropertyataspeedgreaterthanisreason-ableandsafeunderthecircumstances,havingdueregardfortraffic,pedestrians,weatherconditionsandtheintendeduseoftheroadwayandatnotimeataspeedgreaterthan15milesperhour,andnoPersonshalldriveorotherwiseoperateaVehicleonDistrictPropertyataspeedthatendangersthesafetyofanyPersonorproperty.

Section 3.12. Traffic Signs and Signals. NoPersonshallfailtoobserveanytrafficsignindicatingspeedlimit,directionoftravel,caution,stopping,parking,crosswalklanes,trafficlanemarkers,andanyothersignpostedbytheDistrictforsafeguardinglifeorproperty.

Section 3.13. Unattended Motor Vehicles. NoPersondriving,operating,orotherwiseinchargeofamotorVehicleonDistrictPropertyshallpermitittostandunattendedwithoutfirststop-pingtheengine,lockingtheignitionandremovingthekeys.WhenthemotorVehicleisstandinguponanyperceptiblegrade,thePersonshallsettheparkingbrakethereonandturnthefrontwheelstothecurbor

sideoftheroadway.Section 3.14. Unauthorized Use of Parking Places Reserved for Handicapped Persons.(a)Forpurposesofthissection,handicappedpersonmeanseverynatu-ralpersonwhoisunabletowalk200feetormoreunassistedbyanotherpersonorwithouttheaidofawalker,crutches,braces,prostheticdevice,orawheelchairorwithoutgreatdifficultyordiscomfortduetothefollow-ingimpairments:neurological,orthopedic,respiratory,cardiac,arthriticdisorder,blindness,orthelossoffunctionorabsenceofalimborlimbs.

(b)NoPersonshallparkonDistrictPropertyanymotorVehiclewhichisnotbearingregistrationplatesordecalsissuedtoahandicappedperson,pursuantto625ILCS5/3-616,11-1301.1,11-1301.2,ortoadisabledveteranpursuantto625ILCS5/3-609,whichprovisionsarespecificallyincorporatedinthisOrdinancebyreference,asevidencethattheVehicleisoperatedbyorforahandicappedpersonordisabledveteran,inanyparkingplace,includingwithoutlimitationanyprivateorpublicoff-streetparkingfacility,specificallyreservedbytheDistrict,bythepostingofanofficialsignasdesignatedunder625ILCS5/11-301,formotorVehiclesbearingsuchregistrationplates.AnymotorVehiclebearingahandi-cappedlicenseplateorahandicappedparkingdecalordevicecontain-ingtheinternationalsymbolofaccessissuedtohandicappedpersonsbyanylocalauthority,state,district,territoryorforeigncountryshallberecognizedbytheDistrictasavalidlicenseplateordeviceandreceivethesameparkingprivilegesashandicappedresidentsofthisState.

(c)TheDistrictmayremoveorcausetoberemovedtothenearestgarageorotherplaceofsafetyanyVehicleparkedwithinastallorspacereservedforusebythehandicappedwhichdoesnotdisplayhandi-cappedregistrationplatesoraspecialdecalordeviceasrequiredbythissection.

(d)AnyPersonfoundguiltyofviolatingtheprovisionsofthissectionshallbefinednotlessthan$100andnotmorethan$200inadditiontoanycostsorchargesconnectedwiththeremovalorstorageofanymotorVehicleauthorizedunderthissection.

CHAPTERIV-PARKHOURS,CLOSING,ANDGENERALOPERATION POLICIES

Section 4.01. Hours.(a)ExceptasotherwiseprovidedinthisSection,DistrictProperty(Parks)shallbeopentothepublicfromsunriseinthemorninguntilsunsetintheeveningofthatsamedayandDistrictPropertyshallbeclosedtothe

publicfromsunseteachdayuntilsunrisethefollowingday.(b)Parkswithlightedpathways,eg.DeerpathPark,CenturyPark,HawthornMellodyParkandKelliGarvanianPark,shallbeopentothepubliceachdayuntil10:30p.m.;providedhowever,thatbasketballcourtslocatedwithintheseparksshallbeclosedtothepublicfromsunseteachdayuntilsunrisethefollowingday.

(c)TheBoardmaybyresolution,withoutthenecessityofamendingthisOrdinance:(i)establishotherhoursduringwhichDistrictPropertyoranypartsthereofshallbeclosedtothepublic,and(ii)periodicallyrevisethehoursprovided,however,thatnoticeofhoursestablishedbyresolutionshallbepostedattheapplicableparkorparklocation.

Section 4.02. Special Closings. TheBoardortheDirectormaycloseoneormoreDistrictparks,build-ings,andfacilitiesoranypartthereoftothepublicatanytimeandforanyintervaloftime,eithertemporarilyoratregularintervals,andeitherentirelyormerelytocertainuses,asdeemedadvisableandinthebestinterestofthepublicandDistrict.

Section 4.03. Use of Closed Property Prohibited. NoPersonshalluse,occupy,bein,orremainuponDistrictPropertyorleaveanypersonalpropertyinoruponDistrictPropertywhichisclosedtothepublic,orafterclosinghours,unlesspermissionthereforhasfirstbeenobtainedfromtheDistrict.

Section 4.04. Schedules, Fees, Rules, and Regulations. Timeschedulesfortheoperationof,andtheactivitiestobeconductedon,DistrictPropertyandtheamountoffacility,Permitandprogramfees,maybereviewedandapprovedperiodicallybytheBoard.Aspermittedbylaw,feeschargednon-residentsoftheDistrictneednotbethesameasfeeschargedresidentsoftheDistrict.TheBoardmayotherwiseestablishpolicies,rulesandregulationsforproperconductbyPersonsusingDistrictProperty.Specificpolicies,rulesandregulationspertain-ingtoDistrictPropertyandprogramsmaybepostedatorontheap-plicableDistrictPropertyand/orpublishedinDistrictprogrambrochuresorotherwisemadeavailabletotheusersofDistrictProperty,whoshallbechargedwithactualknowledgethereof.AllPersonsshallabidebyallDistrictpolicies,rulesandregulationsandwiththedirectordersorrequestsofemployeesandagentsoftheDistrictwhenusingDistrictProperty.

Section 4.05. Admission/Identification. NoPersonshallenterinto,be,orremaininoruponDistrictPropertywithoutpayinganyapplicableadmissionfees,withoutcomplyingwith

registrationrequirementsthatmaybeestablishedbytheDistrict,orwithoutdisplayingtherequiredadmissionidentification.Alladmissionidentificationcards,papersandticketsarenon-transferableandmustbeindividuallyregistered,unlessotherwisespecificallynotedthereon.AchargemaybemadebytheDistrictforreplacinglostadmissionidentifi-cationcards,papersandtickets.

Section 4.06. Lost, Found, and Abandoned Property.(a)NoPersonshallabandonpropertyonDistrictProperty.

(b)Propertyleftunattendedforlongerthantwenty-four(24)hoursorunattendedpropertythatinterfereswithanyparkvisitor’ssafety,orderlymanagementoftheparkarea,orpresentsathreattoparkresourcesmaybeimpoundedorremovedbytheDistrictatanytime.Theownerofsuchpropertyshallberesponsibleandliableforallcostsandexpensesassociatedwiththeimpounding,removal,storage,orotherdisposaloftheproperty.

(c)AnyPersonfindinglostorunattendedpropertyonDistrictPropertyshallreportthediscoverytotheDistrictassoonasispracticable.When-everaDistrictemployeeoragentfindslostorunattendedpropertyonDistrictPropertyheshallreportthediscoverytohissupervisororDivisionHead.TheDistrictwillattempttomakeeveryreasonableefforttolocatetheproperty’sowner(s).

(d)Unattendedpropertythathasbeenimpoundedorpropertythathasbeenfoundshallbestoredforaminimumperiodofthirty(30)days.Unlessclaimedbytheowneroranauthorizedagentthereof,thepropertymaybeclaimedbythefinderofsuchpropertyunlessthefinderisanemployee,officer,oragentoftheDistrictormemberoftheBoard.AllpropertynotclaimedshallbedisposedofastheDistrictdeemsappropri-ate.

Section 4.07. Building Use. NoPersonshalluseanyDistrictbuildingorfacilityforaneventoractiv-itythatisnotconductedorsponsoredbytheDistrictunlessaPermitthereforhasfirstbeenobtainedfromtheDistrictinaccordancewiththisOrdinanceand/oralicenseagreementhasbeenexecutedwiththeDistrict.AllPersonsusingDistrictbuildingsorfacilitiesshallcomplywiththeprovisionsofthisOrdinanceandwiththeprovisionsandconditionsofthePermitand/orlicenseagreementandwithallotherapplicablepoli-cies,rules,andregulationsoftheDistrictregardingtheuseofDistrictProperty.

CHAPTERV-PERMITSANDOTHERAUTHORITY

Section 5.01. Permits.(a)PermitsmaybegranteduponproperapplicationandapprovalwheretheapplicablesectionofthisOrdinanceoranyotherDistrictordinance,policy,rule,orregulationrequiresaPermitinordertoengageinapar-ticularuse.

(b)EveryPersonrequestingaPermitshallcompleteandfileawrittenapplicationwiththeDirector,onformsprovidedbytheDistrict,andpayapplicableapplicationfeesatthelocationdesignatedbytheDistrict.TheDistrictshalltimeanddatestampeachsuchapplicationimmediatelyuponreceipt.

(c)Exceptasotherwiseprovidedinthissubsection5.01(c),applicationsforPermitsmustbereceivedbytheDistrictatleastforty-eight(48)hourspriortotheuseforwhichaPermitissought.ApplicationsforPermitsundersections2.01,2.06,2.29andanyothersectionofthisOrdinanceoranyotherDistrictordinance,rule,orregulationnotinvolvingtheexer-ciseofFirstAmendmentrightsmustbereceivedbytheDistrictatleasttwenty-one(21)calendardayspriortotherequesteduse.

(d)Exceptasprovidedinsubsection5.01(d)(6),theDistrictshallissuetherequestedPermitwithoutunreasonabledelayunless:

(1) Theproposeduseviolatesanyfederal,state,local,orDistrictlaw,rule,orregulation;or,

(2) ApriorapplicationforaPermitforthesamedate,time,andloca-tionhasbeenorwillbegrantedandtheuseauthorizedbythatPermitdoesnotreasonablyallowoccupancyofthatparticularlocationbymorethanonepermittee;or,

(3) Theproposeduseisofsuchanaturethatitcannotreasonablybeaccommodatedintheparticularlocationappliedfor,considering,with-outlimitation,thelikelihoodofsuchthingsasdamagetoparkresourcesorfacilities,damagetoanenvironmentallysensitiveorprotectedarea’secosystem,impairmentofaprotectedarea’satmosphereofpeaceandtranquility,unreasonableinterferencewithDistrictfunctions,buildings,facilities,operations,programsoractivities,orunreasonableinterferencewiththeuseorpurposeoftheDistrictPropertyappliedfor;or,

(4) TheproposedusewouldsubstantiallyimpairtheoperationoruseoffacilitiesorservicesofDistrictconcessionairesorcontractors;or,

(5) TheproposedusewouldsodominatetheuseofDistrictPropertyastoprecludeotherPersonsfromusingandenjoyingthepark.

(6) Thissubsection5.01(d)isnotapplicabletoapplicationsforcom-mercialactivityPermitsundersections2.06and2.14ofthisOrdinanceortoPermitsforsaleordeliveryofAlcoholicLiquorundersection2.01.TheDistrictreservestherighttoexerciseitsdiscretioninissuingPermitsundersections2.01and2.06.

(e)TheDistrictshallapproveordenyanyapplicationreceivedpursuanttoSections2.08,2.05,2.14,2.21or2.31ofthisOrdinancewithintwenty-four(24)hoursfromitsreceipt.TheDistrictshallapproveordenyanyapplicationreceivedpursuanttoSection2.14ofthisOrdinancewithin(48)hoursfromitsreceipt.Forapplicationsundersections2.01,2.06,2.29andanyothersectionofthisOrdinanceoranyotherDistrictordi-nance,rule,orregulationnotinvolvingtheexerciseofFirstAmendmentrights,theDistrictshallapproveordenytheapplicationwithinfourteen(14)calendardaysfromitreceipt.However,theDistrictmayextendthetimeforsuchactionprovidedthatitnotifiestheapplicantwithintwenty-four(24)hoursaftertheDistrict’sreceiptoftheapplication.SuchnoticeshallspecifythetimewithinwhichtheDistrictwillapproveordenytheapplication.

(f) Iftheapplicationisapproved,theDistrictshallissueawrittenPermittotheapplicant.Iftheapplicationisdenied,theDistrictshallissuetotheapplicantwrittenreasonsfordenyingtheapplication.

(g)Ifanapplicationisdeniedonthebasisofaschedulingconflictorinappropriatenessofthelocation,duration,ortimeoftheactivity,theDis-trictwillmakeareasonableefforttoarrangeanalternativelocation,dura-tionortimethatisacceptabletotheapplicant.IftheDistrictdeniesanapplicationpursuanttosections2.05,2.14,2.21or2.31,ortheapplicantisdissatisfiedwithsuchPermitasissued,hemayappealthedecisiontotheBoardwithinten(10)calendardaysafterthedecisionisrendered.IftheBoardrejectstheappealafterfullreview,oriftimeforfullreviewisnotavailable,theapplicantmayappealthedecisiontotheappropriatestateorfederalcourt.AllotherdecisionsontheissuanceofPermitsbytheDistrictarefinal.

(h)AnyPermitgrantedbytheDistrictmaycontainlawfulprerequisitestotheissuingofthePermitandrestrictionsontheconductofthepermitteduseincludingwithoutlimitation:paymentofareasonablefee;generalliabilityinsurancecoverage;anagreementtofullyindemnifyandholdtheDistrictharmlessfromanyliabilityorcostsresultingfromtheuse;are-

quirementthatthePersonsinvolvedintheuseobserveallfederal,state,local,andDistrictlaws,ordinances,rules,andregulations;time,dura-tion,andlocationrestrictions;restorationdeposit;awrittenagreementbytheapplicanttofullyrestoreanyDistrictPropertysoiledordamagedbytheuse;and,anyreasonablerestrictionnecessaryfortheefficientandorderlycontemporaneousadministrationoftheuse,otheractivitieswithaPermit,andregularDistrictuses,functions,programs,andactivities.

(i) AnyPersonholdingavalidPermitissuedbytheDistrictforuseofDistrictPropertymayusethatDistrictPropertytotheexclusionofanyotherPersonexcepttheDistrict.

(j) Subjecttothetermsofsubsection(g)above,theDistrictmaymakenecessarychangesorplacenecessaryadditionalrestrictionsonanyPermitafterithasbeenissued.

(k)Violationoftheterms,restrictionsandconditionscontainedinthePermitmayresultinthesuspensionorrevocationofthePermit.

(l) Exceptasprovidedinsubsections5.01(l)(1)and(2),noPermitshallbeissuedforaperiodinexcessofseven(7)consecutivecalendardays.APermitmaybeextendedforlikeperiodsoftimepursuanttoanewap-plication,unlessanotherPersonhasrequesteduseofthesamelocationanduseofthatlocationbymorethanonepermitteeisnotreasonablypossible.

(1) ThissubsectionshallnotapplytoPermitsgrantedundersec-tion2.06ofthisOrdinance.ForPermitsgrantedundersection2.06,theDistrictshalldeterminethelengthoftimethataPermitwillbevalid.

(2) ThissubsectionshallnotapplytoPermitsgrantedundersection2.31ofthisOrdinancefornewsracksornewsstands.SuchPermitsshallbeissuedforaperiodofsix(6)months.

(m)ForusesinvolvingtheexerciseofFirstAmendmentrights,theDistrictmaywaiveanyapplicationorpermitfeesiftheapplicantdemon-stratesthatthecostofsuchfeesisprohibitive.Anapplicantmustrequestsuchawaiverinwriting.

(n)Forpurposesofthissection5.01,theterm“exerciseofFirstAmend-mentrights”shallinclude,withoutlimitation,parades,marches,dem-onstrations,rallies,religiousservices,speeches,solicitationofvotes,petitionsignaturesorcontributions,picketingandleafleting.

Section 5.02. Insurance and Hold Harmless Agreement.

(a)Exceptasprovidedinsubsection5.02(a)(1),everyapplicantforaPermitshallacquiregeneralliabilityinsurancetoprotecthimselfandtheDistrictfromliabilityresultingfromhisuseofDistrictPropertyandprovideproofofsuchinsurancetotheDistrictbeforetheDistrictwillissueaPermittoanotherwiseacceptableapplicant.TheDistrictmustbenamedonsuchpolicyasanadditionalinsured.Wherepossible,anapplicantmayacquirearidertotheDistrict’sinsurancepolicyattheapplicant’scostandexpense.ApplicantsshouldcontacttheDistrict’sadministrativeofficeformoreinformation.

(1) ForusesinvolvingtheexerciseofFirstAmendmentrights,includingwithoutlimitationparades,rallies,religiousservices,solicitationofvotes,petitionsignaturesorcontributions,picketingandleafleting,theDistrictmaywaivetherequirementofinsuranceiftheapplicantdemon-stratesthatheorhisorganizationcannotprocuregeneralliabilityinsur-anceorthatthecostofprocuringsuchinsuranceoracquiringaridertotheDistrict’sinsurancepolicyisprohibitive.Anapplicantmustrequestsuchawaiverinwriting.

(b) EveryapplicantmustexecuteanddelivertotheParkDistrictanagreementtoindemnifyandholdtheDistrictharmlessfromlegalliability,propertydamageorinjurytopersonscausedbythenegligentorunlaw-fulactsoftheapplicantoranymember,volunteer,employee,agent,participant,orotherPersonassociatedwiththeapplicantorhisgroupororganization.

Section 5.03. Restoration Deposit.(a)TheDistrictmayrequirepaymentofarestorationdepositasaprereq-uisitetotheissuanceofaPermit.TheDistrictshallrefundthedepositifthePersonresponsibleforthepermittedusecleansanyrefusecausedorleftbytheuseortheuse’sparticipantsandrestoresDistrictPropertytotheconditionitwasinpriortotheusetotheDistrict’ssatisfaction.IftheDistrictisrequiredtocleanuporrestoreDistrictPropertyafterthepermitteduse,thePersonresponsibleforthepermitteduseshallreim-bursetheDistrictforallcostsandexpensesassociatedwiththeclean-upandrestoration.Thecostoftheclean-upandrestorationshallbededuct-edfromtherestorationdeposit.Ifthereareanyfundsremainingafterthecleanupandrestorationcostshavebeenpaid,theyshallbereturnedtothepermittee.Ifthecostsandexpensesfortheclean-upandrestora-tionexceedtheamountoftherestorationdeposit,theDistrictreservestherighttobillthepermitteeandtopursueanyandalllegaloptions.

(b)ForusesinvolvingtheexerciseofFirstAmendmentrights,theDistrictmayacceptawrittenagreementtocleanupandrestoreDistrictPropertyafterthepermitteduseinlieuoftherestorationdepositiftheapplicant

candemonstratethatpaymentofarestorationdepositwouldcreateanunduefinancialhardship.Anapplicantmustrequestthisarrangementinwriting.Ifthepermitteedoesnotsatisfactorilyperformaccordingtotheagreement,theDistrictreservestherighttobillthepermitteeandpursueanyandalllegalremedies.

Section 5.04. Other Authority. ActivitiesotherwiseprohibitedunderthisOrdinance,oranyotherDistrictordinance,policy,rule,orregulationmaybeconductedorengagedinbyaPerson,hisagentsand/oremployees,ifdoneinstrictconformancewiththeprovisionsofanagreementwiththeDistrictthathasbeendulyauthorizedbytheBoard.

CHAPTERVI-ENFORCEMENT

Section 6.01. Police/Security Force.(a)TheDistrictPoliceForceistheVillageofVernonHillsPoliceDepart-ment.TheDistrictPoliceForceshallbetheconservatorsofthepeaceonDistrictProperty,andshallberesponsiblefortheenforcementofallfederal,state,local,andDistrictlaws,ordinances,rules,andregulationsonDistrictProperty.

(b)ThemembersoftheDistrictPoliceForceshallhavetheauthoritytoejectfromDistrictProperty,arrest,orissuecitationstoanyPersonwhoviolatesanyapplicablefederal,state,local,orDistrictlaw,ordinance,rule,orregulationonDistrictProperty.

Section 6.02. Rules to be Obeyed. NoPersonshallviolateordisobeyanyprovisionofthisOrdinanceoranyotherDistrictordinance,policy,ruleorregulationregulatingconductoractivitiesonDistrictPropertyeventhoughthesamemaynothavebeenposted.NoPersonshallviolateordisobeythedirectionsorinstructionscontainedinanynoticeorsignpostedbytheDistrictrelatingtotheuseofDistrictProperty,orthedirectionsorinstructionsofanymemberoftheDistrictPoliceForce,oranyemployeeoftheDistrictseekingtoenforcecompliancewithfederal,state,localorDistrictlaws,ordinances,rules,orregulations.

Section 6.03. Parties to Ordinance Violation.(a)EveryPersonwhocommits,attemptstocommit,conspirestocommit,oraidsorabetsinthecommissionofanyactinviolationofthisOrdi-nanceorotherordinance,ruleorregulationoftheDistrict,asaprincipal,agent,oraccessory,shallbeguiltyofsuchoffense,andeveryPersonwhofalsely,fraudulently,forciblyorwillfullyinduces,causes,coerces,

requires,permits,ordirectsanothertoviolateanyprovisionofthisOrdinanceislikewiseguiltyofsuchoffense.

(b)AnyPersonwhoistheowner,registeredowner,orPersonincontrolofanyanimal,Vehicleorotherpropertyofanykindbrought,placed,parkedorallowedtoremainonDistrictPropertyinviolationofthisOrdinanceorotherDistrictordinance,rule,orregulation,shallbedeemedprimafacieresponsibleforsuchviolationandshallbesubjecttothepenaltiesprovidedherein.

(c)ItisunlawfulfortheowneroranyotherPersonemployingorother-wisedirectingtheoperatorofanyVehicle,torequestorknowinglypermitoperationofanysuchVehicleonDistrictPropertyinanymannercontrarytothisOrdinance.

CHAPTERVII-PENALTIES

Section 7.01. Revocation of Privileges; Fine. AnyPersonviolatingordisobeyinganysectionorpartthereofofthisOrdinance,oranyotherordinance,ruleorregulationoftheDistrictmaybefinednotlessthan$25normorethan$1,000.00foreachoffense,maybeforthwithevictedfromDistrictProperty,ormayhavehisadmis-sionrightstoDistrictPropertysuspended,terminatedorrevoked.TheDistrictPoliceForcemayissueandserveupontheoffenderaNoticeofViolationforanyviolationofthisOrdinance.EachsuchNoticeofViola-tionshallspecifytheamountofthefinetobepaidfortheoffense,whichshallbe$50.00unlessthisOrdinanceprovidesforahigherfineforaspecificviolation.Fineswilldoubleifnotpaidwithinten(10)daysoftheissuanceoftheNoticeofViolation.Finesmayberecoveredbyanac-tioninthenameoftheVillageofVernonHillsintheCircuitCourtfortheNineteenthJudicialCircuit,LakeCounty,Illinois,ifnotvoluntarilypaidbythepersoncommittingtheoffensewithinten(20)daysoftheissuancebytheDistrictPoliceForceofaNoticeofViolation,specifyingtheamountofthefine(s).TheprocedureinsuchactionsshallbethesameasprovidedbylawforlikeactionsforviolationofordinancesincitiesorganizedunderthegenerallawsoftheStateofIllinois.PaymentoffinesshallbetotheVillageofVernonHills.

Section 7.02. Restitution. Inadditionto,orinsteadof,thefinesandpenaltiesprovidedforinSection7.01,anyPersonviolatingordisobeyinganysectionorpartofthisOrdinance,oranyotherfederal,state,local,orDistrictlaw,rule,orregulation,mayberequiredtomakerestitutionfordamageresultingfromsuchviolation(s).TheprovisionsoftheIllinoisParentalResponsibility

Law(740ILCS115/1etseq.)arespecificallyincorporatedinthisOrdi-nancebyreferenceforpurposesofthissection.

Section 7.03. Seizure/Removal/Impoundment of Property. Anyproperty,substanceorthingbroughtinto,utilized,placed,orleftonDistrictPropertyinviolationofthisOrdinance,oranyotherDistrictordinance,rule,orregulationmayberemoved,seized,anddestroyedinthecaseofpropertyandsubstancesreferredtoinSection2.01,AlcoholicLiquors,2.02,AnimalsandPets,2.07,ControlledSubstancesandCan-nabis,and2.34,Weapons,Firearms,Explosives,Rockets,orseizedandimpoundedinthecaseofanyotherproperty,substanceorthing(includ-ingwithoutlimitationVehiclesandbicycles).Propertysoimpoundedshallnotbereturnedtotheowner(s)thereofuntilsuchPerson(s)shallhaveprovidedtheDistrictPoliceForcewithacceptableprooforevidenceofownershipanduntilsuchPerson(s)shallhavereimbursedtheDistrictPoliceForceinfullforallcostsandexpensestotheDistrictofsuchim-poundmentincludingwithoutlimitationanyremovalandstoragecharges.Propertynotclaimedbytherightfulowner(s)thereofwithinsixty(60)daysaftersuchimpoundmentmaybesoldbytheDistrictPoliceForcewhichshallbeentitledtotheentireproceedsthereof,orotherwisedis-posedof,providedthatanymotorvehicletowedand/orimpoundedshallbedisposedofaccordingtotheapplicablelawsoftheStateofIllinois.

Section 7.04. Non-Exclusivity of Penalties. ThepenaltiesprovidedforinthisChapterVIIareinadditiontoandnotexclusiveofanyotherremediesavailabletotheDistrictasprovidedbyapplicablelaw.EachofthepenaltiesprovidedforinthisChapterisnotexclusiveofanyoftheotherpenaltiesprovidedinthisChapterandsuchpenaltiesmaybeimposedsinglyorinanycombinationpermittedbylaw.

CHAPTERVIII-REPEAL

DistrictOrdinances17,22,24,25,26,32,and146andallotherDistrictordinances,resolutions,policies,rulesandregulationsinconflictorinconsistentwithanyoftheprovisionsofthisOrdinanceareherebyrepealed.

CHAPTERIX-SEVERABILITY

ProvisionsofthisOrdinanceshallbedeemedtobeseverable.ShouldanysectionorpartofthisOrdinancebedeclaredinvalidbyacourtofcompetentjurisdiction,theremainingpartorpartsofsuchsectionand/ortheothersections,asthecasemaybe,ofthisOrdinanceshallneverthe-

lessbevalid,bindingandsubsisting.CHAPTERX-PUBLICATIONANDEFFECTIVEDATE

Section 10.01. Publication in Book Form. Inlieuofotherpublications,thisOrdinanceshallbepublishedinbookorpamphletform,andwhensopublished,shallbecomeeffectivewiththesameforceandeffectasifotherwisepublished.Suchbookorpam-phletshallbereceivedasconclusiveevidenceofthepassageandlegalpublicationofthisOrdinanceinallcourtsandotherplaceswithoutfurtherproofofthepassageandpublicationofthisOrdinance.
