    Donald H. Pfster is the Asa Gray Proessor o Systematic Botany in the

    Department o Organismic and Evolutionary Biology at Harvard. Pster teaches

    courses on plants and human afairs and the biology o ungi, and has served as

    the director o the Harvard University Herbaria or nearly 20 years, most recently

    as interim director. He has traveled several times to southern and central Chile

    to ocus on his true passion, the study o ungi, and conducted eld studies

    throughout the Americas and Asia. Along with colleagues rom the University o

    Florida and in Chile, he is studying ungi at the extreme end o the continent in

    the environmentally ragile region around Punta Arenas, Chile.

    Health Requirements: This is an active program, which requires you to make a realistic assessment o yourAll participants are expected to be in active good health, to enjoy traveling as part o a group, and to be reexperience cultural dierences with grace. Walking and climbing stairs are required in many hotels and ato board the aircrat, and as part o many excursions. Prior to traveling, Operator highly recommends visitin

Neither the Sponsor nor Operator, nor any o their respective odirectors, employees, contractors, ofcers or agents (collectively, the Released Parties) shall be held liableany damage to, or loss o, property or injury to, or death o, persons occasioned directly or indirectly by anomission o any other provider, including but not l imited to any deect in any aircrat, watercrat, or vehicle opor provided by such other provider, (B) any loss or damage due to delay, cancellation, or disruption in any mcaused by the laws, regulations, acts or ailures to act, demands, orders, or interpositions o any government

    subdivision or agent thereo, or by acts o God, strikes, re, ood, war, rebellion, terrorism, insurrection, squarantine, epidemics, thet, or any other cause(s) beyond their control, and (C) any and all claims, actions, oor bodily injury, property damage, wrongul death, loss o ser vices, lost prots, consequential, exemplary, indpunitive damages or otherwise which may arise out o or occur during your travel in connection with the Toparticipant waives any claim against any o the Released Parties or any such loss, damage, injury, or death, inany right to seek consequential, punitive or exemplary damages against any o the Released Parties or anywhatsoever. None of the Released Parties sh all be liable for any air carriers cancellation penalty incurred by the pof a nonrefundable ticket.

    Acknowledgment o Risk: You understand and acknowledge that your travel in connection with and particin the Tour or any activities which may take place during the Tour, may involve risk and potential exposure to inatal injury and that risk and dangers may arise or be caused by the negligence or participation o other particcontractors, and/or subcontractors or the Tour or rom other oreseeable and unoreseeable causes incweather and other acts o nature.

    Express Assumption o Risk & Responsibility: In recognition o the inherent risk o the travels and related acin which you are intending to engage, you conrm that you are physically and mentally capable o particin the Tour and that you willingly and voluntarily assume ull responsibility or any injury, loss or damage sby you or caused by you. By registering or the Tour, you certiy that you do not have any mental, physical, ocondition or disability that would create a hazard or yoursel or other participants. Operator reserves the rits sole discretion to accept, decline to accept, or remove any par ticipant on the Tour and reserves the right, to the terms and conditions contained herein, to withdraw any part or all o the Tour and to make such chanmay be necessary.

    Arbitration: Any controversy or claim arising out o or relating to this Agreement or the perormance thereincluding without limitation any claim related to bodily injury, property damage or death, shall be settled by barbitration in Seattle, Washington USA in accordance with the rules o the American Arbitration Associatioexisting, and judgment on the arbitration award may be entered in any court having jurisdiction over the matter o the controversy. Such proceedings will be governed by substantive Washington law. This agreemarbitrate does not waive or modiy the liability release contained in this document.

    Exclusive Governing Law & Jurisdiction: This Agreement shall be governed by the laws o the State o Washwithout regard to conicts o laws principles. I the right to seek arbitration is or any reason waived by both or i judicial review o any arbitration is sought, any action or legal proceeding arising out o this Agreemebe brought exclusively in the courts o the State o Washington, or, i it has or can acquire jurisdiction, in theStates District Court or the Western District o Washington or the appropriate appellate courts, and the hereby waive any objection to venue or jurisdiction in connection therewith. In connection with any action proceeding arising out o this Agreement, the parties hereby specically and knowingly waive any rights thaparty might have to demand a jury trial.
