Submission of Tender:-1. Only those contractors/firms who are registered in Uttarakhand Jal Sansthan are

allowed to take part in this tender. 2. The tender should be submitted on the basis of two bid system, subscribed

envelope 'A' "Technical Bid" and envelope 'B' "Commercial Bid" and envelope ‘C’ “Earnest Money”, all these three envelopes shall be put in a single envelope subscribed "Tender Notice No., Date of Opening and Name of Article.

3. The last date for the submission of the “Tender" 15.01.13, in the official Tender document (in original) issued by the Executive Engineer, Central Store, Dehradun or downloaded through website http://ujs.uk.gov.in shall be duly filled in and signed by a duly authorized person and to be submitted to the office of the Executive Engineer, Central Store, Uttarakhand Jal Sansthan, Dehradun. 4. The tenders without earnest money and concurrence to deposit security amount in the event of acceptance will not be entertained.

5. Earnest money in the following forms should invariably be put in a separate envelope along with separate envelopes of technical bid and commercial bid. All these three envelopes shall be put in a single envelope subscribed "Tender Notice No., Date of opening and Name of Article”. It should be valid for 06 months from the date of opening of the tender. A photocopy of EMD can be retained by the tenderer for claiming the refund of the EMD after the entire procedure is completed. EMD of Rs. 50,000.00 in the form of F.D.R/ C.D.R/ N.S.C/B.G., issued from any Nationalised/ Scheduled Bank/ Post Office in India, duly pledged in the name of Executive Engineer, Central Store, Uttarakhand Jal Sansthan, Dehradun shall be attached.

6. The tenderer shall ensure that the tender is positively received in the office of the Executive Engineer, Central Store before or on the date and upto the time of receipt or tenders as per schedule given in the tender notice. However, if any tender is received by post upto the scheduled date and time of opening of tender, the same shall also be considered. Uttarakhand Jal Sansthan will not be responsible for late receipt of tender in the office of Executive Engineer, Central Store on account of postal delay etc. and such tender(s) shall not be entertained. Document what-so-ever submitted after the schedule time of receipt of tender on the date of opening of the tender shall not be considered. All papers must invariably be submitted with the tender.

7. Tenderers must note it carefully that the such forms, Declaration Part-I, Declaration Part-II, Memorandums, Form of experience, Schedule 'G-1 & G-2', Annexure-‘1’, Annexure-‘2’, Annexure ‘3’ etc. attached with this tender document must invariably be filled up completely and duly signed by a person(s) authorized to do so. Other blank spaces, meant to be filled by tenderers, must also be filled up otherwise the offer will be treated incomplete and will be liable for rejection.

8. The tender document should be signed only by a person to whom the power is delegated by the competent authority and who is authorized in the name and on behalf of company/ firm to do so and become a party.

9. In case, the date of opening of tender is declared a public holiday, the tenders shall be opened on the next working day. If the last date for the sale of tenders is declared a public holiday, the tenders would be sold up to the next working day and the tenders would then be opened on the next working day thereto.

10. The tender document should be clear and without over-writing or corrections but in case if corrections are necessary they must be made by drawing a line over the wrong entry and writing the correct rate and the correction must be initialed by the tenderer. Rates shall be given clearly in figure as well as in words.

11. Stamp duty will be borne by the tenderer according to Govt. rules and regulations.

12. Trade tax as applicable will be paid and Income tax as applicable will be deducted according to Govt. rules and regulations by the department from the bill at the time of payment. Certificate of same shall be issued to the contractor; Form ‘16’ shall be issued by the department on written request of the contractor.

13. The envelope ‘A’ shall be first opened and if it is found in order as per terms and conditions of the tender document, then the envelope 'B' containing the bids shall be opened and rates announced otherwise the bid will be rejected.

14. The rates should be inclusive of all types of classification of soil and as such no claim in respect of classification shall be accepted.

15. The royalty charges of stones, sand, aggregate etc. used shall be deducted from the bills of contractor at the rates prescribed by Govt. from time to time on the basis of quantities of such materials required for finished work.

16. Material to be used for drilling and development of tubewell with accessories shall be conformed to relevant specifications.

17. The department will award the work on turnkey basis i.e. including drilling and development of tubewell with materials or separately without supply of material (i.e. only drilling work). No claim will be entertained on this account.

18. Material used for drilling and development of tubewell such as MSERW Casing Pipe will be tested by third party inspection agency DGS&D/RITES or any agency nominated by the department and all expenditure whatsoever will be charged by the third party inspection agency will be borne by the successful bidder in case of material supplied by the bidder.

19. Allotment or work order for drilling and development of tubewell including drilling/boring with material or without material will be issued to successful bidder from the office of Chief General Manager, Uttarakhand Jal Sansthan.

20. The contract bond and work will be executed by the Executive Engineer of concerned division as per guidelines of Procurement Rules 2008 after allotment of work order from office of the CGM.

21. Without confirmation of water testing report, the water of the tubewell shall not be permitted to use by the department. It will be the responsibility of the contractor and Engineer incharge both where work to be executed. The top of the bore’s casing pipe shall be sealed by the contractor with the welding of a M.S Plate (Cap) upto receiving of confirmation of water testing report.

22. The tenderer should familiarize with this scope of work & site conditions before quoting the rates and submitting the tender.

23. The work shall be started immediately or within 15 days after the award and completed within a time schedule given in the work order.

24. In case of dry bore(s), no payment shall be done for dry bore in any case. It will be the sole responsibility of Executive Engineer, division concerned and contractor both that there should not be any dry bore, in any case, so, it should be confirmed/ensured before starting the drilling of bore. In case of dry bore(s), the casing pipe shall be retrieved by the contractor at their own expenses, no payment will be made on this account by the department.

25. If the tube well remained un-successful due to faulty construction on the part of contractor, nothing shall be paid to the contractor for the drilling of the tube well.

26. Contractor will provide every thing at site which is necessary to execute the work like machinery, equipments, project manager, technical staff and labours and will arrange the necessary accommodation at their own cost. It will be the sole responsibility of the contractor to transport the machines and equipments at site at their own cost. Department will not be responsible for any loss due to accidents during the transportation or during the execution of the work.

27. In case there happens to be any accident at site like human loss, breaking of casing pipe, failing of tool or bit etc. in the bore, the department shall not compensate for any loss and the rectification shall be solely responsibility of the contractor.

28. Contractor shall also make arrangements of first aid facilities for any accidents. All care and precautions shall be taken and it should be ensured that there are no accidents while drilling the bore holes. Proper dress and equipment like gumboots, helmets and tentage etc. shall be provided by the contractor to the workman at site.

29. During any operation carried out for construction of tube well, if any tool, pipe etc. fall down in the tube well then the contractor shall carry out the necessary fishing operation at his own cost. The contractor shall use his equipment for such operation. If the tube well become useless due to any fallen particle it shall be treated as abandoned tube well and no payment shall be made for such abandoned tube well.

30. The whole work shall be guaranteed for 12 months from the date of completion of work against workmanship/bad materials. All defects shall be rectified by the contractors free of cost during guarantee period.

31. The water, electric light etc. for the purpose of work at site shall be arranged by the contractor at their own expenses.

32. The contractor shall furnish the name of firms/manufacturers from where the material for tubewell shall be arranged. The list of manufacturers of material required for drilling and development of tubewell may be fixed by the department and the contractor shall abide to arrange the material from such manufacturers according to list as fixed by the department.

33. All gold, silver, oil, other materials, any relics, antiques and other similar things which may be found in or upon the site shall be property of the Govt. and contractor shall deliver the same to the persons appointed by the Govt. from time to time.

34. The quantity of work can be increased or decreased by the department.

35. The work shall be executed strictly in accordance with the ISI specifications.

36. The work shall be executed as per programme laid down by the Executive Engineer division concerned.

37. Any damage caused to any public/private property during the course of execution of the work shall be restored in good condition by the contractor himself at his own cost.

38. All extracted materials available during the time of execution shall be stacked properly as desired by the Engineer in charge.

39. Tube well assembly shall be got approved and tested before lowering from the Executive Engineer division concerned.

40. Contractor shall ensure uninterrupted completion of the work.

41. The firm/contractor shall abide by the time schedule strictly and shall furnish fortnightly progress achieved by them to the Executive Engineer division concerned and Executive Engineer division concerned shall submit fortnightly progress to Secretary (Appraisal) on 24 columns report as per Annexure-‘1’.

42. The contractor shall be responsible for the departmental material issued to him for the use on the work and shall maintain proper account of the same which will be open for inspection by the department officers at any time.

43. The contractor shall obtain orders in writing from the Executive Engineer division concerned about the site where surplus excavated material will be disposed off.

44. The contractor must take all precautions to avoid accident by exhibiting day and night necessary caution boards, speed limit boards, red flags, red lights etc. He shall be responsible for all damages and accidents caused due to negligence on his part. No hindrance shall be caused to traffic during execution of work.

45. The contractor shall give complete postal & telegraphic address in tender and also leave the copy of the same in the office of Executive Engineer division concerned. All correspondence telegram’s etc. sent on mentioned address in the tender, duly accepted by postal authorities shall be deemed to have been served on the contractor from the date of its posting irrespective of the fact that the same may be returned to the postal authorities undelivered due to any reason. What so ever, change in address shall be promptly intimated to the office of Executive Engineer division concerned and as well as Executive Engineer, Central Store, Dehradun, and acknowledgement received to that effect, unless this is done, the old address shall remain effective.

46. Rates shall be quoted in prescribed tender documents that will be purchased from the department or downloaded from the website by the contractor/firm. If rate quoted in any other paper or a letter pad shall be in the format of Schedule 'G-1 & G-2' as per tender document.

47. Quoting of rates for all items is essential for qualifying the tender failing which it shall, be summarily rejected.

48. All the rates given in Schedule 'G-1 & G-2' for drilling and development of the tubewell includes the cost of carriage, handling, insurance and transportation charges of plants and material to the site of work and back, where required and nothing extra shall be paid to the contractor on this account.

49. The tenderer shall quote the rates of all items separately as mentioned in Schedule 'G-1 & G-2'. However the department shall have the ultimate authority to finalize the lowest rates separately quoted by each bidder, therefore the lowest bidder shall be calculated on the basis of each item rate and not on the basis of overall rate quoted by the bidder. Hence it may be possible that lowest individual bidder may not be treated as the lowest bidder.

50. Validity of quoted rates shall be for one year from the date of entering into the agreement, however it may be extended on mutual agreement of both.

51. The work shall be carried out by the contractor strictly in accordance with the specifications and ISI specifications as per IS-2800 (Part-I) 1991, IS-2800 (Part-II) 1979 with upto date amendments.

52. The work shall be carried out in a manner complying in respect with the requirement by laws of the local bodies in whose jurisdiction the work is situated.

53. The final payment shall be made to the contractor after handing over the tube well to the entire satisfaction of Executive Engineer division concerned.

54. (a) Before submitting the tender, the registered contractor/firm must ensure that he is having proper casing shoe to drill the size given in the tender and it will be verified by the department before finalizing the rates.

(b) Only those tenderers are allowed to participate in the tender who are having more than 02 drilling machine and more than 1100/300 psi compressor.

(c) Only those contractors/firms are eligible to quote the rates in Schedule 'G-1 & G-2' who are having experience for drilling of tubewells and installation of pumping plants in hill districts of Uttarakhand State. Un-experienced contractors/firms are not eligible to quote the rates for the schedule of work above. If, un-experienced contractor/firm will quote rates for above schedule of work, it will not be considered by the department in any case. Proof of experience (order copies) shall be attached with the technical bid.

55. All arrangements for the transportation of drilling equipment to the site of work and its operation i.e. katcha tracks, approach roads, water electric light etc. if so required shall be arranged by the contractor himself at his own cost.

55. If the tenderer fails to complete the work within stipulated time given in work order for reasons beyond his control or unforeseen reasons considered just by the department then extension of time can be allowed by the department. However if extension of time is not allowed by the department, penalty for delay of commissioning of work will be imposed @ 0.5% per week (of the total value of work) subjected to a maximum of 10% of the total value of work and also to get the balance work completed at the cost of tenderer.

56. The contractor shall clear the site properly after the completion within 15 days failing which penalty @ Rs. 500/- per day will be imposed for 1st fortnight and Rs. 1000/- for each subsequent day.

56. In case of artesian conditions, the inner aquifer ceiling and surface ceiling has to be done immediately and tube well shall have to be controlled for overflowing and not allowing the wastage and drainage of ground water.

57. The vertically of the tube well is to be checked jointly by Assistant Engineer and Junior Engineer in charge of work in presence of representative of the firm to ensure that the same is well with in the limits prescribed in the relevant IS code. The final result of verticality so tested will be part and parcel of the bill of the contractor against which payment is to be released. No payment shall be released till the verticality test is conducted at the site and result are found well with in permissible limit.

58. In case artesian condition arises during drilling of tube well and further drilling may not be possible or tube well is collapsed with one or another reason; nothing shall be paid to the contractor. In the event the contractor shall make all arrangements for plugging of tube well in order to avoid subsiding of tube well/formation of cavity inside the earth and subsequent damages shall be restored by the contractor at his own cost till its stabilization.

59. No payment whatsoever shall be made for the tube wells left incomplete by the contractor and for the tube wells which are not vertical and also for such tube well which are rejected by the department.

60. The tube well have to be handed over to the Engineer incharge concerned division giving complete detail as per format of the department.

61. Tenderer must have the similar type of drilling machines, tools & plants required for drilling operation. The list of machines, tools & plants, ownership certificates of such mentioned should be enclosed in technical bid otherwise technical bid will summarily be rejected.

62. Conditional/ Telegraphic/ Telephonic/ Fax/E-mail offer shall not be entertained.

65. SPECIFICATION OF MATERIALS

1. DESCRIPTION OF WORKS:- In the Uttarakhand State there are several habitations which have no source of drinking water or the discharge available of the sources is not sufficient to fulfill the minimum requirement of the habitations. To provide regular and adequate drinking water to the such habitations, this tender for Drilling and Development of 250 mm dia. Mini Tubewells/Tubewells in various districts of Uttarakhand State by ODEX/DTH Casing Pipe Method is invited.

For locating the proper site for tube well construction with in the selected habitation if resistivity survey is required then the resistivity survey shall be carried out by a well qualified and experienced hydrogeologist using his own suitable resistivity meter in the presence of the in charge division concerned.

2. CASING PIPE:- The MS ERW Casing Pipe conforming to IS: 4270/2001 shall be different dia./wall thickness mentioned in relevant work. The outer surface of casing pipe shall be painted with anti corrosive paint. However of assembly shall be lowered, please try to keep the bore vertical. The free end of the casing pipe shall be minimum 1.0 mtr. above the ground level.

3. HYDROGEOLOGICAL SURVEY/PIN POINT:- All geological investigation, successful drilling and development of tubewells will be the sole responsibility of the contractor. Hydrogeological survey is compulsory for each point. The hydrogeological survey shall be done by firm/agency registered in any state preferably Himachal Pradesh/Jammu & Kashmir etc.

4. TESTING OF WATER QUALITY:- The chemical and bacteriological testing will be done by the department or by the contractor from IIT Roorkee/PCRI, BHEL, Haridwar or departmental water testing laboratories.

It shall be the responsibility of the contractor to collect the water sample from completed tube well and send it to testing laboratory for chemical and bacteriological analysis. The water sample for chemical analysis shall be collected in two liter plastic bottle and sample for bacteriological analysis shall be collected in the 300 ml sterilized bottle as per the direction of Engineer in charge of concerned division and in presence of departmental chemist.

5. STRATA CHART:- Strata chart shall be recorded by the contractor during drilling and development of bore and it should be submitted to the engineer incharge of concerned division after completion of drilling work.

The rates for drilling works are inclusive of collection of samples of soil, rocks cutting not less than 100 grams from different strata to be collected at every 10 meter depth after 15 meter and at the change of strata and depositing same with the Engineer in charge duly marked and packed in the plastic container.

The rates are inclusive of the preparation and submission of strata chart of the tube well constructed in the prescribed performa as per Annexure ‘2’

6. INSPECITON OF MATERIAL:- All materials against work order supplied by

contractor will be as per specifications of relevant IS code shall be specified and all the material shall be tested by third party inspection agency nominated by the department in case of material supplied by the bidder.

7. DEPARTMENTAL INSPECTION:- The drilling & development of tubewell shall be duly tested for their performance at the site of work by the engineer incharge of concerned division or accredited representative of the department. A test report bearing signature of authorized representative of contractor and inspecting officer of department shall be attached with the bill of each consignment.

8. YIELD TESTING:- It shall be compulsory for the contractor to carry out the yield test of tube well using suitable submersible pumping set for a minimum time period of 9 hours or as per the direction of Engineer in charge. The work of construction of tube well shall not be treated as completed unless the proper yield test of tube well is conducted. The condition of 9 hours testing shall not be applicable for the tube wells, which do not have sufficient water to run the test for 9 hours.

The tube well shall be disinfected after completion of yield test using bleaching powder or sodium hypo chlorite solution as per the direction of Engineer in charge, at the cost of the contractor as per Annexure ‘3’

9. In the interpretation of description of items specification the decision of the C.G.M., Jal Sansthan shall be final.

10. The following Indian standard may be referred to:

(i) I.S. 2800 (Part-I):1991 code of practice for construction & testing of tube wells/Bore wells.

(ii) I.S. 2800 (Part-II):1979 code of practice for construction & testing of tube wells/Bore wells (Reaffirmed 1999).

(iii) I.S. 4270:2001 Steel tubes used for water wells.

11. Tube wells drilled should be perfectly vertical. The rates for drilling are inclusive of the verticality test required to be conducted.

12 The work shall be carried out by the contractor strictly in accordance with the attached contract specifications and ISI specifications as per IS-2800 (Part-I) 1991, IS-2800 (Part-II) 1979.

13. The final payment shall be made to the contractor after handing over the tube well to the entire satisfaction of Engineer in charge.

14. All welding work shall be done as per I.S. specification and electrodes used shall be I.S.I. marked must be inclusive in the relevant work rate in schedule 'G-1 & G-2'.

15. It shall be the responsibility of the contractor to get the necessary permanent electricity connection of applicable capacity as directed by the Engineer in charge from the electricity department in the name of the Executive Engineer and the amount for the same as per actual shall be paid by the department.

16. The yield test of tube wells shall be conducted by suitable capacity single phase or three phase submersible pumping set to be operated by generator set or by taking temporary electric connection at site. It shall be the responsibility of the contractor to arrange for suitable capacity submersible set, generator set, suitable measuring equipment for measuring the discharge and draw down of the tube well. The rates for item of yield test given in this unified schedule of rates includes for all such arrangements.

66. COMMERCIAL BID

1. The tenderer are requested to quote firm and fix rates in Indian Rupees for each article as mentioned in Schedule Schedule 'G-1 & G-2' of the tender document for drilling and development of 250 mm dia. 3. The rates will not be subject to any escalation at a later stage.

b. After the acceptance of the offer earnest money deposited in the form of FDR/CDR/NSC/BG will be refunded to the unsuccessful tenderers after completion

of the entire tender procedure. No interest will be payable by Jal Sansthan on the Earnest Money.

3. SECURITY CLAUSEThe contractor shall deposit a sum equivalent to ten percent of the ordered value in the form of FDR/CDR/ N.S.C/BG, would be kept deposited by the Executive Engineer, which would be released after 12 months from the date of completion of work. No interest will be payable by Jal Sansthan on the Security Deposit.

4. ENCASH OF A BANK GUARANTEEa. If the period of contract or work is for any reason extended, the contractor shall

have the Bank Guarantee extended upto the period of 12 months after the date upto which the contract or the work period is extended or he shall furnish a fresh Bank Guarantee for the same amount or as directed by Executive Engineer to cover a period of 12 months beyond the extended period and if the contractor fails to do so, it will amount to a breach of the contract thereby entitling the Executive Engineer to encash the Bank Guarantee.

b. The security money shall be released after 12 months from the date of satisfactory completion of all the work against the orders placed under this contract and after deductions of any liability against contractor.

5. MODE OF SUBMITTING TENDERa. The tender should be submitted on the basis of two bid system, subscribed

envelope 'A' "Technical Bid" and envelope 'B' "Commercial Bid" both the envelopes shall be put in a single cover subscribed "Tender Notice No. and Date, Name of Article and last date for the submission of the Tender" in the official Tender document (in original) issued by the Executive Engineer, Central Store, Dehradun or downloaded from website duly filled in and signed by a duly authorized person.

b. In the event of space being insufficient for the required purpose, additional pages of the size: 22.5cm x 28.5cm may be added. Each such additional page must be numbered consecutively, bearing tender number and date and should be duly signed by the authority that has signed the tender document. In such cases reference of the additional pages must be made in the tender document.

c. All other pages, certificates or documents required to be submitted with the tender should also be certified duly and attached firmly with tender document. It should be properly sealed. The envelope should be addressed to the Executive Engineer, Central Store, Uttarakhand Jal Sansthan, Dehradun.

d. The quantities, if any, in the tender notice shall be deemed to be only approximate and will not in any manner what-so-ever be binding on the department.

e. The tender must reach to the Executive Engineer, Central Store, Uttarakhand Jal Sansthan, Dehradun, not later than 15:00 hours on the date of the opening of the tender. Tenders sent by hand delivery should be dropped in the Tender Box before the above time. The Tender Box will be kept in the room of the Executive Engineer, Central Store or any place indicated by Executive Engineer, Central Store on the date of the opening of the tender.

f. No document/ Correspondence will be entertained after the closing time of the tender.

g. Tenders shall be opened at the scheduled time on the date of opening (Date and time mentioned in the tender notice) in the presence of such tenderers or their any authorized representatives who choose to be present. In case the opening of tenders is to be attended by any representative of a contractor firm, his name should be mentioned in the tender itself and the tenderer should also furnish to his representative a letter of authority bearing representative's attested signatures.

h. Rates should be written both in figure as well as in the words and there should be no cutting or overwriting. In case any difference in rates written in word and figures, the rates written in words will be taken as correct.

i. Rates offered should be valid for the full validity period of the contract.

6. SUBMISSION OF DOCUMENTSUntil & unless asked by the Executive Engineer, Central Store specifically, document whatsoever, submitted after the scheduled time of receipt of tenders on the date of opening of the tender shall not be considered. Please submit all papers with tender.

7. SIGNING OF TENDERa. The tender is liable to be ignored if complete information/certificates is not given

therein. Please note that conditions given in the tender documents shall govern the contract. It may please be noted carefully that till such time that a fresh agreement is drawn up embodying the agreed conditions, the conditions given in the tender document shall govern the contract. The tenderer should note this carefully.

b. The individual signing the tender and/or other documents connected with the contract must write his name in BLOCK LETTERS under his signatures.

c. The individual signing the tenders and/or other documents should specify whether:(i) He is the sole proprietor of the firm or constituted attorney of such sole

proprietor.(ii) A partner of the firm, if it is a partnership firm, in such case he must have

authority to refer to arbitration dispute concerning the business of the membership by virtue of partnership agreement or a Power of Attorney.

(iii) Constituted attorney of the firm, if it is a company under the meaning of Company Law, a certified photostat copy of the power of attorney should be attached.

(a) Managing Director/President/Chairman/Company Secretary in case of Limited Co. having authorization for committing the company from its Board of Directors or as is required under Co. Law and

(b) President or Secretary in case of registered co-operative society having such powers through Laws/Bylaws or by special resolution.

8. IMPORTANT NOTES(i) In case of partnership firms, where no authority to refer disputes concerning the business of the partnership to arbitration has been conferred on any partner, the tender and all documents attached there-to must be signed by each and every partner of the firm.(ii) A Person signing the tender document or any documents forming part of the contract on behalf of another shall be deemed to warranty that he has authority to bind each other and if on inquiry it appears that the person so signing has no authority to do so, the General Manager may, without prejudice to other civil and criminal remedies, cancel the contract and hold the signatory liable for all costs and damages.

(iii) In other cases, the resolution/ authorization/ attorney duly attested by NOTARY PUBLIC should be submitted with the tender if not already done.

9. VAGUE OFFERSOffers indicating a number of contractor firm shall not be considered and as such the tenderer must make SPECIFIC MENTION of the particulars of the work on whose behalf the tenderer has quoted the rates.

10. PERIOD FOR WHICH THE OFFER SHALL BE VALIDa. The tenders should remain open for acceptance for a period of 150 days from the

date of opening unless otherwise specified. Any tenderer is not allowed to offer the acceptance period less than 150 days. The validity period can be extended if the S.E and the contractor firm are both agreed mutually. In case, however, the day up to which, the offer is to remain opened, happens to be a public holiday/is declared a public holiday for Govt. offices, the offer shall remain open for acceptance till the next working day.

b. The offer/tender of the contractor firm shall be, for all purposes, deemed to have been accepted and contract made the moment the acceptance latter is signed by the General Manager or S.E.

11. EXPIRY OF VALIDITY OF DOCUMENTSWhen the validity of certain documents called for has expired and renewal has been applied for, but issuing authority has not issued the revalidated document/license, an affidavit on general stamp paper of Rs. 10.00 should accompany the tender. Please do not forget this as tender otherwise shall be liable to be ignored.

12. VALIDITYa. The contract shall ordinarily remain in force upto twelve calendar months from the

date of entering into contract but it can be terminated at any time and any stage by the S.E during the validity of the contract without assigning reason. No claim or damage on account of such termination of the contract shall be entertained.

b. The validity period can, however, be extended if the S.E and the contractor firm both agree mutually.

c. Orders received during the closing days shall be completed in due course in accordance with the conditions and terms of this contract even though, in some cases, work can not be arranged within the stipulated date of the currency of the contract.

13. PANAll tenderers must write their PAN in the tender document.

14. CANCELLATION OF TENDERa. Successful tenderers may be asked to deposit security by the date specified in the

acceptance letter. In case they fail to deposit the security by the specified date, the General Manager/S.E reserves the right to withdraw the acceptance letter without any prior notice to the party concerned and the earnest money will be forfeited.

b. The General Manager/S.E reserves the right to Quash/Reject all or any of the tenders, or to split up the contract without assigning any reason and in suppression of any of the conditions given herein or after.

15. WITHDRAWL OF TENDER If a tenderer withdraws his tender before the expiry of the validity period, the General Manager/S.E may agree to allow such withdrawal but in such a case the earnest money may be forfeited. If the General Manager/S.E does not allow such withdrawal and accepts the tender and the tenderer fails to perform his part of the contract, the earnest money deposited shall be forfeited besides other consequences for breach of the contract.

16. PENALTY OF DEFECTIVE MATERIALSa. The contractor shall liable to pay to the department @ 2% of the cost of the

materials using other than specified in the tender document and same shall be deducted from the bill of the contractor by the Executive Engineer at the Ist consecutive work.

b. The contractor shall liable to pay to the department @ 5% of the cost of the materials using other than specified in the tender document and same shall be deducted from the bill of the contractor by the Executive Engineer at the IInd consecutive work.

c. In case the materials using by the contractor other than specified in the tender document in the IIIrd consecutive work, the same be established after joint testing in the presence of engineer incharge of the work & authorised representative of the contractor, the contractor shall be taken to black list for next 3 years & his security money lying with the department shall be forfeited.

17. MATERIALSa. All materials shall be dispatched F.O.R. specified destination by the contractor duly

insured against all risks during the transit.

b. The contractor will also furnish the following undertaking in writing along with each consignment to the engineer incharge.“All materials using in the works have been as per relevant standard specifications and also in accordance with the terms and conditions of the contract. We also undertake to replace or rectify part or to take back the materials and remit cost thereof at the discretion of the engineer incharge. If the materials are found defective before guarantee period, the cost of the defective materials, along with all liabilities, expenditure will be payable by us on receipt of necessary intimation from the engineer incharge.”

c. In the event of any dispute between the contractor and engineer incharge, the matter would be referred to the SE(M) and the decision taken by him is to be followed.

d. In case of any dispute not settled, the matter would be referred to General Manager who will act as an arbitrator and his decision would be final and binding on contractor and as well as on the engineer incharge.

e. In case of non-compliance of order, contractor firm shall be taken to blacklist for next three years in addition to penalty imposed under clause 29 and earnest/security money laying with the department shall be forfeited.

18. DATE OF COMPLETION OF WORKThe date of final measurement recorded in measurement book shall be taken as the date of completion of work for a particular consignment.

19. RATES1. The rates shall be quoted for drilling and development of mini tubewell/tubewell

in Schedule 'G-1’ are F.O.R destination site in any part of hill districts (excluding Dehradun, Haridwar & Udham Singh Nagar), including transportation of rig machine, T&P, all labour charges, including all taxes. Income tax as applicable will be deducted.

2. The rates shall be quoted for the materials incorporated with the work in Schedule 'G-2’ are F.O.R destination site in any part of hill districts (excluding Dehradun, Haridwar & Udham Singh Nagar), including cost of materials, basic excise duty, insurance charges, packing & forwarding charges, freight including loading, unloading and octroi etc. but are exclusive of statutory duties such as sales/trade tax without Form ‘C’. The Form '16’ if necessary shall be furnished to the contractor by the engineer incharge on written demand of the contractor.

20. MODE OF TRANSPORTATIONThe materials shall be transported by road transport by the contractor at his own expenses and risk.

21. INSURANCEThe contractor will transport all materials and install at specified destination, at his own risk, in full and good condition. No claim will be entertained by the department on this account.

22. BANK CHARGESBank charges, whatsoever, shall have to be borne by the contractor and shall not be paid by Jal Sansthan in any case.

23. COMPLETION PERIODAfter receiving of order, the work should be completed within stipulated period.

24. FORCE MAJEUREThe contract shall be governed by the force majeure clause as specified below:If at any time during the acceptance of this contract the performance in whole or in part by either party of any obligations under this contract shall be prevented or delayed by reasons of any war, hostility, acts of the public enemy, civil commotion, sabotage, fires, floods, strikes, lockouts, explosions, epidemics, quarantine restriction or other acts of God, Government Ruler (here-in-after reference to as eventualities) then provided notice of the happening of any such within 15 days from the date of occurrence thereof, neither party shall by reason of such eventuality be entitled to terminate this contract nor shall either party have any claim for damages against the other in respect of such non-performance or delay in performance and work under this contract shall be resumed as soon as possible after such eventuality has come to an end or ceased to exist, and the decision of the SE as to whether the contract have to be resumed or not shall be final and conclusive.

25. ORDERSAfter the rates quoted by the contractor are accepted and the contract is executed, order/orders shall be placed under this contract by the concerning executive engineer of Jal Sansthan. The order will be placed with the tenderer who successfully qualify technically and commercially. It should be noted that department is under no obligation or binding to place an order on the firm quoting the lowest rate.

26. CANCELLATION OF ORDERThe engineer incharge shall have the right to cancel, modify, reduce or suspend the quantity ordered to any extent, at any time before the work is completely affected without assigning any reason. The contractor will not have objection to this and will also not be entitled the any claim compensation for any cancellation, modifications, reduction or suspension of any order in part or full at any time and at any stage on the ground that such work(s) were executed.

27. TRANSFER OF AGREEMENTThe contractor shall not transfer or assign this agreement to any other contractor without permission of the SE. In the event of the contractor’s transferring or assigning the order whole or part to anyone without permission, he shall be considered as having thereby committed a breach of agreement in question and shall make the order liable to be cancelled and the earnest money and security money shall be liable to be forfeited.

28. PAYMENT(a) 100% payment will be made after the successful completion of work at specific destination as per relevant specifications and after satisfaction of engineer incharge.

(b) In case of dry bores, the casing pipe shall be retrieved by the contractor firm. Nothing shall be payable on this account, no claim shall be considered on this account in any case by the department.

29. LIQUIDATED DAMAGES ETC.a. In the event of work not completed in accordance with the order and as per terms

and conditions of the agreement within stipulated period after issuing of dispatch instructions (D.I.) by Executive Engineer and completed the work within 15 days beyond this stipulated period, but if the work not having been completed within this extended period of 15 days, Executive Engineer shall recover from the contractor the amount of liquidated damages from any money due to the contractor the sum held as earnest/security money or dues pending in the department. This recovery shall be @ 0.25% per day upto maximum 10% of the value of work remaining to be executed at the end of due date for completion of work upto a maximum of 25 days during which the work is not completely affected.

b. Further on the expiry of 25 days after the due date for completion of work it shall also the lawful for the S.E/Executive Engineer to get the work executed from other agency at the risk and cost of the contractor, who, in addition to the aforesaid liquidated damage shall be liable to pay loss or damage caused by the said execution of work.

c. The General Manager may allow additional time for completion of work on consideration of circumstances beyond the control of the contractor to the extent considered justifiable and may decide to forego the whole or part of the aforesaid liquidated damage.

d. In case of non-performance in any form or shape of the terms and conditions of the contract, the General Manager shall have the power to annul, rescind or cancel this contract and upto his notice in writing that he has done so given by registered letter, the contract shall absolutely determine on the date of issue of such notice.

e. In case stipulated period crosses the validity of contract bond any extension in working period may be allowed by General Manager.

f. General Manager may forego the whole or part of the liquidated damage on the circumstances beyond the control of the contractor due to which the work could not be completed.

30. PARALLEL CONTRACTThe General Manager's right to place parallel contract(s) at a later date is reserved. Parallel contract(s) for the work with other firms will be arranged as and which needed. It will be the discretion of General Manager to place work order with such holders of contract as will be considered more convenient and suitable to meet the requirements during the currency of the contract.

31. ARBITRATION CLAUSEa. In case of any dispute between the contractor and the engineer incharge the matter

shall be referred to the SE for his decision and in case, where the contractor is not satisfied with the decision of the SE, the matter shall be referred to the General Manager/Finance Director. Every dispute, difference or question which may at any time arises between the parties hereto or any person claiming under them, touching or arising out of or in respect of this deed or the subject matter thereof shall be referred to the arbitration of General Manager/Finance Director or any person nominated by him. In the event of the arbitrator to whom the matter is originally referred being transferred or vacation his office or being unable to act for any reason, he shall either enter upon the reference himself or appoint another person to act as arbitrator. Such person shall be entitled to proceed with the reference from the state it was left by his predecessor.

b. In all cases where the amount of the claim in dispute is Rs. 50,000.00 (Rs. Fifty thousand only) and above, the arbitrator shall give reasons for the award. The party invoking the arbitration shall specify dispute to be referred to arbitration together with this amount or amounts claimed in respect of each such dispute, subject to the provisions of the Arbitration Act 1940 or any rules made there under and for the time being in force shall apply to the arbitration proceeding.

c. The arbitrator may from time to time with the consent of the parties enlarge the time for marking and publishing the award. The decision taken by the arbitrator will be final and binding on both the parties in question and matters relating to this contract.

32. APPLICABLE LAW The parties to this agreement agree to Dehradun Courts alone shall the jurisdiction over all matters including arbitration matters arising out of this agreement.

Drilling Time Log It is recommended that as the drilling progress an accurate drilling time log to be kept indicating the time taken to drill every two meters depth or where there is change of strata. This log will enable interpretation regarding the nature of the formations (hard, soft, unconsolidated, etc.) which has a bearing on the water yielding capacity of the formation. DEVELOPMENT OF TUBE WELLThe well shall be developed by compressor until sand free clear discharge (water) is obtained from the tube well.

DISINFECTIONThe well shall be disinfected after completion of test for yield. All the exterior part of the pump coming in contact with the water shall be thoroughly cleaned and dusted with powdered chlorine compound. Infact it should be disinfected every time a new pump is installed for the one replaced after repair. A stock solution of chlorine may be prepared by dissolving fresh chlorinated lime. For obtaining an applied standard concentration of 50 ppm, 01 liter of the stock solution should be used to treat 300 liter of water.

HANDING OVER THE TUBE WELLThe tube well should be handed over to the concerning Executive Engineer in the complete shape. The housing pipe should be closed by a well cap for the period between the completion of tube well and the installation of pump sets. The following information should be furnished by the drilling agency on completion of the tube well.

(a) Strata chart of the tube well indicating the different type of soil met with at different depth;

(b) Samples of strata collected, neatly packed and correctly marked in sample bags;(c) Chart of actual pipes assembly lowered indicating the size of pipe, depth ranges,

where slotted/strainer pipes have been used;(d) Hours of development done by compressed air, pump sets or by other means; and(e) Pumping water level at the development discharge.

3. The guarantee is in addition to and not in substitution for any other guarantee executed by the bank in favour of the Jal Sansthan on behalf of the suppliers.

4. The suppliers and the Jal Sansthan will be at liberty to vary and modify the terms and conditions of the tender document/contract without effecting this guarantee, notice of which modifications to the bank hereby waived.

5. This guarantee shall not be affected by any change in the constitution of the bank or of the suppliers nor shall the guarantee be affected by any amalgamation or absorption with any other body corporated and this guarantee will be available to or enforceable by such body corporate.

6. The neglect or forbearance of the Jal Sansthan in enforcing any payments of money, the payment thereof is intended to be hereby secured or the giving of time by the Jal Sansthan for the payment thereof shall in no way release the bank from its liability under this deed.

7. This guarantee is irrevocable except with the written consent of the Jal Sansthan.8. This guarantee shall come into force from the date hereof and shall remain valid till
