Use of Escort Waiting Areas Provided by the State Of Maryland a) All Hauling Permit customers that park on Escort Waiting Areas provided by

the State do so at their own risk. The State assumes no liability for any damages incurred by the Hauling Permit customer, vehicle operators, Hauling Permit vehicles or their escorts.

b) Indemnification and Release Clause – In consideration of the use of State

provided Escort Waiting Areas the Hauling Permit customer hereby knowingly and voluntarily, for themselves, their heirs, administrators, and assigns, release, remise, and discharge the State of Maryland, its employees, agents, contractors and instrumentalities from any and all claims, demands, actions, and causes of action of any sort, for injuries sustained and/or property damaged during their presence on the Escort Waiting Area due to negligence or any other fault.

The Hauling Permit customer further knowingly and voluntarily agrees to defend, indemnify, protect and save harmless the State, its employees, agents, contractors and instrumentalities from any and all present and future losses, expenses, suits, costs, and claims of every kind and description and from any and all liability for damages to which any or all of them may be subjected by reason of injury to persons and damage to property of any person, firm, partnership, corporation, or entity whomsoever or whatsoever, which injury or damage arises out of, or in connection with, any act or failure to act by the Hauling Permit customer, with or without negligence on the Hauling Permit customer’s part, while the Hauling Permit customer is on an Escort Waiting Area property, to the extent permitted by State law, and to defend at their own expense any suits at law or in equity arising therefrom.

c) Hauling Permit customers shall not use an Escort Waiting Area during heavy snow and ice storms.

d) Hauling Permit customers and their escorts may not park or remain at an

Escort Waiting Area for more than twenty-four (24) contiguous hours.

e) The Hauling Permit customers and their private escorts shall maintain the Escort Waiting Area property in a neat, clean and safe condition.

f) The Hauling Permit customer shall maintain comprehensive third-party legal

liability insurance and other such insurance as is required under the law and appropriate for its use of an Escort Waiting Area provided by the State.
