Responsibility of Manufacturers, Importers, Exhibitors, Sellers and Advertisers
• Of any electrical equipment prescribed under Regulation 97(1), Electricity Regulations 1994 must ensure their obligations are fulfilled.
Offences and Penalty Regulation 122, Electricity Regulations 1994, a person
who contravenes or fails to comply shall be guilty and shall be liable to a fine < RM5,000 or prison < 1 year or both.
Section 37(1), Electricity Supply Act 1990, any person cause danger to human life or injury shall be liable to a fine < RM100,000 or prison < 5 year or both.

Online application of (COA) via e-Permit System effectively on 1st Oct 2010 which operated by DagangNet. Applicant complete submission of test reports
& certificate. The t/reports & certificate are from local/foreign laboratories which are recognized by EC/DSM
Once COA issued from EC, applicant needs to enter the SIRIM Product Certification Scheme/ SIRIM Batch Testing Scheme (every consignment Test at SIRIM is subject to inspection and testing

ELECTRICITY (AMENDMENT) REGULATIONS 2012
• The purpose amendment is to align with ASEAN Agreement documents with regards to EE sector;
i. ASEAN Sectoral Mutual Recognition Arrangement for Electrical & Electronic Equipment (ASEAN EE MRA) signed in 2002.
ii. Agreement on the ASEAN Harmonized Electrical and Electronic Equipment Regulatory Regime (AHEEERR) signed in 2005.
The elements of amendments include;
(1) To recognize a foreign CABs within ASEAN and Non-ASEAN. (2) To register a CABs within Malaysia for the purpose of certifying
that any equipment under Regulation 97. (3) Manufactures or imports of EEE shall, prior to the commencement
of business apply to be registered with the Commission (4) Importer of equipment shall submit to the Commission: (a) a test report of the equipment conformity with standards
recognized by the Commission; or (b) a Certificate of Conformity (CoC) issued by a CAB recognized by
the Commission.
the Commission may inspect, test or review any equipment, documentation, test report and conformity assessment submitted to it.
(5) Manufacturers and importers shall keep all technical files of the equipment issued with a test report / CoC for not less than 10 years after the last equipment has left the production line.
(6) A testing laboratory in Malaysia accredited by the accreditation authority shall keep all technical files of any equipment issued with a test report for not less than 6 years after the expiry of that test report.
(7) The Commission may, from time to time, carry out market surveillance to determine if any equipment referred to in Regulation 97 is safe and has the label as specified in these Regulations being affixed to it.
ELECTRICITY (Amendment) REGULATIONS 2012
Issues & Challenges
• Despite all measures taken to control the importation and manufacturing of EEE, there are still lots of sub-standard equipment in the market.
• Our meeting with Jab. Kastam recently reveals that out of thousand CoAs sent to Custom Dept, only 10% are being used to import EEE products.
Way Forward
• Market Surveillance on EEE is an ongoing activities by ST Enforcement department. Most hypermarket and retailers has been reminded not to accept electrical appliances without SIRIM-ST label. Warning letters have been issued to the importers/manufacturers/suppliers/retailers to remove from displaying.
• ST will work together with agencies and associations to ensure EEE products in the market are in accordance with all requirements and safe to be used.
• Towards paperless – no hardcopy of CoA will be issued. Applicant may print the CoA at their end.
• To enhance e-Permit process, online payment for CoA application will soon be implemented by last quarterly year 2012.
• ST will publish a new edition of ‘Information Booklet on Approval of Electrical Equipment’ for December 2012.

The EE Sector is one of the 11 priority sectors identified for integration in ASEAN under the ASEAN Priority Integration Sector initiative.
In 2009 electronics sector has a total trade value of $330 billion. Electronics machinery, equipment and parts, sound equipment and television equipment accounted for 21.5% of the region total trade.
With 11.8% share of world production in 2008, ASEAN is the 5th largest producer of electronic equipment.
