WHEREAS, Tennessee Code Annotated §10-7-408 permits counties to enactan archivesandrecord management fee to fund county archives, and
WHEREAS,the Sullivan CountyDepartmentof Archivesand Tourism is in needof funding forrecords space, andpersonnelfor managing,scanning,andaccessingits archivalrecords,and
WHEREAS,the Sullivan County Public RecordsCommissionunanimously recommendsthecreation of an archives and record managementfee for SullivanCounty.
NOW THEREFOREBE IT RESOLVED By The Board Of County Commissioners OfSullivan, Tennessee That:
SECTION 1. In accordancewith TennesseeCode Armotated §10-7-408,which authorizescounties to establish an archivesand record managementfee, the county legislative herebycreatesan archivesandrecordmanagementfee in accordancewith thefollowing schedule:
A) Courtsof GeneralSessions,Circuit, Criminal, Probate,and Chancery:A fee of $5.00 for all public recordsfiled with the clerks of court for the purposeof initiating alegal proceeding.

10-7-408. Appropriation of funds Filing fees.
(a) The county legislative body of any county which creates a county records commission has the
power to appropriate such funds as may be required for the carrying out of the purposes of this
chapter including, but not limited to, the purchase or leasing of equipment, the equipping of an office
and the payment of the expenses thereof, the furnishing of secretaries and clerical help and the
employment of expert advice and assistance.
(b) In any county, if the county legislative body creates a county records commission, then the
county legislative body is authorized to:
(1) Appropriate such funds as may be required for carrying out of the purposes of this chapter,
including, but not limited to, the purchase or leasing of equipment, the equipping of an office and the
payment of the expenses of the office, the furnishing of secretaries and clerical help, and the
employment of expert advice and assistance; and
(2) Establish and collect, through all entities creating public records, as defined in ~ 10-7-403, an
archives and record management fee not to exceed five dollars ($5.00) per document filed. Funds
collected through this fee must be designated exclusively for duplicating, storing, and maintaining any
records required by law to be permanently kept.

RESOLUTION Requesting The Sullivan County Board Of County Commissioners’ Approval Of$270,000For The Execution Of A Contract To Complete A Facilities Condition And AdequacyAssessmentsAnd Long-range Facilities Master Planning Study For Sullivan County Department OfEducation
WHEREAS,the Sullivan CountyBoardof Education and the County Commissiondesires to completeaFacility Condition Assessmentand Facility MasterPlanningProcess in order to develop a long-rangefacility plan for Sullivan CountyDepartmentofEducation; and
WHEREAS,thepurposeof thestudywill extendbeyonda facilities conditionsstudy that wascompletedin 2008(PEFA study)at the requestoftheCountyCommission;and
WHEREAS, the Facilities Master Planning process includes comprehensiveplans for communityinvolvementthroughasteeringcommitteeand communitymeetings;and
WHEREAS, the Kingsport City Schools and Kingsport Board of Mayor and Alderman are alsoconductinga similar assessment;and
WHEREAS,the estimatedcost of the Facilities Condition and AdequacyAssessmentsand Long-rangeFacilities MasterPlanningStudy will not exceed$270,000and will be sharedequally ($135,000eachpart)betweentheCountyCommissionandtheSullivan CountyDepartmentof Education.
NOW THEREFORE BE IT RESOLVED, that the Sullivan County Board of CountyCommissioners, assembled in Regular Session, hereby authorize amendmentsto the appropriationsin the amount of $270,000 to execute an agreement to conduct the Facilities Condition andAdequacy Assessmentsand Long-range Facilities Master Planning Study, with $135,000 of thefunding coming from the General PurposeSchool Fund’s Restricted for Education Fund Balanceand $135,000coming from the General Fund’s UnassignedFund Balance (Appropriation accountcodes to be assigned by the Director of Accounts and Budgets and the SchoolBusinessManager).

WHEREAS,aFACT (Free Accessto ComputerTraining) granthasbecomeavailablethrough the TennesseeStateLibrary andArchives in an amount up to $2,500for a technologytrainer;and
WHEREAS,the SullivanCountyLibraryhasanticipatedandplannedfor thisproject;and
WHEREAS,thegrantdoesnot requirematchingfunds.
NOW THEREFOREBE IT RESOLVED that the Board of County Commissionersof Sullivan County,Tennessee,assembledin Regular Sessionhereby approvesacceptingand appropriating funds in an amountup to $2,500.00from the Department of State,TennesseeStateLibrary and Archives.

The DEPARTMENT OF TRANSPORTATION ofthe Stateof Tennessee,

3. To transfer or causeto be transferred to the DEPARTMENT without costto it,
all land owned by the COUNTY or by any of its instrumentalities asrequired for right of
way or easement purposes,provided suchland is being usedor dedicatedfor road or othet~
public way purposes;and -
4. Where privately, publicly or cooperatively owned utility lines, facilities and
systemsfor producing, transmitting or distributing communications,power,electricity,
light, heat,gas,oil, crude products,water, steam,waste,sto~water not connectedwith
highwaydrainage,andothersimilarcommodities,includingpublicly ownedfacilities such~
asfire andpolicesignalsystemsandstreetlighting systemsarelocatedwithin theright of
wayof any roador otherpublicwayownedby theCOUNTY, or anyof its
instrumentalities,theCOUNTY agreesthat it will takeactionnecessaryto requirethe
removalor adjustmentof anyof theabovedescribcdfacilities aswould conflictwith the
constructionoftheproject. But theforegoingmaynot bea duty of theCOUNTY sinceit
shall becomeoperative only after the DEPARTMENT has beenunsuccessfulin its efforts
to provide for said removals or adjustmentsfor thebenefitof theCOUNTY.
The foregoingdoesnot apply to thoseutility facilities which are owned by the
COUNTY or oneof its instrumentalities,it beingunderstoodthattheCOUNTY hasthe
duty to relocate or adjust such facilities, if required, provided the COUNTYis notified to
do so by the DEPARTMENTwith detailed advice as to this duty of the COUNTY; and
5. To maintain any frontage road to be constructedas part of the project; and
6. That after the project is completedandopento traffic, to acceptfor jurisdiction
and maintenancesuch parts of any existing DEPARTMENT highway to be replacedby the
project, as shownon the attachedmap; and

7. ThattheCOUNTYwill make no changes or alter any segment of a road on its -
roadsystemthat lieswithin thelimits of the right of way acquiredfor any interchangeto
be constructedaspart of the project and will not permit the installationor relocation of
anyutility facifities within theright ofwayof any such a segment of one of its roads
without first obtainingthe approval of the DEPARTMENT; and
8. That no provision hereof shall be construed aschangingthemaintenance
responsibilityoftheCOUNTY for suchpartof theprojectasmaypresentlybeon its
highway, street, road or bridge system; and -
9. That it is understood and agreed between the DEPARTMENTand the COUN
that all traffic controlsignsfor thecontrol of traffic on a streetunderthejurisdictionoft e
COUNTY and locatedwithin theDEPARTMENT’S right ofway shall be maintained and
replaced by the COUNTY;and
10. That when traffic control devicesfor the direction or warning of traffic, lightin
of roadways or signing, or any of them, which are operated or function by the use of
electric current are constructed or installed as part of the project, they will be furnished
with electricity and maintained by the COUNTY. -
11. If, as a result of acquisition and use of right of way for the project, any structure1
that become in violation of a COUNTYsetback/building line requirement, the COUNTY
agrees to waive enforcementof the COUNTY setback/buildingline requirement and take
other proper governmental action therefor.
The acceptance of this proposal shall be evidenced by the passage of a resolution,
by other proper governmental action, which shall incorporate this proposal verbatim, or y
reference thereto. Thereafter, the DEPARTMENTwill acquire the right of way and

easements,constructtheprojectanddefendany inversecondemnationor damagecivil
actions of which the Attorney General has received the notice and pleadings provided for
herein.
The project plans hercinbefore identified by number and description are
incorporated herein by reference and shallbeconsidereda partof this proposal,includin~

BE IT FUTHER RESOLVED,that if any section,subsection,sentence,clauseor phraseof theResidential Code of Sullivan County adopted herewith is, for any reason, held to beunconstitutional,suchholding shall not affect the validity of the remainingportions of thisResolutionand theResidentialCodeof Sullivan Countyadoptedherewith.TheSullivanCountyCommissionhereby declaresthat it would have passedthis Resolution, and each section,subsections,clauseof the ResidentialCodeof Sullivan County,irrespectiveof the fact that anyone or more sections,subsections,sentences,clausesand phrasesbe declaredunconstitutional;and
BE IT FURTHER RESOLVED,that nothingin this Resolutionor in the ResidentialCode ofSullivan County herewithadoptedshall be construedto limit or impair any suit or proceedingpendingin any court as of August 30, 2014, or any right, remedy or cause of action legallyacquired or legally existing or liability legally incurredas of August 30, 2014 under rules,regulationsor Resolutionherebyreplacedby this Resolution;and
BE IT FURTHERRESOLVEDthat each and all of the regulations,provisions, penalties,conditionsandtermsof said ResidentialCodeof SullivanCounty,andtherevisions,changesandamendmentsthereto, shall be on file in the office of the Building Commissioner/BuildingOfficial/CodeOfficial; and
BE IT FURTHER RESOLVEDthe ResidentialCode of Sullivan County, the revisionsandchangesdefined herewith,and the rules, regulations,provisions, requirements,and all mattersestablishedand adoptedasa part thereofshall takeeffect and be in full force on September1,2014andfrom that day forward.

RESOLUTION To Authorize A Continuing Budget For The Fiscal Year Beginning July 1, 2014;The Issuance Of Tax Anticipation Notes; And The Expenditure Of Funds By Various CountyOffices And Departments
WHEREAS, in the eventtheFiscal Year 2014-2015Budgetof Sullivan County is not approvedby July1, 2014, and it is thereforenecessaryto provide temporaryapprovalof operationsfor Sullivan County;and
WHEREAS, in the event Tax Anticipation Notes are issued, the following guidelineswill apply: Thenotes will be pre-approvedby the State Director of Local Finance; Said noteswill not exceedsixtypercent (60%) of the appropriations of each individual fund; The proceeds of said notes will be used topay authorizedexpensesof the County until taxes and other revenuesfor the fiscal year2014-2015arecollected; The notes evidencing the loans authorized under this resolution shall be issued under theauthorityof T.C.A. §9-21-202,et seq; andsaidnoteswill matureand be paid in ful] with renewal on orbeforeJune30, 2015.
NOW THEREFORE BE IT RESOLVED that the Board of County Commissionersof SullivanCounty,Tennessee,assembledin RegularSessionherebyapprovesthe continuanceof the amountsset forth in the 2013-2014 appropriations and that the various offices and departments areauthorized to expendfunds at the samelevel as theprevious year.
BE IT RESOLVED that the County Mayor is authorized to borrow money on Tax AnticipationNotes.
BE IT FURTHER RESOLVEDthat no local fundscan be expendedor obligatedthat exceedtheprevious year’s budget appropriation until a new budget is adopted and that expendituresmandatedby the State or rules and regulationsadoptedby the State are incorporatedinto thisContinuing Budget.
