WHEREAS.StevenP. Perryandwife SaraS. Perryhave agreedto the closureand abandonmentof thisportion of county road by Sullivan County and havewaived any andall claims for damagesthat mighttherebyexist becauseof suchclosureand abandonment,asevidencedby the attachedAgreementandWaiver/Release; and
WHEREAS, the Sullivan County Highway Commissionerand the Sullivan County Regional PlanningCommissionhaveapprovedtheabandonmentand closureasa countyroad of this portionof countyroadby Sullivan County.

NOW, THEREFORE BE IT RESOLVED that the Board of County Commissionersof SullivanCounty, Tennessee,assembledin Regular Session,hereby approvesthe abandonmentand closureasa county road by Sullivan County of that portion of county road as described aboveand setforth inthe attached survey with attached description prepared by James S. Montgomery, approves theremoval of said portion of county road from the Sullivan County Road Atlas, and approves theelimination of county maintenanceof said portion of county road from this day hence,
This resolution shall take effect from and after its passage. All resolutions in conflict herewith shall be and
the same are hereby rescinded insofar as such conflict exists.

RESOLUTION TO CONTINUE FUNDING FOR NEW FIRE TRUCKS AND NEW RESCUETRUCKS FOR THE AGENCIES ESTABLISHED IN SULLIVAN COUNTY WITHIN THELISTED 12 YEAR PERIOD
WHEREAS,the Sullivan CountyBoardof Commissionersapprovedin 1996-1997aplan to assistin thePurchaseof newPumperFire Trucks for the countyandcity fire departmentsandnewRescueTrucksforthecounty rescuesquadson arotatingbasisamongthem; and
WHEREAS,it is thecurrentintent of theplanto ensurereplacementofthe Fire TrucksandRescueTruckson aregularscheduledreplacementprogramaslistedbelow; and
WHEREAS,to ensurethattheintentoftheprogramis to assurequality vehiclesfortheselisted departmentsthrough thenext24 yearsis appropriatedto reestablishthepolicy; and
WHEREAS,all thedepartmentswill be responsiblefor providingthll-coverageinsuranceon theunit whilein their possession; and
WHEREAS,all thedepartmentswill agreethe truckpurchasedunderthis program,shallshowSullivan Co.Gov’t as first lien holderwith thePurchasingOffice holdingthetitle until nearthe endoftheperiodwhensaidvehiclewill be eligible to be releasedfor saleor tradefor its replacement;

WHEREAS,themostrecentemployeecompensationstudywasperformedin 2006andis no longerrelevantto current situations;and
WHEREAS,the staffing of Sullivan County departments(numberof employees) has evolved over timewithout considerationof a more formal means of analyzingmissionrequirementsand determiningtheappropriatenumberof employees;and
WHEREAS,employeecompensationcostscompriseapproximatelyeighty percent(80%) of the AnnualSullivanCountyBudget,andthemostsolemnand importantduty oftheSullivan CountyCommissionis todevelopabudgetandan appropriatetax rateto supportsaidbudget.
NOW THEREFORE BE IT RESOLVED that the County Commissionherebyauthorizes theCountyMayor, with anyassistancefrom thePurchasingAgentand Sullivan County staff that he may require,to 1) identify appropriate businesses,professionals,etc., capable of performing a formal study ofSullivan County employeestaffing and compensation,2) ascertaincost,time requirements, and otherpertinent information relevant to performing said study, and 3) report back to the CountyCommission within ninety (90) days of the passage of this Resolution with findings andrecommendationspertaining to this study and the selectionof a specificfirm to performthestudy.
This Resolution shall take effect from and after its passage. All resolutions in conflict herewith shall beandthe same are hereby rescinded insofar as such conflict exists.

WHEREAS, the Sullivan County Commission in an action on December 12, 2016 (Resolution Number 2016-11-71)authorized the issuanceofGeneral Obligation School Bonds for the purpose of newschool construction;and
WHEREAS,it has been determined that a sewer pump station will be required for the construction of theSullivan East Middle School; and
WHEREAS,the Sullivan County Department of Education has solicited bids through the County PurchasingAgent for construction of said sewer pump station, and
WHEREAS, bids receivedthroughthe solicitation processhave exceededthe Departmentof Education’sfunding receivedfrom thebondproceeds,and
WHEREAS,the Sullivan CountyDepartmentof Educationhasdeterminedthat sufficient fundsare availablein the GeneralPurposeSchool Fund’s ReserveAccount Assignedfor Capital Projectsto provide for thecompletionoftheproject.

WHEREAS,SullivanCountyMayorandBoardofCommissionersestablishedtheHistoricOverlayZoningregulationsandtheBlountville Historic Overlaydistricts in 2004with afive-memberminimumboard;and
WHEREAS, Sullivan County Mayor and Board of Commissioners amended the Zoning Map to includethe Piney Flats Village Historic Overlay District in 2009 without adding representation from such district;and
WHEREAS,in order increaseparticipation,public educationand betterrepresentationfrom all historicoverlay districts it would be beneficial to increase the board membership by two members; and
WHEREAS,Sullivan County has been designated by the National Park Service, Department of InteriorandtheTennesseeHistorical Commissionsince2012asaCertifiedLocal Government(CLG) communityin good standing which provides additional training and assistance to all Historic Zoning Commissionmembersand staff.

WHEREAS, we recognize that a Director of Schools, whether approvedby electionor chosenbyappointment, becomesChief ExecutiveOfficer of a schooldistrict; and,
WHEREAS,we support Tennessee counties being allowed a local option to re-establish the elected office
of Directorof Schoolsor continueBoardofEducationappointment;and,
WHEREAS,this provision allowing voters to choose to elect or appoint a Director of Schools is to be
determined through a local election in November 2020; and,
WHEREAS, we ascertain that Directors of School canmovetheeducationdynamiccloserto the interestsandgoalsof acommunitywhentheelectoratemakesthechoiceto electorappoint;and,
WHEREAS,we view this choice as a distinct way to embellish long-term planning through the process of
allowing Tennesseecountiesthechoice to elector allow Board of Educationappointmentof a directorasdetermined by popular vote; and,
NOW THEREFORE BE IT RESOLVED by the Board ofCounty Commissionersof Sullivan County,Tennessee,assembledin Regular Sessionhereby requeststhat a state law be passedto allow eachTennesseecounty electorate,as it sochooses,the option to elect or appoint a Director of Schools.

WHEREAS,Sullivan County will receive grant funds in an amount of $2359.00availablethroughtheTennessee State Library and Archives for the purchase of technology supportfor all library locations;and
WHEREAS,said grantcontractwill be effectiveon October1, 2018 andextendfor a periodof 6 monthsaftertheeffectivedate. SaidgrantendingApril 30, 2019;and
WHEREAS,saidgranteewill agreeto participatein thegrantprojectandprovideaportionof funding fortheproject; however,thegrantee’sparticipationwill not impactthe maximumamountreimbursableto thegranteeandsaidamountis intendedasa goal for thetotal project.

RESOLUTION To Authorize the Sullivan County Purchasing Agent to execute ContractAmendment # 3 and # 4 with SecurusTechnologiesInc, an inmate communications company, fortheir Video Relay Serviceand Inmate Debit Account Program, respectively.
WHEREAS,SecurusTechnologies,Inc., in accordancewith FederalCommunicationsCommission(FCC)47 CFR Part 64, currently providesthe inmate telephonesystemfor the Sullivan County CorrectionalFacility at no costto thecountyand generates revenue for Sullivan County at an average of approximately
$12,000-$15,000 per month; and
WHEREAS,Contract Amendment # 1 with Securus Technologies Inc. was approved extending the term of
our Agreementfor an additionalfive (5) years,expiringOctober18, 2019;and
WHEREAS,Contract Amendment # 2 with Securus Technologies Inc. was approved to provide Video
Visitation allowing face-to-face visits between inmates and visitors and provided the Law LibraryApplication allowing inmates legal research capability; and
WHEREAS,ContractAmendment# 3 with SecurusTechnologiesInc. will provideinmatesaVideo RelayServiceallowing deafand hard-of-hearinginmatestheability to communicate with friends and family via
avideoconferencingservice;and
WHEREAS, ContractAmendment# 4 with SecurusTechnologiesInc. will establishan inmateownedprepaidDebit Accountallowing inmatesto pay for certainservicesprovided by Securus, beginning witheducationalclasses/materialsand otheravailablePremiumcontententertainment(songs,games,movies,etc.)on Tabletsprovidedby Securus;and
WHEREAS,approvalof ContractAmendment# 3 and # 4 shall extendthe Term of the Agreementanadditional 24 months, expiring on October 18, 2021.

RESOLUTION to establishan agreementand to work in cooperationwith Sullivan County Boardof Commissioners,Sullivan County Board of Education, and the City of Bristol, TN to developathree-phaseproject (henceforth known asWeaverPike Project) to install sewerlines, including anynecessarypumpstations,along WeaverPike (extending from Sullivan East Middle School —
including Sullivan East High School - to Old JoneshoroRoad). This three-phaseinstallation, whichwill comply with A Policyfor SanitarySewerLineExtensionsin Sullivan County,will replace threeunfinished projects from the City CountySewerAgreement,i.e., PapervilleKnob,BeaverCreek
Road, EvansCreek Phase2, which will require a changeof project resolution from the governingbodiesparty to the original city countyseweragreement.
WHEREAS,WeaverPike Projectwill extendfrom SullivanEastMiddle Schoolto Old JonesboroRoadin threephaseswill allow for economicdevelopmentin thatportionof SullivanCounty;and
WHEREAS,the Weaver Pike Project is situated along theborderof theurbangrowthboundaryandwill
requirecooperationbetweenSullivanCountyBoard ofCommissioners(i.e. Sullivan County), theCity ofBristol, TN, andtheSullivan CountyBoard of Education;and
WHEREAS, it hasbeendeterminedthat thenewSullivanEastMiddle Schoolwill haveto dischargeitssewageinto amunicipalwastewatertreatmentfacility insteadofbeingtreatedon-siteasoriginallyplanned;and
WHEREAS, installationof anewsewerline, including any necessarypumpstation, to theclosestmunicipal sewertrunk line will be necessaryto servicethe newSullivan EastMiddle School;and
WHEREAS,theon-sitewastewatertreatmentfacility at Sullivan EastHigh Schoolis now approachingfifty (50) yearsold andit would be beneficialto Sullivan EastHigh Schoolto install a sewagelineconnectingto thenewline to be installedat Sullivan EastMiddle School;and
WHEREAS,the installationofthesewerlinesalong WeaverPike canbe separatedinto threephases,which would allow for theprojectsto be completedasfinancesallow; and

WHEREAS, the Sullivan County Departmentof Educationhassolicitedbids throughthe County PurchasingAgentfor constructionof saidsewerpumpstation,and
WHEREAS,sincea contractualrelationshipexitswith Mattern& Craigwho initially providedanestimateinvolving afour-inch(4’) sewerline buta largersewerline is mostlikely necessaryandcostefficientgiveneconomicdevelopmentpotentials;and
WHEREAS,it is necessaryto determinetheadditionalcostsofa largersewerlines;
NOW THEREFOREBE IT RESOLVED thatthe Board of County Commissionersof SullivanCounty,Tennessee,assembledin RegularSessionherebyauthorizesagreementsandarrangementsto
be madewith the City of Bristol, TN and the Sullivan County Board of Education to begin theWeaverPike Project in compliancewith theA Policyfor SanitarySewerLineExtensionsin SullivanCounty,which may include contracting with Mattern & Craig to adviseand prepare plansand costestimatesfor anynecessarypumpstations aswell asplans and costsrelated to the installation ofsewerlines of sufficient sizefor all three phasesof theWeaver Pike Project.

WHEREAS,ResolutionNo. 2016-12-76approvedby the Sullivan County Board of CommissionersonJanuary 17, 2017, authorized the Purchasing Agent and County Mayor to solicit a “Request forQualifications”to retainprofessionalservicesto assessthestructuralandengineeringintegrityofthecurrentjail andassess the needs of the jail facility for either expansion and/or new construction; and
WHEREAS,the Purchasing Agent has received“Requestsfor Qualifications”from multiple companiesandhasinterviewedandevaluatedthesecompanies;and,
WHEREAS,theMichael Brady, Inc., Architecture& Engineering,hasbeenchosenasthefirm to providesuchprofessionalassessmentsen’icesto Sullivan County;
NOW, THEREFORE BE IT RESOLVED that the Board of County Commissionersof SullivanCounty, Tennessee,assembledin Regular Sessionhereby approvesSullivan County Mayor, RichardS. Venable,and Purchasing Agent, Kristinia Davis, to enter into a contract with Michael Brady, Inc.(MBI) to perform such professional servicesto assessthe needto improve and/or expand thecurrentjail and to make recommendationsfor construction,expansionand/or renovation asnecessarybasedupon their assessment.

RESOLUTION TO AUTHORIZE THE COUNTY MAYOR AND PURCHASING AGENT TODEVELOPA “REQUEST FORQUALIFICATIONS” TO RETAIN A PROJECTMANAGER TO
OVERSEETHE SULLIVAN COUNTYJAIL PROJECT
WHEREAS,themain structureof the Sullivan County Jail facility wasconstructedin 1986 with an 150bedexpansionbeing addedin 1999andanotherjail extension(separatebuilding)addedin 2005dueto theeverincreasinginmatepopulations;and
WHEREAS, according to experts within the detention system, jail capacity reaches its limit atapproximately90%of its bedspace;however,theSullivan CountyJail overthe last five yearshasaveragedadaily populationat 125%of its total bedspacecapacity;and,
WHEREAS,Sullivan County has selected the firm of Michael Brady Inc. to assesstheneedsof thecurrentjail for eitherrenovation,expansionor newconstruction;and,
WHEREAS,Sullivan Countyis thereforein needof aProjectManagerto manageandadministertheProjecton behalfofSullivanCountyin accordancewith architecturalstandardsandTennesseeCorrectionsInstituteguidelines;to coordinatesiteevaluationsandenvironmentalassessments;to proposeaprojectbudgetuponreviewof recommendations;to walk thesite andperformconstructionobservationon a regularbasis;andto providevariousotherservicesasneededthroughouttheproject’scompletion.
NOW, THEREFORE BE IT RESOLVED that the Board of County Commissionersof SullivanCounty, Tennessee,assembled in Regular Session hereby authorizes the County Mayor andPurchasing Agent to develop a “Request for Qualifications” to retain professional servicesfor theretention of a Project Manager to overseethe Sullivan County Jail Project and to contract with saidProject Managerbasedon their qualifications and experience.

cream food trucks,• Staff visited the site and found that the home has been abandoned or vacated and the yard is somewhat overgrown.• The property is surrounded by other existing single-family dweflings.• The lot also has frontage on the rear along Fedderson Street, within the Wray Blevens Subdivision.• Staff is concerned that any parking of food trucks on this property would become a nuisance to the neighbors,
especially being surrounded by an established subdivision.• While Bloomingdale Pike has seen a trend for redevelopment of residential lots to small businesses, Bloomindale
Road has remained mostly the same zoning. Each site should be considered individually with regards to proximity ofdwellings and public utilities.
• There is no public sewer on Bloomindale Road past Ashbury Street.• Staff recommends against this request for the following reasons:
o Lack of public sewer to support a B-3/General Business District zoning and potential future uses;o Surrounded by established residential dwellings;o Double frontage within subdivision roads;o Location of septic cannot be paved over or driven over;o Existing B-3 zones in the area predate zoning:o Other existing businesses predate zoning;o B-i zone changed to B-3 in 2017 down the road for an office building only; ando Land Use Plan 2006-2026 designates this land to remain low-density residential
Meeting Notes at Planning Commission:• Mr. Billings, landowner/app//cant1 was present to address the commission.• Staff provided a backgroundreport.• The proposed tenant and business owner, Mr. Car/os Hernandez, was present. He stated that he lived in Bristol but
had an existing ice cream and food truck business that he operated out of Kingsport. Discussion ensued.• A neighbor, Mr. EdLeeper was present. He stated that he lived directly across from this rezoning request and was
concerned about all of the trucks tying to pull out onto the road. He did not want to live across from the commercialproperty if It could be helped. Discussion continued.

• The chairman asked Mr. Hernandez if he serviced his trucks on site or where does he take his trucks ~obe serviced.• Mr. Hemandez stated that he had two reputable garages that he normally takes his trucks to for service and repair;
however he wouldpro bably need to do some minor repair on site.• Staff confirmed all of the potential land uses that would be permitted in a 9-3 zone such as auto repair.• After careful consideration, a motion was made by Linda Brittenham and seconded by Don Mumpower to forward a
negative recommendation onto the County Commission based upon the spot zoning request The motion to denypassed unanimously. The chairman thanked the applicants and reminded them of the publichearing set for Thursday,February 213r at 6PM.

o Proximity to existing seasonal commercial campgrounds and marina would make it challenging to develop-thissite into a single family subdivision.
o A subdivision across the cove has yet to be fully built out with many vacant lots;o The site is irregularly shaped and not ideal for crop production;o The home has been vacant for many years and is in disrepair;o The site fronts on Hwy 44 and direct lake access within the cove of South Hoiston;o If approved, the plan shall be reviewed by TDEC, TVA and the Planning Commission for utility, buffering; -
access, density layout and planning regulations.
Meeting Notes at Planning Commission:• Mr. Jimmy Stewart and Travis Richards, partners/owners were present. They presented pictures of Wolf Lair RV Park
in Washington County, Virginia to show examples of their plans for this request. Discussion followed.• Staff presented her background report.• Commissioner Randy Morrell was present to address the commission. /ie stated that he had discussed this request
with surrounding landowners and requestS the applicant consider only requesting a rezoning for the lake side of theparcel and leave the highwayside off of Hwy 44 as agricultural Discussion ensued.
• After considerable discussion and study ofmaterials, a motion was made by Mary Ann Hager and seconded by MaryRouse to forward a favorable recommendation onto the County Commission for the rezoning request as presented.The motion carried unanimously.

cream food trucks.• Staff visited the site and found that the home has been abandoned or vacated and the yard is somewhat overgrown.• The property is surrounded by other existing single-family dwellings.• The lot also has frontage on the rear along Fedderson Street, within the Wray Blevens Subdivision.• Staff is concerned that any parking of food trucks on this property would become a nuisance to the neighbors,
especially being surrounded by an established subdivision.• While Bloomingdale Pike has seen a trend for redevelopment of residential lots to small businesses, Bloomindale
Road has remained mostly the same zoning. Each site should be considered individually with regards to proximity ofdwellings and public utilities.
• There is no public sewer on Bloomindale Road past Ashbury Street.• Staff recommends against this request for the following reasons:
o Lack of public sewer to support a 3-3/General Business District zoning and potential future uses;o Surrounded by established residential dwellings;o Double frontage within subdiv~sionroads;o Location of septic cannot be paved over or driven over;

had an existing ice cream and food truck business that he operated out ofKingspod. Discussion ensued.• A neighbor, Mr. Ed Leeper was present. He stated that he lived directly across from this rezoning request and was
concerned about al/ of the trucks trying to pull out onto the road. He did not want to live across from the commercialproporty if it could be helped. Discussion continued. -
• The chairman asked Mr. Hernandez if he serviced his trucks on site or where does he take his trucks to be serviced.• Mr. l-lernandez stated that he had two reputable garages that he normally takes his trucks to for service and repair;
however he would probably need to do some minor repair on site.• Staff confirmed all of the potential land uses that would be permitted in a 8-3 zone such as auto repair• After careful consideration, a motion was made by Linda Briltenham and seconded by Don Mumpower to for#ard a
negative recommendation onto the County Commission based upon the spot zoning request The motion to denypassed unanimously. The chairman thanked the applicants and reminded them of the public hearing set for Thursday,February 21st at 6PM.

• This area is known as the Painter Creek Community on South Holston Lake and near the Marina.• Staff recommends in favor of this request for the following reasons:
o Proximity to existing seasonal commercial campgrounds and marina would make it challenging to cevelop thissite into a single family subdivision.
o A subdivision across the cove has yet to be fully built out with many vacant lots;o The site is irregularly shaped and not ideal for crop production;o The home has been vacant for many years and is in disrepair;o The site fronts on Hwy 44 and direct lake access within the cove of South Holston;o If approved, the plan shall be reviewed by TOEC, TVA and the Planning Commission for utility, buffering,
access, density, layout and planning regulations.

with surrounding landowners and requested the applicant consider only requesting a rezoning for the lake side of theparcel and leave the highway side off of Hwy44 as agricultural. Discussion ensued,
• After considerable discussion and study of materials, a motion was made by Mary Ann Hager and seconded by Ma!)’Rouse to forward a favorable recommendation onto the County Commission for the rezoning request as presented.The motion carried unanimously.

The following use, private landingstrips for fixed-wingsingle engine aircraft,is subject to review and approval by theBoard of Zoning Appeals for a special exception in the A-I or AR Zoning Districts, subject to the minimum -
requirements listed herein: -
A. A site plan of the proposed landing strip shall be presented at the time of the proposal.
B. The landing strip shall be appropriate for the size and type of aircraft involved, and shall be constructed according tothe manufacturer’s specifications for the type of aircraft involved.
C. Airstrip runways are to be located no closer than one thousand (1000) feet from the centerline of the runway to theclosest dwelling unit, excluding the owner of the property, and that said centerline be located no less than twothousand (2000) feet from any church, school or places of public assembly.
D. All landing strips shall be situated in such a manner that under no circumstances shall an approach or departure beover a residence, excluding the owners, provided that the residence be located a minimum of400 (four hundred) feetbeyond the end or side of the required landing strip length.
