In case, NET Exemption is granted in view of special circumstances, the candidates be compulsorily required to clear the NET within a period of two years from the date of issue of communication of exemption by UGC. 4. exemption. The appointments are made before the clearance is received from the UGC. Thisleads to several litigations.

To avoid this, all the State Governments/Universities/Colleges are advised not to appointsuch candidates till the clearance is received from UGC. The proposals may be sent to theUGC immediately after the selection of the candidates by the Selection Committee in theprescribed proforma alongwith sound justification (through the University in the case ofaffiliated colleges) for relaxation/exemption as per UGC norms in a particular subject inwhich NET/SLET is not being conducted or sufficient number of candidates are not availablewith NET/SLET qualifications for a specified period only.

The appointment letter shall be issued only after receiving the relaxation from the UGC.

Guidelines for implementation of the Merit PromotionScheme for College Teachers

Dear Vice - Chancellor,

The role of the teacher is crucial in the maintenance of academic standards and discipline inan educational institution. A great responsibility therefore, lies on the teacher to ensure thatproper academic atmosphere is maintained in the institution and that all academic work iscarried out efficiently and with devotion to duty as on full-time employees of the institution.Every profession, for its orderly progress, needs certain rules of professional ethics, andeducation is no exception. In order to do justice to this challenging task, the teacher has to bedevotedly involved in programmes of teaching, research, examination and extension:activities taken as a whole. There should be regular assessment of his work and also of theinstitution. At the same time, it is necessary that teachers are provided reasonableopportunities for career advancement, and recognition of merit.

a). Objective

A scheme of Merit Promotion is to be introduced during the 6th Plan Period, with a viewto providing suitable opportunities to the teachers working in the Colleges for careeradvancement in recognition of their significant contributions in the field of teaching,research and allied educational activities. The scheme is intended to be in the nature of aflexible complementing scheme where a teacher after critical assessment of his work atthe end of a specified period can be promoted to the next higher level and the positionthus held by him is treated as personal to the incumbent and no resultant vacancy isrequired to be filled. It is falt that such a scheme would go in a long way in encouragingthe teachers in colleges to engage in teaching, research and allied educational activitiesand make a distinct contribution to the teacher profession and thus help to improve thequality and standards of higher education.

b). Method of Implementation

I. Teachers working in colleges affiliated to a university and included under section 2(f)and which come within the purview of Section 12(A) of the UGC Act who have made

significant contribution and achievement in the field of the teaching and research may beconsidered for Merit Promotion, if they have put in a minimum of eight years ofpermanent service as a teacher of which at least four years have been in the institutionwhere he / she is being considered for such assessment for merit promotion.

II. A teacher who has been considered and not selected for merit promotion in the initialpresentation could, however, submit his / her work again only after a lapse of threeyears.

III. College teachers wishing to have their work assessed and considered for MeritPromotion should present the details of their work to their college latest by 31stDecember, each year. For this purpose, the institutions may keep the profile of teacherswith them in which the teachers may at the end of each year indicate the details of theircontributions of teaching, research, curriculum development, educational reforms,innovative teaching and other forms of academic work done in the institution as well asthe work done in the field of extension and continuing education, sports and culturalactivities etc. Improvement of academic qualifications should also be recorded. Theenclosed proforma (Annexure) could be used for this purpose and these profiles may besubmitted by the college to the university concerned, along with the proposal of theteacher who are seeking assessment of their work, a consolidated report for the period ofpreceding eight years may be made available, incorporating the major contributionsmade by the teacher.

IV. The Vice-Chancellor or his nominee should refer the proposal of the teacher to at least 2experts in the subject / discipline concerned out of a panel of names prepared by theUniversity according to the procedure prescribed by the University for such SelectionCommittees.

The evaluation reports from the experts should be kept confidential and should be madeavailable at least three weeks in advance of the Selection Committee. The SelectionCommittee would consist of the Vice-Chancellor or his nominee, two experts other thanthe referees and the Principal of the College where the lecturer is working.

Merit Promotion be given by the appointing Authority to a teacher only if the SelectionCommittee recommends the same.

V. While considering the proposal of a teacher for Merit Promotion, only merit as definedin Para III may be taken into account. All other factors being equal, seniority may begiven due consideration.

VI. The University should generally take a decision on the proposal of a teacher for MeritPromotion as far as possible before the beginning of the next academic year so that suchpromotions can become effective from the date of the beginning of the next academicsession.

VII. The promotion given to a person would be personal to the incumbent concerned for theperiod he serves the institution where he has been granted promotion.

VIII.The promotion on merit to a teacher under this scheme will not entitle him to any otherresponsibility, administrative or otherwise such as Head of Department / Principal,except where he is even other wise to be considered and will also not lead to any other

reduction in this teaching or other work.

IX. While promotion a teacher on merit, his salary may be fixed in the prescribed scale ofpay for the next higher post with marginal adjustment nearest to the salary being drawnby the promotee, as per usual rules of pay fixation. Since most teachers in the collegeswould be in the scale of lecturer i.e. 700-1600, the teacher, on selection for MeritPromotion may be placed in the scale of Rs.1200-50-1300-60-1900 and be designatedlecturer in Merit Promotion Selection Grade.

X. The financial involvement will vary from State to State but the Commission would assistthe Institution in the implementation of the Merit Promotion Scheme by makingavailable on average contribution at the rate of Rs. 600/- per annum per teacherpromoted to the next higher level in accordance with the guidelines laid down by theCommission up to 31st March, 1985 only, on the condition that the institution concernedcontinues implementation of the scheme and meets expenditure on the salary of theperson concerned as committed expenditure from 1st April, 1985 out of its ownresources or with the assistance of grant-in-aid from the State Government as the casemay be.

XI. No. person promoted by the college prior to the introduction of the UGC Scheme andnot in conformity with the guidelines laid down by, the commission will qualify forassistance from the Commission.

XII. The University would furnish to the UGC, every year latest by 15th August, necessaryparticulars of the persons promoted in the colleges under its jurisdiction, under the MeritPromotion Scheme for college teachers alone with the evaluation report of the expertsand the recommendations of the Selection Committees and also the names of all thepersons considered from each colleges, to enable the Commission to consider remittinggrants due to the concerned colleges.

General

The number of teachers promoted under Merit Promotion Scheme will not exceed 33% of thetotal number of permanent posts in the College, spread over a period of 3 years.

1. Kindly refer to my d.o letter of even number dated November 23, 1982 regardingthe Merit Promotion Scheme for University appointed teachers in the Universities.

2. The Commission had also under Consideration the implementation of a similarscheme for college appointed teachers and a copy of guidelines for theimplementation of Merit Promotion Scheme for these teachers as accepted isenclosed.

3. The Commission would make a contribution of Rs. 600/- per annum for eachperson promoted under the above scheme, in accordance with these guidelines forthe remaining period f the Sixth Plan only after which the expenditure involvedunder the scheme would be taken over as committed expenditure out of thecollege own resources or with the assistance of grant-in-aid from the StateGovernment as the case may be.

4. Any scheme which the University may already have for merit / personalpromotion for college teachers and persons already promoted under which ascheme prior to the present scheme of the UGC becoming effective will notqualify for UGC assistance.

5. The University would supply to the UGC necessary particulars, each year, of thepersons considered under the scheme, the referees evaluations andrecommendations along with minutes of the Selection Committees and personsfinally promoted.

6. I shall be grateful if the University kindly give an assurance after consulting StateGovernment concerned to the effect that the recurring additional liability forimplementation of the scheme would be met by the college, concerned or with theassistance form the State Government concerned with effect from 1-4-1985. Thescheme should be introduced by the University only after obtaining the aboveassurance from the State Government.

Subject:- Leave Rules Prescribed by the UGC for Teachers of the Universities / Colleges

Dear Sir,

The Commission vide its Notification dated 24 December, 1998 on revision of pay scales,minimum qualifications for the appointment of teachers in universities and colleges, andother measures for the maintenance of standards has laid down service conditions (includingleave rules) for teachers. It may please be noted that while issuing this notification, it wasexpected that entire scheme of revision of pay scales, together with all the conditions attachedto it, would be implemented as a composite scheme without any modifications.

It has now been brought to the notice of the UGC that some of the universities have not giveneffect to the Leave Rules prescribed by the UGC as an integral part of the revised pay scales.For implementation of the Leave Rules, it is necessary for the Universities to suitably amendthe relevant statutes / ordinances / rules / regulations as may be required. A copy of the LeaveRules is enclosed for your kind reference.

May I request you to kindly confirm if your university has implemented the prescribed leaverules. In case, your university is yet to implement the revised leave rules, you may pleaseinitiate action for its implementation forthwith. You may also advise the colleges affiliated toyour university to follow the prescribed leave rules. I would appreciate if you could send mea status on the same. If you require any clarifications from us on this issue, please feel free todo so.

Dear Sir/Madam,

In continuation to the UGC Notification dated 24.12.1998 and Regulation No.F.3-1/2000(PS) dated 4.4.200 regarding revision of pay scale and minimum qualification of teachers, Iwould like to inform you that the minimum requirement of 55% marks at Master's level shallnot be insisted upon for Principals, Professors, Readers, Registrars, Deputy Registrars,Librarians, Deputy Librarian, Directors of Physical Education, Deputy Director of PhysicalEducation for the existing incumbents who are already in the university system. Theminimum requirement in their case shall be at least 50% of marks at Master's level. However,55% of marks at Master's level should be insisted upon for those entering the system fromoutside and those at the entry point of Lecturers, Assistant Registrars, Assistant Librarians,Assistant Director of Physical Education.

Dear Sir/Madam,

This has reference to UGC's earlier correspondence / letters regarding appointment ofsubstitute teacher under Faculty Development Programme (Teachers Fellowship) during IXthPlan Period.

In this connection, I am to say that the substitute teacher against the vacancy of teacherfellow, may be made from the candidates, who fulfil the qualifications prescribed by theUGC as per UGC Regulations - 2000. The college should first appoint the qualifiedteachers only, as per the guidelines of the Faculty Development Programme (TeacherFellowship), and the teacher fellow should be allowed to join the research place thereafter. Incase the qualified substitute teachers are not available within a period of one year, teacherfellowship should be withdrawn.

The above decision will be applicable on teacher fellow(s) to whom the approval / awardletter(s) are yet to be issued. The teacher fellowship may not be withdrawn for those teachersfellows who have already joined the research place.

You are requested to comply with the above decision and also circulate the above decision toall the colleges under jurisdiction for immediate compliance.

Subject:- Leave Rules Prescribed by the UGC for Teachers of the Universities / Colleges

Dear Sir,

The Commission vide its Notification dated 24 December, 1998 on revision of pay scales, minimumqualifications for the appointment of teachers in universities and colleges, and other measures for themaintenance of standards has laid down service conditions (including leave rules) for teachers. It may pleasebe noted that while issuing this notification, it was expected that entire scheme of revision of pay scales,together with all the conditions attached to it, would be implemented as a composite scheme without anymodifications.

It has now been brought to the notice of the UGC that some of the universities have not given effect to theLeave Rules prescribed by the UGC as an integral part of the revised pay scales. For implementation of theLeave Rules, it is necessary for the Universities to suitably amend the relevant statutes / ordinances / rules /regulations as may be required. A copy of the Leave Rules is enclosed for your kind reference.

May I request you to kindly confirm if your university has implemented the prescribed leave rules. In case,your university is yet to implement the revised leave rules, you may please initiate action for itsimplementation forthwith. You may also advise the colleges affiliated to your university to follow theprescribed leave rules. I would appreciate if you could send me a status on the same. If you require anyclarifications from us on this issue, please feel free to do so.
