    In 1996, Parties adopted a Protocol to the Convention on the Prevention of Marine Pollution by Dumping ofWastes and Other Matter, 1972 (known as the London Protocol) which entered into force in 2006.

    The Protocol, which is meant to eventually replace the 1972 Convention, represents a major change of approach tothe question of how to regulate the use of the sea as a depository for waste materials. Rather than stating whichmaterials may not be dumped, it prohibits all dumping, except for possibly acceptable wastes on the so -called"reverse list", contained in an annex to the Protocol.

    The London Protocol stresses the precautionary approach, which requires that appropriate preventative

    measures are taken when there is reason to believe that wastes or other matter introduced into the marineenvironment are likely to cause harm even when there is no conclusive evidence to prove a causal relationbetween inputs and their effects. It also states that "the polluter should, in principle, bear the cost of pollution" and emphasizes that ContractingParties should ensure that the Protocol should not simply result in pollution being transferred from one part of theenvironment to another.

    Agreement for the implementation of the provisions of the Convention of 10 December 1982relating to the conservation and management of straddling fish stocks and highly migratoryfish stocks

    (in force as from 11/12/2001)

    The United Nations Agreement for the Implementation of the Provisions of the United Nations Convention on theLaw of the Sea of 10 December 1982 relating to the Conservation and Management of Straddling Fish Stocks andHighly Migratory Fish Stocks sets out principles for the conservation and management of those fish stocks andestablishes that such management must be based on the precautionary approach and the best available scientificinformation. The Agreement elaborates on the fundamental principle, established in the Convention, that Statesshould cooperate to ensure conservation and promote the objective of the optimum utilization of fisheriesresources both within and beyond the exclusive economic zone.

    The Agreement attempts to achieve this objective by providing a framework for cooperation in the conservationand management of those resources. It promotes good order in the oceans through the effective management andconservation of high seas resources by establishing, among other things, detailed minimum internationalstandards for the conservation and management of straddling fish stocks and highly migratory fish stocks; ensuringthat measures taken for the conservation and management of those stocks in areas under national jurisdiction andin the adjacent high seas are compatible and coherent; ensuring that there are effective mechanisms forcompliance and enforcement of those measures on the high seas; and recognizing the special requirements ofdeveloping States in relation to conservation and management as well as the development and participation infisheries for the two types of stocks mentioned above.

    The Agreement was adopted on 4 August 1995 by the United Nations Conference on Straddling Fish Stocks andHighly Migratory Fish Stocks and opened for signature on 4 December 1995. It remained open for signature until 4December 1996 and was signed by 59 States and entities.

    The requirements for the entry into force of the Agreement were met on 11 November 2001, when the Ministerfor Foreign Affairs of Malta deposited an instrument of accession to the Agreement with the Secretary-General.The instrument was the thirtieth instrument of ratification or accession deposited. The Agreement entered into

    force on 11December 2001, i.e., 30 days after the date of deposit of the thirtieth instrument of ratification oraccession, in accordance with article 40 (1) of the Agreement.

    The Convention for the Protection of the marine Environment of the North-East Atlantic (theOSPAR Convention')

    Open for signature at the Ministerial Meeting of the Oslo and Paris Commissions in Paris on 22 September 1992. Itwas adopted together with a Final declaration and an Action Plan.

    The OSPAR Convention entered into force on 25 March 1998. It replaces the Oslo and Paris Conventions butDecisions, Recommendations and all other agreements adopted under those Conventions will continue to beapplicable, unaltered in their legal nature, unless they are terminated by new measures adopted under the 1992OSPAR Convention.

    OSPAR is the mechanism by which fifteen Governments of the western coasts and catchments of Europe, togetherwith the European Union, cooperate to protect the marine environment of the North-East Atlantic. It started in1972 with the Oslo Convention against dumping. It was broadened to cover land-based sources and the offshoreindustry by the Paris Convention of 1974. These two conventions were unified, up-dated and extended by the 1992OSPAR Convention. The new annex on biodiversity and ecosystems was adopted in 1998 to cover non-pollutinghuman activities that can adversely affect the sea.

    Convention on Cooperation for the Protection and Sustainable Use of the River Danube,(1998)

    a.k.a. Danube River Protection Convention

    The Danube River Protection Convention forms the overall legal instrument for co-operation on transboundarywater management in the Danube River Basin. The Convention was signed on June 29 1994 in Sofia (Bulgaria) andcame into force in 1998. It aims to ensure that surface waters and groundwater within the Danube River Basin aremanaged and used sustainably and equitably.

    Convention on the Protection of the Alps (1991)

    The aim of this Convention is the long-term protection of the natural ecosystem of the Alps and sustainabledevelopment in the area, as well as the protection of residents' economic interests. The guiding principles of theConvention are prevention, polluter-pays and trans-border cooperation.

    The Parties to the Convention are:

    In order to fulfil their objective effectively, the Parties to the Convention act in the areas of regional planning, the

    conservation of nature and the countryside, mountain farming, mountain forests, soil conservation, tourism andrecreation, energy, transport, prevention of air pollution, water management, population and culture, and wastemanagement.

    The Convention provides for the drawing up and adoption of application protocols for each of these areas as wellas for resolving disputes between the Parties.

    The Parties are obliged to cooperate in the fields of research and regional monitoring as well as on legal, scientific,economic and technical matters.

    A Conference of the Contracting Parties ("the Alpine Conference") holds regular meetings (in principle every twoyears) to look at issues of common interest for the Contracting Parties and to make decisions and

    recommendations.

    The Convention entered into force for the European Community on 4 April 1998 .

    1) Ratification : a treaty is generally open for signature for a certain time following the conference whichhas adopted it. However, a signature is not binding on a State unless it has been endorsed by ratification.The time limits having elapsed, the Conventions and the Protocols are no longer open for signature. TheStates which have not signed them may at any time accede or, in the appropriate circumstances,succeed to them.

    Accession : instead of signing and then ratifying a treaty, a State may become party to it by the singleact called accession.

    The Agreement between the United Nations and the Government of Sierra Leone on the Establishment of a SpecialCourt for Sierra Leone, with the Statute of the Court annexed thereto, was signed in Freetown, Sierra Leone, on 16January 2002 and entered into force on 12 April 2002, following its ratification by Sierra Leone. The Special Courtis mandated to try those who bear the greatest responsibility for serious violations of international humanitarian lawand Sierra Leonean law committed in the territory of Sierra Leone since 30 November 1996.

    Having determined pursuant to Article 39 of Chapter VII of the Charter of the United Nations that thesituation in the former Yugoslavia constituted a threat to international peace and security, the SecurityCouncil decided to establish an international tribunal as an effective measure to deter the commission ofcrimes, bring those responsible to justice, and contribute to the restoration and maintenance of peace. Inresolution 827 (1993) of 25 May 1993, the Security Council unanimously approved under Chapter VII both the report of the Secretary-General and the appended Statute of the International Tribunal (Statute).

    The drafters of the Statute had explicitly declined to make it a self-contained criminal code. They insteadgranted the Tribunal jurisdiction over a set of very broadly defined crimes, the specific content of which was to be found in customary international law. Though the Tribunal recognizes that bindingconventional law could also provide basis for its jurisdiction, it has in practice always determined that thetreaty provisions in question are also declaratory of custom. As a consequence of this approach, articles 2,3, 4 and 5 of the Statute list the crimes within the Tribunals jurisdiction in very general terms.

    After several resolutions in which the Security Council expressed its grave alarm at continuing reports of widespread violations of humanitarian law occurring in the territory of the former Yugoslavia and takinginto consideration the interim report of the Commission of Experts, the Security Council decides in itsResolution 808 (1993) that an international tribunal shall be established for the prosecution of personsresponsible for serious violations of international humanitarian law committed in the territory of the

    former Yugoslavia since 1991.

    The Security Council states that the situation constitutes a threat to international peace and security, andthat it is determined to put an end to such crimes and take effective measures to bring to justice thepersons who are responsible for them. The Security Council further states its conviction that in theparticular circumstances of the former Yugoslavia, the establishment of an international tribunal wouldenable this aim to be achieved and would contribute to the restoration and maintenance of peace. Thus,the Security Council decides to adopt, by its Resolution 827 (1993) of 25 May 1993, the Statute of theInternational Tribunal for the former Yugoslavia.
