PART A: INTRODUCTION, DEFINITIONS AND INTERPRETATION

1 PURPOSE OF THIS DOCUMENT

This Handbook sets out the terms and conditions applicable to the carriage of passengers and their luggage on NSW Trains and Sydney Trains Services from 24 December 2014. This Handbook replaces the former Passenger Fares and Coaching Rates Handbook and the CountryLink Business Rules Manual, which previously described the terms and conditions relating to travel on CityRail and CountryLink services operated by RailCorp. The terms and conditions set out in this document, as amended from time to time, apply for all Services from 24 December 2014. This document may also be referred to as the Sydney Trains and NSW Trains Fares and Ticketing Business Rules Manual. Additional information on Fares and ticketing products for Sydney Trains and NSW Trains is available by calling 131500 or at www.transportnsw.info. 2 INFORMATION ABOUT CONCESSIONS

4 DEFINITIONS AND INTERPRETATION

4.1 Definitions

Term Definition or interpretation Accessible Seat An allocated seat reserved for passengers with a Disability. Adult A person 16 years of age and over excluding concession holders. Adult Fare The Fare for an Adult for a Booked or Non-Booked Service (as applicable)

published on www.transportnsw.info or www.nswtrainlink.info. Alternative Route Any other routes which may be available between two Stations. Attendant Sighted person four (4) years or older. ATTR Authority To Travel Receipts (ATTR) are issued through Ticket Vending

Machines and allow a customer to travel on a service when the required Ticket is not available through a Ticket Vending Machine. As with other Tickets the ATTR must be purchased prior to boarding the service, as described in section 12.15.

Authorised Officer

A person authorised by the Independent Transport Safety Regulator as an authorised officer for the purposes of the section 46W of the Passenger Transport Act 1990.

Between The word "between" means "to and from". Booked Services Regional Services operated by NSW Trains where the Origin and/or Destination

are in the Booked Services Area on which a customer may be allocated a reserved seat.

Booked Services Area

Has the meaning given to it in clause 4.2(a).

Break of Journey (Non-Booked Service)

Leaving the Paid Area of a Station before reaching the Destination printed on your Ticket and rejoining a later Service using the same Ticket.

Break of Journey (Booked Service)

Time less than 12 hours between arrival at a Station by one Booked Service and departure from the same Station on the next Booked Service.

Charging Unit A measure of distance used to calculate Fares for Booked Services. Child A person four (4) years of age and over, but under 16 years of age. Child Fare 50% of the Adult Fare rounded to the nearest dollar, plus GST. City Railway Has the meaning given to it in clause 1.4 of Annexure A. Complimentary Voucher

A voucher that may be issued by Sydney Trains or NSW Trains, which entitles the holder to free travel as indicated on the voucher. The voucher is not valid for travel and must be exchanged for a Ticket before travel.

Concession Fares Reduced Fares available for eligible concession beneficiaries such as children or pensioners.

CRS Customer Reservation System. Day Tickets Tickets available for travel for one (1) day on date of validity up until 4.00am the

following morning. Declaration Signed statement. Destination (Non-Booked Service)

The Station/zone specified on the Ticket.

Destination (Booked Service)

Last Station of a Leg of an Itinerary.

Disability Has the same meaning as it has in the Disability Discrimination Act 1992 of the Commonwealth.

Distance Fare Fare based on distance. ECRL Epping to Chatswood rail link, including Macquarie University, Macquarie Park

and North Ryde Stations. Employee Any officer, employee or other person in the service of RailCorp, STA, State Rail

Authority, Transport for NSW, NSW Trains or Sydney Trains. Encoded Ticket A rail Ticket incorporating a magnetic strip or surface on which is encoded the

Ticket validity. Fare The charge fixed for the conveyance of passengers for a specified distance or

between specified places.

Any event beyond the control of Sydney Trains or NSW Trains, including:

(a) act of God, earthquake, cyclone, fire, explosion, flood, landslide, lightning, storm, tempest, drought or meteor; or

(b) war (declared or undeclared), invasion, act of a foreign enemy, hostilities between nations, civil insurrection or militarily usurped power;

(c) act of public enemy, sabotage, malicious damage, terrorism or civil unrest; or

(d) confiscation, nationalisation, requisition, expropriation, prohibition, embargo, restraint or damage to property by or under the order of any government or government authority; or

(e) industrial action; or

(f) any other thing outside the control of Sydney Trains or NSW Trains (as applicable) or its employees, agents or contractors.

FTR Financial Transaction Record. Gateway Location A Station on the City Railway from which Fares are calculated when travel

passes through the City Railway. GPT (General Purpose Ticket)

Manually completed paper Ticket, which may be issued in lieu of an Encoded Ticket.

Handbook This Sydney Trains and NSW Trains Fares and Ticketing Customer Handbook, as amended from time to time.

Infant A person under four (4) years of age. Intermodal Destination

A Station serviced by multiple modes of travel, eg: train, bus, Tram and/or ferry.

Interstate Area deemed outside of NSW. Itinerary The total Leg or Legs contained in a Passenger Name Record. Journey - Return Two Single Journeys where the Origin on the first Journey and the Destination

on the last Journey are the same Station. Journey - Single One or more Legs where the Origin and Destination are not the same Station. Leg A Journey between an Origin and a Break of Journey Station or Stopover

Station, or if there is no Break of Journey or Stopover, the Destination. Line A line of railway upon which passenger services travel. Link Ticket A Ticket that combines other travel components with a Fare. Mobility Aid Wheelchair, collapsible wheelchair, motorised wheelchair or motorised scooter

that complies with physical dimensions specified in clause 19.2 (for travel on trains) and clause 19.3 (for travel on coaches).

MyMulti Fare The charge fixed for multi-modal Journeys, irrespective of the number of Journeys, over a specified route, or part of a specified route(s)/zone(s), during a specified period (DayPass, Weekly – 7 days, 90 days, 365 days).

MyTrain 7- 14, 90 and 365 Day Fare

The charge fixed for Journeys, irrespective of number, over a specified route(s), or part of a specified route, for Tickets covering concession weekly (7-day), concession fortnightly (14-day), 90-day and 365-day periods.

MyTrain Concession (Child) off-peak Return Fare

The discounted charge fixed for one return Journey from the Origin Station and return to the same Station.

MyTrain Return Fare

The non-discounted charge fixed for one return Journey from the Origin Station and return to the same Station.

MyTrain Single Fare

The charge fixed for one Journey from one specified Station or one specified place to another specified Station or specified place.

MyZone Tickets All MyTrain tickets, all MyBus tickets, all MyFerry tickets, all MyMulti tickets, the Pensioner Excursion Ticket and the Family Funday Sunday ticket.

Non-Booked Services

NSW Trains Intercity Services and Sydney Trains Services that operate exclusively in the Non-Booked Services Area.

Non-Booked Services Area

Has the meaning given to it in clause 4.2(a).

Term Definition or interpretation Origin A Station from which the first Journey begins. Paid Area That area upon which a person may not enter or leave without being in

possession of a valid Ticket. If the Station has no Ticket barrier, this means the platform. If the Station has a Ticket barrier, this means the platform and all other parts of the Station between the platform and the Ticket barrier.

Pass A recognised authority for travel (deemed as a Ticket). Passenger Name Record / PNR

NSW Trains Reservation system booking identification code.

Passenger Type Specific passenger type code used in the NSW Trains computer reservation system.

RailCorp Rail Corporation New South Wales constituted under the Transport Administration Act 1998.

Railways Acts and Bylaws

Any Act of Parliament of the Commonwealth or of a State which in any way relates to the creation of an entity with the function of operating a railway, or which relates to a railway operated by such an entity and any regulation, bylaw, order or resolution made pursuant to any such Act.

Return Fare The charge fixed for two Journeys where the Origin and final Destination are the same specified Station.

Route A Line or course followed by a Service. Service A Sydney Trains or NSW Trains train, road-coach or minibus provided for

conveyance of passengers, except where the meaning is otherwise implied. Single Fare The charge fixed for one Journey from one specified Station to another specified

Station. Station A recognised place for picking up or setting down passengers travelling on

Services. Stopover Time greater than 12 hours between arrival at a Station by one Service and

departure from the same Station on the next Service. Student Fare 50% of the Adult Fare rounded to the nearest dollar, plus GST. Through Fare Fare covering a Journey for an Itinerary conveyance by rail or motor vehicle. Ticket An ATTR, receipt, pass, MyTrain, MyMulti Ticket or any pass of a similar nature. Ticket Vending Machine

Customer operated vending machine, installed at selected Stations, which issues a range of Encoded Tickets.

Valid Ticket A Ticket which complies with all conditions under the Railways Acts and bylaws relevant to its use.

Wheelchair Space An allocated space for a Mobility Aid.

4.2 Interpretation

(a) These area definitions are to be applied when using this guide: (i) Non-Booked Services Area: The MyZone ticketing system area bounded by

Dungog/Scone, Bomaderry (Nowra), Goulburn and Lithgow. (ii) Booked Services Area: All Lines and Stations outside of the Non-Booked

Services Area serviced and ticketed by NSW Trains, excluding any Interstate locations.

(b) A reference in any clause to a nominated Sydney Trains or NSW Trains officer includes a reference to such other officer as Sydney Trains or NSW Trains may from time to time nominate for the purposes of the clause.

(c) A reference to a Ticket includes a reference to a MyTrain or MyMulti Ticket, a General Purpose Ticket, Authority to Travel Receipt (ATTR), a free school travel pass, incapacitated Ex-member of Defence Force pass, TravelPass, Special Event Ticket or any pass of a similar nature.

(d) A reference to forward portion includes a reference to the forward Journey in respect of any type of return Ticket.

(e) A reference to return portion includes a reference to the return Journey in respect of any type of return Ticket.

(f) For Ticket availability purposes, the nominated date of expiry (eg: “date printed on Ticket”, “date of issue”, etc) is deemed to extend to 4.00am the following morning.

(g) A reference to the singular includes the plural.

(h) All Fares rates and charges are inclusive of the Goods and Services Tax (GST).

(i) Any portion of a day will be regarded as one day.

(j) Any portion of a kilogram will be regarded as one kilogram.

(k) 0.5 cents or more will be regarded as ONE cent. Less than 0.5 cents will be disregarded.

(l) Where it is provided that a Fare, charge or fee, etc be rounded off to the nearest 10 cents - five cents will be regarded as ten cents.

(m) Where it is provided that a Fare, charge or fee, etc be rounded off to the nearest dollar - 50 cents will be regarded as ONE dollar.

PART B: GENERAL CONDITIONS OF TRAVEL

5 GENERAL CONDITIONS OF TRAVEL

The following conditions apply to travel on all Services. By using the Services, purchasing a Ticket to use the Services and/or entering a Paid Area, you accept and agree to all the conditions contained in this Handbook.

5.1 Applicable legislation, regulations and rules

(a) All Services are provided under and subject to: (iii) the Transport Administration Act 1988 and regulations made thereunder, the Rail

Safety National Law (NSW) and the regulations made thereunder, and the Passenger Transport Act 1990;

(iv) any other Railways Acts and Bylaws; and

(v) the provisions of this Handbook.

(b) NSW Trains and Sydney Trains are required to comply with the Privacy and Personal Information Act 1998 and certain other privacy laws, regulations and principles (“Privacy Legislation”). The Privacy Legislation regulates the collection, storage, use and disclosure of personal information. Information about a passenger, including their name, address and other details is “personal information” for the purpose of the Privacy Legislation. NSW Trains’ and Sydney Trains’ privacy policies are available online at www.sydneytrains.info and www.nswtrainlink.info.

(c) Sydney Trains and NSW Trains are committed to providing access to Services to all passengers, in compliance with the Anti-Discrimination Act (NSW) 1977 and the Disability Discrimination Act (Commonwealth) 1992. See clause 19 below for provisions relating to customers with a Disability on Booked Services.

(d) All customers travelling on any Services must comply with Parts 5 and 6 of the Passenger Transport Regulation 2007.

5.2 Passenger Code of Conduct

The following rules apply to passengers travelling on any Service or present on any Sydney Trains or NSW Trains property, including Stations. By using any Service, or entering any Sydney Trains or NSW Trains property, each passenger accepts and agrees to abide by the following rules:

(a) A person who is on a train must not put any part of their body outside any window or doorway of a Service while it is in motion.

(b) A person who is on a train must not enter or leave a Service while it is in motion.

(c) A person who is on a train must not board or leave a Service that is not scheduled to pick up or set down passengers.

(d) A person who is on a train must not board a Service without a valid Ticket and/or reservation.

(e) A person who is on a train must not board a Service wearing soiled clothing, without footwear or being offensive to other passengers.

(f) Passengers cannot board a Service in possession of an opened container of alcohol.

(g) Smoking is not permitted on any Service or at any Station.

(h) A person who is on a Service and in possession of a Ticket must make their Ticket available for inspection or processing by an Authorised Officer on the Authorised Officer’s request.

(i) A person must not travel on a Service on the authority of a concession Ticket unless the person is, by reason of their age, occupation or status, entitled to the concession Ticket. An Authorised Officer may require a person to produce to the Authorised Officer evidence (for example, the person’s pensioner or student concession card) that the person is entitled to the concession Ticket.

(j) A person detected travelling on a Service on an unauthorised Ticket will be required to pay the applicable penalty for travelling on an unauthorised fare.

(k) Customers must not behave in a violent or antisocial manner.

Sydney Trains and NSW Trains, to the extent permitted by law, will not be liable for injury, loss or damage, however it is caused, which a passenger may sustain as a result of a breach of clause 5.2. If a passenger is in breach of any provisions of this Handbook, including the Passenger Code of Conduct, or any other conditions of carriage, conditions of ticketing, or directions given by and Employee or Authorised Officer, NSW Trains and Sydney Trains (as applicable) have the right to refuse to provide any Service to that passenger, and the contract for carriage between NSW Trains or Sydney Trains (as applicable) and the passenger is immediately terminated without right of refund. If a passenger breaches any provision of the Passenger Transport Regulation 2007, NSW Trains or Sydney Trains staff may ask the police to remove the passenger from the Service. An Authorised Officer may direct a passenger to leave a train where the member of staff is in the opinion that the passenger has committed an offence in breach of the Passenger Transport Regulation 2007. Sydney Trains and NSW Trains reserve the right to confiscate Tickets and concession cards for misuse or any breach of the terms and conditions in this Handbook, or any other relevant law, or directions given by an Employee or Authorised Officer.

5.3 Limitation of liability

(a) Except as otherwise provided in this Handbook, and to the extent permitted by law, Sydney Trains and NSW Trains exclude all liability for loss, damage or delay caused or contributed to by or arising from or otherwise related to: (i) inaccuracy in any information concerning or provided in the course of provision of

a Service or the pricing (including any inaccuracy, error or misdescription contained in any travel or tour brochure); or

(ii) the withdrawal or cancellation of any Service; or

(iii) any variation in the time of arrival at or departure from any Station or point of any train, bus or other travel service; or

(iv) the loss or theft of a Ticket, or if it a Ticket is honoured when presented by any person other than the person named on it; or

(v) the act or omission of the party suffering loss or damage, or any third party, including other customers using the Services; or

(vi) the occurrence of a Force Majeure Event.

(b) NSW Trains and Sydney Trains will not be liable for: (i) any indirect, consequential, special or economic loss or damage; or

(ii) loss of profits, revenue, goodwill, anticipated savings or opportunity, including for any claims for breach of contract, tort (including negligence), under statute or otherwise, to the extent that such losses are not reasonably foreseeable by NSW Trains and/or Sydney Trains and the customer at the time of purchase of the Ticket by the customer.

(c) Nothing in this Handbook operates to limit or exclude liability that cannot by law be limited or excluded. NSW Trains’ and Sydney Trains’ liability for breach of any statutory guarantee or term implied by statute which cannot be excluded is (to the extent permitted by law) limited to: (i) in the case of goods:

• the replacement of the goods; or • the supply of equivalent goods; or • repair of the goods; or • payment of the cost of replacing the goods or acquiring equivalent goods; or • payment of the cost of having the goods repaired; and

(ii) in the case of services:

• resupply of the services; or • payment of the cost of resupplying the services.

(d) These limitations are in addition to any other express limitations set out in this

Handbook or at law.

5.4 Carriage of animals

(a) Sydney Trains and NSW Trains are entitled to impose conditions for the carriage of animals on their trains (other than for assistance animals or assistance animals in training) pursuant to sections 41 and 53 of the Passenger Transport Regulation 2007 (NSW).

(b) Sydney Trains and NSW Trains do not permit animals on Services except:

(i) assistance animals, which include dogs trained to alleviate the effects of the Disability on public transport, accompanying a person with a Disability;

(ii) assistance animals in training;

(iii) therapy animals (only where the handler is in possession of a Assistance Animal permit issued by Transport for NSW); and

(iv) police dogs when they are on duty.

(c) An example of an assistance animal is a guide dog used by a visually impaired person. An assistance animal should have been suitably trained, including the use of public transport, and should carry a suitable medallion or other identification to identify it as a trained assistance animal.

(d) Pets (sometimes described as companion animals) are not allowed on Services at any time.

5.5 Times of Services

(a) The times published in the official timetables are those at which it is intended, so far as circumstances permit, that the Services should arrive at, and depart from, the various Stations. However, Sydney Trains and NSW Trains do not guarantee the departure or arrival of Services at the times stated.

(b) Sydney Trains and NSW Trains reserve the right to cancel, either wholly or in part, any of the Services shown in the official timetables and vary the Stations at which the Services will pick up or set down passengers and the times of arrival or departure, as shown in such timetables.

5.6 Before starting a Journey

(a) Before starting their Journey, passengers must check the official timetables or ask the officer in charge of the Station whether they can reach their destination at the desired time.

(b) At the time of purchasing a Ticket, customers are required to check that the correct Ticket has been issued.

5.7 Lost property

Property left on Sydney Trains or NSW Trains premises (including Stations) will be dealt with in accordance with the Lost Property Office procedures available at www.sydneytrains.info or by calling 02 9379 3341.

5.8 Concession, discount and promotional Fares

(a) NSW Trains and Sydney Trains may offer discount, seasonal and/or promotional Fares from time to time. Details of these Fares will be published on the NSW Trains website at www.nswtrainlink.info and/or Sydney Trains website at www.sydneytrains.info.

(b) Concession Fares may be available for eligible beneficiaries. Details about the specific conditions which apply for free and concessional travel are available from the Transport for NSW website at www.transport.nsw.gov.au.

5.9 Third party products

(a) Sydney Trains and NSW Trains may issue Tickets for services not operated by, or that involve a component not operated by, Sydney Trains or NSW Trains. Sydney Trains and NSW Trains issue the same only as the agent for the operator of the service involved and Sydney Trains’ or NSW Trains’ liability does not extend beyond the portion of the Journey made on Services provided by Sydney Trains or NSW Trains. By using services provided by any operator(s) other than Sydney Trains or NSW Trains, a customer may be subject to third party terms and conditions.

PART C – NON-BOOKED SERVICES SPECIFIC CONDITIONS

6 CONDITIONS OF TRAVEL – NON-BOOKED SERVICES

The following conditions apply to Non-Booked Services. These conditions are in addition to, and must be read in conjunction with, the General Conditions of Travel in Part B. 6.1 One class of travel

Holders of first or economy class Tickets for Booked Services who may travel on trains which commence and/or complete their Journey using Non-Booked Services are advised that only one class of travel exists on Non-Booked Services. The economy Fare will be charged for a Ticket covering travel between Stations on Non-Booked Services.

6.2 Payment of Fares

(a) When purchasing Tickets the exact amount of the Fare must be tendered where practicable.

(b) Sydney Trains and NSW Trains are under no obligation to accept coins in excess of the maximum allowed as shown in the table below:

The decision to accept coins in excess of that shown in the table above is at the absolute discretion of the person staffing the Ticket office.

(c) Customers may be required to use Ticket Vending Machines to purchase Tickets. Sydney Trains and NSW Trains are under no obligation to accept a note with a value of more than $50.00 in a Ticket Vending Machine.

(d) If Sydney Trains or NSW Trains provide change as part of a Ticket purchase, customers are required to check that the amount of change provided is correct at the time of purchase.

6.3 Suburban passengers not booked on Booked Services

(a) Passengers with Tickets for Non-Booked Services travelling between Stations within the Non-Booked Services Area may travel using Booked Services at the discretion of Station staff. Such passengers may not, under any circumstances, travel by certain Services specified in the official timetables.

(b) If a passenger wishes to travel in first class or beyond the Stations covered by their Ticket, they must pay the relevant Fare for the entire Journey.

(c) Passengers travelling on Booked Services must abide by NSW Trains Booked Services conditions.

(d) Sydney Trains and NSW Trains reserve the right to require passengers to take substitute Services, which may include travel by Booked Services and/or replacement road Services, where necessary or convenient for Sydney Trains or NSW Trains.

(e) Passengers holding MyMulti or MyTrain Weekly Tickets can travel in economy class to Stations covered by their MyMulti or MyTrain Ticket, on Booked Services where the Service is timed to stop.

(i) Reservations are compulsory and can only be made on the day before or the day of travel.

(ii) Charges are as published from time to time in the NSW Government Gazette.

(iii) All other MyZone Tickets are not valid for travel on Booked Services.

6.4 Tickets where the issuing Station is not the Origin Station

(a) Customers are not entitled to purchase MyTrain Single or Return Tickets commencing at a Station other than the issuing Station, except where: (i) the customer is travelling on the authority of a GPT/ATTR and required to

exchange this for the appropriate Ticket at the Destination Station; OR

(ii) the customer was unable to purchase the required Ticket at the Origin Station and is purchasing a Ticket at the Destination Station, in accordance with Clause 6.5; OR

(iii) the customer is purchasing an extension Ticket to be used in conjunction with an existing periodical Ticket, in accordance with Clause 6.6.

(b) Customers are not entitled to purchase MyTrain periodical Tickets commencing at a Station other than the issuing Station, except where: (i) the fare between the Origin Station and Destination Station shown on the ticket is

equal to or greater than the fare between the issuing Station and the Destination Station shown on the ticket, and is valid for travel on the same Line or Lines; OR

(ii) the customer is travelling on the authority of a GPT/ATTR and required to exchange this for the appropriate Ticket at the Destination Station; OR

(iii) the customer was unable to purchase the required Ticket at the Origin Station and is purchasing a Ticket at the Destination Station, in accordance with Clause 6.5; OR

(iv) the customer is purchasing an extension Ticket to be used in conjunction with an existing periodical Ticket, in accordance with Clause 6.6.

6.5 Passengers travelling without Tickets

(a) Passengers travelling without Tickets must pay the Fare from the starting Station of the Service, unless satisfactory evidence is provided as to the Station at which the passenger joined the Service, in which case the Fare from that Station must be paid. The Fare charged will be the Single or Return Fare (or excursion Fare if such Tickets are available by the Service on which the passenger travels) according to the passenger’s requirements.

(b) Clause 6.5 will apply to passengers who have failed to purchase or renew periodical Tickets at a time when a Ticket selling facility was not available or passengers were unable to produce a current MyTrain or MyMulti periodical Ticket (refer to 15.5).

(c) Alternatively, a passenger, who has travelled from a Station at a time when a Ticket selling facility was not available, may be issued with a MyTrain or MyMulti periodical Ticket to cover his or her travel requirements, if such Ticket is requested.

6.6 Passengers travelling beyond Destination shown on Ticket

(a) A customer who travels to a Station beyond the Destination shown on the Ticket must pay the Fare for a separate Journey between the Destination shown on the Ticket and the Station to which travel is made.

(b) Where the customer commences a trip from a staffed Station, an extension Ticket must be purchased before commencing travel. Where the customer commences a trip at an unstaffed station, the extension Ticket may be purchased at the Station to which travel is made.

(c) Customers are only entitled to purchase an extension Ticket on presentation of a periodical Ticket which is valid for travel between the Station at which travel commences and the Origin Station shown on the extension Ticket.

6.7 Expired Tickets

Expired Tickets are not valid for travel.

6.8 Holders of excursion Tickets travelling by Services on which such Tickets are not available

If a holder of an excursion Ticket who travels for the whole or any portion of the FORWARD or RETURN Journey by a Service for which the Ticket is not available they will be charged the difference between the Fare paid and the ordinary Return Fare between the Stations indicated on the excursion Ticket.

7 REFUNDS – MYZONE TICKETS

7.1 Tickets which may be refunded

Customers holding MyZone Tickets – other than MyBus Tickets or MyFerry Tickets – may apply for a refund for all or part of the value of their ticket, as set out below. Information about refunds of MyBus Tickets or MyFerry Tickets is available on Transport Info (www.transportnsw.info). NOTE: MyZone Tickets were introduced on 18 April 2010 for the greater metropolitan area, including Sydney, the Central Coast, Newcastle and the Lower Hunter, the Illawarra and the Blue Mountains. Refunds and or exchanges for tickets pre-dating this period were closed in July 2010. This includes 10 trip bus and ferry tickets, purchased before 18 April 2010. 7.2 Making an application: General

(a) Customers can request a refund in the following three ways:

(i) manual application;

(ii) online ticketing process; or

(iii) Station Booking Office (Automated refund process).

(b) Transport for NSW is not obliged to accept medical certificates for refund consideration, though usually they are accepted as a goodwill gesture. If any inconsistency is apparent e.g. back dating or alteration etc, Transport for NSW may decline to recognise a medical certificate for refund purposes. Medical certificates submitted for refunds on MyTrain or MyMulti weekly Tickets must cover at least five days.

(c) The decision to accept medical certificates is at the sole discretion of the designated manager.

(d) Any cancellation fee or other fees payable may be deducted from any refund to which a customer is entitled before the refund is paid.

7.3 Manual application

(a) Manual refunds are those submitted at Stations using paper application forms.

(b) Customers are required to complete written application forms if they wish to apply for refunds on Single, Return, Weekly or fortnightly Tickets. These forms are to be handed in to staff at Stations. Customers should submit refund applications as soon as possible. The decision whether to refund a Fare is at the absolute discretion of the designated manager.

(c) For the purpose of the following subclauses “refund value” means the gross refund due, ie: the refund due before the deduction of the applicable refund fee; and “net refund value” means the refund due after the deduction of the applicable refund fee.

(d) A refund fee will be deducted from the refund value. Refund fees will be published from time to time in the NSW Government Gazette.

(e) MyTrain and MyMulti weekly Tickets: refunds are not available if the Ticket has been used for more than three days of the total Ticket validity period.

(f) MyTrain Fortnightly Tickets: refunds are not available if the Ticket has been used for more than 10 days in a 14-day period.

(g) Sydney Trains and NSW Trains are not obliged to refund any amount less than the dollar value of half the applicable Ticket. In such cases one free Complimentary Voucher may be issued in place of the refund value.

(h) All manual refunds must be electronically transferred into an Australian bank account.

(i) A customer entitled to pay a Concession Fare who purchases a Ticket at a higher Fare (for example an Adult Fare) will not be refunded the difference in Fares.

(j) There are NO refunds on Non-Booked Services Single/Return Tickets unless lodged at the issuing Station (booking office) within 30 minutes of purchase.

(k) Unless approved by Transport for NSW in special cases, refunds are not available on Day Tickets.

(l) Customers (including family groups) must check their Tickets and change at the time of purchase. Retrospective adjustment(s) cannot generally be made, except that consideration may be allowed if Tickets are returned to the issuing Station (booking office) within 30 minutes.

(m) If a customer has two MyTrain or My Multi (7 or 14 day) Tickets, no allowance will be made regarding overlapping availability.

(n) Tickets that are mutilated beyond recognition cannot be refunded.

(o) Refunds are not available on MyTrain or MyMulti Tickets purchased for use when another Ticket is lost, stolen or mislaid.

7.4 Online ticketing refunds

(a) Customers can apply online for refunds on registered 90 and 365 day MyTrain and MyMulti Tickets via the Sydney Trains website at www.sydneytrains.info.

(b) Refunds processed online will be paid directly into customers nominated Australian bank accounts after applications have been investigated and approved. Payment cannot be made by cheque.

(c) Tickets that are mutilated beyond recognition cannot be refunded.

(d) Refunds are not available on MyTrain or MyMulti (90, 365 day) Tickets purchased for use when another Ticket is lost, stolen or mislaid.

(e) As longer-term periodical Tickets can also be used outside times of work or court business, refunds will not be allowed for rostered days off, jury service etc.

(f) A customer who does not intend to use a periodical Ticket for a lengthy period of time (due to pending hospitalisation, holidays etc) should immediately seek a refund of the unused portion of the Ticket on learning that they will not be able to use the periodical Ticket. The Ticket must be returned at the time of requesting the refund.

(g) Tickets must be registered to allow online refunds.

7.5 Station Booking Office (Automated Refund Process)

(a) Customers can apply for a refund on 7 and 14 day MyTrain and MyMulti Tickets through the Station Booking Office Automated Refund Process facility.

(b) This facility is available for Sydney Trains and NSW Trains issued Tickets only.

(c) The Ticket refund is calculated from the day the Ticket is surrendered to Station staff.

(d) The calculated refund value, if accepted, will be refunded on site.

(e) Tickets that have expired will need to compile a manual refund form with supporting documentation.

(f) Calculation of Station Booking Office (Automated Refund Process) refund. The refund calculation is as follows:

(i) (Total Fare) less (used value) less (administration fee) = (Total refund value), where (Total Fare) = Original Ticket value; (Used value) = Days remaining % x Total Fare; and (Administration fee) = nominated fee.

(ii) Partial day is deemed as full day (used value)

(iii) Total refund value is the amount to be refunded.

(iv) For days remaining % refer to tables below.

7.6 Tickets lost, stolen or mislaid

(a) Sydney Trains, NSW Trains and Transport for NSW are not obliged to refund or replace lost, stolen or mislaid Tickets or passes. This includes photocopied Ticket(s).

(b) Refunds on periodical Tickets issued in substitution for lost, stolen or mislaid Tickets will be paid on the substitute (ie: NOT the original) Ticket’s value.

(c) The decision whether to refund or replace a lost, stolen or mislaid Ticket is at the sole discretion of the designated manager.

7.7 MyTrain and MyMulti Ticket refunds

(a) Subject to the deduction of the refund fee, a refund may be allowed on a periodical Ticket surrendered during its currency and refund will be based on the value of the Ticket less the value of travel made when the Ticket was in use. MyTrain 90 days and 365 days Twenty-five per cent of the MyTrain weekly Fare for each day (or part of a day) plus the applicable MyTrain weekly or 90 day Fares as the case may be, for the period after the date of issue or purchase of the Ticket (whichever is earlier).

Ticket issued in substitution for lost, stolen or mislaid periodical Ticket in accordance with clause 7.8.

A refund is only payable on the SUBSTITUTE (ie: NOT the original) Ticket’s value. See clause 7.6.

(b) For periodical MyTrain and MyMulti Tickets (90 and 365 days) the used Ticket value may exceed the Ticket purchase price. Refunds will not be paid on Tickets where this is the case.

7.8 Lost, stolen or mislaid periodical Tickets and passes

(a) Except where otherwise provided, when a periodical Ticket (other than a Ticket of less than 28 days duration) is lost, stolen or mislaid a substitute Ticket may be applied for if the Ticket was registered.

(b) Periodical Tickets that have not been registered are not covered by this clause.

(c) If the Ticket is unregistered and the customer is able to provide the original receipt, the decision to replace the lost Ticket is at the absolute discretion of the designated manager.

(e) For terms and fees relating to lost, stolen or mislaid concession passes, refer to www.transport.nsw.gov.au.

7.9 Children and families

(a) Infants are not permitted to travel by any Non-Booked Services unless accompanied by a parent or Adult responsible for the care of the Infant. No Fare will be charged for such an Infant.

(b) The applicable Child Fare will be charged for each Child travelling on any Non-Booked Service.

(c) Any person aged 16 years of age or over will be charged Adult Fare, except:

(i) where they are entitled to free or concessional travel; or

(ii) if they turn 16 during the Ticket’s availability, in which case they will be permitted to travel on that Ticket until its expiry without additional payment.

(d) Sydney Trains and NSW Trains reserve the right to decline to allow a Child to travel on any Service if, in the opinion of an Authorised Officer, such Child should be accompanied by an Adult.

8 BICYCLES

(a) All bicycles must be accompanied by a Fare paying passenger.

(b) Sydney Trains and NSW Trains do not guarantee that space will be available for bicycles on Non-Booked Services.

(c) The rate for bicycles (including a bike frame with wheels detached) carried separately on Non-Booked Services will be: Time and day of conveyance Fare Standard bicycles Between 6.00am and 9.00am weekdays. Or Between 3.30pm and 7.30pm weekdays.

The applicable Child Fare (ie: Child Single Fare, child Return Fare, Child off-peak Fare, etc, as the case may be)

(i) The bicycle must be folded and placed in a bag before boarding any Non-Booked Service.

(ii) The size of the folding bicycle (in its bag) must not exceed the following dimensions – 79x59x36cm (length x height x width).

(iii) The folding bicycle must not obstruct passageways or doorways and not inconvenience other passengers.

(iv) Free travel for folding bikes does not apply to Non-Booked Services that are bus Services, including trackwork buses, NightRide and regular bus/coach Services in outlying parts of the network. These include between Wollongong and Bundanoon, Fassifern and Toronto, Lithgow and Bathurst and the Picton Loop.

(g) A bicycle conveyed in accordance with this clause 8 will be carried at the owner’s risk and, to the extent permitted by law and subject to the limitations of liability in clause 5.3, Sydney Trains or NSW Trains liability will be limited to the extent that the loss suffered by the customer was caused by or contributed to an act or omission of the customer.

9 RESERVATIONS

9.1 Group reservations

Groups of 20 or more passengers may reserve seats on Non-Booked Services subject to the following conditions:

(a) Sydney Trains and NSW Trains reserve the right to limit the total number of passengers for any group booking or to decline additional groups on any one Service;

(b) all group bookings for travel on Non-Booked Services must be paid for in full at least three days in advance of the date of travel, unless otherwise agreed; and

(c) group bookings will NOT be accepted for travel in peak periods, unless specifically authorised by Sydney Trains or NSW Trains.

9.2 Reserved carriages

Subject to approval by Sydney Trains or NSW Trains, a carriage may be reserved for exclusive use by an organised group according to the following conditions:

(a) where the number of passengers is less than the capacity of the reserved carriage, the number of additional passengers required to reach capacity will be charged at Single Adult Fares for the Journey undertaken;

(b) the minimum charge for reserving a whole carriage will be the applicable total Fare for half the route distance travelled by the group (or any part of the group); and

(c) if additional carriages are attached to a train to meet the needs of a group, normal passenger Fares will not apply and the price of the carriage will be determined by Sydney Trains or NSW Trains in their absolute discretion.

9.3 Cancellation of reservations

(a) If a reservation is cancelled, the cancellation is subject to Sydney Trains or NSW Trains recovering any costs already incurred in arranging the reservation.

When travelling on road services Tickets will only be issued for Journeys covering travel provided solely by Sydney Trains or NSW Trains operated road Services. The applicable Fare will apply for the road distance travelled. Return Tickets will not be available. 11 NON-BOOKED SERVICES CO-ORDINATED RAIL AND ROAD COACH

SERVICES

The appropriate Tickets will be issued for Journeys covering travel by Sydney Trains or NSW Trains rail and road coach Services and the Fare will be calculated as the Fare for the distance of co-ordinated rail and road coach travel. 12 NIGHTRIDE BUS SERVICES

(a) A valid MyTrain (return, off-peak return, weekly, fortnightly, monthly, quarterly or yearly) Ticket; MyMulti (weekly, monthly, quarterly, yearly or DayPass) Ticket, Family Funday Sunday Ticket, Link Ticket or Pensioner Excursion Ticket can be used for travel on NightRide Services without payment of an additional bus Fare.

(b) MyTrain Single Tickets are not available for travel on NightRide Services. Customers can be issued a Single Ticket to travel to the NightRide interchange Station and then purchase another Ticket when joining the bus.

13 BATHURST ROAD COACH SERVICE

(a) Services to Bathurst are to be calculated at the off-peak rate at all times.

(b) Bookings are essential on the bus Service (Tickets will not be issued for travel if reserved seating is not available).

(c) The applicable MyTrain, MyMulti3 and MyMulti DayPass Tickets can be used on these Services, but it is essential customers book their seats before travelling.

(d) The sale of MyTrain or MyMulti Tickets is not allowed at any location on the Bathurst road coach route.

15 CONDITIONS OF TRAVEL FOR CATEGORIES OF TICKET ON NON-BOOKED SERVICES

Sydney Trains and NSW Trains reserve the right to suspend or discontinue any class of Ticket.

15.1 Availability of Single and Return Tickets on Non-Booked Services

(a) MyTrain Single Tickets and the forward Journey of return Tickets are available for travel wholly within the Non-Booked Services Area.

(b) The Journey must be started on the date printed on the Ticket and completed by 4.00am the following day.

(c) Return Journey of MyTrain return Tickets must be started on the date printed on the Ticket and completed by 4.00am the following day.

15.2 Advance purchase of Single and Return Tickets

(a) Passengers must purchase Tickets before the arrival of the train. Tickets will be issued in advance as follows: (i) Tickets for Journeys wholly within the Non-Booked Services Area will be issued

on the day of travel only; and

(ii) the issue of Tickets in advance will be subject to variation from time to time.

15.3 Concession (Child) Off-peak return Tickets

(a) Concession (child) off-peak return Tickets will be available for travel on or after 9.00am on Mondays to Fridays and at any time on Saturdays, Sundays and public holidays. They will only be issued after the departure of the last Service before 9.00am on Mondays to Fridays. However, they may be issued to enable travel by authorised Services as published from time to time, which depart before 9.00am, on Mondays to Fridays.

(b) Concession (child) off-peak return Tickets will NOT be available for travel on Booked Services unless specified by Sydney Trains or NSW Trains. Concession (child) off-peak return Tickets will be available for travel on day of issue only.

(c) Approved off-peak trains before 9.00am will be advertised online at www.sydneytrains.info and www.nswtrainlink.info.

15.4 MyMulti Tickets

(a) Unless otherwise provided, MyMulti weekly Tickets, so far as rail travel is concerned, will be subject to the same conditions as MyTrain weekly and fortnightly Tickets.

(b) Unless otherwise provided, MyMulti 90 and 365 days Tickets, so far as rail travel is concerned, will be subject to the same conditions as rail only MyTrain periodical Tickets.

(c) MyTrain concession weekly and concession fortnightly tickets are available from Stations and valid from the date of purchase. MyTrain 90 and 365 Day Tickets are valid from the date of purchase.

(d) MyMulti weekly Tickets and MyMulti DayPass are available from Stations and valid from the date of purchase. MyMulti 90 and 365 Day Tickets are valid from the date of purchase.

(e) My Train concession weekly and concession fortnightly tickets and MyMulti weekly Tickets issued after 3pm will be valid for that day plus the applicable period of the type of Ticket when purchased from Stations.

15.5 MyTrain concession weekly and concession fortnightly Tickets

(a) MyTrain concession weekly and concession fortnightly Tickets may be purchased on any day for a period of 7 or 14 days, starting from the date of purchase.

(b) The exception to this is for Tickets purchased after 3.00pm on any day - these Tickets can then be used for eight (8) or fifteen (15) days starting from the date of purchase.

(c) MyTrain concession weekly and concession fortnightly Tickets are available for travel between the Stations shown thereon for which the Fare has been paid. Break of Journey is permitted in either direction at any Station on Journey/route paid for.

(d) If travel is made to a Station beyond the Destination shown on the MyTrain concession weekly or concession fortnightly Ticket, but within the Non-Booked Services Area, the applicable Fare (ie: Concession Fare) for the additional Journey is payable. If travel is made beyond the Non-Booked Services Area, the applicable Fare for the whole Journey is payable.

15.6 MyTrain and MyMulti periodical Tickets

(a) MyTrain (quarterly – 90 days; or yearly – 365 days) and MyMulti (weekly – 7 days; quarterly – 90 days; or yearly – 365 days) Tickets for travel within the Non-Booked Services Area may be issued at such times and for such periods as prescribed in the following clauses.

(b) A MyTrain or MyMulti Ticket does not give the holder the right to travel: (i) by a private or guaranteed train; or

(ii) by non-guaranteed Services run in connection with special events.

(c) However, the holder may be permitted to travel if their charterers or their representatives consent, on the condition that no revenue is credited by Sydney Trains or NSW Trains to the train concerned in respect of the travel by the MyTrain or MyMulti Ticket holder.

(d) Unless specifically provided otherwise, the Journey may be broken at any Station between those named on the MyTrain Ticket or within the relevant MyMulti zone.

(e) The receipt provided at the time of purchasing a MyTrain or MyMulti Ticket is “proof of purchase”. It must be tendered when requesting a refund or replacement for a lost, stolen or misplaced Ticket. Periodical Tickets must be registered online to allow refund or replacement of a lost, stolen or misplaced Ticket.

(f) No allowance will be made if Fares are reduced during the currency of any MyTrain or MyMulti Ticket.

15.7 Authority to Travel Receipt

(a) Sydney Trains or NSW Trains may install Ticket Vending Machines that issue Authority to Travel Receipts (ATTRs) at selected Stations. These are usually Stations where passenger traffic is insufficient to warrant a supply of Tickets covering travel to all or to some Stations.

(b) Subject to the next clause, where a Ticket Vending Machine is provided at a Station a passenger must purchase a Ticket (if available for the Journey to be undertaken) or an ATTR before boarding a train.

(c) Where reasonable facilities are available at a Station for the purchase of a Ticket for the whole of the Fare applicable to the Journey, a passenger boarding at that Station is not entitled to purchase an ATTR.

15.8 Link Tickets

(a) Tickets covering travel by Non-Booked Services on Lines and in addition to travel on other modes of transport and entry to venues not operated by Sydney Trains or NSW Trains, may be issued by Sydney Trains or NSW Trains. To the extent that such Tickets cover travel on services and entry to venues not operated by Sydney Trains or NSW Trains, Sydney Trains and NSW Trains issues the same only as the agent for the operator of the service involved and Sydney Trains’ or NSW Trains’ liability does not extend beyond the portion of the Journey made on its own Services.

(b) Link Tickets include but are not limited to the Blue Mountains ExplorerLink. Conditions and availability of each Link Ticket type will be as published from time to time.

(c) Fares for Link Tickets will be made up of two components: (i) the applicable Fare for the rail Journey to the interchange Station specified for the

Link Ticket type; plus

(ii) the prescribed “add on” amount to cover charges for services not operated by Sydney Trains or NSW Trains including transport and venue entry, as published from time to time.

(d) Unless otherwise provided, Link Tickets will, so far as rail travel is concerned, be subject to the same conditions as Single, Return or Concession (Child) off-peak Tickets (as appropriate for the Ticket held).

15.9 Intermodal Tickets

(a) Tickets covering travel by Non-Booked Services on Lines and in addition to travel on other modes of transport not operated by Sydney Trains or NSW Trains, may be

issued by Sydney Trains or NSW Trains. To the extent that such Tickets cover travel on services not operated by Sydney Trains and NSW Trains, Sydney Trains and NSW Trains issues the same only as the agent for the operator of the service involved and Sydney Trains’ or NSW Trains’ liability does not extend beyond the portion of the Journey made on its own Services.

(b) Intermodal Tickets include but are not limited to: (i) Moore Park;

(ii) Bondi Beach; and

(iii) TramLink.

(c) Conditions and availability of Tickets to each intermodal Tickets will be as published from time to time.

(d) Fares for intermodal Tickets are made up of two components: (i) the applicable Fare for the rail Journey to the interchange Station specified for the

Intermodal Destination; plus (ii) the prescribed “add on” amount to cover charges for services not operated by

Sydney Trains or NSW Trains, as published from time to time.

(e) Unless otherwise provided, intermodal Tickets, so far as rail travel is concerned shall be subject to the same conditions as Single, Return, Concession (Child) off-peak or MyTrain concession weekly Tickets (as appropriate for Ticket held).

15.10 MyBus products

Use of bus services not provided by Sydney Trains or NSW Trains, regardless of whether the Ticket for that service was sold by Sydney Trains or NSW Trains, will be subject to the terms and conditions for use of that service.

15.11 Airport Line Tickets

(a) Airport Link Company (ALC) Stations are International Terminal, Domestic Terminal, Mascot and Green Square.

(b) Sydney Trains or NSW Trains customers holding Tickets that are valid for travel through the ALC Stations must pay a fee to enter or exit Domestic and International Terminal Stations. This fee is known as a Station Access Fee and the price will be set by ALC.

(c) Fares to ALC Stations will be made up of two components:

(i) the applicable Fare for the rail Journey; plus

(ii) a Station Access Fee as prescribed by ALC.

(d) Interchange Stations for ALC destinations are Wolli Creek and/or Central Station.

(e) Unless otherwise provided, Tickets to Airport Link Stations so far as rail travel is concerned shall be subject to the same conditions as MyTrain, MyMulti Tickets and other types of Tickets.

15.12 Sponsored Fare travel

(a) When a customer asks at a Station to pay for another person’s travel within the Non-Booked Services Area from another Station, this travel is known as “sponsored Fare travel”.

(b) The sponsor will pay the distance-based rail Fare plus an administration charge of $10.00.

PART E – BOOKED SERVICES SPECIFIC CONDITIONS The following conditions apply to any Booked Services. These conditions are in addition to, and must be read in conjunction with, the General Conditions of Travel in Part B.

16 TICKETING CONDITIONS FOR BOOKED SERVICES

16.1 Conditions of carriage

(a) A Ticket entitles the passenger to one and only one allocation on a Service. If a passenger requests an additional allocation, a separate Ticket must be issued for the unoccupied allocation.

(b) Customers shall not: (iii) board or leave a Service in circumstances where the passenger is not scheduled

to board or leave it;

(iv) occupy a sleeping berth or seat without a valid Ticket and/or reservation;

(v) lie or sleep in the aisle or overhead luggage racks; or

(vi) leave children or persons in their care unattended, or leave children, luggage or packages unattended at Stations.

(c) Booked Services ordinary Tickets may be purchased up to 325 days before the date of travel.

(d) Tickets are valid for the date, time and Service as printed on it.

(e) Tickets are not transferable.

(f) NSW Trains may use any mode of transport to carry the Ticket holder. Break of Journey is available at any Station where a Booked Service is timed to stop and should be booked in advance.

(g) Eating and drinking (with the exception of water) is not permitted on board a NSW Trains coach. Customers should advise the coach captain if eating or drinking is required due to medical reasons.

16.2 Disembarking a Booked Service

(a) Customers must not leave the train at any intermediate Station while in transit, except where a Break of Journey has been booked in advance.

(b) If customers choose to leave a train while it is stopped at an intermediate Station, NSW Trains will not be liable for any consequences.

16.3 Alcohol

(a) Alcohol can be purchased on board some Booked Services.

(b) Booked Services do not have ‘alcohol free’ carriages.

(c) NSW Trains is committed to the responsible service of alcohol and complies with all relevant NSW and Commonwealth legislation.

(d) Customers must not consume their own alcohol on board any Booked Service.

16.4 Unaccompanied minors

(a) Children under 11 years of age must be accompanied by an Adult when travelling on Booked Services.

(b) Children aged between 11 and 15 may be permitted to travel alone. For further information, see NSW Wales Trains’ Unaccompanied Minors policy at www.nswtrainlink.nsw.gov.au.

16.5 Tickets issued by general Sales Agents

(a) NSW Trains accepts MCO/Service Vouchers issued by General Sales Agents (GSA) and overseas and inbound tour operators within Australia, for point to point travel on Booked Services.

(b) As vouchers will be issued by a number of agents the format will vary.

(c) These vouchers are treated as a normal Ticket.

(d) To be considered valid for travel, MCO/Service Vouchers must contain the following information:

(i) name of the issuing agent;

(ii) MCO/Service Voucher number;

(iii) passenger name(s);

(iv) PNR number;

(v) FTR number(s);

(vi) date(s) of travel;

(vii) Origin/Destination Station(s);

(viii) seat and berth allocation(s); and

(ix) Passenger Type(s), eg: ADT, CHD, STU.

(e) Vouchers that do not contain all the above information will be deemed invalid, and therefore not valid for travel or refund where no record of a reservation can be located in the reservation system.

(f) Refund and Ticket exchange of a voucher procedures for Tickets issued by GSAs are the same as for Tickets issued by NSW Trains for Booked Services.

16.6 Lost and mutilated Tickets

(a) A customer may apply for a substitute Ticket to replace one which has been lost or mutilated beyond legibility under the following conditions and circumstances:

(i) An applicant must apply before the time of departure and provide positive proof of identification, such as a driver’s licence or passport.

(ii) An applicant must be able to provide Ticket details, such as location of purchase, PNR or date of purchase.

(iii) The onus is on the applicant to accurately supply details of the purchase of the Ticket. If NSW Trains cannot verify the sale from those details, the sale of the Ticket will be deemed not to have taken place.

(b) Provided that either NSW Trains or an agent of NSW Trains can verify the sale of the Ticket from the information provided, a substitute Ticket will be issued.

(c) If the Ticket was sold on an account or with a debit or credit card, an applicant for a substitute Ticket must be the customer who paid for the original Ticket. Otherwise the applicant must be the customer to whom the Ticket was issued.

(d) A substitute Ticket will only be issued for Tickets sold by an authorised NSW Trains sales outlet.

(e) An applicant for a substitute Ticket may apply at any authorised NSW Trains sales outlet.

(f) A fee may be charged for all substitute Tickets (except those issued following an online purchase, as detailed elsewhere in this Handbook). Fees payable will be published in the NSW Government Gazette from time to time. The substitute fee is not refundable.

16.7 Customers travelling in first class using an economy class Ticket

The holder of an economy class Ticket who travels first class will be charged the difference between the first class and economy Fares for the distance of the first class travel.

16.8 Sponsored Fare Tickets

A sponsored Fare is a Fare paid by one customer on behalf of another customer who is at different location for travel on Booked Services. The following conditions apply to sponsored Fares:

(a) reservations and ticketing may only be made within three days of date of travel at any NSW Trains accredited sales outlet or through the NSW Trains Call Centre on 13 22 32;

(b) the travel Ticket can be made available at any NSW Trains sales outlet, provided the Ticket is collected at least one hour before travel, subject to hours of business;

(c) the passenger must produce valid identification at time of Ticket collection;

(d) if the Ticket is booked at a Concession Fare, the passenger must present the applicable recognised transport concession card when collecting the Ticket;

(e) re-bookings may only be made upon presentation of the travel Ticket or substitute Ticket once the substitute Ticket has been issued;

(f) sponsored Fare Tickets can only be refunded to the original sponsor using the original method of payment. If paid by credit card and the original credit card details can be verified, a refund can be processed to that card without sighting the original receipt;

(g) if credit card details cannot be verified then a refund can only be processed on presentation of the original receipt;

(h) Tickets issued on behalf of a voucher account must be refunded back to that voucher account. No monies can be refunded; and

(i) normal re-booking or cancellation conditions apply.

16.9 Unbooked travel (Go Show)

(a) If a customer boards a Booked Service without a reservation, the passenger must purchase a Ticket on the Service for the travel involved.

(b) On–Board staff (train) or Coach Captain (coach) will issue a Ticket for the Journey to the next interchange.

(c) Customers will pay the applicable Fare for that sector only.

(d) No guarantee can be given that accommodation is available for connecting or return Services.

(e) Customers wishing to join a connecting or return Service irrespective of Break of Journey (less than 12 hours) or Stopover (more than 12 hours), must then purchase a separate Ticket at the interchange point and pay the applicable sector Fare for that portion of the Journey, provided vacancies exist.

(f) No unbooked Pensioner Travel Voucher Journeys will be accepted.

16.10 One person booking two seats

(a) A customer may book more than one seat on a Booked Service, however the Fare for the additional seat(s) will be the applicable Adult Fare, regardless of whether the customer is entitled to purchase his or her Ticket at a Concession Fare.

16.11 Conditions for sleeping berths

(a) Booked Services night trains between Sydney-Melbourne-Sydney, Sydney-Brisbane and Casino-Sydney, each has nine two bed compartments. Each bed (sleeping berth) is 185cm X 72cm in size.

(b) Customers occupying a sleeping berth are required to pay a first class rail Fare and a sleeping berth charge, as published from time to time.

(c) There is no concession discount on sleeping berth charges.

(d) NSW Trains shall not be liable to provide sleeping accommodation to meet all requirements, and sleeping berths will be allotted in order of priority of booking.

(e) Sleeping berths are to be booked in accordance with reservation conditions.

(f) Customers may book sleeping berths irrespective of Origin/Destination Stations when a twin-berth compartment is allocated to passengers travelling together.

(g) Upon request, an individual customer may reserve both sleeping berths in a compartment irrespective of the Origin/Destination Stations.

(h) Sole use of a compartment is not available when sleeping berths are converted to seating for daytime use.

16.12 Complimentary meal

(a) Customers who have paid the appropriate sleeping berth charge will be given a complimentary breakfast.

(b) On-board staff will contact customers at the start of their Journey regarding their meal requirements.

(c) Any customer not accepting the complimentary breakfast is not entitled to a reduced Fare.

(d) A menu form with a selection of light breakfasts and breakfast times will be provided to the customer.

(e) If a customer is alighting earlier than times shown on the menu, they will be served earlier.

(f) Any customer sharing a berth and requiring a meal must pay for the meal when it is provided. Customers with sole use of a two-berth cabin will only be provided with one meal.

16.13 Sole use of a sleeping compartment

(a) Upon request, an individual customer may reserve both sleeping berths in a compartment irrespective of the Origin/Destination Stations.

(b) The second sleeping berth Fare will be calculated at the full Adult Fare. If a customer holds a discount Ticket for one berth, the additional Fare for the extra berth will be the same discount if available. If a similar discount is not available another Fare may be charged, provided this Fare is not less than the Fare for the occupied berth.

(c) If a customer paying a Concession Fare requests the sole use of a compartment they will be required to pay the same Fare, but not less than the Fare for the first berth. A PTV can be accepted for the extra berth. The applicable PTV rail Fare plus the full berth fee will be charged.

(d) There is no refund on the unoccupied berth Ticket after the Journey has commenced.

16.14 Children and sleeping berths

(a) Two children aged under 10 years may occupy and will be charged for one sleeping berth, provided they have both paid the appropriate child rail Fares for the Journey being undertaken and are travelling with an Adult.

(b) A maximum of one Adult and one child under 10 will be permitted to occupy any one sleeping berth.

(c) An Adult and a child under 10 are not to be booked in a compartment with an additional unrelated passenger.

(d) If an Adult and child under 10 wish to share a berth they must pay the Adult Fare and the Child Fare plus two berth charges for the compartment.

(e) Passengers travelling with Infants cannot be booked in a compartment to share with an unrelated passenger.

17 FARES FOR BOOKED SERVICES

17.1 General

(a) Fares applying to Booked Services are gazetted from time to time, in accordance with the Transport Administration Act 1988.

(b) All Fares charged are those calculated by the CRS, which reflects gazetted Fares.

(c) First class or economy class Fares are based on Charging Units (distance between Stations).

(d) Where an Itinerary is made up of first and economy class Legs, the total through Charging Units and net Fare at the economy rate is to be calculated. The difference between the first and economy class net Fares for the Legs travelled at first class is calculated and then added to the economy class net Fare. GST is then added to give the total.

(e) Where an Itinerary has a Break of Journey at a Station of less than 12 hours the system CRS the through Fare.

(f) Where an Itinerary has a Stopover the CRS will treat this as a Break of Journey and the Fare for each Leg will be calculated separately and added together.

(g) Customers cannot purchase two separate Tickets on the same Service to gain an advantage on a Fare.

17.2 Extended Journey

A customer in transit who travels to a Station beyond the Destination shown on the Ticket shall pay the Fare for a separate Journey to that Station.

17.3 Cancellation

(a) All cancellation and re-booking transactions conducted at a NSW Trains sales outlet, with the exception of Queensland, are subject to the NSW Trains cancellation & re-booking fee policy, irrespective of the Journey being on a NSW Trains Service or Queensland Rail service or on both. The conditions and charges are set out at www.nswtrainlink.nsw.gov.au.

(b) Cancellations and re-booking transactions conducted at an accredited NSW Trains sales outlet in Queensland are subject to the Queensland Rail cancellation & re-booking fee policy, irrespective of the Journey being on a NSW Trains Service or Queensland Rail service or on both. 17.4 Journeys on Non-Booked Services

(a) Tickets for Non-Booked Services can be sold in conjunction with Tickets for Booked Services, regardless of whether they connect with a Booked Service.

(b) The Non-Booked Leg will be displayed on the Booked Service Ticket and will be charged at the normal applicable Fare which would apply at the time for a customer on a Non-Booked Service.

17.5 Tickets for trips between Lithgow and Bathurst

(a) The following conditions apply for passengers wishing to travel from Stations serviced by Non-Booked Services, on train Services and road coach Services to or from Stations in Lithgow, Wallerawang, Mt Lambie, Meadow Flat, Yetholme, Raglan, Kelso and Bathurst or between these Stations:

(i) Reservations and ticketing can only be processed within 14 days prior to date of travel.

(ii) Reservations to be made for Stations between Lithgow and Bathurst.

(iii) No Credit Card bookings.

(iv) Stations may issue Encoded Tickets on day of travel and General Purpose Tickets (GPT) for advance purchases.

(v) NSW Trains Accredited Agents cannot issue MyZone Tickets or GPTs.

(vi) Fares are in accordance with the ordinary Fares for Non-Booked Services.

(vii) Sales outlets may contact NSW Trains Reservations Centre for bookings when their 10-seat allocation between Lithgow and Bathurst is exhausted. Additional seats booked in CRS will be ticketed at the ordinary Non-Booked Service rate.

(b) Forward or Single Journey must commence on the Commencing Date and return Journey must commence on the Expiry Date endorsed on the GPT.

(c) Tickets are refundable only if purchased and cancelled prior to day of travel. Tickets purchased on day of travel are non-refundable.

17.6 Exchange

Ticketing agents may make changes to a passenger’s Itinerary and reissue a Ticket without having to fully refund a Ticket. The following conditions will apply:

(a) Original Ticket value, including non-refundable Legs, will be credited to the cost of the exchanged Ticket.

(b) If the exchanged Ticket collected Fare is greater than the original Ticket collected Fare, the passenger will pay the difference.

(c) If the exchanged Ticket collected Fare, not including non-refundable Legs, is less than the original Ticket value, the difference will be refunded to the passenger.

17.7 Refund

(a) Reservations must be cancelled prior to Service departure.

(b) Refunds must be processed within 325 days from when the Ticket was purchased.

(c) Ticket will expire and is no longer valid for refund or reissue 326 days after the date of purchase.

(d) If a passenger requires a refund, the Ticket can be refunded at any NSW Trains sales outlet regardless of the original purchase location.

(e) A valid Ticket not required by the passenger will be refunded in full, excluding non-refundable Legs.

(f) Partial refund of a Ticket is calculated by deducting the value of the travelled segments from the total Fare. The balance is the amount of the refund.

(g) Tickets originally paid for by warrant or voucher will be refunded in a corresponding form of payment.

(h) Credit Card refunds must be credited back to the same card number used for the sale of the Ticket being presented. If unable to verify Credit Card details used for the sale of the Ticket, authorisation for a refund is to be requested from the Call Centre Supervisor or Travel Centre Manager.

(i) Journeys paid for by Pensioner Travel Voucher and now not required by the passenger must be refunded in the reservation system to re-credit the passenger their PTV entitlement.

(j) Cancellation fees, or any other fees payable by the customer, may be deducted from the value of any refund to which a customer is entitled, before the refund is given.

18 PAYMENT FOR BOOKED SERVICES

Customers can pay for Booked Services using a number of different methods.

18.1 Cash

The exact amount of the Fare, when practicable, should be tendered when purchasing Tickets.

18.2 Cheques

(a) Under some circumstances, NSW Trains may accept cheques for payment.

(b) A company called CERTEGY provides a cheque clearance and guarantee facility for NSW Trains Travel Centres and Booking Offices.

(c) Cheques presented for payment of a Ticket will be immediately processed through the CERTEGY system, with the customer present.

(d) If the cheque is rejected by CERTEGY, customers will be required to pay using a different method.

(e) Cheques must be made payable to NSW Trains.

(f) Customers are required to present photo identification or two forms of other identification when paying by cheque. Acceptable forms of identification include a current driver’s licence, other government issued ID or a credit/debit card.

(g) Cheques may not be accepted at all NSW Trains or Sydney Trains Stations or booking offices. Customers are advised to confirm with NSW Trains that cheques will be accepted at a particular Station or booking office.

(h) Acceptance and authorisation of cheques by accredited sales agents for payment of Fares on Booked Services is the responsibility of the agent. NSW Trains will not be liable for any transaction fees or non-payment of Fares or charges associated with cheque transactions.

18.3 EFTPOS/credit cards

(a) The following cards are accepted for payment by NSW Trains:

(i) American Express

(ii) Diners Club

(iii) MasterCard

(iv) Visa

(v) JCB (Japanese Card Bureau)

(vi) EFTPOS (only at NSW Trains Travel Centres)

(b) Customers wishing to book and pay by credit card over the phone can do so by phoning the NSW Trains Call Centre on 13 22 32.

(c) Bookings where customers wish to have their Ticket mailed to them by post can only be accepted more than seven (7) days prior to date of travel.

(d) MasterCard and Visa are the only credit cards accepted for on board transactions.

(e) Limits for on-board transactions are as follows:

(f) Food & Beverages $100.00

(g) Ticketing $300.00

(h) Acceptance and authorisation of credit cards by sales agents for payment of Fares on Booked Services is the responsibility of the agent. NSW Trains will not be liable for any merchant fees or non-payment of Fares or charges associated with credit card transactions.

18.4 Pay it @ Post

(i) NSW Trains, in conjunction with Australia Post, allows customers to make payment for travel through the Pay it @ Post facility.

(j) The following conditions apply to customers choosing this method of payment:

(i) To allow time for processing all bookings must be greater than two (2) working days prior to travel.

(ii) Normal OPTL restriction will apply and customers must ensure they pay prior to this date to ensure that their booking is not cancelled.

(iii) Total value of booking must be paid at the Post Office. If passengers wish to pay separately then individual booking references must be created.

(iv) Cash and Debit Cards (EFTPOS) will be the only acceptable payment methods at Australia Post Outlets.

(v) Australia Post office hours vary from location to location.

(vi) Australia Post may set minimum payment amounts.

(vii) An e-Ticket will be e-mailed to the customer when payment is received. The customer is required to print the E-Ticket and be in possession of it when travelling.

(viii) Australia Post Sales Outlets do not process refunds.

(ix) Reservations must be cancelled prior to departure.

(x) Customer must take Rail Ticket to a NSW Trains Sales outlet to obtain a refund or mail the Ticket to NSW Trains for processing.

18.5 Delivery of Tickets – online or phone reservations

(a) Tickets ordered by phone or online will be delivered to the customer by email, fax or post, at the customer’s election.

(b) If a Ticket cannot be delivered by email, fax or post, arrangements can be made to have the Ticket available to the customer when they board the Service.

(c) If a Ticket is not received prior to travel, customers are responsible for contacting the NSW Trains Call Centre on 13 22 32 to request a replacement Ticket. No lost/replacement Ticket fee will apply in these circumstances.

(d) If NSW Trains cannot verify the sale of the Ticket, the sale will be deemed not to have taken place.

18.6 Tentative bookings

Customers may make tentative bookings over the phone, which NSW Trains will hold to allow the customer time to pick up and pay for the Ticket. If the Ticket is not collected by the nominated time, the customer’s reservation will be automatically cancelled.

19 CUSTOMERS WITH DISABILITIES ON BOOKED SERVICES

19.1 General

(a) Sydney Trains and NSW Trains are committed to providing access to Services to all passengers, in compliance with the Anti-Discrimination Act (NSW) 1977 and the Disability Discrimination Act (Commonwealth) 1992.

(b) NSW Trains staff can provide limited assistance to people with Disabilities, in line with their training, qualifications and overall service delivery to passengers.

19.2 Physical limits of trains used for Booked Services

(a) The overall width of a wheelchair, collapsible wheelchair, motorised wheelchair or motorised scooter cannot exceed 70cm and the overall length cannot be greater that 130cm and must be able to manoeuvre a 180 degree turn in an area 154cm long by 207cm wide.

(b) The total weight of a Mobility Aid and its user cannot exceed 300kg. The customer and/or any medical equipment attached to the Mobility Aid must be wholly contained within the confines of the nominated dimensions.

(c) There are no tie down/anchor points fitted on XPT or XPLORER carriages to secure Mobility Aids to their allocated spaces. To ensure the Mobility Aid is secure and does not move during the Journey, the brakes on the Mobility Aid must be in working order.

(d) Wheelchairs, collapsible wheelchairs, motorised wheelchairs or motorised scooters must be able to turn 180 degrees within a space of 207cm x 154cm.

19.3 Physical limits of coaches used for Booked Services

(a) The overall width of a wheelchair, collapsible wheelchair, motorised wheelchair or motorised scooter cannot exceed 80cm and the overall length cannot be greater than 130cm.

(b) The total weight of a Mobility Aid and its user cannot exceed 300kg. The customer and/or any medical equipment attached to the Mobility Aid must be wholly contained within the confines of the nominated dimensions.

(c) Mobility aids must be able to be anchored/secured to tie down points fitted on the coach.

(d) Wheelchairs, collapsible wheelchairs, motorised wheelchairs or motorised scooters must be able to turn 180 degrees within a space of 207cm x 154cm.

19.4 Assistance provided by NSW Trains staff on Booked Services

(a) On-board staff are able to provide the following assistance to customers on Booked Services:

(i) Storing and removing luggage from overhead storage racks.

(ii) To-seat service of food and beverages.

(iii) Placing food or beverages in special feeding or drinking appliances provided by the passenger.

(iv) First aid procedures by qualified staff.

(v) Assistance to the door of the toilet.

(vi) Assistance and familiarisation with the train for the vision impaired.

(vii) Written communication for the hearing impaired if required.

(viii) Personal communication of relevant announcements for the hearing and vision impaired.

(b) On-board staff are not able to provide the following assistance to customers on Booked Services:

(i) Transferring from Mobility Aid to seat/berth or vice versa.

(ii) Transferring passengers from Mobility Aid to toilet, and/or assistance with removal/replacement of clothing and/or personal hygiene functions.

(iii) The giving of injections or medication, other than handling relevant medication containers to passengers as instructed.

(iv) The consumption of food and beverages.

(v) Changing or emptying of bladder or bowel appliances.

(c) Customers who require assistance that cannot be provided by on-board NSW Trains staff are not permitted to travel without an Attendant who is able to provide this assistance.

19.5 Access and Egress

(a) On-board train staff are able to provide assistance to passengers with a Disability boarding or disembarking from NSW Trains services.

(b) A boarding ramp is provided for the loading and unloading of Mobility Aids. Total weight to be supported by the boarding ramp cannot exceed 300kg. NSW Trains train services cannot accommodate a Mobility Aid that is in excess of 70cm wide.

19.6 Passengers with Disabilities

(a) Accessible Seats will be charged at the economy rate on all NSW Train Services.

(b) One Attendant may travel at the economy rate on all Booked Services in an Accessible Seat. If all Accessible Seats have been booked, the Attendant will be allocated a seat nearest the customer with a Disability and the applicable first or economy Fare for that seat will be charged.

(c) Additional Attendants may accompany a customer, however the full Adult Fare for the seat booked must be paid for any additional Attendant(s) and the seating arrangements set out in clause 19.6(b) above will not apply for any additional Attendant(s).

(d) For customers who are able to, and wish to, transfer from their collapsible wheelchair to an Accessible Seat, the seat dimensions on the XPT and XPLORER are 44cm (height) x 44.5cm (width). Space is not allocated for a collapsible wheelchair. The wheelchair must be folded and stowed in a storage area adjacent to the Accessible Seats.

(e) Due to restricted aisle access throughout XPT and XPLORER carriages, passengers travelling with a Mobility Aid cannot be accommodated in any other seat other than those specifically allocated for passengers with a Disability.

19.7 Sleeping Carriage (XPT only)

(a) Customers cannot travel in their own Mobility Aid in XPT sleeping carriages.

(b) A Mobility Aid will not fit into the sleeping compartment or the toilet/shower facilities of the XPT sleeper.

(c) NSW Trains can provide special narrow wheelchairs that can be used to access sleeper compartments.

(d) After accessing the sleeper compartment the NSW Trains wheelchair is folded and stowed in the storage space adjacent the Wheelchair Space in car C.

(e) Customer Attendants can assist by delivering meals and drinks to the compartment.

(f) An Attendant must accompany customers in need of assistance that is not provided by on-board staff.

(g) Both the customer and Attendant pay the applicable rail Fare and sleeping berth charge.

19.8 Accessible Seating – Booked Services - Road Coaches

(a) Only Mobility Aids that comply with the Disability Standards for Accessible Public Transport Guidelines can be transported on NSW Trains contracted road coaches.

(b) There are no designated Accessible Seats on road coaches. Where possible, the passengers will be seated nearest to the door.

(c) The economy rate will be charged for travel.

(d) An Attendant may travel at the economy rate on all NSW Trains road coach Services and where possible be seated next to the passenger with a Disability.

(e) Collapsible wheelchairs must be folded and stowed in the luggage bin.

19.9 Passengers travelling in a Mobility aid on a Booked NSW Trains road coach Service

(a) All road coaches contracted by NSW Trains have been fitted with permanent Wheelchair Spaces and are able to accommodate Mobility Aids that comply with the Disability Standards for Accessible Public Transport Guidelines.

(b) Road coaches run by a private operator on which NSW Trains procures a limited amount of seats cannot be guaranteed to be fitted with permanent Wheelchair Spaces or be able to accommodate Mobility Aids.

(c) A Mobility Aid with a width in excess of 80cm cannot be transported on a Booked NSW Trains road coach Service. The customer and/or any medical equipment attached to the Mobility Aid must be wholly contained within the confines of the nominated dimensions.

(d) The economy rate will be charged for customers travelling in their own Mobility Aid.

(e) An Attendant may travel at the economy rate and will be allocated a seat nearest to the customer in the Mobility Aid.

(f) Customers unable to transfer to a seat unassisted must remain in the Mobility Aid for the entire Journey.

19.10 Passengers travelling in or on Mobility Aid on NSW Trains trains

(a) All NSW Trains train Services provide 2 spaces for those customers who need to be seated in their Mobility Aid for their Journey. These spaces are located near the door to the accessible toilets and the buffet.

(b) The economy rate will be charged for customers travelling in their own Mobility Aid on all NSW Trains train Services.

(c) Due to restricted access a Mobility Aid with a width in excess of 70cm cannot be transported on NSW Trains train services. The customer and/or any medical equipment attached to the Mobility Aid must be wholly contained within the confines of the nominated dimensions.

(d) An Attendant may travel at the economy rate on all NSW Trains train Services in an Accessible Seat. If all Accessible Seats have been booked, the Attendant will be allocated a seat nearest to the customer in the Mobility Aid and the applicable economy or first class Fare for that seat will be charged.

19.11 Passengers travelling with a Mobility Aid on NSW Trains train services and able to transfer to a seat

(a) Customers travelling with a Mobility Aid and requesting an additional seat for their Journey must pay the applicable Fare for the Wheelchair Space. The additional seat is free of charge.

(b) If all Accessible Seats have been booked, the customer is to be allocated a seat nearest to the Mobility Aid. If there are no seats available in the car in which the Wheelchair Space is located, then, the customer is to be booked in an economy or first class seat in another car.

(c) If there is any doubt that a Mobility Aid is suitable for access, clarification can be obtained by phoning the NSW Trains Call Centre on 13 22 32.

19.12 Portable Medical Oxygen Cylinders

(a) Customers with breathing difficulties and requiring the assistance of Medical Oxygen Cylinders can carry and use small portable cylinder types B, CS, CH, CL and D on NSW Trains Services.

(b) Trolley cylinders and cylinders in travel packs with restraining straps weighing no more than 13kgs will be accepted. The cylinder must be in an upright position and secured by its straps to the train or coach seat at all times during the Journey. Customers travelling with trolley cylinders must supply a suitable strap (e.g. velcro) to secure the unit.

(c) Customers can travel with more than one cylinder subject to approval from the NSW Trains Reservations Manager. Customers will be advised that their reservation has been requested and that they will be contacted when the booking is confirmed or if approval is not granted.

(d) Customers must ensure that as some Services are subject to delays, they must ensure that they have sufficient oxygen in the tanks to meet their supplementary oxygen needs.

(e) On-board train staff and coach captains cannot assist with carrying the oxygen cylinder on and off the train or coach.

(f) On-board train staff and coach captains will not be in a position to assist passengers with the following:

(i) Turning the oxygen cylinder on or off.

(ii) Adjusting the oxygen cylinder equipment.

(iii) Repair any component of equipment assembly.

(iv) Adjust the oxygen gas flow meter.

(v) Assist the passenger to position the nasal cannula on the face.

(vi) Provide respiratory therapy in case of oxygen failure.

(vii) Clean the equipment.

(viii) Any other operational/medical need not covered by the above.

19.13 Oxygen Concentrators

Oxygen Concentrator batteries cannot be charged on-board train Services as continuous 240V power supply cannot be guaranteed. Customers wishing to travel with an oxygen concentrator must ensure that they have sufficient battery life for the duration of their Journey.

20 PASSENGER LUGGAGE

20.1 Passenger Luggage on Booked Services

(a) Luggage may include:

(i) clothing and toiletries carried for the personal use of the passenger and contained in a suitcase, backpack overnight bag and/or pannier;

(ii) medium sized candy striped bags containing clothing and soft items are accepted but must not exceed 15kg in weight;

(iii) baby strollers, prams, car seats, booster seats, baby capsules, boogie boards and golf clubs (contained in a fully enclosed and secure bags);

(iv) Mobility Aids required by customer e.g. collapsible wheelchairs, walking frames or crutches. With the exception of motorised scooters and wheelchairs, Mobility Aids will be accepted in addition to the maximum luggage allowance;

(v) swags (which may also be carried as unchecked luggage); or

(vi) other similar items.

20.2 Luggage Allowance

(a) Hand luggage

(i) On trains: - The total weight of hand luggage cannot exceed 5kg and the total measurement must not exceed 30cm high 50cm long and 30cm wide. Hand luggage on trains may be stored under the seat, in the luggage racks provided or at the end of each carriage.

(ii) On Road Coaches: The total weight of hand luggage cannot exceed 5kg and must be able to be stored under the seat. Hand luggage that does not fit under the seat must be stored in the luggage compartment beneath the coach.

(b) In addition to one (1) item of hand luggage, passengers may choose to either:

(i) Carry onto the train two (2) items not exceeding 20kg per item in weight with the total measurement not exceeding 60cm high, 70cm long and 50cm wide; OR

(ii) Check in two (2) items not less than 5kg and not exceeding 20kg per item in weight with the total measurement not exceeding 60cm high 70cm long and 50cm wide, into the luggage compartment. Space is limited. These articles must be checked at the luggage room where a portion of the Luggage Check is attached.

(c) Each article counts as one item. For the purposes of clarity the three-item allowance applies to each seat or sleeping berth occupied, so for example an Adult with two Children, occupying three seats is entitled to 9 items of luggage.

(d) On trains, carry-on luggage may be stored in the overhead luggage racks provided or at the end of each carriage.

(e) No luggage can be carried onto NSW Trains coach Services. All luggage, irrespective of size, must be stored in the luggage compartment beneath the coach.

(f) Baby Strollers/Prams/Capsules/Seats and Restraints, Collapsible Wheelchairs, Boogie Boards and Golf Clubs are classed as carry-on luggage. On trains they can be stored behind the seats at the end of each carriage. On coaches they will be stowed in the luggage bin.

20.3 Conditions

(a) Checked Luggage can be accepted with or without a Ticket. In some instances Tickets are made available on-board and the customer will not receive their Ticket until they are seated and already on the Service. Two valid forms of identification (e.g. drivers licence, Pensioner Concession Card, Medicare card etc) must be presented by a customer, and the customer’s booking details must be verified by NSW Trains, before luggage will be accepted without a Ticket.

(b) Customers booked on Booked Services as ‘PAYCON’ (pay on board) cannot check luggage prior to boarding the Service without a Ticket. They are required to carry their luggage on-board and place it in the space provided, subject to the conditions applicable to carry-on luggage.

(c) Customers must have their name and address legibly and distinctly marked on their luggage both inside and out.

(d) Customers must remove old labels and addresses from their luggage.

(e) There is no provision for excess luggage. The luggage allowance for the number of items, size and weight is the maximum to be carried.

(f) Any luggage in excess of three (3) items and items that weight in excess of the weight allowance (20kg) will not be accepted nor are they to be taken on board Booked Services.

(g) All types of medication must be included in hand luggage to make it accessible for the duration of the Journey. Medication is not to be included in checked luggage.

(h) Luggage can only be accepted for checking at attended nominated Stations (see clause 20.4(g) below).

(i) Customer luggage will only be conveyed between Stations printed on a Booked Services Ticket. Customer luggage will be conveyed to and from nominated Stations which appear on a Booked Services Ticket and in conjunction with travel on Booked Services only. Luggage will not be conveyed to or from a Station which does not appear on the Booked Services Ticket.

(j) Customers may only bring their own unchecked luggage onto the Service, and may not exceed the luggage allowance.

(k) Customers are not to check hand luggage. These items are to be carried with them on board the Booked Service and stowed in the overhead racks. On road coaches they are carried on board and stowed under the seat.

(l) On Booked Services, all checked luggage is stowed the luggage section and is not accessible to the passenger while in transit.

(m) Swags will also be classed as unchecked luggage and they must:

(i) not exceed the passenger luggage weight limit, be clean and not soiled; and

(ii) be no more than 1.4 metres in length and must be rolled, tied and not more than 45cm in diameter.

(n) If there is reasonable cause for NSW Trains to believe that restricted or dangerous goods, including the goods listed in clause 20.5(a), are being carried, the customer will be required to open their luggage for inspection.

(o) Customers must make their own arrangements for the carriage of luggage with private coach operators and other rail systems including Queensland Rail, Victorian Railways and Great Southern Railways.

20.4 Checked luggage

(a) Checked customer luggage will be accepted for conveyance, from a NSW Trains stopping Station, on the day of travel as long as it checked at least 30 minutes prior to the departure of the Service. If the Service is timed to depart before 8am, luggage may be lodged between 10am and 3pm on the day prior to the day of travel.

(b) Customer luggage from a nominated location other than a NSW Trains stopping location must be checked between 10am and 3pm on the day prior to departure of the NSW Trains Service.

(c) A luggage check is to be issued for each item tendered by the customer as checked customer luggage.

(d) Checked luggage destined for a NSW Trains Station must be collected on arrival at the Station.

(e) Checked luggage destined for a nominated location other than a NSW Trains stopping Station will be available for collection between 10am and 3pm the day after arrival of the Booked Service at Sydney Central Station. Passengers requesting luggage are to contact the nominated location on arrival to confirm time of collection.

(f) Customers seeking collection of checked luggage are required to surrender a valid luggage check. At staffed Stations checks are to be surrendered to station staff. At unattended stations checks are to be surrendered to on-board staff.

(g) Checked Luggage will be accepted and delivered at the following nominated Stations:

20.5 Restrictions

(a) The following items will not be accepted as checked luggage, nor are they to be taken aboard a Booked Service as carry-on luggage: (i) Any items in excess of the luggage allowance of 3 items in total.

(ii) Any items that are dirty, soiled, not packed properly, of an offensive/objectionable nature or don't comply with the luggage policy.

(iii) Items that cannot be placed in a luggage rack without danger or inconvenience to customers.

(iv) Items that encroach on the space other customers are entitled to occupy.

(v) Items that are insufficiently secured or protected.

(vi) Luggage contained in cardboard, polystyrene or wooden boxes, garbage bags, large candy striped bags (exceeding 20kg per item in weight with the total measurement not exceeding 60cm high 70cm long and 50cm wide) and tea chests.

(vii) Musical Instruments.

(viii) Sailboards.

(ix) Motor vehicle parts.

(x) Animals.

(xi) Household items and appliances.

(xii) Plants and/or plant matter.

(xiii) Perishable items including meat, seafood, fruit and vegetables.

(xiv) Compressed gases – flammable, non-flammable and poisonous.

(xv) Corrosives – acids, alkalis, mercury and wet cell batteries.

(xvi) Explosives – munitions, fireworks and flares.

(xvii) Flammable liquids and solids – lighter fuel, matches, paints, thinners and firelighters.

(xviii) Oxidising materials – bleaching powder and peroxides.

(xix) Poisons – insecticides or weed killers.

(xx) Firearms, spear guns, crossbows and knives.

(xxi) Any damaged luggage receptacle that cannot be secured or has protruding contents.

(b) NSW Trains will not accept unaccompanied luggage, except where convenient to NSW Trains. NSW Trains will not accept liability for loss or damage of such articles.

20.6 Luggage claims

(a) Claims for checked passenger luggage withheld, undelivered, lost or damaged must be lodged in writing within 14 days of delivery, or in the case of non-delivery within 28 days after the date the luggage was tendered for conveyance.

(b) A passenger who is unable to produce a valid luggage check will be required to complete a Declaration that the luggage check has been lost and the luggage claimed is their property, which is to be supported by personal identification.

(c) Passengers claiming luggage will be required to identify the contents of the luggage.

20.7 Luggage liability

(a) NSW Trains’ liability in respect to checked passenger luggage is limited to a maximum of $300.00 in total per customer. It is recommended that customers seek private travel insurance.

(b) NSW Trains is not liable for loss or damage to articles such as cameras, electrical appliances, radios, jewellery, money or alcohol contained in checked luggage.

(c) NSW Trains is not liable in any circumstances for any handbag, suitcase, backpack, suit bag or similar receptacle commonly used for travel purposes that contains the customer’s luggage.

(d) NSW Trains is not liable for luggage until it is checked for dispatch on a Booked Service.

(e) Hand luggage and unchecked luggage is conveyed at owner’s risk. NSW Trains will not accept liability for any item or possession accompanying the customer and placed in racks, other storage areas or elsewhere within the carriage.

(f) These limitations of liability are in addition to the general limitations set out in clause 5.3.

20.8 Luggage unclaimed

(a) Customer luggage checked to an unattended Station must be claimed by the customer immediately on arrival at the Station.

(b) Failure by the customer to collect the luggage will result in the luggage being carried on to the next attended Station.

(c) Luggage not claimed within 7 days at the Destination will be forwarded to the Lost Property Office and dealt with in accordance with the Lost Property Office procedures, available at www.sydneytrains.info or by calling 02 9379 3341.

20.9 Bicycles, surfboards, snowboards and snow skis

(a) Bicycles, surfboards, snowboards and snow skis may be accepted on NSW Trains coach and train Services, but cannot be accepted on mini coach or taxi Services.

(b) Reservations are essential.

(c) A charge will apply for each item per Single Journey, as published from time to time.

(d) Unaccompanied bicycles, surfboards, snowboards and snow skis are not accepted.

(e) NSW Trains will not accept liability for damage to bicycles, surfboards, snowboards or snow skis.

(f) A customer is only entitled to book a maximum of one bicycle, surfboard, snowboard or one set of snow skis with poles per Leg.

(g) Each bicycle, surfboard, snowboard or snow skis must not exceed the luggage weight allowance of 20kg.

(h) Bicycles, surfboards, snowboards or snow skis will not be accepted as checked luggage without a valid travel Ticket displaying a pre-booked space. Passengers must present the Ticket at time of check in.

(i) Surfboards, snowboards or snow skis must be checked in at least 30 minutes prior to the departure of the Service.

(j) Bicycles must be checked in at least one hour prior to the departure of the Service.

(k) Bicycles must be disassembled and placed in a bicycle box or commercially produced protective bag. No part of the bicycle is to protrude outside of the box or bag.

(l) Bicycle boxes and protective bags must not be torn or damaged and be clearly identifiable with the customer’s name and address and Origin and Destination of Journey.

(m) Bicycle boxes are only available from attended NSW Trains stations.

(n) Customers joining a Service at an unattended location are required to provide their own bicycle box.

(o) Only one bicycle per bicycle box or protective cover will be accepted.

(p) Only surfboards, snowboards or set of snow skis with poles in a commercially produced protective bag or cover supplied by the customer will be accepted.

(q) Commercially produced protective bags must be supplied by the customer.

(r) Only one surfboard, snowboard or set of snow skis with poles per protective cover will be accepted.

(s) A surfboard, snowboard or snow skis and poles with a length in excess of 2m (including protective covering) will not be accepted.

20.10 Folding Bicycles

(a) Folding bicycles are not accepted on mini coach or taxi Services.

(b) Folding bicycles in a protective covering, will be accepted in addition to two (2) checked items of luggage per customer and will be carried free of charge.

(c) A folding bicycle larger than 79cm long, 59cm high and 36cm wide will not be accepted.

(d) Unaccompanied folding bicycles will not be accepted.

(e) NSW Trains will not accept liability for damage to folding bicycles.

(f) A folding bicycle not in a protective covering will not be accepted. No part of the bicycle is to protrude outside of the bag.

(g) Folding bicycles not in a carry bag are subject to the conditions applicable to ordinary bicycles.

(h) Protective bags must not be torn or damaged and must be clearly identifiable with the customer’s name and address and Origin and Destination of Journey.

(i) Only one folding bicycle and no other item per protective cover will be accepted.

(j) Folding bicycles must be checked in at least 30 minutes prior to Service departure.

(k) A folding bicycle must not exceed the luggage weight allowance of 20kg.

20.11 Storage

(a) Sydney Luggage Room, Platform 1, Sydney Central Station will store luggage for customers who: (i) are in transit in Sydney between a morning and afternoon Booked Service;

(ii) are travelling on the same day on a Booked Service; or

(iii) are travelling on the Indian Pacific (same day only).

(b) No luggage will be accepted for storage overnight.

(c) For all purposes, items in storage are considered to be checked luggage.

21 BOOKING RESTRICTIONS

22 CONNECTIONS

22.1 Generally

(a) NSW Trains does not guarantee connections where the time between its Services is less than one (1) hour with the exception shown below; however, those connections may be withdrawn during trackwork.

(b) NSW Trains does not guarantee connections with services operated by other carriers including Great Southern Railways, V/Line, Queensland Rail, domestic or international airlines, cruise/shipping companies and/or any other public transport services.

(c) NSW Trains does not take any responsibility for alterations to the timetables of other transport operators.

22.2 Guaranteed Connections

(a) All train to coach, coach to train and coach to coach connections are guaranteed at all times if indicated with a red arrow in the Booked Services timetable books or shown as guaranteed connections in CRS.

(b) Train to train connections are guaranteed at any common stopping Station between two Booked Services that are rail Services provided the connecting time is one hour or greater.

(c) NSW Trains cannot guarantee connections where the time between its Services is less than (1) hour with the exception of the following, where the connecting time is less than one hour:

• Passengers travelling on the Casino – Sydney XPT (CLK 34) and wishing to join the Sydney to Dubbo XPT CLK427 will connect at Strathfield.

• Passengers travelling on the Casino – Sydney XPT (CLK 34) and wishing to join the Sydney to Melbourne XPT (CLK 623) will connect at Strathfield.

• Passengers travelling on the Canberra to Sydney XPLORER (CLK 632) and wishing to join the Sydney to Grafton XPT (CLK 35) will connect at Strathfield.

23 SPECIAL STOPS

(a) From time to time passengers may request to have a train or coach Service stop at a location that is not tabled to set down or pick up.

24 NSWTRAINS WEBSITE

24.1 Online bookings

Some NSW Trains customers are now able to make online bookings at www.nswtrainlink.info. Further information and terms relating to online bookings are available on the NSW Trains website. 25 TRAVEL PASSES FOR BOOKED SERVICES

25.1 General

(a) A number of rail ‘Travel Pass’ products are sold by NSW Trains.

(b) Some products may only available for bona fide overseas visitors to Australia. Customers wishing to book these products must produce sufficient evidence to show that they are bona fide overseas visitors, such as a return airline Ticket with a departure date within 3 months of the date of purchase of the Ticket.

(c) East Coast Discovery Passes are available to both Australian residents and overseas visitors. Customers are required to show some form of photo ID to verify their identity.

(d) Customers purchasing a rail ‘Travel Pass’ product are issued with a paper pass or confirmation email, which must be exchanged for a Ticket prior to travel.

(e) These passes or emails can be issued/exchanged at selected locations including Sydney, Strathfield, Parramatta, Broadmeadow, Canberra, Bathurst, Armidale, Taree, Coffs Harbour, Grafton, Byron Bay, Wagga Wagga, Albury, QR Travel Centres at Roma St and Central Station Brisbane and GSR Melbourne.

25.2 East Coast Discovery Pass

(a) East Coast Discovery Passes are available for purchase by Australian residents and overseas visitors to Australia.

(b) Limit of one pass per customer.

(c) Pass entitles holder to one Journey with unlimited Stopovers on a Booked Service and/or Queensland TravelTrain services on the main line, Melbourne-Sydney-Brisbane-Cairns and on services east of the main line. This Journey must travel in a northerly or southerly direction, between the Origin and Destination printed on the pass.

(d) Back tracking to travel on a previously untraveled or travelled sector is not permitted except:

(i) Port Macquarie to Wauchope;

(ii) Hawks Nest to Pacific Highway turn-off;

(iii) Yamba to Pacific Highway turn-off;

(iv) Iluka to Pacific Highway turn-off;

(v) Stations between Surfers Paradise and Casino on the southbound Journey;

(h) Unused passes will expire 6 months from the date of purchase and must be submitted for refund to the office of issue prior to their date of expiry.

(i) Travel on Non-Booked Services within the Sydney and Newcastle outer metropolitan area is only allowed for day of travel connections to a connecting Booked Service.

(j) Passes are available for use on Queensland Trainlink connections to and from Hervey Bay, Yeppoon and Airlie Beach/Shute Harbour.

(k) Passes are available on Queensland Citytrain services (excluding bus connections) for day of travel connections to a Traveltrain service.

(l) Passes are not available for travel on Melbourne Met services.

(m) Passes are for economy class travel.

(n) Passes may be upgraded to any other class of travel on payment of the additional Fare.

(o) Adult Fares only. No Concession Fares or discount Fares.

(p) Passes are not transferable.

(q) No refund is allowed after the pass has been validated or Journeys commenced.

(r) No refund or replacement of a lost, stolen, destroyed invalid or expired pass.

(s) Any reservation not cancelled before departure of a booked sector will render that sector invalid for future travel.

(t) Normal luggage allowances apply.

(u) A reservation is essential prior to the use of the pass and entitles the passenger to only one allocation on any Service.

(v) Not available on GSR services.

25.3 Backtracker Rail Pass and Rail Travel Pass Confirmation

(a) Backtracker Rail Pass is available for purchase by bona fide overseas visitors to Australia. See clause 25.1(b) for the requirements for booking a BackTracker Rail Pass.

(h) Legs on Non-Booked Services that are not a guaranteed connection are not included in the price of the pass.

(j) Only one pass per customer.

1 CALCULATING FARES AND DISTANCES ON NON-BOOKED SERVICES

1.1 General

(a) Distances for Fares from one Station to another will be calculated using the total distance of the shortest route of travel.

(b) When the Fare is calculated between two Stations on two different lines via Redfern, travel may be made to Central for the purpose of changing trains only. (No Break of Journey allowed). For more information, see City Railway Section at 1.4 of this Annexure A.

1.2 Approved routes of travel

(c) Exceptions (i) In cases of announced major disruption to Services, passengers may be

permitted to travel to a Station on another route which serves the same district as that of the original starting point without additional cost, whilst in possession of the original Ticket purchased.

(ii) Where two or more routes of travel exist and rail Services are replaced by buses on one of the routes, through causes either attributed or not attributed to Sydney Trains or NSW Trains, passengers may be permitted to, if they so desire, travel by rail by the Alternative Route to the Destination Station without additional cost.

1.4 City Railway, Eastern Suburbs Line and Sydney Harbour Bridge

(a) The City Railway comprises Central, Town Hall, Wynyard, Circular Quay, Martin Place, Kings Cross, St. James and Museum Stations. Special alternative travel conditions applicable to Tickets purchased at City Railway Stations as detailed elsewhere in this Handbook.

(b) The Eastern Suburbs Line comprises Edgecliff and Bondi Junction Stations.

(c) Tickets to the following destinations will be printed "City":

(i) from Central to any of the following: Town Hall, Wynyard, Circular Quay, Martin Place, Kings Cross, Museum and St. James;

(ii) from Wynyard to any of the following: Town Hall, Central, Martin Place, Kings Cross, Museum, St. James and Circular Quay; and

(iii) from Kings Cross to any of the following: Martin Place, Town Hall, Central, Museum, St. James, Circular Quay and Wynyard.

(d) Except where special Fares are prescribed, the Distance Fare between any City Railway Station will be for the distance of 3.21km.

(e) Except where special Fares are prescribed, the Distance Fare between any Station outside the City Railway to any City Railway Station, will be the distance to the designated Gateway Location plus 3.21km.

1 CALCULATING FARES FOR BOOKED SERVICES

1.1 General

(a) Ordinary Fares for Booked Services are as published from time to time. This section should be read in conjunction published Fare information.

(b) Free and concessional travel is also available for eligible beneficiaries on Booked Services. Information about free and concessional travel is available from the Transport for NSW website at www.transport.nsw.gov.au.

(c) The specific Fare charged for any given trip is calculated based the number of distance units for a particular trip in a particular class of travel, less any applicable seasonal, promotional, concessional or other discounts.

(d) Surcharges may also be applied for additional Services, as detailed elsewhere in this Handbook. The value of surcharges is as published from time to time.
