TRANSCRIPTS OF CRIMINAL CASES IN NEW YORK CITY Shorthand minutes are taken during the course of trial proceedings by a court stenographer. In the past this was done by hand in stenographic notebooks, but at the present time minutes are ususally created through the use of stenotype machines. Transcripts of the minutes are made for the use of the court or the attorneys involved in the case only under certain circumstances. At trials of class A and class B felonies, the judge may order the stenographer to transcribe proceedings daily as the trial is progressing. Stenographers a1 ternate in the court room and spend the time out of court typing the transcrlpts. This is called " daily copy." Court reporters are not required to transcribe their minutes i f not requested to do so by the judge or by the defense attorney. When a criminal case is decided in a defendant's favor, no appeal w i l l be made. No need exists in such cases for a transcript of the trial proceedings. In cases in which daily copy was produced, the reporter may destroy the copy if he wishes, or he may retain it in his files. When the defendant is found guilty, hls case may be appealed. In that case, the judge will usually order a transcript of the trial to be made for use in the appeals hearing. The defense attorney may purchase a copy of the transcript, and the prosecuting attorney will also receive one. TRANSCRIPTS OF CRIMINAL CASES IN NEW YORK CITY

several years behind. Access t o the minutes i s by court reporter's name. A

complete record of which reporters cover what t r ia ls is kept by the court

reporters' off ice in the Criminal Court. I f the record of a particular trial i s

needed, the reporter of record i s determined, and a request fo r the minutes he

took on the dates o f the t r i a l i s sent t o the microf i lm unit. The microf i lm i s then

made available t o the stenographer t o transcribe in the event of a reopening of a

trial, or a future appeal. Should the original reporter no longer be available t o do

the transcript, another w i l l be hired for the job. Again, the reporter w i l l be paid

for producing the transcript.

Cases from the New York City Criminal Court (lesser offenses) and cases

from the Supreme Court, Criminal Branch (felonies) are usually f i r s t appealed t o

the Appellate Division o f the Supreme Court. When a case goes t o the appeals

court, a l l of the paperwork connected w i th the case i s compiled by the Appeals

Bureau. Transcripts of size, usually over 100 pages, are treated as separate

documents and are given numbers by the Appeals Bureau. This number,

colloquially known as the "stenographic o r steno number," i s stamped or wr i t ten

on the cover of the transcript. A t present, as a money-saving effort, the daily

copy, i f available, i s used by the court as the copy of record. The transcript

remains w i th the court documents throughout the appeals process; a t the

conclusion, the transcript i s sent directly t o the Criminal Court Library, where it

is kept, arranged by steno number. Transcripts of fewer than 100 pages are not

treated as separate documents. They are f i led with other t r i a l records by the

Appeals Bureau. Most transcripts are more than 100 pages long.

I t i s not clear when the system o f numbering t r i a l transcripts in the

Appeals Bureau began; nor i s i t certain when they began t o be stored in the

Criminal Court Library. The Appellate Division of the Supreme Court was created

by a court reform ac t in 1894 and began i t s work in 1896. However, cases from

the Court of General Sessions were appealed t o similar appeals bodies prior t o

that time. There i s an almost complete series o f transcripts in existence w i t h

steno numbers start ing at 1 and continuing to the present day (approximately

*10900). In fact, record books l is t ing these transcripts are kept in the Appeals

Bureau. The f i r s t book contains an alphabetical l is t ing of defendants w i t h

accompanying steno numbers through the year 1929 (approximately steno number

4800). From an examination of the transcripts, i t i s clear that the numbers do

not form a s t r ic t chronological sequence: " 1 i s a t r i a l in 1908, while numbers in

the 2000's are t r ia ls that took place in the 1880's and 1890's. However, there i s

a single complete numerical sequence, and after the beginning o f the 20003, the

numbers do become more or less chronological. I t i s a reasonable speculation

that the system o f assigning steno numbers began in 1908 (perhaps that i s when

the record book was started) and that numbers were retrospectively assigned t o

court reporters' works as they were entered into the record book. Once the

backlog had been numbered, the numbering system seems to ref lect a

chronological l is t ing o f cases sent t o the Appellate Division.

In 1972, the transcripts wi th steno numbers from 1-3666 were offered t o

the John Jay College Library. The reasons for this are not clear, although i t i s

probable that crowded conditions in the Appeals Bureau o r the Criminal Court

Library necessitated the removal of some records. A request was made o f John

Jay t o produce a catalog of what had been received, but lack o f s taf f and money

made this impossible at the time. Exactly what th is collection contained was

not understood when i t was sent to John Jay. Over the years, personnel changes

both i n the Criminal Court and at John Jay lead t o confusion over what was in

the John Jay collection. However, i t was obvious that i t had historical

significance and that the collection was in a deteriorating condition. As a

result, John Jay applied for and received a grant from the National Endowment

for the Humanities t o microf i lm the collection. This was carried out in 1983-4.

An index t o this set of transcripts i s now in preparation which w i l l include

access t o these transcripts by type o f offense, defendant's name and other

factors. Unfortunately, because the significance of the steno numbers was not

understood a t the t ime of microfilming, the cases were renumbered to put them

in chronological order by the date of the t r ia l . The steno numbers were retained

and l isted as "old numbers."

In 1975, as part o f a reorganization of the records keeping of the City o f

New York, a large number of the transcripts in the Criminal Court Library were

moved t o storage. These were packed in boxes, and sent t o the Municipal Records

Center. The Records Center inventory shows a gap in the steno numbers which

are i n storage. Again, personnel changes were responsible for the fact that no

one realized a t that t ime that the f i r s t 3666 numbered transcripts had been sent

t o John Jay. There i s now an established procedure by which transcripts are

tranferred t o the Records Center for storage when the Criminal Court Library

becomes too crowded.

At present, items w i t h steno numbers from 3667 t o 8000 are stored by

the Municipal Records Office, while the more recent transcripts are housed in

the Criminal Court Library. A card index, arranged by defendant's name, for a l l

transcripts i s available in the Criminal Court Library. Anyone wishing t o use an

item in storage must apply a t the Criminal Court Library. The transcripts w i l l

usually be sent t o the Criminal Court Library from the Records Office within a

week's time. A copy of the microf i lm and the John Jay index w i l l also be made

available t o the Criminal Court Library, so that anyone doing research into

transcripts there w i l l have access t o the complete set

Following are a number of l i s t s which add information t o the John Jay Index.

They were created through a study of both the index f i l e of the New York City

Criminal Court, and the f i r s t record book from the Appeals Bureau which covers

cases sent on appeal from the beginning of the sequence o f stenographic numbers

through the year 1929.

The f i r s t l i s t f i l l s in stenographic numbers for cases in the John Jay

collection for which an "old number" had not been found on the transcript. The

f i r s t l i s t is arranged by John Jay number. The second list i s a rearrangement of

the f i r s t l i s t by defendant name.

The third l i s t consists o f stenographic numbers for transcripts which appear

to be missing from the collection a t John Jay. The names were found through a

search of the Appeals Bureau record book by matching names t o numbers which

were missing in the "old number" f i l e of the John Jay index. In many cases the

John Jay collection has transcripts of t r ia ls for these defendants which may form

only part of the record, or are combined transcripts from which the numbers may

have been missing. In cases where the recod book indicates more than one number

for a particular defendant, these are included. I f the John Jay collection contains

transcripts for the particular defendant although the number in question i s

missing, the related numbers are indicated. These are always steno numbers o r

"old numbers" as they are called in the John Jay index. No attempt has been made

t o l i s t the corresponding John Jay numbers which can be found by looking in the

John Jay Index. In many cases due t o i l legib i l i ty and spelling peculiarities in the

transcription of ora l testimony, errors were made which result in numbers being

assigned twice, or t o the wrong people. The notes indicate such errors when

After a diligent search, I have determlned that some numbers are completely

missing. There is no record of them in the record book and one can only conclude

that they were lost pr ior t o entry into the record book or that for some reason

those numbers were erroneously omitted when numbers were being assigned to

the transcripts.

Finally, there are some miscellaneous problems and errors which seemed

important enough t o mention. This does not exhaust the many problems which

were found during my search through the record book and card f i le . Nor does i t

include the many names of defendants not l isted in the John Jay Index, but who

nevertheless appear as co-defendants in the record book. There were likewise,

co-defendants l isted in the John Jay Index who were not included in the record

book. Anyone using the collection should at least be aware that these problems

exist, and should therefore proceed w i t h caution in any analysis of the cases,

s tat is t ica l or otherwise. -9
