A s a victim in a criminal case, you are entitled to the following rights under Article 1, §28(b) of the California Constitution. (b) In order to preserve and protect a victim’s rights to justice and due process, a victim shall be entitled to the following rights: (1) To be treated with fairness and respect for his or her privacy and dignity, and to be free from intimidation, harassment, and abuse, throughout the criminal or juvenile justice process. (2) To be reasonably protected from the defendant and persons acting on behalf of the defendant. (3) To have the safety of the victim and the victim’s family considered in fixing the amount of bail and release conditions for the defendant. (4) To prevent the disclosure of confidential information or records to the defendant, the defendant’s attorney, or any other person acting on behalf of the defendant, which could be used to locate or harass the victim or the victim’s family or which disclose confidential communications made in the course of medical or counseling treatment, or which are otherwise privileged or confidential by law. (5) To refuse an interview, deposition, or discovery request by the defendant, the defendant’s attorney, or any other person acting on behalf of the defendant, and to set reasonable conditions on the conduct of any such interview to which the victim consents. (6) To reasonable notice of and to reasonably confer with the prosecuting agency, upon request, regarding, the arrest of the defendant if known by the prosecutor, the charges filed, the determination whether to extradite the defendant, and, upon request, to be notified of and informed before any pretrial disposition of the case. (7) To reasonable notice of all public proceedings, including delinquency proceedings, upon request, at which the defendant and the prosecutor are entitled to be present and of all parole or other post-conviction release proceedings, and to be present at all such proceedings. (8) To be heard, upon request, at any proceeding, including any delinquency proceeding, involving a post-arrest release decision, plea, sentencing, post- conviction release decision, or any proceeding in which a right of the victim is at issue. (9) To a speedy trial and a prompt and final conclusion of the case and any related post-judgment proceedings. (10) To provide information to a probation department official conducting a pre-sentence investigation concerning the impact of the offense on the victim and the victim’s family and any sentencing recommendations before the sentencing of the defendant. (11) To receive, upon request, the pre-sentence report when available to the defendant, except for those portions made confidential by law. (12) To be informed, upon request, of the conviction, sentence, place and time of incarceration, or other disposition of the defendant, the scheduled release date of the defendant, and the release of or the escape by the defendant from custody. (13) To restitution. (14) To the prompt return of property when no longer needed as evidence. (15) To be informed of all parole procedures, to participate in the parole process, to provide information to the parole authority to be considered before the parole of the offender, and to be notified, upon request, of the parole or other release of the offender. (16) To have the safety of the victim, the victim’s family, and the general public considered before any parole or other post-judgment release decision is made. (17) To be informed of the rights enumerated in paragraphs (1) through (16).     Ipinaaalam na ang ibang mga kasong kriminal ay maaaring malutas agad-agad sa unang punta pa lamang sa korte.

    Bilang isang biktima sa isang kasong kriminal, ikaw ay may karapatan sa mga sumusunod na karapatan sa ilalim ng Artikulo 1, §28(b) sa Saligang Batas ng California.

    (b) Upang mapanatili at mapangalagaan ang mga karapatan ng biktima sa hustisya at tamang proseso, ang biktima ay karapat-dapat sa mga sumusunod na karapatan:

    (1) Matrato nang makatarungan at may paggalang sa kanyang privacy at dignidad, at malaya mula sa pananakot, panggigipit, at pang-aabuso, sa kabuuan ng proseso ng hustisyang pang-kriminal o pambata. (2) Mabigyan ng makatwirang proteksyon mula sa nasasakdal at sa mga taong kumikilos sa ngalan ng nasasakdal. (3) Maisaalang-alang ang kaligtasan ng biktima at pamilya ng biktima sa pagsasaayos ng halaga ng piyansa at mga kondisyon ng paglaya para sa nasasakdal. (4) Maiwasan ang pagsisiwalat ng kumpidensyal na impormasyon o mga record ng nasasakdal, abogado ng nasasakdal, o iba pang mga taong kumikilos sa ngalan ng nasasakdal, na maaaring gamitin upang hanapin o guluhin ang biktima o pamilya ng biktima o siyang nagbubunyag ng kumpidensyal na komunikasyon na ginawa sa kabuuan ng gamutang medikal o pagpapayo, o kung hindi man ay binigyang pribilehiyo o ginawang kumpidensyal ng batas. (5) Tumanggi sa kahilingan para sa panayam, pahayag, o pagkatuklas ng nasasakdal, abogado ng nasasakdal, o iba pang mga taong kumikilos sa ngalan ng nasasakdal, at magtakda ng mga makatarungang kondisyon sa takbo ng panayam na papahintulutan ng biktima. (6) Mabigyan ng makatarungang abiso at makatwirang pagsangguni kasama ang ahensyang piskal, kapag hiningi, ukol sa, pag-aresto ng nasasakdal kung alam ng piskal, ang mga naisampang kaso, ang pagpapasiya kung pababalikin ang nasasakdal (extradition), at, kapag hiningi, maabisuhan o masabihan ng anumang disposisyon ng kaso bago ang paglilitis. (7) Mabigyan ng makatarungang abiso ng lahat ng pampublikong paglilitis, kasama ang mga paglilitis sa pagkakasala, kapag hiningi, kung saan ang nasasakdal at ang piskal ay may karapatang dumalo at ang lahat ng paglayang

    may kondisyon (parole) o iba pang paglilitis sa paghatol ng paglaya matapos mabilanggo, at dumalo sa lahat ng ganitong paglilitis. (8) Mapakinggan, kapag hiningi, sa kahit anong paglilitis, kasama ang kahit anong paglilitis sa pagkakasala, na kinasasangkutan ng desisyon sa paglaya matapos hulihin, pakiusap, pagsentensiya, desisyon sa paghatol ng paglaya, or kahit anong paglilitis na kung saan ang karapatan ng biktima ay nasasangkot. (9) Mabigyan ng mabilis na paglilitis at isang maagap at huling pagpapasiya ng kaso at kahit anong may kaugnayan sa paglilitis matapos mabigay ang hatol. (10) Mabigyan ng impormasyon ang opisyal ng kagawaran ng probasyon na nagsasagawa ng pagsisiyasat bago ang sentensiya ukol sa epekto ng pagkakasala sa biktima at sa pamilya ng biktima at kahit anong mungkahi sa sentensiya bago ang pag-sentensiya ng nasasakdal. (11) Makatanggap, kapag hiningi, ng ulat bago ang sentensiya kapag mayroon na ang nasasakdal, maliban sa mga bahaging ginawang kumpidensyal ayon sa batas. (12) Mabigyang impormasyon, kapag hiningi, ukol sa paghatol, pag-sentensiya, lugar at oras ng pagkakakulong, o iba pang disposisyon ng nasasakdal, ang nakatakdang petsa ng paglaya ng nasasakdal, at ang paglaya o pagtakas ng nasasakdal mula sa kustodiya. (13) Mabigyan ng bayad-pinsala. (14) Maisauli agad ang ari-arian kapag ang mga ito ay hindi na kinakailangan bilang ebidensya. (15) Mabigyang impormasyon sa lahat ng alituntunin ukol sa mga paglayang may kondisyon (parole), paglahok sa mga proseso sa mga paglayang may kondisyon, magbigay ng impormasyon sa mga may kapangyarihan na isasaalang-alang bago ang parole ng nagkasala, at maabisuhan, kapag hiningi, ukol sa paglayang may kondisyon or iba pang pagpapalaya sa nagkasala. (16) Maisaalang-alang ang kaligtasan ng biktima, pamilya ng biktima, at ng publiko bago maglabas ng desisyon ukol sa paglayang may kondisyon (parole) o kahit anong paghatol tungkol sa pagpapalayo matapos mabilanggo. (17) Mabigyang impormasyon ukol sa mga karapatang binanggit mula sa talata (1) hanggang (16)
