Circumstances of the Accident

On June 16, 2010, the victim reported to work on the second shift and was

assigned the duties of section foreman.

The crew was in the process of extracting coal from a barrier block on the left side

of the section when an unstable coal rib on the roadway was detected. The victim was

instructing the crew on the removal of the unstable rib when a section of the rib from the coal

pillar behind them fell. The fallen rib material dislodged a metal roof jack which struck the

victim causing fatal injuries.

The mining section was located approximately 14,000 feet from the mine entrance.

The height at the accident scene was 15 feet with a 3 feet rock parting present between the

two coal seams being mined.
