The summons dated November 26, 2012 for the Sixth Session of theThirteenth Kerala Legislative Assembly was issued to the Members onNovember 27, 2012. The session commenced at 8.30 a.m. on Monday,December 10, 2012 and adjourned sine-die at 12.30 p.m. on Friday,December 21, 2012. The House met on the following days viz., December 10, 11,12, 13, 14, 17, 18, 19, 20, 21 (10 days of sittings). The House transacted businessfor 66 hours and 3 minutes.
Obituary Reference
On December 10, 2012, the Speaker made references on the demiseof I. K. Gujral, former Prime Minister. Shri Oommen Chandy, Chief Minister,Shri V. S. Achuthanandan, Leader of Opposition and Leaders of various partiesassociated themselves with the sentiments expressed by the Chair. As a mark ofrespect to the deceased, the members stood in silence for a while. The Houseadjourned for the day without transacting other Business.
On December 11, 2012, the Speaker made references on the demise ofSukhdev Singh Kang, former Governor of Kerala, K. Pankajakshan,N. Ramakrishnan, former Ministers P. Govinda Pillai, R. Prakasam,A. Ali Hassan, P. V. Varghese Vaidyar, K. G. Neelakantan Namboothirippad,K. P. Raghava Pothuval, former Members of Kerala Legislative AssemblyK. S. Correction of answer to Unstarred Question
On 17th December 2012 Minister for Home and Vigilance laid on the tablethe corrected answer to starred question No. 172 C dated 18-6-2012.
Adjournment Motion
During the Session 8 notices of Adjournment Motion were received. Out ofwhich one was taken up for discussion, the details of which is given below. Theremaining 7 notices were not admitted during the session.
On December 12, 2012, the Speaker informed the House thatShri C. Divakaran and four other members had given notice for moving of anadjournment motion regarding the serious situation that has arisen consequent onthe reported hike in price of rice and disposal of thousands of tonnes of rice inFood Corporation of India godowns and public distribution system coming tostand still in the State. As the Chief Minister expressed the readiness of theGovernment to discuss the matter, the Speaker informed that the motion be takenup for discussion at 12.30 p.m. and two hours time be allotted for the same.Shri C. Divakaran moved the adjournment motion at the allotted time and adiscussion was held. Shri Anoop Jacob, Minister for Food, Civil Supplies,Consumer Protection and Registration replied to the points raised in thediscussion. Then the motion was put to vote and declared lost.

Announcement by the Speaker

The Registration (Kerala Amendment) Bill, 2009, Passed by the KeralaLegislative Assembly on 31st March, 2010, returned to the House by theGovernor with his message dated 11th August, 2012 as directed by the Presidentfor Consideration under Article 201 of the Constitution of India, was reconsideredand passed again by the Assembly on the 13th December, 2012.

SALIENT FEATURES OF THE BILLS
THE KERALA PROHIBITION OF CHARGING EXORBITANTINTEREST BILL, 2012
The Kerala Money-Lenders Act, 1958 (35 of 1958) is in force to providefor the regulation and control of the business of money-lending in the State. Asper the provisions in the said Act, money-lending license is granted on conditionthat interest on the loans granted by the money-lenders shall not be in excess oftwo per cent of the maximum rate of interest charged by the commercial bankson the loans granted by them and that the interest on deposits shall be given onlyin accordance with the provisions of the Reserve Bank of India Act, 1934(Central Act 2 of 1934) at such rates of interest being fixed by the Reserve Bankof India. A company incorporated under the Companies Act, 1956 (Central Act1 of 1956) is not required to obtain a license under the Kerala Money-LendersAct, 1958 (35 of 1958).
2. Carrying on the business of money-lending without license and violationof the conditions of license is an offence punishable under the Kerala Money-Lenders Act, 1958 (35 of 1958). But, there is no effective mechanism to controlcharging of exorbitant interest in the business by the money-lenders in Kerala.Therefore, in order to release the general public from the difficulties beingexperienced by them by falling prey to any person charging exorbitant interest inthe names like daily vatti, hourly vatti, kandhu vatti, meter vatti, thandal, theGovernment consider it necessary to enact a new legislation, in the publicinterest, to prohibit lending money for exorbitant interest and to provide forawarding stringent punishment to those who charge exorbitant interest in thebusiness of money-lending.
3. As the Legislative Assembly of the State was not in session and theabove proposals had to be given effect to immediately, the Governor of Keralapromulgated the Kerala Prohibition of Charging Exorbitant Interest Ordinance,2012 on the 26th day of August, 2012 and the same was published as OrdinanceNo. 53 of 2012 in the Kerala Gazette Extraordinary No. 1777 dated 27th August,2012.
4. The Bill seeks to replace Ordinance No. 53 of 2012 by an Act of theState Legislature.

THE KERALA MUNICIPALITY (AMENDMENT) BILL, 2012
Sub-section (1) of Section 143A of the Kerala Municipality Act, 1994(20 of 1994) provides that a councillor shall, within three months from the dateof assuming his office, submit a statement of assets and liabilities of himself andother members of his family, in the prescribed form, to the competent authorityauthorised by the Government by notification in this behalf. But, the fact hascome to the notice of the Government that as this time limit is very short, manyof the Councillors in the State could not submit their statement of assets withinthis time limit. As it is the first election held after enhancing the reservation ofwomen to fifty per cent and the members including the women members wereengaged in the developmental activities of their wards, they could not, within thesaid short period of time, submit the statement of assets. Therefore, in order toavoid the elected members who could not submit the statement of assets withinthe fixed time limit from being disqualified, the Government have decided toamend the said Act with retrospective effect by extending the time limit of withinthree months in the said section to fifteen months.
2. The Government consider that along with the steps being taken for theeffective management and disposal of various kinds of waste being increased inthe State day by day, suitable legislation is also required for the same. Therefore,the Government have decided to incorporate provisions in the said Act forsegregating the waste into biodegradable and non-biodegradable wastes at thesource itself and to make the arrangements for waste disposal compulsory intrade centres, hospitals, markets, slaughter houses, chicken stalls, marriage hal1s,houses having more than three storeys, to impose fine to, those who do not havesuch arrangements, to fix the minimum price of plastic covers and carry bagswith the intention to reduce the use of plastic covers and carry bags, to levyadditional fee for their sale, to constitute a special fund for the disposal of waste,by crediting the additional fee and the fine from the cases, being realised in thisconnection to Local Self Government Institutions. Besides, the Governmentconsider that in order to make the processing and disposal of waste moreeffective, the punishment for those who deposit waste in public places and thosewho do not segregate the waste at source shall be enhanced.
3. Though the Kerala Municipality (Amendment) Bill, 2011 for amendingSection 143A of the said Act was published as Bill No. 56 of the ThirteenthKera1a Legislative Assembly, the same could not be introduced in, and passedby, the Legislative Assembly.
4. As the Legislative Assembly of the State of Kerala was not in sessionand the above proposals had to be given effect to immediately, the KeralaMunicipality (Second Amendment) Ordinance, 2011 was promulgated by the

Governor of Kerala on the 23rd day of November, 2011 and the same waspublished as Ordinance No. 52 of 2011 in the Kerala Gazette ExtraordinaryNo. 2220 dated 25th November, 201l.
5. A Bill to replace the said Ordinance by an Act of the State Legislaturecould not be introduced in, and passed by, the Legislative Assembly of the Stateof Kerala during its session which commenced on the 9th day of December, 2011and ended on the same day.
6. In order to keep alive the provisions of the said Ordinance, the KeralaMunicipality (Amendment) Ordinance, 2012 was promulgated by the Governor ofKerala on the 18th day of January, 2012 and the same was published asOrdinance No. 10 of 2012 in the Kerala Gazette Extraordinary No. 147 dated20th January, 2012.
7. A Bill to replace the said Ordinance by an Act of the State Legislaturecould not be introduced in, and passed by, the Legislative Assembly of the Stateof Kerala during its session which commenced on the 1st day of March, 2012and ended on the 23rd day of March, 2012.
8. In order to keep alive the provisions of the said Ordinance, the KeralaMunicipality (Amendment) Ordinance, 2012 was promulgated by the Governor ofKerala on the 11th day of April, 2012 and the same was published as OrdinanceNo. 33 of 2012 in the Kerala Gazette Extraordinary No. 735 dated 11th April,2012.
9. A Bill to replace the said Ordinance by an Act of the State Legislaturecould not be introduced in, and passed by, the Legislative Assembly of the Stateof Kerala during its session which commenced on the 11th day of June, 2012and ended on the 25th day of July, 2012.
10. As per the provisions of sub-clause (a) of clause (2) of article 213 ofthe Constitution of India, an Ordinance promulgated shall cease to operate at theexpiration of six weeks from the re-assembly of the Legislature. Accordingly thesaid Ordinance ceased to operate on the 23rd day of July, 2012.
11. As the Legislative Assembly was not in session and in order to keepalive the provisions of the said Ordinance again and to validate and perpetuateanything done or deemed to have been done or any action taken or deemed tohave been taken under the principal Act, as amended by the Kerala Municipalities(Amendment) Ordinance, 2012 (33 of 2012) and anything done or any actiontaken after the cesser of operation of the said Ordinance, the KeralaMunicipalities (Amendment) Ordinance, 2012 was promulgated by the Governorof Kerala on the 11th day of August, 2012 and the same was published as

THE KERALA DOCUMENT WRITERS’, SCRIBES’ AND STAMPVENDORS’ WELFARE FUND BILL, 2012
The Government considers it necessary to have an enactment to provide forthe constitution of a Welfare Fund for the welfare of the document writers,scribes and stamp vendors in the State of Kerala, to pay pension and otherbenefits to them and for other matters connected therewith.
2. As the Legislative Assembly of the State was not in session and theabove proposals have to be given effect to immediately, the Kerala DocumentWriters’, Scribes’ and Stamp Vendors’ Welfare Fund Ordinance, 2012 waspromulgated by the Governor of Kerala on the 30th day of January, 2012 and thesame was published as Ordinance No. 13 of 2012 in the Kerala GazetteExtraordinary No. 221 dated 31st January, 2012.
3. A Bill to replace the said Ordinance by an Act of the State Legislaturecould not be introduced in, and passed by, the Legislative Assembly of the Stateof Kerala during its session which commenced on the Ist day of March, 2012and ended on the 23rd day of March, 2012. THE KERALA LOCAL AUTHORITIES (PROHIBITION OFDEFECTION) AMENDMENT BILL, 2012
The Government have decided to incorporate specific provisions in theKerala Local Authorities (Prohibition of Defection) Act, 1999 regarding theissuance of directions in writing signed with date, to a member belonging to apolitical party or who has the support of a political party, to exercise his votefavourably or unfavourably or to abstain from voting. In order to incorporatespecific provisions in this respect, the Government intend to amend Sections 2and 3 of the Kerala Local Authorities (Prohibition of Defection) Act, 1999.
2. As the Legislative Assembly was not in session and the above proposalhad to be given effect to immediately, the Kerala Local Authorities (Prohibitionof Defection) Amendment Ordinance, 2012 was promulgated by the Governor ofKerala on the 17th Day of January, 2012, and the same was published asOrdinance No. 5 of 2012 in the Kerala Gazette Extraordinary No. 115 dated 17thJanuary, 2012.
3. A Bill to replace the said Ordinance by an Act of the State Legislaturecould not be introduced in, and passed by, the Legislative Assembly in its sessionwhich commenced on the 1st day of March and ended on the 23rd day ofMarch, 2012. Therefore, in order to keep alive the provisions of the saidOrdinance, the Kerala Local Authorities (Prohibition of Defection) AmendmentOrdinance, 2012 was promulgated by the Governor of Kerala on the 11th day ofApril, 2012 and the same was published as Ordinance No. 31 of 2012 in theKerala Gazette Extraordinary No. 733 dated 11th April, 2012.
4. Though a Bill to replace the said Ordinance by an Act of the StateLegislature was published as Bill No. 105 of Thirteenth Kerala LegislativeAssembly, same could not be introduced in, as passed by, the LegislativeAssembly of the State of Kerala during its session which commenced on 11thday of June, 2012 and ended on 25th day of July, 2012.
5. As per the provisions of sub-clause (a) of clause (2) of article 213 ofthe Constitution of India, an Ordinance promulgated by the Governor under thesaid article shall cease to operate at the expiration of six weeks from there-assembly of the Legislature. Accordingly, the said Ordinance ceased tooperate on the 23rd day of July, 2012.

7. This Bill seeks to replace Ordinance No. 50 of 2012 by an Act of theState Legislature.
THE KERALA PANCHAYAT RAJ (AMENDMENT) BILL, 2012
Sub-section (1) of Section 159 of the Kerala Panchayat Raj Act, 1994 (13of 1994) provides that a member of the Panchayat shall, within three monthsfrom the date of assuming his office, submit a statement of assets and liabilitiesof himself and other members of his family, in the form prescribed, to thecompetent authority authorised by the Government by notification in this behalf.But, the fact has come to the notice of the Government that as this time limit isvery short, many of the members of Panchayat in the State could not submit theirstatement of assets within this time limit. As it is the first election held afterenhancing the reservation of women to fifty per cent and the members includingwomen members were engaged in the developmental activities of their wards,they could not, within the said short period of time, submit the statement ofassets. Therefore, in order to avoid the elected members who could not submitthe statement of assets within the fixed time limit from being disqualified, theGovernment have decided to amend the said Act by extending the time limit of“within three months” in the said section to “fifteen months”.
2. For the above purpose, the Kerala Panchayat Raj (Amendment) Bill,2011 was published as Bill No. 55 of the Thirteenth Kerala Legislative Assembly.The same could not be introduced in, and passed by, the Legislative Assembly.
3. As the Legislative Assembly of the State of Kerala was not in sessionand the above proposals had to be given effect to immediately, the KeralaPanchayat Raj (Third Amendment) Ordinance, 2011 was promulgated by theGovernor of Kerala on the 18th day of November, 2011 and the same waspublished as Ordinance No. 48 of 2011 in the Kerala Gazette ExtraordinaryNo. 2174 dated 18th November, 2011.
4. A Bill to replace the said Ordinance by an Act of the State Legislaturecould not be introduced in, and passed by, the Legislative Assembly of the Stateof Kerala during its session which commenced on the 9th day of December, 2011and ended on the same day.

THE KERALA FARMERS’ DEBT RELIEF COMMISSION(AMENDMENT) BILL, 2012
As per clause (vii) of section 2 of the Kerala Farmers’ Debt ReliefCommission Act, 2006 (1 of 2007), only the liabilities due from the farmers onor before the date of commencement of the said Act is included in the definition

of ‘debt’. The said Act came into force on the 18th day of January, 2007. Theliabilities incurred after the said date do not come under this Act. Some farmersin Wayanad District in the State have committed suicide due to debt trap. TheGovernment consider that this situation will cause far reaching unfavourbaleconsequences among farmers and in the agriculture sector. In this circumstance,the Government have decided to bring all agricultural debts up to 31st October,2011 in the said District also within the purview of the said Act. Therefore, theGovernment consider that amendments are to be made in the said Act so as togive relief to the farmers from the debt trap now being faced by them and byvesting the power to bring the debt liabilities up to a specific date in respect ofany particular distress affected area within the purview of the Act, by notificationin the Gazette, a situation shall be made to take urgent steps for such area.Therefore, the Government decided to amend the said Act.
2. Though a Bill relating to this subject to bring an Act of the StateLegislature was published as Bill No. 72 of the Thirteenth Kerala LegislativeAssembly, the same could not be introduced in, and passed by, the LegislativeAssembly.
3. As the Legislative Assembly was not in session and the above decisionhad to be implemented urgently, the Kerala Farmers’ Debt Relief Commission(Amendment) Ordinance, 2012 was promulgated by the Governor of Kerala onthe 26th day of May, 2012 and the same was published as Ordinance No. 39 of2012 in the Kerala Gazette Extraordinary No. 1078 dated 26th May, 2012.
4. Through a Bill to replace Ordinance No. 39 of 2012 by an Act of theState Legislature was published as Bill No. 126 of the Thirteenth KeralaLegislative Assembly, the same could not be introduced in, and passed by, theLegislative Assembly of the State of Kerala during its session which commencedon the 11th day of June, 2012 and ended on the 25th day of July, 2012.
5. As per the provisions of sub-clause (a) of clause (2) of article 213 ofthe Constitution of India, the said Ordinance ceased to operate on the 23rd dayof July, 2012.
6.
