THE REGULATION OF THE MINISTER OF AGRICULTURE OF THE

REPUBLIC OF INDONESIA

NUMBER 57/Permentan/PK.110/11/2015

ON

IMPORTATION AND EXPORTATION OF PLANT-ORIGINATED FEED

MATERIALS

INTO AND FROM THE TERRITORY OF THE STATE OF THE REPUBLIC OF

INDONESIA

WITH THE GRACE OF GOD THE ALMIGHTY

THE MINISTER OF AGRICULTURE OF THE REPUBLIC OF INDONESIA,

Considers :

a. that the plant-originated plant materials may be

exported from the territory of the Republic of

Indonesia when if the domestic production is

deemed sufficient;

b. that if the domestic production of plant-originated

feed materials is deemed insufficient, the

fulfillment may be done through imports from

other countries;

c. that based on the consideration as referred to in

paragraphs a and b, and in order to comply with

the provision of Article 23 of the Law No. 18/2009

on Livestock and Animal Health as amended by

the Law No. 41/2014 on the Amendment of the

Law No. 18/2009 on Livestock and Animal

Health, it is required to stipulate the Regulation of

the Minister of Agriculture in Importation and

Exportation of Plant-Originated Feed Materials

Into and From the Territory of the Republic of

Indonesia;

In view of :

1. Law No. 12/1992 on Crop Cultivation System

DECIDES:

To establish : THE DECISION OF THE MINISTER OF AGRICULTURE ON

THE IMPORTATION AND EXPORTATION OF PLANT-

ORIGINATED FEED MATERIALS INTO AND FROM THE

TERRITORY OF THE REPUBLIC OF INDONESIA.

CHAPTER I

GENERAL PROVISION

Article 1

In this Ministrial Regulations, the followings are the descriptions:

1. Feed Materials are material products of agriculture, fisheries,

livestock or other appropriate materials to be used as feed, processed

or unprocessed.

2. Plant-Originated Feed Materials are materials originated from plants,

processed as well as unprocessed.

3. Feed is a single or a mix of food materials, processed or unprocessed,

provided for the animals for their survival, ability to reproduce and

breed.

4. Importation is the activity to bring Plant-Originated Feed Materials

from other countries into the territory of the Republic of Indonesia.

5. Exportation is the activity to send Plant-Originated Feed Materials

from the Territory of the Republic of Indonesia to other countries.

6. Importation Recommendation that is hereinafter called as RP-I is the

written information provided for the business people to import Plant-

Originated Feed Materials from outside of the country into the

Territory of the Republic of Indonesia.

7. Exportation Recommendation that is hereinafter called as RP-II is the

written information provided for the business people to export Plant-

Originated Feed Materials from the territory of the Republic of

Indonesia to other countries.

8. The Country of Origin of Imports that hereinafter is called Country of

Origin is a country that exports Plant-Originated Feed Materials to the

territory of the Republic of Indonesia.

9. Import-Originated State Business Unit that hereinafter is called

Business Unit is a location in the Country of Origin that runs the

activity of producing Plant-Originated Feed Materials regularly and

continuosly for commercial purposes.

10. Plant Pest Organisms that hereinafter is shortened as OPT is all

organisms that may damage, detrimentally interfere with the life, or

cause the death of plants.

11. Quarantined-Plant Pest Organism that hereinafter is shortened as

OPTK is all OPT that are set by the Minister to be prevented of

entering and spreading in the territory of the Republic of Indonesia.

12. Packaging is the container used to pack and wrap the Plant-

Originated Feed Materials, directly as well as indirectly touching [the

Feed Material].

13. Lable is a sign in the form of picture, writing or other forms that is

officially issued by the Government of the Country of Origin with the

information on the originality of the product.

14. Contamination is the entry of or the incidence of a hazard in the form

of chemical, biological, physical, and/or pathogenic microorganism in

the Plant-Originated Feed Materials, directly as well as indirectly that

may disrupt the healths of humans, animals and/or the environment.

15. Director General is the head of the echelon I working unit in the

Directorate General of Livestock and Animal Health Services in the

Ministry of Agriculture that performs the duties and functions in the

field of feed.

16. The Center for the Protection of Plant Variety and Agriculture License

that hereinafter is shortened to PPVTPP is the organizational work

unit in the Ministry of Agriculture that performs the duties and

functions in the field of agricultural licensing.

17. Enterprise is a business entity, corporate or incorporated, engaged in

the fields of livestock and animal health.

Article 2

(1) This Ministrial Regulation is aimed as the legal base in the provision

of services in the Importation and Exportation of Plant-Originated

Feed Materials into and from the territory of the Republic of

Indonesia.

(2) The Objectives of this Ministrial Regulation are to:

a. increase the country income;

b. meet the domestic needs for and stabilize supply of Plant-

Originated Feed Material Supply; and

c. ensure that the Plant-Originated Feed Materials entered into the

territory of the Republic of Indonesia are free from OPT, OPTK,

agents of the infectious animal diseases, exotic animal diseases,

as well as to meet the requirements of feed’s quality and safety.

Article 3

The coverage of this Ministrial Regulation includes:

a. the requirements of Importation and Exportation;

b. the procedures of Importation and Exportation; and

c. supervision.

CHAPTER II

THE REQUIREMENTS OF IMPORTATION AND EXPORTATION

Part One

Requirements of Importation

Article 4

(1) The importation of Plant-Originated Feed Materials may be done by

Enterprise(s).

(2) Enterprise(s) in conducting the importation of Plant-Originated Feed

Materials as referred to in paragraph (1) must obtain the import

permit from the minister in charge of governmental administration’s

duty in the field of trade.

(3) Minister that is in charge of the governmental administration’s duty in

the field of trade issues the import permit as referred to in the

paragrapgh (2) after receiving the RP-I from the Director General.

(4) RP-I as referred to in the paragraph (3) is obliged to be made as the

annex of the import permit as referred to in the paragraph (2).

Article 5

(1) Director General issues the RP-I as referred to in Article 4 paragraph

(3) after obtaining advice and consideration from the Demand

Analysis Team.

(2) Demand Analysis Team as referred to in paragraph (1) is established

with the Ministrial Decree signed by the Director General on behalf of

the Minister, with the memberships from the elements of Directorate

General of Livestock and Animal Health Services, Directorate General

of Crops, Directorate General of Horticulture, Directorate General of

Plantation, Agricultural Quarantine Agency and universities.

Article 6

Plant-Originated Feed Materials that may be imported as referred to in

Article 4 paragraph (1) are stated in Annex I which is an integral part of

this Ministerial Regulation.

Article 7

(1) Importation of Plant-Originated Feed Materials must meet with the

administration and technical requirements.

(2) Administrative requirements as referred to in paragrapgh (1) include:

a. Personal Identification Card (ID) or the identification of the leader

of a company;

b. SIUP, API, TDP, and company’s Tax Number (NPWP);

c. Company’s incorporation legal documents and the amendment(s);

d. Company profile;

e. The plans of the Plant-Originated Feed Materials’ importation and

distribution plans for 1 (one) year;

f. Statement Letter (affidafit) from the Enterprise that the Plant-

Originated Feed Materials imported are solely for the purpose of

producing feed;

g. Letter of Intention to provide storage warehouse(s) in order to

meet the requirement of maintaining quality and safety of the

Plant-Originated Feed Material;

h. Reports on the previous [project] realizations; and

i. Stamped Statement Letter stating that the documents submitted

are valid and legitimate.

(3) Administrative requirements as referred to in paragraph (2) points, a,

b, c, and d do not apply to enterprise(s) that have conducted several

previous importations.

(4) Should there be changes in the administrative documents, they must

be reported by attaching the amendment documents.

Article 8

Technical Requirements as referred to in Article 7 paragraph (1) include:

a. Country of Origin;

b. Enterprise(s);

c. Quality and safety; and

d. Packaging and Labeling.

Article 9

The requirements of Country of Origin as referred to in Article 8 paragraph

a, must be free from or endemic-free of OPT, OPTK and/or Foot and Mouth

Disease (FMD).

Article 10

(1) Plant-Originated Feed Materials that come from countries with the

endemic status of OPT, OPTK, and/or FMD-endemic as referred to in

Article 9 may be approved as the Country of Origin of the Importation

after given a certain treatment.

(2) Treatment as referred to in paragragh (1) must be completed with

certificate of treatment and/or stated in the column for treatment in

the phytosanitary certificate of the Country of Origin.

Article 11

(1) In the event of that in the Country of Origin occur the outbreak of

OPT, OPTK and/or FMD, the Plant-Originated Feed Materials are

forbidden to be imported.

(2) The provision to forbid the Importation as referred to in paragraph (1)

is stipulated by the Ministrial Decree.

Article 12

(1) The statement of Free-Status, OPT and/or OPTK-endemic as referred

to in Article ( and the statement of outbreak status of OPT and/or

OPTK as referred to in Article 11 paragraph (1) are based on the

declaration of the International Plant Protection Comissions (IPPC).

(2) The statement of free status or FMD-endemic as referred to in Article

9 and FMD-outbreak status as referred to in Article 11 paragraph (1),

are based on the declaration from the Agency for World’s Animal

Health/WOAH/OIE.

Article 13

The requirements of the enterprise(s) importing Plant-Originated Feed

Materials as referred to in Article 8 paragraph b must meet, at the least,

the implementation of quality and security assurance system of the Plant-

Originated Feed Materials according to the guidelines of Good Agricultural

Practices and/or Good Handling Practices, proven by the availability of the

certificate of quality assurance.

Article 14

(1) Requirements of the product quality as referred to in Article 8

paragraph c is in accordance to the Indonesia National Standards

(SNI), or Minimum Technical Requirements (PTM) established by the

Minister.

(2) SNI or PTM as referred to in paragraph (1) is stated in Annex II that is

an integral part of this Ministerial Regulation.

Article 15

(1) Safety requirements of the Plant-Originated Feed Materials as referred

to in the Article 8 paragraph c do not go over the minimum level of

contamination proven by the certificate of analisys from the Country

of Origin.

(2) The minimum level of contamination as referred to in paragraph (1), is

stated in Annex III that is an integral part of this Ministerial

Regulation.

Article 16

(1) For the stabilization of the domestic supply of Plant-Originated Fed

Materials, State-Owned Enterprise(s) (BUMN) may conduct

importations.

(2) BUMN that conducts Importation of Plant-Originated Feed Materials

as referred to in paragraph (1) is in accordance to the assignment

from the Minister of BUMN.

(3) Minister of BUMN in assigning the BUMN as referred to in paragraph

(2) must be in accordance to the advice of the Minister.

Article 17

(1) The requirements on the Packaging as referred to in Article 8

paragraph d must be originated from the Country of Origin, according

to international standards, labeled and sealed.

(2) Packaging as referred to in paragrapgh (1) may be in the forms of

sacks or containers.

(3) Packaging in the form of sacks as referred to in paragraph (2) must be

completed with lable written in Bahasa Indonesia and English.

(4) Lable in the packaging as referred to in paragrapgh (3) contains the

information of:

a. the species spesies or category of the Plant-Originated Feed

Materials;

b. the name and address of the producing company;

c. the date of production;

d. the date of expiration;

e. the country of origin;

f. the country of destination; and

g. the nett weight.

(5) Lable as referred to in paragraph (3) does not apply to the importation

of bulk product.

Article 18

Packaging in the form of containers as referred to in the Article 17

paragraph (2) must be sealed by the Official with Authority in the Country

of Origin, with clear number, remains intact to the arrival in the importing

country, and must only be unsealed (opened) by the plant quarantine’s

functional official hin the Importing country.

Part Two

Requirements for Exportation

Article 19

(1) Exportation of Plant-Originated Feed Materials may be done by

Enterprise(s).

(2) Enterprises in conducting Exportation of Plant-Originated Feed

Materislas as referred to in paragrapgh (1) must obtain the permit on

exportation from the minister in charge of government administration

in the field of trade.

(3) Minister who is in charge of government administration in the field of

trade in issuing the license/permit as referred to in paragrapgh (2)

may do so after obtaining the RP-II from the Directorate General.

(4) Director General issues the RP-II as referred to in the paragrapgh (3)

after receiving the advice and consideration from the Need Analysis

Team as referred to in Article 5.

Article 20

(1) Eportation of Plant-Originated Feed Materials must meet the

administrative and technical requirements.

(2) Administrative requirements as referred to in paragraph (1) include:

a. Personal Identification Card (ID) or identity of the leader of a

company;

b. b. SIUP, API, TDP, and Company’s Tax-Payer Identification

Number (NPWP);

c. Company’s incoropation legal documents and the amendments;

d. The plan of Exportation of Plant-Originated Feed Materials; and

e. Establishment of quarantine activity location or quarantine

installation from the Agriculture Quarantine Agency.

(3) The administrative requirements as referred to in the paragraph (2)

points a, b, and c do not apply to the enterprise(s) that have

conducted several prior exportations.

(4) Should there be changes in the administrative documents, they must

be reported by attaching the amendment documents.

(5) Technical requirements as referred to in the paragraph (1) are to be

met according to the requirements set forth by the country of

destination.

Article 21

Types of Plant-Originated Feed Materials that may be exported are stated

in Annex IV that is an integral part of this Ministrial Regulation.

CHAPTER III

PROCEDURES OF IMPORTATION AND EXPORTATION

Part One

Procedure of Importation

Article 22

(1) In order to obtain the RP-I as referred to in the Article 4 paragraph (3),

Enterprise submits written request to the Director General through

the Head of PPVTPP, online.

(2) The request as referred to in paragraph (1) must be completed with

administrative requirements as referred to in Article 7 paragraph (2).

Article 23

Head of PPVTPP, after receiving the request as referred to in Article 22,

performs checking of the completion of administration requirements as

referred to in Article 7 paragraph (2) in the time duration of 1 (one)

working day at the longest and must provide the response whether the

request is denied or approved.

Article 24

(1) Request is denied as referred to in Article 23 if the administrative

requirements as referred to in Article 7 paragraph (2) are incomplete

and/or incorrect.

(2) Request is denied as referred to in paragraph (1) is delivered by the

Head of PPVTPP to the Enterprise, completed with the reasons of

denial by online.

Article 25

(1) Request is approved as referred to in Article 23 if the administrative

requirements as referred to in Article 7 paragraph (2) are completely

and correctly met.

(2) Request is approved as referred to in paragraph (1) by the Head of

PPVTPP is delivered to the Director General by online.

Article 26

Director General after receiving the request as referred to in Article 25

paragrapgh (2) performs technical study in the time period of 3 (three)

working days at the most and is to provide response whether the request

is denied or approved.

Article 27

(1) Request is denied as referred to in Article 26 is when [it does] not

meet with the technical requirements as referred to in Article 8.

(2) Request is denied as referred to in paragraph (1) is to be delivered by

the Director General to the Enterprise through the Head of PPVTPP

completed with the resons of denial by online.

Article 28

(1) Request is approved as referred to in the Article 26, if meeting the

technical requirements as referred to in Article 8.

(2) The approval of request as referred to in paragraph (1) is the issuance

of RP-I by the Director General.

(3) RP-I as referred to in paragraph (2), at the minimum include:

a. recommendation number;

b. name and address of the requester and the address of storage

location;

c. number and date of request letter;

d. Country of Origin;

e. types and number of Plant-Originated Feed Materials completed

with their HS codes;

f. location of importation;

g. duration of Recommendation; and

h. purpose of utilization.

(4) The expiration of RP-I as referred to in paragraph (3) point g is 10

(ten) working days since the date of issuance.

(5) RP-I as referred to in paragraph (2) is delivered by the Director

General to the Enterprise through the Head of PPVTPP.

(6) Head of PPVTPP after receiving the RP-I as referred to in paragraph

(4), in the duration of 1 (one) day at the maximum must deliver the

RP-I to the Enterprise through the Indonesia National Single Window

(INSW).

Article 29

(1) Penerbitan RP-I sebagaimana dimaksud dalam Article 28 paragraph

(2) dilakukan 4 (empat) periode dalam 1 (satu) tahun, sebagai berikut:

a. periode kesatu berlaku mulai tanggal 1 Januari sampai dengan

30 Maret;

b. periode kedua berlaku mulai tanggal 1 April sampai dengan 30

Juni;

c. periode ketiga berlaku mulai tanggal 1 Juli sampai dengan 30

September; dan

(2) The request for RP-I as referred to in paragraph (1) is submitted at the

least of one month prior to the expiration period.

Article 30

The issuance of RP-I in every period is done 10 (ten) working days prior to

the expiration period.

Article 31

(1) Enterprise that has received RP-I is obliged to realize the Importation

based on the periodic duration.

(2) Enterprise as referred to in paragraph (1), must submit the report of

the realization of importation at the latest of 5 (five) working days after

the importation to the Director General copying the Head of

Agricultural Quarantine Agency and Head of PPVTPP, by online.

Article 32

In the event of outbreak in the Country of Origin as referred to in the

Article 11, Enterprise may submit a repeat request from other countries

that are free from the outbreak of OPT, OPTK and FMD to the Director

General according to the set forth allocation, by attaching the RP-I issued

and still valid.

Part Two

Procedure of Exportation

Article 33

(1) In order to obtain RP-II as referred to in the Article 19 paragraph (3),

Enterprise submits request to the Director General through the Head

of PPVTPP by online.

(2) Request as referred to in paragraph (1) must be completed with the

administrative requirements as referred to in Article 20 paragraph (2).

Article 34

Head of PPVTPP after receiving the request as referred to in Article 33

paragraph (1) performs checking of the completion of administrative

requirements and at the maximum of 1 (one) working day must provide

the response whether the request is denied or approved.

Article 35

(1) Request is denied as referred to in the Article 33 if all administrative

requirements as referred to in the Article 20 paragraph (2) are

incomplete and/or incorrect.

(2) Request is denied as referred to in the paragraph (1) is delivered by

the Head of PPVTPP to the Enterprise completed with the reason of

denial by online.

Article 36

(1) Request is approved as referred to in the Article 33 if the administraly

and correctly.

(2) Approved request as referred to in the paragraph (1) is delivered to the

Director General by the Head of PPVTPP by online.

Article 37

Director General after receiving all requests as referred to in the Article 36

paragraph (2) performs technical review and in the maximum period of 3

(three) working days must provide the response whether the requests are

denied or approved.

Article 38

(1) Denied request as referred to in the Article 37 is delivered by the

Director General if not meeting with the technical requirements as

referred to in the Article 20 paragraph (5).

(2) Denied request as referred to in the paragraph (1) is delivered by the

Director General to the Enterprise through the Head of PPVTPP

completed with the reasons of denial, by online.

Article 39

(1) Approved request as referred to in the Article 37 is when [it has] met

with the technical requirements as referred to in Article 20 paragraph

(5).

(2) Approval of requests as referred to in the paragraph (1) is by the

issuance of RP-II by the Director General.

(3) RP-II as referred to in the paragraph (2) is delivered by the Director

General to the Enterprise through the Head of PPVTPP by online.

(4) Head of PPVTPP after receiving the RP-II as referred to in the

paragraph (3), in the maximum period of 1 (one) working day must

deliver RP-II to the Enterprise through INSW.

Article 40

(1) Enterprise that has received RP-II must realize the Exportation based

on the number stated in the RP-II.

(2) Enterprise that has conducted the activity of Exportation as referred

to in paragraph (1), must submit reports of the Exportation realization

within maximum of 5 (five) working days since the realization of the

exportation to the Director General copying the Head of Agriculture

Quarantine Agency and Head of PPVTPP by online.

CHAPTER IV

SUPERVISION

Article 41

(1) Supervision is performed against the realization of number, quality

and safety as well as utilization of the Importation of Plant-Originated

Feed Materials.

(2) Supervision od the realization of number and utilization of the

Importation of Plant-Originated Feed Materials as referred to in the

paragraph (1) is performed through the obtaining of access to the

INSW as well as through the obtaining of reports from the Ministry in

charge of government administration in the field of trade.

(3) Provisions on the supervision of quality, safety and utilization of he

Plant-Originated Feed Materials as referred to in the paragraph (1) is

performed according to the provisions of the legislations in the field of

the feed quality and safety supervision.

CHAPTER V

PROVISION OF SANCTIONS

Article 42

(1) Enterprise that does not:

a. Make the importation into a reality as referred to in the Article 31

paragraph (1);

b. Report on the [importation] realization as referred to in Article 31

paragraph (2);

c. Realize the exportation as referred to in Article 40 paragraph (1);

or

d. Making the report of the exportation realization as referred to in

Article 40 paragraph (2), is liable to be given administrative

sanction.

(2) Administrative sanction as referred to in paragraph (1) may be in the

form of:

a. Written reprimand;

b. Not receiving the following RP-I and/or RP-II; and/or

c. Revocation of business license.

(3) Administrative sanction as referred to in paragraph (2) points a and b

are performed by the Director General.

(4) Administrative sanction as referred to in paragraph (2) point c is

suggested by the Director General to the Agency issuing the business

license.

CHAPTER VI

TRANSITIONAL PROVISION

Article 43

In the event of the stipulation of this Ministrial Regulation, SPP or SPP-I of

the Plant-Originated Feed Materials that have been issued are still in force

to the date of the expiration.

CHAPTER VII

CLOSING PROVISION

Article 44

This Ministrial Regulation starts to put into force on the date of its

stipulation.

So that everybody is cognizant of this [Ministrial Regulation], [the Minister]

orders the promulgation of this Ministrial Regulation by having it

published in the State Gazette of the Republic of Indonesia.
