ARRESTED MAY 8th
1942 On May 8th, 1942 he was arrested in Washington, D.C., by the FBI on charges of “Sedition”.
At roughly the same time, more than eighty (80) members of the Chi-cago Muhammad’s Tem-ple No. 2 were taken in under the same charge by FBI agents *working with local police. One of the arrested temple members said the offi-cers "tore the place apart trying to find weap-
ons hidden inside”, since they believed The Nation of Islam was con-nected with the Japa-nese.
The sedition charge against Hon. Elijah Mu-hammad was based on the Nation Of Islam Tem-ple's anti-draft stance and was applied for bla-tantly racist and political reasons. However, the Government authorities failed to mention the real reason was because they were concerned about “The Motherplane

over 300 automatic assault weapons carried by Confederate law enforcement agen-
cies for the 19 days of illegal court proceedings transplanted from the Middle District
of Georgia. Aha! But do you know or have you forgotten about the mothers, daugh-
ters, sisters, fathers, sons, husbands and friends, one family of Nuwaupians known
as the Gullah Geechees (Negroids) from West Africa who inhabited and built the his-
toric Coastal Empire and Low Country (Carolinas, Savannah, and Brunswick) that
were already there working behind the scenes to free our Master Teacher? There are

amongst us, those whose head is bloody but unbowed. We are in the love of All and Love (Ashug) is in us.
Rev. Zack Lyde, Community Activist & Harry Lyde, Retired Police Officer organized and sponsored housing, food, prayer vigils, radio broadcast, transportation, and introduced Brunswick community and St. John's
Missionary Baptist Church to the Nuwaupian family of Dr. Malachi Z. York before and after the trial. These
brothers organized the TOES program - The Other Economic Summit also referred to as The Greedy 8 Alter-native Summit, which was an alternative to the G8 Summit in Sea Island, Georgia a few miles from impov-
erished and environmentally damaged inland towns of Glynn County that afforded the opportunity for Nu-waupians to tell the Truth of Dr. York’s case to the International and Independent Media worldwide in the
summer of 2004. For this, Harry Lyde was falsely accused of improperly touching 2 children (who denied it ever happened) and incarcerated for 100 years in Baldwin County! Sounds Familiar, Think About It.
A lawsuit filed by Tshakamalik Al-Kush (Hon. Shakur Atum Re) and a collaborative radio broadcast
coined “Shouting From The Mountain Top” per the Brunswick 2003 Christmas Parade defended Our
Master Teacher, Nuwaupian Tribe and affiliated organizations while exposing Confederate persecutors like
Judge C. Ashley Royal, Sheriff Howard Richard Sills, Brunswick local government and media outlets associ-
ated with the United States Middle District Court of Georgia – Macon Division conspiracy. Mrs. Edna John-
son, Police Chief for the City of Brunswick penned the statement for the record “I appreciate the profession-
alism of this organization. You enhanced the parade this year.” For standing up to support The Master
Teacher, teaching Wu-Nuwaupu everywhere, operating the All Eyes On Egipt Bookstore in Savannah, orga-
nizing within the Nuwaupian family, and building unity with community activist/leaders (NOI and NNBP) this

M.K. York is a 63-year old fed-eral prisoner being held in the custody of the United States Bu-reau of Prisons (BOP) at the United States Penitentiary, Ad-ministrative Maximum Facility located in Florence, Colorado after unlawfully being sentenced in rural Georgia on Martin Luther King’s Birthday January 19
th
2004, violating Rule 56 of the Federal Rules of Criminal Proce-dure by holding court on a Stat-ute Holiday as defined in 5 USC
§ 6103.
Mr. York was ill prior to his de-tention on May 8, 2002, having been diagnosed with HANE in 2000. HANE is a rare, potentially fatal genetic disorder typified by the rapid swelling (edema) of the skin, mucosa and sub-mucosal tissues which can be deadly if
left untreated

This attorney has endorsed this letter for immediate re-lease as Mr. York is in urgent need of hormonal treatment for Acute Hereditary Angio-Neurotic Edema (HANE) and is being tortured having been given Hydrochlorothiazide, in pill form, known to induce at-tacks from the disease.

U.S. Bureau of Prisons (B.O.P.) who have repeat-
edly denied treatment and forci-bly prescribed medications which exacerbate HANE. His symptoms include swelling of the throat, migraine headaches, extreme breakouts of hives, nausea, and seizures triggered by the Hydrochlorothiazide be-ing prescribed to him. During the course of Mr. York’s incar-ceration, medical record as-sessments have demonstrated a continued downward spiral of his health, with each dramatic change of weather, the pro-longed harsh conditions of his confinement, the incessant de-nial of treatment for HANE by prison medical professionals, and persistent lack of appropri-ate medical care. If Mr. York does not receive proper treat-ment, respiratory arrest or suf-focation is more likely than not
to occur, resulting in death.
Although she is no longer ac-tively involved in the litigation of the medical transfer, Attor-ney-at-Law Leta R. Holden of Holden Law Offices, PLLC, re-ceived a copy of hand-written documentation in the past 72 hours that Mr. York suffered another severe attack on or
about March 5th, 2009.

It can be clearly seen that His Excellency; Consul General Dr. Malachi Kobina York is a victim of torture after being incarcerated in the USP Atlanta Georgia Federal prison upon his court appearance on May 9th 2002.

found egregious violations, including the use of

The UN Committee, which oversees and monitors
actions of Parties to the Convention, also conveyed
its alarm about the number of cases of mistreat-
ment Perpetrated by police against civilians and for
similar violent incidents in the U.S. Prison System.
The Committee recommended that the US abolish
Electro-Shock Stun Belts and Restraint Chairs as
methods of restraining those in custody. It also
expressed concern about the excessively harsh
regime of 'super maximum' prisons.”
A For-mer FBI Agent who went Undercover With al Qaeda told a Senate Hearing that The Extreme Bush Torture Regime was 'ineffective'. A former FBI Interrogator of an Al Qaeda leader told a U.S. Senate Hearing Committee that extreme tech-niques used by the Bush administration were 'ineffective, slow and unreliable' , and often caused the prisoner to stop talking. Soufan said his team had to step aside when Central Intelligence Agency contractors took over using simulated drowning,
sleep deprivation and other harsh methods.
He said those techniques caused the prisoner to 'shut down'. Soufan testified before a Senate Judici-ary Subcommittee, holding the first hearing on ex-treme interrogation methods since the Obama ad-ministration last month released Bush administra-
tion legal opinions that justified the techniques.
He said former Vice President Dick Cheney has sug-gested 'There was good information' obtained from the
extreme methods.
The United States government has consistently applied torture methods on state, local and especially federal prisons; consequently, which have conveniently tucked away federal prison inmates in the aforementioned “Supermax” prisons, which were intentionally built in remote, far away places in each state. These Supermax Prisons were and still are “Factories of Torture” that were able to inflict diabolical techniques of physical, emotional, and mental torture techniques that had basi-cally gone unnoticed in applying their methods of tor-ture until the investigation and reporting of such Prison Inmate Advocacy groups as the American Friends Ser-vice Committee, and the American Civil Liberties Un-ion, which had submitted many class action suits and other legal actions against the Federal Bureau of Prisons on behalf of the prison inmates and also on the basic principles of the violation of an American Citizen’s
Constitutional rights.
The incarceration of His Excellency; Dr. Malachi Kobina York, is a classic example of this inhumane treatment that needs to be exposed to the general public. The fact that Dr. York suffers from a life-threatening disease; Acute Hereditary Angio-Neurotic Edema (HANE). HANE is a rare, potentially fatal genetic disorder typi-fied by the rapid swelling (edema) of the skin, mucosa and submucosal tissues. His medical condition has been virtually ignored by the Federal Bureau of Prisons and as a result, legal action has been taken on behalf of Dr.
York to remove him from this torturous condition.
It must be OVERSTOOD; by the Nuwaubian commu-nity and the general public that this policy of torture comes from the top; specifically, right from the desk of former President George W. Bush. The residue of this torture policy is still being fought against by the Nu-waubian community to free our Master Teacher and
Guide; His Excellency, Dr. Malachi Kobina York.

(1). His arrest on the above date is in violation of Article 29 of the Vienna Convention on Diplomatic
Relations; whereas, the person of a diplomatic agent shall be inviolable. He shall not be liable to any form of
arrest of detention.
(2). Diplomatic officials of the Republic of Liberia, West Africa; through the person of his Liberian
international lawyer counselor Francis Y.S. Garlawolu, have requested His Excellency Consul General Dr,
Malachi Z. York’s Repatriation to Liberia on more than one Occasion.

Government of Liberia, West Africa on Dec. 15th 1999 and has been continuously Active up until the time of
his arrest on May 8th 2002.

fair and speedy trial as he was arrested May 8th 2002, detained and not given a trial until January of 2004,
nearly 2 years after his arrest.

(7). Moreover, he is still receiving Torture and cruel and unusual punishment, which has increased.
Upon being processed there; beginning November 8th 2006, he was placed on 30 days of disciplinary
segregation (Solitary confinement), 365 days of loss of telephone, 365 days of loss of visiting privileges, and
a recommendation of disciplinary transfer, all of which is in direct violation of the enacted terms of the
Vienna Convention on Diplomatic Relations into Federal Statutory Law, 22 U.S.C. Section 254 A-E

On March 27th 2007, H.E. Consul General Dr, Malachi York went on an
emergency basis from Florence ADX Supermax Prison in Florence Colo-
rado, to Parkview Medical Center in Pueblo, Colorado. Medical records
dated March 27th 2007 Indicated that he has a tortuous Aorta. Separate re-
cords dated March 27th 2007 Indicated that he had an abnormal EKG.
The above incidents were taken from transcripts of Federal Court re-
cords from H.E. Consul General Dr. Malachi York’s legal pleas for recog-
nition of his Diplomatic Immunity Status. This blatant ignoring the valid
status of a Liberian Naturalized citizen and Diplomat will have International
and world repercussions. If the Federal government is allowed to ignore
H.E. Consul General Dr, Malachi York’s status, then no foreign diplomat in
the United States is safe. Reciprocally, how will this reflect on the treatment
of our U.S. Diplomats overseas? Especially, in the African countries?
It is requested that this serious matter is investigated as soon as pos-
sible, as H.E. Consul General Dr; Malachi York is suffering from a life-
threatening disease (HANE). In one of your Presidential addresses, it was
mentioned that there would be a better approach to foreign relations by the
United States government. We would trust that this is the case.
Thank you for all of your efforts to bring about a change for the better
in America.

More Money, More Problems

It would seem more money
would result in less problems right? Or
not? This is solely because money
equates debt. All money from the US
and many major countries have their
money loaned to them from the Federal
Reserve Bank (The Fed). As America
continues its path of destruction as
other countries follow suit, the masses
must realize that money is and has al-
ways been a means of slavery, hence
the term “Wage Slave”. On the face of
a dollar bill it says “THIS NOTE IS A LE-
GAL TENDER FOR ALL DEBTS, PUB-
LIC AND PRIVATE”, clearly stating it’s
a form of debt. To repay all debt there
would be no money in circulation. Their
plan, the private owners of The Fed, is
to render all nations to a submissive
state (debt) in order for one world cur-
rency, the AmerosAmerosAmerosAmeros. This form of cur-
rency is already in circulation.
John F. Kennedy was assassinated ironi-
cally after their attempt to pull away from
the Federal Reserve Bank to create a na-
tional independent, debt-free currency.
Abraham Lincoln planned to create a debt-
free currency called the “Green Backs” and
hindered The Federal Reserve from imple-
menting their debt-based currency in the
nation, thus he was assassinated. Andrew
Jackson was attack and survived and as-
sassination attempt by a man named Rich-
ard Lawrence who indirectly claims his mo-
tivation was for the economy. Most likely it
was for Andrew Jackson’s steps toward de-
taching from central bank to avoid national
debt.
