As springtime is here it is atime to rejuvenate andhelp bring out the love
and positive characteristics inthose we care for. As achiropractor we have the abilityto positively touch the lives ofmany patients that enter ouroffices. I recently had a few
patients that have had chronic conditions whichhave been affecting their mental attitude, focus andvigor. This undoubtedly spills over into theirrelationships with friends and family. It is alwaysexciting to see when a patient’s symptomsdecrease or all together are gone with the help oftreatment. As symptoms decrease and functionsincrease, most patients are less irritable and able todo more of what they enjoy, allowing them to be abetter person to those they love. Pretty good stuffif you ask me. If you have something in your lifethat has been negatively affecting you and notallowing you to be the person your loved onesexpect, implement the change, give time andenergy to things most important in your life. Thatbeing said, I hope everyone is enjoying thebeautiful weather we’ve been having. I would like to
mention the two functions coming up soon. First,the 30th Annual America II Corporate Sports Feston Saturday, April 28, 2012 Tampa Bay's teambuilding, morale boosting employee event of theyear held on St Petersburg Beach! There are fiveevents, which are beach volleyball, beach dogeball,corn toss, surf and turf relay and tug of war.If anyone would like to come out the day of theevent to support the teams and have a fun day atthe beach, please contact Dr Woody Brown at (727)518-1967.
The second is the PCCS Annual Golf Tournament
which will be held on May 3, 2012 at Feather

Dear Colleagues,
Well it was another exciting year of
meeting our legislatures “Up on the hill”
in Washington, D.C.! Unfortunately we
have dealt with many of the same
issues as in previous years, mainly
chiropractic not being in the V.A.
system. “Out of the roughly 162 V.A.
bases in the country only 42 offer
chiropractic services.” The need for
chiropractic was initiated at the end of
the Clinton era and made into law in
Bush’s 1st term and again addressed in
his 2nd term! Over a decade has
passed and the U.S. Department of
Veterans Affairs (DVA) still has not
fulfilled what congress has passed into
law.
All of the issues were as follows:

Legislation to eliminate disparities
in Veterans’ Access to
Chiropractic Care.
Enact Legislation to allow
Doctors of Chiropractic to serve
as participants in the US Public
Health Service Commissioned
Corps.

Q. Doesn’t�this�law�violate�Florida’s�Insurance�Equality�Law�that�pre-
vents�discrimination�against�Chiropractic�Physicians?
A. No.�That�anti-discrimination�law�is�in�the�statutes�applicable�only�to
health�insurance�and�does�not�apply�to�auto�insurance.�
Q. Are�chiropractic�physicians�the�only�class�of�physicians�or�health
care�providers�limited�or�excluded�by�HB�119?
A. No.�Podiatric�physicians�are�completely�excluded�from�the�PIP�statute
as�are�massage�therapists,�acupuncture�physicians,�occupational�therapists
and�several�other�health�care�provider�disciplines.�
LAWSUIT ON CONSTITUTIONALITY OF NEW LAW
Q. Is�this�new�law�constitutional�and/or�has�FCA�filed�suit�to�attack
the�constitutionality?
A. This�is�a�complex�question�and�is�being�considered�by�the�FCA�and�its
Coalition�members.�No�lawsuit�has�been�filed�at�this�time.�
Q. Does�exclusion�or�limitation�of�a�profession�give�rise�to�a�judicial
challenge�to�the�validity�of�the�PIP�statute�as�amended�by�HB�119?
A. No.�There�is�nothing�in�the�Florida�Constitution�prohibiting�the�legisla-
ture�from�excluding�a�health�care�discipline�from�any�statute.
EFFECTIVE DATE OF NEW LAW
Q. When�does�this�new�law�go�into�effect?
A. Different�parts�of�the�bill�take�effect�at�different�times.�Generally,�a�bill
becomes�effective�upon�becoming�law.�However,�the�legislature�may�enact
dates�upon�which�a�bill�takes�effect�after�it�has�become�law.��In�response�to
member�calls�about�the�confusing�effective�dates�in�HB�119,��FCA�General
Counsel�Paul�Lambert�prepared�a�table�listing�each�bill�section,�the�section
line�numbers,�a�description�of�the�section's�effect�and�the�effective�date�of
each�section�can�be�found�on�the�FCA�website.���
TIME LIMITS
Q. Is�there�a�time�limit�for�the�patient�to�come�to�my�office?
A. In�order�for�a�patient�to�use�any�of�his/her�PIP�benefits�(via�M.D.,�D.O.
or�D.C.),�the�patient�must�first�present�for�treatment�within�14�days�of�the
car�accident.
$10,000 VERSUS $2,500 IN BENEFITS
Q. Can�a�patient�seeking�chiropractic�care�ever�obtain�the�full�use�of
his/her�$10,000�in�benefits?
A. Yes.�If�the�patient�is�diagnosed�within�the�first�14�days�by�an�M.D.,
D.O.,�ARNP,�or�P.A.�with�an�“emergency�medical�condition,”�the�patient,
upon�referral,�may�receive�follow-up�care�with�you�related�to�the
underlying�diagnosis�to�be�able�to�use�up�to�the�full�$10,000�in�PIP
benefits.�
Q. Can�a�patient�start�off�as�a�non-EMC�and�later,�through�diagnostic
testing,�be�deemed�an�EMC�patient,�able�to�use�his/her�full�$10,000�in
benefits?
A.We�don’t�know.�The�law�states�that�follow-up�care�must�be�consistent
with�the�underlying�diagnosis.�It�is�undetermined�at�this�time�whether
insurers�will�allow�a�patient�to�transfer�into�EMC�coverage.�
Q. If�a�patient�is�diagnosed�with�a�non-EMC�and�is�subject�to�the
$2500�limitation,�after�the�patient�reaches�that�benefit,�can�I�bill�health
insurance?
A. YES.�
Q. If�a�patient�is�diagnosed�with�a�non-EMC�and�is�subject�to�the
$2500�limitation,�after�the�patient�reaches�that�benefit,�can�I�work�off�a
letter�of�protection�with�the�patient’s�lawyer�and�bill�usual�and�customary?�
A. YES.�There�is�no�provision�in�the�new�law�that�precludes�you�from
treating�on�the�LOP.�However,�you�should�make�this�clear�with�the�patient.

A.We�don’t�know.�While�the�new�law�defines�EMC,�it�does�not�provide
examples�of�what�injuries�(ICD-9s)�it�considers�an�EMC.�The�definition
of�“emergency�medical�condition”�in�the�new�legislation�is:�A�medical
condition�manifesting�itself�by�acute�symptoms�of�sufficient�severity,
which�may�include�severe�pain,�such�that�the�absence�of�immediate
medical�attention�could�reasonably�be�expected�to�result�in�any�of�the
following:
(a)�Serious�jeopardy�to�patient�health.
(b)�Serious�impairment�to�bodily�functions.
(c)�Serious�dysfunction�of�any�bodily�organ�or�part.�
Q. If�an�accident�victim�timely�presents�at�an�ER�or�MD/DO/PA/ARNP
provider�and�is�diagnosed�with�an�“emergency�care�condition,”�triggering
the�$10K�benefit,�are�they�able�to�follow�up�with�ANY�provider,�including
a�DC?�Or�must�they�go�only�to�MD/DO/PA/ARNP�providers�if�not
referred�specifically�to�a�DC?�
A. Follow-up�care�can�be�with�a�DC�regardless�of�whether�there�is�an
EMC�or�non-EMC�determination.�There�will�only�be�$2,500�available�if
there�is�a�non-EMC�determination.�The�full�$10,000�in�benefits�is
available�if�there�is�an�EMC�determination.�The�DC�does�not�need�a
referral.�Follow-up�care�must�be�consistent�with�the�original�diagnosis.�
DIAGNOSTIC TESTING
Q. Does�the�$2500�limit�include�diagnostic�testing?
A. Unfortunately,�it�appears�diagnostic�testing�is�included�in�the�$2500
limit.�
MASSAGE AND ACUPUNCTURE
Q. Can�I�do�massage�on�a�patient�and�get�reimbursed?
A. No.�As�of�January�1,�2013,�PIP�insurers�are�not�required�to
reimburse�massage�“as�defined�in�s.�480.033�or�acupuncture�as�defined�in
s.�457.102,�regardless�of�the�person,�entity,�or�licensee�providing�massage
or�acupuncture.”�
MULTIDISCIPLINARY OFFICES
Q. If�I�am�part�of�a�multidisciplinary�practice�with�an�M.D.�who
diagnoses�an�EMC,�can�the�DC�treat�for�follow-up�care�up�to�the�$10,000
in�benefits?
A. YES�as�long�as�that�treatment�is�reasonable,�necessary,�and�related�to
the�automobile�accident.�
EXAMINATIONS UNDER OATH
Q. If�my�patient�is�asked�to�attend�an�Examination�Under�Oath,�will�my
bills�be�put�on�hold?
A. Yes,�quite�possibly.�The�new�law�allows�the�auto�insurer�to�hold
payment�to�providers�until�the�insured�attends�an�EUO.�
Q. Does�the�new�law�require�me�(the�treating�Dr.)�to�sit�for�an�EUO?
A. No,�just�the�patient/insured.
RATE ROLL BACKS
Q. Does�the�new�law�require�auto�carriers�to�reduce�premiums?
A. No.�There�is�a�provision�in�the�new�law�to�suggest�that�auto�carriers
will�reduce�premiums,�but�the�carrier�simply�has�to�justify�why�it�could
not�reduce�the�rate�in�order�for�it�not�to�cut�premiums.
