The Minnesota No-Fault Certification Form

Why was there a Minnesota No-Fault Certification Process?

In 1974 the Minnesota Legislature passed the Minnesota No-Fault AutomobileInsurance Act1.

This Act required Minnesota residents and nonresidents at all times to maintain basiceconomic loss benefits2 and automobile liability coverage on vehicles they own,provided use of a vehicle is contemplated and one of the following is true: (1) Thevehicle required to be registered or licensed in Minnesota, or (2) the vehicle principallygaraged in Minnesota.

Secondly, the Act also required a nonresident of Minnesota to maintain PIP andliability coverages on any other owned vehicle3 whenever the nonresident drives thisvehicle within the borders of Minnesota.

This second requirement presented a problematic situation for insurance companies.Because the polices that companies issue within a nonresident’s home state do notcontain Minnesota No-Fault benefits, companies needed to find a way to extend suchbenefits to nonresident insureds whenever these insureds were driving their vehicles inMinnesota .

To help insurance companies address this problem, the Minnesota Department ofCommerce developed the Minnesota No-Fault Certification form.

What is the Minnesota No-Fault Certification Form?

Following passage of the Minnesota No-Fault Automobile Insurance Act in 1974, theMinnesota Department of Commerce sent a Minnesota No-Fault Certification Form toevery insurance company that was writing automobile insurance in the United States andCanada. Companies were asked to have one of their officers sign, date, and return theform to the Department. By doing this, these companies formally agreed to provideMinnesota no-fault benefits to their non-Minnesota insureds if those insureds wereinvolved in an accident while driving their vehicle in Minnesota .

Which companies signed the form?

Two back-to-back alphabetical listings of insurance companies are attached below. Theselistings indicate the companies whose officers signed a Minnesota No-FaultCertification Form in 1974. The first listing consists of companies that were in Minnesota as of 1974. The second listing, which sequentially follows the consists of companies that were unlicensed in Minnesota as of 1974.

Why is this listing made available to the public?

The Minnesota Department of Commerce regularly receives inquiries from pedo not legally reside in Minnesota but who are involved in accidents in Minnedriving a vehicle they own . These persons wish to know whether they are entreceived Minnesota Basic Economic Loss benefits from their insurance compalosses sustained in their accident.

If these persons happen to carry insurance provided by a company named in onelistings, then these persons will be able to recover Minnesota Basic Economicbenefits from their company even if the company’s policy does not contain colanguage.

If not, these persons will not be eligible for such coverage from their insuranccompany. (They may therefore wish to contact the insurance department of thwhich they reside.) Further, because they would be considered uninsured driveMinnesota law, these persons would also be ineligible for Minnesota Basic EcLoss benefits through the Minnesota Automobile Assigned Claims Bureau.

What if an insurance company was first incorporated after 1974 or underwechange since 1974?

Minnesota No-Fault Certification Forms have been sent out to companies onl1974. Companies incorporated since 1974 will therefore not be found in the lHowever, one should ascertain whether such a company is a member of a compcomprising companies that did sign a Minnesota No-Fault Certification Formcase, Minnesota Basic Economic Loss benefits might be available from that coAlso, if a company name cannot be found in the listings, one should double chcompany has not undergone a name change since 1974. If that has happened, onfind out the prior company name and look for that.

The Department has signed Minnesota No-Fault Certification Forms on file for allinsurance companies listed below. Copies can be obtained if needed by telephoning thefollowing number: (651) 297-2669. Additional questions can also be referred to thisnumber.

What should I do if an insurance company refuses to pay Minnesota No-Faultbenefits?

If an insurance company that is licensed in Minnesota refuses to pay Minnesota basiceconomic loss benefits, please contact the Department’s Enforcement Division (tel: 651-296-2488). The Department will investigate any complaint alleging violations ofMinnesota insurance law and will attempt to resolve claim disputes. While theDepartment may impose fines and penalties if violations are found, the Department hasno authority to secure payments on behalf of any claimant or insured. Unlicensedcompanies do not come under the jurisdiction of the Minnesota Commerce Department’sEnforcement Division.
