DESCRIPTION

Occupying a position high on the banks of Derwentwater in Cumbria, Lingholm was designed in the 1870s by Sir Alfred Waterhouse (1830-1905), one of the most acclaimed architects of the 19th century. We are delighted to be holding this auction featuring the collection of Lord & Lady Rochdale. Lord Rochdale and his wife, Lady Rochdale, hope that the excitement and pleasure that were engendered in collecting and acquiring these pieces will, in turn, be enjoyed by new collectors at this sale. It is the buyer’s responsibility to

ascertain collection procedures,

particularly if the sale is not being

held at our main saleroom.

Bidding

At the Sale

To bid at the sale all potential

buyers must be registered with us

on or before the day of sale. We will

need proof of identification and

residence, and may require a bank

reference. Potential buyers must

collect a bidding number before the

sale begins, and show that number

if successful in purchasing a lot.

Please ensure that the auctioneer

repeats the number correctly when

confirming the sale. If there is any

doubt at this stage as to the

hammer price or buyer it must be

brought to the auctioneer’s attention

immediately. All lots will be invoiced

to the name and address given on

your registration form, which is non-

transferable. If you have purchased

a lot you may take your bidding

number to the accounts department

and receive an invoice immediately.

These should be submitted in

and no handling costs or additional

Resale royalties are not subject to

Occupying a position high on the banks of Derwentwater inCumbria, Lingholm was designed in the 1870s by Sir AlfredWaterhouse (1830-1905), one of the most acclaimedarchitects of the 19th century. The property was originallybuilt for Colonel J. F. Greenall of the Greenall brewingfamily, however during the 1890s it was unoccupied or letfurnished in the summer months, and in the early 1900s itwas purchased by Colonel George Kemp.

Kemp was born in Rochdale, Lancashire in 1866 and waseducated at Shrewsbury School and Balliol College, Oxford.He transferred to Trinity College, Cambridge in 1884, wherehe graduated in the ‘Classical Tripos’ in 1888. As abusinessman, Kemp entered the textile industry, eventuallybecoming Chairman of Kelsall & Kemp, flannelmanufacturers in Rochdale. From 1885 to 1892 he playedfirst-class cricket with Lancashire, scoring three centuriesin his career, and also representing Cambridge University.He was elected Member of Parliament for Heywood as aLiberal Unionist in 1895 and, in 1900, he served in the BoerWar, during which service he was mentioned in despatches.He commanded the 32nd Battalion of the ImperialYeomanry to the end of the war in 1902, and in 1909 he wasknighted for his war services.

At the January 1910 General Election he was elected MP forManchester North West, this time as a Liberal, but steppeddown from the House of Commons in 1912, declaring thathe “loathed politics”. A year later, he was raised to thepeerage as Baron Rochdale of Rochdale. Called to waragain a few years later, Lord Rochdale was LieutenantColonel in command of the 1st/6th Battalions of theLancashire Fusiliers, and was temporarily Brigadier of the127th (Manchester) Brigade of the 42nd (East Lancashire)Division during the Battle of Gallipoli in 1915.

Rochdale married Lady Beatrice Mary Egerton, thirddaughter of Francis Egerton, 3rd Earl of Ellesmere on 5August 1896. Ellesmere had inherited the estates andfamous collections at Worsley Hall in Lancaster andBridgewater House in London, and these wonderfulcollections may have encouraged Rochdale to begin his owncollections, which he did in earnest, in the tradition of otherwealthy industrialists of his time, such as Sir WilliamBurrell. As so often happens, his collecting was carried outin partnership with a scholarly dealer. Rochdale’s dealerand mentor was the famous authority on furniture andworks of art, Percy Macquoid. Macquoid (1852–1925) was atheatrical designer, collector and connoisseur of English

furniture, and the author of articles, largely for Country Life.He produced four books on the history of English furniture,the first major survey of the subject, which have beenreprinted and are still of use today: The Age of Oak, The Ageof Walnut, The Age of Mahogany and The Age of Satinwood.He collaborated with Ralph Edwards on The Dictionary ofEnglish Furniture (three volumes, 1924–1927), and severalpieces in the present collection are illustrated in thiscelebrated reference work.

Lord Rochdale was eventually to own four houses. Apartfrom Lingholm, his other homes were Beechwood inRochdale, Old Hall in Highgate, (Lord Arundel’s old house)and Gunnerside in Swaledale. Slowly these houses began tofill with early furniture and works of art, purchased frommainly London galleries and authorities of the day,including Harold Ainsworth Peto, Sir George Donaldson,Morant & Co, Mallett & Son and, of course, Macquoidhimself. All these purchases were recorded in a marvellousinventory in the possession of the current Viscount,recording dates of purchase and from whom. The inventoryrecords furniture and works of art from the 16th and 17th

centuries; oak and walnut furniture from England, Franceand Italy; Flemish and Italian tapestries and textiles; thecelebrated collection of maiolica, some sold in London in

the 1970’s, and at Lyon & Turnbull more recently, and theremainder in the present collection. There is also rare 17thcentury English silver and silver-gilt and a magnificentcollection of engraved glassware. Where it has beenpossible to identify a piece in this inventory, the informationis annotated next the appropriate lot.

When Lingholm was purchased, panelling was introducedinto the main rooms. The dining room was fitted with aparticularly spectacular carved oak fire surround, salvagedfrom James I’s Hunting Lodge near Southampton. In thehall, Spanish gilt-leather walls created a sumptuous andrich effect, a fitting backdrop to the Renaissance periodfurniture and works of art. To the side of the building, thegreat Stone Hall was created to show off the tapestries,again bought under the guidance of Percy Macquoid andincluded in the sale. The panelled walls with local slateabove the door level are centred on a magnificent ItalianRenaissance fireplace, purchased in Florence fromGiuseppe Pacini Florence on March 20th 1903. The baywindow allowed spectacular views towards the lake, takingin part of the famously planted gardens with its collection ofrhododendrons.

This collection of rhododendrons and azaleas, many plantedin the 1920s and 1930’ are one of Lingholm’s chief glories.

On acquiring the estate, LordRochdale created terraces andcommissioned Bertram Symons-Jeune to lay out the watergardens. The woods aroundLingholm were – and still are –the home of red squirrels andother woodland creatures.

These creatures captured theimagination of one of Lingholm’smost famous visitors, thechildren’s writer and illustrator,Beatrix Potter. The house wasthe favourite summer retreat forPotter and her family and in1901, whilst staying there, shesent a story and picture letterabout a red squirrel colony in

Cumberland to Norah Moore, the daughter of her formergoverness, Annie Moore. “There are such numbers ofsquirrels in the woods here,” she wrote in the letter, “Theyare all very busy now gathering nuts which they hide awayin little holes where they can find them again in winter.” Hercorrespondence was illustrated with sketches of squirrels,one of which she called ‘Nutkin’. She spent the summersketching these squirrels, the landscape around the house,and St Herbert’s Island in the centre of the lake, whichwould eventually become Owl Island in Squirrel Nutkin.Potter sketched and photographed the island from bothsides of the lake from the shores at Lingholm. The islandand its surroundings can be accurately identified fromPotter’s illustrations, one shown here from lot 151. Potteralso drew inspiration here for The Tale of PeterRabbit which uses Lingholm for scenes in the vegetablegarden, with its distinctive wicket gate.

To the end of his life, Lord Rochdale kept collecting: afamiliar figure between the wars in the sale rooms. Thecollection grew steadily, however eventually it all came toLingholm after Beechwood was demolished; Gunnersidesold, and Highgate Old Hall was destroyed after the war.The house was used as a hospital for injured servicepersonnel during World War One; however it continued toremain in the family. Lord Rochdale died in 1945 and wassucceeded by his eldest son, John, who became the firstViscount Rochdale in 1960. He was succeeded by thecurrent Viscount, St John Durival Kemp. Lord Rochdale andhis wife, Lady Rochdale, hope that the excitement andpleasure that were engendered in collecting and acquiringthese pieces will, in turn, be enjoyed by new collectors atthis sale.

Note:The use of such candlesticks or torch-stands, ofwhich numerous examples exist, has been muchdebated. However the consensus is now thatthese objects were only used as torches (mash’alin Persian). This kind of cylindrical pillar shapeclearly appeared in the second quarter of thesixteenth century and may come from north-western India. The shaft of pillar-candlesticksmay have changed from the smooth to thefaceted type around the mid sixteenth century,probably in western Iran.

The lower portion opens as adrawer, a feature introduced in the structure of boxes towardsthe close of the previous century. Under the Tudors and Stuartsthe giving of presents played an important part in diplomacy, anda number of these highly ornamented specimens are said to havebeen presented by Charles II to foreign ambassadors.”

Then she wipedthem with her hair, kissed them and poured perfumeon them." Simon reacts in protest, explaining to Jesusthat she is a sinner. Jesus explains that her actionsprove her love and penitence and forgives her sinsbefore the assembled guests. Though faithfullyemulating many aspects of Bouts' painting, this scenehas several notable differences. The figure on the farright in this version is a wine bearer, whose animatedpose enhances a sense of the dramatic within thescene. In Bouts' original however, the figure on the farright is a stern-looking Dominican monk, kneeled inprayer.

Note:Percy Macquoid was the son of theaccomplished illustrator Thomas RobertMacquoid, and after studying a the RoyalAcademy and abroad worked as anillustrator for the illustrated newspaper'The Graphic' from 1871-1890. By the endof the 19th century he was activelydesigning for theatrical productions, andwas a favoured designor of the notedactor and producer Herbert BeerbohmTree. He was also a keen collector andscholar of antique furniture, contributingarticles to 'Country Life', writing andcompiling four highly influential books onthe subject beginning in 1904 with 'TheAge of Oak', then continuing with 'The Ageof Walnut', the Age of Mahogany', and'The Age of Satinwood'. He latercollaborated with Ralph Edwards on 'TheDictionary of English Furniture', stillregarded as the most comprehensivestudy of the British furniture andconsidered a standard reference for thissubject.Macquoid was probably introduced to the1st Lord Rochdale through the Colonel'scousin Harold Peto, whose name appearsregularly in the household inventory as asupplier of furniture and furnishings toLingholm. Macquoid served as an advisorto Lord Rochdale, makingrecommendations and suggestions forpossible acquisitions. It was under hismentorship that the Stone Room atLingholm was built to accommodate theseries of tapestries.

Note:Emily Georgiana Kemp was born in1860 into a wealthy Baptist familywho made their money during theindustrial revolution, she was oneof the first students at theSomerville College, one of the firstwomen’s colleges in Oxford, latercontinuing her studies at the SladeSchool of Fine Art.Following her studies Kemptravelled through China, Korea,India, central Asia and the Amazon,she sketched, painted and wroteperceptive journals throughout hertravels, turning her focus to theeducation and welfare of women inthese countries, particularly theirrole in religion.In 1909 Kemp travelled to Chinaand wrote what would be the first ofsix books, The Face of China. Itwould appear that she served as anurse during the war, spendingmost of her time in France.However, at the end of the war shedecided to continue her travels, andsubsequently received the awardfrom the French GeographicalSociety for writing Chinese Mettle,a travelogue of her time spent inChina in 1921. STANDARD TERMS &CONDITIONS OF SALE

Lyon & Turnbull carries on business withbidders, buyers and all those present inthe auction room prior to, or inconnection, with a sale on the followingGeneral Conditions and on such otherterms, conditions and notices as may bereferred to herein.

1. DEFINITIONS

In these Conditions:

(a) “Auctioneer” means the firm of Lyon &Turnbull or its authorised auctioneer, asappropriate;

(b) “deliberate forgery” means animitation made with the intention ofdeceiving as to authorship, origin, date,age, period, culture or source but which isunequivocally described in the catalogueas being the work of a particular creatorand which, at the date of the sale, had avalue materially less than it would havehad if it had been in accordance with thedescription;

(c) “hammer price” means the level ofbidding reached (at or above any reserve)when the auctioneer brings down thehammer;

(d) “terms of consignment” means thestipulated terms and rates of commissionon which Lyon & Turnbull acceptsinstructions from sellers or their agents;

(e) “total amount due” means thehammer price in respect of the lot soldtogether with any premium, Value AddedTax chargeable and any additional chargespayable by a defaulting buyer under theseConditions;

(f) “sale proceeds” means the net amountdue to the seller, being the hammer priceof the lot sold less commission at thestated rate, Value Added Tax chargeableand any other amounts due to us by theseller in whatever capacity and howeverarising;

(g) “You”, “Your”, etc. refer to the buyer asidentified in Condition 2.

(h) The singular includes the plural andvice versa as appropriate.

2. BIDDING PROCEDURES AND THEBUYER

(a) Bidders are required to register theirparticulars before bidding and to satisfyany security arrangements before enteringthe auction room to view or bid;

(b) the maker of the highest bid acceptedby the auctioneer conducting the saleshall be the buyer at the hammer priceand any dispute about a bid, which mustbe raised before the next lot is offered,shall be settled at the auctioneer’sabsolute discretion.

(c) Bidders shall be deemed to act asprincipals.

(d) Once made, no bid may be withdrawn.

(e) Our right to bid on behalf of the selleris expressly reserved up to the amount ofany reserve and the right to refuse any bidis also reserved.

3. INCREMENTS

Bidding increments shall be at theauctioneer’s sole discretion.

4. THE PURCHASE PRICE

The buyer shall pay the hammer pricetogether with a premium thereon.

25% up to £25,000 / 20% thereafter.

VAT will be charged on the premium at therate imposed by law.

5. VALUE ADDED TAX

Value Added Tax on the hammer price isimposed by law on all items affixed withan asterisk (*) or dagger (†). Value AddedTax is charged at the appropriate rate

prevailing by law at the date of sale and ispayable by buyers of relevant lots.

6. PAYMENT

(1) Immediately a lot is sold you will:

(a) pay to us the total amount due in cashor in such other way as is agreed by us.We accept cash, bank transfer (details onrequest), Switch or Debit Cards and Visaor MasterCard (please note there is asurcharge of 2% (VAT included) whenusing credit cards). We do not acceptAmerican Express.

(2) any payments by you to us may beapplied by us towards any sums owingfrom you to us on any account whateverwithout regard to any directions of you oryour agent, whether express or implied.

7. TITLE AND COLLECTION OFPURCHASES

(1) The ownership of any lots purchasedshall not pass to you until you have madepayment in full to us of the total amountdue.

(2) You shall at your own risk and expensetake away any lots that you havepurchased and paid for not later than fourworking days following the day of theauction or upon the clearance of anycheque used for payment after which youshall be responsible for any removal,storage and other associated charges.

(3) No purchase can be claimed orremoved until it has been paid for.

(4) It is the buyer’s responsibility toascertain collection procedures,particularly if the sale is not being held atour main saleroom and the potentialstorage charges for lots not collected bythe appropriate time.

8. REMEDIES FOR NON-PAYMENT ORFAILURE TO COLLECT PURCHASES

(1) If any lot is not paid for in full and takenaway in accordance with these Conditionsor if there is any other breach of theseConditions, we, as agent for the seller andon their behalf, shall at our absolutediscretion and without prejudice to anyother rights we may have, be entitled toexercise one or more of the followingrights and remedies:

(a) to proceed against you for damages forbreach of contract;

(b) to rescind the sale of that lot and/orany other lots sold by us to you;

(c) to resell the lot (by auction or privatetreaty) in which case you shall beresponsible for any resulting deficiency inthe total amount due (after crediting anypart payment and adding any resale costs).Any surplus so arising shall belong to theseller;

(d) to remove, store and insure the lot atyour expense and, in the case of storage,either at our premises or elsewhere;

(e) to charge interest at a rate of 1.5% permonth above the current base rate on thetotal amount due, to the extent it remainsunpaid for more than four working daysafter the sale;

(f) to retain that or any other lot sold toyou until you pay the total amount due;

(g) to reject or ignore bids from you oryour agent at future auctions or to imposeconditions before any such bids shall beaccepted;

(h) to apply any proceeds of sale of otherlots due or in future becoming due to youtowards the settlement of the total amountdue and to exercise a lien (that is a right toretain possession of) any of your propertyin our possession for any purpose until thedebt due is satisfied.

(2) We shall, as agent for the seller andon their behalf pursue these rights andremedies only as far as is reasonable tomake appropriate recovery in respect ofbreach of these Conditions

9. THIRD PARTY LIABILITY

All members of the public on ourpremises are there at their own risk andmust note the lay-out of theaccommodation and securityarrangements. Accordingly neither theauctioneer nor our employees or agentsshall incur liability for death or personalinjury (except as required by law by reasonof our negligence) or similarly for thesafety of the property of persons visitingprior to or at a sale.

10. COMMISSION BIDS

While prospective buyers are stronglyadvised to attend the auction and arealways responsible for any decision to bidfor a particular lot and shall be assumedto have carefully inspected and satisfiedthemselves as to its condition we shall ifso instructed clearly and in writing executebids on their behalf. Neither theauctioneer or our employees or agentsshall be responsible for any failure to doso. Where two or more commission bidsat the same level are recorded we reservethe right in our absolute discretion toprefer the first bid so made.

11. WARRANTY OF TITLE ANDAVAILABILITY

The seller warrants to the auctioneer andto you that the seller is the true owner ofthe property consigned or is properlyauthorised by the true owner to consign itfor sale and is able to transfer good andmarketable title to the property free fromany third party claims.

12. AGENCY

The auctioneer normally acts as agentonly and disclaims any responsibility fordefault by sellers or buyers.

13. TERMS OF SALE

The seller acknowledges that lots are soldsubject to the stipulations of theseConditions in their entirety and on theTerms of Consignment as notified to theconsignor at the time of the entry of thelot.

14. STANDARD VENDOR FEES ANDCHARGES (Subject to VAT)

(1) Commission: 15% of the first £3000 and10% thereafter is charged on the sellingprice of each lot (subject to a minimumcharge of £30). Loss and damagewarranty: 1.5% on value of lots sold.Photography: max £40 mono per lot, max£250 colour. Internet Marketing Service:£10 per lot.

(2) If a vendor wishes to withdraw a lotorganized for sale, a withdrawal fee willapply;

(a) If withdrawn over 28 working days priorto the sale, this will be charged at 10% ofthe mid estimate along with any ancilliaryincurred (such as photography), all subjectto VAT at the current rate.

(b) If withdrawn within 28 working days ofthe sale, this will be charged at 20% of themid estimate along with any ancilliaryincurred (such as photography), all subjectto VAT at the current rate.

15. DESCRIPTIONS AND CONDITION

(1) While we seek to describe lotsaccurately, it may be impractical for us tocarry out exhaustive due diligence on eachlot. Prospective buyers are given ampleopportunities to view and inspect beforeany sale and they (and any independentexperts on their behalf) must satisfythemselves as to the accuracy of anydescription applied to a lot. Prospectivebuyers also bid on the understanding that,inevitably, representations or statementsby us as to authorship, genuineness,origin, date, age, provenance, condition orestimated selling price involve matters ofopinion. We undertake that any suchopinion shall be honestly and reasonably

held and accept liability for opinions givennegligently or fraudulently. Subject to theforegoing neither we the auctioneer or ouremployees or agents or the seller acceptliability for the correctness of suchopinions and all conditions andwarranties, whether relating todescription, condition or quality of lots,express, implied or statutory, are herebyexcluded. This Condition is subject to thenext following Condition concerningdeliberate forgeries and applies save asprovided for in paragraph 6 “information tobuyers”.

(2) Private treaty sales made under theseConditions are deemed to be sales byauction for purposes of consumerlegislation.

16. FORGERIES

Notwithstanding the preceding Condition,any Lot which proves to be a deliberateforgery (as defined) may be returned to usby you within 21 days of the auctionprovided it is in the same condition aswhen bought, and is accompanied byparticulars identifying it from the relevantcatalogue description and a writtenstatement of defects. If we are satisfiedfrom the evidence presented that the lot isa deliberate forgery we shall refund themoney paid by you for the lot including anybuyer’s premium provided that (1) if thecatalogue description reflected theaccepted view of scholars and experts asat the date of sale or (2) you personally arenot able to transfer a good and marketabletitle to us, you shall have no rights underthis condition.

The right of return provided by thisCondition is additional to any right orremedy provided by law or by theseConditions of Sale.

GENERAL

17. We shall have the right at ourdiscretion, to refuse admission to ourpremises or attendance at our auctions byany person.

18 (1) Any right to compensation for lossesliabilities and expenses incurred in respectof and as a result of any breach of theseConditions and any exclusions provided bythem shall be available to the sellerand/or the auctioneer as appropriate.

(2). Such rights and exclusions shallextend to and be deemed to be for thebenefit of employees and agents of theseller and/or the auctioneer who maythemselves enforce them.

19. Any notice to any buyer, seller, bidderor viewer may be given by first class mailin which case it shall be deemed to havebeen received by the addressee 48 hoursafter posting.

20. Special terms may be used incatalogue descriptions of particularclasses of items (Books, Jewellery,paintings, guns, firearms etc) in whichcase the descriptions must be interpretedin accordance with any glossary orguidance notes appearing in thecatalogue. These notices and terms willalso form part of our terms and conditionsof sales.

21. Any indulgence extended to biddersbuyers or sellers by us notwithstandingthe strict terms of these Conditions or ofthe Terms of Consignment shall affect theposition at the relevant time only and inrespect of that particular concession only;in all other respects these Conditionsshall be construed as having full force andeffect.

22. Scottish law applies to theinterpretation of these Conditions.
