This guide is designed to provide information about legal issues facing Chester County’ssenior citizens, their caregivers and families. It also lists a number of available resourcesThe Chester County Bar Association has published this guide to help seniors makeappropriate choices so that they can maximize personal autonomy, minimize costs, have

an understanding of applicable legal concepts, and protect themselves against predatorsbent on deceiving, exploiting or defrauding them.

No publication can cover all of the legal issues relating to a group as diverse as the seniorcitizens of Chester County. These materials are, moreover, for informational purposesonly. They are not intended to be, and do not constitute any substitute for, legal adviceor legal opinions on any specific fact or issue. FOREWORD

In the past 20 years, Elder Law developed as a separate specialty because of the issuesfaced by older persons. The baby boomers born after World War II were adding to the“graying of America” – including Chester County. They had problems. Attorneys learnedto address these issues. That body of knowledge led to a separate specialty – “ElderLaw”.

The National Academy of Elder Law Attorneys (NAELA), founded in 1987, now has 4,000members, helping attorneys keep high standards in their work with older clients.

Because an older child often brings a senior parent to the appointment with a lawyer,the attorney has to solve the problem: “Who is the client?” After the interview, the lawyerdecides the best way to make sure the parent’s wishes are identified and respected. Incommunicating with the child and parent, the attorney identifies the client (or clients),decides what can be done to solve the problem, discloses relevant foreseeable conflictsamong the clients, explains his (or her) obligation of confidentiality and need for sharinginformation among joint clients, sets out the fee arrangement, and, finally, explains whenand how the client-lawyer relationship may end. At that point, if the clients accept thelawyer’s terms, the attorney-client relationship begins

It is important for the Elder Law attorney to use his or her understanding of the physicalcognitive and psycho-social challenges of aging and disability, and the skills needed toserve persons physically or mentally challenged.

The attorney offers counsel and representation for critical life decisions, to preserve andpromote the client’s dignity, self-determination and quality of life in the face of competinginterests and alternatives. He or she informs the client about long-term care options, risksconsequences and costs, emphasizing asset preservation, including estate planning and

tax implications of estate and asset preservation strategies.

In summary, the Elder Law attorney helps the older client to solve problems of health,housing, care and financial planning.

CONTINUING LEGAL EDUCATION

Since 1992, Pennsylvania’s attorneyshave been required to take at leasttwelve hours each year of continuinglegal education including the Rules of Professional Conduct and professional-ism in general. This should have a pos-itive impact on the ethical delivery of legal services, but it is still important for older clients to remember their rights asthey work with their lawyers.

Pennsylvania Lawyers Fund for ClientSecurity

 Although the percentage of lawyers in-volved in fraud and theft is extremelylow, the news is often given wide play inthe media. The fact is that lawyers areoften put in positions of trust and temp-

tation which occasionally, though rarely,result in a financial loss to a client. Insuch cases, the Pennsylvania LawyersFund for Client Security can help torecoup some or all of the losses. Claimsare submitted on pre-printed forms fromthe Supreme Court of Pennsylvania,telephone 1 (800) 962-4618.

Choosing an Attorney

Every individual has notions about howto work with a professional advisor toresolve personal problems. To choosethe best person to act on your behalf inlegal matters, you should first think aboutyour goals. Is it a simple question of up-

dating your will, or is it the more complexprocess of planning the series of finan-cial steps for retirement and changesin life situations? Once your needs areoutlined, you can consult friends, rela-tives, business colleagues, clergy and

others for recommendations about at-torneys. Another source of informa-tion is the Chester County Bar Associa-tion Lawyer Referral Service (610)429-1500. They are open from 8:30 to 4:30Monday through Friday, except for legalholidays. That office can help you deter-mine if you might qualify for legal servic-es assistance.

Older Americans Act

The Older Americans Act, which is afederal law, passed in 1965 establisheda basic framework for programs for seniors and their caregivers and set up

 Area Agencies on Aging (AAA) through-out the United States. In 2000, the Act

was expanded to include the Nation-al Family Caregiver Support Programwhich funds programs for information,assistance, counseling, respite care,and supplemental services for care-givers. Information and assistance re-garding Caregiver Support in Chester County is handled through our local

FINANCIAL PLANNING

The need for senior citizens to proper-ly plan is more critical now than it has

ever been in the past. Due to advanc-es in health care, the fastest growingsegment of our population is now thesegment over age 85. The U.S. popu-lation is aging in such a manner thatseniors may now live twenty or thirtyyears or more after they retire. There-fore, it is essential that senior citizensplan for a secure source of income for 

their use during retirement and maxi-mize the use of benefits afforded themunder the current law - both state andfederal.

Sufficient Income During Retirement

To adequately insure that there is suffi-cient income during the retirement years,

each senior citizen should develop hisor her financial plan (i.e. objectives postretirement and the plan for achievingthose objectives) as early as possible.Individuals should identify their poten-tial income needs, health care costs,housing costs, property management inthe event of incapacity, and the disposi-tion of their estates following death.

Social Security Retirement Benefits

For most senior citizens, Social Secu-rity retirement benefits begin at age 65or soon thereafter. Depending upon theextent of the individual’s other income,these benefits may be subject to income

tax. For questions concerning the ben-efits you may be entitled to upon retire-ment, contact your local Social Security

 Administration office or visit their websiteat: http://www.ssa.gov.

Individual Retirement Accounts (IRAs)

Traditional IRAs or annuities are taxablefor income tax purposes. However, thetax treatment of distributions from theIRAs will depend on the individual’s ageat the time of distribution. Distributionsmade from such accounts before anindividual has reached age 59 1/2 are

taxed, and they are also subject to anadditional 10% penalty tax unless thedistribution qualifies for an exception.Once the individual reaches age 591/2, distributions are subject to ordinaryincome tax but are no longer subject tothe penalty tax.

Even if he or she does not need the

money, the owner of a traditional IRAmust begin to receive the entire balanceof his or her IRA through periodic distri-butions by April 1st of the year follow-ing the year in which he or she reachesage 70 1/2. If the IRA owner fails to takethe required minimum distribution in anyyear, he or she will be required to paya 50% excise tax for that year on the

amount not distributed as required.

 Annuities

  Annuities offer a steady stream of income. Each payment received in-cludes a return of the investment made,as well as an interest component. An-

nuities may be purchased from insur-ance companies or arranged privately.However, private annuities involve a riskof loss. For death tax purposes, annui-ties which terminate at death are nottypically included as a part of the annu-

itant’s taxable estate but to the extentthere is any value passing to or for thebenefit of an heir of the annuitant, suchbenefit may be taxed for death tax pur-poses, as well as income tax purposes. 

REVERSE MORTGAGES

In retirement many seniors are land richbut cash poor and typically cannot qualify

for loans. Recognizing this dilemma, thefederal government passed a law autho-rizing home equity conversion mortgag-es for older homeowners. The law is in-tended to mitigate the hardship causedsome seniors by the increased costsof health, housing and subsistence. Inthese so-called “reverse mortgages” alender loans money to a borrower using

the borrower’s home as security. Theloan proceeds may be disbursed in asingle lump sum, monthly payments, or through a line of credit. Unlike tradition-al mortgages, which are usually repaidin monthly installments, reverse mort-gages are repaid at death, at a speci-fied maturity date, at resale of the home,or at refinancing of the mortgage. These

mortgages are a good way to overcomethe “house rich but cash poor” dilemmathat confronts many elderly homeown-ers.

These mortgages may be providedby the federal government as HOMEEQUITY CONVERSION MORTGAGES,or by state or local government agen-

cies, or by banks and private lenders.Home equity conversion mortgagesthat are provided by the federal govern-ment may require that the funds be usedfor a specified purpose, such as homerepairs, and the borrower may have tomeet certain income requirements.

Basic Requirements

Borrowers must be age 62 or older;there is no maximum age limit. Themortgaged property must be a one-unitdwelling used as the principal residence

of the borrower. The property must be ingood repair; proceeds from the reversemortgage may be used to make neededrepairs. The property to be mortgagedmust be free and clear of a mortgageor almost mortgage-free. The borrower may be required to pay the balance of the mortgage from the proceeds of thereverse mortgage.

The Federal Housing Administra-tion (FHA) insured reverse mortgageprogram is administered by the Depart-ment of Housing and Urban Develop-ment (HUD). A borrower’s age, the geo-graphic area and the value of the homedetermine the maximum amount avail-able under this program. HUD permits

an agent appointed by a properly draftedpower of attorney to apply for a reversemortgage on behalf of an elderly hom-eowner. For free information from HUDabout reverse mortgages, call 1(888)466-3487.

Private lenders such as local banks mayalso offer reverse mortgages and may

have more flexibility in setting maximumloan amounts or placing higher agelimits on borrowers. Generally speaking,it is an event of default for a borrower to move from the property. This means,for instance, that a single homeowner who expects to move soon to assistedliving or skilled care should not consid-

er paying for his nursing home bill witha reverse mortgage. He might insteadsell the residence and use the proceedsfor his long term care. A private lender might permit a loan and payments tocontinue even if the a borrower does

not live at the home. However, overallcosts and interest rates may be higher.Contact your local banking institution toask if they offer reverse mortgage prod-ucts and compare details to make thebest choice for your situation. Remem-ber to include closing costs on the loanand interest rates when running calcula-tions.

While reverse mortgages do not ad-versely affect an individual’s receipt of Social Security or Medicare benefits,reverse mortgage proceeds which areheld beyond the month they are receivedare considered “liquid assets” and mayadversely affect eligibility for SSI andMedicaid benefits.

  Another important factor to note isthat these reverse mortgages are“nonrecourse” loans. This means thatyou can never owe more than the valueof the home at the time the loan isrepaid. A lender seeking repayment hasno recourse other than the value of your home. Further information regarding

PROPERTY TAX AND RENT

REBATES

The Property Tax/Rent Rebate Program

began in 1971 to assist elderly citizensto maintain their homes. Under thisprogram, a person living on a limitedincome may be eligible to receive arebate of some part of the money paidfor property taxes or rent during the pre-vious calendar year. Rebates depend onthe claimant’s income level and actualtax or rental costs.

The current (2006) maximum amountpayable under the program is $500 andthe 2006 maximum income for appli-cants is $15,000 per year. Excludedfrom income for purposes of determin-ing eligibility is 50% of Social Security or Railroad Retirement income, as applica-ble. Therefore, for example, a single or 

widowed person with $16,000 per year income from Social Security alone wouldbe counted as receiving $8,000 per year and would qualify. Persons living insubsidized housing may only claim thatamount actually paid in rent.

On June 27, 2006, the Property Tax/ Rent Rebate Program was expanded 

significantly by the passage of Special Session House Bill 39 (SS HB 39). For applicants filing in 2007, the house-hold eligibility income limit has been in-creased from $15,000 to $35,000 and the maximum rebate, depending onincome and actual taxes paid, has beenincreased from $500 to $650.

To be eligible for a property tax/rentrebate, the individual:

t must own and occupy theproperty for which a rebate isclaimed; or, rent and occupy a

property for which the owner paid property taxes. In either case, the property must be theprincipal residence;

t must be a Pennsylvania residentage 65 or older or have aspouse

t age 65 or older living in the same

household;t can be age 50 or older if 

widowed;

t can be permanently disabledand age 18 or older, meetingthe Social Security disablilityrequirements;

t must meet the income eligibility

requirements as describedabove.

Claims applications must be filedbetween January 1 and June 30 of theyear following the year in which the taxesor rent was paid. In addition, ownersmust have paid taxes prior to filing andrenters must make certain their landlords

were required to pay property taxes or made payments in lieu of property taxeson the rental property.

Rebate checks are mailed beginningJuly 1 each year. Proof of income is re-quired, such as copies of the state or federal income tax returns for the claim

year in which you are filing. If you areclaiming a rent rebate, you must includeproof of the rent you paid, such as an af-fidavit signed by the landlord or the land-lord’s agent. If the landlord’s signaturecannot be obtained, the claimant must

complete and submit a notarized rentaloccupancy permit.

Persons who qualify for the property taxand rent rebate program may also be el-igible for PACE or PACENET, which areprescription drug programs funded bythe Pennsylvania lottery (See page 43for more information).

INCOME TAX PLANNING

 As there are tax laws which inure to thebenefit of the elderly, senior citizens

should familiarize themselves with suchinformation and utilize these laws wher-ever possible. For a general guide tothe tax laws affecting the elderly, seeInternal Revenue Service, Publication554, “Older Americans’ Tax Guide.” Thispublication is available free of chargeby contacting the IRS at 1 (800) 829-3676 or at its website at: http://www.irs.

ustreas.gov.

Tax Return Preparation

Many seniors fail to effectively utilizethe tax laws which are beneficial tothe elderly, because they are unable toafford professional tax assistance. For those seniors with limited means, volun-

teer tax preparation and filing assistanceare available through several programs,such as Volunteer Income Tax Assis-tance (VITA) and Tax Counseling for theElderly (TCE), programs coordinated bythe IRS. Local libraries may also be ableto recommend a convenient programsite. Many Senior Centers in Chester County during tax season offer free tax

assistance and tax return preparationthrough volunteers. Information canbe obtained by calling your local Senior Center listed in the white pages of your telephone directory.

The American Association of RetiredPersons (AARP) offers assistance in

many communities through their Tax Aide program. Like VITA and TCE, thisprogram offers free assistance in pre-paring tax returns to elderly people of modest means. To locate the nearestTax Aide site, contact the AARP at

1(888)227-7669 or at their website:http://www.aarp.org.

The IRS also provides walk-in tax returnpreparation services free of charge at itsservice centers.

Standard Deduction at Age 65

 As stated above, federal income tax lawsapply to all Americans; however, certainprovisions give beneficial tax treatmentto seniors. One such benefit is the ad-ditional standard deduction for taxpay-ers who have reached age 65 and whodo not itemize their deductions. Belowis a chart demonstrating the additionalstandard deduction, depending upon

filing status. In order to use the addi-tional standard deduction, the taxpayer must have reached the age of 65 beforethe end of the year for which the returnis being filed. However, an individualwhose birthday falls on January 1 of thesucceeding year, is permitted to utilizethis additional deduction for the tax year preceding his or her reaching age 65.

 A U.S. citizen age 65 or older (or retiredon a permanent basis and on total dis-ability) may be able to take this credit if income does not exceed a certain limit.For tax year 2006, the maximum creditavailable is $1,125.00. As it can be quitecomplicated, it may be helpful to obtainthe assistance of a tax professional toproperly calculate the credit due.

Medical Expense Deductions

If deductions are itemized, medical ex-penses are deductible to the extent

they exceed 7 1/2 % of adjusted grossincome. Please keep in mind that thededuction is limited to unreimbursed out-of-pocket medical expenditures. Exam-ples of deductible expenses include:

Expenditures for medicine, if the medi-cine was prescribed by a physician;

 All the costs associated with a long-termcare facility, including meals and lodging,if the principal reason for admission isthe availability of medical care;

Personal care services, if provided pur-suant to a plan of care prescribed by alicensed health care practitioner. Sinceassisted living care is not traditionallyskilled medical care, only a portion of thecosts associated with such care may bedeductible. The assisted living facilityshould be able to tell you the portion of each payment which is deductible; and

Capital expenditures for equipment andhome modifications to accommodatethe handicapped to the extent they don’tincrease the market value of the resi-dence. For instance, wheelchair rampsand widening of entrances are deduct-ible improvements.

Personal Dependent

If you provide more than 50% of thesupport of a relative, you may be ableto claim that relative as a dependent onyour tax return and as such receive adeduction, provided all of the other ele-ments required by law are met:

The relative’s gross income for that year must be less than $3,300 (in 2006) notincluding nontaxable income such aswelfare benefits or nontaxable SocialSecurity benefits; and

The relative must not have filed a jointreturn with his or her spouse.

Medical Deduction

Even if you are unable to claim a relativeas a dependent, the relative’s medicalexpenses paid by you may be deduct-

ible, if you (or in certain cases, you andothers) provided over 50% of the rela-tive’s total support for the calendar year.The availability of this deduction is notdependent on the income received bythe relative in that calendar year.

Dependent Care Credit

If a parent is dependent upon his or her child for support, regardless of the par-ent’s income, the child may be entitledto this credit, if the parent is incapable(physically or mentally) of providing hisor her own personal care. However,please note it is often more beneficial toclaim the medical expenses as deduc-

tions than to use the credit.

Tax Basis

To properly prepare your income taxreturn, you or your tax preparer will needto know the “tax basis” for each capitalasset (e.g. stock, real estate, etc.) soldwithin that tax year. The tax basis of an

asset is critical to accurately computingthe capital gain or loss resulting from thesale of an asset. The maximum currentcapital gains rate for long term invest-ments is now generally 15%. It can belower, depending on your income level.Typically, tax basis in property is theinitial purchase price of that property, in-

creased in certain instances for major improvements made over the years tosuch property. For instance, if person

 A purchases a house for $200,000 andlater puts a deck on the house at a costof $20,000, person A’s tax basis in the

property is $220,000.

Transfers (Gifts vs. Inheritance)

Using the example above, if person Amakes a gift of the house to his son, hisson’s tax basis in the house will be thesame as person A’s tax basis. Son re-ceives a “carryover” basis of $220,000.

If son then sells the house for $400,000,son will be taxed on $180,000 of capitalgain [$400,000 – 220,000 = 180,000].

If, instead, person A does not give thehouse to his son during his lifetime butat A’s death his son inherits this houseand immediately sells it for $400,000,the son’s basis in the house “steps up”

to $400,000 (value at time of death) andas such, there is no capital gain recog-nized upon the sale. An individual’s taxbasis in inherited property is typicallythe fair market value of such propertyon the decedent’s date of death. Taxbasis consequences, as well as other tax considerations, need to be analyzedwhen determining which assets should

be transferred, if any, and which shouldbe retained. As the tax consequencesof such transfers can be significant, it isprudent to seek the advice of a tax pro-fessional before undertaking such trans-fers. Understanding and carefully docu-menting tax basis can result in signifi-cant tax savings to an individual.

There are other non-tax consequencesthat can follow transfer of a residenceor other property to family members or others including some severe penaltiesassociated with the Medicaid program if 

skilled nursing care is later required. Todetermine whether these issues apply,you should obtain both tax and ben-efits advice before deciding to transfer assets.

Sale of Residence (Exclusion of Gainfrom Income)

Much of the capital gain arising from thesale of a personal residence may be ex-cluded from taxation. Under the currentfederal law, you may be able to excludeup to $250,000 of capital gain on the saleof your principal residence ($500,000 ona joint return in most cases). In fact, if all of the gain can be excluded, the saleneed not even be reported on your tax

return.

This exclusion can be used more thanonce, and does not require the purchaseof a replacement residence. However,this exclusion is only available if all thefollowing are true each time:

t You (or your spouse) haveowned the residence for at

least two of the five yearspreceding the sale;

t You have used the home asyour main residence for atleast two of the five yearspreceding the sale; and

t During the two year period

ending on the date of sale, youhave not excluded gain fromthe sale of another home.

There are special exceptions that mayapply if you did not reside in the homefor a portion of this period because your 

care demanded that you live in a nursinghome.

If you are married and wish to use the$500,000 exclusion, you must file a jointreturn with your spouse for the tax year of the sale, both of you must fulfill theresidency requirement, and neither of you may have used the exclusion within

the past two years.

ESTATE PLANNING

Many people think the term “estateplanning” applies only to very wealthy

people. Nothing is further from the truth. An estate is simply what you own. If youown property, you need to plan ahead inorder to make sure the desired peopleor institutions inherit your property after your death.

If you die without a Will, your assets,including your home, money and other 

property will be distributed to your heirsaccording to the Pennsylvania Intestacylaws. Without a Will, you have no controlover the manner in which your propertyis distributed upon your death.

The existence of a well-consideredestate plan, most importantly a will, canhelp avoid disputes among your heirs

and will give you the peace of mindthat comes with knowing that your finalwishes will be carried out.

It is best to consult with a local attorneywhose practice includes or concentratesin estate planning to discuss your needsand wishes. You should select an individ-ual with whom you feel comfortable and

who will help you in designing a plan tosuit your needs, wishes and budget. Thecost will certainly be less than the muchgreater amounts that may be wasted if you do not have a professionally pre-pared will and other documents.

The Will

 A will is an important legal document andthe cornerstone of most estate plans. Ina will you direct how your property is tobe distributed and you also name a per-sonal representative to administer your 

estate.

The personal representative named ina will is commonly referred to as the“executor.” An executor collects theestate assets, pays the estate debts andmakes distributions to the beneficiariesyou have designated in your will.

It is generally advisable to nominate oneexecutor and an alternate in your willrather than naming two individuals toserve as your co-executors. Co-execu-tors frequently have difficulty getting pa-perwork signed in a timely manner andcan delay estate administration. More-over, disagreements between co-execu-tors can increase the time and costs of 

administration.

If you already have a Will, take it outand reread it. Do you understand whatit says? Do you agree now with the ar-rangements you made earlier? Updateyour Will if circumstances have changed.Marriage, death, divorce, birth, asset

growth, moving to a different state or achange in estate tax laws are events thatmay trigger the need for you to reviseyour will. A good rule-of-thumb is toreview your Will at least once every fiveyears. Significant changes in the federal

tax law were made with the passage of the Economic Growth and Tax Relief Reconciliation Act of 2001 and in everyyear since then.

Keep your original Will in a secure placesuch as a fire-proof box, a safe depositbox at your bank or with your attorney.If your lawyer is holding your will, ask

whether it is being held in a fire-proof vault or other protected location.

If you are afraid that somebody mighttamper with or destroy your Will if theywere to read it, leave it with your lawyer or place it in a safe deposit box where itscontents will be kept private. In Pennsyl-vania, a safe deposit box is accessible

upon death of the owner for the limitedpurposes of retrieving the decedent’sWill and cemetery deed. Under Penn-sylvania law, the safe deposit box is notfrozen, i.e. sealed, if the co-owner of thebox is the surviving spouse.

You have the right to request your orig-inal estate planning documents from

your attorney at any time. The docu-ments belong to you, not your lawyer.You also have the right to revoke your Will and write a new one at any time youchoose, providing you have the mentalcapacity to do so.

Ownership of Property

Your will only controls property whichyou hold in your name alone. It does notcontrol property which is subject to ben-eficiary designations, or property held

 jointly with others with rights of survivor-ship, or “Transfer on Death” accounts.So a Will giving everything equally toyour children may not accomplish this if accounts are in joint name with one of the children “for convenience”.Often people do not understand thelegal consequences of the way their property is titled, and they make serious

errors by placing the names of otherson their accounts or on the deed to their houses. You should consult with an at-torney experienced in Estate Planningbefore changing the title to bank ac-counts, brokerage accounts or deeds.Is it very important to you and to thosethat you wish to benefit that your inten-tions are not frustrated by account des-

ignations which are inconsistent with theway you want your property distributedat your death.

Friends, bank employees, and brokersshould not be relied upon to make estateplanning decisions. Improper titling of property, accounts and beneficiary des-ignations frequently result in unintend-

ed unequal divisions, insufficient fundsto pay taxes and expenses, and bit-terness among heirs. Placing a child’sname on an account could also exposethe account to the creditors of the childand involve you in litigation over the trueownership of your assets.

Non-Probate Property Just as you need to review your Will pe-riodically, you should check the benefi-ciary designations on your life insurance

policies and retirement accounts to makesure they are up-to-date. Many peopleselect beneficiaries when purchasinga life insurance policy or opening their accounts but never recheck these deci-sions. It is particularly important to do soas families change over the years.

Jointly-held property, accounts held

“in trust for <name>” (ITF), accounts“payable on death to <name>” (PODor TOD), and annuities do not pass ac-cording to the provisions of your will, butpass by law to the designated beneficia-ries or to the survivors listed in the title.Be sure to review these carefully whendeveloping your estate plan.

Trusts

Your attorney might recommend the useof a “trust” in larger estates, estates withyoung beneficiaries and in situationswith special circumstances. What is atrust? Many estate planners explain thata trust is like a box where you can placeyour property. A person places money

in the box, the trust, and designates amanager, known as the “trustee,” tosafeguard the contents of the box. Thetrustee then distributes trust assets tothe beneficiaries you select, in suchamounts and at such times as you direct.Of course the money is not really put ina box. The “box” is usually a brokerage

account or a bank account where thefunds are invested by your trustee. For example, a grandparent may wishto set aside money for a disabled grand-child, but may be afraid to do so for fear 

of disqualifying that grandchild fromcertain government benefits. A grand-parent could place the money in a care-fully drafted trust which may be referredto as a Special Needs Trust or Supple-mental Needs Trust, designate a trusteeto invest and safeguard the funds andenable the disabled child to benefit fromthe trust while maintaining eligibility for 

government benefits such as Medicaidor Supplemental Security Income (SSI)payments.

There are many other types of trusts.Credit shelter trusts, also called “by-pass trusts,” are commonly used to helpprotect large estates from federal estatetaxes. Support trusts typically make

payments to beneficiaries based on astandard of providing for health, educa-tion, maintenance and support. Trustscan also be used to set aside money for designated purposes, such as for edu-cation. Discretionary trusts and “incomeonly” trusts can be written to protectspendthrift beneficiaries from squander-ing their inheritance through wasteful

spending habits.

Trusts usually cost more money to createthan a simple will because they are morecomplicated and must be customizedfor each particular situation. In additionto the costs of drafting a trust, there arecontinuing attorneys’ fees and trustees’

commissions over the years as a trustis administered. Many trusts require thefiling of fiduciary income tax returns; ac-cordingly, an accountant’s services areoften needed to help prepare and filethese tax returns. Obviously you need

to consider the ongoing administrativecosts as you decide whether it makessense to create a trust. Generally,however, if you are in a situation wherethe use of a trust would be advisable,the benefits of the trust will far outweighthe administrative costs.

Revocable Living Trusts

Before preparing a living trust, you mustdetermine whether it will be useful for your situation. Generally, in Pennsyl-vania, there is no substantial benefit of the use of a revocable living trust over aproperly drafted will.

  Although revocable living trusts, when

properly drafted, and when used in theappropriate situation, can be valuableparts of a client’s overall estate plan,in recent years living trust scams havebecome increasingly common. Pro-moters of such scams frequently targetseniors through “free” seminars and mailsolicitations because they know thatseniors are concerned about making

sure their “affairs are in order” and can besusceptible to high pressure sales tech-niques. Living trust scam promoters em-phasize the allegedly high fees, delaysand damaging psychological impact of the probate process, and suggest thatyou can avoid all these fees by using arevocable living trust. Living trust scam

promoters also sometimes promise thata revocable living trust will allow you toavoid death taxes and the possibility of a challenge by disgruntled heirs or thatthey will “save money from the nursinghome. The truth is that the costs, taxes

and time commitment involved in ad-ministering a trust are, in most areas,virtually identical to those involved withprobating and administering an estate.Revocable living trusts do not avoidpayment of Pennsylvania inheritanceor other taxes and do not insulate fundsfrom being spent down for Medicaid.

If you are contacted by anyone trying tosell you a revocable living trust, here are

some of the warning signs that may indi-cate that this is a scam:

t high-pressure sales tactics,or unsolicited sales visits;

t suggestion that the LivingTrust is the “only documentyou’ll ever need”;

t suggestion that “attorneysdon’t want you to knowthis information”;

t use of “one-size-fits-all”pre-printed forms;

t excessive prices for forms.Some people are confused by the com-plexity of revocable trusts and may ex-perience or feel a loss of control over the assets in the trust. Moreover, manyfeel the benefits of a costly trust can beobtained through less expensive alter-natives, such as through the use of ageneral durable power of attorney.

  A living trust is appropriate and may bethe best choice if you own real estate inanother state, for example, if you own asecond home in Florida. Property trans-ferred to your trust will not be subject toan ancillary probate in that state, whichwill save considerable cost and simplifythe administration of your estate. You

might consider a living trust for the man-agement of your assets if you becomeincapacitated, as the successor trusteeof your trust will then be able to step into continue in your place.

Joint Property

There are several ways of owning prop-

erty with another person: Tenants inCommon, Tenancy by the Entireties,and Joint Tenancy with Right of Survi-vorship. You should not transfer your property into joint names with another without obtaining legal advice from anattorney who is able to explain the taxand other consequences. When you

transfer your property so that you ownit with another, you are exposing your property to the creditors of that person.There may be income tax, federal estateand gift tax, and also Pennsylvania In-heritance Tax issues. There are several

types of jointly owned property, andpeople often transfer their property into

 joint name with family members, or evenfriends, with the mistaken belief that thiswill reduce estate administration costs,avoid probate, avoid taxes, and gen-erally “make things easier.” This oftenresults in unexpected outcomes, badfeelings, and hardships.

Titling property in joint names is easy todo. Banks and other financial institutionsmay provide forms but are not capableof advising of the potential dangers. Howyou end up owning your property maydepend upon the forms you are givento sign by an employee who does notknow anything about your situation, or understand anything about the various

types of joint property.If your goal is to provide for the man-agement of your affairs if you becomeincapacitated, you should discuss themerits using a revocable living trust or a general power of attorney dependingon your circumstances with your lawyer.If you want certain property to go to aparticular person after your passing, this

should be addressed in your estate planwhich may be done by Will or by ben-eficiary designation depending on theproperty involved.

Inheritance, Estate and Gift Taxes

Over the years, senior citizens have

watched tax regulations at all levels growmore and more complicated. Guidelineinformation is offered below with theadvice to consult with a professional if you have questions.

Pennsylvania Inheritance Tax

Pennsylvania’s Inheritance Tax is a taximposed upon the transfer of property atthe time of an individual’s death. Gener-ally, assets located within the Common-wealth of Pennsylvania and in which thedecedent had an interest name, suchas bank accounts and real estate, are

subject to the tax. The rate of tax is de-termined by the relationship of the ben-eficiary to the decedent. For example,transfers to a grandparent, parent, childor other lineal descendant are taxed at 41/2%, while property passing to a siblingis taxed at 12%. Property passing to asurviving spouse, or from a child under the age of 21 to a parent is not subject

to tax. All other transfers are taxed at arate of 15%. There is no PennsylvaniaInheritance Tax on life insurance pro-ceeds received by a beneficiary. Thetax must be paid within nine months of the date of death to avoid a penalty. If you pay all or part of the tax within threemonths of death, you will receive a smalldiscount.

Federal Estate and Gift Taxes

The federal government imposes a tax“on the transfer of the taxable estate of every decedent who is a citizen or resi-dent of the United States.” The tentativetax is computed on the amount of the

taxable estate and the amount of the ad- justed taxable gifts.

Due to the recent changes in the taxlaw, the maximum estate tax rate willbe steadily decreasing to 45% in 2009,

and will be completely abated in 2010. Atax credit, known as the “unified credit”,allows smaller estates to pass withoutbeing subject to the Federal Estate Tax.This amount is set at $2,000,000 for theyears 2006

Technically, under present law, the totalrepeal of the estate tax will be effec-

tive only for decedents dying betweenJanuary 1, 2010 and December 31,2010. If the repeal is not renewed byCongress by December 31, 2010, theestate tax will revert to the 2002 rules.The federal taxation is not a concern for estates with assets under the amountcovered by the unified credit, but youshould check with your lawyer for other 

specific concerns. For married coupleswith assets in excess of what is coveredby the unified credit, taxes can be avoidedwith appropriate planning, such as bythe creation of a “bypass trust.” Estateswhere combined assets are more thanthe unified credit protected amount for married couples require complex plan-ning by a professional estate planner.

  Again, it is always wise to check withyour lawyer.

Taxable gifts are the total amount of giftsmade during the calendar year, less de-ductions. Annual gifts less than $12,000per person per donee are not taxed.Thus a husband and wife combined may

transfer up to $24,000 to each donee(e.g. $24,000 to each of their children)per year without being subject to federaltaxation. The government provides for an increase of this $12,000 amount for gifts made after 1998 by using a cost-of-

living adjustment.

Planning For Gifts

 As you plan to make gifts in your elder years, you need to know about federalestate and gift taxes, income taxes, realestate law, estate law, wills and divorcelaw. Your first step may be to consult an

attorney.

Your attorney will ask you to gather copies of all federal income tax and gifttax returns, gift checks, recorded andunrecorded deeds, copies of gift lettersand trust agreements. After a review of all the documents and a discussion of your goals, you will be ready to select

the property to be gifted, with your attor-ney’s assistance as you make your de-cisions.

You may want to consider a gift to charity.Many not-for-profit institutions have re-sources to aid you in making gifts, par-ticularly in setting up a charitable giftannuity which allows you to give cash

or securities while providing you witha guaranteed, lifelong income. Under certain conditions, you could enjoy a sig-nificant charitable tax deduction withoutincurring a capital gains tax if you giveappreciated securities with a low costbasis. Again, you need to see your at-torney to help you to review all your

options. You need to keep in mind thatthe federal government taxes some gifts.The Internal Revenue Service defines agift as any voluntary transfer of propertyfrom a donor to a donee without what iscalled full and adequate consideration.

 A gift will be computed when the donor gives up control over the transferredasset. Your gift to anyone during a cal-endar year will be a “taxable gift” to theextent it exceeds $12,000.

The value of a gift for federal gift tax pur-poses is the “fair market value” of theproperty transferred. Fair market value

is generally defined as the “price whichwould probably be agreed upon by aseller willing to sell and a buyer willing tobuy where both have knowledge of thefacts.” Gift tax returns, which list the giftsmade in that year, must be filed annu-ally when you file your personal incometax return if you exceed the $12,000 per person limit in the prior year. Although

filing is required, in many cases unlessthe gifts were sizeable, no tax may bedue at that time.

Meeting With Your Lawyer 

Perhaps the most difficult part of theestate planning process is /overcom-ing procrastination and scheduling that

initial consultation. For the best results,you need to deal with an attorney whoprovides estate planning services on aregular basis. When you call to sched-ule your appointment, be sure to askwhether there is a fee for the initialconsultation. At your first conference,be sure to ask about the total cost to

have your documents prepared. Somelawyers charge for documents on a flatfee basis, while others bill at an hourlyrate. In either case, reputable lawyersalways discuss fees up-front at the initialconsultation and they will put the agree-

ment in writing.

Before you visit your lawyer, you canmake the initial meeting more productiveby bringing the following information:

t a list of what you own andhow it is currently titled;

t a list of your intendedbeneficiaries with their names,ages and addresses;

t your choice of executor andat least one alternate; and

t a list of all the questions youhave about estate planning.

Your lawyer will thus be able to spendmore time developing a plan with youand less time writing down basic infor-

mation. If you suspect trouble in thefamily, mention this to your attorney sothe issues can be addressed in a waythat minimizes conflict. Remember thatanything you discuss with your attorneyis confidential client information.

 After working with you to develop your plan, your lawyer will then prepare thenecessary documents. You may wish

to ask him/her to forward drafts of com-plicated documents, such as trusts, for your review in advance of the final ap-pointment. It is very important that youunderstand all papers you sign. Then,once signed, make sure everything iskept in a secure, fire-proof location.

DO-IT-YOURSELF DOCUMENTS

Enterprising software designers havewritten “family lawyer” computer pro-

grams, which usually include wills, trusts,powers of attorney and advance direc-tives. These come with all sorts of broaddisclaimers telling users to consult their lawyers. However, many people decideto disregard the warnings and draft their own estate planning documents. Thisis analogous to the do-it-yourself appen-dectomy featured in a current television

ad.

The forms included in the typical “familylawyer” program have been preparedby attorneys and, if properly execut-ed, almost always create binding legaldocuments. But, there’s a catch: First,they do have to be validly executed;and, second, they might not do what the

persons signing them think they do.

Executing a will can be tricky. If theperson executing the will says the wrongthing, or if a witness does not actuallysee the person sign, or if one witnessdoes not see another witness sign, thewill can be invalidated. In addition, dif-ferent states have different requirements

and, sometimes, the laws of more thanone state can apply to the same will. So,without having an attorney supervise thesigning of a will, there is a significant riskthat the will may be void.

However, the biggest risk is not with theexecution of the form will, it is with its

content. It’s not that there is anythingwrong with the typical computer-gener-ated form, per se; rather, the problemis that the person who prepares the willmay not know or appreciate the legalor tax problems that affect his or her 

estate. The federal and state taxes thatapply to estates are extremely compli-cated and someone who does not dealwith them daily cannot spot all the issuesthat would affect an estate. State lawsdealing with adopted children, disableddependents, common law marriage,estranged spouses, creditors, and ex-cluded heirs are varied and complex.

Those, combined with the complex dy-namics of multiple marriages and inter-twined family relationships, can create alegal minefield that only a trained expertcan navigate without incendiary results.So, an attorney who is familiar withestate planning is necessary, not nec-essarily because only an attorney canwrite a valid will, but because a trained

attorney has the skill to spot the tax andlegal issues that the will must deal withto avoid problems when the estate issettled. The costs of hiring an attorneyto review or draft a will are always lessthan the costs of hiring an attorney todefend litigation among family membersor with the taxing authorities. That, com-bined with the peace of mind in knowing

that you have explored all the optionsavailable to you with a trained expert,should more than justify the expense of hiring a lawyer in every case.

POWERS OF ATTORNEY

  A Power of Attorney is simply a docu-ment that enables another person to acton behalf of the maker. The person cre-ating the document is called the principaland the person carrying out the wishesof the principal is called the agent. Theprincipal must be mentally competentwhen he or she signs the document, butthe document may remain valid even if the maker becomes incapacitated. Thiscontinuing validity is known at law asdurability. In Pennsylvania, all powersof attorney are durable unless the docu-ment specifies otherwise. This is whythe term durable power of attorney isoften used.

The law regarding powers of attorneywas substantially revised in 1999. Sincethen, all new documents must carry a

large NOTICE provision that warns themaker of the significant breadth andscope of the powers being granted tothe agent. Additionally, in order for thepower of attorney to be legally binding,the agent must sign an ACKNOWLEDG-MENT. The agent affirms that he or shewill act prudently, only in the best inter-ests of the principal, keep good records

and keep the Principal’s money in aseparate account – separate from the

 Agent’s funds. Consequently, THE SE-LECTION OF AGENT IS CRITICAL.

 A power of attorney becomes particular-ly important should the maker becomeincapacitated – whether this incapacity

is short lived or of longer duration. Im-portantly, the agent may be empoweredto make estate planning decisions - tominimize estate taxes and/or to takeMedicaid planning steps. These stepsmay involve giving monies or assets to

the principal’s heirs now, rather than atthe principal’s death. In a power of at-torney, this act is called gifting. Not sur-prisingly, gifting is sometimes abusedby an agent. Since 1999, if gifting is tobe permitted at all, the power of attor-ney document must contain specific lan-guage. If you want your Agent to haveyour authority to make any gifts, please

contact an elder law or estate planningattorney.

In essence, a power of attorney maygrant the agent the power to do any-thing financially that the principal coulddo. Therefore, it is important to consider to what extent to empower your agent.It might be appropriate to grant an agent

limited, closely defined gifting authorityor very far reaching powers. An attor-ney can review these and other detailsto create an appropriate documentfor your particular circumstances andneeds. For example, you may wish tospecifically authorize your agent to useyour funds to consult with an attorney or other professional for legal, accounting

or investment advice – all to better serveyou as your agent.

 A power of attorney may be effective im-mediately or only when a specific, futureevent has occurred. Such a triggeringevent might be when your doctor certi-fies that you are disabled either physi-

cally or mentally. This type of triggeringmechanism is often called a springingclause. However, the need to formallycertify a future event could cause a sig-nificant delay in the ability of your agentto act for you. Therefore, you should

carefully consider the pros and cons of this feature.

To avoid or minimize family squabbles,you should consider advising your familyof your plans for incapacity (power of attorney) as well as your estate. Addi-tionally, it is much more efficient to haveone agent rather than a group of agents.

Obviously, some children might be dis-appointed to not be the one chosen toact. If you communicate with your chil-dren – particularly your chosen agent- during the initial incapacity planningprocess and beyond, you will be able toforestall many disputes.

Your signature (execution) of your power 

of attorney should be witnessed by twoadults (who are not members of your family) and a Notary because this formal-ity is required for some agent’s acts (for example a real estate transaction) andit may improve the ready acceptance of your power of attorney document(s) inother states or countries.

Copies of your power of attorney canbe as valid as the original. Additional-ly, a notarized power of attorney may berecorded (for a fee) in our County Re-corder of Deeds Office or with the Clerkof the Orphans’ Court. Once recorded,certified copies may be purchased andare more readily accepted by financial

institutions.

 Advance Health Care Directives(Living Wills)

Please note: This area of the law has

been recently significantly changed byour legislature. Under the new Act 169,if you fail to appoint a Health Care Agentthe law now designates who may act asyour Health Care Representative under circumstances where you are unable toact yourself. Because this is a substan-tial change in our law, it is particularlyimportant that you review the following

information with your attorney beforetaking any action based upon the infor-mation contained in this section.

In 1992, Pennsylvania became the lastof our fifty states to pass a “Living Will”statute. In 1994, these laws were againrevised to enable anatomical gifts (organdonation).

You might be familiar with the old LivingWill form (the so-called “check the box”form) if you or a family member hasbeen a patient in a Hospital. When youare admitted as a patient, you are askedif you have a Living Will or Advance Di-rective. This question is required byfederal patient rights law. The PA Statu-

tory Living Will form is composed of aseries of yes or no questions related toyour care at end of life.

The PA Statutory Living Will can beacted upon by your agent only if your at-tending physician certifies that you arenear death. Here are a few abreviated

definitions of terms contained in the newPA Statutes.

Incompetent: The Patient lacks suffi-cient capacity to make or communicatedecisions concerning himself or herself 

or the options for treatment.

Life-Sustaining Treatment: Any medicalprocedure or intervention that servesonly to prolong the process of dying or to maintain the patient in a state of per-manent unconsciousness. If your doc-ument so provides, this treatment mayinclude nutrition and hydration admin-

istered intravenously or by stomach or nose tube or other artificial, surgical or invasive means.

Permanently Unconscious: A medicalcondition diagnosed in accordance withcurrently accepted medical standardsand with reasonable medical certainty astotal and irreversible loss of conscious-

ness and capacity of interaction with theenvironment; includes a persistent veg-etative state or irreversible coma.

Who May Execute a Living Will

In Pennsylvania, anyone of sound mindand aged at least 18 years or marriedor graduated from High School may

execute a Living Will. The PA Statuto-ry Living Will only requires two witness-es aged 18 or older. However, eachstate has a similar law with unique re-quirements. Therefore, you may wishto improve the acceptance of the docu-ment in other states by having your andyour witnesses’ signatures notarized.

It is very important to discuss with your physician the kinds of treatments youmight wish to withhold under certain cir-cumstances. Certainly, you would wantto understand what effect certain treat-

ments would have on your body. A copyof your Living Will should be given to your primary care physician who will safe-guard it in your medical records. Your doctor will appreciate this communica-tion because by following your writteninstructions the doctor will be protectedfrom liability. However, you might findthat your doctor is not comfortable with

your expressed preferences, becauseyour choices might not be compatiblewith the physician’s moral or religiousbeliefs. It is much better to discover thisdifference before a crisis occurs. Youcan then find a doctor whose beliefs aremore compatible with your own.

  Additionally, you might wish to name

a surrogate (agent) to carry out your wishes should you be unable to com-municate. Also, you may specificallyprohibit certain persons from acting as asurrogate. For example, you might notwant an estranged spouse interactingwith your doctor regarding your care.

By law, hospitals and nursing homes

must provide patients with informationconcerning Living Wills. However, infor-mation concerning Health Care Declara-tions is optional. Hospitals and nursinghomes may not charge different fees de-pendent upon whether or not a patienthas a Living Will.

The PA Statutory Living Will becomesoperable (or empowers your agent)ONLY when the attending physician isprovided with a copy AND the attendingphysician determines that the patient isincompetent AND that the patient has an

end-stage condition OR is permanentlyunconsciousness. The attending doctor must certify this diagnosis in writing andthis diagnosis must be confirmed by asecond physician. ONLY WHEN ANDONLY IF ALL of these steps are followedis the PA Statutory Living Will able togive your agent legal authority to makeend-of-life decisions for you.

 Absence of a Living Will

If a patient has not executed an advancedirective (Living Will, Health Care Power of Attorney or similar document), thereis no presumption of the patient’s inten-tions to consent to or to refuse life-sus-taining treatment. However, the Penn-

sylvania Supreme Court has held thatwhen there is no advance directive, aclose relative, with the consent of twophysicians and without Court involve-ment, may remove life-sustaining treat-ment from an adult relative who is in apersistent vegetative state.

Durable Health Care Power of Attorney – Possibly a better Choice

Sometimes, an event, condition or cir-cumstance might make it impossiblefor a patient to interact with the doctor.Perhaps, for example, he or she hasbeen in an accident or has been given

medicine to control her pain. He or shemay have undergone surgery and still befeeling the effects of anesthesia. Under such circumstances, the patient’s abilityto listen to the doctor’s explanation of treatment choices and to reasonably

evaluate the alternatives can be signifi-cantly impaired. Similarly, a person suf-fering from Alzheimer’s or other demen-tia may not be able to interact with hisor her health care providers sufficientlyto give informed consent to a proposedform of treatment.

Many people choose to anticipate this

type of incapacity and name an agent(or surrogate) to act for them regarding

  ALL health care decisions. The docu-ment that formally records this choice iscalled a Durable Health Care Power of 

 Attorney (DHCPOA).

Similar to a power of attorney that enablesyour agent to attend to your financial and

property decisions, the DHCPOA canenable your agent to make your healthcare decisions for you if you are too ill tomake them for yourself. Your agent for health care decisions may be the sameperson who is your agent for your finan-cial and property decisions or it may besomeone else. This is because the skills,capabilities and knowledge needed for 

each of these tasks are distinctive.

 Additionally, because we are living longer than ever before, many people now rec-ognize that the possibility is that muchgreater that they will suffer some periodof incapacity – whether temporary (for an operation) or longer (with a progres-

sive or cognitive illness like Alzheimer’sdisease).

Remember, a Living Will only comesinto use at the end of life. A DHCPOAcan cover the much larger gap of time

between incapacity and end of life. Anagent empowered by a well craftedDHCPOA can help insure that your indi-vidual preferences, desires, and wishesregarding your health care are honoredand enforced.

This freedom to name a person who isnot your spouse as your agent of choice

for a DHCPOA was affirmed by a Penn-sylvania Superior Court case calledDuran. Because this area of the law hasreceived a lot of notice in the press andbecause additional legislation is cur-rently pending in this area of law, pleasecontact your attorney to initiate incapac-ity planning.

Out-of-Hospital Do Not ResuscitateOrders

This specialized medical instruction isnow portable or enforceable outside of the walls of a medical facility. Shouldmedical circumstances warrant, a phy-sician may, upon consultation with her patient or the patient’s agent, write a

DNR or Do Not Resuscitate Order. Thisinstruction in a patient’s chart means thatshould the heart stop beating on its ownor should breathing cease, no CPR (car-diopulmonary resuscitation) should bepreformed. For example, a DNR order might be appropriate for a terminally illcancer patient who has been admitted

to Hospice care or a very frail and veryelderly person who lacks the physical vi-tality to respond to or fully or significant-ly recover from CPR medical treatment.

Until 2002 in Pennsylvania, a DNR was

only enforceable within a medical facili-ty. This meant that a person with a DNRcould not enforce it outside the hospi-tal. Thus, if they were well enough totravel and then be in an accident, emer-gency medical service (EMS) respond-ers would be required by law to performCPR even though this act was againstthe patient’s wishes and doctor’s orders,

because the EMS technicians’ job, andvery important public duty is to savelives if at all possible.

Now, Pennsylvania has joined most other states that have procedures to protectpatient’s rights, ensure EMS complianceand still protect the professional integrityof our Police, Fire, EMS and invaluable

emergency responders. Now a personcan have a “mobile DNR” and wear aspecial bracelet to safely and readilyadvise the emergency responder of theexistence of the DNR order. The offi-cial advisory on the bracelet enables theemergency responder to both do their 

 job and respect the patient’s choice.

GUARDIANSHIPS

Sometimes people are unable to makedecisions about their health or financesand can no longer manage for them-selves. Dementia or other progressivemental, emotional or physical illness-es can rob people of the ability to keepthemselves safe. In the worst cases, in-dividuals can become victims of otherswho see opportunities to take cash andpossessions while “helping” or doingfavors. The impaired person may evenbe pressed to make important decisionsabout medical care or living arrange-ments.

To provide a decisions-maker for peoplein these situations, Pennsylvania lawallows the Orphans’ Court to appoint aguardian of the person (for living arrange-ments) and/or a guardian of the estate

(for financial matters). Anyone interest-ed in the person’s welfare can file thepetition seeking a guardian, but a guard-ian must be identified and be willing toserve. The court will not produce oneand there is no public guardian servicein Chester County at this time. Thereare, however, private guardian services.

 Additionally, the Orphans’ Court Guard-

ianship Volunteer Program provides as-sistance to guardians who have beenappointed by the court. The Programprovides visiting and auditing servicesfor the court as well.

To qualify for a guardian, a person mustbe found impaired in such a way that

she or he is partially or totally unable tomanage financial resources or meet es-sential requirements for physical healthand safety. Because a ruling of “inca-pacity” and appointment of a guardianinvolves the curtailing of many important

legal rights, stringent standards must bemet. Notice must be given to the allegedincapacitated person and there is a rightto request counsel.

Hearing Before the Court

The incapacitated person is requiredto attend a hearing before the Chester 

County Orphans’ Court unless excused,for example, by a doctor. An attorney for the incapacitated person is not requiredunless ordered by the court, as in casesinvolving family conflict. When testi-mony by a qualified person such as apsychiatrist or other health care provid-er establishes clear and convincing evi-dence that the person is incapacitated,

a guardian will be appointed. It is impor-tant to note however, that just becausean individual has periods of confusiondoes not mean that he or she will befound incapacitated under the law.

If incapacity is established, the court willappoint a guardian of the estate and/or person with full or limited powers. It is

the duty of the guardian to assert therights and best interests and to respectthe expressed wishes and preferencesof the incapacitated person to the great-est possible extent. The guardian mustalso encourage the incapacitated personto participate in all decisions which affecthim or her to the maximum extent of his

or her abilities. However, the guardiandoes not have to follow the wishes of thatperson if they are in conflict with his or her best interests. For example, manytimes an incapacitated person wants tocontinue to live in his or her home; if the

guardian determines that assisted livingor skilled nursing care is necessary, theguardian is fully authorized to admit theperson to a facility even over that per-son’s objections.

Duties of Guardian After Court Appoint-ment

The appointed guardian has all powersset forth in the court order, usually in-cluding making every kind of decisionwith the exception of admitting to inpa-tient psychiatric facilities or consenting torelinquishment of parental rights. Courtapproval is needed for consent to abor-tion, sterilization, psychosurgery, shocktherapy, removal of a health organ, or to

prohibit marriage, consent to divorce or to consent to experimental procedures.

Typical decisions made by guardians of the person include arranging medicalcare and consenting to surgery or other treatments, determining where an in-capacitated person is to live and con-tracting for admission to nursing facili-

ties. A guardian for the estate has thesame duties as a personal representa-tive, executor or administrator with spe-cific requirements and limitations. Everyguardian must file a detailed annualreport with the Orphans’ Court.

It must be remembered, that a guard-

ianship is subject to review at any time.The court, on its own, may set a date for a review hearing to see whether there isa significant change in the person’s ca-pacity, or to see if there is a change inthe need for guardianship services. Ad-

ditionally, the court may need to reviewa guardian’s failure to perform his dutiesin accordance with the law or to act inthe best interests of the incapacitatedperson. A guardian may use any andall income received by the guardian of the estate, but must petition this courtif she or he wishes to invade principal.The court may also, after a petition and

notice to all parties interested, allowfor payment from the principal of theestate for the care, maintenance or edu-cation of the incapacitated person, hisspouse, children or those for whom hewas making such provisions before hisincapacity. Finally, the court, upon peti-tion and with notice to all parties in in-terest, and for good cause shown, shall

have the power to substitute its judg-ment for that of the incapacitated personwith respect to the estate and affairs of the incapacitated person for the benefitof the incapacitated person, his family,members of his household, his friendsand charities in which he was interest-ed. This may involve many estate plan-ning strategies which the court has the

power to oversee.

Working out a comprehensive power of attorney may make guardianship pro-ceedings unnecessary will be less ex-pensive and stressful than the courtprocess. Any person could, of course,name in advance a preferred guardian

  Applying for Benefits from the Social

Security Office

Do not delay in applying for benefits for which you may be eligible. Any delayon your part could result in fewer ben-efits if you are ultimately found eligiblefor certain benefit programs operated by

Social Security. When in doubt, contactSocial Security to begin the applicationprocess as soon as you may be eligi-ble.

To get an estimate of your benefitswithout using a computer, you cansubmit a completed form SSA-7004-SM

to the Social Security Administration. Ittakes about six weeks to receive the in-formation.

Deadlines

Keep in mind that Social Security willgive you a deadline to finish certaintasks (i.e., file a written application after you call them, file a written appeal if youare dissatisfied with their decision, etc.).You must comply within their timelines or you will lose your right to potential ben-efits. Typically, their deadlines are within60 days. However some deadlines may

be shorter for special circumstances soyou must check this carefully.

Written Explanation for Denial of Benefits

If Social Security denies your claim for any benefits, you are entitled to a writtenexplanation giving the reasons for the

denial. If you do not receive a written ex-planation, ask Social Security to provideyou with this documentation.

Correcting Records with Social SecurityIf you are receiving benefits or applyingfor benefits from Social Security, it is im-portant that you contact the Social Secu-rity Administration to inform them of any

changes or corrections in your records.For example, if you move, change bankaccounts, or disagree with the earningsrecords that they have posted to your Social Security account, you should takeimmediate steps to inform Social Secu-rity of any changes or additions.

It has been estimated that a small per-centage of Social Security participantshave incorrect Social Security retirementaccounts. As a result, the SSA may notbe aware of all of your lifetime earnings,a fact which could lower the retirement

benefits you receive.

It is important to check your records everycouple of years, at least until you are re-ceiving benefits, to verify your earningsrecords on file with Social Security. Inaddition, Social Security is required bylaw to provide a Statement of EstimatedBenefits for those persons who are not

currently receiving benefits and haveworked in Social Security covered em-ployment or self-employment. You canexpect to receive such a Statement eachyear a few months before your birthday.

Social Security Benefits

Most consumers think of Social Securityas applying to retirement benefits. Other programs are also available throughSocial Security.

The system provides benefits not onlyduring retirement but also for survivorsand dependents in case of death or dis-ability.

While retirement and Social SecurityDisability benefits are based on havingworked in the Social Security system

and do not require a showing of need,another program, Supplemental Se-curity Income (SSI), is a needs-basedprogram. To qualify for SSI, an appli-cant, in addition to being aged, disabledor blind, must have no more than $2,000in “countable” assets, basically cash andliquid assets, and very limited income.Social Security retirement benefits and

Social Security Disability benefits arenot reduced if the applicant has other sources of income. SSI benefits arealmost always reduced if other incomeis received.

Keep in mind that this is not a descrip-tion of all of the eligibility requirementsfor each of these programs and bene-

Social Security Retirement BenefitsDetermining Full Retirement Age

 Anyone born before 1938 is eligible for full Social Security retirement benefitsat the age of 65. However, beginning in

the year 2003, the age at which full ben-efits are payable has been increasing ingradual steps from 65 to 67 dependingon the year of your birth. Persons bornfrom 1943-1954, for instance, will reachFull Retirement Age at age 66. Personsborn 1960 or later will reach Full Retire-ment Age at age 67. For more detailsconcerning your Full Retirement Age,

you may consult the Social Securitywebsite at www.socialsecurity.gov.

Early Retirement

No matter what your “full” retirementage is, you may start receiving bene-fits as early as age 62. However, if youstart your retirement benefits before Full

Retirement Age, benefits are reducedfive-ninths of 1% for each month beforeyour full retirement age for the first 36months and five-twelfths of 1% for eachmonth thereafter until full retirementage. There are disadvantages and ad-vantages to taking your retirement ben-efits before your full retirement age. Onedisadvantage is that your monthly ben-

efits are permanently reduced. The ad-vantage is that you collect benefits for a longer period of time. The decision toretire early and collect Social Securitybenefits may depend on your health atthe time of retirement, other availablesources of income, and personal factorssuch as whether you desire to continue

to work.

Effect of Taking Social Security BeforeFull Retirement Age and Continuing to

Work

Persons who decide to take early re-tirement payments from Social Securitybut continue to work should realize thatthe amount of monthly benefit that theyreceive during the “early retirement” timeuntil full retirement age will be reducedunless their monthly earnings are lower than a given amount. Currently a recip-ient can earn about $1,000 per month

($12,480 per year) without penalty. Thisshould be projected in advance. There-fore, another consideration before de-ciding to take early retirement benefitsfor those who work is whether you arewilling to take the lower benefit until your full retirement age is reached. Eachperson’s situation is different, so youshould explore alternatives and possibly

contact Social Security before you makeany decisions.

Effect of Delaying Receipt of Social Se-curity Benefits Up to Age 70

Up to age 70, a delayed Social Secu-rity retirement benefits claim increasesmonthly benefits when received. The

increase varies from a 6.5% increaseper year of delay for those born 1937-1938 to 8% for those born in 1943 or later. Therefore, especially for healthypersons who continue to work after their full retirement age, consideration shouldbe given whether to delay in taking theSocial Security benefit as well in order

to receive a higher benefit. How Social Security Retirement Bene-

fits Are Calculated

Social Security calculates your retire-

ment benefits based on your averageearnings during a lifetime of work under the Social Security system. For mostcurrent and future retirees, SSA aver-ages the 35 highest years of earningsusing indexes. If you did not work for 35years, years in which you did not workwill be counted as zero. Therefore, re-maining in the system and working at

least 35 years may be significant in de-termining the amount of your benefit.

Retirement Benefits for a Spouse

Social Security benefits may be receivedbased on your own record of contribu-tions to the Social Security system or on the record of your spouse or former 

spouse if you fit certain criteria. Ben-efits received on another person’s earn-ings record are referred to as deriva-tive benefits. A spouse of a wage earner can, when he or she reaches retirementage, choose to collect benefits basedupon his or her own record at 100% or the record of his or her spouse basedon 50%. If 50% of your spouse’s benefit

would be higher than 100% of your ownbenefit, then retirement benefits basedon your spouse’s benefit should beelected. This provision allows primarilyfor women who did not work outside thehome while raising their families.

Retirement Benefits Received by a

Widow/Widower 

 At the time of death of the spouse whowas the higher wage-earner, his widow(or her widower) may “bump up” to her spouse’s higher Social Security retire-

ment benefit and receive those bene-fits as her own instead of continuing toreceive her own Social Security benefit.She cannot receive both. There is also alump sum death benefit of $255.

Benefits For a Divorced Spouse

 After divorce, one can receive benefits

based on the contributions of a former spouse if the marriage was at least tenyears in duration. Derivative benefits for divorced spouses do not affect the bene-fits of the contributing spouse and familyallowance does not apply. If a divorcedspouse seeks benefits based on an eli-gible former spouse’s earning record,and the former spouse is not collect-

ing benefits, the divorced spouse cancollect benefits only after two years haveelapsed from the date of the divorce. Inaddition, the spouse from whom benefitsare derived must be eligible for benefits;that is, at least 62 years of age and fullyinsured, even if he/she is not actually re-ceiving benefits. The dependent spousemust be at least 62 years of age and un-

married. If the dependent spouse remar-ries, he/she will not be eligible for deriva-tive benefits from a contributing spouse.However, if such remarriage terminates,the dependent spouse becomes eligiblefor derivative benefits once again fromthe former contributing spouse. If a de-pendent spouse has been married more

than once and each time for at leastten years, derivative benefits can comefrom the former spouse’s contributionsproviding the higher benefits.

Considerations Regarding Remarriage

Under Social Security

If a widow or widower was married to aspouse with a higher earnings recordunder Social Security and is consider-ing remarriage, a remarriage after age60 will permit the widow(er) to choosebetween the derivative benefits thatwould have been received from his or 

her deceased spouse’s earnings andbenefits that would be received with thenew spouse. If the widow(er) remarriesbefore age 60, benefits are limited to thederivative benefits of the more recentspouse.

Benefits for Widow(er)s, DependentChildren and Dependent Parents

On your death, certain members of your family may be eligible for benefits onyour Social Security earnings record if you have earned enough credits whileyou were working. Family members whocan collect benefits include:

t A widow or widower who is 60 or older;

t A widow or widower who is 50 or older and disabled;

t A widow or widower at any age if he/she is caring for a child under 16 or for a disabled child;

t A child who is receiving SocialSecurity benefits;

t Children if they are unmarriedand under age 18;

t Under age 19 but a full-timestudent in elementary or secondary school;

t Children 18 or older and severelydisabled (the disability musthave started prior to age 22)

t Parents, if dependent on you for at least half of their support.

Benefits to Divorced Widow(er)s

To receive retirement benefits based

on the earnings record of a deceasedex-spouse, the deceased wage earner must have been fully insured at the timeof death, and the dependent survivingex-spouse must:

t Be least 60 years of age (or 50years of age if disabled) andhave been married to you for atleast ten years

t Be any age if caring for a childwho is eligible for benefits onyour earnings record;

t Not be eligible for an equal or higher benefit on his/her ownearnings record; and

t Not be currently married, unlessthe remarriage occurred after age 60, or age 50 for disabledwidow(er)s.

The surviving divorced widow receives100% of the benefits instead of the 50%received if the former spouse is alive.

Income Tax on Social Security Benefits

Some Social Security retirement bene-fits are now taxable. The test is whether the individual’s adjusted gross incomecombined with 50% of his/her Social Se-

curity benefits plus any tax-exempt in-terest exceeds a base amount. For indi-viduals, that base amount is $25,000; for married couples, the amount is $32,000.The amount of benefits that will thenbe included in taxable income is thelesser of half of the benefits or half of the excess of the taxpayer’s combinedincome (modified adjusted gross income

plus half of the benefits) over the baseamount.

For individuals whose combined incomeexceeds a higher adjusted base amount($34,000 for single individuals, $44,000for a married couple filing a joint return),the amount of benefits that will be in-cluded in taxable income is the lesser 

of 85% of the benefits, or 85% of theexcess of the taxpayer’s combinedincome over the adjusted base amountplus the lesser of half the benefits or $4,500 for a single person, $6,000 for married couples. Because these issuesare so complex you may wish to consulta tax attorney for guidance.

Social Security Disability InsuranceBenefits (SSDIB)

If you have worked long enough andearned enough Social Security “credits”to qualify for disability on your own workrecord, and if you are medically deter-mined to be unable to do “substantial

gainful” work for at least one year, youmay qualify for Social Security disabilityinsurance benefits on your own account.It is a complicated program and youshould visit your local Social Securityoffice in order to apply. Some lawyers

specialize in SSDI cases. The programis not intended for a temporary conditionand there is no “partial” disability benefitprogram from Social Security. For a dis-abled person, Social Security Disabilitybenefits will be received as retirementbenefits at retirement age.

Supplemental Security Income Benefits

(SSI)

The SSI program is based on means. Toqualify, you must be “poor” (low incomeand few assets) and be either medicallydisabled, blind, or 65 or older. It is nota benefit program to “supplement” theincome you may already receive in theform of retirement benefits, SSDIB, or a

pension. You must meet strict incomeguidelines in order to receive thisbenefit. For example, if you are a singleperson in Pennsylvania who is medical-ly disabled and you receive more thanabout $610.40 per month from another benefit such as SSDIB, retirement, or a pension, you will not be eligible for SSI benefits, based on the income you

receive. The primary benefit to receivingSSI in Pennsylvania is that SSI recipi-ents at this time automatically qualify toreceive Medical Assistance (Medicaid)medical coverage.

MEDICARE

Instituted in 1965, Medicare is a healthinsurance program administered by the

federal government Centers for Medicareand Medicaid Services (CMS) to assist

  Americans, age 65 and older, somedisabled persons under age 65, andpersons with end stage renal disease of any age, with payment of medical costs.The Medicare program has traditionallyhad two parts. Part A consists of cover-age for most of the costs involved in a

hospital stay; Part B is medical insur-ance which pays a portion of the cost for doctor and outpatient medical care.

  An individual is entitled to Medicarebecause he/she or his/her spouse paidfor it through Social Security taxes. Itis not a means based program. Theprogram for seniors is provided to assist

senior citizens whose medical bills, as agroup, are typically higher than the restof the population.

 Application should be made within a fewmonths before your 65th birthday regard-less when you are taking Social Securi-ty retirement benefits. Eligibility and en-rollment are handled by the Social Se-

curity Administration office at 1101 WestChester Pike, West Chester, PA 19380,Telephone 610-431-0529 (local) 800-772-1213 (toll free).

Beginning November 15, 2005, Medi-care participants are also eligible toapply for a new program, Medicare Part

Eligibility

Part A - Hospital Insurance

Part A has two types of eligibility. Mostpersons age 65 or older are covered,for free, based on their work records or on their spouse’s work records. Peopleover 65 who are not eligible for free Part

 A coverage can enroll and pay a monthlyfee for the same coverage.

Part B -Medical Insurance

  Anyone who is age 65 or older and acitizen of the United States or a resi-dent of the United States who has beenhere lawfully for five consecutive yearsis eligible to enroll in Medicare Part Bmedical insurance. This is true whether or not they are eligible for Part A hospi-tal insurance. Everyone enrolled mustpay a monthly premium and in the year 

2006 the premium is $88.50 per month.For most persons, their premium is de-ducted from their monthly Social Secu-rity check.

Coverage

Part A of Medicare covers most of thecosts incurred directly from a hospital

as inpatient care. In addition, some of the costs of inpatient rehabilitation treat-ment in a skilled nursing facility may becovered for a limited time if there is ad-mission to the facility following a qualify-ing hospital inpatient stay of at least three(3) days. To be eligible for Part A hos-pital insurance coverage, the care and

treatment must be medically reasonableand necessary. Part A does not cover outpatient or elective and cosmetic pro-cedures. Doctors’ bills are not coveredunder Part A but may be covered under Part B.

During each benefit period, the individualmust pay the hospital insurance deduct-ible before Medicare will pay anythingtoward the incurred bill; in 2006, the de-ductible is $952. This amount may becovered under a person’s SupplementalHealth Insurance (see below).

For a stay in a skilled nursing facility tobe covered by Medicare Part A, it mustbe preceded by a three (3) day or morehospital stay and the patient’s doctor must verify that the individual requiresthe level of care. When the patient is con-sidered to have “plateaued” in therapy,both the therapy and Medicare cover-age typically stop.

Medicare may cover up to 100 days of inpatient care in a skilled nursing facil-ity during any one spell of illness periodand the first twenty of these days, if thepatient is eligible, are covered 100%.For the balance of the days, the patientis responsible for the daily copayment,which in 2006 is $119 per day. Once a

person has been in a skilled nursing fa-cility for 100 days in a benefit period,there will be no further coverage fromMedicare Part A and the patient will betotally responsible thereafter. Coveragecan and often does stop earlier than 100days if the patient either does not coop-erate with or is seen not to be benefiting

by continued therapy.

Part B medical insurance requires thatthe services by the doctors, clinics andlaboratories are medically necessary.Some preventive medical procedures

are covered by Part B. These includean initial wellness exam and also teststo check for heart disease (cholesterol),diabetes, breast cancer mammography,cervical, vaginal, colorectal, and pros-tate cancers, osteoporosis and glauco-ma. Flu shots and one pneumococcalpneumonia shot are also covered. 

Normally Medicare Part B pays onaverage about one-half of an individu-al’s total medical bills. Since there areoften balances remaining, Pennsylva-nia has enacted the “MOM” law whichforbids any doctor from billing patientsfor the balance of the bill above the ap-proved Medicare amount. There is anannual deductible of $124 per year.

Your doctor can bill you for 20% of theapproved fee which amount is not paidby Medicare. This is another reason for supplemental insurance. If you believeyou have been overbilled above theMedicare amount, you can call the Penn-sylvania State Department of Aging at(717) 783-8975.

 Appeals in Denials of Benefits

If you are denied Medicare benefitseither in a hospital or a skilled nursingfacility, you have the right to an appeal.Pennsylvania has a program called“APPRISE” where trained volunteer 

counselors provide free one-on-one as-sistance or telephone assistance witheligibility and benefits questions for allpeople over the age of 60, their familiesor their caregivers. You can call themtoll free at (800) 783-7067, or contact

the APPRISE Office in West Chester bycalling (610) 344-6009. Also in Penn-sylvania, you may call Quality Insightsof Pennsylvania (the QIO) which pro-tects the rights of Medicare beneficia-ries receiving care. For example, if youare denied admission to a hospital, areasked to leave the hospital before youfeel well enough, if your nursing facility

requires you to leave, or you are dissat-isfied with the quality of care, the QIOreviews your complaints, free of chargeto Medicare beneficiaries includingthose enrolled in HMOs. Supplemental Health Insurance –

Medigap and Medicare AdvantagePlans

Even after Medicare pays its portion of an individual’s medical bills, sizeableco-pays and deductibles often remain.Therefore, it is recommended thatseniors purchase some type of private in-surance to pay all or part of that balance.

Because such insurance policies are de-signed to fill the gaps in Medicare pay-ments, the term “Medigap” has devel-oped. There are a wide variety of plansavailable depending on the amount of coverage sought but two types are mostcommonly used.

The Medigap coverage, also referred

to as a traditional indemnity plan suchas Blue Cross/Blue Shield coverage or 

  AARP, is typically more expensive butdoes not require referrals and pays upto its agreed upon share after Medi-care pays its portion of the bill. It doesnot require members to use a “provider network.” Medigap policies, followingthe passage of Medicare D are no longer 

permitted to write new prescription cov-erage and persons with Medigap planswho participate in Medicare “D” will needto get a “stand alone” prescription plan.The Medicare Advantage coverage istypically less expensive than Medigapand is managed care, usually an HMOtype plan, that require members to obtain

referrals and use a provider network.These include Aetna Golden and Key-stone 65. These may also have pre-scription drug plans that come with thehealth insurance coverage. 

Since Medicare Part “D” prescriptioncoverage has taken effect, it can be crit-ical to coordinate your health insurancecoverage with your prescription cover-age since some health insurances havetheir own prescription coverages and some health insurance plans have none.If your health insurance is not consistent with your prescription drug coverage,

it is possible that you can be dropped because of the inconsistency. Ask ques-tions of the insurance companies and agents if you are not sure.

Insurance companies must offer “openenrollment” which means that they areforbidden to deny a Medigap policy toanyone who buys it within the first six

months after enrolling in Medicare PartB. Medigap policies offer a choice of one of ten plans, “A-J,” and must meetcertain standards such as guaranteedrenewability. The costs for the differentMedigap plans vary widely.

  As a general rule, Medicare coverageis available only inside the USA with

the exception that a citizen of the USAwould be covered in Canada if he or shewere en route to Alaska.

Medicare Prescription Benefit – Part “D”

The first federally subsidized drugprogram for seniors took effect January1, 2006. Under Medicare “D” privatehealth insurers offer limited insurancecoverage for prescription drugs to thosepersons who are Medicare recipients.

Keep in mind the following points:

1) If you currently have what is re-ferred to as “creditable” coverage for prescription drugs through your em-ployer, former employer, union, or oth-erwise, you should consider staying withthat plan since, if you move to a privateMedicare “D” plan, you could lose your 

retiree or other coverage;

2) If you are in a Medicare HMO or PPO which offers prescription coveragethen you must stay with that plan. Donot choose a different plan unless youwish to disenroll from your MedicareHMO or PPO.

3) If you are receiving Medicaid,then you were automatically enrolled ina Medicare Part D plan. If you do notlike that plan, unlike other Medicare Dparticipants, you can change the plan inthe following month and do not have towait for the open enrollment period.

4) If you are in PACE or PACENET,Pennsylvania now has a program PACEPLUS MEDICARE that offers “wraparound” coverage for prescription drugsand coordinates federal and state ben-efits. See the PACE and PACENET

Section in this book. More informationcan be obtained by calling 800-225-PACE.

5) Participation in Medicare “D” isvoluntary. There is a penalty for personswho sign late. However, it is importantto assure that you receive the right cov-erage.

6) When choosing a plan under Medicare “D, be careful. In addition tothe issue of losing prior retiree coveragedescribed in 1) above, normally you canswitch plans only once a year during theenrollment period.

7) There is a monthly premium be-

ginning as low as $11 a month for Medi-care “D” and a wide variety of plans.If you are exploring coverages, beginby seeing whether the plan covers thedrugs you take. One way to do this is bychecking the internet at www.medicare.gov.

MEDICAID

Medicaid is a joint Federal/State programoperated by the Department of Public

Welfare through its local County Assis-tance offices that helps to pay for longterm care for persons in skilled nursinghomes. The Medicaid Waiver programhas limited slots to provide services inthe home. Application for Medicaid topay for skilled nursing care in Chester County must be made to the Chester County Assistance Office, 100 James

Buchanan Drive, Thorndale, PA 19372.Telephone number (610) 466-1000.

  At home services under the MedicaidWaiver program must be approved boththrough the County Assistance Officeand the Chester County Department of 

 Aging Services. Detailed supporting doc-umentation must be submitted in eachcase for applications to be granted.

In order for a nursing home resident toqualify, he or she must be both medicallyand financially qualified and the nursinghome in which he or she resides mustbe Medicaid certified. There is no Med-icaid for residents of Assisted Living inPennsylvania at this time. The Medicaidprogram applies after personal liquid

assets have been spent down to about$2,400 but for persons with monthlyincome of less than $1,869 (2007 figure),a disregard is allowed so that the actualamount that may be kept by the ap-plicant in that case is $8,000. Specialrules known as the spousal impover-ishment rules apply to married couples,

which may allow the spouse remain-ing at home (the community spouse) tokeep much more in assets and incomeunder complicated rules. (See below).The individual receiving benefits under Medicaid must contribute all of his or her 

own monthly income (including social se-curity benefits, pension) less a small al-lowance (now $40) for personal needs.

Eligibility

Medical: An applicant for nursing home Medicaidbenefits must actually need long term

care in a skilled nursing facility (or, if athome, require a similar level of care).

  A Medical assessment, an MA-51, or Options Assessment should be request-ed by the nursing facility where the ap-plicant resides.

Financial and General:

t The Applicant must be 65 years

or older or disabled

t The Applicant must be a citizenof the United States as defined

t To apply in Pennsylvania, theapplicant must be a resident of Pennsylvania but there is nowaiting period as such

t The applicant’s available and

countable assets (generally,liquid assets such as cash,stocks, bonds and similar assets)must be worth less then $2,400unless the disregard appliesin which case the amount is$8,000. (See, however, below,for married couples.)

For married couples, the applicant’sspouse may keep approximately one-half of the combined countable assets of both spouses ranging from a minimum,in 2007, of $20,328 up to a maximum of $101,640 (the CSRA or “spousal share”).

The actual amount depends on count-able assets as of date of admission tothe nursing home. Available or count-able assets consist of assets owned bythe applicant in his/her own name andalso assets titled jointly and assets titledin the name of the applicant’s spouse. InPennsylvania, the community spouse’sIRA, 401(k) or other pension funds are

completely exempt.

This is a significant difference betweenPennsylvania and neighboring states in-cluding Delaware, Maryland and NewJersey where the community spouse’sIRA and 401(k) must be spent down.The rule follows the facility where theservices are being provided. The value

of assets to determine the CSRA is cal-culated based on completion of a Re-source Assessment Form. Assets thatare not counted for purposes of the abovecalculation and which may be protectedinclude, but are not limited to, the familyresidence (however, special rules applyas to possible estate recovery), onemotor vehicle, property used in a trade

or business, term insurance, life insur-ance with a face value of a maximumof $1,500, an irrevocable burial reserve,household goods and personal effects.

Disqualification

 Any gifts or transfers for less than fair 

market value, can potentially make theapplicant ineligible to receive Medicaidbenefits even if all of the stated criteriahave been satisfied. For this reason, in-dividuals should be cautious and shouldseek guidance regarding transfers or re-

titling of assets during the 5 year periodprior to applying for benefits. This in-cludes transfers into the name of other family members, gifts to family and other persons, and charitable contributions.

WARNING: Please note that both theCommonwealth of Pennsylvania andthe federal government have recently

enacted substantial changes to the Med-icaid eligibility rules. The implementa-tion of these changes will require further modifications to the Pennsylvania Med-icaid rules. The information containedhere should be used only as a generalguide and, if Medicaid is an issue, youshould immediately consult with an at-torney who is an experienced elder law

practitioner knowledgeable in Medicaidto be sure that the rules are correctlyapplied to your situation.

 As part of the Deficit Reduction Act of 2005 (effective February 8, 2006), manyMedicaid rules were changed. There-fore, it is critically important that infor-mation relied upon by the Applicant is

current information and not commen-tary written before passage of the ActSupport by Children – In addition to theabove, in July, 2005, the PennsylvaniaState Legislature by Act 43 moved intothe Support Law a rarely used law thatcould indicate that adult children mightbe responsible in support actions rela-

tive to their parents. The PennsylvaniaBar Association has taken a formal posi-tion in opposition to this Act and is cur-rently attempting to secure its repeal.

“Look Back” Period and Effective Date

of Ineligibility

Under the prior gifting rules, The County Assistance Office in administering Med-icaid would consider gifts made within36 months, or 60 months if a trust is in-volved, prior to the date when the appli-cant nursing home resident applied for Medicaid. Under the new gifting rules,

under federal law, any gift made sinceFebruary 8, 2006 has the potential tocause a period of ineligibility during the 5year period (60 months) after it is made.

  Administratively the Commonwealthhas issued regulations effective March3, 2007 that they will not consider giftsthat when taken together total less than$500 in a given month. This includes

contributions to charity and gifts to chil-dren and other family members.

Under the prior gifting rules, dependingon the size of a gift, its effect on eligi-bility would expire based on a formula.Under the new gifting rules, the periodduring which the applicant will be unableto receive Medicaid runs from the date

he or she would otherwise qualify, that isfrom the date when assets are down to$2,400 or $8,000 if there is a disregard.This means that when the applicant hasno funds or minimal funds remaining, hewill be expected to pay back gifted fundsto use them for his care. The issue of what will happen if the funds cannot be

recovered as, for instance, when assetsor funds have been given to charity or when funds given to children have beenspent or children refuse to return assetsgiven to them is not addressed. Thereis a procedure for a Waiver for Undue

Hardship but it is possible that the Com-monwealth will proceed against anyonewho received gifts during the affectedperiod. It is therefore, critically impor-tant that families receive knowledgeableadvice concerning likely risks beforetransferring residences, bank accounts,and other assets to any other person or entity.

Proof of Citizenship

 A new federal law requires not only citi-zenship, as defined, but also documen-tary proof of citizenship using certainspecific documents ranked in order of preference such as U.S. Passports or birth certificates to obtain Medicaid ben-

efits.

Medicaid Planning

Medicaid planning is still a viable optionfor some persons under some circum-stances. As one example, a personwho has resided with parents and caredfor them in the parents’ home might,

if certain requirements are satisfied,qualify under the “Caretaker Child” ex-emption to have the family home trans-ferred into the caretaker’s name withoutany period of disqualification and withoutany estate recovery. Knowledgeablelegal assistance should be sought if this is believed to apply to assure that

the criteria are satisfied, because if theperson does not qualify as a “Caretaker Child,” then the parent could be disqual-ified from Medicaid

Pennsylvania now has specific rules af-

fecting loans to adult children, mortgag-es, annuities, purchases of life estates,excess equity in residences over $500,000 and others. Therefore, assis-tance should be sought if there is anyreasonable likelihood that Medicaid willbe under consideration as a source for payment.

Estate Recovery

On the death of a person over age 55who has received Medicaid benefits ina nursing home, the government mustseek recovery of the amounts paid toa nursing home from the deceased’sestate. In Pennsylvania such recov-ery can only be made from the probate

estate, that is, any assets titled in theindividual’s name alone at the time of death that are or could have been trans-ferred by a Will.

VETERANS’ BENEFITS

There are a variety of federal benefitsavailable to veterans and their depen-

dents. Basic eligibility is available to anyperson who served in the armed forcesduring a designated wartime period andreceived an honorable discharge.

marriage and divorce. The Office alsoextends personal visits to veterans andtheir survivors who are shut-ins.

Health Care Benefits

Health Benefits must be applied for atthe local VA Medical Center, which in

Once enrolled, a veteran is eligible toreceive services anywhere in the UnitedStates. VA medical centers provide afull range of medical care, both physi-cal and mental. The cost of such carewill depend on the income of the veteranand upon whether or not the disabili-

ty was “service-related”. Nursing homebenefits may also be available and thecost is determined by these same stan-dards although the tendency, for longterm care services, has been to providea supplement known as Aid and Atten-dance instead of expanding existing res-idential Veterans facilities. Aid and At-tendance is available in some cases for 

war time Veterans and widows/ widow-ers of Veterans to be applied to the costof Assisted Living and in-home care.Prescription benefits under the VA aregenerous especially where other cover-age is not readily available. VA prescrip-tion benefits do count as “creditable cov-erage” under Medicare Part “D.”

PACE AND PACENET

(Pharmaceutical Assistance Contractfor the Elderly)

and PACE PLUS MEDICARE (2006)

Pennsylvania provides pharmaceu-tical assistance for qualified seniors(age 65 and over) under the PACE andPACENET programs. These programsmay be the only pharmaceutical plan for covered seniors or may coordinate cov-erage with private plans in appropriatecases. PACE and PACENET are con-

tinuing even following implementationof the federal pharmaceutical program,Medicare Part “D.” The resulting cov-erage which “wraps around” someMedicare “D” plans is called PACE PlusMedicare and began for some seniorson September 1, 2006. PACE Plus is in-tended to eliminate coverage gaps anddeductibles and to lower copayments.

Pennsylvania seniors with limited incomeand no coverage under either retiree or employer sponsored plans should prob-ably first explore PACE and PACENETto see whether they are eligible, sincePennsylvania has promised to coor-dinate coverages and to supplementin areas such as the “donut hole” de-scribed under Part “D” that Medicare will

not cover. Citizens are eligible for PACEif their annual income for the precedingyear is not higher than $14,500 for asingle person or $17,700 for a marriedcouple living together. PACENET incomelimitations are $23,500 for a single and$31,500 for a married couple living to-gether.

You must have lived in Pennsylvania for at least ninety days prior to the date of your application and you must not be eli-gible for pharmaceutical benefits under medical assistance (Medicaid).

The PACE and PACENET programs arebased on income only and not on assets.The basic PACE plan has no deductiblebut there is a co-pay of $6 per genericprescription and $9 for brand name med-ications. PACENET requires a $500 per person deductible. Thereafter, you paythe first $40 per month on prescriptionsand an $8 co-pay for generic drugs and

$15 for brand name drugs.

Eligibility is subject to annual renewal,and eligibility could be terminated if youmove out of state or are found guilty of fraud or abuse or if you are covered byanother plan which pays the full costs of your prescriptions.

  Applications are available from your local area Agency for the Aging (Chester County Department of Aging Services),pharmacy, senior citizen center, or your local legislator’s office. Your completedapplication must be accompanied byproof of age and residency. You mayapply thirty days prior to your sixty-fifthbirthday.

 Pennsylvania’s prescription program re-quires the use of generic drugs, unlessthere are no generic drugs available for the prescription you require or if thereare certain medical restrictions whichrequire the use of a brand-name drug.Participating pharmacies display a

PENNSYLVANIA LOW INCOME

HOME ENERGY ASSISTANCE

PROGRAM (LIHEAP)

The Pennsylvania Department of PublicWelfare administers a low income homeenergy assistance program to help lowincome families with their winter heatingbills. LIHEAP is not a welfare programor loan and no lien is placed on thehome. Consumers do not have to paythe money back.

LIHEAP consists of three components:cash benefits to help eligible low incomehouseholds pay for their home-heatingfuel; crisis payments, if needed, toresolve weather-related supply short-age, and other household energy-related emergencies; and energy con-servation and weatherization measuresto address long-range solutions to the

home heating problems of low incomehouseholds. Application to LIHEAP incrisis may also assist in preventing dis-connection or termination of heatingservice by a utility. Payments under LIHEAP can be depen-dent on available funding for the year.The maximum crisis benefit for the year 

2006 was projected at $300. Incomelimits depend on household size. In 2006,the income limit for cash and for crisisassistance for a single person house-hold was $12,920 and for a two personhousehold was $17,321. Applicants areto be treated equitably whether they arehomeowners or renters. Weatheriza-

LONG-TERM CARE FACILITIES

Long-term care facilities can be thoughtof as housing with integrated supportive

services. The level of service varies withthe type of facility. This section outlinesimportant aspects of the most commontypes: nursing homes, assisted living fa-cilities and continuing care retirementcommunities. Nursing Homes – Skilled or Intermedi-ate Care Nursing Facilities

 A nursing home is a facility where resi-

dents receive around-the-clock nursingcare designed to help them with the activ-ities and needs of daily living and healthcare. Residents do not need the kind of acute health care provided in a hospital.However, they do need more supportivecare than is available in either indepen-dent living or assisted living. A personusually enters a nursing home after all

other long-term care options, such as anassisted living facility or living at homewith supportive services, are found to beinadequate.

Medicare does not provide substantialcoverage for long term nursing homecare. Medicare may pay for a portion of

the cost for the first 100 days of a nursinghome stay, under very limited circum-stances that are considered to be reha-bilitative. Those circumstances are:

t Skilled nursing or rehabilitationservices are provided within 30

days of a Medicare-coveredhospital stay of at least 3 days;

t  A doctor certifies theresident’s need for skilledcare on a daily basis;

t Skilled care is actuallyreceived on a daily basis;

t The facility is Medicare

approved.

If these requirements are met, Medicaremay fully cover up to the first 20 days of skilled care and a portion of the cost for the next 80 days of skilled care. It mayand often does cover less time than a full100 days. Note that continued receipt of Medicare benefits depends on progress

in therapy. Medicare does not cover custodial care.

Medicaid is the only public benefitprogram that covers intermediate or skilled care provided in a nursing homeafter Medicare benefits are exhausted.In order to be eligible for Medicaid, anindividual must not have “countable”

assets of more than $2,400 (or $8,000if a “disregard” applies. See Medicaidsection of this Handbook. “Countable”assets are all assets available to the in-dividual, except for:

t the individual’s residenceand personal belongings;

t one car;

t an irrevocable prepaidburial fund;

t $1,500 of life insurance.

When a nursing home resident’s assets

have been reduced to $2,400 (or $8,000),Medicaid will cover the resident’s stay inthe nursing home. Keep in mind, onceeligible for this Medicaid nursing homeassistance, the resident’s income is con-sidered available to pay for his or her nursing home care while Medicaid paysthe difference. The resident may keepfrom his or her income $40 per month for 

personal needs. In the case of a marriedcouple, the spouse remaining at home isallowed to keep at least $20,328 of thecouple’s countable assets and as muchas one-half of the assets, up to $101,640(2007 rates). Also, there are very com-plicated Medicaid rules which take intoaccount the amount of each spouse’sindividual income and the amount of 

the couple’s countable assets that thespouse remaining at home is allowedto keep. This may allow the spouse re-maining at home to retain a minimummaintenance allowance of up to $1,650per month or additional to cover excessshelter costs.

Because of the extremely complex rules

governing Medicaid eligibility, it is ad-visable to seek the counsel of an elder law attorney to guide you through thismaze. Your particular situation maylend itself to legitimate and legal waysto “spend down” your countable assetsto the $2,400 threshold while preserv-ing some portion of such assets for your

spouse staying at home or for other family members. Also, under certain cir-cumstances, particularly where incomeof both spouses combined is below themonthly minimum, Medicaid rules allowfor asset protection designed to let the

spouse staying at home retain morethan the designated spousal share.

Residents’ Rights

Upon admission to a nursing home, aresident or his/her family will be requiredto sign an admission contract. Enteringinto a nursing home can thrust a family

into emotional turmoil. A prospective res-ident or the family member or membersresponsible for the resident might feelpressure under emergency circum-stances to sign a nursing home admis-sion contract without a careful review of its terms. Do not be pressured Read thecontract and have it reviewed by a elder law attorney before signing. Federal and

state laws have been enacted to protectindividuals entering nursing homes andan experienced advisor can make surethat you get the benefit of these protec-tions. For example:

t  A nursing home cannot require aresident to waive his/her right toapply for Medicaid. Furthermore,

a nursing home cannotdiscriminate against a residentwho is receiving Medicaid.Nursing homes must establishand maintain identical policiesand practices regarding transfer,discharge and covered servicesfor all residents regardless of 

source of payment.

t  A nursing home cannot require athird party guaranty of paymentas a condition of admission or continued stay.

t   A nursing home is allowed torequire that an individual havinglegal access to a resident’sincome and assets, such as anagent under a power of attorney,sign a contract, without the agentincurring any personal liability,promising to pay for a resident’scare from the resident’s funds.

t   A nursing home cannot requirea resident to agree to payprivately for a specified periodof time before the nursing homewill allow the resident to convertto Medicaid.

Once admitted to a nursing home, a res-ident enjoys certain rights mandated by

both federal and Pennsylvania law. For example:

t   A nursing home must conducta comprehensive assessmentof every resident’s functionalcapacity within 14 days of admission. The assessmentmust be used to develop,

review and periodically revise,as necessary, an individualizedplan of care for each resident.The resident, the resident’sfamily and, if desired, theresident’s legal representativemust be given full opportunity toparticipate in the development

of the plan of care.

t  A resident has the right to choosea personal attending physicianand to be kept fully informedabout care and treatment.

t  A resident has the right to remainfree of physical and chemicalrestraints which are not requiredto treat the resident’s medicalcondition.

t  A resident has the right to privacywith regard to communicationsin writing and by telephone andwith regard to visits of family and

meetings of resident groups. Aresident must be provided withreasonable access to the use of a telephone where calls can bemade without being overheard.

t  A resident has the right to accessto clinical records upon requestby the resident or the resident’slegal representative.

t  A resident has the right to voicegrievances with respect totreatment or care without fear of reprisal.

t   A resident can only betransferred or discharged froma nursing home under limitedcircumstances which are spelled

out in the law, upon 30 daysadvance written notice.

t   A nursing home must informevery resident of his/her legalrights, orally and in writing, at thetime of admission. Pennsylvaniamaintains an ombudsmanprogram to investigate and

resolve complaints made by or on behalf of residents of nursinghomes and other long term carefacilities.

The Pennsylvania Department of Aginghas designated the Area Agency on

  Aging for each county to be the localproviders of these ombudsman servic-es. The Chester County Departmentof Aging Services telephone number is(800) 692-1100 ext 6350 or (610) 344-6350.

 Assisted Living Facilities

 Assisted living is housing for older indi-viduals who need some assistance withthe activities and needs of daily livingand perhaps some medical help, butwho do not need the degree of care pro-vided in a nursing home. The goal of anassisted living facility is to help peoplelive as independently as possible.

 An important benefit of residency in anassisted living facility is help with med-ication. A resident can be remindedwhen to take medication and a nursecan assist the resident in taking medi-cations.

Payment for residency in an assist-ed living facility is almost exclusively

through private arrangements with theresident. Neither Medicare nor Medicaidcovers residency in an assisted living fa-cility. If a resident needs some sort of skilled medical or nursing care, Medi-care may cover such care under thesame rules that would apply to homehealth care in general. Long-term care

insurance will pay benefits for residen-cy in an assisted living facility if the pol-icy’s “benefit triggers” requirements aremet by a resident’s need for assistancewith activities of daily living or by a res-ident’s cognitive impairment. Most long

term care insurance policies define “ac-tivities of daily living” as including dress-ing, eating, bathing, toileting and trans-ferring from a bed to a chair, and usuallyrequire that an individual needs assis-tance with a certain number of these ac-tivities of daily living.

Contract Questions

Upon entrance to an assisted living facil-ity, a prospective resident should care-fully review the admission contract. Sig-nificant issues to consider in evaluatingan admission contract include:

t What personal care services areto be provided? Who deliversthese services? Is the service

provider licensed or certified?

t What are the monthly or other charges for such services?

  Are housekeeping servicesincluded? How can fees beincreased and what happens if fees are increased and a residentcannot afford the higher fee?

t In the case of a married couple,what happens upon the death of a spouse? Is a change of livingunit required? How would feesbe affected?

t What recreation or culturalactivities are available and arethey included with the monthly

fee?

t Is transportation provided to suchthings as doctor appointments,shopping and communityactivities? Is a separate feecharged?

t   Are nursing services availableat the site? What happens if a resident’s health declines?Is the facility responsible for coordinating medical care?

t How does the facility determinethe point at which a residentcannot be served by the facility?

What recourse does a residenthave to challenge the facility’sdecision? Is there a grievanceprocess?

Residents’ Rights

Under Pennsylvania law, residents of anassisted living facility have the followingrights:

t the right to privacy, including theright to have access in reasonableprivacy to a telephone and theright to have uncensored accessto the mail;

t the right to receive visitors;

t the right to leave and return to

the home;

t the right to participate in religiousactivities;

t the right to exercise the rights of acitizen and to voice grievances;

t the right to be provided with 30days advance written notice of

the facility’s intent to terminatea resident’s stay and the reasonfor termination;

t the right to be free of chemicaland physical restraints.

Continuing Care RetirementCommunities

These facilities provide different levelsof care based on the particular needsof the individual resident. New residentsusually move into independent livingunits. As they age and become physical-ly disabled and need assistance with theactivities and needs of daily living, resi-dents move to an assisted living facilitylocated on the grounds of the continu-ing care retirement community. Somecontinuing care retirement communitiesprovide assisted living services in theindependent living units so that a resi-dent does not have to move. If physicaldecline continues and more intensivecare is needed, nursing home care isalso available within the confines of thecontinuing care retirement community.Upon entrance into a continuing careretirement community, a resident entersinto a contract whereby the continuingcare retirement community agrees toprovide housing, a certain level of activi-ties and health care support as neededin return for the resident’s payment of an entrance fee and monthly occupan-

cy fees. In most cases, residents donot own their living unit. The servicesoffered can vary; most provide house-cleaning, laundry facilities and at leastsome meals. The monthly fee for resi-dents who move into the assisted living

or nursing home facilities may be higher than if they had remained in an indepen-dent living unit.

 A careful review of the contract, prefer-ably by an attorney, is advised to makesure the resident understands what heor she is buying. Some continuing careretirement communities offer unlimited

health services in exchange for the en-trance fee, while others provide that res-idents pay an additional fee for healthcare services as they are needed. Stillothers offer a combination of the two.The fee-for-services arrangement isbecoming increasingly more common.Other important issues to be reviewedin a continuing care retirement commu-

nity contract are:t Who determines when a resident

must change living arrangementsdue to a decline in health?

t What are a resident’s rights andresponsibilities with regard tofurnishing and altering his/her living unit?

Pennsylvania law mandates that all con-tinuing care retirement community con-tracts:

t provide for continuing care;

t specify all services to be provided

and provide that a residentcannot be liable to a healthcare provider for services thatthe continuing care retirementcommunity promises to furnish;

t describe any exclusions or limitations on coverage for pre-existing conditions;

t provide for termination by either 

party upon 30 days written noticeand the terms for refund upontermination;

t contain notice of rescissionrights before moving in.

The advantages of living in a continuingcare retirement community are:

t   An individual whose healthdeclines can move into anassisted living unit or, if necessary, to a nursing homewithin the same residentialcommunity.

t Payment of the entrance fee locksin a fixed price for continuingcare at an amount that is usuallyless than the market rate for nursing home care. For thisreason, some people consider a continuing care retirementcommunity as a form of long termcare insurance. However, if therewill be a substantial increase inthe monthly service fee upon

moving into the assisted livingor the nursing home portion of the continuing care retirementcommunity, there could stillbe a need for long term careinsurance.

t   A couple who moves into acontinuing care retirementcommunity is assured that if onespouse must enter the nursinghome, the other spouse will beliving on-site and can easilyvisit.

Because a continuing care retirementcommunity comprises both assistedliving and nursing home care, differentactivities within the continuing care re-tirement community can be governedby different laws and regulations. Res-idents would be protected by the lawsthat apply to assisted living facilitieswhile they are receiving assisted livingservices and they would be protectedby the laws that apply to nursing homeswhen residing in the nursing home com-ponent of the continuing care retirementcommunity. See previous sections cov-ering assisted living facilities and nursinghomes for a description of these protec-tions.

Nursing Home Licenses: Problems,Sanctions and Revocations

  Although nursing home placement isa difficult decision, there are people tohelp you to verify that you are placingyour loved one in a secure environment.One contact person is the long-termcare ombudsman who responds to care

 Any employee or administrator of a li-

censed facility who has reasonablecause to believe that a resident of thefacility is a victim of abuse is requiredunder Pennsylvania law to report theabuse immediately. The law does notrequire that the reporter be a direct eye-witness; having more than a suspicionobligates them to make an oral report atonce, followed up by a written report to

law enforcement officials. This reportingrequirement protects a care-dependentperson and applies to all caretakers.Civil and criminal fines and imprison-ment for up to one year can be imposedupon the person or facility that commitsthe violation or abuse.

Pennsylvania law protects nursing home

residents by requiring criminal historybackground checks by the Pennsyl-vania State Police of all employees of public or private nursing homes, per-sonal care facilities, adult daycare andhome healthcare providers. Employeeswith certain felony and misdemeanor convictions are precluded from workingin these facilities.

The final sanction under Pennsylvaniastate law is that a facility can have itslicense revoked or its licensing withheldin the first place for any one of the fol-lowing reasons: gross incompetence,negligence, misconduct in operating thefacility or mistreating or abusing an indi-

vidual cared for in the facility. This sanc-tion applies to both physical and mentalabuse of a patient. This law serves asa deterrent to such abuse since thefacility cannot do business without alicense. Court cases in Pennsylvania

LONG-TERM CARE INSURANCE

The term “long-term care” is general-ly understood to mean the kind of careneeded by the old and frail who are, for example, suffering from a dementia suchas Alzheimer’s disease or other disabili-ties of old age. Long-term care mostlyconsists of custodial care, i.e., care de-signed to assist an individual to performthe activities and meet the needs of dailyliving. Such activities and needs includeeating, bathing, dressing, toileting andtransferring from a bed to a chair. Super-vision or assistance to assure the safetyof those with cognitive impairments isalso considered custodial care. Long-term care can be provided in the homeor in a long term care facility, such as anursing home or an assisted living com-munity.

Neither Medicare nor supplementalMedigap insurance covers long-termcustodial care. Long-term care insur-ance sold by commercial insurancecompanies can be purchased to cover long-term care.

Long-Term Care Costs

The average cost of nursing home carein Pennsylvania is currently more than$81,000 a year. Home health care maycost up to one-half this amount depend-ing on the intensity of the care servic-es provided. In fact, around-the-clocknursing care can exceed the cost of a nursing home. Assisted living facili-

ties can run from $60 to $150 a day or $38,000 a year.

Services Covered

When you purchase a long term care in-

surance policy, it is critical that you un-derstand the types of services that willbe covered. Some policies only cover care provided in a nursing home, whileothers also cover services provided inassisted living facilities, adult day carecenters or other community facilities. Apolicy should be carefully reviewed soyou understand exactly the kinds of ser-

vices that it will cover.

If you want to remain at home as longas possible, consider a policy that in-cludes home care coverage. Policiesdiffer widely in how home care coverageis provided, so a very careful review of this type of coverage is strongly advised.Some policies limit home care coverage

to skilled services, i.e., those performedby registered nurses, licensed practi-cal nurses and occupational, speech or physical therapists. Some policies offer a broad range of home care benefitswhich include services of home healthaides who can assist with custodial care.Some policies will also cover homemak-er or chore worker services which would

pay for aides who cook meals and dohousework. Most policies will not paybenefits to family members who performhome care services.

Coverage Needed

Most policies express benefits in terms

of a daily amount. In order to make aninformed decision as to the amount of coverage that you will need, you musthave an idea of the amount of long termcare costs that you anticipate. If your ideal long term care facility charges $180

a day, you will need a policy that paysa daily benefit of $180 less the amountof your income. For example, if your income consists solely of Social Secu-rity benefits of $1,500 a month ($50 aday, based on a 30-day month), you willneed, at the bare minimum, a policy witha daily benefit amount of $130.

Factors Affecting Costs

Most policies include a waiting period,sometimes called an “eliminationperiod,” before benefits can begin. Thismeans that you can choose to have ben-efits begin 20, 30, 60, 90 or 100 daysafter you enter a long term care facility.The longer the waiting period, the lower 

the cost of the policy. Of course, youwill have to have resources to cover thecost of long term care during the waitingperiod.

 An important feature to consider in anylong-term care insurance policy is infla-tion protection. Long-term care that costs$3,300 a month now will cost $5,375 a

month in 10 years and $8,756 a monthin 20 years, assuming an annual infla-tion rate of 5%. The younger you arewhen you purchase the policy, the moreimportant it is to consider adding infla-tion protection. Obviously, this protec-tion adds to the cost of the policy.

Benefit Triggers

When the benefits are payable under along term care insurance policy is de-termined by what are commonly called“benefit triggers.” A benefit trigger is a

medical condition or a degree of physi-cal or mental disability that an individu-al must meet before qualifying for ben-efits.

For a person with a physical, as opposedto a mental disability, policies usuallyprovide for benefits to begin when thatperson cannot perform a specified

number of “activities of daily living,” i.e.,eating, bathing, dressing, toileting andtransferring from a bed to a chair. Poli-cies can differ on the number of activi-ties of daily living that a person mustneed assistance with before benefitscan be triggered. Also, it is important tounderstand how a policy defines the in-ability to perform a particular activity of 

daily living. Does the policy require theneed for “hands-on” assistance or doesit only call for the need for someone tosupervise the activity? The more clearlya policy defines its benefit triggers, theeasier it will be to make a claim whennecessary.

For a person with a mental or a cog-

nitive disability, some policies providethat benefits are triggered by a diag-nosis of “cognitive impairment,” suchas Alzheimer’s disease or Parkinson’sdisease. This is an important feature tolook for in a policy. A person can havea cognitive impairment and need longterm care services because it would be

unsafe to leave him or her alone but, if such a person could perform the activi-ties of daily living without assistance,benefits would not be payable withoutthe cognitive impairment trigger.

Cost Considerations

Long term care insurance is most ap-propriate for individuals under age 65whose assets are between $200,000and $1,000,000. Premiums are usuallyset for life, based on your age when youbuy the policy; each premium is lower,therefore, if you buy at an earlier age.

If you have more than $1,000,000 inassets, it may not be worth paying thepremiums over a long period of time toprotect an estate of that size againstthe risk of long term care costs. Thechances that you will need any sort of long term care is minimal until you reachyour eighties. At current interest rates,it takes about $770,000 in investment

assets to produce funds necessary tomeet annual long-term care costs for 10years; therefore, a person with assetsof this magnitude can essentially self-insure against the risk of long term carecosts.

Consumer Tips

t  Ask questions.t Take your time.

t Get the actual policy and read itbefore you buy it.

t   Ask the insurance agent for athorough explanation of whatdegree of disability triggers

benefits.

t Do not let the attractivenessof a lower premium push youinto a policy that provides lesscoverage than you really need.

  A cheap policy that leaves youunderinsured is no bargain anda waste of money.

t Consider policies from at leastthree companies. No two longterm care insurance policies arealike.

t Do not spend more than 5%or 6% of your annual income

on long term care insurancepremiums.

t Check the financial stability of the insurance company you areconsidering.

t Do not be pressured. Once youreceive a policy that you havepurchased, you have 30 days

to review it and return it if youchange your mind.

Independent Advice

Examining long term care insurancepolicies is fraught with difficulty for theconsumer. This section has outlined themore important provisions of such poli-

cies and has tried to convey a senseof the complexity of the issues raised.Other similarly complex provisions notcovered in this chapter are duration of coverage, exclusions from coverage andvarious optional coverages. Once youstart shopping for long term care insur-ance, it would not be unusual for you to

The Pennsylvania Department of Agingoutlines several types of housing options

for all levels of independence.

Independent Housing Options 

 A Continuing Care Retirement Commu-nity (CCRC) offers independent living,usually in an apartment or cottage, andaccess to a higher level of care such as

personal care or a nursing facility. Resi-dents move between levels of care astheir needs change. Services, such asmeals, medical care, social and recre-ational activities, are provided through acontractual arrangement for the lifetime

of the resident. Residents usually payan entrance fee and a monthly charge.Retirement Communities offer indepen-dent living in an apartment or cottage.They are intended for healthy, mobileolder people and generally offer nospecial services. Units may be rented or purchased. Many retirement communi-ties offer recreational amenities such as

golf, swimming or tennis.

Subsidized Housing is made availableby the federal government providingrental assistance to low income elderlypeople. Income eligibility is 50% of themedian income for the county of resi-dence; individuals must be age 62 or older. Assistance is determined by an

individual’s income with tenants paying30% of their income toward the rent.

Housing Options for Individuals WhoMay Require Assistance or Supervision

Domiciliary Care Services for adultsare supervised living arrangements ina homelike environment for adults who

are unable to live alone because of dem-onstrated difficulties in accomplishingdaily activities, social or personal adjust-ment, or resulting from disabilities. TheChester County Department of AgingServices is responsible for assessmentand placement of residents in domiciliarycare homes. Residents are eligible for

a domiciliary care supplement paymentif they are eligible for SSI or have anincome less than the combined federal/state payment for domiciliary care andare not related to the provider.

Nursing Facilities provide medical care,rehabilitation, or other health services toindividuals who do not require the careand treatment of an acute-care hospi-tal. Most nursing facility residents areunable to take care of themselves ontheir own and may have chronic illness-es or have been transferred from a hos-pital following a serious illness, accident

or operation.

Personal Care Homes, sometimes called“assisted living facilities” offer room andboard and assistance with activities of daily living (such as bathing, grooming,meal preparation, taking prescriptionmedication but do not provide the levelof care offered by a hospital or nursing

home.

Family Caregiver Support Programs

There are State and National FamilyCaregiver Support Programs whichfocus on reinforcing the care beinggiven to frail family members in their own homes by reimbursing some of the

costs of supplies, services, equipmentand home modifications and by offeringcounseling, educational and financial in-formation.

  An initial assessment determines thepackage of benefits best suited to theneeds of both the caregiver and the

senior receiving the care. Eligibility isbased on household income on a slidingscale, but there are differences betweenthe state program and the national.

Geriatric Care Managers

In this day of many options for seniors,a Geriatric Care Manager can helpconnect families with services that areappropriate for their physical, financial,and emotional needs Such a Manager can evaluate housing options, selectsuitable placement, assist with the ad-mission and moving processes, or 

arrange for services that will permit thesenior to remain safely at home. Greatcare should be taken in selecting a CareManager with whom you wish to workand on whom you expect to rely.

ELDER ABUSE AND NEGLECT

 Abuse or neglect occurs in all commu-nities, all economic levels, among allraces, all nationalities and people of allreligions. When the victim is elderly itis known as “Elder Abuse.” Federal andstate laws make it clear that everyonehas the right to be safe. No one shouldbe too embarrassed to get help and noone has to tolerate abusive situations.Federal and state laws also protect older adults who lack the capacity to protectthemselves and are at immediate risk of abuse, neglect, exploitation or abandon-ment.

Signs of Abuse or Neglect

  Abuse can be any one or more of thefollowing:

t Infliction of injury;Unreasonable confinement;Intimidation;

 Any punishment thatresults in physical harm;

t Infliction of mental anguish;

t Withholding food, necessarymedication or medical services;

t Sexual harassment;

t Rape;

t Any physically or emotionallycontrolling behavior thatrestricts independenceor activity.

Elder abuse and neglect is not alwayseasy to identify; signs to consider include:

t Bruises and broken bonesblamed on falls; the real causemay be pinching or beating;

t Weight loss which mightbe result of starvation or neglect, not just illnessor lack of appetite;

t Dementia is not always apart of aging; malnutrition or the misuse of medicationscan also be causes.

Don’t be afraid to make the call. Do notconfront the abuser yourself. Your callmay help protect a neighbor, a friend, aloved one or you from further abuse. Thecall could mean the difference betweenlife or death.

Protection From Abuse Orders (PFAs)

There is assistance available to get anorder to keep the abuser away from thevictim. In order to petition for a Protec-tion From Abuse Order (PFA), one mustbe, or have been, in a relationship with,or a family member of, the abuser. APFA can prohibit abusive conduct andcan remove/exclude the abuser from

Zero Tolerance for Abuse

There are many organizations in Chester County working to prevent elder abuse.They have zero tolerance for abuse, butthey can’t help if they don’t know aboutthe abuse. Whenever you hear or seeabusive behavior you should call 911. If you ignore the abuse or think it will get

better without intervention, you may berisking your life or the life of someoneyou know. Abuse always gets worsewithout help; everyone should know thathelp is available.

AMERICANS WITH DISABILITIES

ACT (ADA)

Upon finding that some 43,000,000

  Americans have one or more physi-cal or mental disabilities, and that thisnumber is increasing as the populationas a whole is growing older, Congress,in 1990, passed the Americans with Dis-abilities Act. The purpose of the ADAis to provide a clear and comprehen-sive national mandate for the elimina-tion of discrimination against individuals

with disabilities. The ADA ensures thatthe Federal Government plays a centralrole in enforcing standards to addressdiscrimination faced by those with dis-abilities in employment, public services,public accommodations, and telecom-munications. At the core of the ADAis the prevention of job discriminationagainst those with disabilities.

Definition of Disability

The Act defines disability as follows:

t  A physical or mental impairmentthat substantially limits oneor more of the major lifeactivities of such individual;

t  A record of such animpairment; or 

t Being regarded as havingsuch an impairment.

What the definition means is that if an in-dividual, when compared to an averageperson, has a significant restriction on a

major life activity (or is unable to performa major life activity), that individual is con-sidered disabled under the ADA. Major life activities include functions such ascaring for oneself, performing manualtasks, walking, seeing, hearing, speak-

ing, breathing, learning and working.It should also be remembered that thedisabling condition must be permanentor long-term to come under the ADA.Therefore, even if a temporary condi-tion, such as a broken bone, the flu, or pneumonia, limits a person’s activities,it is not considered a disability under the

 ADA.

Employment

No covered entity shall discriminateagainst a qualified person with a disabil-ity because of the disability of such indi-vidual in regard to job application proce-dures, the hiring, advancement, or dis-charge of employees, employee com-

pensation, job training and other terms,conditions, and privileges of employ-ment. The term “covered entity” meansan employer, employment agency, labor organization or joint labor-manage-ment committee. The term “employer”means a person engaged in an indus-try affecting commerce who has 15 or more employees for each working day

in each of 20 or more calendar weeks inthe current or preceding calendar year,and any agent of such person. The term“employer” does not include the UnitedStates, a corporation wholly owned bythe government of the United States,an Indian tribe, or a bona fide privatemembership club (other than a labor or-

ganization) that is exempt from certainlaws. The ADA also does not prohibitreligious corporations, associations, ed-ucational institutions, or societies fromgiving preference in employment to indi-viduals of a particular religion.

Reasonable Accommodations

Under the terms of the ADA, an employ-er must make “reasonable accommoda-tions” to an employee, or potential em-ployee, who has a disability. If an em-ployee can perform the essential func-tions of a job, i.e. the primary duties of a

 job position, with a reasonable accom-modation being made by an employer,then the employer cannot fire, or refuseto hire, the employee because of a dis-ability. If an employer does refuse tohire a person, or fires a current employ-ee solely because of a disability or toavoid having to accommodate that dis-ability, then that employer has discrimi-

nated against that person, according tothe ADA.

The term “discriminate” includes notmaking reasonable accommodations tothe known physical or mental limitationsof an otherwise qualified individual witha disability who is an applicant or em-ployee, unless such covered entity can

demonstrate that the accommodationwould impose an undue hardship on theoperation of the business of the coveredentity. There are other ways in which acovered entity may improperly discrimi-nate, such as excluding or denying equal

 jobs or benefits to a qualified individualbecause of the known disability of an in-

dividual with whom the qualified individ-ual is known to have a relationship or association; and utilizing standards, cri-teria, or methods of administration thathave the effect of discrimination on thebasis of disability or that perpetuate the

discrimination of others who are subjectto common administrative control.

The term “reasonable accommodation”means any change in the work environ-ment or in the way things are normallydone on the job so that a person with adisability can perform the essential func-tions of the job safely and adequately.

This may include making existing facili-ties used by employees readily accessi-ble to and usable by individuals with dis-abilities (such as providing a ramp) andmay include job restructuring, part-timeor modified work schedules, reassign-ment to a vacant position, acquisition or modification of equipment or devices,appropriate adjustment or modifications

of examinations, training material, or pol-icies, the provision of qualified readersor interpreters, etc.

No employer is required to lower produc-tion standards or eliminate an essential

 job function or duty as a reasonable ac-commodation. Furthermore, an em-ployer may argue that making a certain

necessary accommodation will causean “undue hardship” to their businessand thus they should be relieved of thatobligation. The term “undue hardship”means an action requiring significantdifficulty or expense. In evaluating an“undue hardship”, consideration is givento the overall size and financial resourc-

es of the company as well as to the typeof operation or operations of the coveredentity. It is also a defense to a chargeof discrimination that an alleged appli-cation of qualification standards, tests,or selection criteria that screen out or 

tend to screen out or otherwise deny a job or benefit to an individual with a dis-ability has been shown to be job-relatedand consistent with business necessity,and such performance cannot be ac-complished by reasonable accommoda-tion. The term “qualified standards” mayinclude a requirement that an individualnot pose a direct threat to the health or 

safety of other individuals in the work-place.

Reassignment

In order to qualify for protection under the ADA, an employee should be able toperform the essential functions of their 

  job, with reasonable accommodation.

However, the courts have found that if aperson is unable to perform the essen-tial job functions of their current posi-tion, the employer may still be obligatedto reassign him or her to another posi-tion that he or she can perform, with or without accommodation. This obligationto reassign an employee arises under any of three different circumstances:

t If the employee cannot performthe essential functions of the present position, despitereasonable accommodations;

t If the employer claims theaccommodation neededto keep the employee in

their current position wouldcause undue hardship; or 

t If no accommodation ispracticable or possible for the person to perform the jobduties of the current position.

Furthermore, if reassignment is appro-priate, there has to be a position avail-able; the employer need not create one.The position must be vacant and the em-ployee must qualify for the new position.In the example where the employee hasa speech impediment and cannot act asa telephone receptionist: if the employer has a vacant word processing positionavailable and the employee can effec-tively use a word processor and performthe duties of that position, then reas-signment is appropriate. Although reas-signment seems like a great idea, it canbe to a lower paying position, or outsidethe geographical area, in which casethe employee pays the moving expens-es. If the employee refuses the positionbecause of lower pay or a move beingrequired, he or she cannot later comeback and make a claim against the em-ployer under the ADA, since the employ-er satisfied the obligation.

Medical Examinations

The prohibition against discriminationshall include medical examinations andinquiries. Except in certain circumstanc-es, a covered entity shall not conduct amedical examination or make inquiriesof a job applicant as to whether such ap-plicant is an individual with a disability or as to the nature or severity of such dis-

ability. An examination must be shown tobe job-related and consistent with busi-ness necessity. Also, if an examinationis given after an offer has been madebut prior to commencement of the em-ployment duties it must be shown that

all entering employees are subjected tosuch an examination regardless of dis-ability. In such a situation, the employer may condition the offer on the results of the examination but must maintain themedical records in separate files andadhere to rules of confidentiality. Super-visors and managers may be informedregarding necessary restrictions on the

work or duties of the employee and nec-essary accommodations, and first aidand safety personnel may be informed if the disability might require emergencytreatment. Government officials inves-tigating compliance with the ADA alsoshall be provided relevant informationupon request.

 A covered entity may also conduct vol-untary medical examinations that arepart of the employee health programavailable to employees at the work site.

 A covered entity may make inquiries intothe ability of an employee to perform job-related functions.

Illegal Use of Drugs and Alcohol

The term “qualified individual with a dis-ability” does not include any employ-ee or applicant who is currently en-gaging in the illegal use of drugs whenthe covered entity acts on the basis of such use. The ADA does not, however,exclude those who have completed or

are participating in drug rehabilitationprograms. Covered entities are allowedto adopt or administer reasonable poli-cies such as drug testing to ensure thatthe individual is no longer engaging inthe illegal use of drugs. A covered entity

may also require that employees shallnot be under the influence of alcohol atthe workplace. A covered entity may alsohold an employee who engages in theillegal use of drugs or is an alcoholic tothe same qualification standards for em-ployment and behavior that such entityholds other employees, even if any un-satisfactory performance or behavior is

related to the drug use or alcoholism of such employee.

Posting Notices

Every covered entity as defined aboveshall post notices in an accessible formatto applicants, employees, and membersdescribing the applicable provisions of 

the ADA.

Receipt of Services

The term “qualified individual with a dis-ability” also includes an individual witha disability who, with or without reason-able modifications to rules, policies, or practices, the removal of architectural,

communication, or transportation barri-ers, or the provision of auxiliary aids andservices, meets the essential eligibilityrequirements for the receipt of servicesor the participation in programs or activi-ties provided by a public entity.

The term “public entity” means any state

or local government, any department,agency, special purpose district, or other instrumentality of a State or States or local government, and the National Rail-road Passenger Corporation (as well asother certain commuter authorities).

Under the ADA, no qualified individualwith a disability shall, by reason of suchdisability, be excluded from participationin or be denied the benefits of the ser-vices, programs, or activities of a publicentity or be subjected to discriminationby any such entity.

 After August 25, 1990, it became unlaw-ful discrimination for a public entity thatoperates a fixed route system to pur-chase or lease a new bus, a new rapidrail vehicle, a new light rail vehicle, or any other new vehicle if said vehicle isnot readily accessible to individuals withdisabilities, including individuals whouse wheelchairs. A public entity that op-

erates a fixed route system (other thana system that provides only commut-er bus service) must provide Paratran-sit and other special transportation ser-vices to individuals with disabilities, in-cluding those in wheelchairs, which aresufficient to provide these individuals alevel of service that is comparable to thelevel of designated public transportation

services provided to individuals withoutdisabilities; or, in the case of responsetime, a level of service comparable, tothe extent practicable, to the level of such public transportation services pro-vided to individuals without disabilities.

Public Accommodations

No individual shall be discriminatedagainst on the basis of disability in thefull and equal enjoyment of the goods,services, facilities, privileges, advantag-

es, or accommodations of any place of public accommodation by any personwho owns, leases (or leases to), or oper-ates a place of public accommodation.

  A private entity is considered a “publicaccommodation” if the operation affectscommerce. Included are inns, hotels,motels, restaurants, bars, motion picture

houses, concert halls, stadiums, grocerystores, clothing stores, laundromats, li-braries, zoos, parks, day care centers,senior citizen centers, golf courses,gymnasiums, etc. Making accommoda-tions to individuals with disabilities mustbe “readily achievable.” “Readily achiev-able” means able to be easily carriedout without much difficulty or expense.

Factors include the nature and cost of the action needed, as well as the overallfinancial resources of the facility or fa-cilities involved.

AGE DISCRIMINATION IN

EMPLOYMENT ACT (ADEA)

Who and what does the Act protect?The Age Discrimination in Employment

 Act protects people who are 40 and older from discrimination in the workplace.What is considered discrimination in theworkplace?

  Any act by an employer that treatspersons unfairly because of their age isconsidered discrimination in the work-place. This includes not only being firedbecause of their age, but also, beingtreated differently or less favorably. For example, someone over 40 receives lesspay than someone younger for doing thesame work.

What must be proven in a discriminationclaim? In order to be successful in a dis-crimination claim you must prove all of the following:

t You were qualified for the job,

t Someone younger and lessqualified was hired in your place,

t  Age was a determining factor inthe decision, AND

t There is no other valid reasonfor the failure to hire you.

What if an employer tries to disguise agediscrimination by claiming that the layoff or discharge is the result of downsizingor a reduction in the workforce? In sucha case, the discharged employees mayhave a claim under the ADEA if they can

What do you do if you feel that you havea claim under the ADEA? Special agen-

cies have been set up to assist you indiscrimination cases. In Pennsylvania,the agency set up to assist in discrimina-tion cases is the Pennsylvania HumanRelations Commission (PHRC). Theparallel agency for the federal govern-ment is the Equal Employment Oppor-tunity Commission (EEOC). Be awarethat, while these agencies are designed

to assist you with a discrimination claim,each agency has deadlines for notifi-cation. The PHRC gives you 180 daysafter the discriminatory act to give themnotice and to file the necessary paper-work. The EEOC gives you 300 days todo so. If you feel that you have beentreated unfairly by your employer, notifythese agencies immediately. Do not wait

for your employer to resolve the issue. If the deadline passes, you may have lostyour right to make a claim.

Suggestions For Resolving Complaints

The Pennsylvania Office of the AttorneyGeneral publishes consumer protectionbooklets which include these sugges-tions if you plan to resolve a complaint

yourself:

t Decide on the specific complaintyou wish to make;

t Have a clear statement of thespecific action you want theperson or business to take toremedy your complaint;

t Proceed without delay;

t If you are making the complaintin person, take along thepurchase receipt, any guarantyor warranty, and if possible, theproduct;

t Be assertive! If you are toldby a salesperson or companyrepresentative that they cannotdeal with your complaint, ask tospeak with a higher authority or supervisor;

t If you complain by mail, givethe brand name, model number,

size, color and other detailsneeded for identifying theproduct. Include in your letter a specific explanation of thecircumstances surrounding your complaint;

t Keep copies of your letter and allcorrespondence you receive. If you return the product, be sureto insure it.

 Avoiding Scams

The Pennsylvania Office of the AttorneyGeneral periodically publishes the “Con-sumer Reference Guide for Seniors,” apamphlet that can help you avoid scamsand frauds. The pamphlet reiterates the

phrase “If it sounds too good to be true,it probably is,” and points out that scamartists typically use the “nice guy” ap-proach. It also states that con artistsoften use words or expressions includ-ing:

“Cash only” - Why is cash necessaryfor a proposed transaction? Why not acheck or credit card?

“Secret plans” - Why are you beingasked not to tell anyone?

“Get rich quick” - Any scheme should

be carefully investigated.

“Something for nothing” - A retiredswindler once said that any time you arepromised something for nothing, youusually get nothing.

“Contests” - Make sure they aren’t ahoax to draw you into a money-losing

scheme.

“Haste” - Be wary of any pressure toact immediately or lose out.

“Today only” - If something is worth-while today, it is likely to be available to-morrow.

“Too good to be true” - Such a schemeis probably neither good nor true.

“Last chance” - If it is a chance worthtaking, why is it offered on such shortnotice?

“Left-over material” - Left-over materi-

als might also be stolen or defective.

If you are unable to obtain the relief thatyou expected from the Bureau of Con-sumer Protection, you should promptlyseek legal advice from a qualified, repu-

table local attorney, because there arestrict time limits in which you must pursueany legal actions for fraud. Typically awritten civil complaint must be filed withthe appropriate court within two years of the commission of the fraud.

Charitable Organizations

Senior citizens who are solicited bycharitable organizations can call thePennsylvania Department of State’sBureau of Charitable Organization’s toll-free number at (800) 732-0999 to findout if the organizations are registered tosolicit contributions; how much incomethe organizations received; how muchthe organizations spend on programs,

services, administration and fundrais-ing. Seniors can also call the toll-freenumber with any complaints they haveabout organizations which have solicit-ed funds from them.

Some precautions when you are calledfor donations:

 Ask for written information, including thecharity’s name, address and telephonenumber;

  Ask for identification; if the solicitor refuses, hang up;

Call the charity to check whether they

Watch out for organizational names

which sound like established chari-ties; some phony groups use titles thatclosely resemble respected legitimateorganizations;

Know that “tax-exempt” is not the sameas “tax-deductible.” The exemptionrefers to the organization but your con-tribution may or may not be deductible

and, if that is important to you, ask for areceipt for the amount of your contribu-tion;

Be skeptical if someone thanks you for a pledge you do not remember making.Keep records of any pledges you makeand check them before cutting a check;

Refuse high pressure appeals. No legit-imate organization should pressure youfor your gift.

Mail Fraud

Mail fraud is illegal but it neverthelessremains a popular means for a con artistto try and trick you. Do not respond to

Telemarketing

Telemarketing is another method com-monly used to get your personal infor-mation such as credit card numbers,checking account numbers, Social Se-curity number, driver’s license number,etc. Do not give out this informationunless you placed the call yourself to awell known, reputable company. Other tips include:

t Never pay for a prizeover the phone;

t Never allow a caller to pressureyou into acting immediately;

t Never agree to any offer untilyou have seen it in writing

The law prohibits telemarketers fromcalling consumers who have stated thatthey do not want to be called. Pennsyl-vania law permits telemarketers to makecalls only between the hours of 8:00a.m. and 9:00 p.m. If you want your name removed from telemarketing lists,send your name, telephone number (in-cluding area code) and address to the

Telephone Preference Service, DirectMarketing Association, P.O. Box 9014,Farmingdale, New York 11735-9014.This action will help reduce the number of unsolicited calls even if it won’t stopall the calls.

GRANDPARENTS’ RIGHTS IN

PENNSYLVANIA

 The Declaration of Public Policy of the

Pennsylvania General Assembly statesthat when it is in the best interest of thechild it is the public policy of this Com-monwealth to assure reasonable andcontinuing contact of the child withgrandparents. There are three specif-ic circumstances in the Domestic Rela-tions Code that permit grandparents toseek visitation and/or partial custody:

t When a parent is deceased;

t When parents’ marriageis dissolved or parentsare separated for sixmonths or more; and

t When a child has residedwith grandparents for 

twelve months or more.

It is the grandparents’ burden to proveto the court that his or her visitation and/or partial custody would be in the bestinterest of the child and would not inter-fere with the parent-child relationship.The court will consider the amount of time spent between grandparents and

the child prior to seeking visitation and/or partial custody as well as the qualityof the time spent between grandparentsand the child.

In Pennsylvania, grandparents may seekphysical and legal custody of a grand-child if it is in the best interest of the child

not to be in the custody of either parentand if it is in the best interest of the childto be in the custody of the grandpar-ent. The grandparent must prove to thecourt that he or she has genuine careand concern for the child; that the rela-

tionship between the child and grand-parent began with the consent of aparent of the child or pursuant to a courtorder; and the grandparent must haveassumed the role and responsibilitiesof the child’s parent for at least the pro-ceeding twelve months. The grandpar-ent must have provided for the physical,emotional and social needs of the child.

If a child has been declared dependentby the state, the court may issue a tem-porary order granting custody of thechild to the grandparent.

The grandparent bears the burden of persuasion when he or she seeks visi-tation, partial custody or custody. Thegrandparent has to prove that it is in the

best interest of child and that the rela-tionship won’t interfere with the parent-child relationship.

Grandparents may not, however, begranted visitation, partial custody or custody of the grandchild when theparent of the child is not deceased, theparents are not separated or divorced

and the child has never resided with thegrandparent. If a grandchild has beenadopted by a person other than a step-parent or another grandparent, any rightspreviously granted will be automaticallyterminated upon the adoption.

Procedure for Filing

In Chester County a grandparent canbegin the proceeding for visitation or custody by filing a Complaint in Custodywith the Prothonotary in the courthouse

in West Chester, PA. The filing fee is ap-proximately $150.00. Next, the partiesschedule the mandatory mediation ori-entation with the court-approved custodymediator listed on the Complaint cover-sheet. The mediation occurs after allparties attend the parenting class whichis also listed on the Complaint cover-sheet. The purpose of the mediation is

to attempt to reach an agreement amongthe parties. If mediation is successful,the mediator will write the agreementand present it to the court. If the media-tion is unsuccessful, the parties attend acustody conciliation conference.

The custody conciliator recommendsa temporary order. Thereafter, the

custody matter is heard before a judge of the Court of Common Pleas of Chester County.

Drivers’ Licenses

If you are a new resident of Pennsyl-vania you will have (15) days from thedate you take up residency to becomelicensed in the Commonwealth. If youare currently licensed in another stateand your license has not been sus-pended, revoked, etc., you will normal-ly only have to take a written test andturn in your out-of-state license. You

may get a handbook to study to take thetest. It is advisable to at least reviewit prior to taking the test. It may havebeen a while since you last took a testand the laws, although consistent, mayhave changed just enough for you tomiss too many questions. You can getthe handbook from any licensing center or testing station. They are listed in the

blue pages of the phone book. If youare currently licensed you must renewyour license every four years. Youshould receive a notice in the mail fromthe Pennsylvania Department of Motor Vehicles. (PENNDOT) You may renewby mailing in the fee or going to the In-ternet and doing it through the govern-ment’s website: http://www.dot.state.

you pay the ticket and then discover thatit results in a conviction that requires amandatory period of suspension or re-vocation. Have counsel investigate thecharge and determine the consequenc-es of what you should or should not doto remedy the adverse effect of failing toappear.

If you have never had a driver’s licenseyou should get a copy of the handbookand follow the directions on how to goabout being licensed for the first time.You will be required to have a medicalexamination to determine if you aremedically fit to drive safely. Your privatedoctor can do the examination. You willalso have to produce a valid form of iden-

tification to get a learner’s permit. Thismay require you to obtain a certified birthcertificate. You, obviously, should makesure that you could drive a car. Unlesssomeone you know is teaching you, youshould hire a reputable driving school toteach you. You do not have to own a car in order to have a driver license. You dohave to have insurance on any car that

you drive, whether you own it or not.

Having a drivers’ license is considereda privilege. Therefore your license maybe recalled, suspended, cancelled or revoked. The reasons for these adverseactions are numerous.

The most typical reason for the sus-pension of your license is either failingto respond to a traffic ticket or acquir-ing sufficient points to be suspended.Just as suggested above, if you aresuspended due to a fail to appear you

should contact legal counsel to deter-mine the extent of the consequences of that ticket.

Your privilege to drive an automobilemay be recalled upon a determinationof incompetence or a finding by a phy-sician, psychologist or psychiatrist of acondition that prevents you from safely

operating a motor vehicle. The reportof a physician, psychologist, psychia-trist or even a police officer, to Penndotwill result in such an inquiry. Penndotwill send a letter to inform you of theadverse action concerning your license.The reason for the adverse action isgenerally explained in the letter. Themail date of the letter, expressly stated

in the body of the notification letter, isvery important. The notification will gen-erally give you (30) days to appeal theadverse action of Penndot to the Courtof Common Pleas. If you file a timelyappeal this will, in most instances, stopthe adverse action and you will still beable to drive legally. This is called a “su-percedes” in legal terms. In other situa-

tions you must take immediate action inorder to prevent the loss of your drivingprivileges.

  An appeal must be filed in the Courtof Common Pleas of your residence.There are some minor differences of where the appeal must be filed, gener-

ally involving an arrest for driving under the influence with a refusal to take a testthat occurs in another county rather thanyour county of residence. In almost allcases where you are legally licensedand there is a suspension or revocation,

if you timely file your appeal within the(30) day limit, the suspension or revoca-tion will not take place. A supercedes isentered and Penndot will be preventedfrom taking the adverse action until thereis a final resolution of the case beforea judge of the Court of Common Pleas.These actions do not qualify for juries todecide the outcome.

The exception to the supercedes beingentered is when there is a recall of your driver’s license due to a medical condi-tion. Some medical conditions that mayaffect you are if you black out, have epi-leptic black outs, seizures, disqualifyingeye conditions, drug addiction or alcoholaddiction or have any medical condi-

tion that would prevent you from safelydriving a vehicle. In this type of case youmust file an appeal as quickly as possi-ble. An expedited hearing will be heldin court. The attorney for Penndot willargue that the license should be surren-dered due to the safety of the generalpublic. The Penndot attorney will usethe medical evidence of the examining

doctor or the statements of the psychol-ogist to justify your not driving. Your pre-senting medical evidence and reports of other doctors that have determined thatyou are medically fit to drive can chal-lenge that evidence. You may also berequired to pass a road test given by adriving center. If you are successful, a

letter is sent to Penndot and the licensewill be reinstated. If unsuccessful, youwill have another court appearancebeyond the expedited first hearing. Atthe next hearing you may again presentadditional evidence that you are medi-

cally fit to drive. However, during thebreak in time between the first hearingand the second one, you will not be per-mitted to drive. If you are not successfulin the second hearing you are permittedto appeal the Court of Common Pleasdecision to the Commonwealth Courtwithin (30) days. The filing of the secondappeal will not reinstate the license until

the next court decision is reached. If youare successful your license will be rein-stated. If you lose, you may then peti-tion the Supreme Court of Pennsylvaniafor an allowance to appeal. Your appealis not automatic or guaranteed. If thePennsylvania Supreme Court acceptsyour appeal and you are successful, youwill be reinstated. If not, you will not be

able to drive. However, if your medicalcondition is such that it may not be per-manent, you will have the right to peti-tion Penndot to be reinstated after your condition has reached a safe status.

Identification Cards

Most establishments require a driver’s

license for identification. Non-driversat the Pennsylvania Department of Transportation Driver License Centerscan obtain an ID card, similar inappearance to a driver’s license. AnyPennsylvania driver who voluntarilysurrenders his/her license for medicalreasons can obtain this ID free of

charge. All others, including thosewho have never had a driver’s license,must pay a $9.00 fee. You must bringproof of identification such as a birthcertificate, your old driver’s licenseand your Social Security card. Even if 

your regular drivers license has beensuspended or recalled, you are entitledto obtain an identification card. If youare in that category you will notice thatyour drivers license number will bethe same as the identification carednumber. The centers are listed in theblue pages of the phone book under State Government, Department of 

Transportation.

Handicap Parking

If you are disabled and need a specialparking placard or parking place, youcan contact the Pennsylvania Depart-ment of Transportation, Bureau of Motor Vehicles, Riverfront Office Center, 1101

South Front Street, Harrisburg, PA17104; (800) 932-4600.

Vehicle Registration

The annual fee for registration of a pas-senger car is $36. You may request a“Vanity Tag” from Penndot. There is anadditional one time cost for the tag of 

$20. If you are bringing in your vehiclefrom out-of-state you will have to gothrough the process of proving owner-ship, proof of insurance, proof of resi-dency and any other requirement thatPenndot has in place. You should haveyour title; registration card and any other identifying information for your vehicle

that is required in order to properly reg-ister your vehicle.

You are required to have your vehicle in-spected at least once per year. The dateis set at the time that you register your 

vehicle in the Commonwealth. It is stag-gered in order to spread out the number of inspections that are done in any one-month. Inspections are done by autho-rized dealers and are strictly controlledby the Commonwealth. However, youshould check with your neighbors to gettheir recommendations of local inspec-tion stations that are reasonable. Also,

there are some counties in Pennsylvaniathat require an additional inspection todetermine whether or not your vehicle isburning fuel efficiently. These high ratecounties will require two stickers insteadof one.

Traffic Tickets

Pennsylvania has a point system wherea few serious violations have pointsimposed as a result of being convict-ed. Since the point system is subjectto change by the legislature it is wise toconsult legal counsel to determine thedetriment to your driving privileges if youare convicted or plead guilty to a trafficoffense.

There are also a number of offenses thatrequire mandatory periods of suspen-sion or revocation. The recent changein the laws now provides a (6) monthsuspension for a conviction for CarelessDriving. The previous penalty was anassignment of (3) points. This is a sub-

stantial change in the laws that many donot know. It is best to check first rather than risk the severe penalties that couldbe imposed by such a conviction.

PERSONAL RECORDS

It is important to keep complete writtenrecords so that your personal informa-

tion is readily available when needed. Inonly one place record where the originalof your will, power of attorney, and livingwill are kept. Also include informationsuch as your Social Security number,bank accounts and other investments(including account numbers), real estateholdings, insurance policies, and other important legal and financial informa-

tion. All of this is required by your agentor guardian in case of your disability or incapacity and is required by your ex-ecutor or personal representative uponyour death.
