What will dentistry and medicine look like

when the government and other payer’s

desired outcomes are more important

than the doctor’s recommendations?

We have heard many times that the payer

(usually government) is not getting the

desired outcomes they want for the money

that they are paying The current sick care

delivery system in America, pays for the

results of people’s behaviors—which, a

lot of times, can cause the illness or issue

being treated An example is a lost tooth

which can result in an implant, bridge or

complete or removable denture to be

performed The feeling is, 30% of what is

being done is not necessary, 50% of what

they want done is not being done and

every year the sick care delivery system

asks for more Soon the doctor will be

asked to produce a better outcome and

their pay will be tied to it

The new future is Patient Centered Primary

Care Homes (PCPCH) and Accountable

Care Organizations (ACO), who are willing

to accept the risk for a group of people

for the desired outcomes; and the PCPCHs

that will have a team of people to manage

a patient’s care So when the Oregon

Health Plan (OHP), Public Employee Benefit

Board (PEBB) and the Oregon Education

Employment Board (OEBB) transition

to this system, do you know how your

practice will fair? Will producing the

desired outcomes demanded by these

organizations force you to join a larger

organization such as Advantage Dental,

ODS Dental, Willamette Dental or a like

organization?

Does this relationship put you in direct

competition with lesser paid technicians

such as the mid-level provider and will

the dentist become a commodity like all

others? Do you feel this relationship will

allow you to use your doctorate degree or

will your degree become equal to that of

the technician?

What happens if dentistry becomes

institutionalized and made a commodity?

And what happens when the system

performs like the individual dentist is?

What is happening now to the dentist

is like what happened to physicians An

interesting book to consider reading is

“The Death of the Private Practitioner” It is

about physicians, but it will be of interest

to you

The lone wolf practitioner will have to

get big enough, have a special skill set

or limit what they do; or we suspect

they may perish Soon, requirements for

getting paid by a third party, such as the

Government, will become too onerous

When the government and other payer’s

begin to dictate the outcomes, the

individual practitioner may not be able

to keep up with the resources needed

to compete Whether it is technology,

procedures or equipment the individual

practitioner will be burdened by

compliance with additional regulatory

requirements Meeting these requirements

may affect quality of patient care and the

practitioner’s ability to run a profitable

business However, there could be safety in

numbers Group practitioners’ affiliations

with independent practice associations

(IPA) or cooperatives like Advantage Dental

could become the individual practitioner’s

safe haven

A good example of this is the current issue

surrounding an oral surgeon in Oklahoma,

who is accused of not following the

appropriate sterilization procedures and

allegedly exposing his patients to multiple

communicable diseases This incident

illustrates the issue of how your patients

will know that your office meets standards

Additionally, how are the government

agencies and other payers going to know

you are meeting the standards?

So, Advantage Dental is sending you

a recently published, State of Oregon

Board of Dentistry, infection control rules

document; and asking you to attest, in

writing, that your practice is in compliance

If you do not comply with this request

it puts Advantage Dental in a difficult

situation The company will not be able to

assure the various government agencies

and others, such as other insurance

companies, that you are in compliance

In addition, Advantage Dental will have

to implement an audit process to ensure

that those that attest they are complying

are in fact doing so If no audit process is

implemented, our fear is that the State will

begin to perform inspections and assign

valuation grades similar to those you see

in restaurant windows Can you imagine

the sticker grade on your front window or

glass door rating you A, B, C or D like

a restaurant?!

The future of Advantage Dental will be a

delivery system made up of contracted

and/or owner dentists and its own

clinics—providing an organization that

can provide the support and resources

to meet the requirements of the various

payer types

It used to be a relationship between

the doctor and the patient, now it is a

relationship between the doctor, the

patient and the entity paying the bill It’s

a strange new world that everyone will

need to learn to navigate

Transformation Legislation SB373As you may remember, the Oregon

legislature passed two pieces of legislation

(HB3650 and SB1580) which created

the Oregon version of an Accountable

Care Organization called a Coordinated

Care Organization (CCO) This legislation

consolidated all Medicaid contracts with

the Oregon Health Authority (Physical

health, behavioral (mental) health and oral

health) into one organization for the OHA

to contract with To date, 16 CCO’s have

been created around the state

What it would take to get dentistry and

the Dental Care Organization (DCOs) to

support this transformation? Two things

were asked for Since this transformation

of the Health Care delivery system was to

begin with Medicaid and the DCOs were

the organizations that provided care for

Medicaid, it was asked that the DCOs be a

part of governance And, because of the

complication of physical health and the

hospitals; the complications of Mental

Health and the county Mental Health

Authority and the fragility of the Dental

OHP delivery system, the DCOs asked for

adequate time to transition

The legislative intent seemed to offer

the DCOs as a major component of the

health care delivery system; and thus a

spot in governance The legislation did

give the DCOs until July 1, 2014, to become

contracted with a CCO It also seemed to

give the DCOs until July 1, 2017, to exist as

a DCO under the CCOs—and prevented

the CCOs from contracting with anyone

other than a DCO

In August of 2012, the OHA obtained an

assistant attorney general opinion that

said that once a CCO contracted with one

DCO they could contract with anyone

they wanted to With this the CCOs, by

and large, have ignored the intent of the

putting a DCO member on governance

Advantage Dental was able to prompt

Senator Bates of Medford to introduce

legislation (SB373) that would give DCOs

a contract until July 1, 2017, for sure; and

make it a requirement for the CCOs to

contract with all DCOs before they could

contract with anyone else

Many of you sent in letters supporting

this legislation and Advantage Dental

would like to thank you for your continued

support in this matter Sadly, it looks like

this legislation may not pass In fact, when

you read this newsletter this issue will have

been decided one way or another

The Oregon Board of Dentistry (OBD) recently sent out

an email regarding infection control guidelines because

of a recent event in Oklahoma regarding the failure to

test heat sterilizing devices for proper functioning In

addition to the event in Oklahoma, the OBD has found,

while doing several recent investigations that a few

dental offices were not testing their heat sterilizing

devices for proper functioning on a weekly basis Failure

to test on a weekly basis is a violation of OAR 818-012-

0040, and could result in Board action

818-012-0040 INfectIoN coNtRol GUIdelINes

In determining what constitutes unacceptable patient

care with respect to infection control, the Board may

consider current infection control guidelines such as

those of the Centers for Disease Control and Prevention

and the American Dental Association Additionally,

licensees must comply with the following requirements:

(1) Disposable gloves shall be

worn whenever placing fingers

into the mouth of a patient or

when handling blood or saliva

contaminated instruments or

equipment Appropriate hand

hygiene shall be performed

prior to gloving

(2) Masks and protective eyewear

or chin-length shields shall be

worn by licensees and other

dental care workers when

spattering of blood or other

body fluids is likely

(3) Between each patient use,

instruments or other equipment

that come in contact with body

fluids shall be sterilized

(4) Heat sterilizing devices shall be

tested for proper function on

a weekly basis by means of a

biological monitoring system

that indicates micro-organisms

kill

(5) Environmental surfaces that

are contaminated by blood or

saliva shall be disinfected with

a chemical germicide which is

mycobactericidal at use

(6) Impervious backed paper,

aluminum foil, or plastic wrap

may be used to cover surfaces

that may be contaminated by

blood or saliva and are difficult

or impossible to disinfect The

cover shall be replaced between

patients

(7) All contaminated wastes and

sharps shall be disposed of

according to any governmental

requirements

silver Nitrate Update:During the April 19, 2013 Oregon Board of Dentistry meeting,

the Board approved moving proposed rules that would allow

dental hygienists and dental assistants to apply silver nitrate to a

public hearing Please note that the current prohibition against

dental hygienists and dental assistants applying silver nitrate will

remain in effect until after the public hearing and will change

only if the Board of Dentistry votes to approve the proposed rule

changes A date for the public hearing has not been announced

Board approved the following rule change to OAR 818-026-0020

General Anesthesia Permit may not administer, for purpose of

anxiolysis or sedation, Benzodiazepines or narcotics in children

Understandably, providers would like to

do all the fillings; however young children

that cannot be managed in the office

should be hospitalized and treatment

performed in the hospital

Recently, studies that support these

changes have been published in the

professional literature Work done at the

Mayo Clinic shows general anesthesia can

have an impact on the young developing

brain And, there is new information that

shows when dentistry is done, without

preventative intervention, new decay can

start as early as six months after the initial

treatment has been completed

the disease under control and not have

to continually redo the work that has

already been done; and to deliver care for

better oral health in your patients

filling is considered a failed outcome

This standard will be held equally for a

child treated in the hospital or surgery

center operating room, or patients

being seen in the hospital emergency

room The economic incentives will

reward methodology

that produces a different

outcome and the new

mantra, “Right Treatment

at the Right Time in the

Right Place ”

As a part of Advantage

Dental’s efforts to

meet the standard, it is rethinking how

it provides for care and revisiting the

process for hospital referrals In the past,

children, 3 and under, were allowed to

be sent to the hospital without having a

preventative treatment plan (PTP) in place

and without having a failed attempt for

treatment in the office This will no longer

be the case; now both the PTP and a failed

attempt for treatment in the office will be

required

The silver nitrate/fluoride varnish medical

management of caries process in young

children, who have less invasive caries,

should

now be

used as a

treatment

attempt

The goal is

to manage

the caries

process until the child gets older and can

be treated in the dental office using in

office sedation protocols (if needed) Also,

a written pre-op and post-op preventative

treatment plan will be required

If you are treating a patient on referral

from the Primary Care Dentist (PCD) you

should get the PTP from the PCD; and it

needs to be part of the referral If you are

the PCD acting as the specialist, then you

will need to develop your own PTP

Before claims will be paid, this PTP will

need to be included The standard referral

form has been redone so that the PTP

becomes part of the record If you are

suggesting a PTP that is different from the

standard, you will need to include it in

the referral

It is suggested, where practical, to have a

record of the silver nitrate/fluoride varnish

treatment series attempted before the

patient is taken to the hospital The only

exception to the above requirements will

be those patients with medical conditions

or behaviors that interfere with office

treatment, such as an abscessed tooth in

the very young or those with a disability

When any of these conditions exist they

Required with Hospital Referal Submission:• Completed Hospital Referral Form

• Referral from PCD to Specialist (not required if PCD is acting as Specialist)

• Pre-op Radiographs (if available)

• Completion of the Preventative Treatment Plan (PTP)

Just a reminder: it is the responsibility of the PCD, when sending referrals to the specialist, to include all of the necessary

information, as well as assisting the patient being referred with scheduling an appointment with the specialist

2013 Hospital Dentistry Referral Process

2013 GOALS pcd UtIlIzatIoN RepoRt: fIRst QUaRteR, JaNUaRy thRoUGh maRch

The goals for 2013, will be the same as those for 2012, namely utilization of gross cap versus encounter (CAPGrvsENC green column),

not to exceed 100% and referral to specialists versus cap (RefvsCap yellow column), not to exceed 20% Also, the percent for

preventive visits for pregnant women, and percent of preventive visits 0-11 years old, should increase by 10 % over the

2012, numbers

The Quality Improvement (QI) and Payor Relations committees will be meeting during 2013, to work on the new outcome measures

for 2014, when Advantage starts contracting with Coordinated Care Organizations (CCOs) Payment Methodology will probably

change dramatically in the future, but for now, it remains to be seen There will be much more emphasis on access to care,

preventive measures, Hospital usage etc , but we will keep you posted as this progresses The chair of the QI committee is Sam

on posterior teeth and reduced them

DMAP has changed the ruling to

allow one surface composites on

posterior teeth (for patients on the

Plus and Reduced Plans); these will be

reduced to the amalgam rate Because

Advantage still is not receiving the

credit for any composites that are done

on posterior teeth from DMAP, any

composites on posterior teeth that are

more than one surface will no longer

be allowed If your patient requests

tooth colored fillings they will need to

pay for it—unless you decide not to

charge them If you decide to charge

them, make sure you have them sign

the Patient Responsibility Waiver

and document the decision in the
