Additional Protocol to the Agreement between

the European Economic Community and Macao on

trade in textile products consequent on the

accession of the Hellenic Republic to the

European Communities

THE COUNCIL OF THE EUROPEAN COMMUNITIES, of the one part, and

THE GOVERNMENT OF MACAO, of the other part,

CONSIDERING the accession of the Hellenic Republic to the European

Communities on 1 January 1981,

HAVING REGARD to the Agreement between the European Economic Community and

Macao initialled in 1977, hereafter called the "Agreement",

HAVE DECIDED to determine by common accord the modifications to and transitional

measures of the Agreement consequent on the accession of the Hellenic Republic

to the European Communities

and TO CONCLUDE THIS PROTOCOL:

Article 1

The text of the Agreement as thus amended, including its annexes, protocols

and exchanges of letters which form an integral part thereof, shall be drawn

up in Greek. It shall be authentic in the same way as the original texts.

Article 2

The Agreement shall be amended as follows:

1. The limits set out in Annex II shall be amended in accordance with the

Annex hereto.

2. Article 6, paragraph 2 shall henceforth read as follows:

"Where the Community finds that, under the system of administrative

control set up, the level of imports of products in a given category not

listed in Annex II originating in Macao exceeds the following per­

centages, in relation to 102 per cent of the preceding year's total

imports of products in that category, into the Community:

- for categories of products in Group I, 0.2 per cent,

- for categories of products in Group II, 1.2 per cent,

- for categories of products in Groups III, IV or V, 4 per cent;

it may request the opening of consultations in accordance with the pro­

cedure specified in Article 14 of this Agreement, with a view to

reaching agreement on an appropriate restraint level for the products in

such category."

3. Protocol B to the Agreement shall be replaced by the following text:

"In accordance with the procedures set out in paragraphs 2 and 4 of

Article 6 of the Agreement, a quantitative limit may be fixed on a

regional basis where imports of a given product into any region of the

Community exceed the following regional percentages, in relation to the

amount representing 100/102 (one hundred divided by one hundred and two)

of the volumes stipulated in paragraph 2 of the said Article 6:

4. For the purpose of ca lcu la t ing " the preceding year 's t o t a l imports"

referred to in paragraphs 2 and 3 above, fo r both 1980 and 1981, the

imports from the Hel lenic Republic to be taken in to considerat ion, sha l l

be those recorded in 1980.

A r t i c l e 3

This Protocol and the Annex thereto form an integral part of the Agreement.

Article 4

This Protocol shall be approved by the contracting parties in accordance with

their respective procedures. It shall enter into force on 1 January 1981,

provided that the contracting parties have notified each other before that

date that the relevant procedures have been completed. The Protocol shall

enter into force on the first day of the second month following such

notification.

Article 5

This Protocol shall be drawn up in two copies, in the Danish, Dutch, English,

French, German, Greek, Italian and Portuguese Languages, each of these texts

being equally authentic.
