A stall may also be given to any other state Tourism & Govt. agencies. However, the dishes specified for selling in the various stalls (as specified in the tender document) will preferably be not allowed to be sold in this stall.

HTC/SKMA also intends to promote Heritage Food Specialties/

delicacies of various regions of all across India. Any Food stall so set-up would preferably will not sell any similar items listed to the tendered.

DIRECTIONS:-

1. Where MRP is mentioned on the items, the sale price should not be more than the specified MRP.

2. In case of packaged mineral water and soft drinks, juices etc, only the permitted brands for which sole selling rights have been given by HTC will only be allowed to be sold. Only vegetarian items can be sold on stalls mentioned in “Vegetarian” Category Non-Vegetarian dishes can be sold only on the specified category of stalls separately mentioned in “STALLS ALLOWED TO SELL “NON-VEGETARIAN DISHES ALSO BESIDES SELLING VEGETARIAN DISHES”

3. Liquor, Cigarette, Tobacco etc. cannot be sold anywhere in the Food Court of the Mela.

General Terms and Conditions

1. Incomplete, conditional tender and the tenders without EMD in specified mode are liable to be rejected out rightly.

2. Each activity/job has to be provided and made operational as per specifications and schedule.

3. No subletting will be permitted. 4. The rates can also be negotiated, if necessary, and the

payment will be made accordingly. If Agency fails to supply the ordered quantity or fails to make the service operational fully as per the requirement and the specifications, all the equipment lying at site will be confiscated and alternate arrangement will be made at the risk and cost of the Tenderer. Further, the EMD alongwith security deposit, if any, will also be forfeited.

5. In case of any dispute, the matter will be referred for Sole Arbitration to the Managing Director, Haryana Tourism Corporation/Chief Administrator - SKMA who may either himself/herself act as the Arbitrator or appoint any serving/retired officer of Haryana Govt. / HTC to act as the Sole Arbitrator on his/her behalf. The decision so taken will be final and binding on both the parties.

6. Every Agency has to supply a list, 21 days (7th

January,

2016 is last date) before start of the Mela, of its team/employees showing their names, addresses and photographs for the purpose of issue of photo identity cards as well as for Police Verification. The charges as prescribed by the management for the same have to be

deposited in advance in the Mela office. 7. Smoking, consumption of liquor, and chewing of tobacco

etc. by the staff of the service providers are totally banned. 8. The following documents will have to be supplied with the

Note: The management reserves the right to accept or reject any one or all the tenders, without assigning any reason.

Specific terms and conditions for all

1. The applicant should have experience of working in the same line in the name himself for a minimum of three years.

2. The applicant should either be an Individual, Firm OR Company.

3. He must have participated in similar activity of atleast one mega vent/fair/festival of a national repute in the last 5 years and has adequate manpower, infrastructure and resources to fulfill the requirement.

4. Service Tax, Swatch Bharat Cess as applicable and other applicable taxes are to be paid in addition to the license fee for all the activities and Entertainment Tax in respect of Amusement & Adventure sports activities also to be paid in addition.

Initially Envelope A will be opened and the short listing of the eligible parties will be made on the basis of the technical eligibility criteria. 5. After financial bids and proper negotiations would be held between L-1,L-2 & L-3 parties/firms/agencies or H-1,H-2 or H-3 as the case may be and only after verifying various important aspects that the job work would be granted to the finalised agency. It is to be noticed that quality as well as rates both would be taken into consideration while finalising the agency by SKMA.

6. That I/We will submit declaration on a non judicial stamp paper of Rs. 10/-

TERMS AND CONDITIONS

TENDER FOR GRANT OF LICENCES

FOR EACH FOOD STALLS IN FOOD COURT

1. Various type of Food Stalls mentioned in the list enclosed with the Tender Document will be set-up at specified/designated places in the Food Court of the Mela Ground.

2. The Tender will be submitted in two parts i,e Envelope A (containing the Technical Bid and the DD for the EMD) and Envelope B (containing the Financial Bid and the amount to be filled should not be less than the reserve price + service Tax, Swatch Bharat Cess as applicable as mentioned at page 25-28) are to be put in a third envelope and to be superscribed as “Surajkund International Crafts Mela, 2016-Tender for the Food Court” Initially Envelope A will be opened and the short listing of the eligible applicants will be made on the basis of technical eligibility criteria only. The Envelope B containing the Financial Bid will be opened only of the shortlisted applicants on the basis technical criteria only.

3. HTC/SKMA reserves the right to run its own Food Stalls to be set-up by various IHMs of Haryana etc. Similarly, Food Stalls will also be set-up by the Theme State, by the participating countries, if any, and by any other Govt. Agency as may be permitted by HTC/SKMA.

4. The earnest money of the successful bidder will be converted into security and will be refunded after the Mela is over.. However, the EMD of others will be refunded in 15 days.

5. The licensee would enter into an agreement with licensor and only after it is executed then the rest of the formalities would be initiated.

6. The successful applicant will have to deposit the license fee as per the following schedule:-

a) First installment of 50% of the total bid accepted by the office is to be deposited in cash/DD at the time of finalization/issue of the allotment letter.

b) Second installment of 25% of the total bid amount to be deposited on or before 2.00 p.m. on 30th December, 2015.

c) Third and last installment of 25% of the total bid

amount to be deposited on or before 2.00 P.M. of 7th

Janaury, 2016.

d) Post dated cheques for the 2nd

& 3rd

Installments are

to be deposited in advance at the time of signing of the agreement.

In case of default/delay in payments as mentioned above,

Haryana Tourism Corporation will be at liberty to forfeit the entire

amount of EMD/ security and the installments paid by the Tenderer.

7. The possession of the specific Food Stall will be given on 25th

Jan, 2016 by 4.00 p.m. only on completion of the following formalities:-

a) Deposit of the total amount as mentioned in clause 6. b) Execution of the agreement (on Non judicial stamp

papers of requisite value to be purchased in the name of the licensee) containing the prescribed terms and conditions.

c) Deposit of two passport size photographs, attested copies of Ration card/Voter I/Cards /PAN Card/Adhar Card/Passport etc. of the Licensee/M. Partner in case of Partnership firm or the MD/Director in case of Company.

d) Deposit of the list showing the details of his property. e) Name, address, Mobile No, and other details of the

employees to be deputed for Mela Duty with two recent passport size photograph.(latest by 7th January, 2016 by 4.00 PM

In the event of failure of highest bidder to take over the

possession by 21st

Jan, 2016 by 4.00 p.m., Haryana Tourism

Corporation will have the right to allot to some other eligible bidder and to forfeit the entire amount paid by the licensee including the security deposit.

8. The Licensee will have to pay all applicable taxes, fees, levies, service tax etc. as may be imposed by the authorities/Govt. from time to time.

9. That the Licensee will engage trained staff for the conduct of business and will bear their salaries/wages etc and will ensure due compliance of the applicable Labour Laws and other applicable laws.. The said staff has to be courteous and well mannered with the customers/ visitors. The Licensee will be fully responsible for the conduct and behavior of his employees and loss of reputation or property if caused by the nuisance created by the licensee or his employees in relation to the running of business and dealing with customers the same will be

indemnified by the licensee to the licensor. Child labour will not be permitted.

10. That the Licensee will be solely responsible for any adulteration in the eatable items. In case, some adulteration is found /reported in the eatables items, he will be liable for action under the provisions of PFA Act OR any other applicable Act/Law.

11. That the Licensor will provide the water required for the day to day use of the Licensee. However, the Licensee will have to pay for the use of the electricity on “pro rata basis” as per the electricity load utilized by him. The billing for the electricity will be on the basis of the power load supplied for each Food Stall which will be done by Technical Staff deployed by the Haryana Tourism Corporation. Advance charges for the same have to be deposited by the Licensee with HTC latest by 30th January,2016 and its settlement will be made at the end of the Mela.

12. That the Licensee will ensure that only one eco-friendly Banner is displayed inside the licensed premises duly prepared as per the design approved by the Haryana Tourism Corporation.

13. That the premises will be deemed to be Public Premises as defined in the Haryana Public Premises and Land (Eviction and Rent Recovery) Act. 1972, as amended from time to time.

14. That the Licensee will exhibit a Complaint book at conspicuous place which will be made available to the customer(s) on request and which will also be opened for inspection by person(s) duly authorized by HTC

15. The Licensee will obtain various permissions as and when required as per the local regulations. In case of any offence on the licensed premises, the licensee will be solely responsible for its penalty consequences.

16. The Licensee will not sell any other article except those for which it has been licensed in the said premises or use it for any other purpose. The Licensee will not carry out any addition/alteration in the premises without prior written permission from the Licensor..

17. The Licensee will not be liable for any claim from licensor against any untoward incidents like theft, riots, natural calamities or the failure of electricity, or even change of the policy by the Govt.

18. That the Licensee will not install and operate any public address system or any other media in the stalls allotted to him, which may cause disturbance in area where the stall is located.

19. That the Stall/site will be given on “AS IS WHERE IS “basis as

shown at the time of the open auction. The Licensee will have to make provisions for furniture and fixture for the use of the customers at his own level. Only such space can be utilized for laying of the furniture as assigned by the Licensor.

20. That the Licensor reserves its right to cancel the license at any time if it is seen that the use of license is against the public policy as a whole or the license is being used for obnoxious purpose and the use of license may lead to danger to public safety and the license is used for other purposes than for what it was granted.

21. That the Licensee will have to display the rate list for each and every article allowed to be sold in the Food Stall. Further, the

Licensee will have to get the rate list approved by 25th

January,

2016 by 5.00 p.m. from the Licensor before it is displayed outside the food Stall.

22. That the Licensee is to ensure the use of LPG Cylinder (Commercial) only for cooking of the food. No other material will be allowed to be used for cooking purposes.

23. That the Licensee will install sufficient number of Fire Extinguisher in the Food Court area allotted to him to avoid any mishap. .

24. The packed goods are not to be sold above MRP .If it is found that the sale is being done above the MRP, the Licensee will be responsible for the consequences apart from the action prescribed for violation of general terms and conditions. .

25. Regarding the sale of Mineral water and soft drinks etc, the management may grant Sole Selling Rights to any party and in that case, only the specified brands of the packaged drinking Water and soft drinks etc can be sold by the Licensees. The purchase of bulk stock have to be made from the specified Agency/Manufacturer as allowed by the Licensor.

26. The Licensees will ensure that the use of disposable plates, glasses, spoons etc should be of good quality of food grade material..

27. Licensee would also put good quality dustbins/garbage bins in sufficient numbers so as to manage Degradeable & Biodegraable waste material separately in and around their food stalls.

28. The employees at various food stalls would be required to wear Headgear/Hand gloves /Aprons etc. wherever required for safe and hygienic preparation of food items.

29. That any dispute arising out of these terms and conditions will be referred to the sole arbitration of the Managing Director,

HTC/ Chief Administrator, SKMA. HTC who may himself act as the Arbitrator or appoint any serving or retired officer or any other person as Arbitrator to act as Arbitrator on his/her behalf. The proceedings before the Arbitrator will be governed by the provisions of the Arbitration & Conciliation Act-1996, as amended from time to time. The appointment of any person as Arbitrator will not be invalidated merely on the ground of his being associated with LICENSOR as one of its Officers in any capacity whatsoever. The terms and conditions are as under: 1. 30 No. Stalls approx will be put-up near Delhi Gate. The stalls are

2. Incomplete, conditional Tender/EOI OR without EMD in specific form (wherever applicable) are liable to be rejected outrightly. Sealed Tender is to be submitted with DD for the EMD @ Rs.50,000/- for each shop. 4. The stalls will be given on „AS IS WHERE IS” basis and it will have to be returned in the same condition in which it was taken otherwise security will be adjusted/forfeited against any default.

5. The Stalls are proposed to be let out from 1st February to 15th Feb, 2016 For 15 days. The possession will be offered on erection / construction of stalls after 27th January, 2016.

6. The party interested in hiring of the stalls may bid for single stall, two stalls or for upto 35 No. stalls (In multiple of five). The preference will be given to an agency/ party who undertakes the project on turn-key basis for Erection/ construction of Stalls, Marketing & allotment and day-to-day management of the area where these stalls are proposed to be erected/constructed. However, SKMA reserves the right to object to selling of any objectionable material as per the laws of the land.

7. The charges for electricity as per actual consumption or on the basis of pro rata reading of the meter will have to be paid extra.

8. The sale of any form of Handlooms, Handicrafts, Jewellery and Eatables items etc are prohibited.

2 The Bidders have to submit Tender Document in two Bid System. The Bids should be sent in two separate sealed envelopes respectively super-scribed as “TECHNICAL BID for Demonstration/popularization of Hot Air ballooning during 30 t h Sura jkund In te rna t iona l Cra f ts Mela 2016 and “PRICE BID for Demonstration/popularization of Hot Air Ballooning during 30th Surajkund International Crafts Mela 2016. Both these sealed envelopes should be put in one large envelope along with the cover letter with the Tender fee and any other fee as applicable. Sealed Bids can be personally submitted by hand delivery/courier/Hand delivery or sent by registered post at Surajkund Mela Secretariat, Surajkund Tourist Complex, Haryana Tourism, Faridabad (Haryana) INDIA.

3 Bids not in the prescribed forms/formats will be summarily be rejected. 4 Bids must be accompanied with the following documents:

i. An affidavit-cum-declaration certifying that the Bidder satisfies the Technical Requirements. Such affidavit-cum-declaration must be signed by the Bidder or by an authorized signatory (in case of authorized signatory a certified true copy of the resolution authorizing the signatory to sign the affidavit-cum- declaration shall have to be enclosed);

ii. Documentary proof, where ever applicable, as evidence of satisfaction of the Technical and Financial Requirements;

iii. A sum of Rs.1,50,000/- (Rs.One lakh Fifty thousand) as earnest money deposit (“EMD”) by way of a crossed demand draft drawn on any scheduled bank payable at Faridabad. The Demand Draft should be drawn in favour of “Surajkund Mela Authority” payable at Faridabad.

iv. Copies of all tax registrations; and in case of individuals, a certified true copy (attested by a notary) of identity proof. Acceptable identity proofs are Indian passports, Voter IDs, Aadhar Card, and/or Ration Cards.

Bids that do not contain the above documents, where relevant, shall be summarily rejected. In such a case, SKMA/HTC shall reserve its right to forfeit the EMD, if any.

5 Bidders are advised to fill all information clearly and legibly in typed format. In case of the price Bid, amounts shall be stated in figures and in words. In

case of any discrepancy in the amount in figures and the amount in words, the amount stated in words shall be considered. Please ensure that there is no strikethrough, overwriting, alteration or erasures.

6 Bidders must ensure that they fulfill the Technical Requirements (Technical & Financial capabilities) prior to submitting their Bids. Price Bids of technically disqualified Bidders (who/which do not fulfill the Technical Requirements) shall be summarily rejected & shall not be opened and their EMD will be returned

7 The technical Bids will be opened at the Sunbird Motel, Surajkund Tourist Complex, Faridabad on the date as mentioned in this tender.

8 Price Bids of Bidders that have qualified will be opened on a date and time which will be intimated to the technically qualified Bidders. Both the technical Bid and the Price Bid will be opened in the presence of Bidders or their authorized representative who may choose to be present at that time.

9 In the event, if a qualified Bidder wants to withdraw the Bid, the EMD of such Bidder shall be forfeited.

10 The EMDs of all unsuccessful Bidders (other than such Bidders whose Bids have been rejected on grounds) will be refunded, without any interest, after the Letter of Award has been accepted by the Successful Bidder.

11 No interest will be paid on the amount of EMD deposited. 12 As per evaluation process mentioned in Tender Document, the Qualified

Bidder that has been declared as Successful Bidder/ Preferred Bidder and shall be issued the Letter of Award to Operate Hot Air Ballooning during 30th Surajkund International Crafts Mela 2016. In case if the Successful Bidder/Preferred Bidder does not accept the Letter of Award, SKMA/HTC, in its sole and absolute discretion, retain the power to issue a Letter of Award to a next Highest Bidder, without ascribing any reason and the decision of HTC/SKMA shall be final and binding upon all Bidders.

13 The successful Bidder will be intimated about the acceptance of his/its Bid. Hence no enquiry in this regard need be made. Canvassing in any form shall invite disqualification from the Bidding process

14 The Successful Bidder shall be required to submit the Letter of Acceptance to the Authority within 7 days of issuance of Letter of Award. Failing which the Letter of Award shall stand withdrawn without any liability on SKMA.HTC and the EMD of such Bidder shall stand forfeited. In any case, HTC/SKMA shall have the right, exercisable at its sole discretion, to either issue a fresh Letter of Award in favour of the second highest Bidder or to invite fresh Tender / Bids.

15 Bulk Insurance: The bidder shall be responsible to take bulk insurance for the tourists as well as pilots and other technical staff and third party, the copy of the same shall have to be deposited with the corporation atleast 10 days before the Mela.

16 Failing to fulfill the aforementioned obligations, the Letter of Award shall stand withdrawn without any liability on SKMA/HTC and the EMD of such Bidder shall stand forfeited. In any case, HTC/SKMA shall have the right, exercisable at its sole discretion, to either issue a fresh Letter of Award in favour of the second highest Bidder or to invite fresh Bids.

17 EMD of successful Bidder will be converted in to Security Deposit. 18 The successful bidder will have to deposit a performance bank guarantee

of Rs. 10.00 Lac which would be returned after successful completion of the operations.

19 HTC/SKMA reserves the right to accept or reject any Bid at its sole discretion and without assigning any reason.

20 Bidders should note that: a. If they withdraw their Bid after their technical Bid has been

accepted, or b. If they conceal any material information or make

incorrect and misleading statements or misrepresent facts in their Bid, o

c. Try to influence HTC/SKMA or any of its officials in relation to the evaluation of Bids HTC/SKMA shall have the right to forfeit their EMD and blacklist them from participating in any future tenders issued by HTC/SKMA

21 All columns in the tender should be typed. No alteration in the description of the schedule shall be permitted. All corrections should be authenticated under the full manual signature of the Bidder.

22 Bids shall remain valid for a period of 120 days from the date of opening of the Price Bid.

23 In exceptional circumstances and at its sole discretion, S K M A / H T C may require an extension of the Bid validity period. The request and the responses thereto shall be made in writing (or by E-mail or fax). The EMD provided shall also be suitably extended. A Bidder may refuse such request for extension without forfeiting the EMD. A Bidder granting the request shall not, however, be permitted to modify his Bid.

24 Bids must be received by HTC/SKMA at the address specified not later than the Due Date of submission of tenders/bid.

25 HTC/SKMA may, at its sole discretion, extend the Bid Due Date and amend the Tender by amending the Tender documents. In such a case, all rights and obligations of HTC/SKMA and Bidders previously subject to the Bid Due Date will thereafter be subject to the Bid Due Date as extended.

26 During evaluation of Bids, HTC/SKMA may, at its discretion, ask a Bidder for further clarifications and/or information. The request for clarification and the response thereto shall only be in writing. The Bidder shall have to reply to the clarification within 7 Business Days from the date of receipt of the request failing which the Bid of such a Bidder shall be rejected and HTC/SKMA shall have the right to forfeit the EMD of such Bidder.

27 HTC/SKMA will scrutinize all Bids to determine whether or not (a) the Bids are complete, (b) computational errors have been made, (c) the required EMD has been furnished, (d) the documents have been properly signed, and (e) the Bids are generally in order. Bids from representatives, without Tender Fee and proper authorization from Bidders shall be treated as non-responsive.

28 No Bidder shall contact HTC/SKMA or any of its officials on any matter relating to any Bid from the Bid Due Date till the issue of the Letter of Award.

29 Any effort by a Bidder to influence H T C / S K M A or any of its officials in relation to H T C / S K M A Bid evaluation, Bid comparison or contract award decisions shall result in rejection of such Bidder‟s Bid and forfeiture of the EMD and such other action as H T C / S K M A may at its discretion determine.

30 The papers of the technical Bids should be numbered serially in typed. 31 Any postal delay or loss in transit will not bind H T C / S K M A . 32 Evaluation of Bids would be in accordance with the provisions of law.

33 In case of dispute between H T C / S K M A and any Bidder the decision of Authorized Signatory of H T C / S K M A will be final subject to concerned Bidder being given a hearing before taking any decision. It shall be deemed that by submitting a Bid that the Bidder has:

i) Made a complete and careful examination of the Bid Document; ii) Received all relevant information requested from the Authority; iii) Accepted the risk of inadequacy, error or mistake on the information

provided in the Bid Document or furnished by or on behalf of the Authority relating to any matters referred in the tender;

iv) Satisfied itself about all matters, things and information including matters referred in the tender and required for submitting an informed Bid, execution of Agreement in accordance with the Bid Document and performance of all of its obligations there under;

v) Acknowledged and agreed that inadequacy, lack of completeness or incorrectness or information provided in the Tender Document or ignorance of any of the matters hereinabove shall not be the reason for any claim for compensation, damages, extension of time for performance of its obligation, loss of profits etc. from the authority, or a ground for termination of the contract by the Selected bidder.

vi) Acknowledged and represented that it does not have a Conflict of Interest, and

vii) Agreed to be bound by the undertakings provided by it under and in terms hereof

Terms & conditions: 1. The operations shall be run in the name of “AGENCY / OPERATOR”. 2. Land: Necessary land required for the operations of event will be

made available by HTC/SKMA. The agency / Tenderer/Bidder shall inspect the piece of land on offer for smooth operations of Hot Air Ballooning before submitting its tender. No request for change of site would be entertained after the tender.

3. Bulk Insurance: The bidder shall be responsible to take bulk insurance for the tourists as well as pilots and other technical staff and third party, the copy of the same shall have to be deposited with the corporation before event. H T C / S K M A shall not assign the work till the copy of valid insurance coverage is deposited.

4. The Selected agency / operator shall install necessary equipments and should ensure they are of good quality conforming to international standards. The Selected agency / operator should furnish quality certificate from competent authority for these equipment.

5. The Selected Agency / Operator should operate the activity on continuous basis during the Mela period. If the Selected Agency / Operator fails to run the facility for a period of three consecutive operational days, H T C / S K M A shall have to power to forfeit the EMD submitted for violation of any terms & conditions of the tender.

6. All sanctions, permissions, no objections, letters of intent, consent, licenses, clearance, approvals etc. shall be obtained by the selected bidder / operator at his cost and such document shall be kept effective and in force at all material times throughout the operation period

7. Poor spare parts should be replaced immediately and safety certificate with validity should be obtained from the authorized State Govt. Safety Officer and produced before operation.

8. The Authority shall have the right to inspect the premises and also the books of accounts, etc. of the selected bidder / operator at any time. Selected bidder / operator may be required to submit the accounts as and when directed by the Authority, which the selected bidder / operator cannot deny and the same shall be provided by the selected bidder / operator within a reasonable time not later than 3 days.

9. The selected bidder / operator have to confine his activities only within the specified area handed over to him by H T C / S K M A .

10. All costs, charges, including stamp duty and registration charges, etc. shall be borne by the selected bidder / operator.

11. The H T C / S K M A will not be vicariously liable for any act of the selected agency / operator and the selected agency / operator shall alone be liable for violation of any law and the selected agency / operator agrees to indemnify the H T C / S K M A from all claims.

12. The Selected agency / operator should arrange electricity, water and maintenance and other facility at their own cost.

13. The Selected agency / operator shall erect of temporary structures for accommodating their staff at their own cost. Only temporary structures are allowed to be erected.

14. In case of any dispute, the HTC/SKMA will refer the dispute to an Arbitrator in accordance with the provisions of the Arbitration and Conciliation Act 1996 and the parties agreed to abide by the decision of the Arbitrator

Process for Selection of Operator: 1. The sealed bids submitted to HTC/SKMA will be opened on the date and

time mentioned in this tender document 2. The bids will be evaluated in terms of the Technical and Financial

Criteria‟s mentioned in “Evaluation Parameters for Shortlisting of Bidders” of this tender document.

3. The Price Bids of all qualified Bidders shall then be opened on the due date and the qualified Bidders may choose to attend the Price Bid opening. However, Price Bids of those Applicants/Bidders who are technically disqualified shall be returned without opening their Price Bids. .

4. Other terms and conditions applicable but not limited to for submission of Tender/Application for Manager are as follows: All clauses mentioned in - „Instructions to Bidders‟, –„terms and conditions‟ and - „Evaluation Parameters for shortlisting of Bidders‟ of this bid document should strictly be followed. Any Bidder who fails to submit the required information shall be summarily rejected without assigning any reason, whatsoever. The decision of SKMA/HTC in terms of award of contract shall stand final, and no queries shall be entertained post the completion of selection process.

Evaluation Parameters for shortlisting of the Bidders

The Bidder‟s competency and capability is proposed to be evaluated on the basis of the following two-stage process; Stage I: Technical Evaluation: This stage is divided into two sections: Section 1: Technical Criteria

The Bidders should have the following basic eligibility to be considered for the further process: 1. The bidder should have an experience of running and operating similar

services ei ther on temporary or permanent basis for at least at 3 years. 2. The bidders /Hot Air Balloon should be registered with DGCA and should

carry air worthy certificate during the entire period of event. 3. The pilots should be licensed to fly commercial flight on hot air balloon

and in case any endorsement is needed from DGCA in the pilot licence, a copy of the same shall be submitted.

4. The bidders should have spare equipments to replace faulty equipment during the event so as not to have any break in the operation during event.

5. The bidders should have additional qualified pilots to replace any forced absence due to ill health etc.

Section 2: Financial Criteria The bidders should have a net financial worth of atleast 1.5 Cr with valid proof of similar operations in last three years.

Note: i) Please provide documentary proof to fulfil the above mentioned technical &

financial criteria ii) Relevant documents are to be furnished for evaluation of Financial Capabilities:

The Mela ground is spread over 40 acres of land and offers ideal opportunity for setting up booth in the mela area near Apna Ghar for instant photography of the visitors visiting mela wearing traditional Haryanvi Dress on loan basis available in

the booth. The pre–requisite requirement is as under:-

1. The Bidder must have good quality camera for producing instant photographs of the visitors visiting Mela against charges.

2. The bidder must have sufficient number of traditional Haryanvi Dress/Jewellery/Household Gadgets etc. as mentioned above.

3. The bidder shall have experience in the trade. 4. The staff deputed for photography will be in proper

uniform wearing photo identifies cards etc. for quick identification.

5. The bidder will depute adequate professionals to man & manage the booth.

6. The lodging/boarding arrangement will be made by the bidder himself. No permission will be granted to staff for stay at Surajkund after the Mela timings

7. The Bidder must deposit full amount alongwith other taxes, if applicable before the start of mela in the form of

DD only in favour of “Surajkund Mela Authority”, payable at Faridabad.

8. The bidder will obtain valid permission which may be required to be obtained from any local authority/ authorities.

9. The bidder will use the particular space/premises for running this activity for which permission has been granted.

10. The successful bidder has to display the rates of photographs (with/without frame) in photo booth properly.

GENERAL TERMS AND CONDITIONS

1. Incomplete, conditional tender and the tenders without EMD ( in DD Only) in requisite form only are liable to be rejected out rightly.

2. The quantity of items can be increased or decreased by 10% subject to the requirements. In that case, proportionate payment or payment on the basis of the item wise rates will be made.

3. Each activity/job has to be provided and made operational strictly as per specifications and schedule.

4. No subletting will be permitted.

5. The tenderer must give basic rates and clarify all applicable Taxes, EPF, ESI, etc. and give the Certificate in following months and the payment on account of applicable taxes, EPF, ESI and Service Tax will be released after submitting the Proof /Certificate.

6. Rates quoted will be item wise + Applicable taxes as well as in Gross Total. The total will be in figures as well as in words. Cutting and overwriting of the figures/amount is not allowed. While making comparative statement, the gross total of the particular item as a whole will be taken into consideration.

7. The rates can be negotiated with the lowest bidder L1, L2, L3, if

necessary, and the payment will be made accordingly. 8. If Tenderer/service provider fails to supply the ordered quantity or

fails to make the services fully operational as per the requirements, specifications and time schedule all the equipments lying at site will be confiscated and alternate arrangement will be made at the risk and cost of the Tenderer. Further, the EMD alongwith security deposit, if any, will also be forfeited.

9. Every Service Provider will supply a list, atleast 25 days (latest by 7.1.2016) before start of the mela, of its team members/employees showing their names, addresses and photographs for the purpose of issue of photo identity cards as well as for Police Verification. The charges as prescribed by the management for the same will have to be deposited atleast 15 days (latest by 15.1.2016) before the start of the Mela in advance in the Mela office by the service provider. No substitution of the employees will be allowed except in emergent cases and that too with the prior approval of management in writing. Further, a list of its employees as well as the substituted/changed employees to be deputed for the Mela duty, showing their names, addresses and photographs has to be supplied for the purpose of Police Verification

10. The cost of Identity Card is Rs. 200/- per Card

11. The Agency/Service provider will solely be responsible for maintaining the proper record of employees/persons provided for various activities for the mela and for payment of all emoluments/wages as per the statutory requirement/labour laws. The HTC/SKMA will in no case be responsible for payment of the wages and compensation etc., if any, to the manpower deployed by the Service provider.

12. The rates will remain valid till the Mela is over. 13. Smoking, consumption of liquor/alcohol and use of tobacco products

etc. by the service providers and the staff deployed by him/her is strictly

prohibited. 14. Sealed tenders are to be submitted latest by 11.00 A.M. of 3rd

December, 2015. The sealed tenders so received will be opened at 11.30 A.M. on 3rd December, 2015 at Conference Hall at Sunbird Motel, Surajkund in presence of the representatives of the parties who may like to be present.

15. The following documents will have to be supplied by the tenderer alongwith the Tender Document.

In case of any disputes, the matter will be referred for Sole Arbitration to the Managing Director, Haryana Tourism Corporation who may either himself/herself act as the Arbitrator or appoint any serving/retired officer of Haryana Govt. / HTC to act as the Sole Arbitrator on his/her behalf. The decision so taken shall be final and binding on both the parties.
