Tendering Portal of Dept. of Animal Husbandry http://ahd.maharashtra.gov.in. and http://adf.maharashtra. etenders.in. by the Commissioner of Animal Husbandry, M.S, Pune-1
In this Tender, minimum three valid technical bids not received from the bidders, so that, this
first extension is given. The Online Tender Time Schedule is displayed on the e-Tendering Portal of
Dept. of Animal Husbandry http://ahd.maharashtra.gov.in. and http://adf.maharashtra.etenders.in.
All the terms and conditions for the tender are as earlier.
For valid tenderer, there is no need to pay the fees for purchase of tender, Earnest Money
deposit and sample submission for the earlier bidder, but all tenderer should submit the technical and
commercial bid .

TERMS & CONDITIONS
1. ITEMS OF TENDER FOR RATE CONTRACT :
Online tenders are invited by the Commissioner of Animal Husbandry, M.S Pune-1
for finalising rate contract for supply of Manually operated Chaff Cutter (IS-7898) and Power
operated Chaff Cutter (2HP, 3HP & 5HP) (IS-11459) to be distributed to farmer beneficiaries of
the Animal Husbandry Department under the centrally sponsored fodder and feed development
scheme for the period from 05/09/2012 to 20/09/2014. The technical specifications of the chaff
cutters to be supplied are provided in Annexure- A-1 to A-4 to this document.
2. ELIGIBILITY FOR PARTICIPATION IN TENDER PROCESS :
a) The manufacturing Companies with valid license / Certificate of Registration, issued
by competent authority for items listed in Annexure- A -1 to A-4 OR the authorised
Dealer / Distributors having valid certificate, are eligible to submit the tenders.
b) It must be noted that the tenderer should not have been black-listed by any
Government Agency / Institutions of local self Government / Public Sector in India
under any contractual relation with them or pending legal / penal action for complaints
of quality. The undersigned reserves the right for insisting upon submission of Good
Performance Certificate issued by any such agency.
c) The registration certificate of manufacturing company must indicate that production of
chaff cutters is commenced. Provisional Registration without commencement of
production is not sufficient.
d) The bidder company should clearly state whether the firm is registered with NSIC/SSI
Unit.
e) In case the tenderer is submitting tender as Dealer/Distributor of any company, he
must have valid certificate of authrisation of Dealer/Distributor issued by the
manufacturing company.
f) The bidder should have Commercial Test Report of the chaff cutters obtained from
any of the following Institutions approved by Department of Agriculture and

3. HOW TO GET A TENDER FORM
Tender Form along with Terms & Conditions can be downloaded from
e-Tendering Portal http://adf.maharashtra.etenders.in of the Dept. of Animal Husbandry w.e.f.
17.01 hrs of 05/09/2012 to 17.45 hrs. of 20/09/2012 by payment of Rs. 5 ,000/- (Rupees
Five Thousand only) as the cost of tender form in the form of Demand Draft drawn on
any Nationalised Bank. The demand draft shall be drawn in favour of "Accounts Officer
to the Commissioner, Animal Husbandry, Maharashtra State, Pune” payable at Pune. The
tender document can be downloaded from above mentioned websites after entering the
details of demand draft for purchase of tender form. The scanned copy of this demand
draft should submitted in the technical envelop. The cost of tender form is non refundable.
The Demand Draft must be submitted physically to the Commissioner, Animal
Husbandry, Fodder Development Desk, (AH-.14), Mendhi Farm, Gokhalenagar, Pune -16
before 21/09/2012 up to 17.45 hours.
A fee of Rs 1038/- shall be payable directly to the service provider online during

5. SUBMISSION OF SAMPLES
Sample of each item for which rate is quoted must be submitted giving the required
information in the format. Sample without Name of producer or brand name, in
embossed/engraved form, will not be accepted. Bidders should obtain a receipt in the
format of Annexure - B and the scanned copy of the receipt must be submitted online in
Technical Envelope. All columns in the format must be filled in.
Sample should be submitted from 06/09/2012 to 18/09/2012 during office hours, on
any working day at the office of Commissioner of Animal Husbandry, Fodder
Development Desk, (AH -.14 ), Mendhi Farm, Gokhalenagar, Pune -16 for verification.
The samples must be submitted along with the Commercial Test Report of Govt. approved

institutes enlisted in Para-2(f) above. The summary of Commercial Test Report must
however be uploaded online in the technical envelop.
Samples should be affixed with a label showing:-
a. Name and address of the firm.
b. Tender number.
c. Commercial Test Report number/date/institute.

The required valid technical bids not received from the bidders, So that, this
extension of time is given. There is no need to pay the fees for purchase of tender for the
earlier bidder, but they should submit the technical and commercial bid again. Also, they
should submit the Samples and Commercial Test Report as per IS standard, if earlier was
rejected.
7. EARNEST MONEY DEPOSIT (EMD)
a. The Earnest Money Deposit for Manually operated Chaff Cutter is Rs 2.0 Lac. The
EMD for Power operated Chaff Cutter (2HP, 3HP & 5HP) is Rs 5.0 Lac for each type.
The EMD should be paid in the form of Demand Draft drawn on any nationalized
bank. Cheque or cash will not be accepted in any case. The scanned copy of the DD
should be uploaded for online tender submission. The Demand Draft for EMD shall be
physically submitted to the Office of the Commissioner, Animal Husbandry, Fodder
Development Desk, (AH-.14), Mendhi Farm, Gokhalenagar , Pune -16 before
21/09/2012 up to 17.45 hours. The following categories of suppliers are exempted
from payment of earnest money deposit-

i. The firms located in Maharashtra & Registered with Director General of
Supplies & Disposals, New Delhi.
ii. Small Scale Industrial Units registered with Director of Industries,
Maharashtra, only for item manufactured by them.
iii. The SSI units registered with National Small Industries Corporation and
Small Industries Service Institute of Govt. of India for their manufacturing
items.
iv. Government and Semi-Government Institutions of Maharashtra and
undertakings of any State Government /Government of India.
v. Suppliers registered with the Central Stores Purchasing Officer of the
Directorate of Industries, Maharashtra, who has satisfactorily supplied the
material for last five years.
c. In case of claim for exemption of EMD, the bidder must submit necessary documents /
exemption certificate from appropriate authorities..

d. The EMD is liable to be forfeited, in case the rates quoted by the tenderer are approved
but the party refuses to enter into the agreement for supply.
8. MANNER OF SUBMISSION OF ONLINE TENDER FORMS
Tenderers should prepare and submit tenders online on departmental e-tendering
portal http://ahd.maharashtra.gov.in by two bid systems. All the required documents as
mentioned below, need to be uploaded online in technical envelope of the e-Tender.
During Bid Preparation of the e-Tender, tenderers have to generate HASH VALUE of the
Technical and Commercial envelopes. The rates must be submitted online in the
prescribed form given in commercial envelope, duly encrypted with tenderer’s digital
signature certificate. The rates for the items in ANNEXURE – A-1 to A-4, should be
quoted regionwise for supply of chaff cutters in any district/area of the entire region, as
per the indent. Rates for a specific district/area of the region will not be accepted. It may
be noted that while online opening of the e-Tender, Technical Envelope will be opened in
the first stage. Commercial Envelope will be opened only after ascertaining whether the
tenderer has fulfilled all requisites terms and conditions. The tender not fulfilling any of
the requisite terms and conditions will be rejected and the commercial envelope will not
be opened in such case. Also no further claim will be entertained.
.
A. Technical Envelope (Technical Bid) : The technical information in the form of
following documents is mandatory.
I. For manufacturers, a Valid Manufacturing License /Certificate of Registration,
issued by competent authority. For dealers/distributors, a Certificate of
Authorisation as a Authorised Dealer / Distributor, issued by the manufacturing
company.
II Sales Tax Registration Certificate of the manufacturer/dealer/distributor unit, with
registration number /TIN, valid on the date of filing the tender. In case the
application for allotment of registration /TIN is being pending with the concerned
department, the copy of the application accepted by the sales tax department has to
be attached. A valid certificate for exemption of Sales Tax must be enclosed,
wherever applicable.
III. Last years’ annual report and audited financial statement of bidding firm.
IV. Demand Draft for purchase of tender.
V. Scanned copy of Demand Draft for Earnest Money Deposit:-
(1) The Earnest Money Deposit for Manually operated Chaff Cutter is Rs 2.0 Lac.
The EMD for Power operated Chaff Cutter (2HP, 3HP & 5HP) is Rs 5.0 Lac for
each type. The Demand Draft should be drawn on any Nationalized Bank in the
name of "Accounts Officer to the Commissioner Animal Husbandry,
Maharashtra State, Pune-1"
or
(2) Certificate of exemption for Earnest Money Deposit from the concerned
authorities.
VI. Test Report of chaff cutter from any approved institute, enlisted in para 2(f) above.

VII. Onsite Warranty Certificate for 2 years
VIII. Tender sample submission proforma cum departmental receipt (Annexure B).
IX. Information brochure of Chaff cutter.
XI. Details of machinery/infrastructure available for production/supply of Chaff cutter.
XII. Details regarding experience of supply of chaff cutters in the past, if any.
XIII. Declaration duly Signed (Annexure -D).
XIV. Check list duly signed (Annexure -C).
All the above documents should be uploaded online in the Technical Envelope. The
original documents should be kept ready for verification on demand. Failure to enclose the
above documents will make the tender form liable for rejection.
B. Commercial Envelope (Commercial Bid):- The rates should be quoted only in the
online price tender. The rates are to be quoted region wise. The rates must be valid for
supply of chaff cutters in any district/area of the entire region, as per the indent. Rates
for a specific district/area of the region will not be accepted. The bidder should quote
his price for any or all of the following regions.

The rates not quoted in prescribed online tender form or quoted on separate paper
will not be considered and such tender will be rejected. The Commissioner, Animal
Husbandry, Maharashtra State, and Pune reserves the right to call for break up of rates
quoted, if necessary.
C. Technical Envelope and Commercial Envelope should be sealed separately and HASH
VALUE of both envelopes must be generated online. No tenders will be accepted
after stipulated date & time. Also no request for extension of time will be entertained.
D. Tenders sent by Registered Post or by Speed Post / Courier will not be accepted.
E. The firm making any undue effort to bring pressure from outside/departmental authority
will be liable for outright rejection.
9. CHECK LIST

The documents in the check list must be compulsorily uploaded online with e-Tender
form. Any omission in this regard, will make the tender liable for its rejection. Before
preparation of the online tender, the tenderer is advised to check each item and score at the
appropriate place as Yes or No in the checklist.
10. . HOW TO QUOTE RATES
a. The F.O.R. Destination Rates for supply of Chaff Cutters should be quoted. in prescribed
online tender form (Annx-E). The chaff cutters are to be supplied at the Taluka Veterinary
Mini polyclinics or The Taluka Panchayat Samitees, where minipolyclinic does not exist.
The rates are to be quoted region wise. The rates must be valid for supply of chaff cutters
in any district/area of the entire region, as per the indent. Rates for a specific district/area
of the region will not be accepted. The bidder should quote his price for any or all of the
regions mentioned in Para-8(B) above.
b. Rates should be quote Itemwise and Regionwise in the Commercial Envelop E-1 to E-4.
c. The rates should be quoted inclusive of all Taxes applicable. Tax structure as per VAT /
CST as applicable, must be followed. The Department will not provide Octroi Exemption
Certificate.
d. Rates must be submitted only in Online Prescribed Tender form-Commercial Envelope.
e. Validity of Rates – The rates quoted would be valid for a period from 01/10/2012 to
30/06/2014. The repeat order for the tendered items can be given by the purchaser
within this period. The tenderer is bound to supply the items with the accepted rates.
11. PRICE VARIATION / ESCALATION
a) Increase in rate on any account such as increase in input cost etc. will not be admissible
in any case.
b) The tenderer will not quote or offer less price than the approved price in relation with
this tender and agreement to any agency / institute concerned with Government of
Maharashtra or Government of India or supply the same item to any of its distributor /
dealers / whole- sellers at a lower rate, (after applying all relevant discount structures)
during the contract period including extension if granted, failing which “the tenderer” will
have to accept the lesser price for all the orders concerned during the contract period.
12. ACCEPTANCE OF TENDERS
a. The Commissioner, Animal Husbandry, M.S. Pune-1 reserves the right of accepting
whole or any part of the tender or to refuse all tenders without assigning any reason.
b. The Commissioner, Animal Husbandry also reserves the right to call for break-up of
the quoted rates if required.
c. The Commissioner, Animal Husbandry does not pledge himself to accept the lowest
tender and reserves the right of accepting the whole or any part of the tender or portion
of the rate offered against any item and the tenderer shall supply the same at the rates
quoted.

13. SIGNING OF AGREEMENT
a. Successful tenderer/authorised representative shall enter into the Contract Agreement
with the Competent authority i.e. The Commissioner, Animal Husbandry, M.S., Pune-
1, preferably within 10 days of acceptance of tender or when called.
b. The successful tenderer will be required to execute an agreement on judicial stamp
paper of Rs.500/-
c. Only the person authorised by due resolution in this contest is allowed to sign the
agreement on behalf of the successful tenderer. Any other person will not be eligible to
sign the agreement on behalf of the successful tenderer.
d. The Earnest Money Deposit will be forfeited in case the tenderer fails to sign the
agreement after acceptance of his tender. The tenderer is liable to be blacklisted in such
case.
14. SECURITY DEPOSIT:-
a. The successful tenderer will have to give a Security Deposit of 3% of total value of
the total quantity of Chaff Cutter will be supplied in form of bank Guarantee or
term / fixed Deposit Receipt drawn on any nationalized bank.
b. The Government and Semi-Government Institutions of Maharashtra and undertakings
of any State Government /Government of India will be exempted from paying the
security deposit.
c. The security deposit will be returned after 6 months of successful completion of
warranty period. The security deposit should therefore be valid for 30 months.
Indemnity bond after the above period will be required to be given by the party
agreeing and assuring that in case of any complaint of losses the same will be paid
by the contractor to the Commissioner, Animal Husbandry, Maharashtra State, Pune.
d. Security Deposit will stand forfeited, in case of any breach of terms and/or conditions
of the tender and/or contract.
15. INDENTING PARTIES
District Deputy Commissioners and District Animal Husbandry Officers of the
animal husbandry department, M.S. shall be the Indenting Officers for the chaff cutters
under the rate contract.
16. DEMAND AND SUPPLY SCHEDULE
a. Successful tenderer will have to supply the goods as per order placed within 60 (sixty)
days or the period given by the indenting officer after receipt of supply order. For
failure within the above stipulated period, the tenderer is liable for a penalty of 0.5 %
(Half percent) of the total price of the purchase cast per week or part thereof for late
delivery of such goods till the date of its final supply/receipt.
b. A repeat order within the validity period of the tender may be given, if required.

c. The number of items to be purchased may change as per the requirement.
d. The Contractor will have to necessarily supply the item of the same quality and make,
as have been specified in his bid.
17. BILL RAISING, PAYMENT AND PROCEDURE THEREOF
a. Payment shall be made by the indenting officer on production of bills raised by the
contracting company. All payment shall be made in the name of contracting company
only.
b. As the payments are made from Government Treasury, the undersigned shall not be
responsible for any delay in receipt of grants from Government or procedural delay due
to treasury operations, which is beyond control of undersigned or the indenting officer.
18. TAX DEDUCTIONS FROM BILLS
Income tax at appropriate rate will be deducted at source for the supply made.
19. QUALITY CONTROL
i If the undersigned desires to inspect the material, producing facility and stores of
Chaff Cutter, all these components should be offered for inspection to him or to his
representative at the cost of supplier.
ii. All the Chaff Cutters would be tested for its quality before supply to the farmer
beneficiaries, by the Indenting Officer from any of the Polytechnic College /
Agricultural Engineering College / Industrial Training Institute (ITI). The cost of such
testing will be borne by the tenderer.
20. PENALTY CLAUSE
In case, contracting party fails to deliver consignment thereof within the contract
period of delivery or in case the goods are found not in accordance with the prescribed
specifications and/or as per approved samples, the Commissioner, Animal Husbandry,
Maharashtra State, Pune shall exercise his discretionary powers to take one or more of the
following actions. Any loss, penalty imposed on supplier shall be deducted from the bills
payable to him to the extent of bill amount and any other amount due to contractor under
the same or any other contract with the undersigned or any of the indenting agencies.
a. To recover from the contractor as liquidated damages, a penalty of 0.5% (Half percent)
of the stores price, which the tenderer has failed to deliver as aforesaid for each week
or part of a week during which the delivery of such stores may be in arrears, and/or
b. To purchase such stores from any other sources and at such price as the purchasing
officer in his sole discretion feels fit and to recover the differences of cost if any from
the contractor. The additional amount of expenditure incurred over and above
approved rates will be liable for recovery from the contractor. The defaulting

contractor will be penalised to the extent of differences in the rate of 100% of the value
of the order. If the defaulting contractor fails to pay penalty, he will be permanently
delisted from the list of approved contractors of departments of Maharashtra
Government/Central Government and security deposits of the contractor will be
forfeited.
c. To forfeit the entire amount of security deposit of the contractor.
d. To cancel the contract or part thereof with the tender.
e. To blacklist the supplier permanently from the list of departmental suppliers.
21. WARRANTY CLAUSE AND ITS OPERATION
The Tenderer /Contractor / Seller / Successful Bidder should declare that the Chaff
Cutter to be supplied under this contract shall be of best quality and workmanship and
shall be strictly in accordance with the specifications and particulars contained /mentioned
in ANNEXURE A-1 to A-4. The tenderer has to give onsite warranty of 2 years for the
chaff cutters to be supplied.
22. FORCE MAJEURE
If, at any time during the continuance of this contract, the performance in whole or
in part by either party of any obligation under this contract shall be prevented or delayed
by reason of any war, hostility, acts of the public enemy, civil commotion, sabotage, fires,
floods, explosions, epidemics, quarantine restrictions, strikes, lock outs or acts of God
(hereinafter referred to as events), provided notice of happening of any such eventuality is
given by either party to the other within 21 days from the date of occurrence thereof,
neither party shall by reason of such event, be entitled to terminate this contract nor shall
either party have any claim for damages against the other, in respect of such non
performance or delay in performance; and deliveries under the contact shall be resumed as
soon as practicable, after such event has come to an end or ceased to exist, and the
decision of the purchasing officer as to whether the deliveries have been so resumed or not
shall be final and conclusive, provided further that if the performance in whole or part of
any obligation under this contract is prevented or delayed by reason of any such event for
a period exceeding 60 days, either party may at its option terminate the contract, provided
also that if the contract is terminated under this clause, the purchaser shall be at liberty to
take over from the contractor at a price to be fixed by the purchasing officer, which shall
be final and all the unused, undamaged and acceptable materials, bought out components
and stores in course of manufacture in the possession of the contractor at the time of such
termination or such portion thereof, as the purchaser may deem fit accepting such
material, bought out components and stores as the contractor may with the concurrence of
the purchaser elect to retain.
23.PERIOD OF VALIDITY OF RATE CONTRACT
The contract shall be valid the period from 01/10/2012 to 30/6/2014.

24 .SETTLEMENT OF DISPUTES
a. It will be the responsibility of the tenderer to prove beyond doubt his liability for any
exemption from paying the Earnest Money Deposit and/or Security Deposit wherever
applicable. The tenderer should produce relevant document/certificate from the
competent authority in such case.
b. All the disputes between indenting agencies and the supplier shall be settled by the
undersigned. However, the disputes between the contractor and the undersigned or the
appeal against the decision of undersigned in disputes referred to him, shall lie with the
Secretary/Principal Secretary of the Department of Animal Husbandry, Government of
Maharashtra.
c. Judicial proceedings if any, will be under the jurisdiction of Pune Court.
25. REMOVAL OF DIFFICULTY
a. The undersigned shall take such decision to remove difficulties due to ambiguity of
provisions in the tender documents or due to provisions which are inconsistent with
the objective of this tender.
b. The dates quoted in the tender form are subject to change for any reason or in the
event of any holiday, abruptly declared by Government.

1 Material The material for construction of various components

7898 and the material for construction of blade shall

2 Hardness All cast iron components shall have a hardness of 160
to 220 HB and the hardness of the blade shall be as per

3 Handle The diameter of the handle support shall be minimum
of 15 mm. The total length of the handle shall be at
least 500 mm and the length of wooden shall be 430
mm to 150 mm. The diameter of the grip shall be 37 m
to 42 mm
4 Flywheel A flywheel of 900 mm to 1350 mm diameter shall be
provided. The weight of the fly-wheel shall not be less
than 24 kg.
5 Main shaft The length and diameter of the shaft shall be 400 mm
and 30 min respectively.
6 Worm The outer diameter and length of the worm shall be 75
mm or 80 mm and 155 mm respectively. The pitch of
the worm shall be 25 mm. It shall be provided with
two holes for proper fixing to the shaft. The distance
of centre of hole from the end of the worm shall be 50
mm or 13 mm.
7 Worm Gears The outer diameter of the gears shall be 125 mm or
133 mm.
8 Feed Rolls There shall be two feed rolls. The length and outer
diameter of the rolls shall be 207 mm and 75 mm or 85
mm respectively.
9 Springs Total length of each spring shall be minimum 95 mm.
The outer diameter shall be 20 mm and the number of
coils shall be 18.
10 Stand Stand shall consist of four legs. The leg shall be made
of angle section of minimum 50 mm X 50 mm x 2mm
size. The total height, length and width of the stand
shall be minimum of 750 mm, 600 mm and 550 mm
respectively.
