TERMS AND CONDITIONS

1. The contract will remain in force for a period of two years from the date ofcommencement and may be extended beyond two years on mutual acceptance, if sodesired by the Medical Superintendent.

2. Laboratory should be located in Delhi and Firm should have experience of providing full 24 hours Lab. services support to atleast 100 bedded hospital under Central Govt. /Govt. of NCT Delhi/PSUs/ESIC for minimum three years.

3. The tenderer must have necessary in house (at the quoted Lab premises) facilities formost of the tests in respect of latest technology & technical knowledge to carry out theLab investigations round the clock for which rates are being quoted. With each testit should be mentioned whether the test is conducted in house or outsourced. In case ofoutsourced investigations, the details of laboratory to which the investigation is to beoutsourced must be provided in the Technical Bid. The methodology and the timeperiod after which the report will be provided should be mentioned for each investigation.

4. A status report on the infrastructure facilities available with the tenderer in support of histechnical capability to execute the quoted Lab investigations must accompany the tenderhighlighting details of equipment, type of procedure and details of qualification &experience of manpower, whether full time or part-time, engaged for conducting the quotedinvestigations, quality control measures (including document proofs) , and automation invarious sections of laboratory. The tenderer will be liable for all types of responsibilities including medico-legal either in house or outsourced investigations

5. The tenderer should have complete functioning laboratory including a) microbiological investigations; b) molecular biology – genetics investigations (such as PCR, Karyotyping) and c) histopathological investigations. All three parts of these services should be in house.

6. The tenderer should have atleast 5 years of continuous NABL certification.

7. The tender must accompany an Earnest Money of Rs.3,00,000/- (Rs. Three Lacs only) by Bank/Demand Draft in favour of “ESI FUND A/C No.1”. Tender received without EMD/Tender cost will be rejected out rightly, which is refundable to the tenderer. No interest will be paid for such amount.

8. The successful tenderer must submit the Security Money of Rs. 6,50,000/-(Rupees Six Lacs Fifty Thousand only) in the shape of Demand Draft issued in favour of “ESI Fund Account No.1”, which will be kept in the hospital as performance security for the period ofservices awarded. No interest will be paid on such security. The said security will beforfeited in case of successful tenderer fails to provide satisfactory services/ unduedelay in providing services or leaving the contract in the middle of the contract period.

9. In case the firm to whom the contract is awarded, fails to accept the offer, the MedicalSuperintendent shall have the right to forfeit the earnest money deposited by the firm. Nocorrespondence/conference in this regard will be entertained.

10. The tenderer shall have to mention his name and address (along with the telephone, Fax,Mobile numbers) for all future communications and shall be the sole signatory of thequotation.

11. Tenderer must undertake at the time of applying for tender that he has perused theterms and conditions of the tender and the same are acceptable to him. Anyconditional acceptance shall make tender liable for rejection.

12. Tender is required to be submitted in two bids viz ‘Technical Bid’ and ‘FinancialBid’ separately superscribing on the envelopes as ‘Technical Bid’ and “Financial Bid’respectively. Each and every page of the quotation is to be serially numbered and dulysigned by authorized signatory/tenderer. Both the envelopes are to be put in a singleenvelope superscribing “Tender for carrying out Lab. investigations” with name of thetenderer and specifying the number of sealed envelopes enclosed/inserted.

13. (A) Technical bid:- This should include following :

(i) EMD to be furnished in accordance with serial No.7 of Terms & Conditions.(ii) Terms & Conditions duly signed by the tenderer along with seal.(iii)Technical details of the quoted tests as per following format:(Annexure I)

(iv) In case of cultures, the tenderer should quote rates both for with antibioticsensitivity and without antibiotic sensitivity. Details of antibiotics are enclosed in Annexure– II, out of which the selection for sensitivity test is to be made by technical expert as perprescribed suitable spectrum depending upon the growth of organism.

(v) If any test not included in the Annexure-I, the tenderer should perform all such investigations by their own lab or outsourced lab (should be NABL certified Lab.).

(vi) If any test which is referred and the tenderer is unable to perform due to any reason with proper justification of unlisted/not included investigations in Annexure-I, the tenderer will be liable for all types of responsibilities including the quality of test and their reports for any medico-legal purpose and the tenderer shall be liable for any legal consequences thereof.

(vii) The award of tender shall be subject to satisfactory report of technical committee which will visit the lab for its functioning, manpower (Doctors, Technicians, Non- Technical staff), equipments, infrastructure etc.

(viii) The tenderer who has maximum number of in-house NABL tests & maximum number of in-house tests (among listed investigation in Annexure-I) will be preferred.

(ix) The Histopathology slides of all specimen sent will be provided by the outsourcedlab. Blocks will be provided as and when demanded without any extra amount by theoutsourced lab.

(B) Financial Bid: - It should comprise of following:-

(i) All pages of the quotation must be signed by the tenderer and the rates should be given both in figures and words.

(ii) In case of variation in rates, rates quoted in the figure will be treated as final.

(iii) The prices of the tests should be indicated in the Financial Bid against the name of each test as per format given below:- (Lists of tests as per Annexure III)

14. The successful tenderer shall execute an agreement containing all the terms andconditions mentioned in the tender document on a non-judicial stamp paper of Rs.100/-(Rs. One Hundred only) and he will have to deposit security money of Rs. 6,50,000/-(Rupees Six Lacs Fifty Thousand only) in the form of Demand Draft in favour of “ESI FUND A/C No.1” payable at Delhi. No interest shall be payable on said deposit (Security money) in anycircumstances. The amount of Security Deposit shall be refunded on the expiry of thecontract on furnishing “No Dues Certificate”.

15. The rates of specific/special tests should be procedure based whether they are performed by various techniques like RIA/ELISA/PCR or any other methodology used.

16. In case the agency/firm fails to execute the job after entering into the contract orterminate the contract before completion of period of contract at their own accord, theMedical Superintendent shall have the right to forfeit the security money deposited by the firm for execution of contract for the remaining period through some other firm.

17. Bills are to preferred immediately after completion of a month in triplicate along with thethird copy of the reports of investigations. They are to be submitted to central Diary in theoffice of Medical Superintendent, IG ESI Hospital, Jhilmil, Delhi. Income Tax deduction asapplicable shall be made at source at the time of release of payment. Payment of bill will besubject to deduction of statuary liabilities, if any.

18. The tenderer should have 24 hours working/functioning laboratory so that the collection of samples, reporting of tests and despatching of reports of all the investigations should be done round the clock.

19. In case of inability to collect samples from the hospital as per the requirement of thehospital or not furnishing test report within stipulated time, a penalty up to Rs.500/-(Rupees Five Hundred only) per such instance may be levied on the tenderer by theMedical Superintendent and any extra cost incurred whatsoever by the ESI Corporationon analysis of samples from the open market shall be recovered from the tenderer bydeducting the same from the monthly bills.

20. In case of wrong diagnosis resulting out of incorrect reporting of samples, the legalliability arising out of it, if any, shall entirely rest with the tenderer with cost and damagesapplicable.

21. An undertaking should be enclosed with tender document that the firm is not chargingrates lower than quoted in his present quotation, from any other Institute/Hospital inDelhi.

22. In case of any dispute, the decision of the Medical Superintendent shall be final andbinding on both the parties.

23. M.S. reserves the right to reject or accept any tender without assigning any reasonthereof. M.S. also reserves the right to terminate the tender/offer after itsapproval at any time during the currency of the tender period, if the performance isfound not to be satisfactory or the tenderer fails to provide the services.

24. The terms and condition contained herein shall form part of/shall be taken as if theywere included in the contract agreement to be entered into by the firm.

25. The quotation would be valid for a period of six months.

26 The evaluation of technical bid will be based on presence of trained manpower,automation, infrastructure alongwith latest technology presence of in-house facility andmaximum time taken to provide the reports.

27. The tariff list available with the firm shall be provided by the tenderer at the time of contract, which will be valid during the contract period.

28. The rates of unlisted tests shall be applicable either as per CGHS/AIIMS rates, and if not available in CGHS/AIIMS rates, then rates shall be calculated on the rates provided by the tenderer in their tariff list after deduction of 15%.

29. COLLECTION OF SAMPLES

The successful tenderer shall make his own arrangement at his cost to get thesamples collected from the department of Pathology everyday under recommendedconditions specific for the samples. Routine samples drawn/obtained from OPDpatients and wards must be collected between 11:00 a.m. to 12:00 Noon everyday andin case of any emergency investigations the sample must be collected as and wheninformed telephonically round the clock . The contact number of the tenderer forthis purpose shall have to be furnished in his tender. He shall have to providecontainers for collecting all samples outsourced. The samples are to be received alongwith the requisite requisition slips in duplicate.

30. SUBMISSION OF REPORTS

Time, latest technology/methodology and accuracy in result would be the essenceof the contract/offer. The approved tenderer shall have to make necessaryarrangement at his cost to deliver the reports of investigations of samples collected dulysigned by the competent authority within the minimum possible time to the department oflab services. In emergency cases reports may also be asked/communicatedtelephonically & to be followed by delivery of written reports. The reports shall have tobe prepared in triplicate out of which two copies should be sent to the department of labservices immediately. The third copy shall be enclosed in one bunch later on along withthe bills.

31. In case of any emergency investigation, the report of the test must be available as early as possible or maximum within four hours from the time of collection of the sample, either by telephonically/e-mail/fax to the concerned person.

32. The contract can be terminated by the Medical Superintendent, I.G. ESI Hospital, Jhilmilby giving one month’s notice.

33. The Medical Superintendent reserves the right to amend or withdraw any of the termsand condition contained in the tender document.
