UNITED KINGDOM SEED CERTIFICATION SCHEME

THE CERTIFICATION OF CEREAL SEED IN SCOTLAND

2 INTRODUCTION

This booklet explains the requirements and procedures for the certification of cereal seed in Scotland. Those intending to enter crops or seed lots for certification in England, Wales or Northern Ireland should refer to corresponding booklets issued by the Certifying Authority in these areas.

The Cereal Seed (Scotland) Regulations 2005 (“Regulations”) and The Seeds (Registration, Licensing and Enforcement) Regulations (RLE) 2006 state the statutory requirements of the certification scheme. Nothing in this booklet shall be deemed to be at variance with these Regulations. A list of the scale of current statutory fees payable is available from the Certifying Authority or you can find them on the Science and Advice for Scottish Agriculture (“SASA”) web site at http://www.sasa.gov.uk.

The Regulations stipulate that marketing of cereal seed may only take place if it meets defined minimum standards and comes from crops meeting certain standards. Seed will be “Certified” only if it meets the statutory requirements of the Certification Scheme described in this booklet.

Marketing of uncertified seed may not take place, unless covered by the exceptions given below:

seed sold for delivery to countries outside the European Union, Norway, Lichtenstein and Iceland (the “EEA”);

seed which is used for tests and trials or scientific and selection purposes, provided that the producer has an authorisation from the Scottish Ministers;

and seed marketed for further processing, treatment or cleaning for which there is a satisfactory field inspection report and provided the identity of the seed is ensured.

Data Protection Act

Applicants should note that information supplied on seed certification forms will be used for the purpose of determining the application, for enforcement purposes and for research and statistical purposes. Publication of information may take place in line with Scottish Ministers commitment to allow access to information and in accordance with the Environmental Information Regulations, the Code of Practice on Access to Government Information and the Freedom of Information Act.

3 DEFINITIONS

3.1 Certifying Authority

The organisation responsible for supervising the procedures relating to the Cereal Certification Scheme is SASA. Direct all enquiries relating to all aspects of cereal seed production and certification in Scotland to the Certifying Authority at the address below:

3.2 Maintainer

The company or person indicated in the relevant UK National List or the EU Common Catalogue who is responsible for the maintenance of the plant variety in relation to listed varieties. This includes any company or person lawfully multiplying seed bred by another in relation to a variety

that is not of a listed variety and the production of Breeders Seed, Pre-basic Seed or Basic Seed in the United Kingdom.

3.3 National List & Common Catalogue

The list of varieties of cereal species published in accordance with the Seeds (National Lists of Varieties) Regulations. Each variety must undergo 2 years of testing to gain entry onto the National List and once a variety is on the National List, it is eligible for entry into the Certification Scheme in the United Kingdom (subject to fulfilling the relevant UK conditions for certification).The Common Catalogue is a list of varieties published in the Official Journal of the European Communities. These varieties are eligible for certification under the Certification Scheme (subject to fulfilling the relevant conditions for certification).

3.4 Applicant

An Applicant is a company or person that applies to the Certifying Authority to certify seed, including the entry of seed crops.

3.5 Merchant

A licensed company or person registered to market seed in accordance with the RLE Regulations.

3.6 Processor

A licensed company or person registered to process seed in accordance with the RLE Regulations.

3.7 Packer

A licensed company or person registered to package or repackage seed in accordance with the RLE Regulations.

The Certifying Authority will maintain a register of all Merchants, Processors, and Packers in Scotland as required by the RLE Regulations.

3.8 Responsible Person

To ensure that the requirements and procedures are carried out to the satisfaction of the Certifying Authority applicants, merchants, processors, and packers must nominate one person with sufficient knowledge of the relevant Seed Regulations and authority within the firm to be the “responsible person”. The responsible person should sign all forms for seed certification or a signature on their behalf will be acceptable. The responsible person will be the first point of contact in event of any queries and communications from the Certifying Authority.

3.9 Grower

A person who grows seed crops within the Certification Scheme.

3.10 Official Seed Testing Station

A laboratory maintained by the Scottish Ministers and authorised to carry out official tests on all kinds of seed as provided for in the Plant Varieties and Seeds Act 1964.

3.11 Licensed Seed Testing Station

A laboratory currently authorised to carry out official tests under a licence granted by the Scottish Ministers under the terms of the RLE Regulations or under a licence granted by the Department of Agriculture and Rural Development, the National Assembly for Wales or the Secretary of State under equivalent legislation.

3.12 Official Inspector

An officer of the Certifying Authority authorised to inspect cereal seed crops.

3.13 Official Sampler

An officer of the Certifying Authority authorised to sample cereal seed lots.

3.14 Officially Licensed Crop Inspector

A person who is currently authorized to carry out cereal crop inspections under the RLE Regulations, by way of a licence granted by Scottish Ministers, or Fera, DARD, the National Assembly for Wales under equivalent legislation and who meets the conditions of Annex X.

The Certifying Authority will maintain a register of all licensed crop inspectors in Scotland as required by the RLE Regulations.

3.15 Officially Licensed Sampler

A person who is currently authorized to carry out seed sampling under the RLE Regulations, by way of a licence granted by Scottish Ministers, or Fera, DARD, the National Assembly for Wales under equivalent legislation and who meets the conditions of Annex X.

The Certifying Authority will maintain a register of all licensed seed samplers in Scotland as required by the RLE Regulations.

3.16 Plot Sample

The portion of the seed sample, submitted for testing for the purposes of an official examination that remains after the removal of the quantity of seed used for the Analytical Purity and Germination Test is the “Plot Sample”. After completion of the other seed determination tests’, return the remaining seed to its original bag with appropriate identification, and store under conditions in accordance with instructions issued by the Scottish Ministers. The appropriate closing dates for the receipt of Plot Samples representing multiplication category (Pre-Basic, Basic, Certified Seed and Certified Seed 1st Generation) seed lots also apply (see Annex III).

If a plot sample is not submitted to the Certifying Authority in time to sow a control plot, crops entered using the seed lot will be officially inspected by the Certifying Authority at the applicants expense and no licensed crop inspectors report will be accepted for the crops so entered.

3.17 Control Plots

Control plots are plots grown by the Certifying Authority using a representative sub sample of the plot sample for establishing the varietal identity and purity of the seed lot.

For a licensed inspection to be used for seed certification an official control plot will be required for each seed lot, and the plants produced in the control plot will have to pass an official examination for the minimum EC standard (not HVS) for which the crop is entered. In the absence of a control plot, any inspection will have to be official. Scottish Ministers will recognise control plots sown in other areas of the United Kingdom, provided confirmation of this fact and the result is made available to Scottish Ministers. If you are uncertain that a control plot has been sown in other areas of the United Kingdom, you may wish to send a plot sample of each seed lot you intend to enter for crop production in Scotland to SASA.

Additionally, if a seed lot fails the minimum EC standard (not HVS) for varietal purity in post control, licensed inspections will not be allowed on any crops sown with such a seed lot, and official inspections will have to take place. For example, a licensed inspection will be allowed to take place on C1H seed lot that fails the C1H standards in post control, but if this seed lot were also to fail C1L in post control, a licensed inspection will not be allowed, and an official inspection will be required.

Samples from certified seed lots not intended for seed production may also be sown in control plots and the Certifying Authority will notify applicants of any adverse results. All purchasers of a seed lot must be notified, in writing, of any adverse result from a control plot test. Notification must be given as soon as practicable as, and in any case, not later than 7 days after the seller receives the information.

3.18 Breeders seed

Seed of a generation prior to Pre-Basic seed which has been produced by or under the responsibility of the maintainer according to accepted practices for varietal maintenance;

which is intended for the production of Pre-Basic seed or Basic seed.

3.19 Pre-Basic seed

Seed of a generation prior to Basic seed which has been produced by or under the responsibility of the maintainer directly from Breeders seed or from Pre-Basic seed;

which is intended for the production of Pre-Basic or Basic seed or with the permission of the maintainer Certified Seed (CS), Certified Seed 1st Generation (C1) or Certified Seed 2nd

Generation (C2);

and meets the conditions for Pre-Basic seed (see Annexes I & II).

3.20 Basic seed

Seed which has been produced by or under the responsibility of the maintainer directly from Breeders’ or Pre-Basic seed;

which is intended for the production of Certified seed, Certified seed 1st generation or Certified seed 2nd generation;

and meets the conditions for Basic seed (see Annexes I & II).

3.21 Certified seed (CS) (Maize, Rye and varieties of Hybrid Wheat, Barley, Oats and Self Pollinating Triticale)

Seed which has been produced directly from Basic seed or with the written authority of the maintainer from Pre-Basic seed;

which is intended for grain or fodder crop production;

and meets the conditions for Certified seed (see Annexes I & II).

3.22 Certified seed, 1st generation (C1) (Wheat, Barley, Oats & Triticale other than Hybrids)

Seed which has been produced directly from Basic seed or, with the written authority of the maintainer from Pre-Basic seed;

which is intended for the production of Certified seed 2nd generation, or for grain or fodder crop production;

and meets the conditions for Certified seed, 1st generation (see Annexes I & II).

3.23 Certified seed, 2nd generation (C2) (Wheat, Barley, Oats & Triticale other than Hybrids)

Seed which has been produced directly from Basic seed or Certified seed, 1 st generation or, with the written authority of the maintainer, from Pre-Basic seed;

which is intended for grain or fodder crop production;

and meets the conditions for Certified seed 2nd generation (see Annexes I & II).

3.24 Higher Voluntary Standard (HVS)

For Basic seed, Certified seed 1st and 2nd generation (wheat, barley and oats other than hybrids) there is a Higher Voluntary Standard which is a statutory standard. Entry at this level means crops will have to meet the higher standards (see Annex I) for crop conditions, varietal purity, species purity, and wild oats. If crops fail to meet these standards, they will be eligible for consideration at the EC minimum standard.

If a crop meets the HVS (see Annex I) then seed from that crop is eligible for certification at HVS. Seed not meeting the HVS (see Annex II) will be eligible for consideration for certification at the EC minimum standard.

It is permissible to enter seed lots of HVS or minimum standard for the production of crops at either level of any subsequent generation subject to the provisions in Section 6.

3.25 HVS Verification

As grown seed or seed lots imported from outside the UK may be eligible to be re-graded to the HVS. An application to verify that the seed has attained the HVS shall be made to the Certifying Authority on form SDC 11. As grown seed will require a crop result from the appropriate Certifying Authority specifying that the seed meets the criterion for HVS (see Annex 1).

For imported seed lots, a seed test report is required specifying that the seed meets the criterion for HVS (see Annex II). If the seed test report shows that the test was carried out on 500g only, a further 500g must be tested to show that the seed lots meets the criteria for HVS.

3.26 As Grown Seed

Seed harvested from a crop which has met the crop standards (see Annex I), may be marketed for processing, providing that the identity of the seed is ensured.

3.27 Varieties eligible for certification

Any variety that is on the relevant UK National List or EU Common Catalogue is eligible for certification under the Scheme if the seed meets the relevant crop and seed standards and complies with the relevant provisions of the Cereal Regulations. Any other variety is eligible for entry into the Scheme, subject to the provisions below;

seed of varieties entered for National List trials but not yet on a relevant UK National List or an equivalent list of another EEA state is eligible for “Breeder’s Confirmation” if the seed meets the relevant conditions (see Annexes I and II). Seed may only be entered at Pre-basic or Basic categories. This confirmation does not permit the marketing of the seed. The specific details of this procedure are in Annex XII;

seed marketed for export to countries outside the EEA under the OECD Cereal Scheme.

4 FORMS and LABELS

Annex IX gives a list of the forms required for certification; supplies of these are available from SASA. .

Applicants should apply for labels for Pre-Basic, Breeders Confirmation, or OECD seed to SASA on form SDG 9A.All other labels are available through an officially contracted supplier. Details of the official contractor are supplied through seed certification information letters. For information on the current contractor, contact SASA.

Licensed Seed Testing Stations should obtain supplies of SDG 10s from the Official Seed Testing Station for Scotland in paper or electronic form. All forms (except SDG10) are available for downloading and over typing on the SASA web site(http://www.sasa.gov.uk) and completed forms should be posted to the address on page 6.

5 CROP ENTRY REQUIREMENTS FOR PRE-BASIC, BASIC AND CERTIFIED SEED

5.1 Pre-Basic and Basic seed

The production of Pre-Basic and Basic seed must be under the responsibility of the maintainer. The Certifying Authority will reject an application if the applicant is not the maintainer unless the maintainer gives their written approval.

5.2 Certified Seed

The production of Certified seed of rye and varieties of Hybrid wheat, barley, oats and self-pollinating triticale will be from Basic seed or from Pre-Basic seed with the written approval of the maintainer.

The production of Certified seed 1st generation of wheat, barley, oats and triticale will be from Basic seed or from Pre-Basic with the written approval of the maintainer.

The production of Certified seed 2nd generation of wheat, barley, oats and triticale will be from Certified seed 1st generation, Basic seed or from Pre-Basic seed with the written approval of the maintainer.

The applicant will notify The Certifying Authority, on form SDG 1 of each seed lot intended for use in crop production by the appropriate closing date (see Annex III). Use a separate form SDG 1 for each category and species (kind) of seed. For Crop entries from imported seed see section 8.

The applicant must:

Arrange for multiplication in fields which meet the requirements for previous cropping and isolation distances (see Annex I);

Ensure that the grower retains at least one label from each seed lot sown and it is prominently displayed in or near each crop, alternatively the label should be clearly marked with the field identity number (FID) and it is made available at the time of inspection.

For the production of seed crops, enter the details of each seed lot (already notified on form SDG 1) on form SDC 2 and send it to the Certifying Authority by the appropriate closing date (see Annex III). The form SDC 2 must give the Certifying Authority precise details of each crop sown. Use a separate form for each seed lot registered on form SDG 1. If more than 9 crops are sown from one lot a second fully completed form will have to be used with a further sheet number. Where crops have been sown using more than one seed lot all the seed lots used should be declared on the SDC 2 and all the crops on the sheet should be sown with the same seed lots. The Certifying Authority will notify acceptance or rejection of entries.

Consecutively number all SDC 2 forms. Each batch of consecutively numbered forms SDC 2s must be accompanied by a summary on form SDG 2A. Construct the Crop Identity number for each crop (see Annex VIII) by completing the details required on form SDC 2.

NB If an applicant has entries with more than one Certifying Authority or for more than one crop group (e.g. Cereals or Oil and Fibre) it is essential that sheet numbers are not duplicated.

Pre-Basic and Basic seed crops will be inspected by an official inspector at any appropriate stage or stages during production to assess whether or not the crop meets the appropriate conditions (see Annex I).

An official inspector or a licensed inspector may inspect seed crops of Certified seed 1st or 2nd generation crops. The inspectors must carry out inspections at a suitable stage or stages during the growing season to assess whether or not the crop meets the appropriate conditions (See Annex I). Applicants must notify the Certifying Authority of the names and license numbers of licensed inspectors on the first copy of form SDG 2A sent each season (i.e. Winter and Spring). Notify the Certifying Authority of any changes.

Crop inspections must be carried out in accordance with “Instructions to Crop Inspectors” issued by SASA. Upon completion of the inspection report (SDC 3), the details and the recommendations of the inspector(s) findings should be sent to the SASA on the day of the inspection .

5.3 Withdrawal of Crop Entries

Crops may be withdrawn at any time. If the applicant withdraws a crop before SASA start the inspection procedure, any official crop inspection fee will be refunded, together with part of the initial fee, minus an administration fee.

NB. Distribution of the crop cards to the applicant or the official inspector will signify the latest date for the refunding of part of the initial and/or inspection fee.

5.4 Crop Results

SASA will notify the applicant of the acceptance or rejection of the crop.

5.5 Control Plots

For a licensed inspection to be used for seed certification an official control plot will be required for each seed lot, and the plants produced in the control plot will have to pass an official examination for the minimum EC standard (not HVS) for which the crop is entered. In the absence of a control plot, any inspection will have to be official. Scottish Ministers will recognise control plots sown in other areas of the United Kingdom, provided confirmation of this fact and the result is given to Scottish Ministers. If you are uncertain that a control plot has been sown in other areas of the United Kingdom, you may wish to send a plot sample of each seed lot you intend to enter for crop production in Scotland to SASA.

Additionally, if a seed lot fails the minimum EC standard (not HVS) for varietal purity in post control, licensed inspections will not be allowed on any crops sown with such a seed lot, and official inspections will have to take place. For example, a licensed inspection will be allowed to take place on C1H seed lot that fails the C1H standards in post control, but if this seed lot were also to fail C1L in post control, a licensed inspection will not be allowed, and an official inspection will be required.

5.6 “As Grown” Seed

“As Grown” seed may be marketed for processing. The segregation of the harvested seed from all other seed is the applicants’ responsibility and a label with the information specified should identify it when it is being moved:

variety;

category; and

either, the crop identity number or the name of the grower and FID number of the field in which it was grown.

The applicant’s will use their own labels for this purpose.

6 REGRADING OF ACCEPTED CROPS AND “AS GROWN” SEED

The Certifying Authority will notify the applicant of each crop with the category or categories that any seed lots produced from the crop are eligible.

The general rules are:

Pre-Basic crops grown from Breeders seed will be eligible for Pre-Basic or Basic seed;

Pre-Basic crops grown from Pre-Basic seed will be eligible for Basic seed, Certified seed 1st

generation, or Certified seed 2nd generation and for varieties of rye and hybrid varieties of wheat, barley, oats and self pollinating triticale Certified seed;

Basic crops grown from Breeders seed will be eligible for Basic seed only;

Basic crops grown from Pre-Basic seed will be eligible for Certified seed 1st generation or Certified seed 2nd generation and for varieties of rye and hybrid varieties of wheat, barley, oats and self pollinating triticale Certified seed;

Certified seed 1st generation crops will be eligible for Certified seed 2nd generation;

Crops entered for minimum standard are eligible as seed at the EC minimum standard of a lower category only;

HVS crops are eligible as seed at the EC minimum standard.

The Cereal Regulations require a minimum of 2 multiplications to produce seed sold to the farmer for commercial crop production. The first multiplication must be by or under the responsibility of the Breeder. The second is not restricted. Downgrading may result from failure to meet the entry standards in the crop, or at the request of the applicant subject to the above.

“As grown” seed may be downgraded before application for certification of a seed lot.

Seed may be regraded to a higher category after crop inspection. An application must be made to SASA who will check that all the entry requirements at the higher level have been met, e.g. a crop entered for and passing Certified seed 1st generation may be eligible to be regraded to Basic seed if:

the seed lot used to produce the crop was eligible to produce Basic seed;

the crop met the standards for Basic seed (see Annex1);and

the crop was officially inspected; and

the maintainer gives written authority.

Seed cannot be marketed at the higher category or level until a decision on the application has been made by SASA.

7 BULKING OF CROPS WHICH HAVE PASSED CROP INSPECTION

The applicant is responsible for the bulking of seed from crops of the same variety that have passed crop inspection and for which a result has been issued. Apply for the bulking of crops or parts of crops on form SDG 4A. The numerically lowest crop identity number of the constituents will identify the bulk. A bulk from the produce of crops that have passed at different categories and/or levels will take on the status of the constituent with the lowest category and/or level.SASA will notify the applicant if a bulking is unacceptable. When the bulk is ready for certification treat it in the same way as the produce of a single crop.

8 IMPORTED SEED

8.1 Seed imported for crop production.

If a variety is entered for certification in Scotland and it is not on the relevant UK National List but is on the EU Common Catalogue the Certifying Authority will require:

an adequate description of the variety and a standard sample of seed of the variety supplied by the certification authority in the listing country, in time for sowing in UK control plots;

a representative sample of the seed lot for multiplication, in time for sowing in UK control plots.

If a variety is entered for certification in Scotland and it is on the relevant UK National List the Certifying Authority will require:

a representative sample of the seed lot for multiplication, in time for sowing in UK control plots.

In both cases, the form SDG 5 should be marked “Plot sample only” in the “Additional Test” section. Minimum sample weights apply to these samples (see Annex IV).The sampler must remove and submit a label to SASA from each lot. The bag/s from which label/s are removed must be re-labelled with appropriate UK official labels giving the country of origin and sealed as appropriate.

If a variety is entered under the OECD seed scheme follow the procedures outlined above.

8.2 Seed imported from out with the EEA

SASA requires the following information to be completed on form SDG 30 when seed is imported from a country that is not an EEA State in a package exceeding 2 kilograms:

species;

variety;

category;

country of production and official inspection authority;

country of despatch;

importer;

quantity of seed; and

it would be helpful if the Seed Lot Reference Number or other unique identification number is supplied for each lot imported.

The information is required annually to arrive not later than 30th November. Nil returns are required. The requirement applies only where seed is imported directly from a third country for first marketing in Scotland. Where third country seed is imported into another EEA state and then marketed for export into Scotland it is not necessary to provide SASA with the information.

9 IDENTIFICATION, LABELLING AND SEALING OF CLEANED PRE-BASIC, BASIC AND CERTIFIED SEED

Processors must ensure the full identification of all seed on their premises and under their responsibility.

SASA will supply fully printed Pre-basic labels upon receipt of a completed form SDG 9A. All other official labels are available through a contracted supplier. In addition, SASA will also supply fully printed “Breeders Confirmation” and OECD labels upon receipt of a completed form SDG 9A.

Construct the Seed Lot Reference Number for each seed lot (see Annex VIII) and ensure that it is correct. Print the Seed Lot Reference Number onto the appropriate official labels along with the all the other information required on the labels (see Annex VI).

Attach the labels to the bags and seal each bag in one of the ways described below.

Self adhesive labels used on paper or polypropylene (but not woven) sacks:

stick the label onto the top of the bag and stitch through once, no further sealing is required; or

stick the label onto the body of the bag, use a finger and thumb seal to seal the stitching.

Card or tear resistant labels used on paper, polypropylene or woven sacks:

stitch through once, no further sealing is required;

for card labels a second label must be placed in the bag before sealing.

Tear resistant labels with holes used on bags that are neck tied (e.g. ½ tonne bags)

attach the label to the neckties’ and seal with a finger and thumb seal; or

stitch through once, no further sealing is required; or

place labels into a plastic wallet on the side of the bag in such a way that the label will be damaged if any attempt is made to remove the label, and seal the neckties with a finger and thumb seal.

Numbered/Lettered Bags

If the top of the bag has numbers or letters on the bag and a single line of stiching through the numbers/letters self adhesive labels can be stuck onto the bag. In these cases no further sealing i.e. a Finger and Thumb seal is necessary.

Whole bag labels

Each container may have the label pre-printed on it. The label shall be the same colour and contain the same information as specified in Annex VI. Serial numbers approved by SASA must be printed or stamped on each label

Heat-sealed plastic sacks and certain valve packs require no further sealing.

For seed certified in large containers (e.g. Bins), the containers must be labelled and sealed so that the contents cannot be removed without breaking the seal. The use of any container type other than standard bags requires the prior approval of SASA.

If the seed lot is sampled before labelling and sealing, the sampler must label and seal the containers immediately after sampling or supervise the procedure.

NB EACH container in a seed lot must be properly sealed and labelled.

For further details consult the “Instructions to Seed Samplers” booklet issued by SASA.

For details of the information required on, and the use of, supplier’s labels for small packages and Breeders Seed see Annex VI. The provision of supplier’s labels is the processors responsibility.

9.1 Re-Labelling of Seed Lots

Under certain circumstances, e.g. downgrading of seed lots, it may be necessary to remove old labels and replace them with new ones. This process can only be carried out by, or under the supervision of, an Official/Licensed Sampler who will note all the information on the original labels and supervise their removal. Before the new labels are attached, they must be checked to see that all relevant information has been correctly recorded. In some situations, SASA may permit self-adhesive labels to be stuck over the original labels. In this situation a finger and thumb seal must be applied to each bag. Where whole bag labels have been used the seed must be re-bagged and the new Seed Lot Reference Number allocated. In all cases of re-labelling the month and year of sealing on the label must be changed to “Re-Sealed on (month and year of re-sealing)” together with the name of the Certifying Authority responsible for the resealing. Containers must be checked to see that they are adequately sealed and re-labelled. Records must be kept to account for all the official labels removed and these records must be made available to the Certifying Authority on request.

9.2 Re-Labelling of Imported Seed

The procedure is identical to that in the preceding paragraph but in addition the Official/Licensed Sampler is responsible for ensuring that the new labels are endorsed with the country of original production of the seed. Thus, for example, if the seed originated in Germany or Sweden the new labels must be endorsed "Country of Production Germany" or "Country of Production Sweden" respectively.

9.3 Re-Labelling of OECD Seed

The procedure is identical to that in paragraphs 9.1 & 9.2 but OECD labels must be used for re-labelling. SASA will supply pre-printed OECD labels for seed to be exported upon receipt of a fully completed form SDG 9A. If the seed lot is for domestic use OECD labels can be obtained from an officially contracted supplier.

10 SAMPLING OF CLEANED PRE-BASIC, BASIC AND CERTIFIED SEED

An official or licensed sampler may sample seed lots of any generation unless the Certifying Authority requires sampling to be carried out by an Official sampler.

Annex IV gives the maximum weight of seed lots and the minimum weight of samples.

The Certifying Authority may refuse to certify a seed lot when there is evidence that the seed lot was not sufficiently homogeneous or there is evidence that sampling was not carried out in the approved manner.

Seed lots for sampling must be presented in such a way as to permit sampling in the manner described in cereal seed regulations and the “Instructions to Seed Samplers” issued by the Certifying Authority.

NB The use of automatic samplers requires the prior approval of the Certifying Authority and an official or licensed sampler must supervise the operation of the automatic sampler.

Samples from Breeders, Pre-Basic, Basic, Certified or Certified 1st generation seed lots, used for crop production in that season must reach SASA by the appropriate closing date (see Annex III) unless by prior agreement. In all cases, the control plot must arrive in time for SASA to sow a control plot otherwise a Licensed Crop Inspection will not be permitted.

When any other tests are required the test requested (e.g., 3 Kg Wild Oat Search), must be stated on the form SDG 5 under “Additional Tests.”

In the event of a seed lot being re-sampled, the form SDG 5 should be marked “RE-SAMPLE” in the “Additional Tests” section.

11 MARKETING OF SEED

Marketing includes selling, offering for sale, holding with a view to sale, and any disposal, supply or transfer for the purpose of commercial exploitation of seed to third parties, whether or not for payment.

Trade in seed not aimed at commercial exploitation is not “marketing”. Examples of trade not aimed at commercial exploitation are:

supplying seed to official testing and inspection bodies; and

supplying seed to anyone for processing or packing provided that the recipient does notbecome the owner of the seed.

The above shall not apply to the marketing of seed, which has not yet been fully certified, if:

the seed is marketed for processing;

the identity of the seed is ensured; and

the seed has been harvested from a crop which has been found by an official field inspectionto satisfy the conditions specified in Annex I for the relevant category of seed.

11.1 Requirements of the Regulations

The “Regulations” require that any seed lot must be “Officially Certified” prior to marketing; the issue of an official certificate is dependent on:

application for registration of the crop (or crops) from which the seed lot is to be obtained (SDC 2);

satisfactory official examination of the crop(s);

application for sampling and testing of the seed (SDG 5);

satisfactory official examination of the seed sample (SDG 10);

application for an official certificate for the seed lot (SDG 7 or 8)

In addition, the certifying authority will refuse to issue, or withdraw, an official certificate:

if a control plot examination shows that the varietal identity and purity standards (see Annex I) have not been met;

or the seed sample has not been drawn correctly;

or there is evidence to show that the seed lot did not meet, or after certification no longer meets the standards (see Annex II);

or there has been any breach of seeds regulations in relation to the seed lot including breach of the licensed seed or crop inspector’s licence.

The certificate issued in respect of a seed lot is based on forms SDG 7 or 8 as appropriate.

However, the “Regulations” allow the marketing of seed before the actual issue of an official certificate in respect of any seed lot, subject to the following conditions:

application for the issue of an official certificate has been made (SDG 7 or 8);

the seed has met the appropriate field and seed standards;

the seed shall be deemed not to have been “officially certified” if after marketing it is subsequently discovered that the application would have been refused on the grounds that the standards specified (see Annexes I and II ) had not been met;

where seed is deemed not to have been “officially certified”, the seller of the seed shall inform the purchaser, not later than 7 days after being notified by the Certifying Authority of withdrawal of certification.

Sellers of seed should ensure that all the steps leading to and, including application for the issue of an official certificate for a seed lot have been taken, and that (except for germination in cases of early movement of seed) all the seed standards have been satisfied.

11.2 Early Movement of Seed

Marketing of a Seed Lot to the first buyer by way of trade before the completion of the official germination test is permitted, providing:

SASA has been presented with a seed test report (SDG 10) which shows that all the other seed standards (see Annex II) have been met (including that for loose smut if required);

SASA has been presented with a provisional germination report that shows that the seed meets at least the minimum germination standard (see Annex II). This test must be on a sample which represents as closely as possible the eventual seed lot and its tonnage;

SASA is notified in writing of the name and address of the first buyer by way of trade as soon as practicable after delivery and in any event not later than seven days after delivery;

the first buyer by way of trade is provided either before or at the time of delivery with;

- a written statement that the Seed Lot has been marketed before completion of the official germination test;

- the preliminary germination result;

the person marketing the seed must guarantee a minimum percentage of germination, which must be the percentage germination of the seed ascertained in the provisional germination report;

a separate additional suppliers’ label attached to each container in the seed lot states:

- the supplier’s name and address;- the Seed Lot Reference Number;

- that the seed is being sold before the official examination of the germination of that seed lot has been concluded; and

- the minimum percentage germination guaranteed by the person marketing the seed.

A person who sells any seed in accordance with procedures outlined above must keep records of all the transactions for two years after the date of delivery of the seed. The records must include the following information and must be made available to the Certifying Authority on request:

the date of such delivery of the seed lot; ,

the reference number of the seed lot or part of a seed lot delivered;

the name and address of the first buyer by way of trade;

the date on which the preliminary test of germination was carried out and of the result of that test; and

the date on which the first buyer by way of trade was informed of the result of the completed official germination test.

The “Early Movement” provision only applies to seed sold to the first buyer by way of trade. The first buyer by way of trade must be another seed merchant. Further marketing beyond the first buyer by way of trade, is prohibited, before the completion of the official germination test. The “Early Movement” provision applies to all seed sold in Scotland regardless of where the seed is entered for Certification.

If the result of the official germination test is below the standard, the applicant must inform the purchaser of the result (actual %) of test. Notification in writing must be as soon as practicable as and in any case not later than 7 days after the seller receives the information. The Certifying Authority will regard the seed lot as “not certified” if the result of the official germination test is below the standard. Unless it is possible to take a resample from the full seed lot and the official test shows that the seed meets the minimum germination standard, no further sales must take place. If the germination test result is below standard and marketing of the seed is to occur the applicant must declare the actual germination figure on a separate supplier’s label (see Annex VI) for Pre-Basic and Basic Seed lots.

11.3 Marketing of Seed in Bulk

The marketing of Certified Seed of the 1st and 2nd Generation seed in bulk is permitted as long as the marketing takes place directly to the “final user” i.e. the farmer. This does not apply to seed traded between merchants. The seller of the seed must be in receipt of the SDG 7 signed by the Certifying Authority.

the seed must be loaded directly into the container used by the final consumer e.g. farmer’s own trailer or similar;

the requirements regarding the sealing of packages, do not apply provided that the container is securely closed (but not necessarily sealed) at all times, especially after filling to ensure that no spillage of seed can occur;

the requirements regarding the labelling of packages, do not apply but the customer must be given, in writing, before or at the time of collection of the seed, all the information that would be given on the official label. If, in the case of 1st Generation seed, the seed is intended for crop production this statement is required for Crop Authentication;

sample each consignment after it is in the farmer’s container. Carry out sampling according to the requirements of the Cereal Seed Regulations by an official or licensed sampler;

send the 1kg sample to the Official Seed Testing Station for Scotland for testing. Send the sample in the usual way, and identify it with a notation saying: “SEED MARKETED IN BULK.” in the additional tests box of the SDG 5;

the sampler must keep records for each consignment marketed in bulk (e.g. Seed Lot Reference Number, variety, amount of seed marketed, date of marketing, name of farmer to whom sold etc).

The seller must notify the Certifying Authority by the 10th January each year the quantities of seed marketed in bulk between 1st January and 31st December of the previous year.

12 THE CERTIFICATION OF PRE-BASIC, BASIC AND CERTIFIED SEED

Make applications for certification of a seed lot, form SDG 7, to the Certifying Authority in whose area the seed is processed. (An applicant must be registered as a merchant and/or processor.) Submit each application or batch of applications at the same time that you send form SDG 5 to the appropriate sampler. Based on the application and a report (form SDG 10) from an Official or a Licensed Seed Testing Station the Certifying Authority will endorse the SDG 7 forms and return a copy to the applicant. Only, after endorsement of the form SDG 7, as “Officially Certified” by the Certifying Authority, will a seed lot be deemed Pre-Basic seed, Basic seed, Certified seed (rye and varieties of Hybrid wheat, barley and oats), Certified seed 1st generation, or Certified seed 2nd

generation.

NB Send the Application for Certification, form SDG 7 to the Certifying Authority before any marketing takes place if the early movement provision outlined in Section 10 is used to market seed.

Officially certified Pre-Basic seed, Basic seed, Certified seed and Certified seed 1st and 2nd

generation seed lots, which are held over for entry into the scheme or marketing in subsequent years, need not be re-sampled but records must be available to account fully for their use. At the time of sale, merchants must ensure that the seed lot meets the marketing standards.

Where a seed lot has been re-sampled a further SDG 7 must be completed and sent to the Certifying Authority with, “RE-SAMPLE” marked in the Original Seed Lot Reference box.

The seed will retain its original labels and Seed Lot Reference Number.

A seed lot, which has been, rejected (i.e. “not certified”) for certification for failing to satisfy the seed standards cannot be marketed. In the event of a seed lot being “early moved” and subsequently, it has failed to meet the germination standard the Certifying Authority will advise applicants of the procedure to be followed. A seed lot, which has been, rejected (i.e., “not certified”) for certification for failing to satisfy the seed standards and which is subsequently re-cleaned, should be treated as an entirely new seed lot. It must be re-labelled and given a new Seed Lot Reference Number and the procedure outlined above followed except that the original Seed Lot Reference Number should be stated in the Original Seed Lot Reference box on form SDG 7.

If a seed lot is sampled for official testing prior to the application of a chemical treatment, the applicant must inform the purchaser(s) of the seed lot in writing that the official test took place before the chemical treatment was applied to the seed. The Seed Lot Reference Number will not change at subsequent chemical treatments by any processor. In the case of seed treated against loose smut, see below.

Previously certified seed lots, which are subsequently treated against loose smut with an approved treatment (see Annexes I, II & V), require separate sampling if a plot is to be sown by SASA. Submit the SDG 5 and SDG 7 and endorse the SDG 5 “Plot Sample Only” in the “Additional Tests” section. If only part of a seed lot is treated, a new Seed Lot Reference Number must be allocated and the details of the lot submitted on the new form SDG 7, including the original Seed Lot Reference Number, and the treatment. If part of a lot is treated for loose smut and a plot sample is required, the treated portion constitutes a new seed lot, therefore a seed lot fee is payable.

Applications to certify produce from crops, which have failed to meet the loose smut standards (see Annex II), are allowed with the following provisos:

The application for sampling and testing (form SDG 5) should be endorsed “Embryo Test” in the “Additional Tests” section. All such official embryo tests must be conducted at an Official Seed Testing Station (OSTS) and a fee will be payable for each test. The OSTS will also carry out the official purity and germination test on Pre-Basic, Basic and Certified seed if required, but the entire official sample may be sent to a Licensed Seed Testing Station (LSTS) in the normal way and the required portion passed to the OSTS for embryo testing. In all other respects, follow the normal certification procedures.

Alternatively, treat, with an approved treatment, such produce to control loose smut, whether an embryo test has been carried out or not. The Certifying Authority must approve the control method used. Submit a sample, drawn by an official or licensed sampler, of the treated seed to the Certifying Authority. The Certifying Authority will then accept the seed lot for certification (see also Annexes I & II.).

When chemically treated seed which is either surplus to requirements or has been found to be sub-standard is disposed of, all official labels must be removed before the seed leaves the seller’s premises. Record the details of individual lots involved.

12.1 Tetrazolium test (STZ test)

The Regulations allow the use of a STZ test on all categories of cereals as an alternative to the full germination test. This will enable rapid marketing of the seed lot. Either the OSTS or a LSTS that have approval to carry out such tests can perform STZ tests.

The relationship between STZ and germination is very good; however, in some circumstances the TZ test will give an over-estimation. For example, the STZ test does not detect the effects on germination of:

chemicals; or seed-borne diseases.

In addition, in seed lots where drying damage is present the germination of such lots is invariably lower than that indicated by the test.

For these reasons, certification will not be permitted by STZ testing if:

heat damage is present; or the seed crop was treated with glyphosate.

Furthermore, STZ testing is only available for seed lots of wheat and oats that are to be sold untreated when a disease test demonstrates that the combined levels of Microdochium and/or Septoria are less than 10%. This does not apply to seed lots of Barley.

12.1.1 Reporting STZ Results (Wheat, Barley and Oats)

The result of a TZ test will be reported as a percentage of viable seeds and the number of seed tested must be reported. This is important because there are different pass percentages depending on the number of seeds tested. For example:

100 seeds tested: 93% and above viable = pass, otherwise fail.

200 seeds tested: 90% and above viable = pass, otherwise fail.

400 seeds tested: 85% viable and above = pass, otherwise fail.

12.1.2 Reporting STZ Results (Naked Oats)

100 seeds tested: 85% and above viable = pass, otherwise fail.

200 seeds tested: 82% and above viable = pass, otherwise fail.

400 seeds tested: 75% viable and above = pass, otherwise fail.

12.1.3 Reporting STZ Results (Triticale)

100 seeds tested: 88% and above viable = pass, otherwise fail.

200 seeds tested: 86% and above viable = pass, otherwise fail.

400 seeds tested: 80% viable and above = pass, otherwise fail.

It will be the responsibility of the applicant to ensure seed submitted for STZ meets the conditions for this test. Seed tested by STZ that is subsequently found not to have met testing criteria will be deemed not to have been certified. A germination test must be carried out if there is any doubt about whether a STZ test is applicable.

The results of a germination test will always take precedence over those of a STZ test and enforcement and certification control will be based on germination.

The “Early Movement” provision outlined in 10.1 above does not apply to seed lots, which are subject to a STZ test.

12.2 Moisture Content Testing

The Regulations set 17% as the maximum moisture content of cereals and will require moisture content tests to be carried out on all cereal seed lots entered for Certification. Either the OSTS or LSTSs can carry out moisture content tests. Seed treatments applied as aqueous suspensions have a significant affect on seed moisture content and processors should ensure that seed meets the moisture content standard after the application of such treatments and prior to processing.

When sampling a seed lot for certification purposes, the sampler should draw the moisture sample in such a way as to minimise exposure of the sample to the atmosphere. The sampler must submit moisture content samples using one of the following methods:   

Sample the seed lot in the usual way and submit the complete composite sample to the seed testing station in an airtight container. For samples tested at LSTSs the weight of the composite sample must be at least 2.25 kg; for samples to be tested at the OSTS the weight of the composite sample must be at least 1.25 kg;

Fill a moisture proof container by drawing it through the seed representing the composite sample prior to passing through the riffle/soil divider.  The moisture content sample must be a minimum of 100g and may need to be larger depending on the type of moisture meter the seed testing station is using. The sampler should check with the seed testing station before dispatch of the moisture sample. The container is then sealed and the remainder of the composite sample mixed and divided as detailed in the Regulations and the “Instructions to Seed Samplers” issued by SASA to give a submitted sample of at least 2kg, for LSTS, or 1kg, for the OSTS. Put the moisture sample inside the sample bag with the certification sample.  In this way, the seed for moisture content tests is isolated from the rest of the seed in the sample bag on which the other certification tests will be carried out. 

Submit the samples for testing as soon as possible. Seed testing stations must complete moisture content tests within 5 days of sampling of the seed lot or the test will be considered invalid and another moisture content sample will be required.

Use one of the following examples of containers for submitting moisture samples:

Re-sealable plastic bags;

Foil and polythene bags that can be heat-sealed;

Glass or polythene bottles with an airtight top.

The Certifying Authority must approve any other types of moisture proof container types.

13 BLENDING OF SEED

Seed of the same variety from lots previously “Officially Certified” or ”Not Certified” but have been harvested from seed crops, which have passed the relevant inspection, or a combination of the two may be blended. Where different categories or levels are blended, the blend will assume the category/level of the constituent with the lowest crop result. Remove and destroy the original labels When the blend has been made, a new Seed Lot Reference Number is required using the numerically lowest crop identity number (see Annex VII) and new labels must be attached. When the blend is ready for certification, follow the procedure for a single seed lot but use a form SDG 8 instead of form SDG 7.

When a blend consists of seed previously certified (or entered for certification) and seed not previously entered for certification, again use a form SDG 8.

14 PAYMENTS FOR CERTIFICATION

14.1 Seed Lot Fees

A fee for each separate seed lot is payable within one month of demand.

14.2 Crop Entry & Inspection Fees

The total area, rounded up to the nearest hectare, for initial and crop inspection is charged and payable within one month of demand. Fees are also payable for official re-inspections of seed crops.

14.3 Official Sampling & Label Printing Fees

Fees for Official sampling and Label printing (Pre-Basic, Provisional Certification, and OECD seed lots only) are also payable within one month of demand.

The Certifying Authority will supply a list of fees or you can find them on the SASA web site (http://www.sasa.gov.uk)

15 REPACKAGING AND SMALL PACKAGES

Processors or packers may repackage seed into containers of any size, if the requirements for sealing and labelling are met.

For Pre-Basic, Basic, and Certified seed in containers other than “small packages” (see Annex VI) carry out all packaging operations under the supervision of an official or licensed sampler. The sampler will note all the information on the original labels and supervise their removal. Attach new labels, and check that all the relevant information on the original labels is entered correctly on the new labels and then seal the containers or check that they are sealed if the label is used as a sealing device. Destroy the original labels. Samplers must keep adequate records to account for all the official labels destroyed and make these records available to the Certifying Authority on request.

For certified seed in small packages, (see Annex VII) an official, a licensed seed sampler, a seed merchant, a seed packer or a seed processor, must seal the package. A supplier’s label must be provided which has all the information required (see Annex VI) included on it. The relevant seed merchant, seed packer, seed processor, licensed or official seed sampler must keep adequate records to account for the use of all Certified Seed re-packaged into small packages, of all official labels removed from the containers and then destroyed, and of the weight and number of all “small packages” made up. The seed merchant, seed packer, seed processor, licensed or official seed sampler must make these records available to the Certifying Authority on request.

16 DOWNGRADING OF SEED LOTS

If a seed lot fails to meet the relevant standards, the Certifying Authority will endorse the SDG 7 with the eligible categories for that the seed lot.

The sampler will note all the information on the original labels and, where appropriate, supervise the removal of these labels. Attach new labels, showing the revised category and/or level, and check that all the relevant information on the original labels is added to the new labels and then seal the containers or check that they are sealed if the label is used as a sealing device. Destroy the original labels. Samplers must keep adequate records to account for all the official labels destroyed. Samplers must make these records available to the Certifying Authority on request.Where ‘whole-bag’ labels are used, the seed must be repackaged into new bags. Re-sampling is not required but a SDG 7 should be completed for each downgraded seed lot in the normal way except that the original Seed Lot Reference Number must also be entered on the form. The Certifying Authority will endorse and return the form

The downgrading of seed lots, which were originally, blends notified on form SDG 8 should be applied for on form SDG 8.The original labels must either be destroyed or, where adhesive labels have been used, new adhesive labels may be superimposed.

The Certifying Authority may compel an applicant to downgrade a part of a seed lot when evidence indicates that the part lot does not meet the standards.

Where a seed lot is downgraded from one category to another i.e. from 1 st Generation to 2nd

Generation a fee is payable.

17 MIXTURES

Mixing of Cereal seed after certification with other varieties or kinds of cereal seed is permitted provided that, the mixture is effective against the propagation of a harmful organism or with fodder plant seed. Other seed such as vegetable, oil and fibre plant, or beet may be included provided there is a proportion of fodder plant seed in the mixture.

The mixing and packaging operation must be carried out under the supervision of an official/ licensed sampler, who is responsible to the Certifying Authority for ensuring that the following procedures are adhered to:

the constituent lots meet the standards laid down in the appropriate Seeds Regulations;

the labels on the constituent lots in the mixture must be checked to ensure that they comply with the Seeds Regulations;

the mixing procedures must ensure that the mixture is as uniform as possible and there is no risk of contamination from lots not intended for inclusion;

the appropriate mixture labels must be applied (see Annex VI) and for variety mixtures the labels must be annotated “Passed for marketing in UK only”;

the bags, sacks, or other containers must be properly sealed;

where necessary, further relevant information must be forwarded to the purchaser (see Annex VI);

a record must be kept of the following for each lot:

- reference number of the mixture and brand name, if any;

- kinds and/or varieties of constituents;

- Seed Lot Reference Numbers of constituent lots;

- proportion by weight of each constituent;

- details of labels used;

- Seed Lot Reference Number; and

- total weight of mixture.

The packer must keep records in such a form that the declared constituents and the composition of each mixture are easily ascertained and this information, linked with the records of constituents in the possession of the firm when the mixture was made up.

NB. Where seed from non-EU countries is used, check the following:

that it comes from a country with whom the UK has an “equivalence” arrangement;

that it bears the appropriate OECD labels or, in certain cases, the official labels of

Certifying authority of that country;

The maximum weight of a lot is 30 tonnes or 40 tonnes for mixtures that include Maize.

18 RECORDS AND INSPECTION OF FIELDS, PLANT AND PREMISES

Seed merchants, seed processors and seed packers must keep adequate records to show the production and movement of the seed and the use of official labels, which must be produced to the Certifying Authority on request. The Certifying Authority may require access at all reasonable times to seed production fields, cleaning plants or other premises for purposes of inspection as set out in the RLE Regulations.

Annex XII specifies the circumstances under which this is permissible, and the procedures required in such cases.

20 PRODUCTION OF SEED ABROAD AND IMPORTED SEED

20.1 Production elsewhere in the European Community or EEA

Production in another EU Member or EEA State should be by arrangement with the Certifying Authority in the EU Member or EEA State concerned. Notify the Certifying Authority of any such arrangement before the despatch of any seed for multiplication.

20.2 Production outside the EU or EEA under the OECD Schemes

Persons wishing to multiply seed under the OECD Scheme in a country other than an EU Member or EEA State must obtain the approval of the Certifying Authority before the despatch of any seed for multiplication.

20.3 Production outside the EU or EEA other than under the OECD Scheme

For multiplication abroad aimed at producing seed for import into the UK, other than as outlined above, obtain prior approval from the Certifying Authority.

20.4 Seed Imported for Marketing in the UK

Subject to eligibility of the variety, seed certified within the EU or EEA may be marketed in the UK. In addition, marketing of seed certified in third countries with which the EU has an equivalence arrangement is permitted, providing that the labels state it meets EU Rules and standards.

20.5 Seed imported for multiplication

Submit a sample of seed imported for multiplication and enter the seed lot in the normal way. If a sample is not submitted, the Certifying Authority will only allow entry if the crop is Officially Inspected

20.6 Seed imported for blending

When seed is imported for inclusion in a blend, processors must attach one bag label from each imported constituent lot to the application for certification (form SDG 8).

20.7 As grown seed imported for marketing in the UK

For seed harvested in another EU Member or EEA State which has met field standards but has not yet been certified (has not been tested for seed standards) grey labels should be used to identify the seed. The labels must contain the following information:

authority responsible for field inspection and Member State or their initials;

species;

variety, in the case of varieties (inbred lines, hybrids), which are intended solely as components for hybrid varieties, the word "component" shall be added;

category;

in the case of hybrid varieties the word "hybrid";

An official document containing the following crop information must also accompany the seed:

authority issuing the document;

species;

variety;

category;

reference number of the seed used to sow the field and name of the country or countries which certified that seed;

field or lot reference number;

area cultivated for the production of the lot covered by the document;

quantity of seed harvested and number of packages;

number of generations after basic seed, in the case of certified seed;

attestation that the conditions to be satisfied by the crop from which the seed comes have been fulfilled;

where appropriate, results of a preliminary seed analysis.

It should be noted that seed grown in the UK that has met field standards but has not yet been finally certified may be exported to another EU Member or EEA State if labelled with official grey labels containing the information specified above and accompanied by form SDG 13 containing the information specified above.

22 PROCEDURES SUMMARY

22.1 Phase 1 – Crops (Applications for field inspection)

on a form SDC 1, enter the seed lot(s) used to or intended for use to sow the crop(s). The form must reach the Certifying Authority the appropriate closing dates (see Annex III);

details on form(s) SDC 2 of the crops to be field inspected must reach the Certifying Authority by the appropriate closing dates (see Annex III). Seed stocks specified on an SDC 2 must relate to all the crops on that form;

fees for field inspections are billed in arrears. Entered Area’s should be summarised on form SDG 2A, which must accompany the SDC 2 form(s). If licensed inspectors are to be used at field inspection, their details must be included on SDG 2A.

22.1.1 Crop Inspection

Officially Inspected Crops:

The certifying authority will notify applicants of proposed visits, and of the inspectors recommendations.

Officially Licensed Inspected Crops:

Applicants will make their own arrangements, but The Certifying Authority will supply report cards (SDC 3) pre-printed with the application details.

In either case, The Certifying Authority will issue applicants with a crop result for each entry giving the final decision on the crop, when other results are taken into consideration. Applicants must properly identify all crops and produce.

Pass a copy of the crop result to the purchaser if “as grown,” seed is sold

22.2 Phase 2 – Seed (Applications for seed lot certification)

produce from crops which have passed field inspection must be identified in storage, whether on merchants or growers premises;

produce from crops of the same variety may be bulked, but the Certifying Authority must be notified on form SDG 4A before bulking takes place;

after cleaning and treating, the produce, (untreated seed may be entered) is prepared for sampling. Individual seed lots must be of no more than 30 tonnes (maximum tolerance 31.5 tonnes);

for sampling of the seed lot, the applicant must complete form SDG 5. This form is the instruction to sample and the request for seed testing and incorporates the sample bag label. The sample (properly labelled) is sent to either an Official or a Licensed Seed Testing Station, which will report the results of testing to the Certifying Authority and the applicant;

The applicant must also complete form SDG 7, (application for certification of the seed lot) or SDG 8, (application for certification of a blended seed lot). This must be submitted to the

PART 2 – ANNEXES

23 ANNEX I - CONDITIONS RELATING TO A CROP

23.1 Seed Stocks

An application for registration of a seed lot to be used to produce the crop must have been made by the applicant to the Certifying Authority on form SDC 1. Submit the sample of the seed lot to the appropriate Certifying Authority by the appropriate closing dates (see Annex III).

23.2 Previous cropping

23.2.1 Wheat, barley, oats and triticale

The minimum previous cropping requirements are:

1.1.1.1 Pre-Basic and Basic Seed:

No other cereal species or other variety of the same species will have been grown in the preceding 2 years. If the same variety was grown in the previous 2 years, the crops must have been sown with Pre-Basic, Basic, or Certified seed of the 1st or 2nd Generation. Under certain circumstances on receipt of an application, the Certifying Authority may permit a catch crop to count as a previous crop.

1.1.1.2 Certified Seed, 1st Generation:

No other cereal species will have been grown preceding year; no other variety of the same species will have been grown in the 2 previous years. If the same variety was grown in the 2 previous Pre-Basic, Basic, or Certified seed of the 1st or 2nd Generation -Basic, Basic, Certified. 23.3 Isolation

In the case of a fence, this must be constructed using substantial posts and at least two strained wires, together with a clear separation of clean fallow ground or non-cereal crop. The fence must remain in place until after harvest. The acceptance of such a separation is at the discretion of the Certifying Authority.

23.3.2 Rye

The Certifying Authority recommends that:Crops of 2-row barley for the production of Pre-basic, Basic and Certified seed, first generation should be isolated by at least 50 metres from any crop of a 6-row barley variety and vice-versa. Similarly, the same distance should be used isolate 6-row seed crops of different varieties.A distance of at least 50 metres should isolate crops of wheat and barley from possible sources of infection from loose smut.

23.4 Crop Condition (all categories of seed)

The agronomic condition of the field and the state of development of the crop must be such that a check of varietal identity and varietal and species purity (where applicable) can be carried out. Crops must not be so underdeveloped, stunted, weedy, diseased, damaged, or lodged that adequate inspections cannot be undertaken.

Crops more than 33% lodged will be rejected at HVS, and at the minimum standard at least, 50% of the crop must be in an acceptable condition for inspection. In both cases, the distribution of the acceptable area must be such that random counts are feasible.

Identify the crops properly in the field.

# The varietal purity standard will be applied in the field and in control plots by means of a reject number (except Rye) appropriate to the standard and the populations of the crop or plot.

The Certifying Authority issue tables of reject numbers to crop inspectors. A crop, which does not meet the standard for which it was entered, will be rejected or may be downgraded to a lower level or category. For the purposes of certification, the Certifying Authority regard 2-row barley in 6-row, barley and vice-versa and intermedium barley in either as varietal impurities. The same applies for speltoids in wheat and fatuoids in oats.

23.6 Species Purity (HVS only) £

The species purity standards apply only in the field by means of a reject number appropriate to the population.

There are no standards for Triticale or at minimum standard.

23.7 Reject Numbers (except rye)

The reject number is the number of impurities AT WHICH THE CROP IS REJECTED at a given level. The reject number is based on a statistical calculation, because only a portion of the

crop is examined. Reject numbers provide a proper basis for the rejection of a crop or stock, which can be assumed to meet the standards unless the impurities are equal to or exceed the reject number. This does not mean, however, that the standards can be claimed for a certified seed lot but rather that there was no valid reason for rejecting it at the particular standard.

23.8 Loose Smut in wheat and barley $

The Certifying Authority will use control plots to establish infection levels in the sown seed stocks and entered crops. Produce from crops failing to meet the standards will not be considered for further certification unless:-

An embryo test carried out at an Official Seed Testing Station on the certification sample shows that the seed meets the standards specified. In these cases, the Certifying Authority will grant certification and marketing will be permissible. If the appropriate standards are not met, downgrading will be allowed subject to compliance with the lower category/level standards; or

The seed is treated using an approved treatment to control loose smut, whether or not an embryo test has been conducted. The sample of the treated seed, drawn by an official or licensed sampler, must be submitted to the Certifying Authority before the lot is accepted for certification. The Certifying Authority must approve any control method; details of treatments currently accepted by the Certifying Authority are available on request.

23.9 Other Weeds

There are no field standards for weeds other than wild oats. The inspector may, however, record on the SDC 3, and draw the attention of the grower or applicant to any weeds likely to affect the quality of the harvested seed.

23.10 Control Plots

In accepting or rejecting a crop, the Certifying Authority may take into account the results of control plot tests. If a control plot fails to meet the standards for post control, i.e. a 1st Generation seed lot fails to meet the varietal purity standards for 1st Generation the Certifying Authority will insist that an Official Inspection takes place at the applicants’ expense. This would not apply when a 1st Generation HVS seed lot fails at that grade but passes at the 1st Generation minimum standards.

23.11 Chemical Treatment of Seed Crops

Some chemicals used in crop husbandry, e.g. Plant growth regulators and some herbicides, may affect the appearance, certain morphological characteristics particularly ears and panicles, of cereal crops.

Such effects may create difficulties in field inspections and applicants should be aware that in some cases the assessment of varietal identity, and purity could be difficult to determine. If seed crops entered for field inspections are to be treated, the Certifying Authority advise applicants to ensure that all the manufacturers’ instructions are adhered to and that the entire area is evenly treated.

It is strongly advised that only formulations with Commercial Approval under the Regulations of the Food and Environment Protection Act, are used and then only for approved purposes.

24.3 VARIETAL IDENTITY AND PURITY

The seed must possess the identity of the variety and meet the varietal purity standards (see Annex I).

24.4 SEED HEALTH

The seed must be of a satisfactory state of health regarding the presence of seed-borne diseases and organisms affecting the seed are concerned.

24.5 WILD OATS – SEED IMPORTED INTO NORTHERN IRELAND

The Northern Ireland Cereal Seed Regulations specify that, importers of cereal seed must inform DARD within 3 days of any importation and are required to give details of the quantity, nature and location of the seed.

Oat seed may be moved into Northern Ireland if the seed lot is accompanied by an official seed test report, which shows that a 3 kg sample of the seed drawn in accordance with the Regulations has been examined and found free of wild oats;

The field standard in Northern Ireland of nil wild oats in the field does not apply in Great Britain for wheat, barley, triticale, and rye. An examination of a 3kg sample drawn in accordance with the Regulations of seed of these species must find the sample, to be free of wild oats. It must be accompanied by an official seed test report to this effect, unless a copy of a field inspection report showing freedom from wild oats is available, in which case the examination of a 1kg sample is acceptable;Contact address (see page 6)

26 ANNEX IV - MAXIMUM WEIGHT OF A LOT AND MINIMUM WEIGHT OF A SAMPLE

The maximum weight of a seed lot shall be 30 tonnes (maximum tolerance 31.5 tonnes) except maize, which is 40 tonnes (maximum tolerance 42 tonnes).

The minimum weight of a sample for testing at an Official Seed Testing Station shall be 1kg and for seed imported into Northern Ireland, it is 3kg (see Annex II). The minimum weight of a sample of Maize is 250 g for Basic Seed of inbred lines and 1 kg for Basic seed other than inbred lines and Certified seed.

Samples sent to a Licensed Seed Testing Station shall be twice the minimum weight specified above.

For the moisture test, the sample must be a minimum of 100g and may need to be larger depending on the type of moisture meter being used at the seed testing station. The sampler should check with the seed testing station before dispatch of the moisture sample

27 ANNEX V - TREATED SEED

Where parts of the produce of a crop are given different seed treatments before the seed is certified, each such part must be regarded as a separate seed lot requiring a separate Seed Lot Reference Number, and a separate sample and test.

A seed lot that is to be chemically treated but has not yet been so treated may be sampled for official testing. In the case of seed lots tested before treatment, the Seed Lot Reference Number will not change at subsequent chemical treatments by any processor. If re-sampling is required each part of the lot with a separate treatment must then be considered as a separate lot, and labelled, and sampled appropriately.

28 ANNEX VI - LABELS OR MARKING OF SEED CONTAINERS

28.1 Use of labels

Three types of official labels are available –

- self-adhesive;- tear resistant; and- card.

declared net or gross weight;

Affix a separate supplier’s label giving the following information for Pre-Basic or Basic seed that does not meet the statutory germination standard:

the Seed Lot Reference Number.

NB: if the seed is of a lower standard, under the terms of any General Licence that may be in force at the time, the labelling requirements of that General Licence must be met.

State the nature of the additive and the approximate ratio between the weight of pure seeds and the total weight if granular pesticides or other solid additives are used.

28.5 Labels for “As Grown” Seed for Export

This number can be read off by reference to the Crop Data Sheet (form SDC 2).

Applicant number 9999 enters 6 sheets of crops of cereals for the harvest in 2012. On the sixth sheet which is for Certified seed, 1st generation, and the top right hand corner of the form should look like this:-

NB If an applicant has entries with more than one Certifying Authority, it is essential that sheet numbers are not duplicated.

When seed crops of the same variety are being bulked, in accordance with the procedure explained in Section 7, the resulting bulk will assume the identity of the numerically lowest crop identity number. Enter this number as the first constituent crop on form SDG 4A.

30.2 SEED LOT REFERENCE NUMBER

The applicant for certification of a seed lot must construct this number and use it to identify the processed seed before and after marketing.

Construct the Seed Lot Reference Number as follows:

32.1 LICENSED CEREAL CROP INSPECTORS – SCOTLAND

The Seeds (Registration, Licensing and Enforcement) Regulations 2006, allow a licence to be granted by Scottish Ministers, to a person fulfilling stated conditions for the purpose of inspecting seed crops in accordance with the Cereal Seeds Regulations.

The license will allow inspectors to carry out inspections of seed crops to produce 1st and 2nd

generation seed crops of wheat, barley, oats, rye, and triticale. The license does not allow inspectors to carry out inspections of seed crops to produce Pre-Basic or Basic seed; officers of the Certifying Authorities will carry out these inspections.

To attain a license as crop inspectors, persons must meet the following conditions:

have attended a course of instruction in the theory and practice of crop inspection held by the Certifying Authority, and have satisfied the Certifying Authority as to their competence;

attend training and undergo examinations as the Certifying Authority may consider appropriate;

carry out their functions in accordance with instructions issued by the Certifying Authority;

maintain their expertise by regular crop inspections (this will normally involve not less than 5 crops a year – 35 hectares), and be subject to supervision of their duties by officers of the Certifying Authority;

not inspect more than the maximum as laid down by the Certifying Authority in the Instructions to Crop Inspectors.

Licensed crop inspectors will personally undertake the inspection of seed crops in accordance with the procedures prescribed in “The Instructions to Crop Inspectors” issued by the Certifying Authority and, if necessary, supervise the work of provisional licence holders. Crop inspectors with provisional licences will be limited to the inspection of certain categories of crops or to the inspection of certain categories only in the company of full licence holders.

Licensed crop inspectors will be responsible for the following functions:

ensuring that inspections are correctly carried out in accordance with the methods laid down in the certification procedures, and in the “Instructions to Crop Inspectors”;

for the completion and submission of reports on crop inspections to the Certifying Authority;

for keeping records of the crops inspected.

Issue of a full licence will cover a period of 3 years and a provisional licence 2 years. The licence may be withdrawn at any time if a licensed crop inspector fails to comply with the conditions of the licence or in the opinion of the Certifying Authority are no longer qualified or competent to perform the duties.

Renewal of a licence on expiry will require evidence of continued competence.

for the sampling, labelling and sealing of all seed lots which they are instructed to deal with by an applicant for certification of a lot, by the Certifying Authority or by the Official Seed Testing Station;

to the Certifying Authority for ensuring that representative samples are correctly drawn from any seed lot handled under UK Seed Certification Schemes;

for the despatch of samples to an Official Seed Testing Station or to a Licensed Seed Testing Station;

for keeping records of seed lots sampled, and of labels, seals and sample bags issued by the Certifying Authority and used by them;

for the proper maintenance of all sampling equipment used by them or in their charge; and

for any re-labelling and re-sealing of seed lots and for the opening of sealed containers when re-labelling and re-sealing may be necessary.

The sampler will carry out all sampling operations in accordance with approved methods and with the procedures prescribed in the Instructions to Samplers using the specified instruments and devices and the labels and seals issued by the Certifying Authority or, where appropriate, approved by the Authority.Issue of a licence will cover a period of 3 years It may be withdrawn at any time if a licensed seed sampler fails to comply with the conditions of the licence or is no longer qualified or competent to perform the duties.

33.1 Crop Entry

Initial fees are payable on crops entered for field inspection. These are charged on an area basis according to the Category of the entered crop (as stated on form(s) SDC 2). Fees for all official inspections are charged separately.

33.2 Seed Lots

Fees are payable on the entry of seed lots for certification. These are charged per lot according to the Category.

33.3 Sampling:

Where an official sampler is used a sampling fee is payable.

33.4 Labels

A fee for the issue and printing of official labels is payable.

All fees are payable within one month of demand.

Seed testing fees are payable separately, to the appropriate Official or Licensed Seed Testing Station.

The Certifying Authority will accept applications for the provisional certification of the seed of varieties, which have been entered for, but not accepted on, the National Lists of the UK or another Member State. The following conditions apply:

the UK Certifying Authorities will accept applications only from the breeder or maintainer who entered the variety for National Listing, or their UK agent;

the production must be under the control of the breeder or the maintainer, or their UK agent;

the seed produced will not be legally marketable if the variety is not eventually added to a National List or the EC Common Catalogue.

34.1 Seed Lot Applications

Only Pre-Basic and Basic seed may be the subject of an application for provisional certification.

A stock relationship diagram must accompany an application. This must relate to a stock, which has satisfactorily completed either its first year of DUS testing in the Member State for whose National List it has been entered or an equivalent period of testing in any other Member State.

The applicant must supply the Certifying Authority with the required official sample of the seed stock to be sown (including any imported seed) by the prescribed closing date*.

34.2 Labelling

Label “Provisionally certified seed” with official labels appropriate to its category with either the approved name of the candidate variety or, if it does not have one, the allocated National List number and breeder’s reference number.

The labels will be over-stamped “Provisionally Certified.”

The Certifying Authority will print and issue the labels upon receipt of an SDG 9A.

34.3 Crop Entries

Applications using provisionally certified seed lots can be accepted only if the seed is entered from one of the following categories:

Breeders, Pre-Basic and Basic seed.

The entry will normally be from one of these categories unless the seed was provisionally certified under a corresponding system in another Member State.

Entries can be accepted for the production of the following categories of seed only:

Wheat, barley, oats and triticale;

Pre-Basic, Basic, C1

Rye

Pre-Basic, Basic, Certified.

Crop entries must be made on form SDC 2 to the Certifying Authority and each batch of SDC 2s must be accompanied with a form SDG 2A.

The applicant must supply the Certifying Authority with a standard sample of the variety by the prescribed closing date*.

Officials of the Certifying Authority, must carry out the field inspections and the applicant is responsible for providing the Certifying Authority with a provisional description of the variety, *.

The crop must meet the minimum requirements for the category for which it has been entered.

34.4 Marketing of Provisionally Certified Seed

Until the candidate variety has been added to a National List or the EU Common Catalogue, the provisionally certified seed must remain under the control of the applicant and may in no circumstances be marketed.

*Applicants must bear in mind that provisional descriptions and official samples are not automatically provided by other Certifying Authorities; they should therefore allow for possible delays in obtaining them.
