CYBERSECURITYOur entire way of life fundamentally depends on the internet, and the cybersecurity issues that result challenge everyone. Yet there is arguably no issue more important today, but less understood, than cybersecurity. This presentation will focus on technology and cybersecurity trends from Silicon Valley to Washington. It will explore our role in cybersecurity both as individuals and attorneys, address the tension between convenience, security, and privacy, and highlight some of the unexpected ways we encounter cybersecurity. You will walk away with answers to your most pressing questions: What can you do to protect your data? Which threats are most pressing? How can you reduce the likelihood that you will be targeted?

SPEAKER: CAMILLE STEWARTis an attorney whose crosscutting perspective on complex technology, cyber and national security, and foreign policy issues has landed her in significant roles at leading government and private sector companies like the Department of Homeland Security and Google. Previously working on cybersecurity

and risk issues at Deloitte, Ms. Stewart currently focuses on mobile platform policy at Google. Ms. Stewart was also an Obama Administration appointee at the Department of Homeland Security, where she served as the Senior Policy Advisor for Cyber Infrastructure & Resilience Policy. Ms. Stewart is a New America Cyber Policy Fellow, Truman National Security Fellow, and Council on Foreign Relations Term Member. She is a 2018 New America Top 35 Black American National Security & Foreign Policy Next Generation Leader, the 2018 National Urban League Cyber Connoisseur Honoree, and 2016 Women in Technology Rising Star Awardee. EMERGING TECHNOLOGIES: LEGAL IMPLICATIONSTechnology is being created and deployed at an unprecedented rate of change, affecting each industry directly or indirectly. From automated vehicles, virtual reality, blockchain, Internet-of-Things, gene editing, wearables, and personalized medicine to nanotechnology, big data, and robotics – at no other time has humanity been faced with such tremendous technological and scientific change – and

the legal implications that go with it. Though some disagree on the rate of future growth, there is no indication that this all-encompassing time of exponential change is going to slow down anytime soon.

This presentation will explore the various technologies we contend with on the road, in the sky, and in our homes and offices and assess potential liabilities, lawsuits, evidence and defenses associated with many of the examples provided. The intent is to heighten awareness to skillfully navigate around obstacles we previously could have only imagined encountering in science fiction.

SPEAKER: YVONNE STEVENS is a Faculty Associate at Arizona State University’s Sandra Day O’Connor College of Law. Her teaching and research focus reflect her interest in emerging technologies from a legal and ethical perspective. She has published and spoken on a number of topics including

technology & employment, artificial intelligence, cybersecurity, bioethics, biotechnology, genetics and risk governance. Among other commitments and interests, Ms. Stevens is a member of the American Association for the Advancement of Science (AAAS), Chair of the Risk, Policy & Law Specialty Group, Society for Risk Analysis, a member of the American Society of Law, Medicine and Ethics, an ASU Law Legal Analytics Program fellow and a member of the Law & Technology Committee, Arizona Technology Council. Ms. Stevens received her LL.M. in Biotechnology and Genomics from ASU’s Sandra Day O’Connor College of Law in May 2013 and holds an LL.B. (J.D. equivalent) from the Schulich School of Law, Dalhousie University, Halifax, Nova Scotia.

LUNCH AND LEARN: THE PATH OF LITIGATION AND TORT REFORM IN COLORADO: HAS COLORADO LOST ITS WAY?In recent years, Colorado’s traditional status as a predictable, common-sense venue for litigation has been challenged by court decisions that expand liability beyond statutory intent. But changes adopted by the Legislature this spring are likely to shift our state’s business climate on perilous course much more rapidly. This program will address recent judicial rulings and statutory trends that are influencing Colorado’s litigation climate and tort reform efforts. The program will include an update on the 2019 Colorado legislative session.

SPEAKER: MARK HILLMAN served two terms in the Colorado State Senate (1999-2005), serving as Majority Leader (2003-04) and Minority Leader (2005), and was appointed State Treasurer (2005-06). Since 2009, he has served as executive director of the Colorado Civil Justice League, Colorado’s leading organization in the fight against lawsuit abuse. His writings have appeared in the Wall Street Journal, Denver Post, Colorado Politics and RealClearPolitics.com, as well as in numerous local community newspapers across Colorado.

SPEAKER: BRANDON HULL is the legislative director for CDLA and serves as a legislative analyst for several Colorado trade organizations. He is shareholder with Overturf McGath & Hull, P.C. Mr. Hull’s insurance defense practice includes construction defects, environmental law, products liability, legal malpractice, and employment

discrimination. His professional liability work includes the defense of architects and engineers and other design professionals. Mr. Hull is a trained mediator and holds a mediation certificate from the American Arbitration Association.

THE ATTORNEY DISCIPLINARY PROCESS IN COLORADOJudge William R. Lucero, the Presiding Disciplinary Judge, will be presenting an overview of Colorado attorney disciplinary proceedings. Judge Lucero’s presentation will provide an introduction to the Office of the Presiding Disciplinary Judge (PDJ) and an overview of the disciplinary hearing system, including pretrial and trial procedures for disciplinary hearings, the role of hearing boards, the issuance of disciplinary opinions, and appeals of disciplinary opinions. He will also discuss other types of proceedings that come before the PDJ, such as readmission and reinstatement proceedings. Following Judge Lucero’s presentation, Jessica Yates, Attorney Regulation Counsel, will discuss the intake process and then address hypothetical ethical dilemmas and issues that lawyers may face, discussing the ethical rules that

are implicated and how regulation counsel might address a request for investigation under those circumstances. A question and answer session will take place at the end of the presentation, time permitting.

SPEAKER: THE HONORABLE WILLIAM R. LUCERO received his J.D. in 1972 from the University of Denver. He served in the Denver District Attorney’s Office from 1972 to 1990 and the United States Attorney’s Office from 1990 to 2001, where he supervised the Complex Prosecution Unit and the Appellate Unit. He then returned to the Denver

District Attorney’s Office and served as Chief Trial Deputy until 2004, when the Colorado Supreme Court appointed him Presiding Disciplinary Judge. In 2002, Judge Lucero was inducted into the American College of Trial Lawyers. He is a past member of numerous committees handling professional responsibility matters, including the Colorado Supreme Court Grievance Committee, the Attorney Regulation Committee, and the Federal Committee on Conduct. He received the Colorado Hispanic Bar Association’s award for Outstanding Hispanic Lawyer of the Year in 1995.

SPEAKER: JESSICA YATES is Attorney Regulation Counsel for the Colorado Supreme Court. Ms. Yates oversees attorney admissions, attorney registration, mandatory continuing legal and judicial education, attorney discipline and diversion, regulation against the unauthorized practice of law, and inventory counsel matters. Prior

to her appointment by the Colorado Supreme Court, Ms. Yates was in private practice as a partner at Snell & Wilmer LLP, focusing on appeals and litigation. She clerked for the Honorable David M. Ebel of the U.S. Court of Appeals for the Tenth Circuit. She earned her J.D. from the University of Virginia School of Law in 2006. Moderated by James M. SPEAKER: TIMOTHY A. PRATT is the former General Counsel and Chief Administrative Officer at Boston Scientific and, before that, was a trial lawyer with a national practice at Shook, Hardy and Bacon. He has served as president of the Federation of Defense and Corporate Counsel and is currently president of Lawyers for Civil Justice.

Mr. Pratt has been selected as one of the Best Lawyers in America. Legal 500 named him to the “Corporate Counsel 100”, which identifies the most powerful corporate legal advisers in the United States. In 2016, he was honored by The Burton Awards as a “Legend in Law.” He is a frequent speaker on the future of law and lawyering.

JUDGES PANEL: ALL THINGS TRIAL…INCLUDING TECHNOLOGYChanges and advancements in our world impact how we, as civil defense attorneys, try cases. Technology is now available in nearly every courtroom and studies show that jurors increasingly expect attorneys to utilize that technology. The composition of jurors continues to be diverse, but almost all jury pools include “millennial” jurors, who seemingly have different expectations. LUNCH AND LEARN: COLORADO LAW UPDATELong-time member of CDLA and former Board member Jeffrey Ruebel will again, per his own description, “play the role of the ‘Little Boy who cried wolf’…and provide a survey of new developments in case law and statute in his own brand of alleged humor.”

SPEAKER: JEFFREY RUEBEL is a native of Brush, Colorado. After teaching special education for one year and high school level courses for two more years, he attended the University Of Colorado School Of Law. Mr. Ruebel has tried over 60 civil jury trials of 3-days or longer, and has handled innumerable bench trials, arbitrations and other adversarial

proceedings. Mr. Ruebel has been inducted into the American Board of Trial Advocates (ABOTA), is a member of the Association of Defense Trial Attorneys (ADTA), has served as President and Board member of the Colorado Defense Lawyers Association (CDLA), has edited its newsletter and acted as its legislative liaison for over 15 years, and heads up the CDLA Amicus Committee. He received the John Grund Lifetime Achievement Award and has twice been recognized as Lawyer of the Year by the Civil Justice League.

ARTIFICIAL INTELLIGENCE AND THE DEFENSE OF CIVIL ACTIONSArtificial intelligence has not yet taken control of humanity, but it may soon guide many aspects of our lives and our work. This discussion presents a high-level overview of what artificial intelligence is, how it affects the practice of law right now, and how it may transform the public perception of tortious culpability in the future. In addition, it identifies some of the AI tools available now to assist your practice. Finally, this presentation also seeks to challenge you to think about what it means for the theory of tort law when humans are no longer the only entities who the public believes are individually responsible for negligent actions.

SPEAKER: MATTHEW LINTON is Of Counsel at Ogletree Deakins. He advises clients on a broad range of workplace and environmental safety and health issues, artificial intelligence, machine learning, robotics, autonomous vehicles, employment matters, and government investigations throughout the nation. He routinely

handles the legal and crisis response to workplace accidents and fatalities and safety related whistleblower complaints with agencies such as OSHA, MSHA, and

many others. Mr. Linton’s knowledge and experience as a former U.S. government attorney help clients achieve the best possible outcomes when facing complex, high-profile agency enforcement actions.

CONSUMER PROTECTION LAW – HB 18-1128In 2018, the Colorado General Assembly passed one of the country’s strictest data privacy laws. HB18-1128, which went into effect in September 2018, contains detailed requirements regarding the protection and disposal of personal identifying information, and mandates the nation’s tightest deadline to notify affected persons when a breach occurs. The bill’s primary sponsor, Former State Representative Cole Wist, along with Alissa Gardenswartz, will provide context for why this bill was written, give an overview of how this new law applies to you and your clients, and provide insight into where data privacy law is going.

SPEAKER: COLE WIST is a fourth-generation Coloradan. He just completed two terms in the Colorado General Assembly, serving as the Assistant Minority Leader of the Colorado House of Representatives and a Commissioner on the Uniform Law Commission. Mr. Wist is also a 30-year defense attorney. His litigation practice emphasizes

representation of employers in labor and employment matters and workplace accident investigations. Mr. Wist has counseled and defended clients following some of the country’s highest profile occupational disasters. SPEAKER: ALISSA GARDENSWARTZ is a shareholder at Brownstein Hyatt Farber Schreck, LLP. Prior to joining Brownstein, Ms. Gardenswartz served as a deputy attorney general for consumer protection in the Colorado Attorney General’s office. She became the first to oversee antitrust cases, financial and charity fraud cases, and litigation related

to the master settlement agreement between tobacco manufacturers and the states. In 2015, she was appointed deputy attorney general for consumer protection and oversaw all of the consumer protection and antitrust enforcement activities as well as consumer education and outreach. She frequently testified before the Colorado General Assembly on consumer protection legislation and was one of the principal drafters of the new data protection and breach notification laws.

Judge Robert McGahey will be conducting two breakout sessions: “The Dos and Don’ts in a Courtroom” and “Arguing to the Court (Motions, Jury Instructions and Discovery Disputes).” Our own Jason Young, of Pearl Schneider Young, an experienced NITA instructor, will teach you “How to Take a ‘Useful’ Deposition.” Finally, join the larger group and hear from Tony Moore, of Childs McCune, on the “Evolution of the Millennial Jury.” Come ready to ask questions, share ideas, and get to know your peers.

HUB’S PUB Each year at the Annual Conference, CDLA holds a raffle and silent auction for “Hub’s Pub” in honor of Dan Hubbard, the former incoming president of CDLA, who suffered a cardiac incident while riding his bicycle home from work and passed away unexpectedly. The money raised through Hub’s Pub goes toward purchasing bicycles that are donated to the Children’s Hospital of Colorado and CASA (Court Appointed Special Advocates) for abused or neglected children.

Over the past 7 years, the Hub’s Pub raffle and silent auction has raised over $75,000 and donated over 248 Specialized and Trek bicycles and helmets to the Children’s Hospital of Colorado and CASA.

Hub’s Pub raffle and silent auction are not the only way to contribute. We understand that busy and hectic personal and business schedules do not allow all to attend the Conference and participate in the fundraising event. To help simplify community involvement, CDLA has created an easy and efficient way for firm and individual members to donate directly via a link on the CDLA website at codla.org.
