B. Recommend Approval to Amend FY 2011/12 – 2015/16 Transportation Improvement Program Two resolutions are presented for recommendation of approval. The first was signed by the MPO Chairman May 2 as an emergency TIP amendment. Although the resolution has been signed and transmitted to FDOT and the Federal Highway Administration, the TIP changes must still be ratified by the MPO committees and board. The emergency TIP amendment Resolution 2012-13 contains two items, both part of the Wekiva Parkway project: (1) an additional $1.6 million added to the preliminary engineering phase for

mitigation of the portion of SR 429 from Old McDonald Road to the Orange County line, this is the design-build segment through the Neighborhood Lake property to temporarily connect SR 46 to CR 435; and $253,000 for preliminary engineering for a new alignment of SR 46 from just east of Round Lake Road to the Orange County line; this will be a new connection to SR 429. Some background on the emergency TIP amendment, at the April 25 MPO Governing Board meeting, staff introduced a list provided by FDOT of time-critical additions to the FDOT Program that required MPO approval into the TIP in order to receive sign-off from Federal Highway Administration. FDOT requested the morning of the April 25 meeting for the MPO to add to Resolution 2012-11 four items pertaining to the Wekiva Parkway project and an item to construct a short segment of US 27 between Polk County line and US 192. The Governing Board approved the five additional items. Resolution 2012-11 is provided for committee acknowledgement. The second resolution requested for action is a new amendment. The resolution includes one item, $2.5 million for right-of-way acquisition for small portions of ROW along four corridors in Lake County: Wekiva Parkway, SR 50, SR 44 and US 441.

C. Transportation Management System Budget – FY 2012/13 Staff has drafted a new TMS budget for the period, October 1, 2012, through September 30, 2013. The budget is presented proactively to allow member local governments to plan through their budget processes to fund the prescribed amount for each jurisdiction. Staff has presented a budget that is reduced 10 percent from FY 2011/12 amounts. Additionally, the MPO continues to offer $40,000 in federal funds toward both counties’ traffic counts and crash data, with the stipulation that the MPO continues to directly manage those programs. Based on feedback from the TAC and the Governing Board, staff has also created an optional base rate that would include access to data and data services. Under the base rate amount, members would pay additionally for services including traffic study review, policy assistance and grantwriting. Local governments would need to respond by September to the MPO as to which option is preferred for FY 2012/13.

D. Transportation Management System Interlocal Agreement At the February meeting, staff presented a draft interlocal agreement to better define the services provided under the MPO’s Transportation Management System. The system has evolved into a consolidation of multiple databases including crash data, traffic counts, functional classification, roadway capacity, entitled and reserved trips, traffic impact study reviews, rezoning and comp plan amendment reviews and policy assistance. The draft agreement has been refined by legal counsel to reflect procedural requests made by the TAC last meeting. Staff requests the TAC provide feedback. When the TAC is comfortable with the draft document, staff requests action to recommend the final draft to the Governing Board for distribution to all partners.

IV. DISCUSSION ITEMS

A. Prioritization Process for the FY 2017/18 – 2034/35 List of Priority Projects

MPOs are required to adopt a List of Priority Projects (LOPP) by September of each year. For the Lake~Sumter MPO, the process begins in May with a review of the adopted LOPP. After discussion of needs throughout the two counties, and on the methods which the MPO shall use to rank projects, MPO staff will create a draft LOPP to be presented in June. The LOPP will come back before the MPO for final approval in August. At FDOT’s

request, the formatting of this year’s LOPP is being redesigned to eliminate, on many tables, the separation of projects by county. For example, Table 9, Enhancement Projects, will remain separated into two sub-tables due to the manner in which funding is allocated. The redesign is timely with MPO staff’s development of a web based, interactive LOPP. The interactive LOPP will facilitate intuitive access to current and historical information through its webmap services.

B. Proposed Amendments to Transportation 2035 , Wekiva Parkway Project

Staff has been requested by FDOT to process an amendment to the MPO’s long-range transportation plan, Transportation 2035. Before the board could amend the cost-feasible plan to show the means by which the various components of the Wekiva Parkway project are cost-feasible, the MPO Governing Board April 25 opened a public comment period to provide at least 45 days for comments on the amendments. The earliest the amendments would come back before the committees and the MPO for final approval is June. Timing of the resolution to amend will be dependent on the execution of the pending financing agreement between FDOT and the Orlando-Orange County Expressway Authority. A Memorandum of Understanding was signed by both parties. However, the actual financing agreement has yet to be executed. Once the agreement is finalized, staff will bring a final resolution for the plan amendment before the MPO. At this time, staff is presenting information supporting the plan amendment.

C. FY 2012/13 – 2016/17 Transportation Improvement Program The MPO’s draft five-year TIP is under review as part of a public comment period opened April 25. The draft document, along with variance report was presented in April and approved as a draft. The new TIP will come back before the MPO in June for final approval by resolution.

D. Urbanized Area Map – Transportation Management Area (TMA)

Staff will give an update on the results of the 2010 Census and the pending impacts on the MPO in terms of funding and in terms of the MPO’s potential status as a Transportation Management Area. Staff is working with federal agencies to fully document impacts to the MPO and each county regarding transportation and transit funding.

E. Changes to North Lake~Sumter Task Force Staff is in the process with the North Lake~Sumter Task Force of sunsetting the group and reconstituting members into new task forces focused on specific regional projects. The 470 Corridor is a focal point of economic development in need of an MPO-level focus by Wildwood, Leesburg, Sumter County and Lake County. For Northwest Lake County, the now-funded FDOT study of the US 27 Reliever through Lady Lake, Fruitland Park and Leesburg, along with pending construction along US 441/27 and the Gardenia Trail design, create a significant list of common projects warranting a reconstituted task force for Northwest Lake.

F. Legislative Update Staff will give an update on the results of the recent legislative session. A summary prepared by the Florida MPO Advisory Council is provided. Staff will be working much earlier this year to prepare for the 2013 Florida Legislative Session. This year, staff is performing outreach during the summer to build state delegate support for extending the referendum option for a transportation surtax to be extended to all counties with an MPO.

V. PROJECT UPDATES

A. 2 FDOT Studies - Wekiva Area and US 27 Reliever Staff will provide an update on the two studies now funded by FDOT to assist local planning efforts. The first is a network analysis in the sub-region pending construction of the Wekiva Parkway. The study would examine the impacts of a built-out Wekiva Parkway project. The second is the study of a potential four-lane boulevard from US 441/27 in Lady Lake to SR 44 in west Leesburg. The study would look at the Rolling Acres Road corridor in Lady Lake and how it might be connected through Fruitland Park to SR 44 to provide improved north-south local access as Buena Vista Boulevard and Morse Boulevard provide just west in The Villages.

B. Florida East Coast Industries Orlando-to-Miami Passenger Rail Service, All Aboard Florida An announcement was made recently by Florida East Coast Industries that the rail company is planning to commence, in 2014, passenger rail service between Orlando and Miami. FECI owns 200 miles of the 240-mile route. The gap in the route is between Orlando and Cocoa Beach. Discussions are underway with FDOT, Orlando Utilities Corporation and Orlando-Orange County Expressway Authority on potential corridors that could be purchased or leased to make the connection. VI. PRESENTATIONS

A. Candidate Resurfacing Projects Amir Asgarinik, FDOT District Transportation Systems Manager, will discuss the candidate resurfacing projects.

B. SR 19 PD&E Study Update David Cooke, FDOT, and Steve Ferrell, HDR, will give a brief informational update as they prepare for the alternatives meeting scheduled May 24 for the SR 19 Howey Bridge PD&E Study. They will discuss progress of the study and the alternatives evaluation.

FDOT REPORT was given by Vickie Wyche who gave an update on the Lake and Sumter projects. COUNTY REPORTS Scott Cottrell, Sumter County, updated the committee on some of the construction projects in the county. He said that the pavement management is full force. There are some preservation projects in the Village under way and they are developing next year’s program. OTHER AGENCY REPORT None MPO STAFF REPORT was given by T.J. Fish who gave an update of the committee with regards to the population impacts with 2010 census and the urban areas maps. The census is reporting that there are gaps in some of the urban areas in the MPO and thus not meeting the criteria for population thresholds in a transportation management area. TAC MEMBER REPORTS/COMMENTS Alisha Maraviglia, City of Tavares, said that they are at 60% design plans for the one-way pair. Jim Hitt, City of Clermont, said that the street scape downtown project contract was awarded. Dianne Kramer, City of Eustis, said that they have a brand new mixed-use two-story building in downtown with commercial space on the first floor and residential space on the second floor. She also said that the Chamber of Commerce is moving to the old Wells-Fargo building. PUBLIC COMMENTS None AGENDA UPDATE None CONSENT AGENDA

John Zielinski, FDOT, and Mansoor Khuwaja, HDR, shared with the committee the results of the I-75 System Access Management Report (SAMR) that FDOT has conducted over the last two years. The study identified improvements that can be made to better operation and safety conditions.

US 441 PD&E Update Mary McGehee, FDOT, and Tara Jones, CH2M Hill, presented the committee with an update on the US 441 Planning Development and Environment Study, which looks at the potential of widening the four-lane facility to six lanes from SR 44 to SR 46 in Mount Dora. Public meeting is scheduled for May 9th from 5:00 pm to 7:00 pm at the Mount Dora Community Building.

ACTION ITEMS A. Recommend Approval by Resolution to Amend the FY 2011/12 – 2015/16 Transportation

Improvement Program Mr. Fish led the discussion with modifications made to resolution regarding construction of the Mini-Town/Transportation safety training facility being removed and replaced with additional Safe Routes To Schools funding; MOTION was made by Scott Cottrell to recommend approval of the FY 2011/12 – 2015/16 Transportation Improvement Program as amended; seconded by Dianne Kramer -- motion passed fourteen to zero.

B. Recommend Approval of the Draft FY 2012/13 – 2016/17 Transportation Improvement Program and for the Governing Board to Open Public Review Period After a brief explanation; MOTION was made by Alisha Maraviglia to approve the Draft FY 2012/13 – 2016/17 TIP and to recommend to the Board to open for public review period; seconded by Frank Watanabe -- motion passed fourteen to zero.

Mr. Fish led the discussion; MOTION was made by Alisha Maraviglia to recommend to the Board the adoption of the FY 2012/13 – 2013/14 UPWP; seconded by Peter Brandt -- motion passed fourteen to zero.

DISCUSSION ITEMS A. Congestion Management Plan T.J. Fish explained the expectations for the CMP and the role the TAC will play in its

development. Signal synchronization efforts from Lake County to Sumter County to Marion County were also discussed.

B. Freight, Goods and Services Strategic Plan Study T.J. Fish and Pam Richmond gave a brief update on the activities completed to date

including the MPO role in the MetroPlan Orlando’s Freight Advisory Council.

PROJECT UPDATES A. Wekiva Parkway and Trail

T.J. Fish briefed the committee on the pending financing agreement between FDOT and Orlando-Orange County Expressway Authority that will change the means by which the projects can be included as cost-feasible in the MPO’s 2035 transportation plan.

B. Florida Central Railroad Track Upgrades and Replacement T.J. Fish explained that the draft contracts with local government partners have been

distributed and are being reviewed by the participating local governments. C. US 441 Corridor Alternatives Analysis

T.J. Fish explained that the passenger rail study will commence after the execution of funding agreements between local governments and FDOT.

D. SR 50 Corridor Alternatives Analysis T.J. Fish gave a brief update on the AA affecting the SR 50 Corridor, from the University

of Central Florida east of Orlando to Clermont in Lake County. E. US 192 Corridor Alternatives Analysis T.J. Fish gave a brief update on the AA along US 192 Corridor from Kissimmee to US 27

in the Four Corners area. F. Lake County Sector Plan and Wellness Way (Lake-Orange Partkway) T.J. Fish gave a brief overview on the progress of the planning process for the 15,000-

acre area south of Clermont. G. Groveland Economic Development Visioning T.J. Fish gave a brief update on the work with the City of Groveland, Lake County, and

the Regional Planning Council in developing a vision from Groveland emphasizing opportunities connected to transportation.

FY 2011/12-2015/16 TIP TO THE APPROPRIATE AGENCIES. 9

WHEREAS, the Lake~Sumter Metropolitan Planning Organization (MPO) is the duly 10

designated and constituted body responsible for carrying out the urban transportation planning and 11

programming process for the Lake-Sumter Planning Area; and 12

WHEREAS, Florida Statutes 339.175, 23 U.S.C. 134, and Title 49 U.S.C. require that the 13

MPO, as a condition to receiving federal capital or operating assistance, has a continuing, cooperative, 14

and comprehensive transportation planning process that results in plans and programs consistent with 15

the approved comprehensive plans of the units of local government within the MPO’s jurisdiction, and 16

with state and local planned growth and economic development patterns; and 17

WHEREAS, 23 C.F.R 450.324 provides that the Lake~Sumter MPO shall develop a 19

Transportation Improvement Program (TIP) for the metropolitan planning area, and 23 C.F.R. 450.326 20

allows an MPO to revise the TIP at any time under procedures agreed to by the cooperating parties and 21

consistent with 23 C.F.R. 450.326; and 22

WHEREAS, the FY 2011/12 - 2015/16 TIP was adopted by the MPO on June 22, 2011 based 24

on then-funded projects in the Florida Department of Transportation (FDOT) Five Year Work 25

Program; and 26

WHEREAS, the FY 2011/12 – 2015/16 TIP was amended by the MPO on August 24, 2011 to 28

transfer funding in FY 2011/12 in Preliminary Engineering for Gardenia Trail II and Gardenia Trail III 29

to a Project Development & Environmental study of the Wekiva Trail project, and to allocate funds for 30

two segments of the Wekiva Parkway Line and Grade projects; and 31

32

WHEREAS, the FY 2011/12 – 2015/16 TIP was amended by the MPO on September 29, 2011 33

to adjust funding in FY 2011/12 for the Leesburg/Wildwood Trail and several transit related projects in 34

Lake County and Sumter County; and to add, as an Appendix, Lake County’s FY 2011/12-2015/16 35

Transportation Construction Program and Sumter County’s FY 2011/12-2015/16 Capital Improvement 36

Plan; and 37

WHEREAS, the FY 2011/12 – 2015/16 TIP was amended by the MPO on December 7, 2011 39

to adjust funding in FY 2011/12 for Section 5307 capital fixed route grant to purchase buses for Lake 40

County; to allocate construction funding in FY 2014/15 for Donnelly Street Streetscape and Tremain 41

Street Greenway Access Road and Trail projects; to allocate additional resurfacing and lane 42

construction funds in FY 2011/12 for CR542W and C-48 roadway segments; to allocate additional 43

preliminary engineering funds in FY 2015/16 towards Lake Wekiva Trail project; and to allocate funds 44

in FY 2011/12 towards design of new realignment for CR 46A; and 45

WHEREAS, the FY 2011/12 – 2015/16 TIP was amended by the MPO on January 25, 2012 to 47

allocate funding for the installation of pavement markings in Lake County and Sumter County, for 48

signal crossing upgrades in Sumter County, and for a Green Mountain Scenic Byway Trailhead and 49

Overlook of Lake Apopka in Lake County; and 50

WHEREAS, the FY 2011/12 – 2015/16 TIP was amended by the MPO on April 25, 2012 to 52

allocate construction funds towards Canal Protection Program, Phase 52 of Florida’s Turnpike (SR 53

91); allocation of funds for construction of left turn lanes on Lake County CR 473; programmed funds 54

for two sidewalk projects within Lake County, Thomas Avenue and Orange Avenue; and allocation of 55

funds for rail safety project on Huey Street in Sumter County; funding for preliminary engineering of 56

four segments of and construction of one phase of the Wekiva Parkway project; and 57

WHEREAS, FDOT informed the MPO subsequent to the April 25, 2012 Governing Board 59

meeting that changes to the FDOT Work Program had occurred, thus necessitating a time-critical TIP 60

amendment in order to satisfy requirements of the Federal Highway Administration regarding the 61

FHWA’s issuance of a Finding of No Significant Impact for the Wekiva Parkway project; and 62

WHEREAS, the two changes to the FDOT Work Program that necessitated an emergency TIP 64

amendment signed by the MPO Chairman May 2 in order to maintain consistency between the two 65

programs are as follows: (1) addition of $1,620,000 to the preliminary engineering phase for 66

mitigation for a new SR 429 from Old McDonald Road to Orange County line (F.M No. 2382756) and 67

(2) funding in FY 2011/12 for preliminary engineering of SR 46 Realignment (F.M No. 2382754); and 68

WHEREAS, a total of $2,500,000 toward right-of-way acquisition in FY 2011/12 for Lake 70

County corridors including SR 50, SR 44, US 441 and Wekiva Parkway corridors. 71

NOW, THEREFORE, BE IT RESOLVED by the Lake~Sumter MPO that: 73

1. The FY 2011/12-2015/16 TIP is hereby amended to program a total of $2,500,000 toward 75

right-of-way acquisition in FY 2011/12 for Lake County Advanced ROW Acquisition 76

project (F.M. No. 4167241) within Lake County along the corridors of SR 50, SR 44, US 77

441 and Wekiva Parkway; and 78

2. The Chairman of the Lake~Sumter MPO is authorized to submit, and hereby submits, the 79

amended FY 2011/12 – 2015/16 TIP to the: 80

THE LAKE COUNTY BOARD OF COUNTY COMMISSIONERS, THE SUMTER COUNTY BOARD OF COUNTY COMMISSIONERS AND THE MUNICIPALITIES OF

ASTATULA, BUSHNELL, CLERMONT, COLEMAN, EUSTIS, FRUITLAND PARK, GROVELAND, HOWEY-IN-THE-HILLS, LADY LAKE, LEESBURG, MASCOTTE,

MINNEOLA, MONTVERDE, MOUNT DORA, TAVARES, UMATILLA, AND WILDWOOD FOR CREATION, FUNDING AND IMPLEMENTATION OF A MASTER

TRANSPORTATION MANAGEMENT SYSTEM PROGRAM

RECITALS

WHEREAS, the Lake-Sumter Metropolitan Planning Organization (MPO) was created through interlocal agreement between Lake County, Sumter County, and the 14 municipalities of Lake County and was approved by Gov. Jeb Bush on December 9, 2003; and

WHEREAS, the MPO is responsible for managing a continuing, cooperative, and comprehensive transportation planning process for the MPO Area of Lake and Sumter counties; and

WHEREAS, the MPO approved, and entered into, an Interlocal Agreement on November 28, 2007, with Lake County, Sumter County, and the municipalities of Astatula, Clermont, Eustis, Fruitland Park, Groveland, Howey-in-the-Hills, Lady Lake, Leesburg, Mascotte, Minneola, Montverde, Mount Dora, Tavares, Umatilla, and Wildwood for the creation, funding and implementation of a Master Transportation Concurrency Management System (TCMS) Program, said agreement recorded in the Official Records of Lake County on January 30, 2008, at O.R. Book 3575, Page 734, and recorded in the Official Records of Sumter County on February 8, 2008, at O.R. Book 1901, Page 727; and

WHEREAS, on September 23, 2009, the MPO approved Resolution 2009-23 to

add a safety program based on crash data to the TCMS, and to rename the TCMS the Lake~Sumter MPO Transportation Management System (TMS); and

WHEREAS, in FY 2010/11, the municipalities of Center Hill and Webster became

part of the TMS via Sumter County by virtue of an interlocal service boundary agreement between each city and the county, and in FY 2011/12, the municipalities of Bushnell and Coleman were invited to participate per a rate established by the MPO in the FY 2011/12 TMS Budget; and

WHEREAS, the MPO’s Technical Advisory Committee (TAC) has recommended,

and the MPO’s Governing Board agrees, that a new interlocal agreement to reconstitute the TMS is desired in order to define the specific data and services that the MPO will make available to the member cities and counties; and


WHEREAS, the 2011 Florida Legislature passed HB 7207, codified in Chapter 2011-139, Laws of Florida, which removed transportation concurrency as a statewide mandate from the Florida Statutes’ growth management laws, and which effectively made transportation concurrency optional for local governments; and

WHEREAS, nonetheless, transportation capacity management is a growth

management principle that ensures the necessary transportation facilities and services are available concurrent with the impacts of development and that proposed developments will not degrade a roadway below the adopted level of service standards; and

WHEREAS, despite the optional nature of transportation concurrency, safety

and security remains a state and federal emphasis, and one of the objectives in the creation of MPOs was to encourage and promote the safe and efficient management, operation and development of surface transportation systems; and

WHEREAS, the MPO’s maintenance of a crash data system in coordination with

member governments is in accordance with the objective to encourage and promote the safe and efficient management, operation and development of surface transportation systems; and

WHEREAS, the MPO is equipped with staff, consultants and sufficient expertise to provide services under the TMS that are valued by member local governments but that are not part of the state and federal requirements regarding tasks achieved through the use of state and federal funds; and

WHEREAS, because the MPO’s fiscal year begins on July 1st, and the fiscal year for the MPO’s member governments begins on October 1st, it is necessary to set up a timeframe within which member cities and counties will specify the services and data they wish to avail themselves of through the TMS managed by the MPO;

NOW, THEREFORE, IN CONSIDERATION of the mutual terms, understandings, conditions, and payment hereinafter set forth, and intending to be legally bound, the parties hereby agree as follows:

Article 1. Recitals 1.1 The foregoing recitals are true and correct and incorporated herein by reference.

Article 2. Purpose 2.1 The purpose of this Agreement is to define the Transportation Management

System and the process through which the TMS is implemented. The TMS is a centralized database of transportation information that all parties to the


agreement may utilize as part of individual transportation programs as prescribed within individual comprehensive plans and land development regulations. Each year, services provided as part of the TMS will be recommended by the TAC and approved by the MPO Governing Board. The types of services generally offered as part of the TMS include but are not limited to database management for crash data, traffic counts, functional classifications, roadway capacity, Level of Service (LOS) and encumbered or reserved trips, and services such as MPO review of traffic impact studies, rezonings and comprehensive plan amendments, policy formulation, grant writing and funding research.

Article 3. Procedure

3.1 On an annual basis, the MPO TAC shall review the list of and budget for TMS

services. The list of TMS services reviewed by TAC shall go to the MPO Governing Board for action on and inclusion in the MPO budget by March 31st of each year, starting in the year 2013. The MPO may amend its approved list of TMS services or TMS budget for the upcoming fiscal year between April 1st and September 30th, if termination by a member government or member governments makes it necessary for the MPO to revise its menu of services or the budget.

3.2 So that the centralized transportation capacity management system of the TMS will contain the most current information available, member local governments will provide to the MPO data on development applications, vested and existing development, traffic count information, legally vested trips, formally reserved trips and certificate of occupancy information. Updated information shall be delivered to the MPO under the terms of this Agreement on a quarterly basis at a minimum, and ideally on a monthly basis. Failure to provide said information in the required timeline will result in correspondence from the MPO to the local government requesting updated information.

3.3 Local governments may submit data from any applicant who is seeking a

development approval for a project, including the traffic impact analysis, the number of proposed residential units and amount of non-residential square footage by use in accordance with the latest edition of the Institute of Transportation Engineers (ITE) Trip Generation Manual.

3.4 Upon receipt of such data by the MPO, the following procedure shall be

implemented in order to provide the local government with the information required in a timely fashion:

1) Provided the data received is determined to be sufficient to issue a report

of findings, the MPO will evaluate the data based upon existing road capacity information - including adopted LOS, performance LOS, existing trips, reserved trips and vested trips - and submit a report of its findings within 15 calendar days of receipt of the request.

2) If the local government determines that additional information should be factored into the analysis, it may submit its comments for evaluation to


the MPO within 15 calendar days of the issuance of the MPO’s capacity report for that application.

3) The MPO will review additional information submitted by the local government and provide final comments within 15 calendar days of the submittal of new information.

4) If the impacted facility is a state or federal facility, the MPO shall consult with the Florida Department of Transportation (FDOT) on mitigation strategies pursuant to state and local laws. If no comments are received from FDOT within 30 days, the MPO will issue its report based upon existing data.

3.5 The MPO will not make development approval determinations or

recommendations based on transportation impacts on behalf of any local government. The MPO will issue a report of findings based on the data maintained by the MPO and the data submitted by the local government. The responsibility to make recommendations of approval or denial on development applications remains with the local government.

3.6 The MPO will, upon request, assist any member local government in assessing

needed changes to comprehensive plans, policies or land development regulations related to transportation capacity management or mitigation of transportation impacts. Such services will be provided based on the exercised option of each local government to participate in the TMS through either: (1) an all-inclusive rate that covers all data and related data services as well as specialized services outlined below or (2) a base rate that covers only all data and data related services, with additional specialized services to be provided on-demand at a rate per the MPO’s TMS fee structure.

3.7 Data and data related services - the following layers of data are available to local governments to be managed by the MPO subject to annual budget approval:

1) crash data – basis for safety program and data for CTST 2) traffic counts – mgmt. of county counts and integration with FDOT counts 3) functional classification – additional database component 4) roadway capacity – additional database component 5) Level of Service – LOS policies 6) entitled and reserved trips – component of congestion mgmt.

(concurrency) 3.8 Services - the following services are available to local governments to be

managed by the MPO subject to annual budget approval: 1) traffic impact study reviews 2) rezoning and comp plan amendment reviews (does not include DRI

review) 3) policy development assistance 4) site-specific consultation on planning, land use, community design issues 5) multi-modal mobility policies


6) assistance with FDOT on access permitting, driveway connections, cure plans and local access management

7) grant writing 8) Local Agency Program (LAP) assistance 9) assistance with prop (fair) share agreements and public private

partnerships 10) funding research

Article 4. Term

4.1 This Agreement shall become effective upon execution by the last party. The

executed agreement shall be recorded in Sumter County and in Lake County with MPO paying the recording costs.

4.2 This Agreement shall remain in effect until terminated by the parties to this

Agreement, or as otherwise provided by law. Any party may withdraw from this Agreement, without penalty, between April 1st and September 30th of each year, by providing written notice of intent to withdraw to all of the other parties of this Agreement; however, all member governments that anticipate that they will not include TMS services from the MPO in their budget are encouraged and requested to provide unofficial notice of the same to MPO at the earliest possible opportunity. After September 30th of any year in which the Agreement is in effect, a party that wishes to terminate shall provide ninety (90) days notice prior to termination, and shall make all payments up to and including the date of termination. The withdrawing party and the remaining parties shall execute a memorandum reflecting the legal withdrawal of the party and the alteration of list of parties that are signatories to this Agreement.

4.3 Upon termination of the Agreement by a member government, the member government may request and receive database output of TMS data, current at the time of termination, particular to their jurisdiction.

Article 5. Funding

5.1 The menu of and budget for TMS services presented to TAC and to the MPO

Governing Board for approval each year shall include two (2) options for member government participation and funding of the TMS: 1) an all-inclusive rate, which shall allow the member government to avail itself of any TMS service offered by the MPO at no additional charge; or 2) a base rate for the member government to remain a part of the TMS program, with specific services to be provided to the member government upon request and at an hourly rate. A fee structure prescribing hourly rate shall be reviewed annually and approved prior to October 1st. All member governments shall elect one of the two options described herein, and shall pay either the all-inclusive or the base rate to MPO by October 1st of each year. Member governments selecting option two (2) above shall remit payment to MPO for requested services charged at an hourly rate within thirty (30) days of receipt of an invoice from the MPO.


5.3 Should population be a basis for determining annual local contributions to the TMS, in each odd numbered year, the population figures and related contributions will be reviewed and adjusted as necessary for population changes. Funding contributions will be adjusted based upon Bureau of Economic and Business Research (BEBR) population figures. The best available information will be provided to each local government via presentation of the new TMS budget by the MPO. The new contribution rates shall become effective October 1 of each year.

Article 6. Annual Report

6.1 An Annual Report on the status of all facilities included in the TMS shall be

published each year and may be used in the MPO annual project prioritization process. The report will focus on the performance of facilities and the safety of facilities.

Article 7. General Provisions

7.1 This Agreement, and any amendments hereto, may be simultaneously executed

in several counterparts, each of which is executed shall be an original, and such counterparts together shall constitute one and the same instrument. 7.2 Amendments or modifications to this Agreement may only be made by written

agreement signed by all parties hereto, with the same formalities as the original agreement.

A RESOLUTION OF THE LAKE~SUMTER METROPOLITAN PLANNING

ORGANIZATION (MPO), AMENDING TRANSPORTATION 2035, THE MPOs LONG RANGE TRANSPORATION PLAN, IN ACKNOWLEDGEMENT OF AN AGREEMENT

BETWEEN THE FLORIDA DEPARTMENT OF TRANSPORTATION (FDOT), FLORIDA’S TURNPIKE ENTERPRISE (FTE), AND THE ORLANDO ORANGE COUNTY EXPRESSWAY AUTHORITY (OOCEA) TO SHARE THE COSTS TO

FULLY FUND THE WEKIVA PARKWAY PROJECT; REVISE THE COST FEASIBLE PLAN IN TRANSPORTATION 2035 TO SHOW THE NEW FUNDING PLAN FOR THE

WEKIVA PARKWAY PROJECT BY: ADDING THE PORTIONS FDOT HAS COMMITTED TO FUNDING TO THE STATE STRATEGIC INTERMODAL SYSTEM SECTION OF TABLE 5 AND UPDATING THE OOCEA LIST OF FUNDED PROJECTS

RELATED TO THE WEKIVA PARKWAY PROJECT; INCLUDING THE NEW PROJECT COSTS IN YEAR OF EXPENDITURE DOLLAR AMOUNTS; AND

AUTHORIZING TRANSMITTAL TO THE FLORIDA DEPARTMENT OF TRANSPORTATION AND THE FEDERAL HIGHWAY ADMINISTRATION

WHEREAS, the Lake~Sumter Metropolitan Planning Organization (MPO) is the duly

designated and constituted body responsible for carrying out the urban transportation planning

and programming process for Lake-Sumter Planning Area; and

WHEREAS, 23 CFR Section 450.322(a) and Florida Statute 339.175(6) require each

Metropolitan Planning Organization to develop and approve a Long Range Transportation Plan,

addressing at least a twenty-year planning horizon, at least every five years; and

WHEREAS, TRANSPORATION 2035, the MPOs long range transportation plan, was

adopted on December 8, 2010; and

WHEREAS, Transportation 2035 was prepared in accordance with Chapter 4 of the

Florida Department of Transportation MPO Program Management Handbook; and

WHEREAS, the plan must identify project priorities that can likely be funder over the

next 25 years given available revenues; and

WHEREAS, the Wekiva Parkway is a regionally significant project that includes the

construction of 25 centerline miles of new toll expressway through Lake County, Orange

County, and Seminole County; and

WHEREAS, the Wekiva Parkway project includes seven miles of 4-lane and 6-lane

portions of SR 46 in Lake County, reconstruction of the US 441/SR 46 interchange in Mount

Dora, and relocation of CR 46A to provide improved wildlife connectivity and additional local

road system benefits; and


WHEREAS, the Orlando-Orange County Expressway Authority (OOCEA) had planned

to fund, operate, and maintain the Wekiva Parkway at the time TRANSPORTATION 2035 was

adopted; and

WHEREAS, since that time, OOCEA has developed a funding plan and entered into an

agreement with the Florida Department of Transportation (FDOT) and Florida’s Turnpike

Enterprise (FTE) to fund the Wekiva Parkway project; and

WHEREAS, FDOT and FTE will fund the 6-laning of SR 46 from East of Pond Road to

East of Round Lake Road, also known as Segment 3A for the sum of $11 million; and

WHEREAS, FDOT and FTE will fund the reconstruction of the US 441/SR 46

interchange, including a southbound to westbound flyover ramp and 6-laning SR 46 from west

of US 441 to east of Pond Road, also known as Segment 3B for the sum of $32 million; and

WHEREAS, FDOT and FTE will fund construction for the tolled segment of the

Wekiva Parkway from the Orange County Line to west of Old McDonald Road, also known as

Segment 4B for the sum of $52 million; and

WHEREAS, FDOT and FTE will fund the CR 46A realignment from SR 46 to north of

Arundel Way, also known as Segment 5 for the sum of $10 million; and

WHEREAS, FDOT and FTE will fund construction for the tolled segment of the

Wekiva Parkway from west of Old McDonald Road to east of Wekiva River Road, also known

as Segment 6 for the sum of $198 million; and

WHEREAS, OOCEA will fund construction for the tolled segment of the Wekiva

Parkway from the Orange County Line to Round Lake Road, also known as Segment 2C for the

sum of $14 million and

WHEREAS, the FDOT has requested that TRANSPORATION 2035 cost feasible plan be

amended to document the new funding plan for the Wekiva Parkway project so the funding can

be programmed in the FDOT Work Program.

NOW, THEREFORE, BE IT RESOLVED by the Lake~Sumter MPO that:

1. The TRANSPORTATION 2035 cost feasible plan is hereby amended to

incorporate the new funding plan for the Wekiva Parkway project; and

2. The Chairman of the MPO is hereby authorized and directed to transmit the

TRANSPORTATION 2035 amendment to the Florida Department of

Transportation and the Federal Highway Administration.

CONSTRUCTION IN PROGRESS 238394-2 US 441 from Perkins Street to North of Griffin Road This project consists of realignment and intersection improvements to US 441 (SR 500) and US 27. Construction will widen US 441 (SR 500) to six lanes from Perkins Street to Griffin Road. Water mains will also be installed from Lee Street to Griffin Road. Estimated completion: June 2012 (91%) LANE CLOSURES:

238395-4 US 441 from Martin Luther King Blvd. to Lake Ella Road This project 6 lanes SR 500/US 441 from Martin Luther King Blvd. (SR 460) to Lake Ella Rd. This project is now under construction. Estimated completion: July 2013 (34%) Lane Closures:

238429-3 SR 50 and US 27 Interchange This project consists of the widening and reconstruction of SR 50 and SR 25 (US 27) from four lanes to six lanes and includes the addition of sidewalks, bike lanes and drainage improvements. The existing interchange bridges will be replaced with this project. Estimated completion: September 2013 (27%) LANE CLOSURES: 4/29/12 – 5/3/12; 8 pm-7 am SR 50 EB and WB closed at US 27 a detour is n place with assistance.

424881-1 SR 19 from CR 452 to North of Golden Gem Drive Project consists of pavement milling and resurfacing of the northbound lanes of SR 19 from CR 452 to North of Golden Gem Drive. Estimated completion date: July 2012 (28%) Lane Closures: 4/30/12 – 5/3/12; SR 19 NB lane closures 427577-1 SR 40 Bridge #110077 Deck replacement. Estimate completion date: June 2012 (30%)

Other Projects Pending

1. US 441 - Widening to six lanes along 4.1 miles from Lake Ella Road to Avenida Central South (FM No. 2383955). About $16 million in right of way is funded through FY 10/11. Design for six-laning of the 1.9 miles from Perkins Street to SR 44 is in progress, with $25 million in right of way funded through FY 12/13 (FM No. 2383943).

2. US 441 - Construct north and southbound turn lanes at CR 466 intersection (FM No. 430189). This is a privately funded project. Bids are to be received in FY 13/14. The estimated cost is $500,000.

3. US 441 - An environmental study into possible widening along 1.6 miles from SR 44 (old CR 44B) to Lincoln Avenue in Mt. Dora is planned for FY 13/14 (FM No. 429356). PD&E underway

4. US 27 - Six-laning 6.5 miles from Boggy Marsh Road to Lake Louisa Road (FM No. 238422). Design has been completed and right of way acquired. Construction is not yet funded.

5. SR 44 - Resurface 2.3 miles from the Sumter County line to SR 44/CR 468 (FM No. 427230). Bids are to be received in FY 12/13. The estimated cost is $4.5 million.

to be acquired in FY 11/12.

8. SR 46 - An environmental study is being conducted by the Orlando-Orange County Expressway Authority along the 16.5 miles from US 441 to Orange Blvd. in Seminole County (FM No. 238275) in conjunction with their study of a potential Wekiva Parkway.

9. SR 19 - Resurface 1.9 miles from Summit Chase Villas to SR 19/US 441 (FM No. 427246). Bids are to be received in FY 12/13. The estimated cost is $2.5 million.

10. SR 19 - An environmental study into possible widening along the 4.7 miles from CR 48 to CR 561 is planned for FY 10/11 (FM No. 238319). Design of improvements is funded in FY 13/14.

11. SR 33 - Construct left turn lane at CR 474 (FM No. 423096). Bids are to be received in FY 13/14. The estimated cost is $660,000.

12. CR 450 - $2.3 million in grants to Lake County through FY 12/13 is to pay for design and construction of paved shoulders from the Marion County line to Lake Yale Road (FM No. 427480).

13. Washington Street Sidewalk - A $370,000 grant to the City of Eustis in FY 10/11 is to pay for a sidewalk from Fahnstock Street to Abrams Road (FM No. 423385).

14. Rolling Acres Road Sidewalk - $830,000 in grants to the city of Lady Lake through FY 12/13 is to pay for design and construction of a sidewalk from Vista San Polo to Griffin Road (FM No. 427855).

15. South Lake Trail - $2.7 million in grants to Lake County through FY 12/13 are to pay for design and construction of Section I of this trail from the existing Clermont Trail to Groveland Park in downtown Groveland (FM No. 422570).

16. Leesburg/Wildwood Trail - A $2.1 million grant to the City of Leesburg in FY 11/12 is to pay for construction of this trail from the Sumter County line to US 441 (FM No. 424444).

17. Lincoln Avenue Sidewalk - A $490,000 grant to Lake County in FY 13/14 is to pay for construction of a ten foot sidewalk from Tremain Street to Unser Street (FM No. 429594).

18. CR 561 - $1.1 million in grants to Lake County through FY 13/14 is to pay for construction of a roundabout at the CR 455 intersection (FM No. 429606).

19. Citrus Tower Blvd. - A $200,000 grant to Lake County in FY 10/11 is to pay for installation of a traffic signal at Oakley Seaver Drive (FM No. 427481).

20. Lake Center Drive - A $133,000 grant to the City of Mt. Dora in FY 10/11 is to pay for a sidewalk from north of Lake Center Drive to west of Eudora Road (FM No. 423458).

21. CR 470 - A $4 million grant to Lake County in FY 13/14 is to pay half the cost of replacing the bridge over Florida’s Turnpike (FM No. 430238). This is a County Incentive Grant Program project.

22. CR 466A - A $6.9 million grant to Lake County if FY 12/13 is to pay half the estimated right of way costs for widening along the three miles from the Sumter County line to US 27 (FM No. 430253). This is a Transportation Regional Incentive Program (T.R.I.P.) project.

CONSTRUCTION IN PROGRESS

1. CR 311 (I-75 Frontage Road) - Replace bridge over Jumper Creek (FM No. 242118). The estimated cost is $1 million. Estimated completion date: June 2012 (27%) No lane closures anticipated

2. SR 50 - Resurface 4.2 miles from the Hernando County line to SR 471 (FM No. 424884). The estimated cost is $1.8 million. Estimated completion: June 2012 (63%)

NEAR FUTURE CONSTRUCTION

1. SR 50 - Remove bridge over abandoned railroad west of Mascotte (FM No. 424524). Work to estimate begin date May 2012. The estimated cost is $2.6 million.

Other Projects Pending

1. I-75 – Six-laning along the 21.5 miles from the Hernando County line to Florida’s Turnpike (FM No. 242626). Design is in progress, with right of way acquisition funded through FY 13/14 (FM No. 2426262/3).

2. I-75 - Resurface 14.4 miles from the Hernando County line to the Panasofkee Creek Bridge (FM No. 427375). Bids are to be received in FY 12/13. The estimated cost is $16 million.

3. US 441/27 - A study has been conducted to determine the expansion needs along the 12.1 miles from Griffin Road in Lake County to CR 42 in Marion County (FM No. 2383951/2/3). Design in Sumter and Marion Counties is funded in FY 12/13 (FM No. 2383957).

4. SR 48 - Widening to four lanes along the 1.6 miles from I-75 to Main Street (CR 475) (FM No. 2404182). Right of way is to be purchased in FY 11/12. Bids are to be received in FY 15/16. The estimated cost is $20 million.

5. SR 48 - Construct westbound right turn lane at CR 475 intersection (FM No. 2404183). Bids are to be received in FY 12/13. The estimated cost is $200,000.

6. SR 48 - Resurface 1.9 miles from east of I-75 to west of SR 35 (Noble Avenue)(FM No. 427241). Bids are to be received in FY 12/13. The estimated cost is $1.2 million.

7. US 301/SR 44 Intersection - Construct north and southbound turn lanes (FM No. 430188). This is a privately funded project. Bids are to be received in FY 13/14. The estimated cost is $130,000.

8. US 301 - An environmental study into the possible widening from two to four lanes along the 15.5 miles from CR 48 to SR 44 is planned for FY 13/14 (FM No. 430132/430133).

9. CR 469 - A $2.8 million grant to Sumter County in FY 11/12 is to pay for resurfacing along the 13 miles from CR 48 to SR 50 (FM No. 429759).

10. CR 466W - A $1.6 million grant to Sumter County in FY 11/12 is to pay for resurfacing along the 3.5 miles from CR 209 to CR 475 (FM No. 429758).

11. CR 466 - A $1.6 million grant to Sumter County in FY 14/15 is to pay for resurfacing along the 4.5 miles from US 301 to just east of CR 475 (FM No. 428443).

12. CR 466/US 301 Intersection - Construct north and southbound turn lanes (FM No. 430187). This is a privately funded project. Bids are to be received in FY 13/14. The estimated cost is $180,000.

13. CR 475 - A $2 million grant to Sumter County in FY 14/15 will pay for construction of paved shoulders and resurfacing along the 3.7 miles from CR 470 to CR 542, including replacement of the timber column bridge at Juniper Creek with concrete box culverts (FM No. 429944).
