GENERAL CONDITIONS OF SALE
DEFINITIONS
In the content of these General Terms and Conditions of sale ("G T& C"), terms in capital letters refer to the
following meanings:
« AIDC »: Refers to the Company in simplified terms: Aéroport International du Castellet
« Airport »: Refers strictly to the runway, the terminal building as well as all other infrastructure necessary for
its use/ operations
« The Customer»: Refers to the customers of AIDC
« Parties »: Refers to both The AIDC and the Customer and individually AIDC or the Customer
« Services »: Refers to all services provided by AIDC
« MTOW»: Refers to Maximum Take-Off Weight this value is used for invoicing and rounded up to the next ton.
« TAG »: Refers to Touch and Go of the plane without stopping on the runway.
APPLICABLE FIELDS
The shareholder company ("AIDC") with a capital of 2,500,000 euros, head office is located at 3100 Route des
Hauts du Camp - 83330 Le Castellet - France, registered in the trade and commercial register companies of
Toulon under the number 479 467 193 ,
AIDC provides different products and services to its customers and users and therefore all services or products
are subject to these G T & C which will prevail over other documentation, except in the presence of a valid
contract. All requests and / or use of services are subject to GT&C. Failure to decline these GT&C, the customer
will be held liable. AIDC reserves the right to modify and change the GT&C without prior notice from AIDC by
stating the current GT&C in place. These later, include GT&C all tariffs, current text as well as annexes. No special
condition will prevail over the GT&C except when made in writing on our part. When the customer confirms
handling request he is therefore legally bound and waves his right to dispute the current GT&C of sale
Whereas AIDC has not required the application of a right and / or any clause of the GT&C, whether permanently
or temporarily, cannot in any case be considered as a waiver of this right or clause.

PRICES / FEES
All prices are in Euros without taxes and excluding VAT. Therefore, the price will be subject to the additional VAT
charges. The prices invoiced are as published on the day of the operation/service
The tariffs are provided on site, via internet on the Airport website, Aéroport International du Castellet at the
following web address: http://www.aeroportducastellet.com .
Grand Prix de France of Formula 1: We would like to inform our clients that for the period of the Grand Prix F1
from 18 of June 2018 till 25 of June 2018 inclusive, different financial and operational conditions are put in place.
CONDITIONS OF PAYMENT
All payment made to Aéroport International du Castellet, can’t be considered as a deposit. The Client can’t in
any case or for any acclaimed reason retain all or part of payment nor claim any kind of compensation. All fees
and charges are payable in full at the Airport Reception prior to departure.
METHODS OF PAYMENT
Payment of invoices issued for services provided by AIDC are payable on the due date in one in full at the Airport
reception. All major credit cards are accepted such as Visa, Eurocard/MasterCard and American Express to
which the client fully acknowledges the right of use, by check or by postal order payable to:

- By BACS
For international BACS, the Clients should stipulate: «All BACS charges must be borne by the Payer»
- By Direct Debit or standing order, by credit card in person or by telephone.
- Cash payments in (Euros) are acceptable at reception within the legal limit.
- For aviation fuel payments, the following cards, cash or credit card are accepted :

PAYMENT NOTICE
Payment of invoices must be made in full. Any claims will be invalid after 15 days of receipt of the invoice.
No discount will apply regardless of advanced payment (Article 2 de la loi N°92-1442 du 31/12/1992).
FEES – INVOICING CHARGES
Except from customers « on account », we advise that failure to pay the landing fees in full at the Airport
Reception Desk, an additional charge of 15.00 € excluding VAT will be added to the final invoice
SANCTIONS FOR LATE OR NON PAYMENT
GENERAL PROVISIONS – DELAYS, DISPUTES AND LEGAL COSTS
Any invoice that hasn’t been settled at the end of payment period, a reminder letter will be sent.
Penalties: In case of delays, non-payment or late payment; penalties of 1.5 times of the current interest rate will
apply after a formal notice and without further reminders.
Legal costs recovery: A fixed payable fee of 40.00€ per invoice for recovery costs will be charged (Decree 2012-
115 of 2-10-2012). However, if the recovery cost incurred exceeds the limit, additional compensation will be
charged.
Litigation: In the event of non-payment on time and after sending a formal notice, the case will be referred to
the litigation department. The debt collection costs and late penalties will be the responsibility of the Customer.
EXCEPTIONAL CLAUSES
CANCELATION OF BENEFITS AND SPECIAL DISCOUNT
AIDC may in the event of non-compliance with the legal deadlines for payment of invoices, cancel immediately
and definitively any commercial advantage granted to the Customer. The cost occurred by external debts
collectors will be added to the invoices in chronological order of issue.
TERMIATION OF CONTRACT
In the event of non-compliance by one of the parties of any of its obligations, the contractual relations may be
terminated automatically by one or other of the parties, formal written thirty (30) working days’ notice by
registered letter with acknowledgment receipt that has not received a follow-up.

SEIZURE OF AIRCRAFT
AIDC reserves the right to oppose a Customer who is the object of a breach of the obligations of settlement, and
implement measures of conservatory seizure in accordance with the legal provisions in force.
Article L123-4 civil aviation Code:
"In the event of non-payment or insufficient payment of airport charges, handling charges or administrative
penalties imposed by the Airport Control Authority, the Airport Operator or Administration Authority and Law
Enforcement Authorities may, after prior written notice in attempts to obtain all settlement of invoices,
repossess the aircraft as precautionary measure till payment of all debts has been settled by the customer.
The order of judgement enforcement is forwarded to the Air Traffic Control Authorities for the purpose of
repossessing the aircraft. The customer is then notified of the judgement as well as the operator of the aircraft
The customer or the owner of the aircraft will be held liable for all legal costs occurred by such outcome.
Payment of the sums due shall result in the release of the aircraft. "
INTELLECTUAL PROPERTY RIGHTS
All use, copy or broadcast of all items covered by intellectual property rights is strictly prohibited without prior
permission from AIDC.
LIABILITY AND INDEMNITY
The Customer and its insurers shall not make any claim against AIDC and its insurers for any damages of any
nature (delay, injury or death of passengers, injuries or death of employees of the Customer, loss of luggage,
goods, damage to property of the Customer and any consequential financial damages, etc.) suffered as a result
of, or in connection with, the performance of the Services and guarantee, to the extent permitted by law, against
any recourse by third parties for damages of any nature suffered by, or in connection with, the performance of
the Services, except in the case of serious negligence or intentional misconduct of AIDC.
AIDC and its insurers shall not make any claim against the Client and its insurers for damages of any nature
suffered as a result of or in connection with the performance of the Services, except in the case of serious
negligence or intentional misconduct of the Customer.
Finally, and notwithstanding what is stated in the first paragraph above, AIDC warrants the Customer for any
material damage to the aircraft caused by a negligent action or omission of AIDC, within the following financial
limits:
Aircrafts Limitation of liability
Airline Jets €500,000
Helicopters €100,000
Business Jets 1% of aircraft value, subject to a minimum of €50,000
The liability of AIDC cannot be sought by the Customer for financial losses such as, and not limited to, losses of
operations, losses of revenue, except in case of serious negligence or willful misconduct.
Damages less than € 3,000 will not be claimable.

FORCE MAJEURE
AIDC shall be exempt from any liability for any failure to perform its obligations in respect the terms and
conditions of sale resulting from force majeure. Force majeure covers any other causes outside of AIDC’s control
as per article 1148 of the civil Code.
DISPUTES - TRIBUNAL - GOVERNING LAWS AND JURIDICTION - LANGUAGE
Any dispute, claim or execution in connection with GT&C is subject to French law.
Failure to resolve any dispute, the matter will be referred to The Commerce Tribunal of Toulon. In case of
contradiction or misinterpretation or miss translation, only the French version of the GT&C will be upheld in
resolving the matter between the two parties.

CLASSIFICATION OF AIRCRAFTS
(MTOW reference – excluding helicopters)
MTOW is specified on the navigation certificate of the Aircraft or on the Aircrafts register, rounded to the next
ton. The weigh is referenced in metric tons, and the dimensions are in metric system.

LANDING FEES
Aircrafts exempt from landing fees in the following cases:
- Returning Aircraft due to technical problem / issue.
- Aircraft on rescue missions or medical emergencies transfer.

subject to 50% of handling fee charge. - All handling cancelations within less than 24 hours prior notice to departure or arrival will be subject to
100% handling fee charge.

PASSENGER TAX
This tax is for the use of the Airport’s reception and facilities.

Passenger tax is payable on departure only : - Applicable for all commercial aircrafts - Applicable for non-commercial aircraft 6 ton MTOW and over.
Who is exempt from passenger fee charge :
- All crew members
- Passengers on board returning aircraft due to technical problems or bad weather conditions
- Passengers on board an aircraft for technical stopover.
- Infants under 2 years of age.
- Passengers arriving and departing on board an aircraft making short technical stop over.
AIRPORT OUT-OF-HOURS OPENING CHARGES
Airport normal operational hours (no extra charge):
Summer opening hours (France) : 9H00 - 18H00
Winter opening hours (France) : 9H00 - 17 H00
The cost for each arrival and departure and access to the Airport outside of opening hours: 100.00 € per hour
(*)Any hour started is due.
Extension « for departures » starts at the time of arrival of the crew to the Airport terminal building
Extension « for arrivals » ends when all crew members leave the Airport terminal building.

HANGAR PARKING CHARGES
This fee is payable by all visiting aircrafts requesting hangar parking from AIDC subject to availability.

Total area is calculated as follow: length x wingspan in meters and rounded to next (m²).
Charges per day = total occupied area (m²) x 0,67€
