ORDER BY THE HIGH COMMISSIONER, WITH THE APPROVAL OF THE SECRETARY OF STATE, UNDER SECTION 4(2). IN EXERCISE of the powers vested in him by subsection (2) of section 4 of the Trading with the Enemy Ordinance, 1939, and No. 36 of 1939. of all other powers enabling him in that behalf, the High Com- missioner, with the approval of the Secretary of State, has ordered and it is hereby ordered as follows:— 1. This Order may be cited as the Trading with the Enemy (Specified Persons') (Amendment) Order (No. 11), 1940, and shall be read as one with the Trading with the Enemy (Specified Per- sons) (Amendment) Order (No. 9), 1940, hereinafter referred to as the principal Order. 2. The Schedule to the principal Order shall be varied :— (a) by inserting the names and addresses specified in Part I of the Schedule to this Order; (b) by deleting the names and addresses specified in Part II of the Schedule to this Order; and (c) by making the amendments specified in Part III of the Schedule to this Order. 3. O R D E R B Y T H E H I G H C O M M I S S I O N E R , W I T H T H E A P P R O V A L OF T H E S E C R E T A R Y OF S T A T E , U N D E R S E C T I O N 4(2).

I N E X E R C I S E of the powers vested in h im by subsection (2) of section 4 of the Trading with the E n e m y Ordinance, 1939, and No. 36 of 1939. of al l other powers enabling h im in that behalf, the H i g h Com­missioner, wi th the approval of the Secretary of State, has ordered and it is hereby ordered as fol lows:—

1. This Order may be cited as the Trading wi th the Enemy (Specified Persons') (Amendment) Order (No. 11), 1940, and shall be read as one with the Trading with the Enemy (Specified Per­sons) (Amendment) Order (No. 9), 1940, hereinafter referred to as the principal Order.

2. The Schedule to the principal Order shall be varied :—

I N E X E R C I S E of the powers vested in h im by section 1 8 of the No. 18 of !940. Compensation (Defence) Ordinance, 1 9 4 0 , the H i g h Commissioner

has made the following rules :—

1. These rules may be cited as the Compensation (Defence) Notice of Claim Rules, 1 9 4 0 .

2. Claims for compensation or for apportionment of compensa­

tion under the said Ordinance shall be made by notice in accord­

ance with the forms specified in relation to such claims respectively in the Schedule to these rules.

3 . Every such notice of claim shall be signed by the claimant or by a person duly authorised by the claimant on his behalf and shall be delivered to such person as the competent authority by whom the requisition or acquisition was effected shall direct or, failing any such direction, to the competent authority.

I N E X E R C I S E of the powers vested in them by, paragraph (d) of subsection (1) of section 25 of the Road Transport Ordinance, the Loca l Council of Holon, with the consent of the District Commis­sioner, Lydda District , and the licensing authority, have made the following by-laws :—

1. These by-laws may be cited as the Holon (Licensing of B i ­cycles and Tricycles) By-laws, 1940.

2. In these by-laws "bicycle" and "trkyycle" mean any bicycle or tricycle other than a motor bicycle or motor tricycle; " L o c a l Council area" and " L o c a l Counci l" mean the area of jurisdiction of the Loca l Council of Holon and the Loca l Council of Holon, ' re­spectively; "tester" means the person or persons authorised by the Loca l Council to test bicycles or tricycles.

3. No person residing within the Loca l Council area, shall ride a bicycle or tricycle on any road within such area, unless such bi­cycle or tricycle has been licensed in accordance with the provi­sions of these by-laws and bears a number-plate issued in respect thereof attached thereto behind the seat facing the rear of the bi -cj^cle or tricycle in such a manner as to be visible at all times.

4. No licence shall be issued unless and until the applicant pro­duces a certificate to the effect that the bicycle or tricycle in respect of which he requires a licence has been duly tested and passed by the tester. Such certificate shall be issued free of charge.

5. Every person residing within the Loca l Council area who desires a licence and number-plate in respect of a bicycle or tricycle, shall make application therefor to the Loca l Council, and the Loca l Council shall issue to such person such licence and number-plate upon payment of the fees set out in by-law 6 of these by-laws.

6. The fee to be paid to the Local Council i n respect of each licence for a bicycle or tricycle issued by them shall be two hundred and fifty mils, an additional fee of fifty mils shall be paid in re­spect of the number-plate for such bicycle or tricycle :

Provided that if any licence is issued on or after the first day of Ju ly in any year, one hundred and twenty five mils shall be paid in respect of such licence.

7. A l l licences issued under these by-laws shall expire on the thirty-first day of December next following the date of issue there­of.

8. Number-plates must be maintained in good condition and any Number-number-plate which becomes defaced or defective shall be replaced P l a t e s • on renewal of the licence against payment of the fee prescribed for the issue of number-plates in by-law 6 of these by-laws.

3. Where the breadth of ... parcel is less, but the area is not less than any of the prescribed minima, the Settlement Officer may at his discretion order the adjustment of a parcel or parcels within the boundaries of an adjoining parcel or parcels by the exchange of land of equal value.

­ .4. (i) A fragment of land which under the terms .of this Order may not'be re­

gistered, shall be added to the land of an adjoining owner who shall pay to the owner of the fragment compensation which shall be assessed by the Settle­

ment Officer.

(ii) A share which under the terms of this Order may not be registered, shall be added to the share of a co­owner in the" same parcel who shall pay to the owner of the share compensation which shall be assessed by the Settlement Officer. , ' ­••

fer to him of the fragment or of the share, it shall be added to his parcel or share;

(b) Where more than one of the adjoining owners or co­owners desire the transfer to them of the fragment or share, it shall be added to the parcel or share of such adjoining owner or co­owner as may be decided by lot;

(c) Where none of the adjoining owners or co­owner desires the transfer of the fragment or share, it shall be added to the parcel or share of such adjoining owner or co­owner as the Settlement Officer may direct:

Provided that no fragment or share shall be added to any parcel or share unless the־ parcel or share resulting from such addition is capable of registration under the terms of this Order.

(iv) (a) Where two or more adjacent fragments of land are incapable of regis­

tration under this Order, the Settlement Officer may combine a sufficient number of fragments to form a parcel which is capable of registration under the terms hereof.

(6) Where two or more shares are incapable of registration under this Order, the Settlement Officer may combine a sufficient number of shares to form a share the total area represented by which would enable regis­

tration of the combined share.

The person in whose name the parcel or share resulting from such addition shall be registered, shall be decided by the Settlement Officer in one of the following ways :— ,

(I) 'Where only one of the owners of the fragments or only one of the co­

owners desires the combined parcel or share resulting from such addition, it shall be registered i n his name;

(II) Where more than one of the owners, of the fragments or more than one of the co­owners desire the combined parcel or share resulting from such addition, it shall be registered in the name of such owner or co­owner as may be decided by lot;

(III) Where none of the owners of the fragments or none of the co­owners desires the combined parcel or share resulting from such addition, it shall be registered in the name of such one of the owners or co­owners as the Settlement Officer may direct.

1. A l l citrus growers are hereby required to submit to the Palestine Citrus Con­trol Board, c/o Department of Agriculture, P . O . B . 662, Jaffa, not later than the 9th January, 1941, particulars regarding each of their citrus groves as set out in the Schedule to this notice.

2. The said particulars shall be submitted on the appropriate form (Citrus Grove Registration F o r m C . C . B . / l ) i n the manner indicated therein. Copies of the said form may be obtained as follows :—

(a) Citrus growers who are members of a Cooperative Society can obtain copies of the Eorm from their Society;

(6) Other citrus growers should apply for copies of the Eorm to their respective District Officer or Mukhtar.

3. A n y citrus grower who owns more than one grove shall submit the said par­ticulars on a separate form in respect of each grove.

4. Where the person completing the said E o r m in respect of any particular grove is a managing partner and not the sole owner of such grove, such person should, when signing the form, indicate therein on whose behalf he is signing.

N O T I C E .

The H i g h Commissioner wi th the approval of the Secretary of State has decided not to prescribe a quota of immigration certificates for the six months October, 1940—March, 1941.

2. Dur ing the period A p r i l , 1940—September, 1940, authorities were granted under the prescribed quotas for the admission of 9,400 immigrants, of whom about 5,700 were principar immigrants and about 3,700 dependant wives and minor children. Of these only about 1,300 were able to reach Palestine during the period, and while the validity of the immigration authorities granted has been extended to the 31st March , 1941, it is clear that the circumstances of international travel make it most difficult for prospective immigrants who hold immigration authorities for Palestine to reach this country within the period when their absorption in the economic life of the country was anticipated. As things are, some of these pro-

- spective immigrants may arrive in Palestine at a time when transfer of new capital to Palestine is most difficult, when the opportunities for the investment of capital

in Palestine are much restricted, and when the problem of unemployment i n the country is the cause of serious preoccupation to the Government and to the general public. In such circumstances Government has decided that a new quota of im­

migration certificates cannot be justified.

3. Since it is highly probable that a, number of immigration certificates granted during the past summer w i l l not be utilized, the H i g h Commissioner has decided that replacement immigration certificates in strictly limited number may be granted in special circumstances where the admission of the holders of such authorities wi l l be to the clear advantage of the country.

4. Thus, while there w i l l be no prescribed quota for immigrants it may be expected that a certain number of immigrants wi l l continue to arrive during the winter months in virtue of authorities granted during the summer months or during the current six months in replacement of authorities already granted that cannot be utilized.

5. The following account is given of Jewish immigration since the 1st of A p r i l , 1939:—

Certificates available (subject to economic absorptive capacity) under the policy declared i n Command Paper 6019 of M a y , 1939 :—

(a) A quota of 10.000 a year, five years beginning on 1st A p r i l , 1939 ' 50,000

(b) Supplementary refugee certificates 25,000

There are some 8,000 prospective immigrants who have received permission to come to Palestine but had not arrived at the 30th September. If it be assumed that all these wil l arrive in Palestine, the balance of immigration certificates available for.issue during the 3J years remaining of the 5 years period beginning 1st A p r i l , 1939, is between 36,000 and 37,000, allowance being made for the number of illegal immigrants who have been allowed to remain in Palestine since the 30th September, 1940, (including the " P a t r i a " passengers), which number wi l l be deducted from the next quota.
