WHEREAS an area of land measuring 466 square metres, forming part of parcel No. 182 of Land Registration Block No. 7053, Jaffa, and coloured green on Survey Plan No. 358/43, is registered in the Land Registry of Jaffa in the category termed "Metrouke", having previously been registered in the category termed "Mulk"; AND WHEREAS prior to the coming into force of a town planning scheme known as Scheme "E"—Bassa Replanning Scheme, Jaffa, notice of the grant by the High Com- missioner of authority to put which scheme into force was published in the Gazette No. 788 of the 8th June, 1938, at page 651, the hereinbefore recited land formed part of a public highway; AND WHEREAS by the said scheme it was provided that the alignment of the said public highway should be altered so that the hereinbefore recited land should cease to form part of the said public highway; AND WHEREAS I am satisfied that it is in the public interest to convert the herein- before recited land from the category termed "Metrouke" to the category termed "Mulk", and that, by the alteration of the alignment of the said public highway in accordance with the said scheme, provision will be made whereby any rights or benefits which may formerly have been enjoyed in or over the hereinbefore recited land will be replaced by such rights and benefits as I regard as being reasonably equivalent in character to such former rights and benefits; Now, THEREFORE, I, JOHN STANDISH SURTEES PRENDERGAST VEREKER, FIELD-MARSHAL VISCOUNT GORT, V .C., G.C.B., C.B.E., D.S .O., M .V.O., M.C., High Commissioner for Palestine, in exercise of the powers vested i n me by Article 16c of the Palestine Orders in Council, 1922 to 1939, and of all other powers enabling me in this behalf, do hereby order that the hereinbefore recited land shall be converted into the category termed "Mulk" and registered accordingly in the Land Registry of Jaffa.     L O C A L C O U N C I L S O R D I N A N C E , 1941. • BY-LAWS MADE BY THE LOCAL COUNCIL OF K A F R Y A S I F UNDER SECTION 9.

    No. 36 of 1941. I N EXERCISE of the powers vested i n them by section 9 of the Loca l Counci ls Ordinance, 1941, the Loca l Counc i l of K a f r Yas i f , w i th the approval of the D i s t r i c t Commissioner, Gal i lee Dis t r i c t , have made the fo l lowing by-laws: —

    Citation. 1• These by-laws may be cited as the K a f r Y a s i f (Licensing and Cont ro l of Dogs) By-laws, 1944.

    Interpretation. 2. I n these by-laws :־— " ־ L o c a l C o u n c i l area" and " L o c a l C o u n c i l " shall mean the Loca l

    C o u n c i l area of K a f r l r a s i f and the Loca l Counc i l of K a f r Y a s i f respectively.

    "Owner" i n re la t ion to any dog shall mean any person having the • custody oi׳ control of such dog.

    Licensing s - ^ ° person shall w i t h i n the Loca l Counc i l area keep any dog unless of dogs. such dog has been licensed and bears on its col lar a metal number-

    plate issued i n respect thereof under these by-laws. Issue of 4. A n y person who desires a licence to keep a dog w i t h i n the L o c a l licences and Counc i l area shall make app l ica t ion therefor to the Loca l Counc i l , number-plates. ! f the Loca l Counc i l approve of the grant of such licence, the Loca l

    Counc i l , on payment of the fees set out i n by-law 6 hereof, w i l l issue to such person a licence as aforesaid and a metal number-plate.

    Custody of 5. Notwi ths tanding anything contained i n by-law 3 hereof, a tern-unlicensed porary v is i tor to the Loca l Counc i l area having the custody of any dog dogs in or resident w i t h i n such area who assumes temporar i ly the custody certain cases. of any dog may, for a per iod not exceeding fifteen days, keep such dog

    Licence fees. 6 - ^ n e Loca l Counc i l shal l charge a fee of two hundred and fifty mi ls for each licence to keep a dog and a sum not exceeding fifty mi l s as cost of the number-plate issued i n respect thereof:

    Prov ided that licences may be granted free of charge t o : (a) any shepherd or herdsman i n charge of flocks i n respect of not-

    more than two dogs;

    (6) any b l i n d person i n respect •of a dog used by h i m as a guide. 7. A licence issued under these by-laws shall expire on the 31st day of

    December next fo l lowing the date of issue thereof. 8. —(1) The Loca l C o u n c i l may refuse to grant a licence to any person

    or may wi thdraw any licence granted to any person to keep any dog w i t h i n the Loca l Counc i l area for a l l or any of the fo l lowing reasons : —

    ( a ) that such dog is of a savage d ispos i t ion ; (6) that such dog is dangerous to publ ic securi ty;

    " '(c) that such dog by its ba rk ing causes any noise which is so loud and so continuous or repeated as to cause a nuisance to occupants or i n mates of any premises on which such dog is kep t ;

    ( d ) that the owner of such dog has been convicted for an offence under section 386 of the C r i m i n a l Code Ordinance, 1936, on more than one occasion;

    (c) that the owner of such dog has on more than one occasion been convicted for commit t ing a nuisance by keeping a dog under such conditions as are dangerous to publ ic health.

    (2) Where a licence is wi thdrawn under the provisions of this bylaw no refund of the fees charged under by-law 6 hereof w i l l be made.

    9. —(1) E v e r y dog i n respect of which a licence has been refused or wi thdrawn shall , w i t h i n four days, be delivered by its owner to the kennels of the Loca l C o u n c i l and, subject to the provisions of paragraphs (2) and (3) hereof, shall be disposed of as the Loca l Counc i l may direct.

    (2) Where any dog has been delivered to the kennels of the Loca l Counc i l by reason of a licence having been refused o r . wi thdrawn under paragraph ( a ) or ( b ) of by-law 8(1) hereof, such dog shal l not be destroyed u n t i l an order authoris ing its destruction has been granted by a Magistrate i n accordance w i t h section 5 of the Rabies Ordinance, 1934.

    (3) Where the owner of any dog which has been delivered to the kennels of the Loca l C o u n c i l by reason of a licence having been refused or wi thdrawn under paragraph (c) or { d ) or (e) of by-law 8(1) hereof:

    ( a ) w i t h i n forty eight hours from the delivery of such dog to the kennels of the Loca l Counc i l , indicates i n w r i t i n g to the Loca l C o u n c i l his in tent ion of t ak ing legal proceedings against the destruc t ion of such dog, and

    ( b ) pays i n advance to the Loca l C o u n c i l a fee at the rate of 50 mils per diem for the feeding and accommodation of and attendance on such dog i n respect of a per iod of twenty one days and thereafter i n respect of such further per iod u n t i l a decision i n the matter has been given by a Competent Cour t ,

    such dog shal l not be destroyed u n t i l after a decision as aforesaid has been g i v e n :

    P r o v i d e d that i f any dog so detained i n the kennels of the Loca l C o u n c i l is subsequently destroyed or released or dies du r ing such detention, the owner of such dog shall be charged only i n respect of the number of days for which the dog was actual ly detained and the balance w i l l be refunded to h im.

    10. —(1) Subject to the provisions of by-law 5 hereof, any dog found w i t h i n the Loca l C o u n c i l area which is not licensed or which is not weari n g a col lar bearing the metal number-plate referred t o . i n by-law 4 hereof shall be seized by an officer of the Loca l C o u n c i l or the Pol ice wnd shal l deliver i t to the kennels of the Loca l C o u n c i l :

I f d u r i n g the said period of forty eight hours the dog is not claimed i t shal l be destroyed:

    P rov ided always that i f the dog appears to be of value, and there is reason to believe that i t is licensed although not wearing a collar bearing a number-plate as aforesaid, the per iod of detention may be extended to seven daj\s.

    11. The owner of any dog which has been seized and detained i n accordance wi th the provisions of the preceding by-law may recover such dog w i t h i n the period specified i n the sa id by-law upon product ion of a licence i n respect thereof and upon payment to the L o c a l C o u n c i l of a fee at the rate of 50 mi ls per diem for the feeding and accommodation of and attendance on such dog.

    12. The Loca l Counc i l w i l l cause a register to be kept for the purpose of these by-laws i n which w i l l be recorded f u l l par t icu lars of any dog i n respect of which a licence is granted, and the owner thereof shal l furnish such par t iculars as may be called for by the Loca l Counc i l .

    ' 13. A n y owner of a dog who fai ls to comply wi th the provisions of these by-laws shall be liable on conviction to a fine not exceeding five pounds and i n the case of a cont inuing offence to an addi t iona l fine not exceeding one pound for every day du r ing which the offence is cont inued after convict ion as aforesaid.

    14. N o compensation shall be payable to any person on account of any action taken by the Loca l C o u n c i l or their servants or agents under these by-laws except upon proof that the provisions of these bylaws have not been complied wi th by the L o c a l C o u n c i l or their servants or agents.

    P A L E S T I N E ( D E F E N C E ) O R D E R I N C O U N C I L , 1937. REGULATIONS MADE BY THE H I G H COMMISSIONER UNDER ARTICLES 6 AND 10, .

    I N EXERCISE of the powers vested i n h ira by Ar t ic les 6 and 10 of the Palestine (Defence) Order i n Counc i l , 1937, and of a l l other powers enabling h im, the H i g h Commissioner has màdé־ the fo l lowing , regulations : ׳ — Citation and construction. Gaz: 19.4.36, p . 259.

    Regulations 14c, M D and 14EO! the principal regulations repealed and replaced.

    1. These regulations may be cited as the Defence (Emergency) (Amendment) (No. 4) Regulations, 1944, and shall be read as one wi th the Emergency Regulations, 1936, hereinafter referred to vui "the p r i n c i p a l regulat ions". : ^

    2. Regulat ions 14c, 14I> and 14E of the p r i n c i p a l regulations are hereby repealed and replaced by the fo l lowing regulat ions; — •

    "14B. F o r the purposes of these regulations,• the exprassion "unlawful association" means any body of persons, whether incorporated or unincorporated and by whatsoever name ( i f any) i t may from time to time be known, which—־ ( a ) by its consti tution or propaganda or otherwise advocates, i n

    cites or encourages any of the fo l lowing u n l a w f u l acts, that is to say— (i) the overthrow by force or violence of the consti tut ion of P a l

    estine or the Government of Pa les t ine ; . • ( i i ) the b r i ng ing into hatred or contempt of, or the exc i t ing of

    disaffection against, H i s Majesty's Government i n the U n i t e d K i n g d o m or the Government of Palestine or the H i g h Commissioner i n his official capac i ty ;

    ( i i i ) the destruction or i n j u r y of property of H i s Majesty 's Government i n the U n i t e d K i n g d o m or of the Government of Pales t ine . ־ '• ׳ ־ ;

    ( iv) acts of terrorism directed against servants of H i s Majesty 's Government i n the U n i t e d K i n g d o m or against the H i g h Commissioner or against servants of the Government of Pales t ine ;

    or which has committed or has claimed to have been responsible for, or to have been concerned i n , any such acts as are mentioned i n sub-paragraph ( i i ) , ( i i i ) or (iv) of this pa rag raph ; or

    ( 6 ) is declared by the H i g h Commissioner, by notification i n the Gazette, to be an un lawful association

    and includes any branch, centre, committee, group, faction or i n s t i tu t ion of any such body.

    14c.—(1) A n y person who— ( a ) is, or acts as,, a member of •an unlawful association, or (&) manages, or assists i n the management of, an un lawful associa

    t ion, or holds any office or posi t ion i n or under . an un lawful association, or

    ( c ) does any work or performs any service for an un lawful association, unless he proves that he bona fide believed that the work or service was not for an un lawful association, or

    (d) attends any meeting of an un lawfu l association, or (e) permits or suffers any meeting of an un lawful association to

    be held i n any house, b u i l d i n g or place belonging to or occupied by h im or under his control, unless he proves that he d i d not

    know of or connive at the meeting or that he bona fide believed that the meeting was not a meeting of an un lawful association, or

    (/) has i n his possession, custody or control any book, account, per iodical , handbi l l , poster, newspaper or other document, or any funds, i n s ign ia or property, belonging or re la t ing to or issued by or i n the interests of, or p u r p o r t i n g to belong or relate to or to be issued by or i n the interests of, an un lawful association, or

    ((/) writes or otherwise prepares or produces, pr in ts , types or otherwise reproduces, publishes, exhibits, sells or exposes for sale, distributes, transmits, or knowingly handles, any such t h i n g as is mentioned i n paragraph (/) , o r

    (A) collects, receives, requests or demands any donation or subscr ip t ion for an un lawfu l association or under pretence that i t is for an un lawfu l association,

    ( 1 ) by w r i t i n g , words, signs, or other acts or representation, direct ly or ind i rec t ly whether by inference, suggestion, imp l i ca t ion or otherwise, acts on behalf of, or as a representative of, an un lawful association,

    shal l be g u i l t y of an offence against these regulations. (2) Sub-regulat ion (3) of regulat ion 18 of these regulations shall

    have effect i n respect of any such offence as though "three years" was substituted therein for " s i x months" as the max imum imprisonment which can be imposed on conviction fo l lowing a t r i a l under the provisions of the Magistrates ' Cour ts J u r i s d i c t i o n Ordinance, 1939, and as though "ten years" was substituted therein for "three years" as the m a x i m u m imprisonment which can be imposed on convict ion following a. t r i a l upon informat ion .

    (3) I n this regulat ion "document" includes any substance recording , or on which is recorded, any matter, whether by letters, figures, marks or p i c to r i a l or other representation, or by more than one of those means."

    8. Sub-regulation (3) of regulat ion 18 of the p r i n c i p a l regulations is hereby amended—

    ( a ) by substi tut ing "Magis t ra tes ' Courts J u r i s d i c t i o n Ordinance, 1939" for "Magis t ra tes ' Courts J u r i s d i c t i o n Ordinance, 1935" there in ;

    ( b ) by subst i tut ing the reference " N o . 45 of 1939" for the reference " N o . 16 of 1935" i n the m a r g i n thereof;

    ( r ) by substi tut ing the fo l lowing for the second paragraph thereof: — "Where any person is convicted under the provisions of these re

    gulations, any goods, articles, documents, money or other things i n respect of which or i n re la t ion to which the offence was commit ted shal l be l iable to be forfeited by order of the Cour t to the Government of Pales t ine ."
