Breach of Planning Control:Breach of Planning Control: The unauthorised mixed use of land for the: o The storage of motor vehicles, lorry backs and trailers, motor vehicle parts and tyres o The dismantling of motor vehicles o The repair of motor vehicles o The storage of scrap metal o The deposit of waste

Circumstances:The site is a former scrap metal storage yard to the rear of numerous residential properties. Its use has varied over time and the nature of the current use being a mixture of uses; means there is a requirement for planning permission to be obtained. Negotiations have taken place to control the use and restrict it to the previously established use however this has proved unsuccessful. Challenge letters have been sent and joint action involving the Environment Agency and multiple site visits taken place. It has now become necessary to commence formal enforcement action The unauthorised mixed use causes noise and general disturbance within a residential neighbourhood and does not demonstrate that risk of harm has been minimised, it does not make positive contribution to lives of resident through high quality inclusive design, it harms amenity of residents and operates through a sub-standard access/layout harming highway and pedestrian safety, it is piecemeal development with a uncontrolled and intensive nature which harms the setting of nearby Listed buildings contrary to policies EN8 , SC1 EN3, EN8 DS1 and DS5 and of the Council's core strategy development plan document and policy WDM2 of the Council's adopted waste management development plan document. The Planning Manager (Enforcement and Trees) authorised the issuing of an Enforcement Notice under delegated powers, on 3 January 2019

Breach of Planning Control:Unauthorised hand car wash & valeting use and associated development works

Circumstances:In May 2017 an Enforcement Notice was issued by the Council in respect of unauthorised structures on the land, which were being used in connection with an unauthorised hand car wash use. The requirements of the Enforcement Notice were complied with in March 2018 and the unauthorised use ceased. However, the land is again being used for the operation of a hand car wash and valeting business along with associated development works, for which the Council has no record of planning permission having been granted. The land owner and occupier of the property have been requested to rectify the breach of planning control, however no action has been taken. On 27 December 2018 the Planning Manager (Enforcement & Trees) authorised the issue of an Enforcement Notice in respect of the unauthorised use of the land. It is considered expedient to instigate Enforcement (Legal) Action as the unauthorised use and associated development works are detrimental to visual amenity and highway safety, contrary to policies DS1, DS3, DS4 and SC9 of the Council's adopted Core Strategy Development Plan document and the polices contained in the National Planning Policy Framework.

Breach of Planning Control:Unauthorised externally mounted roller shutter

Circumstances:In December 2016 the Council received an enquiry regarding a roller shutter at the property. An inspection showed that an externally mounted roller shutter had been installed to the front elevation of the property, for which the Council had no record of planning permission having been granted. A retrospective planning application for the roller shutter, reference 17/00887/FUL, was refused by the Council in April 2017. The unauthorised externally mounted roller shutter remains in place and on 2 January 2019 the Planning Manager (Enforcement & Trees) authorised the issue of an Enforcement Notice. It is considered expedient to instigate Enforcement (Legal) Action as the unauthorised roller shutter is detrimental to visual amenity by virtue of its design and appearance, contrary to Policies DS1, DS3 and SC9 of the Council's adopted adopted Core Strategy Development Plan Document, the Council's adopted Shopfront Design Guide, the Council's adopted A Shopkeepers Guide to Securing their Premises Supplementary Planning Document and the policies contained in the National Planning Policy Framework.

Breach of Planning Control:Unauthorised use of land in connection with a wedding and event venue, public house and restaurant business

Circumstances:Following complaints received in this office, a site visit revealed that a substantial area of field adjacent the above public house car park, had been changed to a entertainment, wedding and events venue associated to the public house use. The land is located in the Green Belt and within a site of a historic battlefield The use of the land for the aforementioned purpose does not benefit from planning permission and is unauthorised; it is an inappropriate and unsustainable use within the greenbelt harming the openness and character of the greenbelt. The use and development causes significant harm to the historic battlefield heritage asset and also causes noise and disturbance associated with the use harms the amenity of nearby residential property. The use is contrary to Policies:- Policy GB1 of the Council's Replacement Unitary Development Plan, Core Strategy Development Plan Document Policies SC9, EN3, EN4, and EN8 and paragraphs 134 to 136 and paragraphs 143 to 146 of the National Planning Policy Framework (Section 13 Protecting Green Belt Land) and paragraphs 184 and paragraphs 190 to 196 of the National Planning Policy Framework (Section 16 Conserving and Enhancing the Historic Environment). The Planning Manager (Enforcement and Trees) authorised the issuing of an Enforcement Notice under delegated powers, on 10 December 2018.

Breach of Planning Control:Unauthorised operational development consisting of the formation of a raised development platform and two marquees.

Circumstances:Following complaints received in this office a site visit revealed that a substantial area of greenbelt land to the rear of the existing pub car park had been developed for the purpose of installing very large marquees used for staging of entertainment weddings and other events. No planning permission has been sought or exists for the development work which is in the green belt and within a historic battlefield. The development is unauthorised and is considered an inappropriate and unsustainable use within the greenbelt, harming its openness and character. Subsequent site visits to the premises by the enforcement officer revealed a green container and security fencing remained on the land despite the landowners being requested to remove it. On 3 January 2019 the Planning Manager (Enforcement & Trees) authorised the issue of a Section 215 Notice. It is considered expedient to instigate Enforcement (Legal) Action as the untidy condition of the land has an adverse impact on the visual amenity of the residential area.
