1.0 PROJECT OVERVIEW

1.1 Background

EnCana Oil & Gas (USA) Inc. (EnCana) requests a Special Use Pennit (SUP) from the Garfield County Board of County Commissioners (BOCC) for the construction, operation, and maintenance of the proposed Story Gulch Compressor Station (SGCS). The proposed location of the SGCS straddles the southern edge of Section 34, Township 6 South, Range 96 West, and northern edge Section 3, Township 6 South, Range 96 West, of the 6th Principal Meridian. The compressor station is located approximately 12 miles northwest of Parachute, Colorado. The proposed SGCS is located on a 7.2 acre parcel of EnCana owned property, which is part of the EnCana's 45,000 acre North Parachute Ranch (NPR) property. The SGCS would provide an additional natural gas processing facility to accommodate both future and current natural gas volumes being produced in the Piceance Basin.

1.2 Description

The SGCS would consist of 14 natural gas engine driven, electric driven, or a combination of natural gas driven and electric driven compressors; 14 air coolers; an outdoor electrical substation; two power distribution centers (PDC); a generator building; launcher/receivers; four slug catchers; a three-phase separator vessel; four glycol regenerator units; four glycol contactors; one blowdown stack; eight 1200 barrel (bbl) liquids storage tanks and vapor recovery units; liquids storage vessel; pump building; fuel gas building; and one control maintenance building.

Based on current projected volumes, EnCana will install two natural-gas driven engines in 2009. As natural gas volumes increase, EnCana will install additional compression. At completion, the SGCS will have up to 14 natural-gas driven compressors and related ancillary equipment. EnCana will utilize electric-driven engines when feasible and requests approval to exchange natural-gas driven engines for electric-driven engines when feasible as part of this SUP approval.

Please note that actual number of compressor engines installed for any given year is an estimate based on today's current and anticipated production volumes and is considered a forward­looking statement. Forward-looking statements involve numerous assumptions, known and unknown risks and uncertainties, both general and specific, that contribute to the possibility that the predictions, forecasts, projections and other forward-looking statements would not occur, which may cause the company's actual perfonnance and financial results in future periods to differ materially from any estimates or projections of future perfonnance or results expressed or implied by such forward-looking statements.

As described above, EnCana would install the compressors in phases over the next several years. A portion of the expansion would be completed in 2009 and the remainder of the expansion would be installed at a later date. Actual number of compressors and installation dates may be accelerated or delayed based on field development. The intent of this Special Use Permit application is to allow for the expansion in its entirety to be considered within this application.

The gas-driven compressor units will be installed outdoors as temporary units until they can be replaced by electrical units. As gas-driven compressor units are replaced with electric-driven units, the electric-driven compressor units will be enclosed within a building referred to as the Inlet Gas Compressor Building # I and the building dimensions are approximately 6O-feet by 300-feet. The electric-driven compressor units will be powered by the substation and PDC buildings, which will receive power from a new 230,000 volt power line, which will be constructed from EnCana's Middle Fork Compressor Station. The substation and power distribution centers will house the electrical transformers and equipment needed to regulate the 230,000 volt power line and distribute the electrical power to the electric-driven compressors and facility equipment. The substation will contain outdoor equipment to step-down the 230,000 volt power to lower voltages that will be distributed to the electrical motors through the electrical equipment housed in the PDC buildings. The two PDC buildings will be next to the substation and the dimensions for the two power distribution centers will be 20-feet by 80-feet. The generator building will house a backup electrical generator and the building will be 30-feet by 60-feet. The pump building is necessary to handle liquid products and the dimensions of the pump building will be 20-feet by 40-feet. The fuel gas building will contain equipment to supply fuel gas to the on-site equipment and the dimensions will be 8-feet by 20-feet. The control maintenance building will provide a location for the plant operators to monitor the operation of the compressor station and control natural gas processing equipment. The control maintenance building will include a unisex restroom and wash station and the building dimensions will be 60-feet by 60-feet.

EnCana will attain grading and building permits from the Garfield County Building and Planning Department before the start of construction activities at the SGCS. Site plans and drawings for the SGCS are provided in the Site Plan Tab.

1.3 Purpose and Need

EnCana plans to increase production in the Piceance Basin by approximately 100 to 200 million standard cubic feet per day (msc£'d), each year, for the next several years. The proposed SGCS would be built in phases starting in 2009 and ultimately expand capacity to approximately 440 mmscf/d by the end of 2013. The proposed SGCS expansion has been sized to accommodate EnCana's current and future estimated gas production from Garfield County and existing and future natural gas from other natural gas producers in Garfield County.

1.4 Location

The proposed SGCS is located on approximately 7.2 acres which straddles the southern edge of Section 34 Township 4 South, Range 96 West and the northern edge of Section 3 Township 4 South, Range 96 West of the 6th Principal Meridian EnCana is the owner of this parcel of property, which is part of the North Parachute Ranch. The Garfield County Assessors maps and deed and legal description for the property are provided in the Landowners Tab.

The SGCS is located on lands zoned Resource Lands.

1.5 Project Design

The SGCS would be designed in accordance with American Petroleum Institute (API), American Society of Mechanical Engineers (ASME), Institute of Electrical and Electronic Engineers (IEEE), National Electric Code (NEC), National Fire Protection Association (NFPA), and Occupational Safety and Health Act (OSHA) standards.

2.0 SECTION 5.03 CONDITIONAL AND SPECIAL USES

The following sections address impacts as required by Section 5.03 of the Garfield County Land Use and Zoning Regulations.

2.1 Water and Sanitation Utilities

Portable toilets will be available on-site and potable water will be transported from off-site and made available to personnel during the construction of the SGCS. The portable toilets will be maintained throughout construction, until pennanent sanitation and water utilities are installed. EnCana is planning to install a 100 bbl fresh water cistern and a 750 gallon septic tank and leach field at the SGCS, upon approval of the SUP from the Garfield County BOCC. A unisex restroom facility and wash station is being proposed in the maintenance building. EnCana will submit an Individual Septic Disposal System Pennit to the Garfield County Building and Planning Department. The proposed septic system is currently designed to a percolation rate of 60 min/inch, which is the slowest absorption rate and the septic system will be designed based on the percolation test and engineer's recommendations. Potable water provided at the SGCS will include bottled water and potable water stored in the 100 bbl fresh water cistern. EnCana will use Colorado Department Public Health and Environment (CDPHE) certified potable water haulers to transport water to the SGCS.

2.2 Access

The SGCS is located approximately 12 miles north of Parachute, Colorado on the south side of Divide Road. EnCana will construct a gravel driveway off of Divide Road to enter the site.

2.3 Neighborhood Character

The proposed SGCS is located in a developing oil and gas industrial setting, and minimal visual impact would occur to the general public or adj acent property owners from the construction and/or operation of the SGCS. The nearest residence is more than 8 miles away. Installation of the compressor station would not change the existing neighborhood character.

3.0 SECTION 5.03.07 INDUSTRIAL OPERATIONS

The following sections address impacts as required by Section 5.03.07 of the Garfield County Land Use and Zoning Regulations.

3.1 EXisting Lawful Use of Water

No water depletion would occur as pm1 of this project. EnCana has prepared and utilizes the Story Gulch Stonnwater Management Plan (SWMP) and the Spill, Prevention, Control and Countenneasure Plan (SPCCP) for Gas Gathering Facilities. Implementation of these plans

ensures that activities comply with stormwater management and spill prevention controls and countermeasures as required by Garfield County, the State of Colorado, and the United States Environmental Protection Agency. Implementation of these plans also ensures that EnCana would not pollute surface runoff, stream flow, or groundwater. Copies ofthe SWMP and SPCCP are provided in the Stormwater and SPCCP Tab.

3.2 Generation of Vapor, Dust, Smoke, Noise, Glare or Vibration

No smoke or glare would be produced as a result of this project. Minor vibration would occur from operation of the compressor engines; however, vibrations would not be noticeable at the property line. Equipment operation would produce vapor, which is a standard by-product of equipment operation. EnCana would apply water, gravel, tackifier, or other equivocal measures as necessary to prevent fugitive dust emissions from equipment and/or vehicles traveling in the proj ect area.

EnCana has completed a sound level study for the proposed SGCS, which will be operated in compliance with Colorado Oil and Gas Conservation Commission (COGCC) regulations. After construction of the SGCS, EnCana will perform an additional sound level survey. If operations exceed COGCC regulations, EnCana would install sound mitigation equipment as necessary to meet COGCC regulations. Sound mitigation measures could include a combination of residential grade silencers over fans, pre-fabricated steel buildings over compressors and drivers, and/or installation of other sound mitigation equipment. The sound level survey is provided in the Supporting Documentation Tab.

EnCana is currently in the process of submitting applications and acquiring air quality permits from the CDPHE Air Pollution Control Division for the proposed SGCS. The air permits will not be attained until early to mid 2009. Copies of the air permits will be provided to the County as they are received.

3.3 Wildlife and Domestic Animals

EnCana contracted WestWater Engineering Inc. to prepare a Wildlife Assessment and Mitigation Plan for the proposed SGCS, which is included in the Supporting Documentation Tab.

3.4 Traffic Impacts

The construction of the SGCS would require a workforce of approximately 50 to 75 personnel over a period of 5 to 7 months. Construction crews would access the site via the Sprague Gulch Road off of Rio Blanco County Road 5 and to a lesser extent Garfield County Road 215. Access via 215 ends at EnCana's Guard shack and the road passes through EnCana property and crosses Exxon property as well. Access is estimated to be 25 percent on CR 215 and 75% on Sprague Gulch.

Automobile traffic along Garfield County Road 215 would increase by approximately 12 to 25 vehicle roundtrips per day during the peak construction period, which would last approximately 4 to 6 months. The consideration for approximately 25 vehicles accessing the site per day was

based on the factor of project workers making repeated mUltiple trips between the SGCS and Parachute and for the delivery of construction materials.

Construction operations would occur on a 5 to 6 day work schedule, with the nonnal working hours from 7:00 AM until 5:00 PM. The SGCS would remain in operation for approximately 30-years and the compressor station would operate 24-hours per day. During the operations phase of the project, personnel necessary at the site would be 2 to 4 plant operators, which nonnally work from 7:00 AM to 5:00 PM on a 5 or 6 day work schedule. No full-time employees are located on-site. The compressors are monitored remotely from EnCana's Parachute Office. Operation of the SGCS would not result in any additional impacts to county roads. The tables below provide a list of the type of vehicles accessing the SGCS during the construction and operational phases of the project and the estimated traffic impacts to Garfield County Road 215.

3.5 Abutting Property

The nearest residence is approximately eight miles to the southeast of the proposed SGCS. The remaining abutting property owners are also involved and currently operating natural gas processing or mineral extraction facilities, so no additioual impact would occur to the abutting property owner from the construction and/or operation of the SGCS.

3.6 Reclamation Plan

Prior to abandonment of the SGCS, EnCana would contact the Garfield County Planning Director to arrange for a meeting and joint inspection of the SGCS. This meeting and inspection would take place a minimum of 30 days prior to abandonment, and would be held so that an agreement on an acceptable abandonment plan can be reached.

EnCana will complete final reclamation measures in areas that are not necessary for operation of the compressor station facility. The majority of the disturbed areas at the SGCS will be hard­scaped with gravel to facilitate compressor station operations. EnCana has developed the North Parachute Reclamation Plan to reclaim disturbed areas as a result of constructing well pads,

access road, compressor stations, and pipelines. The NPR Reclamation Plan is included in the Supporting Documents Tab.

3.7 Emergency Response Plan

EnCana would comply with its Emergency Response Plan (ERP), which describes the functional roles and accountabilities for life safety, property damage, and environmental response. The ERP also describes the communication and notification protocols to engage support, based on the nature and complexity of the emergency. The ERP is included in the Emergency Response Tab.

EnCana would reimburse the appropriate emergency service provider for costs incurred in connection with emergency response for activities associated with this project.

4.0 SECTION 5.03.08 INDUSTRIAL PERFORMANCE STANDARDS

All operations at the SGCS would comply with applicable county, state, and federal regulations regulating water, air, and noise pollution and would not be conducted in a manner constituting a public nuisance or hazard. Operations would be conducted in a manner as to minimize heat, dust, smoke, vibration, glare and odor and all other undesirable environmental effects beyond the boundaries of the property. The following section address compliance with the standards set forth in Garfield County Zoning Regulations 5.03.08.

4.1 Sound Volume

EnCana would conduct a sound level study to determine compliance with COGCC regulations. If operations exceed COGCC regulations, EnCana would install sound mitigation equipment as necessary to meet COGCC regulations. Sound mitigation measures could include a combination of residential grade silencers over fans, pre-fabricated steel buildings over compressors and drivers, and/or installation of other sound mitigation equipment.

4.2 Vibration

EnCana would provide vibration mltJgation to meet all vibration regulation requirements. Vibrations would not be noticeable at the fenced property boundary at the SGCS.

4.3 Smoke and Particulate Matter

Smoke would not be produced as a result of this project. EnCana would apply water, gravel, tackifier, or other equivocal measures as necessary to prevent fugitive dust emissions from equipment and/or vehicles traveling in the project area. EnCana is currently applying for and acquiring air quality permits from the CDPHE Air Pollution Control Division for the proposed SGCS. The air permits will not be attained until the early to mid 2009.

4.4 Heat, Glare, Radiation, and Fumes

Ancillary facilities may produce heat during operation of the SGCS. Heat produced would be minimal and would not be detectable at the SGCS property boundary. No glare, radiation, or

fumes would be produced. Adjacent property would not be affected and a public nuisance or hazard would not be created.

4.5 Storage

Compressor engines and ancillary equipment would be temporarily stored at the SGCS. Temporary storage would no longer be needed once the compressors and ancillary equipment are installed. After construction is complete, routine maintenance and repair items would be stored on-site. Storage of heavy equipment would not be allowed at SGCS, except during installation of the compressors.

• Storage tanks are located on-site and each tank will store approximately 1200 barrels (bbls). Storage is in accordance with EnCana's SPCC Plan.

• No wastes will be produced by operation of the SGCS. Any waste material generated will be disposed of at a licensed disposal facility. No materials or wastes would be deposited on­site.

• Lighting will be provided at the SGCS. Lighting will be directed downward and inward to prevent direct reflection on adjacent property.

4.6 Water Pollution

EnCana has prepared and utilizes the NPR SWMP and the spcep for Gas Gathering Facilities. Implementation of these plans ensures that activities comply with stormwater management and spill prevention controls and countermeasures as required by Garfield County, the State of Colorado, and the United States Environmental Protection Agency. Implementation of these plans also ensures that EnCana would not pollute surface runoff, stream flow, or groundwater. Copies of the SWMP and SPCCP are provided in the Stormwater and SPCCP Tab.

The SOCS would consist of 14 natural gas engine driven, electric driven, or a combination of natural gas driven and electric driven compressors; 14 air coolers; an outdoor electrical substation; two power distribution centers (PDC); a generator building; launcher/receivers; four slug catchers; a three-phase separator vessel; four glycol regenerator units; four glycol cOlltactors; olle blowdown stack; eight 1200 barrel (bbl) liquids storage tanks and vapor recovery units; liquids storage vesse l; pump building; fllel gas building; and one control maintenance building.

Based on current projected volumes, EnCana will install two natural-gas driven engines in 2009. As natural gas volumes increase, EnCana will install additional compression, At completion, the SGCS will have up to 14 natural -gas driven compressors and related ancillary equipment. EnCana will utilize electric-driven engines when feasible and requests approval to exchange natural-gas driven engines for electric-driven engines when feasible as part of thi s SUP approval.

As described above, EnCana would install the compressors in phases over the next several years. A portion of the expansion would be completed in 2009 and the remainder of the expansion would be installed at a later date. Actual number of compressors and installation dates may be accelerated or delayed based on field development. The intent of this Special Use Permit application is to allow for the expansion in its entirety to be considered within this application.

The gas-driven compressor units will be installed outdoors as temporary units until they can be replaced by electrical units. As gas-driven compressor units are replaced with electric-driven units, the electric-driven compressor units will be enclosed within a building referred to as the Inlet Gas Compressor Building # I and the building dimensions are approximately GO-feet by 300-feet. The electric -driven compressor units will be powered by the substation and PDC buildings, which will receive power from a new 230,000 volt power line, which will be constructed from EnCana's Middle fork Compressor Station. The substation and power distribution centers will house the electrical transformers and equipment needed to regulate the 230,000 volt power line and distribute the electrical power to the electric-driven compressors and facility equipment. The substation will contain outdoor equipment to step-down the 230,000 volt power to lower voltages that will be distributed to the electrical motors through the electrical equipment housed in the PDC buildings. The two PDC buildings will be next to the substation and the dimensions for the two power distribution centers will be 20-feet by 80-feet. The generator building will house a backup electrical generator and the building will be 30-fcct by 60-feet. The pump building is necessary to handle liquid products and the dimensions of the pump building will be 20-feet by 40-feet. The fuel gas building will contain equipment to supply fuel glts to the on-site equipment and the dimensions will be 8-feet by 20-feet. The control maintenance building will provide a location for the plant operators to monitor the operation of the compressor station and control natural gas processing equipment. The control maintenance building will include a unisex restroom and wash station and the building dimensions will be 60-feet by 60-feet.

Alter construction of the SGCS , EnCana will perform an additional sound level survey. If operations exceed COGCC regulations, EnCana would install sound mitigation equipment as necessary to meet COGCC regulations. The construction of the SGCS would require a workforce of approximately 50 to 75 personnel over a period of 5 to 7 months. Construction crews would access the site via the Sprague Gulch Road ofJofRio Blanco County Road 5 and to a lesser extent Garfield County Road 215. Access via 215 ends at EnCana's Guard shack and the road passes through EnCana property and crosses Exxon property as well. Access is estimated to be 25 percent on CR 215 and 75% on Sprague Gulch.

Automobile traffic along Garfield County Road 215 would increase by approximately 12 to 25 vehicle roundtrips per day during the peak construction period, which would last approximately 4 to 6 months. The consideration for approximately 25 vehicles accessing the site pcr day was based on the factor of project workers making rcpeated multiple trips between the SGCS and Parachute and for the delivery of construction materials.

Construction operations would occur on a 5 to 6 day work schedule, with the normal working hours !fom 7:00 AM until 5:00 PM. The SGCS would remain in operation for approximately 30-years and the compressor station would operate 24-hours per day. During the operations phase of the projcct, personnel necessary at the site would be 2 to 4 plant operators, which normally work from 7:00 AM to 5:00 PM on a 5 or 6 day work schedule. No full-time employees arc located on-site. The compressors arc monitored remotely from EnCana's Parachute Officc. Operation of the SGCS would not result in any additional impacts to county roads. The tahles below provide a list of the type of vehicles accessing the SGCS during the construction and operational phases of thc project and the estimated traffic impacts to Garfield County Road 215.

I. APPLICATION SUBMITTAL REQUIREMENTS As a minimum, specifically respond to all the following items below and attach any additional infonnation to be submitted with this application:

1. Please submit, ill narrative form, the nature and character of the Special Use requested. Submit plans and s/lpporting information (i.e. letters from responsible agencies). Include specifications for the proposed lise including, bllt not limited to, the hours of operatioll, the number and type of vehicles accessing the site on a daily, weekly alld/or monthly basis, alld the size ami location of any existing alld/or proposed structures that will be used ill conjunction with the proposed use, and provisiolls for electric power service alld allY other proposed utility improvements. Be specific.

EnCana Oil & Gas (USA) Inc. (EnCana) requests a Special Use Pern1it (SUP) from the Garfield County Board of County Commissioners (BOCC) for the construction, operation, and maintenance of the proposed Story Gulch Compressor Station (SGCS). The proposed location of the SGCS straddles the southern edge of Section 34, Township 6 South, Range 96 West, and northern edge Section 3, Township 6 South, Range 96 West, of the 6th Principal Meridian. The compressor station is located approximately 12 miles northwest of Parachute, Colorado. The proposed SGCS is located on a 7.2 acre parcel of EnCana owned property, which is part of the EnCana's 45,000 acre North Parachute Ranch (NPR) property. The SGCS would provide an additional natural gas processing facility to accommodate both future and current natural gas volumes being produced in the Piceance Basin.

The SGCS would consist of 14 natural gas engine driven, electric driven, or a combination of natural gas driven and electric driven compressors; 14 air coolers; an outdoor electrical substation; two power distribution centers (PDC); a generator building; launcher/receivers; four slug catchers; a three-phase separator vessel; four glycol regenerator units; four glycol contactors; one blowdown stack; eight 1200 barrel (bbl) liquids storage tanks and vapor recovery units; liquids storage vessel; pump building; fuel gas building; and one control maintenance building.

Based on current projected volumes, EnCana will install two natural-gas driven engines in 2009. As natural gas volumes increase, EnCana will install additional compression. At completion, the SGCS will have up to 14 natural-gas driven compressors and related ancillary equipment. EnCana will utilize electric-driven engines when feasible and requests approval to exchange natural-gas driven engines for electric-driven engines when feasible as part of this SUP approval.

Please note that actual number of compressor engines installed for any given year is an estimate based on today's current and anticipated production volumes and is considered a forward­looking statement. As described above, EnCana would install the compressors in phases over the next several years. A portion of the expansion would be completed in 2009 and the remainder of the expansion would be installed at a later date. Actual number of compressors and installation dates may be accelerated or delayed based on field development. The intent of this Special Use Pemlit application is to allow for the expansion in its entirety to be considered within this application.

The gas-driven compressor units will be installed outdoors as temporary units until they can be replaced by electrical units. As gas-driven compressor units are replaced with electric-driven units, the electric-driven compressor units will be enclosed within a building referred to as the Inlet Gas Compressor Building # I and the building dimensions are approximately 60-feet by 300-feet. The electric-driven compressor units will be powered by the substation and PDC buildings, which will receive power from a new 230,000 volt power line, which will be constructed from EnCana's Middle Fork Compressor Station. The substation and power distribution centers will house the electrical transfomlers and equipment needed to regulate the 230,000 volt power line and distribute the electrical power to the electric-driven compressors and facility equipment. The substation will contain outdoor equipment to step-down the 230,000 volt power to lower voltages that will be distributed to the electrical motors through the electrical equipment housed in the PDC buildings. The two PDC buildings will be next to the substation and the dimensions for the two power distribution centers will be 20-feet by 80-feet. The generator building will house a backup electrical generator and the building will be 30-feet by 60-feet. The pump building is necessary to handle liquid products and the dimensions of the pump building will be 20-feet by 40-feet. The fuel gas building will contain equipment to supply fuel gas to the on-site equipment and the dimensions will be 8-feet by 20-feet. The control maintenance building will provide a location for the plant operators to monitor the operation of the compressor station and control natural gas processing equipment. The control maintenance building will include a unisex restroom and wash station and the building dimensions will be 60-feet by 60-feet.

EnCana will attain grading and building permits from the Garfield County Building and PlaID1ing Department before the start of construction activities at the SGCS. Site plans and drawings for the SGCS are provided in the Site Plan Tab.

2. If you will be using water or will be treating wastewater ill COil junction with the proposed use, please detail the amount of water that would be used and the type of wastewater treatment. If you will be utilizing wel/water, please attach a copy of the appropriate well permit ami any other legal water supply informatiou, including a water allotment contract or ((11 approved water augmentation plan to demonstrate that you have legal and adequate water for the proposed use.

POliable toilets will be available on-site and potable water will be transported from off-site and made available to personnel during the construction of the SGCS. The portable toilets will be maintained throughout construction, until permanent sanitation and water utilities are installed. EnCana is planning to install a 100 bbl fresh water cistem and a 750 gallon septic tank and leach field at the SGCS, upon approval of the SUP from the Garfield County BOCC. A unisex restroom facility and wash station is being proposed in the maintenance building. EnCana will

submit an Individual Septic Disposal System Permit to the Garfield County Building and Planning Department. The proposed septic system is currently designed to a percolation rate of 60 min/inch, which is the slowest absorption rate and the septic system will be designed based on the percolation test and engineer's recommendations. Potable water provided at the SGCS will include bottled water and potable water stored in the 100 bbl fresh water cistern. EnCana will use Colorado Department Public Health and Environment (CDPHE) certified potable water haulers to transport water to the SGCS.

3. Submit a site plan / map drawn to scale that portrays the boundaries of the subject property, all existing alld proposed structures 011 the property, alld the COllllty or State roadways withill one (1) mite of your property. If you are proposing a Ilew or expanded access onto a Coullty or State roadway, submit a driveway or highway access permit.

A copy of the site plan and topographic map are provided in the Site Plan Tab. The SGCS is located approximately 12 miles north of Parachute, Colorado on the south side of Divide Road. EnCana will construct a gravel driveway off of Divide Road to enter the site. EnCana will submit and attain a Garfield County Driveway Permit before the start-up of construction activities.

4. Submit a vicinity map showillg slope / topography of YOllr property, for which a U.S. G.S. 1 :24,000 scale quadrangle map will suffice.

An 8.S-inch by II-inch topographic map and a 24-inch by 36-inch area topographic map of the SGCS are provided in the Site Plan Tab.

5. Submit a copy of the appropriate portion of a Garfield County Assessor's Map showing all the subject property and public and private landowners adjacellt to your property (which should be delilleated). III addition, submit a list of all property OWllers, public alld private landowners and their addresses adjacent to or within 200 ft. of the site. This information can be obtained from the Assessor's Office. We will also need the names (if applicable) of all mineral right owners of the subject property. (1) Utilities adequate to provide water aJ/{1 sallitation service based 011 accepted ellgineering standards ami approved by the Board of Coullty Commissiollers shall either be in place or shall be cOllstructed ill cOlljunctioll with the proposed use.

Portable toilets will be available on-site and potable water will be transported from off-site and made available to personnel during the construction of the SGCS. The portable toilets will be maintained throughout construction, until permanent sanitation and water utilities are installed. EnCana is plalming to install a 100 bbl fresh water cistern and a 750 gallon septic tank and leach field at the SGCS, upon approval of the SUP from the Garfield County BOCC. A unisex restroom facility and wash station is being proposed in the maintenance building. EnCana will submit an Individual Septic Disposal System Permit to the Garfield County Building and Planning Department. The proposed septic system is currently designed to a percolation rate of 60 min/inch, which is the slowest absorption rate and the septic system will be designed based on the percolation test and engineer's recommendations.

(2) Street improvemellts adequate to accommodate traffic volume genel'llted by the proposed lise and to provide safe, cOllveniellt access to the use shall either be in place or shall be cOllstructed ill cOlljunction with the proposed use.

The SGCS is located approximately 12 miles north of Parachute, Colorado on the south side of Divide Road which is in Rio Blanco County. Access to the site in Garfield County is via County Road 215 to EnCana's private property and no additional improvements are required.

(3) Desigll of the proposed use is orgallized to minimize impact 011 and from adjacellt IIses of land through installation of screell fellces or lalldscape materials on the periphery of the lot alld by locatioll of intensively utilized areas, access points, lighting and signs in such a manner as to protect established neighborhood character;

The proposed SGCS is located in a developing oil and gas industrial setting, and minimal visual impact would occur to the general public or adjacent property owners from the construction and/or operation of the SGCS. The nearest residence is more than 8 miles away. Installation of the compressor station would not change the existing neighborhood character.

5.03.07 Industrial Operations: Industrial Operatiolls, including extraction, processing, fabrication, industrial support facilities, mineral waste disposal, storage, sanitary landfill, salvage yard, access routes and utility /illes, shall be permitted, provided:

(1) The applicallt for a permit for industrial operations shall prepare and submit to the Planlling Director ten (10) copies of an impact statement 011 the proposed use describing its location, scope, design and constructioll schedule, including an explanation of its operational characteristics. One (I) copy of the impact statement shall be filed with the COl/My Commissioners by the Planning Director. The impact statement shall address the following:

(A) Existing lmvfitl use of water through depletion or pollution of surface run-off, stream flow or groundwater;

EnCana has prepared and utilizes the Story Gulch Stonnwater Management Plan (SWMP) and the Spill, Prevention, Control and Countenneasure Plan (SPCCP) for Gas Gathering Facilities. Implementation of these plans ensures that activities comply with stonnwater management and spill prevention controls and countenneasures as required by Garfield County, the State of Colorado, and the United States Environmental Protection Agency. Implementation of these plans also ensures that EnCana would not pollute surface runoff, stream flow, or groundwater. Copies of the SWMP and SPCCP are provided in the Stonnwater and SPCCP Tab.

(B) Impacts on adjacent land from the generation of vapor, dust, smoke, noise, glare or vibration, or other emanations;

No smoke or glare would be produced as a result of this project. Minor vibration would occur from operation of the compressor engines; however, vibrations would not be noticeable at the property line. Equipment operation would produce vapor, which is a standard by-product of equipment operation. EnCana would apply water, gravel, tackifier, or other equivocal measures as necessary to prevent fugitive dust emissions from equipment and/or vehicles traveling in the project area.

EnCana has completed a sound level study for the proposed SGCS, which will be operated in compliance with Colorado Oil and Gas Conservation Commission (COGCC) regulations. After construction of the SGCS, EnCana will perfolli1 an additional sound level survey. If operations exceed COGCC regulations, EnCana would install sound mitigation equipment as necessary to meet COGCC regulations. Sound mitigation measures could include a combination of residential grade silencers over fans, pre-fabricated steel buildings over compressors and drivers, and/or installation of other sound mitigation equipment. The sound level survey is provided in the Supporting Documentation Tab.

EnCana is currently in the process of submitting applications and acquiring air quality penn its from the CDPHE Air Pollution Control Division for the proposed SGCS. The air pennits will

not be attained until early to mid 2009. Copies of the air pemlits will be provided to the County as they are received.

(C) Impacts Oil wildlife alld domestic allimals throllgh the creatioll of hazardous attractiolls, alteration of existing lIative vegetatioll, blockade of migratioll routes, lise pattems or other disruptiolls;

EnCana contracted WestWater Engineering Inc. to prepare a Wildlife Assessment and Mitigation Plan for the proposed SGCS, which is included in the Supporting Documentation Tab.

(D)Ajjirmatively show the impacts of trllck alld automobile traffic to and from sllch IIses and their impacts to areas in the COUllty;

The construction of the SGCS would require a workforce of approximately 50 to 75 personnel over a period of 5 to 7 months. Construction crews would access the site via the Sprague Gulch Road off of Rio Blanco County Road 5 and to a lesser extent Garfield County Road 215. Access via 215 ends at EnCana's Guard shack and the road passes through EnCana property and crosses Exxon property as well. Access is estimated to be 25 percent on CR 215 and 75% on Sprague Gulch.

Automobile traffic along Garfield County Road 215 would increase by approximately 12 to 25 vehicle roundtrips per day dUling the peak construction period, which would last approximately 4 to 6 months. The consideration for approximately 25 vehicles accessing the site per day was based on the factor of project workers making repeated multiple trips between the SGCS and Parachute and for the delivery of construction materials.

Construction operations would occur on a 5 to 6 day work schedule, with the normal working hours from 7:00 AM until 5:00 PM. The SGCS would remain in operation for approximately 30-years and the compressor station would operate 24-hours per day. During the operations phase of the project, personnel necessary at the site would be 2 to 4 plant operators, which normally work from 7:00 AM to 5:00 PM on a 5 or 6 day work schedule. No full-time employees are located on-site. The compressors are monitored remotely from EnCana's Parachute Office. Operation of the SGCS would not result in any additional impacts to county roads. The tables below provide a list of the type of vehicles accessing the SGCS during the construction and operational phases of the project and the estimated traffic impacts to Garfield County Road 215.

The nearest residence is approximately eight miles to the southeast of the proposed SGCS. The remaining abutting property owners are also involved and currently operating natural gas processing or mineral extraction facilities, so no additional impact would occur to the abutting property owner from the construction and/or operation of the SGCS.

(F)Mitigatioll measures proposed for all of the foregoillg impacts identified alld for the standards identified ill Section 5.03.08 of this Resolutioll.

No mitigation measures are proposed. EnCana will implement m1tIgations measures recommended by the Garfield County BOCC and Building and Planning Department.

(2) Permits //lay be granted for those lIses with provisiolls that provide adequate mitigatioll for the followillg:

(A) A plall for site rehabilitation must be approved by the COllnty Commissioners before a permit for conditiollal or special use will be isslled.

Prior to abandonment of the SGCS, EnCana would contact the Garfield County Planning Director to arrange for a meeting and joint inspection of the SGCS. This meeting and inspection would take place a minimum of 30 days prior to abandonment, and would be held so that an agreement on an acceptable abandonment plan can be reached.

EnCana will complete final reclamation measures in areas that are not necessary for operation of the compressor station facility. The majority of the disturbed areas at the SGCS will be hard­scaped with gravel to facilitate compressor station operations. EnCana has developed the North Parachute Reclamation Plan to reclaim disturbed areas as a result of constructing well pads, access road, compressor stations, and pipelines. The NPR Reclamation Plan is included in the Supporting Documents Tab.

EnCana will comply with the standards contained in Section 5.03.08 of this Resolution.

5.03.08 Industrial Performance Standards: All industrial operations in the County shall comply with applicable County, State, and Federal regulations regulating water, air and noise pollution and shall not be conducted in a manner constituting a public nuisance or hazard. Operations shall be conducted in such a manner as to minimize heat, dust, smoke, vibration, glare and odor and all other undesirable environmental effects beyond the boundaries of tfte property in which such uses are located, in accord witft tfte following standards:

(1) Volume of sound generated shall comply with the standards set forth in tlte Colorado Revised Statutes at the time any new application is made. (A. 93-061)

EnCana would provide vibration mitigation to meet all vibration regnlation requirements. Vibrations would not be noticeable at the fenced property boundary at the SGCS.

(3) Emissiolls of smoke and particlliate matter: every use shall be operated so as to comply with all Federal, State alld COUllty air quality laws, regulatiolls and stalldards;

Smoke would not be produced as a result of this project. EnCana would apply water, gravel, tackifier, or other equivocal measures as necessary to prevent fugitive dust emissions from equipment andlor vehicles traveling in the project area. EnCana is currently applying for and acquiring air quality pem1its from the CDPHE Air Pollution Control Division for the proposed SGCS. The air permits will not be attained until the early to mid 2009.

(4) Emissioll of heat, glare, radiatioll and fumes: every use shall be so operated that it does not emit heat, glare, radiation or ji/mes which substalltially illterfere with the existing use of adjoilling property or which cOllstitutes a public Iluisance or hazard. Flaring of gases, aircraft wamillg signals, reflective paillfing of storage tanks, or other such operatiolls which may be required by law as safety or air pollution control measures shall be exempted from this provisioll;

Ancillary facilities may produce heat during operation of the SGCS. Heat produced would be minimal and would not be detectable at the SGCS propeliy boundary. No glare, radiation, or fumes would be produced. Adjacent property would not be affected and a public nuisance or hazard would not be created.

(5) Storage area, salvage yard, sallitary landfill and milleralwaste disposal areas (A 97-J12)

A) Storage of flammable or explosive solids or gases shall be ill accordance with accepted standards alld laws and shall comply with the lIational, state alld local fire codes and writtell recommendatiolls and/or comments from the appropriate local protection district regarding compliance with the appropriate codes; (A97-112)

Storage tanks are located on-site and each tank will store approximately 1200 barrels (bbls). Storage is in accordance with EnCana's SPCC Plan.

Flammable and combustible liquids and gases will be stored in accordance with accepted standards and laws and will comply with the national, state, and local fire codes and written recommendations and/or comments from the appropriate local protection district regarding compliance with the appropriate codes.

(B) At the discretion of the County Commissioners, all olltdoor storage facilities may be required to be enclosed by felice, landscapillg or wall adequate to cOllceal such facilities from adjacent property; (A97-112)

EnCana will implement recommendations or requirements for fencing, landscaping, and walls from Garfield County BOCC or Building and Planning Department to conceal or minimize visual impact to adjacent property owners from the construction and operation of the SGCS.

No waste products or materials will be deposited at the SGCS in a fonn or manner that will allow off-site transport.

(D) Storage of Heavy Equipment will only be allowed subject to (A) and (C) above alld the followillg stalldards: (A97-112)

The SGCS will be located on EnCana owned property, which consists of approximately 45,000-acres and the facility is zoned resource lands not within a platted subdivision.

2. The equipment storage area is IIOt placed allY closer thall 300 ft. from any existillg residelllial dwelling.

No residential buildings are located within 300-feet of the proposed SGCS. The nearest residence is approximately eight miles southeast of the facility.

3. All equipment storage will be enclosed in all area with screellillg at least eight (8) feet in height and obscured from view at the same elevatioll or lower. Screenillg may include bennillg, landscapillg, sight obscuring fencillg or a combillatioll of allY of these methods.

Visual impact is non-existent because of the location of the SGCS. The facility is located on top of a plateau within a 45,000-acre parcel and is not visible to the general public.

Compressor engines and ancillary equipment would be temporarily stored at the SGCS. Temporary storage would no longer be needed once the compressors and ancillary equipment are installed. After construction is complete, routine maintenance and repair items would be stored on-site. Storage of heavy equipment would not be allowed at SGCS, except during installation ofthe compressors.

Lighting will be provided at the SGCS. Lighting will be directed downward and inward to prevent direct reflection on adjacent property.

All percolatioll tests or groulld water resource tests as may be required by local or State Health Officers must be met before operatioll of the facilities may begin.

EnCana has prepared and utilizes the NPR SWMP and the SPCCP for Gas Gathering Facilities. Implementation of these plans ensures that activities comply with stormwater management and spill prevention controls and countermeasures as required by Garfield Connty, the State of Colorado, and the United States Environmental Protection Agency. Implementation of these plans also ensures that EnCana would not pollnte surface runoff, stream flow, or groundwater. Copies of the SWMP and SPCCP are provided in the Stormwater and SPCCP Tab.

10. A $400.00 Base Fee: Applicallt shall sign the "Agreemellt for Paymellt" form and provide the fee with the application.

The $400.00 base fee is included with the SUP Application submittal.

11. Submit 12 copies of this completed application form alld all the required submittal materials to the Buildillg and Plallnillg Departmelll. Staff will request additiollal copies ollce the Special Use Permit applicatioll has been deemed techllically complete.

EnCana has submitted two copies of the completed application form and all the required submittal material to the Garfield County Building and Planning Department. EnCana will provide additional copies of the SUP application to the Building and Planning Department once the application is deemed technically complete.

II. PROCEDURAL REQUIREMENTS (The following steps outline how the Special Use Pennit Application review process works in Garfield County.)

1. Submit this completed application form, base fee, and all supplemental information to the Garfield COUllty Planning Department. It will be received alld givell to a Staff Planner who will review the application for technical completelless.

2. Once the application is deemed technically complete, the Staff Planner will send you a letter indicating the application is complete. In addition, Staff will also send you a "Public Notice Form(s)" indicating the time and date of your hearing before the Board of County Commissioners. Prior to the public hearing, Staff will provide you with a Staff Memorandum regarding your requested Special Use. (If Staff determines you application to be deficient, a letter will be sent to you indicating that additional information is needed to deem your application complete.)

3. It is solely the Applicant's responsibility to ensure proper noticing occurs regarding the requested Special Use and the public hearing. If proper notice has 1I0t occurred, the public hearing will not occur. Notice requirements are as follows:

a. Notice by publication, including the name of the applicant, description of the subject lot, a description of the proposed special use amlnatllre of the hearing, and the date, time and place for the hearing shall be given once in a newspaper of gelleral circulation in that portioll of the County in wldch the subject property is located at least thirty (30) but not more tlUIIl sixty (60) days prior to the date of such hearing, and proof of pUblication shall be presented at hearing by the applicant.

b. Notice by mail, containing information as described under paragraph (1) above, shall be mailed to all owners of record as shown in the County Assessor's Office of lots within two lllllldred feet (200') of the subject lot aud to all owners of mineral interest in the subject property at least thirty (30) but not more than sixty (60) days prior to such hearing time by certified return receipt mail, and receipts shall be presented at the hearing by the applicant.

c. The site shall be posted such that the notice is clearly and conspicuously visible from a public right-of-way, with notice signs provided by the Planning Department. The posting must take place at least thirty (30) bllt not more than sixty (60) days prior to the hearing date and is the sole responsibility of the applicant to post the notice, and ensure that it remains posted until and during the date of the hearing.

4. The Applicant is required to appear before the Board of County Commissioners at the time and date of the public hearing at which time the Board will consider the request. III addition, the Applicant shall provide proof, at the hearing, that proper notice was provided.
