Sting court dispute could threaten pop music publishers THE HIGH Court case in which Sting of The Police is suing Virgin music for the return of £700,000 and the return of his song copyrights could threaten the whole basis of the pop publishing business. It follows hard on the heels of Gilbert O'Sullivan's successful retrospective case against the MAM group of com- panies in which he was awarded his copyrights, masters, and all the profits made from them under contracts that ran out four years ago. MAM is appeal- ing against the judgement. A deal was struck between Sting and Virgin when the singer was in an unknown group called Last Exit. It gave Virgin copyright of his songs and enti- tled him to 50 percent of the royalties they generated for the first three years of he contract, and 60 percent during the last two. The best-sellers Outlandos d'Amour, Regatta De Blanc and Zenyatta Mondatta fell within the period of the contract, which ran out on October 6 last year. Yet, according to Sting's counsel Andrew Bateson QC, Virgin had re- fused the singer a recording contract and had made £700,000 from the Police's success with A &M without doing any- thing to earn it. "The contract meant that the company had no obligation to ensure the music was recorded - and they did nothing," said Bateson. Police's A&M deal was said to have been the result of hard work by manager Miles Copeland. Sting told Mr. Justice Mars -Jones that he had not understood a word of the publishing contract and never suspected there was anything wrong with it. He said it was only at the insistence of his wife that a solicitor was consulted, and that he did not get involved in the legal discussions. It was after signing with A &M that Sting was advised that his publishing contract was less than it should be. Copeland advised him to 'get out of the deal' but when he asked for better terms, the then managing director of Virgin Music Carol Wilson did not improve the deal. Virgin is contesting the case, which is scheduled to last for at least a fortnight. Fears that there might be a rash of similar court cases over publishing contracts were being played down by publishers last week, although there is thought to be at least one dispute looming, between a major songwriter and his publisher over a 50-50 contract. quits to launch own TV merchandising firm COLIN ASHBY, managing director of K-tel and a&r manager Nigel Mason have resigned and are setting up their own TV merchandising company. To be known as TV Records, the Arista to import all albums from Germany ARISTA ALBUMS will be pressed in West Germany by associated company Sonopress with immedi- ate effect, although distribution will continue through PolyGram in the UK. Arista and Chrysalis Records - the Tandem partnership - have just renewed their manufacturing and distribution agreement with PolyGram for a three year period. Under the new terms PolyGram will manufacture and distribute all Chrysalis product, but manufac- ture only 7 -inch and 12 -inch singles for Arista. Arista is now utilising the facili- ties of major German plant Sonop- ress for album and cassette require- ments, delivering to PG for dis- tribution in the UK. The German plant has facilities for 250,000 albums and 180,000 cassettes per day. "Even in the peak peak period we can press as required cutting down the stock risk which we would face because of the lack of capacity in the UK," said David Adams, com- mercial manager of Eurodisc.     Managementtakes Haircutto courtHAIRCUT ONE Hundred face a courtbattle over management with a companynamed Testfold Ltd claiming in theHigh Court that the group is still boundin a contract which the group says isended.

    The dispute came before Mr JusticeGoulding last Monday and proceedingswill continue on July 28, althoughprogress is bound to be hampered by thefact that the group is on tour in America.

    Testfold, the company run by CarlAdams, told the court that the grouphad agreed to pay 20 percent manage-ment fees. Since April the arrangementthrough which the company collectedearnings on behalf of the group hadbroken down.

    Haircut One Hundred, who claim tobe self -managed now, maintain that theoriginal agreement was signed underpressure. This is denied by Testfold.

    The company is seeking an interiminjunction banning the group fromcollecting money for their perform-ances.

    Poor attendance at RAVRO revitalisation meetingWITH A London attendance of just 19people the revitalisation of the Recordand Video Retailers Organisation got offto a muted start last Wednesday.

    Those 19 present represented onlyeight retail concerns and the meetingbegan with just four dealers present, astate of affairs which new chairman Alan

    Davison described as "So poor I can'tbelieve it. I'm disgusted."

    Six thousand invitations were sent outfor the London meeting, and the follow-ing night's Northern gathering in Birm-ingham.

    The meeting was, however, not with-out constructive debate. Dealers agreed

    Jan -March figuresreveal buoyant 45SIGNIFICANT CONTRIBUTIONSfrom the independent labels made surethat singles sales were the bright spot inthe BPI's quarterly sales survey figuresrevealed last week.

    However, album sales continued theirdownward trend and the generally opti-mistic recent performance of pre-re-corded cassettes suffered a slow -down.And a moving annual total of tradedividends reveals that since March 1979shipments to the stores have declined by22.1m albums, worth almost £22 mil-lion.

    Despite a 14 percent price increase onsingles over the January -March periodthe previous year, singles delivered tothe trade increased by seven percent andtheir value was up by an impressive 22percent at £14.8 million during thequarter.

    "Product has been sufficiently strongto bear a 14 percent average priceincrease during the past 12 months,"commented BPI director general JohnDeacon. "Several of the smaller inde-pendent companies have contributedsignificantly in helping to maintain astable and healthy singles market."

    LP sales declined by five percent inthe same period, and Deacon blamedhome taping and the high level ofunemployment in the record industry'sprime markets -a million people under25 are jobless.

    The unequal struggle is pointed up bythe increase in album prices of just sixpercent in the past year. Less than 12

"We can offer them a com-plete marketing service, including thepurchase of TV time at attractive rates,"said Ashby.

    TV Records has retained MichaelBungay/DFS as its time -buying adver-tising agency. The company lookedafter K-tel's needs until three years ago.Distribution, pressing, printing, salesand promotion will be undertaken on acustom basis as required.

    With question marks hanging overthe future of TV -promoted repertoire,as screentime costs increase but volumelevels decline, Ashby reckons that histiming is perfect to take advantage ofchanging market conditions. "There isplenty of excellent repertoire around,particularly among the independentlabels. We will be looking towardscompilation albums aimed at youngsterswho have been passed over becausevolume was regarded as inadequate -but it will be fine for us. We also want toproject releases at the 20-30 year -oldmarket. And we shall be after exclusivetracks."

    TV Records will release two albumsin September and a total of five beforethe end of the year. "We want the tradeto have the same confidence in us that ithas in K-tel," said Ashby. "That meanswe will not make any false claims aboutour advertising spend, we will carry outour TV campaigns as announced andwhen we say we are going national wewill mean it."

    "The fact that cassettes have beenable to bear substantial price increasessuggests that they are perceived in adifferent light by consumers now. Im-proved quality has probably helped thecassette to move up market, and theratio between LP and tape sales is nowless than two to one," summed upDeacon.

    "The overall value of trade deliveriesin the first quarter was £55.4 millioncompared with £50.2 million in the sameperiod last year. This is an increase of10.4 percent and less than one percen-tage point lower than the rate of inflationand a fairly promising sign."

    Another way in which small dealerscan compete, it was suggested, was todiversify and use greater skill andexperience to provide the public with aservice which went beyond simply sell-ing chart material.

    Staff axed asRocket plansretrenchmentELTON JOHN'S Rocket Records hasbecome the latest casualty of the recordindustry recession.

    Staff were told last week that thecompany will be severely pruned fromSeptember 1 with a total of sevenredundancies forecast. The only recordlabel executives to survive the cut -backwill be managing director John Hall andinternational manager Robert Kev.

    Of the six -strong artists roster - apartfrom Elton John - there are hints thatmost will be dropped apart from oneunspecified act. The company is alsodue to leave its plush Lancaster Gateoffices in the Summer and move to newpremises in Kensington.

    Rocket chief John Reid broke thenews to staff last Wednesday, blaming,"the economic pressures that beset theindustry at present particularly licensedlabels."

    "Companies like this don't makemoney any more," added John Hall."We are the last of a dying breed, and wefell between two' stools. We had largeoverheads and were faced with a situa-tion where we had to come up withregular major hits."

    Elton John will continue on theRocket label, but will be more closelyallied with Phonogram International, towhom the label is licensed, while RocketPublishing and John Reid Enterprisesare both unaffected by the changes andwill continue operating as before.

    BPI tells Govt, that tape levywould not damage blank salesALTHOUGH THE BPI continuesto fight shy of saying how much itwould like to see levied on blanktape, the body's detailed submis-sion to the Government, followingthe last year's copyright GreenPaper, yields some clues.

    The results of research carriedout by financial consultants Ernstand Whinney indicate that "Thatsort of levy the music industryproposes would not have anymarked effect on blank tape sales."

    The BPI is in favour of a levy onblank tape being fixed by an inde-pendent tribunal which will bear inmind the possible impact on the

    blank tape industry. But its submis-sion continues: "There would haveto be a very substantial levy indeedbefore the sale of blank tapes isseriously affected."

    Given that the average retailprice of a C90 tape - the mostpopular format for home taping - isaround £1.10, Ernst and Whinney'sfigures calculate that only when alevy approaches an extra £2 pertape that sales would fall dramati-cally. A 50p levy would only reducethe tape market by 2.8 percent,while a £1 surcharge might reduce itby 5.8 percent.

  • MUMAGSALIVE AND well and living in Ilford, where until a couple of months ago she wasworking in a sweet shop is the singer who is currently Number One in Australia,having previously hit the peak in the UK and Canada and only just missed it inAmerica. The record is, of course, 'I've Never Been To Me' by Charlene (need'Angelo) who actually cut the record in 1976, five years before she married herEnglish husband and settled in the east London suburb, having quit the businessin 1980. Everybody had forgotten about the record until a dj in Tampa, Floridabegan playing it and found it was winning positive listener response. Motowntracked Charlene down and re-signed her. The record went on to become thelabel's first by a white singer to make the American top ten. At the end of themonth she's off to the States to record a duet with the redoubtable Stevie Wonder.

    INDUSTRY EXECUTIVES attending recent previews of forthcoming Wool-worth promotion activities impressed to learn that sales of discs and tapes are nowsecond only to confectionery in the chain's product packing order . . . AndrewBateson looks like becoming the industry's favourite brief. After representing thePPL in those interminable Performing Right Tribunal hearings over AIR's appealagainst needletime payments, the QC then represented Gilbert O'Sullivan in hiscase against MAM and has now been recruited by Sting for the battle againstVirgin Music, a hearing incidentally before Mr Justice Mars Jones, the judge whoconducted the MAM-O'Sullivan case. Worth noting, too, that last week VirginMusic had the number one UK album (ABC), number one US single (HumanLeague) and number one LP in Germany (OMD) . . . further departures from theCBS marketing department - label managers Pete Winkelman and John Mais,both heading in the direction of A&M and Rondor, respectively . . . A&M, by theway, is hosting a swanky party, entitled Burf's Decayed, next week to mark TonyBurdfield's ten years with the company. A well deserved tribute - but isn't it a signof the times that once these events used to be held to mark at least 20 years with thefirm . . . also on the party beat, at the end of business last week, BASCA laid on asurprise luncheon for chairman Jimmy Kennedy to mark his 80th birthday, whichhe actually celebrates on July 20.

    Virgin chainFROM SEPTEMBER, the VideoPalace - the video distribution and retailoperation set up by former Virginfinance director Nik Powell - is to stockall Virgin shops with a 500 -strong rangeof music, cult, and feature film videocassettes.

    The racking arrangement was agreedlast week between Powell and Virginretail managing director Steve Mandy.

    The September launch will take placeat Virgin's Edinburgh, Peterborough,Portsmouth and Plymouth outlets, to berapidly followed by the other 17 shops inthe chain in groups of four.

    Initially all video titles will be avail-able for hire and for sale in the VHSformat, but as stock is increased andexpanded, other formats will come onstream.

    Re -structureattop of IFPIAPPOINTMENT OF Coen Solleveldas the IFPI's new president has beenfollowed by the restructure of theorganisation's top management.

    Ian Thomas, formerly joint actingdirector with Gillian Davies, becomesdirector general and chief executive.Gillian Davies has been names associatedirector general and chief legal advisor.

    Thomas has been with IFPI since1968, while Ms. Davies joined two yearslater.

    DONNA SUMMER'S new albumDonna Summer (K99163) is available ina limited edition picture disc and is thesubject of a major marketing campaignby WEA.     PU113111SHIIIGAS WELL as bringing about the demiseof Interworld's London office, ChappellInternational's big -dollars acquisition ofInterworld Inc. (predicted in this col-umn several weeks ago) has also promp-ted a major internal re -shuffle at Inter -song Music/UK - the company giventhe responsibility of handling Inter -world's US catalogues in Britain.

    A re -structuring of Intersong's pro-fessional department is now on thecards, it seems. And some departuresand new appointments could beannounced shortly, according to manag-ing director, Bruno Kretchmar. "Weare gearing up to meet the challenge thatthe Interworld acquisition presents," hesays.

    Apprently, some 95 per cent of the"thousands" of titles owned or control-led by Interworld are now in Chappell/Intersong hands worldwide. The other 5percent (mostly signed through Inter -world's London office) are still ownedby Arista Music/Careers Music in theUnited States - and now administered inthe UK by State Music (through itssub -publishing deal with the A riola-Arista publishing companies).

    Intersong's 'catch' comprises sometasty items - such as classic titles by Hall& Oates, Barry White, Jimi Hendrixand Randy Newman and 'pop stan-dards' like '24 Hours from Tulsa', 'Tie aYellow Ribbon Round the Old OakTree' and Lesley Gore's 'It's My Party'.Also transferred to Intersong after thesale are the rights to Interworld's pub-lishing deal with Lorimar Films whichincludes the soundtracks to major TVseries like Dallas and The Walton.

    The combination of Intersong's owncatalogue (which includes BruceSpringsteen titles), with Interworldcopyrights and the massive Burlington/Palace catalogues, which the companyacquired from Decca a couple of yearsago, now makes Intersong one of thebiggest publishing houses in LondonBut Kretchmar denies that the companyis developing into purely a collectionorganisation and a 'rest home' for oldcopyrights. He says the operation is stillvery much geared towards breaking newtalent.

    "Catalogues such as Interworld giveus a broader base from which to oper-ate," he says. "We can use them as a'springboard for our current activitiesand Burlington/Palace has alreadyproved that there is plenty of mileageleft in old catalogues. One of its 12 -year -old copyrights, 'Tainted Love', becamea huge hit last year. These cataloguesprovide the revenue that gives us anopportunity to do lots of things - such asbreak more new acts like the JulianMarshall/Deborah Berg group Eye ToEye which has now broken in the States- after two years of hard work."

    Jobete Music is another companywith a wealth of top quality material inits back catalogue that is seeing a lot ofaction at present. Apart from the Roll-ing Stones' version of 'Going To AGo -Go', and the six year old 'I've NeverBeen To Me', by Charlene, Hansa isnow putting out a specially re -mixedversion of Japan's cover of 'I SecondThat Emotion'.

    The Faulty familywhere artists are

    businessmen tooVERMILION AND The Aces andMenace may not be two of the mostmemorable bands of the '77 punkexplosion, but their respective leadinglights are alive and well and in thebusiness.

    Vermilion Sands and Steve Tannettare now working very hard organisingFaulty Products and its associated labels- Illegal, Step Forward, WXYZ andTotal Noise. Tannett has been withFaulty since the beginning in 1978,doubling as a warehouse boy and one ofthe acts. "It's been an education forme," he says, "I now do production,marketing, sales and a&r. It's like afamily in some ways, in a sense we'regrowing up, seeing how far you can takean indie label."

    Faulty retains only one of the originalbands, Gene October's irrepressibleChelsea. In the last six months they havecome from being, as Tannett puts it, a"no no" to releasing a well -receivedalbum and selling out gigs. The newerpunk orientated bands are doing evenbetter with the publicity surroundingthe notorious Anti -Nowhere League'scontroversial 'Woman' single, and theformation of the Lords Of The NewChurch.

    The company first became involvedwith The Lords last November whenBrian James released a solo single, 'WhyWhy Why'. Now the band's debutalbum, out on July 9, is being backed byFaulty's first big promotional push."We're doing fly -posting, radio andpress advertising", explains Sands."They'll also be a picture disc but it

    won't be any sort of hype. It'll be sold atthe correct price for a picture disc -about the same as a 12 -inch".

    Total Noise, the most recentlyformed label, is probably the mostinteresting. The two Total Noise EPsout so far consist of four tracks, two byfairly established bands and two byunknowns. "It's a great way to get bandsheard without losing money and withoutnecessarily making a fortune. The con-cept is no rules, no divisions, just totalnoise. I like noise," says Tannett.

    "I really believe in young bands andthe independent scene. It's stronger andmore important than its ever been,that's why we went back to it (Faulty arenow distributed by Pinnacle). We wantto work with the majors, rather thanagainst them though. It's no good not

    joining things like the BPI, we now havea voice, it's a healthy situation. As far asdistribution goes, I like to use the cartelas well as Pinnacle. We don't want tolose touch, the Rough Trades of thisworld are very important."

    Faulty Products are moving to newpremises (in the same W11 area ofLondon) in August, have a reasonablerelationship with their accountants anda very positive outlook. An instantprediction, Steve? "Chelsea will have ahit single. Definitely."

  • PEATURECommercial sponsorship of music has been slow catching on in Britain, but the success of the recent Rolling Stones tour&the reflected glory for its three sponsors may make the record industry think again. PAUL CAMPBELL talks to some ofthe people who are resposible for setting up sponsorship deals.

    Industry looks warily atcommercial sponsorshipBLANK TAPE manufacturer TDK,motorcycle company Piaggio and jeanmakers Lee Cooper are currently bask-ing in the glory of one of the world'sgreat musical events - the RollingStones tour.

    All three are major sponsors of theself-styled 'greatest show on earth' andas such will expect lucrative spin-ottsfrom their part in bringing the RollingStones to the public.

    In the case of TDK that success willbe seen in increased product awarenessand, of course, sales of tapes -a factorwhich has not gone unnoticed amongrecord companies.

    EMI in Germany could not have beenless pleased with the appointment ofTDK, or any other blank tape manufac-turer, at a time when it is preaching the`Home Taping Is Killing Music' mes-sage, but the Stones see sponsorship as anecessity.

    It costs around £5 million to put theStones on the road for a European tourand before Mick Jagger picked up hismicrophone he made surefinancial side was watertight.

    The Selling Of The Stones washandled by a UK company NightingaleMusic, a subsidiary of the BerkeleySquare -based West Nally, the giant of

    'sports sponsorship.TV presenter Peter West and

    businessman Patrick Nally are responsi-ble for sports events, trophies andcompetitions bearing the names of Gil-lette, Coca Cola, Cornhill and Benson &Heges, plus events such as the DavisCup.

    All the marketing of the World Cupwas handled by this company andNightingale is both a part of this giantand the independent concern of oneJohn Gaydon.

    Gaydon will be known in musiccircles as the 'G' in EG Managementwhich he co-founded and left to go intomanagement consultancy. He is also themanager of Godley & Creme.

    Godley & Creme are best known as arecording duo but they fit into Night-ingale perfectly because they are filmcommercial makers and designers ofsuch things as a range of sportswear forCoca Cola and a mascot for the Olympicmovement, to name just two projects.

    NIGHTINGALE WAS conceived threeyears ago when Gaydon met Nally inNew York. Nally mentioned that someof his clients were interested in music asan advertising medium and Gaydon hadthe wherewithal to bring it about.

    It began in Easter 1980 with a series of

    concerts at London's Rainbow Theatrewith Levi Strauss as the sponsor andincluded a special 50th anniversaryconcert at the theatre, starring ElvisCostello.

    This resulted in another LS promo-tion which took the form of a specialboxed set of records available only topeople who bought jeans in a certainperiod.

    TDK gets good billing onthe German programmefor the Rolling Stonestour. It treated theoccasion with its standardagressive marketingpower.

    Blondie would be a very attractive proposition for sponsors, says expert JohnGaydon.

    "I thought 'Great! sponsorship isgoing to take off, but things have beenrelatively quiet for two years. TheRolling Stones provided an ideal oppor-tunity said Gaydon.

    Nightingale heard that the Stones'business adviser Prince Rupert Lowen-stein was looking for sponsors and, incompetition with other companies,some of them UK -based, made the rightbid.

    It cost Nightingale a 'seven -figuredollar' sum and it then set about sellingoff the individual rights to variouscountries.

    "The Rolling Stones are perfect.Every country they visit they get frontpage newspaper spreads and any spon-sor would be pleased to get his nameassociated with that sort of act," saidGaydon.

    With the wide range of appeal whichthe Stones inspire the sponsor has muchto gain by giving away balloons, stickersand other gimmicks while taking spacein the programme and using banners onthe outside of the stadium telling thefans which firm had made it all possible.

    "The boom of the 60s and early 70s is

    over and there doesn't seem to the samesort of money to be made in music. Thecost of touring is particularly prohibitivebut is still important," he added.

    Gaydon sees the soulution to thisproblem in sponsorship and it is not justthe star names who could benefit.

    No doubt mindful of the antiAmerican stance of the new Germanbands, Levi Strauss organised a packagetour for three new bands in that country.

    "Why don't say, EMI, put out sixbands they have signed recently as apackage and attract a sponsor? Theresult could be something like `TDKbrings you the bands of tomorrow'?

    "People who buy records, buy jeans,drink Coke, smoke, drink are idealtargets for many of the large com-panies," he said.

    IN THE UK it was hoped for some timethat the Milk Marketing Board wouldsponsor the Stones tour. With Jagger'sfitness a major selling point Gaydonbelieves that the move would have baenan ideal complement to the `Gotta LottaBottle' campaign.

    When the MMB turned it down jeanmanufacturer Lee Cooper stepped in.

    "Why don't EMI put out six bands they have EMI also turned down the chance tosponsor the UK dates. In France & Italysigned recently as a package and attract a sponsor?" Piaggio, which makes Vespas, Gilera and

    - Bianci, saw it as the ideal opportunity to

    fight the Japanese bike invasion andSpanish dates had a number of supplier -sponsors, not least Ellesse, the T-shirtmanufactureres.

    The rest of Europe went to TDK whotreated the occasion with its standardaggressive marketing power. An in-store promotion with Stones tickets asthe prize left the German public in nodoubt that TDK was responsible for thetour.

    Gaydon sees no paradox in involvingblank tape manufacturers in the creativeside of music. "Maybe if the recordindustry adopted a similar marketingattitude it would do a lot better. Theyshould be spending money on researchand marketing; not on lawyers fightingtape manufacturers.

    He cannot understand why the UKcompanies haven't competed with theJapanese in manufacturing and market-ing their own blank tapes instead ofleaving the market almost exclusively tothe Japanese companies.

    So far Nightingales's sponsorshipdeals have included such things as musicfrom the Gillette Marathon, the Silk CutCountry Festival, and Placido Doming-o's 'El Mundial' official theme for theWorld Cup.

    "It is early days in the sposorshipmarket but I think it is a winner. I dothink that it is important there is amiddle man who knows the creativeneeds of the group and those of theadvertiser. Liaison between the groupand sponsor must be through a sym-pathetic channel," he said

    Gaydon sees the makers of jeans,tapes, video equipment, car companies,soft drinks, alcohol, tobacco etc as idealsponsorship targets.

    Groups like Blondie would be mostattractive to the sponsors although thereis no limit to the type and scale ofsupport. For instance would any com-pany be interested in naming the mainauditorium of the National Jazz Centreto be opened in London next year?

    black to becrediblePINK FLOYD: THE WALLTHE WALL is a truly nasty film.relentless in its pursuit of depicting theworst excesses of human behaviour, astudy of madness and the corruptingeffects of violence and alienation.Roger Waters' view of mankind istotally and morbidly hopeless. Heoffers no solutions, no hope for thefuture. Love, even that of a mother forherfatherless son, is depicted as beingunhealthy. The bleakness of Waters'vision is dramatically underlined at theend of the film when the wall issymbolically blown apart to reveal ascene on the other side no lessdesolate, with a young boy casuallyusing a molotov cocktail as a plaything.

    Confusing, overlong, always dis-turbing and frequently frightening inthe way the camera explicitly dwells onblood, rape, war, and rotting humanity,The Wall is obviously painfully auto-biographical. Waters message seemsto be that violence may be the onlyantidote to the claustrophobic way inwhich people's lifestyles are deter-mined.

    It catches up with Pink, a burned outrock star, in his hotel room in LosAngeles, living in his own private hell, ahair's breadth away from madness andsuicide. Lacking dialogue in the con-ventional sense, it leaps from presentto past. to nightmarish visions of thefuture, sequences regularly enhancedby Gerald Scarfe's monstrous anima-tion. Bob Geldoff, who plays Pink. isuninhibited and hugely impressive. Hisdestruction of the hotel room andsubsequent self -mutilation are two ofthe film's more chilling moments.

    Such is the awful fascination ofwhat's happening on the screen that itis not always easy to give properconcentration to Pink Floyd's music,but there are certainly occasions whenthe juxtaposition of visual and soundimages, both equally violent, make astunning impact on the senses.

    Brilliant though director Alan Par-ker's film is. it was good afterwards toget back into the street and find thatthere were still ordinary human beingswalking around. Hopefully its messagewill not be taken to heart by impress-ionable youth.

    JACKSON BROWNELondon, Hammersmith OdeonA SINGER and writer of enduringclass. Jackson Browne returned toLondon last week to play just over twohours of warmly -received music to anaudience that simply refused to let himleave the stage.

    Although he has never enjoyedgigantic sales success in Britain hissongs have a carefully -crafted, rolling

    feel to them that has a wide appeal,while the best of them 'Before TheDeluge', 'Song For Everyman' and theepic 'The Pretender' have a grippinglyrical intelligence that overcomes anyEnglish prejudice against the LAschool of singer songwriters. Add tothat a typically high quality Americanband boasting, among others, the goldchip names of Russ Kunkel on drums,Danny Kortchmar on guitar and atalented slide player filling the spotusually occupied by David Lindleycalled Rick Vito, and a stage soundthat rarely fell below the outstanding,and the evening was bound to be asuccess.

    Browne took the opportunity to pre-mier a couple of new songs of which`Lawyers In Love' looks set to becomea favourite, although a stiff -leggedsemi -reggae number 'Tender Is TheNight' was not so successful. In finevoice, Browne accelerated a bit to-wards the end of the long concert with`Running on Empty and 'Doctor MyEyes' before climaxing with the classicroad song 'The Load Out', segueinginto 'Stay' and returning for an ex-tended run of encores.

    THE CLASHBrixton, Fair DealTHE BRIXTON Fair Deal is a con-verted cinema in the grand old tradi-tion. Very large, extremely ornate. andcapable of getting packed to the gills ifthe right band is on. Even on WorldCup final night the Clash managed tomake the gigantic auditorium socrowded that a fair proportion of theaudience would thankfully havechanged places with the teams sweat-ing it out in the Bernabeu stadium.

    The fans - a surprisingly widecross-section of humanity - had a longwait before some taped Ennio Morri-cone machismo heralded the appear-ance of the band. Strummer. nowseverely tonsured in a semi -Mohicanand looking as angry as ever after hisdisappearing act, was eager to get onwith the show, cranking out the chordsto 'London Calling' before the cheershad died down. New to the band wasTerry Chimes, who replaced TopperHeadon on drums shortly after Strum-mer's return. and who has obviouslyslotted into the scheme of thingsperfectly.

    Material ranged over the band's nowextensive and varied repertoire. takingin plenty of reggae and some funk aswell as straightforward punkythrashes, but the emphasis was onsloganeering as always - it's theClash's secret weapon and its particu-lar expertise. If more of the first wave ofpunk bands had been able to expressthe moods of the times in simple,shout -a -long hooks, more might havelived to tell the tale. 'Know Your Rights'is a good example. The various pointswere emphasised by a very good (andexpensive) light show and a selectionof back -projected slides of riots, urbanwarfare, rastafarian heroes and othermodern cultural ikons. In their current'Rock The Kasbah' mood. Clash lookgood for another six years or so.barring more disappearances.

    Disco DealerA surprisingly static top end to thedisco chart this week, as Odyssey andShalamar hold off all corners withease, and Imagination once again havejust failed to take the chart top.Possibly due to the late arrival of12 -inch pressings in some areas, IreneCara's 'Fame', despite its number onepop success, has been held at number3. The album, however, leaps atbreakneck speed into the LP chart atnumber 3, after many months on salewith nary a whisper of activity. Thecatalyst for all this activity, of course,has been the 'Fame' TV series whichthe BBC are shrewdly showing im-mediately after 'Top Of The Pops'each Thursday.

    Lower down the top 50, there isplenty of activity, with nine new en-tries and a surprising number of im-ports making an appearance; this maybe an effect of the slightly decreasednumber of domestic releases as wemove into the traditionally quiet mid -Summer period.
