Part 1 Invitation
1.1 BID CALL
.1 Offers signed under seal, executed, and dated will be received by the Owner, at the offices of the Owner located at 1395 Blair Lake Rd, Upper Nappan, Cumberland County, Nova Scotia, before 2:00 p.m. local time as designated by the reception desk clock on the 3rd day of March, 2020.
.2 Offers submitted after the above time shall be returned to the Bidder unopened.
.3 The Low Bidder to submit the Supplementary Bid information, as requested below, to the offices of the Consultant no later than 48 hours after the time for receipt of bids.
.4 Offers will be opened publicly immediately after the time of receipt of bids, at the office of the Owner.
.5 Any corrections or additions to any submitted Tender will not be accepted unless it is initialed by the person signing the Tender.
1.2 INTENT
.1 The intent of this bid call is to obtain an offer to perform work to complete Office Renovations located at 43 Main Street, Springhill, Cumberland County, Nova Scotia, for a Stipulated Price contract, in accordance with the Contract Documents.
.2 Perform the Work within the time stated in Section 01 11 00.
Part 2 Contract and Bid Documents
2.1 DEFINITIONS
.1 Contract Documents: as defined in the Contract.
.2 Bid Documents: as defined in Section 00 71 00.
.3 Bid Price: defined as the monetary sum identified by the Bidder in the Bid Form.
2.2 AVAILABILITY
.1 Bid Documents may be obtained at Acadian Printing, located at 46 Anson Avenue, Unit 7, Amherst, Nova Scotia (tel: (902)667-3556).
.2 One set of Bid Documents can be obtained by Bidders for the sum of 100$
.3 Electronic copies will be available at no cost upon request.
.4 Bid Documents are made available only for the purpose of obtaining offers for this project. Their use does not confer a license or grant for other purposes.
2.3 EXAMINATION
.1 Electronic Bid Documents will be available on the NS Procurement and MCC websites.

.2 Upon receipt of Bid Documents verify that documents are complete; notify Consultant should the documents be incomplete.
.3 Immediately notify the Consultant upon finding discrepancies or omissions in the Bid Documents.
2.4 QUERIES AND ADDENDA
.1 Direct questions in writing, by way of fax, or email to: Design Plus Architecture Inc. at [email protected] & (506) 384-3535.
.2 Addenda may be issued during the bidding period. All addenda become part of the Contract Documents. Include costs in Bid Price.
.3 Verbal answers are only binding when confirmed by written addenda.
.4 Clarifications requested by Bidders must be in writing not less than 4 Working Days before date set for receipt of bids. The reply will be in the form of an addendum, which electronic copies will be posted on the NS Procurement and MCC Web Site for Bidders no later than 2 Working Days before receipt of bids.
2.5 UNSOLICITED ALTERNATIVES DURING BIDDING
.1 Where Bid Documents stipulate a particular Product, requests to use unsolicited alternatives will not be considered by the Consultant less than 7 days before receipt of bids.
.2 When a request to use an unsolicited alternative is made, the Consultant may approve the unsolicited alternative and will issue an Addendum to known Bidders.
.3 When requesting an alternative to specified Products, include any changes required in the Work to accommodate such unsolicited alternatives. A later claim by the Bidder for an addition to the Contract Price resulting from changes in the Work necessitated by use of unsolicited alternative Products will not be considered.
.4 Product or system alternatives proposed by Bidders at the time of receipt of bids may be considered by Consultant if submitted as an attachment to the Bid Form. Unsolicited alternatives not approved in writing by the Consultant prior to the receipt of bids shall not be included in the Bid Price.
.5 Requests for unsolicited alternatives submitted with the Bid Form will be evaluated and will be either included in, or excluded from, the Contract. The Consultant will be the sole judge as to their acceptability.
.6 Provide sufficient information to enable the Consultant to determine acceptability of unsolicited alternatives. Include information identifying:
.1 Compliance with codes and standards.
.2 Compatibility with contiguous materials and systems.
.3 Product history.
.4 Corporate history.
.5 Life cycle costing.
.6 Environmental considerations.

.7 Provide complete information on required revisions to other work to accommodate each unsolicited alternative, and the dollar amount of additions to or reductions from the Bid Price, including revisions to other work.
.8 Unless requests to use unsolicited alternatives are submitted prior to, or as part of the bid submission, and subsequently accepted, provide the specified Products or assemblies.
.9 Prior approval to submit unsolicited alternatives is not required.
Part 3 Site Assessment
3.1 SITE EXAMINATION
.1 Visit the Place of the Work and surrounding area before submitting a bid.
.2 A visit to the Place of the Work has been arranged for all Bidders on March 16th, 2020 at 2:00pm local time.
.1 Meet at the main entrance lobby.
.3 Bidders visiting the Place of the Work will be required to be accompanied at all times by a representative of the Owner.
.4 The Owner will not consider any claims for additional payments during the execution of the Work for extra work or difficulties encountered resulting from conditions which were either visible or could be reasonably inferred from an examination of the Place of the Work prior to the submission of bids.
.5 Upon completion of site examination, reinstate the Place of the Work to its original condition. Pay for costs of repair to damaged Products and systems
Part 4 Bid Submission
4.1 BID INELIGIBILITY
.1 Bids that are unsigned, improperly signed or sealed, conditional, illegible, obscure, contain arithmetical errors, erasures, alterations, or irregularities of any kind may, at the discretion of the Owner, be declared informal.
.2 Bids with Bid Forms and enclosures which are improperly prepared may, at the discretion of the Owner, be declared informal.
.3 Bids based upon prices seeming to be so unbalanced as to adversely affect the interests of the Owner may, at the discretion of the Owner, be declared informal.
.4 Bids based upon an unreasonable period of time for completion of the Work may, at the discretion of the Owner, be declared informal.
4.2 SUBMISSIONS
.1 Bidders shall be solely responsible for the delivery of their bids in the manner and time prescribed.
.2 Submit one copy of the executed offer on the Bid Forms provided, signed and corporate sealed together with the required security in a closed opaque envelope, clearly identified with Bidder's name, project name and Owner's name on the outside.

.3 Insert the closed and sealed Bid Form envelope and requested bid bond in a larger opaque envelope and label this envelope as noted above.
.4 Improperly completed information, or irregularities in bid bond, may be cause not to open the bid envelope and to declare the bid informal.
4.3 BID DEPOSITORY
.1 Not used.
Part 5 Bid Enclosures and Requirements
5.1 SECURITY DEPOSIT
.1 Bids shall be accompanied by a Bid Bond in the amount amount equal to 10% of the Bid Price (excluding HST) in Canadian funds.
.2 Endorse the Bid Bond in the name of the Owner as obligee, signed and sealed by the principal (Contractor) and surety.
.3 Use Bid Bond Form CCDC 220, or a form of equal content acceptable to Owner.
.4 Include the cost of the Bid Bond in the Bid Price.
.5 The security deposit will be returned after delivery to the Owner of the required Performance and Labour and Materials Payment Bond(s) by the accepted Bidder.
.6 If no contract is awarded, all security deposits will be returned.
5.2 AGREEMENT TO BOND
.1 Submit with the Bid Form and Bid Bond a Agreement to Bond, stating that the surety providing the Bid Bond is willing to supply the Performance Bond and Labour and Material Payment Bond required.
5.3 PERFORMANCE ASSURANCE
.1 The accepted Bidder shall provide a Performance Bond and a Labour and Materials Payment Bond as described in the Supplementary Conditions.
.2 Include the cost of bonds in the Bid Price.
5.4 WORKPLACE SAFETY INSURANCE
.1 Provide a signed and dated Clearance Certificate issued by the provincial or territorial jurisdiction having authority, confirming that, at the date of the bidding, the Bidder maintains an account, and is in good standing.
.2 Provide a valid Letter of Good Standing from Construction Safety Nova Scotia or equal.
5.5 TAXES
.1 The General Conditions of the Contract specifically excludes Value Added Taxes, such as the federal government's Goods and Services Tax, from the Contract Price.

.1 The Bidder, in submitting an offer, agrees to attain Substantial Performance of the Work by the date indicated in the Contract Documents.
.2 The Owner requires that the Work be completed as quickly and expeditiously as possible.
5.7 BID FORM SIGNING
.1 Sign and seal the Bid Form prior to submission using the most appropriate of the following methods:
.1 Sole Proprietorship: signature of sole proprietor in the presence of a witness who will also sign. Insert the words "Sole Proprietor" under the signature. Affix seal if deemed necessary by local practice.
.2 Partnership: signature of all partners in the presence of a witness who will also sign. Insert the word "Partner" under each signature, and affix seal to each signature if deemed necessary by local practice.
.3 Limited Company: signature of the duly authorized signing officer(s). Insert under each signature the officer's capacity to act on behalf of the company. Affix the corporate seal. If the bid is signed by officials other than the President and Secretary of the company, or the President-Secretary-Treasurer of the company, a copy of the by-law resolution of the Board of Directors authorizing them to do so, must also be submitted with the Bid in the Bid envelope.
.4 Joint Venture: each party of the joint venture shall execute the Bid under their respective seals in a manner appropriate to such party as described above, similar to the requirements of a Partnership.
5.8 SUPPLEMENTARY BID SUBMISSION[S]
.1 The lowest Bidder will be requested to complete and submit the documents listed below at the time and place for the supplementary bid submission described in Article 1.1 - Bid Call.
.2 Supplementary Bid Submissions:
.1 Supplementary Information Form, Section 00 43 00 – Supplementary Information
.2 Verification of qualifications.
.3 Verification of superintendent's experience / resume.
.4 Workers compensation board clearance form.
.3 Failure to submit the requested documents before the designated time may result in the Bidder's bid being declared informal by the Owner.
Part 6 Offer Acceptance or Rejection
6.1 DURATION OF OFFER
.1 Bids shall remain open to acceptance and shall be irrevocable for a period of sixty (60) days after the bid closing date.

.1 The Owner reserves the right to reject any or all Bidders or to accept any bid should it be deemed to be in its best interest to do so, and to waive irregularities and omissions, if in so doing, the best interest of the Owner will be served.
.2 Bidders expressly waive any right to make any claim against the Owner for any matter arising from the Owner exercising its rights, as stated above.
.3 After acceptance by the Owner, the successful Bidder will be notified in writing.
.4 After a bid has been accepted, all rejected bids will be returned to the respective Bidders with submitted bid securities and other requested enclosures.

SAFETY CERTIFICATION
We acknowledge the requirement for Safety Certification in accordance with Section 01 35 29.06 – Health and Safety Requirements and have attached a Construction Safety Association Letter of Good Standing or approved alternative from province of work, as evidence of compliance for all projects with a tender value greater than $10,000.00. The Contractor shall maintain a Certification of Recognition (COR) Program and it shall remain in force until certificate of final completion.

(c) we have arrived at this bid without collusion with any competitor, (d) this Bid is open to acceptance by the Owner for a period of 60 working days from the
date of bid closing, and (e) all bid form supplements called for by the Bid Documents form an integral part of this
bid. (f) we include here with a Bid Bond in the amount of ten percent (10%) of the total tender
price.
