OPTION 1: The 50% Law - Not Just a CBO Concern Presenters: Kindred Murillo, Contra Costa County CCD, Roy Stutzman, Retired CBO, Contra Costa County CCD and Arnold Bray, ACCCA Advocate. This session will cover the basic Education Code and Title 5 sections and how they relate to the 50% law. Topics will include account coding, release and reassigned time, filling out the CCFS 311 (don’t wait - antici-pate), waivers and sanctions.

Presenters: Robert (Bob) Henry, Lozano Smith and Tom Henry, Education Management Assistance Corporation.

Before joining Lozano Smith, Bob Henry was the General Counsel for the Coast Community College District and the Los Angeles Com-

munity College District. He currently represents both the Sonoma County Junior College District and the Napa Valley Community College District. Tom Henry was the founding executive director of the Fiscal Crisis and Management Assistance Team (FCMAT) and is now the chief executive officer of the Education Management and Assistance Corporation (EDMAC). Tom has served as state appointed trustee for three community college districts in California.

These experts will provide a fascinating review of the essential standards of accreditation with an emphasis on the levels of sanctions available to WASC. The session will also explain the relationship between federal law (HEA) and WASC accreditation with an emphasis on due process as required by the HEA.

This panel will briefly review the provisions of of SBX2-9, legislation signed into law by the Governor in February 2009 which amended several laws that currently require cities, counties, school districts, transit districts, and other government entities to operate a labor compliance program (“LCP”) or to contract with a third party LCP to enforce prevailing wage requirements on specified bond-funded or design-build public works projects.

This session will cover the history of the compressed calendar, advan-tages and disadvantages of compressing the academic calendar, the application process for approval of a calendar change, laws and regu-lations governing academic calendars, and best practices for academic calendars—with a particular focus on the recently adopted Addendum to the Student Attendance Accounting Manual.

Presenter: Don Fraser, Redevelopment and Financial Consulting

This session will provide background information on the requirement for redevelopment agencies to make pass through payments to school districts, county offices of education and community colleges. The speaker will review the major findings from the State Controller’s audit of these payments and the resulting legislation, AB 1342. This legislation required redevelopment agencies to report the pass through payment obligations over the past five years and the actual amount of the payments that were made. A number of problems have arisen over the correct method to calculate these payments, which will also be discussed during the session.

Chris and Ed will conduct a comprehensive workshop on the apportionment process. This is a workshop designed for district fiscal staff new or relatively new to the state apportionment process. The workshop will cover the appor-tionment cycle, including all the data inputs required at each apportionment. The primary apportionment document, the Exhibit C, with special emphasis on the calculation of district growth revenue will also be reviewed.
