1 Introduction & Legal Frameworks

1.1 Background

Blacktown City Council (Council) has a diverse network of open space that covers various levels of recreation use. In total, Council manages and maintains approximately 800 reserves with a total area of approximately 1800ha of open space. The Plan of Management for Sportsgrounds (the plan) aims to provide a basis for guiding Council’s ongoing management of Sportsgrounds within the Blacktown Local Government Area in accordance with the requirements of the NSW Local Government Act 1993 (the Act). This plan addresses sportsgrounds throughout Blacktown City that fit into the broader scheme of the City’s open space network. The plan aims to serve as a key management tool that is strongly related to other strategic plans of Council such as Council’s Management Plan, as well as research obtained in preparation for Council’s Recreation and Open Space Maintenance Strategies. The 2013 Sportsgrounds Plan of Management supersedes the previous Sportsgrounds Plan of Management adopted in 2008.

What is a Plan of Management for Community Land?

A Plan of Management is a document which guides the management of particular categories or specific areas of community land that are within the direct ownership of Council, or in the control and management of Council. Plans of Management for community land may take either of two forms: • As a ‘generic’ plan covering a number of sites where the attributes and values

remain the same, or • As a ‘specific area’ plan covering a particular site where management issues

and values may be more complex and require site specific planning targets. This Plan of Management is a generic plan covering a number of sites under the category of Sportsground. The sites covered by the plan were determined based on the ability for the sportsground to be best managed using generic objectives outlined in this plan. Certain sportsgrounds have unique and complex characteristics, and as such require site specific plans of management which more accurately reflect the individual characteristics of the sportsground. (See Appendix 1 for a full list of Sportsgrounds covered in this generic plan) Plans of Management for Community Land are public documents and can be amended or reviewed at any time by Council. This Plan of Management will have a comprehensive review within five years of adoption. This Plan of Management has a role in helping the community gain a better understanding of the often complex day to day management of Councils public lands. These management processes can take the form of routine and ongoing

maintenance of parks and sportsgrounds, the design and construction of new open space and community facilities, and the management of environmentally and ecologically sensitive areas of remnant bushland, creeks and other water bodies. Finally, the plan establishes a firm outline for the long term sustainable management of the community land estate in relation to Sportsgrounds, and the delivery to the general community of Blacktown City a network of sportsgrounds that provides a valuable asset for residents to pursue an active lifestyle. Guidelines for the Categorisation of Community Land as Sportsground Under Section 36(4) of the Act, community land should be categorised as Sportsground where it is shown that the land is used or proposed to be used primarily for active recreation involving organised sports or the playing of outdoor games. As prescribed under Section 36F of the Act, all Councils are required to manage all Sportsgrounds in accordance with the following core objectives; (a) to encourage, promote and facilitate recreational pursuits in the community involving organised and informal sporting activities and games, and (b) to ensure that such activities are managed having regard to any adverse impact on nearby residences. (This Plan of Management refers to all Community Land listed in Appendix 1)

1.2 Study Process

Preparation of the plan has included a review of existing research and related issues gathered for recreation and open space planning purposes. Such research includes information regarding Council’s assessment of recreation and open space provision and issues pertaining to such provision. Members of the community were provided the opportunity to give comment on the draft Plan of Management in accordance with the NSW Local Government Act (1993). The draft Plan of Management was exhibited for 28 days with a further 14 days for receipt of comments. Comments were reviewed and analysed, and where necessary amendments made to the plan. The Values of Sportsgrounds The values associated with sportsgrounds can be described as relating to the degree of usefulness and satisfaction afforded to the community in meeting their expectations. Sportsgrounds take on the role of being significant barometers in assisting the maintenance of community health and well being in the urban context. Importantly, sportsgrounds reflect the community itself, and are generally designed and sited for the needs of the local community, planned to be within walking or cycling distance from homes and not necessarily dependent on the use of vehicles to reach, allowing access to all members of the community. Sportsgrounds act in many respects as a cultural interface between the private lives of individuals and families, and the public sporting life of the community, and add value through providing a range of facilities catering to the present day and future population of Blacktown City. Council manages a large network of public sportsgrounds covering a range of needs from junior half size playing fields, single and double playing field complexes, tennis courts, and various fields catering to the specific needs of various sporting associations, provided with infrastructure and facilities to assist and promote the public’s enjoyment of active and passive recreation. In addition to being active sporting complexes, many sportsgrounds also have a community park quality about them due to the large amount of open spaces, with the majority of sportsgrounds being equipped with playgrounds, shade and picnic shelters, pathways and tree planting to bring an aesthetic quality and assist in creating specific identities. The provision, maintenance and management of this infrastructure is crucial in sustaining value associated with this community land.

Through the development and review of this Plan of Management, several management issues were identified. These issues relate to the ongoing management of sportsgrounds and will help deliver future actions. They include;

1.4 Commonwealth Legislation Disability Discrimination Act The Commonwealth Disability Discrimination Act (DDA) 1992 - allows for individuals to lay complaints if they have been unfairly treated because of their disabilities. Under the DDA a disability is defined as:

“ (a) total or partial loss of the person’s bodily or mental functions; or (b) total or partial loss of a part of the body; or (c) the presence in the body of organisms causing disease or illness; or (d) the presence in the body of organisms capable of causing disease or illness; or (e) the malfunction, malformation or disfigurement of a part of the

person’s body; or (f) a disorder or malfunction that results in the person learning differently

from a person without the disorder or malfunction; or (g) a disorder, illness or disease that affects a person’s thought processes,

perception of reality, emotions or judgment or that results in disturbed behaviour.”

The Act promotes awareness that disability does not diminish a person’s fundamental rights within the community. Council’s aim is to make our sportsgrounds accessible through thoughtful design, including but not limited to park furnishings, public facilities, pathways and crossings. Environment Protection and Biodiversity Conservation Act The Environment Protection and Biodiversity Conservation Act 1999 seeks to provide for the protection of the environment, especially parts of national environmental significance. As well as promoting the conservation of biodiversity and ecologically sustainable development through the conservation and the ecologically sustainable use of natural resources. (This review has identified this legislation as relevant to this Plan).

1.5 State Government Legislation

Local Government Act

The NSW Local Government Act (1993) provides the legislative framework for Council’s day to day operations. The Act identifies a Council’s responsibility to actively manage land and to involve the community in developing a strategy for management. The NSW Local Government Act (1993) requires all community lands to be covered by a Plan of Management that must identify: • the category of the land (refer Section 3.1). • objectives and outcomes for the land (refer Section 3.2-3.6). • the means by which Council proposes to achieve objectives and outcomes

(refer Section 4.0). • the way by which Council proposes to assess its performance (refer Section

5.0). • expressly authorise any leases, licences or other estates.

The nature and use of community land may not change without an adopted Plan of Management.

Local Government Regulation

All Council property classified as Community Land is required to be categorised in accordance with the guidelines for categorisation listed in the NSW Local Government (General) Regulation (Part 4, Division 1).

Crown Lands Act 1989 Five sportsgrounds covered in this plan are located on Crown land and can be viewed at Appendix 2. Therefore, their management is subject to provisions in the Crown Lands Act 1989, which is administered by the Department of Lands. The Objects of this Act (Section 10) are to ‘ensure that Crown land is managed for the benefit of the people of New South Wales’ and in particular to provide for:

(a) a proper assessment of Crown land, (b) the management of Crown land having regard to the principles of Crown land management contained in this Act, (c) the proper development and conservation of Crown land having regard to those principles, (d) the regulation of the conditions under which Crown land is permitted to be occupied, used, sold, leased, licensed or otherwise dealt with, (e) the reservation or dedication of Crown land for public purposes and the management and use of the reserved or dedicated land, and (f) the collection, recording and dissemination of information in relation to Crown land. The Department of Lands management philosophy directly relates to the Principles of Crown land management which is listed in Section 11 of the Crown Lands Act 1989. These principles affect and control all aspects of the Department of Lands activities including the management of Crown lands for public recreation purposes. The principals are:

(a) that environmental protection principles be observed in relation to the management and administration of Crown land, (b) that the natural resources of Crown land (including water, soil, flora, fauna and scenic quality) be conserved wherever possible, (c) that public use and enjoyment of appropriate Crown land be encouraged, (d) that, where appropriate, multiple use of Crown land be encouraged, (e) that, where appropriate, Crown land should be used and managed in such a way that both the land and its resources are sustained in perpetuity, and (f) that Crown land be occupied, used, sold, leased, licensed or otherwise dealt with in the best interests of the State consistent with the above principles. This Plan of Management applies to both Community Lands owned by Council and managed under the Local Government Act (1993), and Crown land owned by the Department of Lands and managed under the Crown Lands Act (1989).

NSW Anti-Discrimination Act The NSW Anti-Discrimination Act 1977 makes it unlawful to discriminate on the grounds of race, sex, disability, age, sexual orientation, age and on other grounds in certain circumstances. The act promotes equality of opportunity for all people. National Parks and Wild Life Act 1974 The National Parks and Wild Life Act 1974 covers the establishment, preservation and management of national parks, historic sites and Aboriginal relics throughout NSW as well as the protection of native flora and fauna. Threatened Species Conservation Act 1995 The Threatened Species Conservation Act 1995 (TSC Act) provides for the protection of all threatened plants and animals native to NSW and their habitats (including endangered populations and ecological communities, and their habitats). The TSC Act provides for the listing of species, populations and ecological communities considered to be threatened in NSW. Schedule 1 of the TSC Act contains listings of endangered species, populations and ecological communities, and schedule 2 of the TSC Act contains listings of vulnerable species. This Act requires the preparation of Recovery Plans or Priority Action Statements for listed threatened species, populations and endangered ecological communities, and Threat Abatement Plans for listed Key Threatening Processes (Schedule 3). Public authorities, such as Council, cannot make decisions which are inconsistent with the provisions of these Plans. State Environmental Planning Policy (SEPP Infrastructure) 2007 The SEPP (Infrastructure) 2007 aims to effective “delivery of infrastructure across the State by:

a. Improving regulatory certainty and efficiency through a consistent planning regime for infrastructure and the provision of services; and

b. Providing greater flexibility in the location of infrastructure and service facilities; and

c. Allowing for the efficient development, redevelopment or disposal of surplus government owned land; and

d. Identifying the environmental assessment category into which different types of infrastructure and services development fall (including identifying certain development of minimal environmental impact as exempt development); and

e. Identifying matters to be considered in the assessment of development adjacent to particular types of infrastructure development; and

f. Providing for consultation with relevant public authorities about certain development during the assessment process or prior to development commencing.”

This SEPP takes precedents over Councils LEP 1988 Amended (and BLEP 2013 when in force), where conflicts arise between the requirements of the two documents.

Tobacco Legislation Amendment Bill 2012. This Bill commenced on 7 January 2013 and the objects of this Bill are as follows: (a) to amend the Smoke-free Environment Act 2000 to extend the prohibition on smoking in enclosed public places. So that from 7 January 2013 smoking will be prohibited in part, in the following outdoor public places:

(i) within 10 metres of children’s play equipment; (ii) a swimming pool complex; (iii) a spectator area at a sports ground or other recreational area being used

for an organised sporting event.

1.6 Local Planning Context

Blacktown Local Environment Plan The existing zoning for the sportsgrounds in Blacktown City Council’s Local Environmental Plan (LEP), 1988, is zone 6(a) Existing and Proposed recreation. The objectives of the 6(a) zoning applying to sportsgrounds in Council’s ownership or control are to: Provide public open space to meet the existing and future recreation

and leisure needs of residents. Provide opportunities to enhance the environmental quality of the City

of Blacktown. Identify land that is required for future open space purposes.

Council is currently in the process of preparing a new Comprehensive LEP to reflect the NSW Government’s Standard Instrument (Local Environment Plans) Order 2006 (standard instrument). The new LEP is based on standard zones, definitions and provisions that are consistent across NSW. The new comprehensive LEP, when in force, will replace Blacktown’s LEP 1988 Under the proposed draft Comprehensive LEP 2013 a significant portion of land currently zoned 6(a) Existing and Proposed Recreation in this Plan of Management will be zoned as RE1 Public Recreation. The objectives of the RE1 zone are: To enable land to be used for public open space or recreational

purposes. To provide a range of recreational settings and activities and

compatible land uses. To protect and enhance the natural environment for recreational

purposes.

Council’s corporate goals

Blacktown City Council’s Vision Statement underpins our strategic direction and influences all actions we take in providing the best possible living and working environment for our community. Council’s Vision Statement is as follows: VISION STATEMENT “A City of Excellence – Diverse, Dynamic, Progressive.” Blacktown City 2030- Delivering the Vision Together Blacktown City 2030 provides a strategic framework for Blacktown City Council to operate within over the next 17 years and beyond. A series of Strategies and Trigger Projects have been developed to ensure that Blacktown City 2030 becomes a reality. One strategy most relevant to sport, recreation and open space is;

• A Sporting and Active City-

To establish Blacktown City as the recognised sporting capital of Western Sydney through the development of world standard sporting venues and events and by promoting community participation in local sports as part of having a ‘Blacktown healthy lifestyle’.

Council's Delivery Program identifies the goals that Council has committed to delivering to the community over the next four years and supports delivery of Blacktown City 2030. It has six strategy areas that cover aspects of our City and what Council wants to achieve as part of its long term vision.

The Operational Plan is a one year Plan that outlines the specific actions to be undertaken in a financial year in order for Council to achieve the goals identified in the Delivery Program. Council's annual budget is included in the Operational Plan. The Plan has a series of measures that will be used to monitor Council's progress towards achieving Blacktown City 2030.

Recreation and Open Space Strategy

Council’s Recreation and Open Strategy 2009 (ROSS) provides a vision that;

“Blacktown offers residents and visitors with every opportunity to pursue vibrant, healthy and family-oriented lifestyles all year round. Open space, leisure and recreational facilities and services are renowned for being safe, appealing, accessible and diverse in nature. They are underpinned by a rich, unique and varied environment for recreation, sport, leisure and a range of passive pastimes”.

The ‘ROSS’ is arranged around the following six priorities reflecting the long term achievement of key strategies in the Blacktown City 2025 – Delivering the Vision Together document:

• Sport.

• Informal Recreation.

• Aquatic and Indoor Facilities.

The directions for sport include:

• The provision and development of sportsgrounds within a hierarchy.e provision of key facilitie organised activities.

Blacktown Community Demographics - Summary General Demographics • In 2012, Blacktown City had a population of 312,479, (49.7 % males, and

50.3% females). • Blacktown City has a very young population with 28.1% of the population aged

between 0-17 years. • Blacktown City’s population was of middle-class background, with a high

representation in middle-ranged weekly incomes, relatively high post-school qualification achievements, a high proportion of dwellings being purchased, and high accessibility to private vehicles.

• Population growth is expected to continue in Blacktown, particularly from new housing estates that are soon to be developed in the North West release areas.

Sporting Users • Participation in organised sports is highest in Soccer and Netball with these

sports being more heavily participated in comparison to national statistics. • Organised sport participation in Blacktown City is significantly higher in males

compared to females, which is in line with state & national trends. • Participation in non-competitive recreation is highest in activities such as tennis,

swimming and golf similar to NSW & Australian trends. • Research undertaken in relation to Recreation Planning suggests that provision

of passive recreation facilities is as important as active recreation facilities. • With the increased growth in population and climatic changes coupled with

continued interest in physically active lifestyles, demand for sportsgrounds is predicted to increase in the future.

2 Site Scope & Description

2.1 Application of this Plan

This plan applies to a number of sites under the category of Sportsground throughout the Blacktown Local Government Area. All Councils in New South Wales are required under the Local Government Act (1993) to establish a register of all land in their ownership. Under the Act, all Councils must classify the land according to its function within the longer term strategic plan of Council. (See Appendix 1 for a full list of Sportsgrounds covered in this generic plan) 2.2 Description of Sportsgrounds In order to best develop and manage the variety of different sportsgrounds across the vast area of Blacktown, a hierarchical approach is required. This approach needs to fit within a wider strategic framework of recreation and open space planning. As endorsed by Council sportsgrounds are provided within a hierarchical framework which provides the structure for service level across the sporting landscape within Blacktown. The following reserves listed in Appendix 1 are currently in the planning or construction phase of development and will in the near future be transferred to Council for care, control and management:

• Reserve 710 – Waite Reserve, Acacia Gardens. • Reserve 791 – Cornucopia Reserve, Glenwood. • Reserve 797 – Stanhope/Sentry Drive, Parklea. • Reserve 815 – Jonas Bradley Park, The Ponds. • Reserve 822 – Peel Reserve, The Ponds. • Reserve 936 – Village Oval, Ropes Crossing.

Some unique sportsgrounds that require special consideration will be covered within this generic plan of management until such time that site specific plans of management are developed. The following sports grounds have individual PoMs with objectives, strategies and actions that are linked to this generic PoM:

• Reserve 218 – Tregear Reserve Plan of Management 2007. • Reserve 163 – Whalan Reserve Plan of Management 2008.

Whilst the individual Plans of Management are consistent with this generic Plan of Management, the recommendations and action plans for the individual Plan of Management would take precedence over the generic Plan of Management.

3 Basis for Management

3.1 Core Management Objectives

The NSW Local Government Act 1993 requires that all Council property classified as community land be categorised in accordance with the guidelines for the categorisation listed in the Local Government (General) Regulation. The Local Government Act outlines a number of core objectives for management related to each category, which are listed for the applicable category of sportsground as tabled below: Category Core Objectives Sportsground • to encourage, promote and facilitate recreational pursuits in

the community involving organised and informal sporting activities and games, and

• to ensure that such activities are managed having regard to any adverse impact on nearby residences.

3.2 Community Values / Community Consultation Findings

The consultation undertaken in preparation of the Recreation and Open Space Strategy helped form the community values and findings as summarised below;

• The need to better cater for older children and young people. • The need to establish and enhance multi-functional space. • The need to improve access and equity of sportsgrounds. • Address vandalism and create safe, appealing areas. • The need to increase the quality of open space, including the quality and

maintenance and cleanliness of reserves.

3.3 Community’s Desired Outcomes

From these findings, the following community outcomes have been outlined for sportsgrounds;

• Improve the quality and function of sportsgrounds within an appropriate hierarchy of provision (recognising there will be different standards).

• Establish some significant and higher standard sporting facilities, with an equitable spread across the Blacktown City.

• Support the ongoing development of sport and encourage participation in sport across Blacktown City.

• The need to assist sporting groups to deal with issues relating to declining player and volunteer numbers and increase cost of insurance.

3.4 Vision Statement

Blacktown City will offer a diverse, yet hierarchical network of sportsgrounds to provide opportunities for people of different ages, cultural and social backgrounds to gain benefits from sportsgrounds through community interaction and physical activity. Sportsgrounds will be appealing, safe, and accessible.

3.5 Role of the Sportsground

Formal structured facilities for organised individual and group sporting activities form a strong backbone in the local community creating and providing opportunities for a wide range of sports. Council supports a vital sporting community operating at local and regional levels, comprising membership from all sections of the community and the diverse cultural backgrounds represented across the community. The role that sportsgrounds have in the modern urban landscape is many and varied, as diverse as the communities they are provided for. They are planned and designed to contribute effectively to the needs of the adults and children who use them, through the provision of formal facilities for people of all ages, abilities and backgrounds. Dual Purpose of Sportsgrounds Council recognises that some sportsgrounds throughout Blacktown serve a dual recreation and drainage function and this function must be monitored closely so as to maintain the integrity of the values associated with these assets.

3.6 Aims and Objectives

The implementation of sound and effective management practices for Sportsgrounds within Blacktown City is a high priority of Council. Council recognises the values and benefits of local sportsgrounds to the community in terms of developing and providing appropriate recreational opportunities. Sportsgrounds provide benefits in terms of allowing the development of organised active recreation and sporting facilities to meet a range of needs for all members of the community. This Plan of Management creates a framework for the management of Sportsgrounds in accordance with the NSW Local Government Act, 1993. The objectives of this Plan of Management are to:

• Assist in the development of pro-active land management strategies and policies for sportsgrounds within Council’s operational structure.

4 Management Issues and Action Plans

4.1 Management Issues

Five broad issues of management concern are addressed in this Plan of Management: 4.1.1. Provision and Access

• Reliable physical access to sportsgrounds at all times of the year ensuring usability and community satisfaction.

• Equal access to sportsgrounds for all members of the community regardless of ability, age, gender and race is recognised as being vital to the proper provision of facilities.

• Location, walking, distances, linkages and proximity to other precincts such as shops, schools, transport and community centres are important considerations in providing sportsgrounds that meet the expectation of the community through a strategic link with other community infrastructure.

• Sportsgrounds should be located so that at least two boundaries address a public street.

• Issues of car parking and traffic congestion on local streets often cause concern to users and local residents. Off street car parking facilities for users of the ground needs to be considered in terms of proposed uses and patronage. Overflow parking areas must also be considered.

• The provision of sportsgrounds that are not only multi-purpose but also allow for maximum compatibility in usage in that the land can be used by multiple users to an optimal sporting capacity with minimal conflict between users of the sportsground.

• Pathways are designed to facilitate movement through the park and where provided, are constructed of resilient hard wearing materials, generally in accordance with Australian Standards for accessibility, allowing the use of wheelchairs, prams, strollers and providing easier access for the elderly or infirm.

• Gateways are provided at key entry locations and are to be designed to facilitate the unobstructed access to the park for wheelchairs, prams, etc, but prevent access to cars and motorcycles.

• Ensure adequate provision of sportsgrounds across the local government area with an equitable spread of differing levels of sportsgrounds where warranted.

• Provision of sportsgrounds should meet the demands of the community whilst providing flexibility and adaptability to change in future trends.

• Philosophy of developing and upgrading multi-purpose sportsgrounds that can be used on a year round basis.

• Access onto grounds must be available for emergency, maintenance and security vehicles with suitable barriers erected to discourage inappropriate vehicular access.

4.1.2. Environmental Quality and Sustainability

• Attention to susceptibility of flooding and erosion due to dual drainage purpose of many sportsgrounds within Blacktown City.

• Provision for closure of fields after peak seasons to allow for renovation, regeneration and revegetation where required.

• Adequate car parking to diminish the need to park on grassed areas and residential streets.

• Enhance aesthetic quality and provision of shading of sportsgrounds through adequate planting.

• Consider the issue of salinity that impacts the Western Sydney area when planning for the provision and management of sportsgrounds.

• Use of relevant management strategies to assist the long-term sustainability of sportsgrounds.

• Management of Council resources to monitor, assess and inform staff and stakeholder of environmental quality issues and opportunities.

4.1.3. Management & Maintenance

• Manage and maintain the health and quality of landscape elements and infrastructure through the utilisation of a hierarchical approach to the management of sportsgrounds.

• Manage groundcovers and turf through regular mowing and maintenance cycles.

• Manage and maintain hard, soft and artificial playing surfaces. • Manage and maintain Council provided sporting infrastructure. • Regularly inspect and report on facility and infrastructure conditions. • Maintain park facilities and associated facilities including pathways, seating,

of Management. • Consult with stakeholders to gain a better understanding of the issues facing

sportsgrounds and the opportunities available to improve the use, management and maintenance of specified sportsgrounds.

4.1.4. Community Interaction and Engagement

• Active engagement of Park Committees that assist in the operation and administration of many established sportsgrounds within Blacktown and provide a link between users and Council.

• Park Committees function by liaising with Council officers and providing feedback from the local community regarding the management of sportsgrounds.

• Allow for community consultation to be undertaken in the preparation of sportsground design.

• Allow for community interaction in the development of public artworks as interpretive elements for temporary or permanent installation in the surrounds of the sportsgrounds.

• Protection of property and privacy needs to be considered with provision for traffic management on the affected area.

• Raising awareness of the benefits of sport and recreation and as such increasing the understanding of location and use of sportsgrounds throughout Blacktown.

• Promote a culture of respect and accountability amongst all stakeholders of sportsgrounds.

• Establish and maintain good relationships with adjoining land owners and occupiers, and sportsground users, either directly or through the relevant committees.

4.1.5. Leases & Licences

• Leases and licences on sportsgrounds will be considered by Council, subject to conditions.

• Leases and licenses are to be in accordance with the conditions listed in the NSW Local Government Act, 1993 and Council’s Policies.

• Leases and licences on sportsgrounds are to be consistent with the core objectives for sportsgrounds.

• Existing and new lease / licence agreements offer enhancement of sportsground use and amenity and social / cultural equity.

• New lease / licences do not detract from sportsground character or use or unduly impact on adjoining uses.

• Existing easements are maintained without undue impact on the sportsground function.

• Leases and licences to be assessed by Council with consideration of conflict reduction between stakeholders.

• Leases and licenses should provide the ability to balance the ‘here and now’ as well as the anticipated use, plans and trends of sportsgrounds in the immediate future.

5 Implementation and Review

5.1 Future Use and Development

Sportsgrounds will continue to provide a resource that encourages, promotes and facilitates recreational pursuits in the community. Any current and / or planned development and activities should be managed with regard to any adverse impacts on neighbouring residents as well as taking into consideration the dual drainage purpose that many sportsgrounds have. It is envisaged that as this Plan of Management is implemented, sportsgrounds throughout Blacktown will continue to see increased use for active and informal sporting activities due to improved management. This in turn will lead to enhancing the health and wellbeing of the community.

5.2 Leases and Licenses

The NSW Local Government Act, 1993, allows Council to grant leases, licences and other estates over all or part of community land. Leases and licences are a method of formalising the use of land and facilities. Leases and licences can be held by groups such as community organisations and schools, and by commercial organisations or individuals providing facilities and/or services for profit. A lease will be typically required where exclusive use or control of all or part of a sportsground is desirable for effective management. A lease may also be required due to the scale of investment in facilities, the necessity for security measures, or where the relationship between a major user and facilities in the sportsground justifies such security of tenure. Licences allow multiple and non-exclusive use of an area. A licence may be required where intermittent or short-term use or control of all or part of the sportsground is proposed. A number of licences for different users can apply to the same area at the same time, provided there is no conflict of interest. The definition of "estate", under Section 21 of the Interpretation Act, 1987, includes other rights over land, such as easements, including "interest, charge, right, title, claim, demand, lien and encumbrance, whether at law or in equity". This Plan of Management expressly authorises the lease, licence or grant of any other estate over all of the sportsgrounds, the land and any buildings located on the land specified, for community purposes for a term not exceeding five years. The purposes must be consistent with the core objectives of the land (listed in 4.1.5 of this report) and legislative requirements (Local Government Act, 1993 – as amended 1999).

Council can support leases or licences on community land for periods exceeding five years, the maximum period under the Local Government Act 1993 is 30 years

(including any period for which the lease or licence could be renewed by the exercise of an option) for purposes consistent with the categorisation and core objectives of the particular area of community land. Community land may only be leased or licensed for a period of more than five years if public notice is given according to the requirements of Sections 47 and 47A of the Local Government Act 1993.

If an objection to the proposal is made, Council may not grant a lease, licence or other estate without the consent of the Minister of Local Government.

This Plan of Management expressly authorises the leases or licences for periods exceeding five years, but not longer than 30 years as per the Local Government Act 1993.

New leases over five years must be tendered unless to a non-profit organisation.

5.3 Implementation

Recommendations in this Plan of Management are to be implemented in order of priorities established in the action plan (Section 4.2) over the next 5 to 10 years.

5.4 Review

This five year interim review of the Plan of Management is in line with requirements of the NSW Local Government Act, 1993 and Regulations. This Plan of Management will have a comprehensive review within five years of adoption. It is envisaged that within this timeframe, certain sportsgrounds will have site specific Plans of Management developed due to unique considerations. These plans will outline specific action plans not outlined in this Plan of Management for that corresponding sportsground. This Plan of Management for community land, when adopted will revoke any existing generic Sportsground Plan of Management.
